Issues getting business GL policy Posted: 04 Dec 2019 09:53 PM PST I previously owned an automotive repair company for 2 years and had a General Liability policy for 1mil/1mil through Erie. In that time I had no claims and was paying roughly $1000 per year. Last month I dissolved my sole member LLC and formed a new LLC as a partnership. This new company is very similar to my old company aside from the fact that we are focusing more on heavy equipment, agricultural equipment, and fleet vehicles (which I was insured for before) and my tool/equipment value has increased about $50,000. I had a falling out with the agency who sold me the policy due to the fact that they refused to do anything when I sold a personal vehicle and had to remove coverage on it- they let my get charged two months of premiums on it before I finally called the carrier directly and cancelled myself. Therefore, I am not getting my policy written through them. About a month before this I began reaching out to agencies trying to get quoted. Only one actually followed up with me. I spent the entire month going back and forth with them, supplying information etc. Finally, at the last minute- literally the day we were supposed to start work, the agent got me a quote for $300,000 in coverage for $3400 per year through a carrier I had never heard of. After reviewing the binder I found that they didn't even get most of what we do covered and had coverage for totally unrelated things. I asked her to make the changes I needed and told her that the premium seemed way too high. I didn't hear anything for about 10 days after that, when she finally called and said she couldn't find a company to write the policy I need. So I took my business elsewhere. So I found another agency in my town around the middle of november, told the agent what I had been through, and he seemed really confident that he could help me. I gave him all the info etc. About a week goes by and he calls me and asks a few more questions that the underwriters wanted. I wait through the thanksgiving holiday until yesterday, giving him now a total of 12 business days working on this. I went in and he still had no answers for me. It just feels like no carriers even want to insure my type of business. I had no idea that this insurance would be such an issue. This company is my only income, and not having GL is a huge risk in my line of work. I can't even seek work with bigger clients right now because of it. What, if anything, can I do to expedite this process? Is there some chance I can just bypass an agency completely and get a policy written by going direct to the carrier? [link] [comments] |

(TX) Posted: 04 Dec 2019 05:32 PM PST Was in traffic on the highway and at a standstill when a semi in the adjacent lane bumped me at low speed causing significant cosmetic damage on the side of my car. They did not stop but I got the license plate off the back of the load and the trucking company name from the cab door. Filed a police report and a claim with USAA. USAA said at first that it's being opened as a collision claim but may be changed to uninsured motorist since it was hit-and-run. But it's moving slowly and I don't know how long it will take to find out. What should I expect and what are the different factors at play in how this is handled? I've read online that hit-and-run is generally treated as UM, but have also separately read that that's only if the driver is identified but uninsured and that otherwise it's just a standard collision claim. Posted: 04 Dec 2019 09:22 AM PST My wife, my son and I live south of Pittsburgh. On Monday I was moving things out of my storage locker into a 26 foot uhaul. The corners around each of the buildings were tight but I did most of them without any difficulty. near the end I turned a corner and thought I had more room than I did and ended up hitting the corner of the building. I damaged the downspot, some of the gutter and the two walls. The damage didn't seem very extensive, but I've never been in a situation like this and quite frankly I have been worrying myself sick. I have only had accident and it was nearly 10 years ago. I have a clean driving record and I had insurance on the uhaul but the uhaul wasn't damaged because I was only going 3-5 mph. There was cosmetic scratching but nothing structurally. I have been in correspondence with the storage facility owner and she estimates it will be 1000-4000 dollars. I was hoping to find some advice about how to proceed. She has been very understanding and said she is going to try to get it done as cheaply as possible for me, but I am still worried she is going to make me pay up front or for all of it at once. Is the increase going to be astronomically high? Or is there a chance that it will not be too bad? Assume no prior accidents or tickets, licensed for almost two years. Guidance needed on an RMIS assignment! Posted: 04 Dec 2019 10:55 PM PST Howdy everyone! I am a current RMIS student and I am having difficulty with this assigned case. We utilize the CG 00 01 04 13 CGL Policy for our cases. I am leaning towards the pollution exclusion (1).(a).(iii) however I cannot think of a defense the Insurer would utilize to combat this exception to the exclusion. Any help is greatly appreciated! Thank you In January 2019, the Autry Farms ("Autry") contracted with Industrial Herbicides, Inc. ("IBI") to treat a crop of potatoes to prevent sprouting. Sprouting makes the potatoes less desirable to a consumer, hence less valuable. The potatoes were stored in a storage facility. Autry had a property insurance policy which insured against the risk of loss or damage to the storage facility and the stored potatoes issued by Idaho Northern Insurance Corporation. IBI treated the stored crop of potatoes by spraying them with a sprout-inhibiting chemical. A fire broke out while IVI was spraying the potatoes, damaging the storage facility and the stored crop of potatoes. The fire was caused by flammable fumes emitted by the chemical brought to the facility by IBI. Idaho Northern paid $150,000 to Autry to settle the claim for the damage to the potatoes caused by the fire. Idaho Northern then filed suit against IBI to recover the $150,000 it paid to Autry. Idaho Northern alleged the fire was caused by IBI's negligence in the way and manner in which IBI stored the chemical at Autry's storage facility. Wilmette Casualty Co. issued a CGL policy to IBI that was in effect on the day the fire happened. IBI tendered the lawsuit to Wilmette and demanded a defense. Wilmette reviewed the lawsuit and the policy. Wilmette informed IBI that the claim asserted against it by Idaho Northern in the lawsuit was not covered by the CGL. IBI then sued Wilmette for breach of contract for refusing to defend and indemnify it.

Posted: 04 Dec 2019 11:20 AM PST If I am driving my own vehicle that I have insured through X company and I rear end another vehicle, I will be at fault and my insurance will pay for the other vehicle and driver. But what if the passengers with me are injured. Let's say it's my wife, cousin, and another friend who I have no relation with. From what I understand, my medpay will pay for anyone in my car but what about my bodily injury? Also, isn't there a difference for how it will work if they are family vs non family? My mom was in an accident and got served Posted: 04 Dec 2019 06:29 PM PST So, as the title says, my mom got in an accident and was recently served a court summons and I'd like opinions. I have my P&C license (got it 3 months ago so be kind, I'm still learning) so i know no one can tell me exactly what is going to happen but I am curious to see what peoples opinions are. Relevant information: we are located in NYS. My mom drives a bus for the ARC of our county and was driving this vehicle during the accident. The vehicle is a 14 passenger medium sized white bus. Vehicle 2 was a Nissan Altima driven by a boyfriend of Geico's insured, only him in the vehicle. The accident: my mom gets like a 2 hour break or something like that during the day when all of her riders are doing their thing. Sometimes she grocery shops, goes home and naps, basically does whatever since she's allowed to. This day (March 2019) she decided to go home for a bit. She was backing into our driveway in a residential area like she always does, and got stuck in the snow. She was pulling forward and backing in again to get past the mound of snow the town plow put in front of her driveway. She states that at this point she had done it a couple times when she noticed vehicle 2 started coming down the road. She was still stuck and trying to back into the drive way and I'm not sure what he was doing. She says he didn't brake until 2 houses before hers but I'm not sure how accurately she could know that if she was supposedly still trying to back into the driveway. She did say she braced for impact so she saw him coming at some point. Regardless, he couldn't stop his vehicle and slid into the front end of the bus. According to her, there was no room for him to have gone around her at any point and given the distance between them she would not have been backed in enough for him to have not had to at least slow down even if she she wasn't stuck. I can understand the not going around her since residential roads get narrow in the winter and it was a big bus she was try to back up. When the cops showed up they told my mom it was her fault because she was blocking the road. Yes, I told her cops don't determine fault. I am unsure if she got a ticket or not. Now, the ARC does not believe my mom is at fault and is not accepting liability so they are being sued along with my mother. I have the summons and it has both the ARC and my mom listed and Geico's insured (not the driver, his name is not on these papers at all) for just under 7k property damage. [CA] Posted: 04 Dec 2019 06:22 PM PST This is in California A couple weeks ago, a dude rear ended me coming off the freeway when I stopped to yield to oncoming traffic. Minor damage to my rear bumper (2013 Hyundai Accent, the hatchback version), there's a crack and some scuffs to my bumper cover. I was twisted to check traffic when he hit me, so I had a little bit of pain that I was a bit paranoid about and went to urgent care for the next day, and they recommended I get a couple deep tissue massages over the next month for muscle spasms, rather than rx muscle relaxants. Ok fine. I don't intend to fix my bumper, but I would like the massages covered... I didn't actually talk with the adjuster - I gave my side when I called in to file the claim in the first place, the adjuster had left me a voicemail that he'd be speaking with his insured later and to call him back and provide pictures of the damage, which I did thru their online portal. I didn't hear anything back with the holiday and being out of town and didn't get to follow up. Came back to find a check in the mail for $467.24. My questions are:

Missed flight due to car accident Posted: 04 Dec 2019 05:55 PM PST Was rear ended last month and Geico (the insurance of the fella who hit me) was pretty transparent about the ole "let's try to ignore this claim until they give up" strategy..... regardless, when I was rear ended I was on my way to the airport, missed my flight and had to rebook on another airline which was quite the expense.... What recourse do I have here? It's a $1000 loss which is in that weird zone of too little to sue over but enough where I want to pursue it. Any suggestions? [link] [comments] |

Posted: 04 Dec 2019 01:27 PM PST I was recently told my persistent back pain is being caused by bone spurs on my lower spine and scoliosis. I've never had these type of problems before and I'm still awaiting a treatment plan. I make barely enough to survive with my current job, so I am using "Free Care" that I received from University Medical Center in New Orleans, where I live. My free care is valid through the end of April, but open enrollment is now and I am eligible for a large discount due to my finances. I can get a silver plan with $1000 deductible for around $100/mo, however my partner is about to start receiving union benefits through his job in the next few months. We've lived together long enough for me to be added to his insurance, but I won't know how much extra it will cost him until he's joined the union. Since money is a big issue for me, I'm not sure if it's smartest to stay with Free Care until his insurance comes through, or if I should buy my own insurance, which will negate my Free Care, or just continue with the Free Care as long as possible. Adjuster is asking for photos of car damage Posted: 04 Dec 2019 02:54 PM PST Someone rear ended me a couple of days ago and I filed a claim with the other driver's insurance company. The adjuster called me today to get my statement and asked that I send him photos of the damage. I have not taken my car into a body shop for an estimate yet. It's not a normal rental as I will still cover mortgage/taxes/insurance, and they will cover everything else (maintenance, utilities, etc). I'm not sure of the proper type of insurance to get.

Went to Allstate arena for a concert and leaving the parking lot a car merging into my lane, hit me on my drivers side passenger door. He immediately switched back to his lane and kept going. I got a picture of his plates as well as description of him. Me and my wife filed a police report and haven't heard anything. Accident was minor, but there was medical involved, one visit. They are requesting release form of data (not release of medical I believe, that might come later). Is it safe to sign? I have a bill and everything, but they want all data so medicare can release how much they paid. Here is the intro letter. I do not have a lawyer. We are not looking to make this a huge long case as we have 2 other cases we are dealing with, as it was very very minor. It's been a very bad year. Thank you. My car is still not repaired and there is no ETA on when it will be finished. My 30 day rental coverage has run out so now I'm paying out of pocket and I'm pissed. I carry UMPD which is the law in NH. Can I file a UMPD claim for loss of use to get my rental expenses reimbursed under my UMPD coverage? They have an extended network through the PHCS Multiplan. Though my PCP's office is listed as participating with the PCHS Multiplan on their website's insurance list, I don't see my PCP herself on the Multiplan's provider search list for the specific plan. (One provider at this office surprisingly is, but she isn't.) Suppose she definitely doesn't par with the Multiplan. I have Medicaid as my secondary insurance. I live in New York. She pars with Medicaid. Does Medicaid generally pick up at least some of the cost if you go to a provider that's not in-network with your primary insurance? Not at fault car accident my car totaled Posted: 04 Dec 2019 11:35 AM PST In Ohio, I was in the center lane of a 3 lane highway. A car on the entrance ramp freeway lost control, crossed a grass median, entered the freeway perpendicular to traffic and straightened out right in front of me. I hit the brakes but could not stop in time and slammed into the cars rear end. The other driver was cited and admitted fault to me at the scene. My car is totaled. My insurance company valued my car at around 300 less than what I owe. I have not heard from the other drivers insurance company, accident was a week ago. What are my options so I don't end up with owing on a car that was totaled and I will no longer own? Should/can I negotiate with my claims adjuster? Should I use her insurance? The milage is at 194K and it's a 2007. I'm thinking of keeping my car and taking the balance. The reason for that is because I'm not in a comfortable financial place to buy another car. Based on my research and the offer the insurance gave me, I'm not getting a bad pay off whether I keep my car or hand it over to my insurance. I got the car in great condition and I've been great at keeping up with maintenance. It will need new tires soon. Since I'm thinking of keeping my car, I'll be changing my policy to just liability and restricting my drive time after this. I'm planning to keep the money in my savings and building up on it so as to have a better down payment down the road. Am I going wrong about this? Is this an ok plan? Thanks in advance! Obtaining media liability insurance Posted: 04 Dec 2019 10:57 AM PST I am the sole member-manager of an LLC that owns and operates a YouTube channel which publishes video news. The company earns a significant amount of money and has substantial assets. From what I have understand, obtaining media liability insurance would be a good business decision. I know what I am generally looking for in a policy, but not having purchased commercial insurance before I don't know where to start in actually getting a policy. There are a handful of insurers who advertise offering media liability coverage — Hiscox, The Hartford, Chubb, Axis, Apogee, Burns & Wilcox — but they seem to be geared toward much larger companies. (For example, by having only a single contact listed. I sure as hell can't pay a significant part of that guy's salary!) How should I approach this? Is it generally a better idea to purchase through an agent vs. directly from the underwriter? One would think that going straight to the source would be less expensive, but again, I have no experience with this and I don't want to walk into something that's out of my league. Posted: 04 Dec 2019 06:33 AM PST I totaled my car two weeks ago, two days before then got in a small accident..lady hit me. $2,500 in damages. $1,000 from my deductible was taken out (even though it wasn't my fault, my insurance is subrogating ladies insurance to get that $1k back) so $1,500 was sent to my lein holder. Second accident (where I totaled it) was my fault. Insurance payed out $7k but took out 1k deductible so payed out 6k, my loan is 9k. I have gap coverage so that will cover the rest..will the 1k that my insurance is trying to get back from the FIRST accident get sent to ME or my LEIN holder? I'm also thinking about paying off the remaining $1.5k on my loan BEFORE gap covers it and AFTER both checks are sent out to my lein holder.. because I know gap can take up to a month and I can't get another car loan until this one is payed off so I know in that case they would prob have to send the 1k to me, but I'm wondering if the loan isn't payed off..I'd that 1k is going to me or my loan..so my question is will that $1k that my insurance is trying to subrogate from the other parties insurance from first accident get sent to ME or my LEIN holder?
