Neighbor threatens lawsuit over act of God damages

    Posted: 07 Nov 2019 04:26 AM PST

There was a tornado in my area and a branch of the tree in my yard fell onto my neighbor's carport and damaged it. The incident happened 2 days after we closed on the house and we moved in the day it happened so we had no knowledge of the condition of the tree. He got a hold of my homeowner's insurance somehow and made a claim for damage.

The desk adjuster of my insurance looked at the inspection report and the pictures I sent her and decided it's an act of God and denied his claim. He was not pleased and threatened a lawsuit.

My question is can he sue me for liability and will any lawyer take his case? My insurance said they'll take care of the legal things for me if the neighbor decides to sue but I'm curious to know how likely it will happen?

He is asking me for my last name since all the information he has is my address. Should I give him my last name or should I just ignore him and avoid any further contacts?

Will Giving Accidental Wrong Car Information for Insurance Have Serious Repercussions?

    Posted: 08 Nov 2019 01:43 AM PST

I'm in Georgia, US. I'm currently trying to get car insurance online and have to give my car model and type (coup or sedan). Unfortunately, my car is back home, being driven down here tomorrow morning, and I haven't seen it in so long I can't remember what type of Civic it is or if its 2-door or 4-door.

It's the middle of the night, so I can't message anyone near where my car is to ask. My question is, if I apply for this insurance and get either of these two wrong, will that have bad repercussions?

I’ve noticed things missing from my home while I was away.

    Posted: 07 Nov 2019 05:26 PM PST

No, there was no forced entry.

Yes, there were a number of people who had access to my home—all of whom I have a personal connection with.

    Yes, I have homeowner's insurance.

What are the pros and cons of filing on my homeowner's insurance?

I know I need to make a police report, however, I don't want to falsely accuse anyone.

Any advice from experience will be greatly appreciated.

From the short list I've gathered, it's close to around $4,396.

I was in and out of the hospital, so yes, this is very new and bizarre to me.

Live in NYC and have health insurance. Went to the ER last night and got discharged. Found out they don't take my insurance.

    Posted: 07 Nov 2019 02:04 PM PST

Longtime lurker, first time poster here. Situation is as above. Is there anything I can do? I had a CT scan done so I fear my bill is going to be a chunk of change. Anyone else been through this? I was unsure which hospital takes my insurance as first time using an emergency room.

I asked multiple times throughout the night about insurance and they said someone would come around and take details, which they did eventually. At that point no info was still provided and the register person said we'd figure it out if the insurance didn't cover it. I was a bit loopy at the time and had had headaches for the past 2 days so wasn't really fully functioning. Is there any way my insurance could cover this despite it being out of network? Appreciate any feedback.

Should I be concerned about using emergency roadside because of CLUE report?

    Posted: 07 Nov 2019 06:13 PM PST

So long story short, I've never been in an accident, no tickets -- spotless driving record. So today I came to start my car, wouldn't turn on. Recently moved to a new city, didn't have a jumper, and no one around to help. So ended up using my Geico Emergency Roadside. They came out, got it started for me. Few hours later, I go to turn on my car again, same issue (yes, I now realize it is a bad battery). So I call them again, they put me in the queue to send one out, but it was going to be like 3 hours so I asked them to cancel the dispatch.

I'll need to have the car jumped tomorrow so I can take it to a shop to get the battery replaced. Is it a bad idea to use the roadside assistance again? Mind you, this'll be the second time I've ever used it. I was reading online about CLUE, and got a little concerned that using this might cause problems down the line.

Can any professionals on here help a student?

    Posted: 07 Nov 2019 01:23 PM PST

This might get deleted but I figured I would try anyways. I am a junior at Temple University majoring in Risk Management & Insurance and Legal Studies. For my P&C course I have been tasked with writing a position paper focusing on a topic in the P&C field. The paper requires me to "interview" (message a few questions) and cite two industry professionals in the paper.

If you would be willing to help a student get an A and survive this semester please let me know it would be appreciated!! My topic is most likely going to be the risk of the 2022 World Cup and if the event should be pulled from the area. Expertise in political risk/human capital risk etc. would be best.

    Farm insurance questions

    Posted: 07 Nov 2019 07:53 PM PST

Hi guys. New to Reddit. Hoping to get some advice on my situation with farm insurance in BC, Canada.

In my 40 x 120 ft 2-level-barn, the roof in the middle 40 x 60 ft section caved in with snow and ice leaving what use to be a 40 x 60 upper loft floor as now a flat covering exposed to the weather.

Snow and ice was excluded in the insurance and I had the 40 x 60 caved-in section it taken down and removed the debris.

Does this 40 x 60 upper floor section need side railings as per what one insurance company is saying?

Medicare while still employed at age 65

    Posted: 07 Nov 2019 01:44 PM PST

    Hello,

I had some questions about Medicare for my parents. We are located in Maryland, US.

My mother is currently undergoing cancer treatment with her insurance through her employer but we were looking to switch over to Medicare w/ Medigap as it will be less out of pocket for us over all.

Her 65th birthday was October 11th. If we apply to Medicare now when would her coverage start? From my research, it seems like it would be awhile until it starts coverage. Should she keep her employer insurance until then? If and when her Medicare coverage starts, would she be able to terminate her employer insurance so she does not have to pay both premiums?

Also, about Medigap, when will she be available to apply for Medigap? Does she have to wait for her Medicare coverage to start?

Medicare process is very complicated and we just needed the best option to cover for our mother's cancer treatments.

Thank you for your time everyone.

Was hit in a hit and run accident, other driver not cooperating.

    Posted: 07 Nov 2019 11:45 AM PST

Hey everyone in desperate need of some advice.

I was hit in an accident recently. I quickly realized that the driver started to speed away and I followed them to get the License plate as my car could barely keep up. I was only able to get the license plate number. Police would not come to the scene since the driver had sped away so I had to make a police report at the station. There are no pictures, and all the red-light cameras at the intersection have turned out to be dummy cameras.

After calling my insurance and getting assigned an adjuster, they find out who owns the car. Turns out he was not driving the car, so it was being borrowed. His insurance has told ours he has become uncooperative and will not give up the location of the car and driver. We were told now that we just need to pay our deductible to start repairs.

Wondering if there is anything else we can do in this situation. We keep telling the adjuster we want the claim open but our insurance has assured us they will not keep pushing 3rd party's insurance company to locate the vehicle.

    Thanks,!

Update: Heard back from 3rd parties insurance and they have revealed that they won't do anything till they get a statement from the driver of the vehicle, who the owner of the vehicle won't tell their insurance who it is.

I have a court order awarding me 2800 for my truck that was totaled almost a year ago now. but insurance wants to pay 1400 and make me sign a release of liability for them and the owner of the car. Is this normal? And do I have an recourse to get the rest of what's owed to me?

Looking at switching to Metromile. I was wondering what people think of this company in terms of getting claims covered? I don't drive a ton so I'm not too concerned with the monthly rate, but in how well they handle claims in the event of an actual accident

    Health Insurance Question

    Posted: 07 Nov 2019 10:56 AM PST

My 18-year-old niece lives in my house with me in Illinois. She attends community college. She has no job. She lives on financial aid, and I charge her no rent or utilities. She is currently on her father's health insurance plan through his job (also in Illinois), but he wants to remove her from his insurance. What should she do to get health insurance of her own? And does my income affect her choices since she lives in my house? She does have some health issues that require a doctor's care and also is prescribed medication. Thanks for your advice.

    Edited: to remove a typo.

Minor collision; I’m at fault. Worth filing a claim?

    Posted: 07 Nov 2019 04:53 PM PST

I encountered a minor collision this week (my fault), causing cosmetic damage to the front of my car. Other car is fine. I drive a lease, so a repair is important. Local body shops are estimating the cost to be ~$2000. I have a $500 deductible and pay $230/month.

I spoke to an insurance agent who was kind enough to help me forecast the future premium increase if i choose to file. Looking like $100 monthly increase, assuming I'm at fault.

My inclination is to pay for the repair out of pocket and keep my record clean. I figure I'd rather save money in the long run than take the easy way out now. What do you think?

    edit: I live in Michigan.

    Diminished Value Claim

    Posted: 07 Nov 2019 04:38 PM PST

I was rear ended in an accident, my Mazda3 was hit by a car who was then hit and pushed into me again. The third car fled the scene, I have no info. I contacted the middle cars insurance (Trader's) to process a diminished value claim and was told I would need to provide a total of 7 vehicle reports for comparable vehicles. I haven't been able to find these without paying $30+ so I contacted Trader's to see if they would reimburse and was told it is my responsibility to prove so I would not be reimbursed. Do I have any options without just eating the cost? Doubt it would help but the driver of the car was not insured or licensed but the car was covered on the owner's policy.

Doctor wants me to trigger a racing heart, but no one wants it supervised

    Posted: 07 Nov 2019 06:51 AM PST

Over the past 4 months I've had an issue with my heart racing 210+ bpm for 1.5 hours. The first time it occurred I was in a museum so the onsite nurse had a couple of instruments to confirm the heart rate. I developed a theory as to what triggers it, and the doctor agreed (generally drink coffee, then do a heavy workout, then wait an hour for the heart to naturally slow down, which would then trigger the 200+ bpm). He gave me a portable ekg device that I wear on my chest 24/7 for 30 days. He asked me to trigger the racing heart to make sure it gets captured for a proper diagnosis. As you can imagine, as a 52 yo I'm already paranoid of a heart attack, etc., and I live alone so I'm not too keen to trigger this. I asked about doing it in a hospital but he said no one asked about that before - which I was quite surprised. I called my insurance about this but the lady who answered wasn't able to help me or come up with a way for insurance to cover this. What options do I have?

    Umbrella insurance/homeowners

    Posted: 07 Nov 2019 01:45 PM PST

If a person is sued for Slander/libel would your homeowners insurance or umbrella insurance pick up the cost of legal defense or any judgements?

There would likely not be a judgement due to fact. This is more of a SLAPP related issue.

    Question about car insurance (CA)

    Posted: 07 Nov 2019 12:45 PM PST

I'm the guy who asked for help in a car accident last week. For people who didn't read my post about the accident I was found 0% at fault and told my rates wouldn't go up so this shouldn't have anything to do with the accident. Anyway you all helped out so much I have another question

My car insurance is on the higher side. This is to be expected my car insurance is for a car that I bought which is a Scion FRS. So I'm well aware that my insurance will be pricier. The bank I financed through wants full coverage and I can afford the insurance even as it is now, but I'm confused with what AAA is charging me and how their doing it.

Last year I bought the car, shopped around for insurance a bit, but the insurance AAA quoted me at 245 a month which I was happy with when comparing it to other companies. I got my first bill and was charged 262 and about halfway through the year it rose to about 280. Again I can afford this, but my insurance was set for renewal in September and it was fully paid off by July which I found really odd. I was being charged 40 dollars over what was quoted and my insurance was fully paid 2 months early.

Second year I did some more shopping, but for what my bank wants in terms of coverage AAA was still the best go to. The agent told me that I'd be paying 230 a month ten dollars less than last year. I asked him why my bills were high for 2018 but he couldn't give me a straight answer. First bill comes and its 262 again which I pay, second bill comes and again its 262. Its already 30 dollars more than what the agent told me it would cost. I'm wanting to schedule visit with an agent, but before I do that I wanted to ask, am I just missing something here? Is this a normal thing with insurance?

Which health insurance should we choose?

    Posted: 07 Nov 2019 12:28 PM PST

Sorry if this is a stupid question, but I honestly have no clue about insurance. Through my husbands work, our family of 3 is covered and we pay nothing monthly. With any of the options below, we pay nothing monthly. We currently have the Kaiser plan but we hate Kaiser and so are looking at the Silver/Gold/Platinum options. I don't want to choose the wrong one but despite doing my research I still don't really understand which one would be best in our situation, which is why I included all the information we've been given on the options.

Some basic health info - We're all generally healthy, the only major medical expense that we might anticipate over the next year is we might try to conceive another child, which can obviously be very expensive. Knowing all that information, which plan would be best for us? (Again, not including the Kaiser plan, just included for an example of what we're currently used to.)

I'm hopefully going back to school in September but I will need to pay a $1000 deductible next year for a procedure in January. I would prefer to use flex spending for it. What are the implications if I don't work for this company for the full year?

    Dininished value claim

    Posted: 07 Nov 2019 09:55 AM PST

First off, I live in rural ohio. Yesterday at 2pm i was on a two lane state route headed home from school and a 75 year old woman was driving the opposite direction in an F150 with a ladder that wasn't properly secured. As she passed me the ladder came loose and struck my 2019 Honda Accord sport (havent even had it a month.)

Her insurance has admitted liability and ive received an estimate of 6700 for the damages.

My question is this. Prior to being struck by her ladder due to her negligence my Accord was an asset which held a certain worth, and now even after the repairs which her insurance is covering that asset is worth less. I told her adjuster that i would like compensation for that devaluation and she said that she didnt think Ohio required any compensations for asset devaluation due to negligence.

This sounds sketchy and i feel like i have a case but thought id reach out for some input or knowledge/wisdom regarding my situation.
