It really helped me take a proactive approach instead of letting worry sif in the drivers' seat. I looked in my bank account this morning, and the purchase was reversed! In addition to advice regarding contacting my bank, you guys gave excellent advice about what to do in a situation where I might fall short on food again, which can definitely happen when you're living paycheck to paycheck, and I hope anyone who ever finds them self in this situation remembers they can always visit a local food pantry in an emergency food shortage! I only posted that original post on this forum, so any similar posts on other forums aren't me, but having this happen made me aware of it being a possibility and also something others might go through. I was waiting on my next paycheck, so I bought $175 worth of groceries with $300 in the bank. The cashier kept asking me to swipe my card saying the transaction did not go through. I checked my bank balance with my Wells Fargo app and found that Walmart had already charged me the $175 for groceries. I asked for a manager to come and fix the situation. Manager assured me the charge would drop off. He asked for my bank card to call my bank. He said he wanted to look at the customer service phone number, so I told him the phone number. I also called my bank. They opened a claim and said they would email me the claim number, but I checked my inbox, and I did not receive an email from them. I asked the manager to try to contact his supervisor to see if the situation could be fixed so I could leave with my groceries as Walmart had already charged me for them and with the transaction pending, I did not have enough funds available to buy more groceries. Manager refused to contact his supervisor. He said, "he's not here." I ended up having to leave a full cart of groceries with this manager in tears and drive to Wells Fargo to explain the situation. They told me there was nothing they could do as long as the charge was pending. They said to call them as soon as the charge went through. I called Walmart customer service and explained the situation and emailed their corporate office. This morning, the charge went through. I called Wells Fargo and let them know, and they emailed me a claim number. I also emailed Walmart customer service again. As a single working mom of two young children, $175 is a lot of money to me. Tree company broke power line. Power company sent me repair bill. Posted: 07 Nov 2019 03:56 AM PST Last month we had a tree company come out to cut some trees at our home in Florida. They are fairly highly rated in the area and the guy assured me that they are licensed and insured. When quoted the guy said that he would climb into the trees, but on the day he wanted to use his bucket truck as that would be faster. They ended up removing a fence and tearing up my yard as their truck got stuck in the sand for hours. At the end of the day, just before dark, there were still 2 palm trees to be done near the power line in front of our yard. I thought that they were wrapping up and would come back the next day, but as my wife and I were having dinner we heard an explosion outside and the power went out. The guy had hit the power line with his bucket truck and the cable snapped. The guy felt the shock but said that his rubber boots saved him. He decided not to do the 2 palm trees anymore because it was too dangerous, so he said that the total bill would be less. I was in shock and gave him a check and they left before the power came back on. Our street was without power for about 2 hours. One of the energy company guys came to me saying that someone from the tree company had told him that everything was my fault. She had claimed that I had been pressing them about the palm trees and that I had been unreasonable. I had no idea where that came from. We never talked about the palm trees that day and they were the ones insisting to use the bucket truck. I had been watching them from a distance. The guy from the energy company said that someone from their legal department would stop by later that night to get information about the tree company, but no one ever came. I later looked them up and the tree company's LLC has been inactive for a year, so now I wonder if they even have insurance. The receipt he gave me doesn't even have a name or contact details. A month later we received a bill in the mail for $500 from a company in Colorado, but it was addressed to the tree company. I called the number and the person said that they had been trying to contact the tree company and failed. I gave them the information that I had. She asked if I had their insurance information, but I didn't. Yesterday I received a voicemail from this arbitration company asking me to call them back, as the case will be going to their legal department. Am I responsible for paying this $500? I am the one who hired this company and I should have probably asked for their insurance papers before they started, but they were the ones that caused the damage. I don't know if this matters, but the power line is over the easement area and technically not on our property. I have certainly learned my lesson to ask for paperwork from any future companies that I hire. Should I try to contact the tree company for the arbitration company, or stay out of this? Edit: I talked with the company that represents the energy company, and they said that if I am willing to cover the costs they can go down to $325, otherwise they will send it back to the energy company and they will use their legal department to get the full amount. I am leaning toward just paying this and be done with it. I don't want to get into a fight with anyone or deal with lawyers. A friend of mine owns a hanger on a private airstrip in Florida the airport has been there for 30+ years and has about 60 hangers. The area is zoned commercial property currently but a new city project is trying to change that. Behind the airport is a swampy undeveloped forest that is only used as the area pilots fly over on approach. There have been several crashes in this swamp over the years which is why it is used instead of the surrounding developed areas. The city has annexed the area and plans on building 900 1/4 acre homes that will backup to the airport. No one at the airport wants this since a wall will likely need to be built to keep people off the active taxiways and eventually people are going to complain about the noise even though they are moving right next to an airport. The most recent development is the city trying to rezone both areas to a new zone they are creating called "residential and airport support". No one knows what that means but I suspect they would use it to enforce restrictions on what times people are allowed to fly. There is a meeting coming up next week but the city has already spent a lot of money on the project and are being sneaky regarding the whole thing so I doubt they will listen to our concerns. Is there anything my friend can do or say to fight them? At this point, the homes are probably going to get built but if they could build them a little further back that would be better. The old landlord of the building sold it at the tail end of last month. This new landlord has plans to fix up the place and raise rent 500 dollars! Thats fine for my roommates and I, but really sucks for the folks who have lived here for 7 years. This new landlord is already emailing us asking if we've made a decision to leave and that they have someone who wants to see the apartment. We're not even half way through our lease yet. This is kinda rude and I'm worried they're going to continue this throughout the rest of our time here. I get that landlords want to get someone in ASAP after the current tenants leave, but this seems highly inappropriate. After a death in my family she notified this Patron that she would be unable to provide the cake she ordered ......EDIT..... that the patron failed to provide information on size / number of people flavors etc despite multiple attempts to gather said information (no payment exchanged hands). With approximately 12 days notice . The Patron sent "Their Deep condolence for your non disclosed family member to fall ill so suddenly 12 days before my first real wedding. " in an envelope filled with ultra fine glitter. Going on to state how "I know customer satisfaction and word of mouth are key in starting local business. I will be sure to share our experience with our church & guests about my experience. " The glitter contaminated two pans of product not to mention the kitchen in general now requiring extensive cleaning and to redo the contaminated product. The suspect was eventually arrested and arraigned. Their lawyer somehow got ahold of who sent the tip in (My wife). And now the suspect is aware that she turned him in. We called a lawyer who told us to call crimestoppers. They haven't returned our calls. What do we do? Do we have basis for a suit? Edit: I think reddit sees "suit" and assumes we're trying to make a quick buck. Money would be alright but it's more about what's right. Dont lie to people. For reference, I live in North Carolina, and I originally wanted to be adopted when I was a minor but when I reached out to my biological father who I've been NC with for years to give his consent, he refused and told me that he would do everything in his power to make the legal process as difficult for us as possible. (He's an ass.) Our lawyer told us that it would be significantly more expensive to override him with my being a minor, so for financial reasons we chose to wait until I was no longer a minor and we would proceed with an adult adoption. I'm currently 19 and we are about to proceed. However, I've been informed by a mutual family member that he still intends to try to stop, or at least make exceedingly difficult and expensive, the adoption process. My question is, can he actually do that? What are his rights in this? I hate feeling like there's even a possibility of him being able to affect this negatively. If it helps, he has a documented history of parental negligence and emotional abuse, and my mother was granted full custody of me when I was 9, and he never requested visitation or initiated any contact so that was the last time I saw him. I have lived primarily with her and my stepfather since birth. I also have proof that bio father failed to pay child support for 18 years, as well as extremely abusive gaslighting texts from him detailing his resentments towards me. Would any of that be usable if he attempts to stop the process under the guise of him wanting to retain parental rights? They recommended I renegotiate my noncompete but it would cost roughly $1500 to start. The lawyer. Hinted towards just going after their customers anyway but don't mention your previous employer or use my last name. Since these accounts are not exclusive to one person or company your previous employer will never find out you contacted them and it will be very expensive to enforce the noncompete. I told them the accounts that my previous employer had we're not bringing in that much money so the lawyer said it's likely they're just bluffing. TLDR my previous employer was bluffing in reminding me of my noncompete. It will cost them too much money to actually sue me. My dad has moderate cognitive impairment and has lost the will. I was able to find a will but it has "COPY" stamped on the front and the clerk of court said we had to have the original. The will was drawn up in 1986 and is pretty simple everything goes to dad, in the event they died together a small amount would go to my mother's parents (her mom is still alive so I guess just to her) and the rest split between me and my sister. I also found a power of attorney my parents had written up in 2007 with a different attorney, I thought perhaps they updated the will during that time but cannot find any evidence of that. It was a single attorney office and I tried to contact the attorney but he is deceased. Any advice on what I can do to help my dad get the probate process started? I live in North Carolina. Posted: 07 Nov 2019 07:40 AM PST So we bought our house ~3 years ago. We were aware it was under a Right of Way easement for the power company and that there would be a lot of limitations to what we could actually do with our back yard, and we went through with the purchase regardless. We were told an exception had been made for the shed on the property as well as the deck even though both TECHNICALLY fall just within the boundaries of the easement. These were confirmed with the town through our realator who is a good family friend and wouldn't have intentionally lied to us about something like that. From somewhere else, I genuinely cannot remember the source of, we were told the fence enclosing about 3/4 of an acre of the 1.82 acre property was fine as long as there was access to the property if the power company ever needed to get people, trucks or other equipment onto the property(I may have read this online when researching RoWs). The fence is chain link, with a large gate at the back, right at the main service road for the power lines. I don't believe trucks could get through there, but the people they send for vegetation clearing use is regularly. At the front of the yard, closest to the driveway, there's a large drive gate that would easily fit a service vehicle, along with an additional 4' section of fence that was cut away and folded down into the grass. We assume the drive gate wasn't large enough and the power company cut it down at one point to access the yard while the previous owners still occupied the home. Earlier this week the power company performed another vegetation clearing which essentially removed ALL the vegetation from our back yard. I was a little upset but I understand they have the right to do this, so I e-mailed the power company and requested information on what vegetation IS allowed within the easement (not on the service road, mind you). I also inquired as to whether we would be allowed to install a childrens' swing set and what requirements there would be for a drive gate if I were to repair the damaged sections of the fence(including the section that was cut, and a large section at one corner that was damaged by my brother in-law's plow truck on year). I had planned on replacing all the chain link in the front with cedar, and including a nice large drive gate. When I requested this information from the power company, their response was that they had no record of a license aquired for the fence and that I would need to pay a 250$ license review fee to tell me if I can repair my fence. The application also included an option for a 750$ license permit fee. I'm now concerned that I'm going to have to either pay 250$ for the existance of this fence, have to pay 1000$ to have it repaired, or, worst case scenario, be forced to remove the entire thing... Do I have ANY options here? The fenced in yard was a huge selling point for us with our dog and 2 kids. As much as I'm bothered that they keep cutting down all the vegetation, I understand that that is part of the agreement. I'm also concerned that if the power company starts looking into us now, that they might call us out on the shed and deck as well. I also don't really speak with my sister or brother who weren't very close with my mother either. She had recently gotten married to a man who owned a lot of money in back child support from another marriage. She owned a house but also had tons of medical bills from her illness. So, when my mother did pass in 2017, my sister and brother showed up asking if I would sign away the rights to her estate so that my brother could handle everything as it would be easier. I hadn't seen my brother in almost 15 years so it seems really weird but it also seemed like a better solution than us all having to deal with it. I signed the paper he had and never heard from him after the fact. A few days went by and I questioned my sister as to why we both would do that. She started saying how my mother had no will which is the opposite of something she has told me before. She once told me my mother wanted to leave me a house. Then she went on to describe all the bills that accumulated and how the state would take all the money for her new husbands back support if left to him. She essentially was saying how there wouldn't be anything left once it was all said and done. Fast forward to a couple days ago; i find out my sister owns my mother's old house and is renting it out. It seems to confirm my suspicious that they cut me out from my mother's estate. My question is; although its been so long, is there anything I can do to either confirm this suspicious or find out what really went down? He wrote a full A4 page complaint, all of it is either twisted or entirely made up. The main points in the complaint are: I saw him on grindr and mentioned it to him: TRUE. As in, I mentioned in passing "oh I saw your profile on grindr lol". Is this seriously sexual harassment!? I frequently approach him while high and annoy him: FALSE. I don't do drugs and we maybe exchange a word of greeting every two weeks, if that. I message him from our work chat: TRUE. However, it's only ever links to music videos; we have the same taste in music and he's never acted anything but appreciative. I tried to hug him in the office once: FALSE. I was walking towards him back to my desk, raised my hands and said his name, as in "hello!". He said "please do not touch me", and I replied that I hadn't any intention of doing so. I sat near him once, brought my chair as close to his as possible and touched myself: FALSE. This is entirely fabricated. WTF? I stare at him constantly: FALSE. I don't even sit anywhere near him. Posted: 07 Nov 2019 08:17 AM PST We have a 2014 Ford Fusion SE 2.5L with the 6F35 6-speed automatic transmission. For some background, the 2010-2016 6F35 is notorious for failures and problems, and many of them had recalls and/or TSBs regarding various issues with them. Unfortunately, pulling up our VIN shows that our specific manufacturing run was one of the very few that were not recalled or do not have TSBs out on. So we technically have no leg to stand on there. Now, Ford's Powertrain warranty was 5y(from factory ship date)/60k miles. We purchased the vehicle about a year and a half ago at 27k miles from a dealership (satisfying the warranty requirement that chain of sales must stay with actual dealerships, and still within the warranty time period). At around 50k miles and 4.5 years from warranty start date (so still within warranty), the transmission began exhibiting the common symptoms of these transmissions' problems and failures....hard shifting and slipping, erratic RPMs, etc. While on a road trip, the transmission finally failed, popping out of gear and refusing to shift at all (while whining/grinding). It was dead in the water (I had to coast it to the side of the highway). We had it towed to an authorized service center and I returned home, 400 miles away. After the car had cooled down and sat for a few days, though, apparently the problem temporarily went away. The vehicle shifted fine and the service techs couldn't figure anything out. So they did some unrelated recall work (steering column bolt and shifter linkage bushings) that needed done anyway and released the car to us. Having said that, understanding the nature of the failure and our safety concerns, that dealer/service center shipped the car back to us for free rather than making us drive it 400 miles back home. Since then, erratic/hard shifting and slipping has continued off and on, and we've had to just deal with it...until this weekend. At 65k miles (5k miles and 1 month out of warranty), the transmission finally fully imploded. As in, the internals are in pieces and it puked ATF everywhere. It's done. Game over. Our local Ford dealership (not the dealership we bought the car from, mind you), while sympathetic to our cause, has to go through the protocol. We've filed a claim with Ford, but we have to wait for our service center to tear apart our transmission, figure out exactly what happened, and link the failure with the previously reported problems. They can then petition Ford on our behalf to cover all or part of the cost. My problem is that Ford can (and apparently has, in other people's experiences) still say no. A new transmission for this vehicle is $4k plus $1-1.5k labor. I cannot afford that in any way, shape, or form. I also still owe $13k on it, and it's only worth about $11k. So selling/junking/trading in isn't an option. I really need Ford to cover this, and frankly I think they should (even just from an ethical standpoint). But what are my options if they say no, or will only cover a small portion of the cost? Do I have grounds to sue? I will say that I don't exactly have a ton of money to front to file a lawsuit in the first place, which puts me in a beggar's position...and not many lawyers around here do pro bono work (the few who do are absolutely swamped). We do have the paperwork from the first/temporary transmission failure, and have given copies to our local service center. They have claimed thus far that they will do what they can to fight for us, but I need a backup plan in case Ford tries to weasel out of it or the service center decides it's not worth the time or effort to fight for us after all. Thoughts, advice, suggestions? Note: I am aware that there is a lawyer who was involved in the Focus/Fiesta Powershift transmission lawsuits who is trying to put together a mass action lawsuit regarding the Fusion 6F35 issues as well, but that doesn't exactly help me right now. So I currently live in Chicago, IL with a car that's still registered to my old address in Indiana(Porter County). I've been to the DMV in cook county now 12 times since 5/2018 when my parents moved from our old indiana address(my dad is on the title so the car was legally registered). Once they moved, I've hit countless road blocks with Wells Fargo, who was the lien holder/auto loan company. I requested multiple times for my loan agreement to be mailed to me, but they kept sending copies of the title, which is useless for getting illinois tags as the IL DMV needs the copy of the contract. I also got married in this timeframe and thought I had updated my last name countless times with them by phone(the rep would always just say "yep it's changed is there anything else I can do for you?" and I thought that that was done. Turns out they need a whole document filled out that no rep ever mentioned or started that process even though I said every time that my name changed due to marriage, and now that my account is closed, its too late to do this process. Because a year had gone by and my tags were expired at this point, I got fed up and paid the car loan off early so I could just bring the title in that would just have my name on it. I paid wells fargo $1300 on 10/9/19 and they processed the payment and closed my account on 10/12/19. Then I heard nothing back. This past saturday night I got into a car accident, which resulted in my car being impounded for expired registration. Understandable, I've been trying to get it done and shouldn't have been driving with expired tags. The issue now is that Wells Fargo is claiming they released the lien on 10/12/19 to the Indiana BMV to process and mail to me. I called the BMV last night after going to the IL DMV 3 times this week with various documents(wells fargo finally faxed me my loan agreement after requesting it 3 times - 2 of the 3 they never submitted the request. took almost 72 hours for them to fax a document). Because Wells Fargo closed my account - they claim they don't have my title anymore. They do NOT have a tracking number for when it was shipped to the BMV. The BMV has not received anything at this point, and when they pull up my vehicle title records they only have one with Wells Fargo still listed as the lien holder - meaning they can't issue me a lost/duplicate title because technically Wells Fargo still owns the car. Wells Fargo keeps repeating they don't have it and can't do anything. I had to renew my registration online through the BMV website and print a copy of my updated registration in order to at least get my car out of the impound(which i called the impound first to verify theyd accept this, and they confirmed they would). However, I have a court date on 12/17/19 where if I can't prove i have access to the address my car is registered to(I don't) then i could face potential jail time or at the very least, my car would be re-towed until this is resolved. I guess my question at this point is what the heck do I even do next? I have the loan agreement, bill of sale, notice of final payment, and prev registration. Without the last name on the loan agreement matching my driver's license I cant get illinois tags. And i cant get the title until wells fargo releases the loan, which they said they already did almost a month ago. I'm at a stand still and can't afford to go to jail because my title is in limbo. I'm looking for any advice on if I should contact a lawyer at this point(which I can't really afford after all these impound fees and paying my registration in indiana and then will have to pay it again for illinois - totalled to around $800, and I only make $14/hr and still have rent/bills to pay). The attorney handling my father's estate just filed a lawsuit against me. Posted: 06 Nov 2019 02:26 PM PST I don't know how to explain this in a way that makes sense because I am extremely frustrated right now, I need help understanding what is going on. In May my dad killed himself in Ohio. I live in Oregon but I'm his only adult child so the burden of burial and his estate ect was on me, but my grandma produced a legal document for me to sign which transferred that liability to her. She took care of the cremation, she hired the lawyer to handle the estate. Fast foward to today. I get a summons in the mail regarding a "complaint for land sale" where the attorney she hired is the plaintiff and I'm listed as a defendant amongst my underaged siblings and the county treasurer. The front page clearly says "If you fail to appear and defend, judgement by default will be taken against you for the relief demanded in the complaint." First of all, I can't go to Ohio. I literally cannot afford a plane ticket to go to court in Ohio. If I can't afford to go to court does that mean I will be held financially responsible for everything because my siblings are minors? Second of all, what does this even mean? I get that she needs to sell the house, that's like the whole reason my grandma hired her. But why would she be suing me about it? Ex-husband not exercising time sharing [FLORIDA] Posted: 07 Nov 2019 07:07 AM PST My ex has chosen to not exercise his 50/50 timesharing with me due to his fiance's feelings about my daughter. This is a culmination over several years of me speaking to him about the way my daughter is being treated by her. I have a lot of emails documenting this. Our initial informal arrangement happened after her teachers called us in because my daughter seemed depressed to them. We met after that and he suggested only having her every other weekend. He also told me he is an alcoholic and just started going to AA. Prior to his first weekend in the new arrangement, he emailed me to say that he does not think that it is a good idea for my daughter to be in his home whatsoever, and so every other weekend he would pick her up for a few hours to hang out. Because this arrangement is informal and has only been going on for a couple weeks, I am nervous that he can go back to bringing my daughter to his home 50/50 when it is truly bad for her mental health. She has expressed to me and to her therapist that she is worried my ex's fiance will become physically violent eventually due to a few occasions of screaming in her face, and knocking her TV on the floor, slamming doors. I know I need to seek a formal custody change, but I want to know if there are any prior steps I should take - such as a guardian ad litem - to help solidify my case for a custody change. Thank you. Got a letter stating we’re getting evicted because we did not pay rent when we actually did pay rent Posted: 07 Nov 2019 11:21 AM PST We're in Iowa. Our apartment is no longer a lease, as it was only a year and now it's just month to month. I payed rent with a money order on the 1st and put it in the rent deposit slot. I tried talking to the manager but she told me she'll look later. I found my receipts for the money order and called the customer service number to see if it had been cashed and it was cashed on November 4th. Posted: 07 Nov 2019 07:05 AM PST My husband, our 2 year old and I moved into a house we found on Facebook marketplace back in May. We were desperate to get out of a shitty housing situation and I was in my last semester of graduate school, needless to say we were ready to move. The house initially didn't allow pets, so we told them we had 2 cats and 2 dogs and the owner (our landlord) immediately told us it was fine. He seemed like he was in a big rush to get someone to rent the house. The house was definitely a fixer upper and after living there for a couple months, we realized the house wasnt up to code at all. The basement had no ventilation or exits. We were also told by the owner that the house also tested positive for mold a month ago after we requested a mold inspection. Our plan was to ride out the lease until May 2020 so we can buy a house. The lease we signed was almost too...simple. It was a page and a half. We live in colorado if that helps. On Monday afternoon my husband came home to our 3 bedroom ranch-style home engulfed in smoke and our basement flooded. Our landlord had entered the house while we weren't there (with our permission) to do maintenance. When I came home there were fire trucks and firemen everywhere. The fire had apparently started in the same spot in our basement our landlords brother had been doing maintenance. Our sons playroom and all our furniture and possessions in the basement are ruined. We don't have renters insurance (lesson learned) so we will be working on replacing these things over the next few years. Honestly I'm so happy none of us were home when the fire started, especially considering the fire started in the basement where our son always plays. The fire department had a fire inspector come to the house on Monday and she ruled out multiple potential causes of the fire. In the end, they couldn't determine what started the fire but everyone thought it was suspicious that the fire started where the maintenance was being done that day. During the investigation, our landlords brother came and looked at the house. He had been the one present when the maintenance was being done and said nothing to the fire investigator until I spoke up and told the fire department he was in the house earlier. Our landlords brother kept avoiding eye contact (they are asian so it might be cultural) and said almost nothing. The fire inspector asked why the owner wasnt present but his brother was. The owner of the house did not show up to see the damage until hours later and did not call us to see if we were ok. We are now living in a hotel with our pets and 2 year old son. The owner of the house has refused to pay for anything. This includes our hotel until we find a place to live, moving costs and first months rent for another place. They own 5 different properties so it seems cruel to me that they would cause a fire and leave a family with a small child with no place to live and no means to find a place. We are lucky that we have an incredible support network and have received a lot of monetary donations from friends and family. The owner of the house is refusing to hire a private investigator to determine the cause of the fire and instead is trying to start reconstruction of the house right away. This makes me think they are trying to conceal evidence. All I asked of the owner was to help us with moving costs and the hotel we are staying at. He is refusing to pay anything. The fire investigator said they are not required to hire a private investigator unless insurance tells them to. Yesterday the owner sent us a text that the house had just tested positive for asbestos. We both work decent jobs, have always taken care of the houses we've lived in and have no family to help in the state. We are looking to pursue legal action immediately.
