    Other driver lied to Police/Insurance

    Posted: 02 Oct 2019 01:17 PM PDT

I am in Ontario, Canada. A woman reversed her car into my car while exiting a plaza then lied in her Police report stating that I rear-ended her. I obtained surveillance video from the plaza confirming my story and that she was lying. Insurance has officially deemed her 100% at fault.

Curious what is likely to happen to her now. Would they cancel her policy or?

    Opinions of Securian Accident Insurance

    Posted: 03 Oct 2019 02:23 AM PDT

My employer is switching accidental death and dismemberment insurance to Securian insurance. The brochure says it will on top of being ad&d insurance provide us clientele with cash payouts for emergency room visits, concussions, fractures etc. it seems too good to be true for only about $3 a month and I cannot find any online reviews of this company. Anyone have any thoughts on this or experiences with this company?

Left turn accident. Who is at fault?

    Posted: 02 Oct 2019 04:31 PM PDT

To set the scene, this accident occurred on a major 35mph road in the US (west coast). The road has three lanes in each direction with an occasional fourth left turn lane. I've been driving for 5 years with only 1 prior accident that was my fault (less than 50 dollars of damage to other party).

A few weeks ago I was driving down the leftmost lane on my side (ie closest to the traffic going in the opposite direction on left). After slowing down to 25-30mph to allow the car in front of me to enter a left turn lane that just emerged, I began speeding up to 35-40mph.

Less than 5 seconds later, I noticed a car enter my lane headfirst. It came from a road perpendicular to the one I was on and was trying to make a left turn into the opposing flow of traffic on my left. I'm not sure of its speed but likely not more than 15mph. As soon as I saw it enter my lane, I began braking but ended up having to swerve right and hit the left rear bumper with my left front lights. At the moment of the accident, their car was wholly in my lane and I believe slowing down to turn left at the median. There was visible damage to both cars, mine moreso than theirs.

The man in the other vehicle claims that I was only one going in that direction of traffic to have not seen him and to have been speeding up. He claims that was already "most" of the way across the intersection. Admittedly, I hadn't noticed him until he was in the lane to my right and began entering my lane perhaps 20ft away.

When exchanging information, it turns out he only has a learner's permit and that he doesn't have it on him. More than that, he claims that there was someone in the vehicle with him (because a permit requires another licensed driver in the vehicle) and that they had already left because his house was nearby. I'm 90% sure he's lying because even if they had a reason to run home, they would've had to cross 3 lanes of traffic in front or behind my car in the seconds after the accident happened for me not to have noticed. Otherwise my attention was wholly on the other vehicle after pulling into a parking lot together.

There was also two passerbies who exchanged information with us. I forgot to ask what they saw but they seemed sympathetic to the other driver perhaps because they also lived nearby. We did not end up calling police because the other party insisted that they didn't have time to wait around. And even calling the non-emergency line after they left told me that they wouldn't send out a car unless I insisted. Note that the other party left their car behind because the car wasn't exactly drivable long distances (loose part scraping the ground).

    That said, my questions are:

    • If I hadn't seen them coming until they were crossing the lane to my right and I was at the speed limit of 35mph, am I at fault?

    • Would the other driver not carrying their learner's permit on them matter to insurance?

    • If the witness were to side with the other driver, would that seriously hurt my case? And what if the other driver lied and claimed that there was another person in the car with them?

first accident, will my insurance premium go up?

    Posted: 03 Oct 2019 01:12 AM PDT

I've been driving for 11 years. Today I was involved in a sideswipe accident for the first time where I was the at-fault party. No major damages were incurred other than scratches to the other car's bumper. Considering this is my first accident ever, will my insurance premium go up significantly? Or will the insurance company take into account the fact that this is my first accident in the 11 years I've been driving?

Dumptruck rocks damaged my vehicle's paint

    Posted: 02 Oct 2019 06:49 PM PDT

    Hey all,

I take great pride and care of my vehicle's appearance, investing in a ceramic coating for the paint ($400) anually, regularly washing and doing a yearly machine multi-step polishing, and it's been free of blemishes since I've purchased it!

Yesterday when travelling on the highway, a dump truck was spewing dust and debris out the rear, and even though I tried to avoid it, my car was pelted with rocks and whatnot, pitting up the windshield heavily and putting chips and dings all over my car's grille/hood. I was the "500 feet away" but this truck was going above the speed limit and passing everybody in the middle lane.

Is there any comprehensive claim I can file? I am very upset by this due to the hours and care I've put into my car's paint. What would be expected outside of a replacement windshield?

    Neck injury surgery recommended

    Posted: 02 Oct 2019 04:29 PM PDT

A lady ran a stop sign and T-boned my pickup truck on my way to work. Both trucks were pretty damaged, totaled. I was rushed to the ER where I was treated and discharged. Felt pains in my shoulders and neck. At the ER Xrays of my neck and shoulders didn't show anything. The doctor gave me a shot in my right shoulder. The following day I couldn't move my neck and my whole body was sore.

I went to see my primary doctor who immediately ordered mri for my shoulders and neck. I had herniated disc and bulging disc compressing on the spinal cord. C3, C5, C6. Both shoulders showed tendinosis. He started me on physical therapy right away.

My doctor referred me to an orthopedic surgeon for further analysis. The orthopedic surgeon informed me that my neck is pretty damaged and that I need a four level cervical ACDF surgery C3-7. I sought another opinion at Johns Hopkins and was told the same thing.

I retained a lawyer immediately. I'm scared to operate because my big brother and uncle both died a few years after going through back and neck surgery. The complications caused them to go back for further surgery. I'm actually scared.

My current total medical bills including lost wages is $39,000. Geico is refusing to tender the policy limit of $100,000. They are saying if I don't get the surgery they won't tender the policy limits. The accident was captured on video which geico has reviewed. Their insured was sited.

Any chance they would tender the limit before a lawsuit is filed? The lawyer sent them 5 years of my W2, $140k a year as a site engineer for a developer.

Can I talk to my car insurance without immediately triggering an increase?

    Posted: 02 Oct 2019 06:16 PM PDT

I just damaged a rental car and I'm not sure how much the damage will be. It was a single vehicle accident and I'm hoping the only repair required is paint. Assuming it's more than my deductible ($500) can I talk to my insurance company (Progressive if it matters) and ask them what my rate increase will be to see if it's worth filing the claim? I don't want to ask them if it'll trigger a rate increase even if I don't file.

Uninsured motorist when having collision coverage?

    Posted: 02 Oct 2019 09:53 PM PDT

Consequences of not having uninsured motorist (Texas) while having collision coverage? If an uninsured motorist hits me, can I go through my collision coverage and just pay the deductible and wait for my insurance (geico) to sue for my deductible back?

Would I (transgender ftm) be commiting insurance fraud if I categorized my top surgery as gynecomastia (CPT 19300)? And a few ofther questions, I would be so greatful for any help at all.

    Posted: 02 Oct 2019 09:05 PM PDT

So my insurance company offers a gender reassignment module, but the policy is through my transphobic company who obviously elected not to include it in their policy. I have been diagnosed with gender dysphoria, and my psychologist is very willing to write a letter saying that chest masculinization surgery would not only benefit my mental health but is necessary. I have been on testosterone for about a year and a half, I have had my legal name and gender marker changed. My birth certificate says I am male. My chest is only an A cup and I am a skinny guy. As my birth certificate has been amended to male, then I am technically a male with breasts which is gynecomastia.

A little bit about my exact policy:

My insurance covers breast reduction (but I don't meet the guidelines with an A cup chest) and it also covers gynecomastia correction surgery with the following guidelines:

III. Gynecomastia surgery request - must satisfy all the following: A - G

    A. Age of onset – must satisfy either of the following: 1 or 2

    1. Adolescent onset – has persisted for at least two years; or

    2. Adult onset – has persisted for at least one year.

    B. True gynecomastia, confirmed by glandular breast tissue, has been documented on physical exam and/or mammography; and

    C. The gynecomastia is classified as Grade II or above per the American Society of Plastic Surgeons' classification; and

    D. Gynecomastia persists despite at least one year of treatment of underlying pathologic causes (eg, endocrinologic abnormalities, tumors, kidney or liver disease, etc.), when medically appropriate; and

    E. Potential gynecomastia-inducing medications have been discontinued for at least one year, when medically appropriate; and

    F. Member has abstained from illicit substances known to cause gynecomastia for at least one year, as confirmed by urine toxicology; and

    G. Persistent breast pain due to gynecomastia, refractory to medical therapy including analgesics and anti-inflammatory agents.

So I meet all of those requirements although I don't know exactly what the second part of G means.

Also, the beginning says: "Medical Necessity Criteria – Must satisfy one of the following: I-III" but then it has a section IV which reads:

IV. Breast reduction or gynecomastia surgery requests for either of the following: A or B

    A. Deformities that are congenital, developmental, or are due to injury – refer to MP/R002 Reconstructive Surgery.

    B. Breast hypertrophy or gynecomastia causing a psychological condition - both of the following: 1 and 2

    1. There must be documentation from a mental health professional, that the member's clinical condition meets the diagnostic criteria for a DSM mental disorder diagnosis (eg, anxiety disorder, major depressive disorder, gender dysphoria, body dysmorphic disorder) causing clinically significant distress or impairment as evidenced by validated scales and measures - must satisfy both of the following: a and b

    a. Distress must be quantified by a disorder-specific symptom rating scale such as the Appearance Anxiety Inventory12; and

    b. Impairment must be quantified using a standard measure such as the World Health Organization Disability Schedule 2.0 (WHODAS)13. See Attachment B

    2. Where applicable, there must be documentation that the member has not responded, is intolerant to, or a poor candidate for other appropriate or conservative treatments for the member's clinical condition (eg, psychotherapy).

So once again I would meet this requirement, but I believe going that route would classify it as a cosmetic surgery which my policy once again doesn't cover.

In the end, this would end up being coded as CPT code 19300 Mastectomy for gynecomastia. I would need a doctor willing to code the surgery as such, which I am hoping won't be hard. Obviously I don't want the doctor to get into trouble but as I said I am legally and medically listed as male, therefore having breasts would technically kinda be gynecomastia. My small chest size means that the same surgical technique used in gynecomastia surgery would be used here. In every single way, this is gynecomastia surgery except for the fact that I used to be female. My intent here isn't to commit insurance fraud obviously, just get what is a necessary procedure for me that would significantly improve my quality of life covered by my insurance.

Does my insurance somehow have it noted in their system that I am transgender or that one point I was identified as female? I know that they told my father they updated my gender marker back when I got my name changed, but I can't find any way for me to check and make sure that happened.

Literally any help or advice would be absolutely amazing, Thank you for taking the time to read this.

[IL] Workers Comp Policy for HOA with 0 Employees

    Posted: 02 Oct 2019 01:29 PM PDT

I'm on the board of directors at condo in Chicago. We're self managed and have 0 employees. We've previously had an accountant and maintenacne man that were W2, and have what I believe is a lefover worker's comp policy from that. But we've since brought accounting in-house and our maintenance man is now an invoice-only sole proprietor who has his own coverage. My current broker is telling me that we should keep the coverage in force because if we hire a company to perform work (HVAC, roofer, brick mason, etc...) and they do not have a policy, or their policy has lapsed, then our policy should cover it. However, when trying to shop competitive quotes, I'm having trouble finding brokers that will actually write a worker's comp policy without any W2 employees. Do we need this coverage? Or is our agent just trying to sell us something we don't need?

Employer is terminating insurance coverage due to part-time status, AND saying I will not be eligible for COBRA

    Posted: 02 Oct 2019 04:34 PM PDT

    Is this allowed/legal?

I am an independent contractor, but due to an ongoing working relationship with a client, I was brought on as an employee of their third party Staffing/HR company. I only do a few hours of work for this client per month, so I am definitely not working full-time, but I have had insurance through this company for the last 3-4 years because "All" of their employees were eligible and I opted-in - I paid everything myself, the company doesn't contribute towards premiums at all.

Today they told me that because I have been identified as Part-time I will no longer be eligible and furthermore will not be eligible for COBRA either, because that is only for Full-time employees, even though I've been insured through them for 3-4 years.

My question is, is this true? I guess it's up to them to offer insurance to part-time employees or not, but shouldn't I be eligible for COBRA by way of being insured for several years and now having that coverage terminated?

Any info/advice is much appreciated, thank you!

    SafeCo vs Grange Homeowner's Insurance

    Posted: 02 Oct 2019 04:20 PM PDT

Hi All, I am in the process of shopping for HO (HomeOwner's) Insurance quotes. I got a couple quotes from SafeCo through two different independent agents and a quote from Grange Insurance Association. The two SafeCo quotes are pretty close to each other while the Grange quote has a substantially lower (~35% less) premium despite have ~5% higher coverages than the SafeCo quotes.

What gives? What can I look into to explain this? Does anyone have experience with either/both of these insurers?

What will happen and who will pay?

    Posted: 02 Oct 2019 04:07 PM PDT

I hit my neighbor's car with a minor dent in Mid January this year. At that time I had insurance 1. He told me he would come back with an estimate of the repair within a week but he didn't show up. I changed my insurance in February next month to insurance 2 and it started from February 15. Now my neighbor comes back in August with the estimate of $3k saying the whole door needs to be replaced. We went to my repair guy and he gave an estimate of $950 to fix the dent. We could not come up to an agreement since I asked him to come along and drop the car to my repair guy so that I'll pay $950 for repair but he is asking to give him $950 and he will take care of it by fixing it somewhere nearby. So Now he claimed it into my insurance, the one that I have right now. If the insurance finds out the incident happen in January they will not cover it. My old insurance does not process claim old as 6 month. So what will happen? There is no police complaint or anything. I would appreciate the advice.

No collision coverage, hit someone's bumper

    Posted: 02 Oct 2019 07:33 PM PDT

I have cheap car insurance with no collision coverage. I rear ended someones bumper. The damage came out to be $1000 for the other persons car. How do I handle this? I have Geico insurance can I use geico accident forgiveness since is the first time I have gotten into an accident?

Really stupid question can I have the person who I hit file a claim stating that the accident was tomorrow and I get coverage for collision now? (probably fraud)

If the person I hit has collision insurance can I offer to pay their deductible? Im really looking to avoid paying the full $1000.

    USAA vs California Casualty

    Posted: 02 Oct 2019 10:31 AM PDT

I have USAA (through my dad who was an army officer) and have had it my adult life (20+ years). My son recently got his license which caused my insurance premiums to spike so much I decided to double check with another insurer. California Casualty also works with a preferred client base (teachers), which I am. When I bundle home & auto, California Casualty is $1000 cheaper per year, which is significant.

I've grown up with everyone around me saying how great USAA are, and I've had good experiences with them. I'm seriously thinking about switching, even though I will get flak from family members. Because I have so many military family members, I'm used to a lot of loyalty around me for USAA. I guess my question is: is that loyalty warranted, even with a $1000 per year price difference?

[USA] Looking for temporary health insurance until I can sign up for next year online. Is MSRA basically a 2nd deductible?

    Posted: 02 Oct 2019 06:30 PM PDT

Looking at some options and it has a deductible AND an MSRA. So, in one example, I would have a $5,000 deductible and 30% MSRA. So if I had an emergency that cost $100,000 does that mean I would pay $35,000? Also, why does this exist? Seems like just another way for the insurance company to screw you over.

Just lost my health insurance in NJ, how's your day going?

    Posted: 02 Oct 2019 05:56 PM PDT

So I just found out that my insurance marketplace policy was cancelled. I had been delinquent for one month 3 months ago, this month I had forgotten to move money to my checking account in time for the auto-debit. I paid on time in full the months in between. So because I was delinquent at one point exactly 90 days ago and was delinquent for exactly 1 day 90 days later my policy has been terminated. This rule makes absolutely no sense and I already feel the sense of futility setting in having dealt with insurance companies in the past.

Making matters worse I have a chronic illness and lots of prescriptions and doctors visits to pay for. Huzzah!

I don't expect that there is any way to remedy this but if anyone knows of any steps I can take to fix the situation it's New Jersey Horizon Blue Cross Blue Shield.

Otherwise, cheers to the uninsured life lads. I'd say break a leg but that's the exact opposite of what I want to have happen right now.

Person crashed in to me yesterday and has not processed a claim through their insurance company.

    Posted: 02 Oct 2019 05:03 PM PDT

Yesterday a woman crashed her car into the side of mine during standstill traffic, the front and rear fenders need replacing, as does the passenger front door. Repairs quoted at 2.3k.

I have her licence plate, drivers ID, name and address and her insurance company. I called her insurance company today and they said until she makes a claim or lets her insurance know that there's nothing they can do. They can't even reach out to her to confirm if this happened. I guess I understand that but it's just so frustrating.

I have full coverage through my own insurance but it seems unfair to pay the $800 excess for something I wasn't at fault for.

I went to my local police station and they also said there was nothing they could do to contact this individual.

I found her Facebook and am on the fence about messaging her (politely) and asking if she got around to calling her insurance company.

    A conundrum for the experts.

    Posted: 02 Oct 2019 01:03 PM PDT

We store a pickup truck and camper in Nevada in a storage unit facility. It has its own enclosed unit with a locked door. We live in Hawaii. We have Idaho plates as that's the last place we lived on the mainland and we renew by mail using our old address. (We do own raw land right next to that addy but since nothing's built on it it doesn't get a physical mailing address). We use the storage facility address for the physical location of the rig for the insurance company, a well known national chain. We can't use Hawaiian plates as they require an annual safety check with pics on island. We could get Nevada plates but then we would have to establish a primary residence and/or get one of those bogus mail drops. We have rigs and our residence in the islands so obviously our Hawaiian licenses. How in the hell are we supposed to negotiate this? I always fear an accident will have the insurance company denying our claim because of the mix and match we're forced into for living on an island 3000 miles away. Oh, we are retired civilians, not military. Thoughts?
