    Neighbor’s tree, my problem? Insurance

    Neighbor’s tree, my problem?

    Posted: 24 Aug 2019 05:36 PM PDT

Hi everyone, I have numerous family members telling me this situation sounds wrong but I'm not sure how to continue.

I live in upstate ny. Last weekend a bad cell of thunderstorms came through and knocked one of my neighbors trees onto my yard, taking a section of chain link fence and a bunch of tree limbs from one of my trees with it. The tree originally stood right next to our property line and is now 99% on my lawn. I am unable to remove it myself.

I'm not very familiar with this particular neighbor and we were out of town at the time. Thankfully my other neighbor did some leg work to get us all in touch.

The neighbor had called his insurance company to see what to do. They said this would be handled by me and my homeowners insurance.

Sure enough I called my company and they began the claims process. I asked a number of different ways and the answer was the same: even though this was a neighbors tree, because it was in good health and was taken down by wind onto my property, I and my insurance company are responsible for the cost of removing the tree and repairing the fence. The company offers $500 toward the removal of the tree and I have a $1000 deductible. I'm not clear if the $500 goes toward the deductible but I assume it does not.

An agent hasn't made their way out to my home yet to assess the damage. I'm not sure if my tree with need to be cut down now that it's missing many large branches.

Anyway, any person I'm telling this to says a series of things along the lines of "that's their tree, how is it your responsibility?" Or "take the guy to small claims court". Or "you're doing something wrong bc when X happened to me, Y happened."

This is my first homeowners claim so I am curious what my options are.

    Thanks

(UK) Bath leaking. Floorboards black, wet and smelling... It's been 18 hours and insurance company has still not sent a plumber...

    Posted: 25 Aug 2019 03:24 AM PDT

They also know I have a disability and am classed as a vulnerable person.

They originally kept saying "we may not get someone til Tuesday it's a bank holiday weekend" when I called Saturday evening. Despite me being in Scotland and it not being a bank holiday here. I told them that nicely. Just so they knew it wasn't an issue here.

Second dude told me "well with the amazing weather can you blame them for not wanting calls?". Again. This is Scotland. Not south England where they are! Whole other country and its not hot where I am. Which I tell them. Again so they know this excuse they've given, isn't really a factor here.

I've been understanding! One of the girls calling to update me last night is really nice. Thanking me for being so understanding etc. Like I get it. It's Sat night.

But this is when I thought they were calling any and all plumbers

Today I wake at 10:30 and there's been no call yet from insurance. Despite them saying they'd start at 830am. And obviously as the day goes on.... These emergency plumbers are gonna GET jobs that tie them up!

I call insurance company. The man tells me that they've been trying since 830 am and the contractors" either are busy or are just not answering. Same stuff they told me last night.

I burst into tears. I've woken today in agony. After a hellish sleep due to stress and anxiety attacks. In a full flare of my physical medical condition. Stress does that. And anxiety mental healths taken a tumble.

And what helps? My body pains? Long baths. That I can't have.

And the black floorboards that smell BAD, are worrying me. What if it's black mould and I'm breathing it in? I have a compromised immune system too... Infections can kill me.

Insurance man tells me he will go try the contractors again and, if not, then see what else he can do.

I already asked during first calls yesterday and they won't allow me to get anyone in myself to deal with it.

Lady also asked if we were in all night sat. I said yes. And she asked about Sunday (today) and I told her we'd be free til afternoon... It's knocking on the afternoon now.

    I'm in the UK. Scotland.

Tried Googling to try find regulations and rules or anything to do with this kinda thing. And how long they can leave a household in this situation.

I think it's a leak that's been coming from under bath for some time... But I'm no plumber. And we have no idea if using the toilet or sink is making it worse. But obviously we NEED to use those.

We only noticed the water situation when the wetness creeped from the lino bathroom across the doorway into the carpetted hall.

We lifted up all the lino to try see where the water extent went to etc. So lino is all up and in the garage which I told the first insurance lady. As we wanted to also let floorboards try dry out.

Anyone got any suggestions at all?

I could've had a plumber in myself by now. Who could at least tell me the black floorboards weren't dangerous and the toilet and sink isn't making matters worse. To alleviate some of the mega stress I'm under.

Coz the "bank hol weekend". The home insurance brokers can't discuss with my actual insurers coz they closed til Tuesday. And we've been told if they say no to the payout. We need pay for this plumber they're arranging. And it would've been costly enough on a sat call out rate... And now we are info SUNDAY rates. Even higher! Coz of them... And then we may need pay for it to boot!

Unhappy, stressed out and in increasing levels of pain here :(

Sorry for the rant. Just don't know what to do...

Please help! Grandparents have life insurance policies on my kids and I want this policy canceled

    Posted: 24 Aug 2019 11:38 PM PDT

My in laws have life insurance policies on my kids. My husband signed the consent forms without telling me.

The grandparents are the owners. My husband is the beneficiary as far as we know.

But now the relationship has gone south so we don't want them to have these policies any more.

How can we have them canceled? I know the company but will another agent be able to help me with this?

    Thanks!!

Edit to add: Does "insurable interest" matter here? They provide no financial support towards raising these kids. If something were to happen to my children, we are capable of paying for funeral arrangements. Would this make these policies fraudulent?

Does business insurance cover fraud perpetrated by an imposter?

    Posted: 24 Aug 2019 07:28 PM PDT

I hired someone who represented themselves as being with company A to do a job that did not get done. I paid them for the work up front. When investigating, I found out this person does not work for company A and I was actually defrauded. They have been identified and authorities are pursuing criminal charges. Does company A's insurance generally cover this type of fraud? If so, how do I start a claim? If it matters, I lost $2400.

Is it possible/how common for a small impact car crash to cause serious spine injuries?

    Posted: 24 Aug 2019 10:39 PM PDT

I hit a car at super low impact (10mph at best) about 6 months ago. Totally my fault, no excuses.

I smashed the bumper of the other car. My front bumper scratched with bumps and broken lights. My car is a suv and the other car is a small sedan.

I got a call yesterday from my insurance that the other driver suffered serious spinal injuries (or so she claims?).. apparently she's done MRI and is recommended by her doctor to undergo some sort of spinal surgery that may or may not permanent side effect.

I'm not too worried about being liable as I'm sure my insurance will take care of this and I have a pretty high policy limit (500k).

but my question is..is this normal? I'm not a doctor and i'm not saying she's lying but this seems excessive? She seemed fine afterwards. the damage to her car supposedly less than $1500 and didn't even damage the frame of the car. Is this possible?

Insurance adjusters, is this normal/common and totally possible?

My Dad’s insurance is cancelling his policy after filing a claim 2 years ago and is lying about why. What options does he have to fix this situation?

    Posted: 24 Aug 2019 10:36 PM PDT

I apologize if this has a lack of info as he just told me this story, but I'll try to convey all the details effectively. 2 years ago my dads pipes froze and broke, thus flooding the crawl space under the house, during a cold front that took place in South Carolina. He ended up filing a claim and they had to come out and inspect under the house, during which they ended up finding a crack in one of the house's support beams. This required structural engineers to come out and evaluate if the beam damage was due to the freeze and if it needed repairs or not. The new inspector came out, deemed the crack to be a natural crack ("surface crack") in the wood, not caused by the incident, and not requiring a repair. The claim went through for $7K and was supposedly over and done with after the repairs were made. Fast forward a few years and now Geico is claiming my Dad has ignored 17 contact attempts by email requesting a picture of the repair done on the beam in question, along with a receipt for the repair, and will now be canceling his homeowners insurance policy. He is unable to take the pic himself as he is out of state handling a long term family issue ATM, but also because the repair was never done nor paid for by Geico. He asked for proof of the attempted contacts by Geico and was informed that "they could see the emails but couldn't show/send them to him". Additionally, geico was going to send someone out to look at it, but my dad doesn't know when he can return to the state and doesn't want anyone on his property or in/around his house without someone there. What are his options in this mess?

Thinking of switching insurance companies. Will they know of a speeding ticket I got 4 months ago?

    Posted: 24 Aug 2019 06:47 PM PDT

Like the title says, I'm looking for a new insurance agency to save a bit of money from bundling my home and auto. Problem is, I got a speeding ticket 4 months ago that has not increased my current insurance. I've noticed when you do the online quotes or talk to an agent they ask if you've had any traffic violations recently. Can I lie and get away with it? Whats the best way forward? Any help appreciated.

Was rear-ended by motorcycle (We BOTH have Geico)

    Posted: 24 Aug 2019 07:48 PM PDT

Somewhat of a confusing situation. I was waiting to turn left at an intersection in my brand new Subaru Outback when I noticed a motorcycle pull up behind me. It caught my eye because the driver was not wearing a helmet and (being a motorcyclist myself) I know that law requires California motorcyclist to wear helmets at all times. Anyway, he fairly obviously accidentally hit the gas and let go of the clutch, causing him to lurch forward and slam into my car. We pulled over and it turns out that he does not have a motorcycle license and he was just moving it for his friend (a police officer who was intoxicated at a bar down the street...). He was also somewhat intoxicated himself, but was very cooperative.

Exchanged info with him plus filed a police report/obtained owner's info and insurance as well. Here's my problem though...

Since we BOTH have Geico, will I run into any issues filing for a diminished value claim? Also, because the owner was not driving, will Geico still cover this or will I have to pay my deductible? I've always hated dealing with insurance in collisions, so I just want to get an idea of what to expect.

    Insured to value

    Posted: 24 Aug 2019 07:35 PM PDT

Hello, I just purchased a home for $440,000 and my home insurance policy has a dwelling coverage of $200,000. I received a letter from mortgage company stating that Dwelling coverage must be for at least 80% of insurable value or 100% of Guaranteed Replacement Cost on the improvements.

I won't be able speak with mortgage company or insurance agent until Monday. What does this all mean? I'm clueless. How much coverage do I need ? This is from my home appraisal, not sure if it matters :

ESTIMATED REPRODUCTION OR REPLACEMENT COST NEW

    OPINION OF SITE VALUE =$ 369,000 Source of cost data LOCAL CONTRACTORS DWELLING 728 Sq.Ft. @ $ 180.00 =$ 131,040

    Garage/Carport 255 Sq.Ft. @ $ 50.00 =$ 12,750 *Estimated cost data gathered from local constructors and area Total Estimate of Cost-New =$ 143,790

Less Physical Functional External *Land value and the land/improvement ratio is typical of the area. Depreciation 71,895 =$( 71,895) Depreciated Cost of Improvements =$ 71,895 "As-is" Value of Site Improvements =$ 10,000 Estimated Remaining Economic Life (HUD and VA only) 30 Years

Would the $200,000 in dwelling coverage not cover it?

I am young and I know it

    Posted: 24 Aug 2019 03:49 PM PDT

I'm young and I know it. I'm just graduating from UCLA and now moving into a house with several friends. I'm living in LA so the housing is expensive, but I just found the perfect place (very excited). However the place I'm renting at requires $1,000,000 in rental coverage which I feel like is a lot? Is that more than the norm for renters insurance in a house in LA (and not a particularly fancy one). I don't think I'm being taken advantage of because the real estate agent wouldn't get the money the insurance company would, but still ?? Am I being taken advantage of / how much would this cost? Please let me know, thank you !!

Car deemed total loss by insurance post flash flood; keep the car or trade it for check?

    Posted: 24 Aug 2019 06:57 AM PDT

Okay, so I'm pretty new here and have been trying to find information on this topic. So far I have found quite a bit about flooded cars but no information on what happens after. I currently live in NJ. My street floods semi regularly for a few minutes at a time so I try not to park on the areas that do. I park my car in the street only as i do not have a garage. Recently I came home in the middle of a thunderstorm and parked across the street where I thought my car would be safe. I came out next afternoon to find the carpets and mats soaked on both the front seats and back seat areas. I also noticed the airbag and seat belt light were turned on the dash. I questioned opening a claim as my ded. is $500 but after researching the possible repair cost for the sensors for the airbag and seat belt I made the choice to open one. I was willing to bite the bullet for the $500 if they would cover the rest. I got my car detailed 3 days later as it began to smell and the seats were starting to dampen from the condensation (I was not able to air out the vehicle as it was raining the whole week and I do not have a garage).

The point I'm trying to get to is this: the inspector came by yesterday and said the car had a mixture of salt and freshwater (due to the drains on my street and where they lead) and since it got to the door levels and inside the vehicle the company had to total it. I was devastated as this car was in pristine condition with 47000 miles on it. I've had it for 4 years and received it with 15000 miles but it is a 2012 model. I also had power seats, a lojack installed on it, new tires and a backup camera. In the end I was given two choices: 1. Give up the car to the insurance at which point they'll give me a check for 40% of what I paid for the vehicle. (Clearly not enough to buy a vehicle of the same value imo) 2. Keep the car and receive a check with a lower amount (about $1400 difference). I was also told this would change the title of the car but I would be free to get rid of it as I see fit. I know if I want to sell the car down the line I have to disclose the history of the vehicle and I have no issue with that.

The problem is this; I love my car. It is of great sentimental value to me. I understand the car COULD have issues down the line due to rust and electronically failure . Has anyone been in this situation before and chosen to keep the vehicle? If so, did the premium go up as the car could be hazardous? Do I need to pay to get the car a new title? And where would it need to be inspected?

Any help and kindness is appreciated.

    P.s: I own the vehicle

I love being an adjuster. How about you?

    Posted: 24 Aug 2019 09:09 AM PDT

I never knew what I wanted to do with my life, career-wise. I got my BA in history just because I like history. When I couldn't get a good enough score on the LSAT to get into law school, I went back and got my MBA. I literally put all the specializations on a piece of paper, put them in a jar and picked the first one I grabbed...Healthcare Management.

After I graduated and was on the job search, a friend recommended being an Injury adjuster for insurance. At that point I associated insurance with sales and said Nope, not for me. Then I went to a job fair and spoke to several insurance companies as well as other companies. I submitted a lot of resumes.

At that point I was mostly interested in companies that had offices in TX (I was in WA at the time). Most healthcare jobs I was applying for were only regional but every insurance company I applied to had an office in TX. Anyway I got hired on by my current auto insurance co in non-complex auto claims. I hated it, but waited the requisite period of 6 months, applied for an Injury position and got it! Been doing it for a few years now and I absolutely love it.

If you've made it this far, thank you. I just love my job and I sincerely hope you do too.

PS...WA was awesome but TX was closer to family and with a child, being near family takes precedence. Id go back to WA in a heartbeat if I could.

The windshield of my car is cracked and it’s spreading, should I file a claim in my insurance?

If I negotiate a lower payment with the hospital I received a bill from will that reset or effect the deductible with my insurance?

    Posted: 24 Aug 2019 01:48 PM PDT

I recently had a hospital stay that ended up in about $6000 total bill. My insurance covered everything after the $2000 deductable which I owe to the hospital.

If I negotiate a lower payment or total bill with the hospital will that somehow effect what insurance will cover going forward? Like will I have to "hit" the deductible again?

    Don’t mess with my discount?

    Posted: 24 Aug 2019 01:37 PM PDT

    Cute commercials.

Does this mean that State Farm is giving a discount that depends on some GPS placed on your car 24/7 telling them where you are, how fast you go etc?

Does anyone know how they do this?

How long is the data kept?

Who might they share the data with? (If I drive to Target, will I start getting ads from them?)

What about sharing with law enforcement?

    What could go wrong?

Hope this isn't the future of all insurance.

In need a help with homeowners insurance policy and furnace issues.

    Posted: 24 Aug 2019 11:55 AM PDT

So my parents furnace ended up taking a shit and had to be replaced. During the repair the company that replaced it said this should be covered by insurance and to file a claim.

So we filed a claim and had the company replace the furnace. During replacement the said it flooded due to the condensate pan cracking and leaking down into the unit still said this should be covered.

Insurance calls said it's not covered since its ware and tare.... does this sound right ?

    CO,$1000 deductible. Furnace cost 3500.

    Are we outta luck ?

Car insurance: Can i avoid my car getting totalled by waiving supplemental damage?

    Posted: 24 Aug 2019 08:23 AM PDT

My car got hit by another car a week ago. I filed the claim on their insurance and they agreed to pay for the damages. I took it to the insurance's preferred body shop to get the estimates for the damage. After that I took my car to a body shop of my own choice.

The insurance already sent me a check for the initial damage estimates. But my body shop then found additional damage that the previous body shop missed from the accident. They filed a supplemental damage form to the insurance. Now I got a voicemail from the insurance agent that my car may be a possible total loss and wanted to speak to me about it. I tried calling the agent but it wasn't answered. I got the voicemail late in Friday afternoon and now I have to wait till Monday morning to call them again.

I don't know what to do if my car is totaled. I just wanted to get the body fixed and move on. The car is very old but runs very well. The damages were all cosmetic. Is there any option for me to just go with the initial estimate and avoid my car being totaled? If that is not an option, what would be the best choice between accepting a totaled car and getting the money and buying another car, or perhaps getting a salvage title and getting the car rebuilt and drive. I am in Pennsylvania if that matters.

Citi Credit Card Travel insurance claim denied - visit to Dad with stage 4 cancer.

    Posted: 23 Aug 2019 10:24 PM PDT

Hi All, thanks in advance for any help you can give me.

I had booked my family's annual August vacation flights to visit my parents in Japan, but I found out that my Dad was diagnosed with cancer in July. I had to quickly change plans so that I could fly out immediately with my family joining me after. Everyone's flight dates changed, and all told, the cost to cancel our existing travel dates and rebook cost about $2000. Luckily (I thought) I had bought the tickets with my citi credit card so after reviewing their travel insurance policy which covers family member's life threatening illnesses, I contacted their benefits dpt and submitted various documents they required.

I was informed today that my claim was denied because they are trying to classify this as a travel interruption - not a cancellation. Here's their definition of the coverage:

"Trip Cancellation coverage begins on the date the Trip was purchased and ends on the Trip Departure Date. Trip Interruption coverage begins on the Trip Departure Date and ends on the Trip Completion Date."

According to Citi, since my travel was "interrupted", not canceled, and I was not traveling when I had to change my travel plans, I am not entitled to reimbursement. I of course disagree because my existing flights had to be cancelled and rebooked to totally different dates.

It seems like if I was traveling to somewhere else like Spain, and then I had to cancel those flights and then book a trip to Japan because my Dad was sick I would be in the clear. However, because I had been planning on traveling to Japan and the destination did not change, they are trying to slimily slip out of reimbursement by saying it's an interruption.

I have a call scheduled with the adjuster next week. Any advice or insight from people knowledgeable about travel insurance would be hugely appreciated. Dealing with my Dad dying while these guys try to play lawyer ball with me is really taxing.
