Posted: 08 Aug 2019 03:00 PM PDT I made a post several days ago and since then the insurance has informed me that they cannot pay for the damages to my car because the cyclist was liable for the accident. I was in the middle lane when a car swerved into my lane and hit my car, causing $5k in damage and my car is undrivable. Are they correct in placing no liability on the driver who hit me? My insurance adjuster initially told me that while it was understandable that the other driver would swerve to avoid hitting the bike, he was still responsible for the damages to my car. This insurance adjuster told me not to contact him any further because we weren't dealing with my policy because I only have liability. He referred me to the adjuster of the other driver (same insurance company). I'm just trying to better understand the laws and whether my insurance company is trying to give me an excuse or if I should continue fighting this matter. [link] [comments] |
Paid for car detailing job, car got hit, can I ask for a refund? Posted: 09 Aug 2019 02:59 AM PDT I'm not sure if this belongs here, but please remove if it doesn't. I recently paid a detailing shop for a ceramic coating job. They usually charge half the price up front for materials and half at the end, but due to unrelated reasons, they weren't going to charge me for labor. As a result, I paid up front for the coating itself. However, a couple days before I was supposed to bring my car in, it was hit in a parking lot (hit and run, no idea who it was). Tesla takes forever to ship parts, and the body shop estimated about a six month wait time and a two month repair time. Insurance agreed to pay for everything. Now, obviously I wouldn't be getting the coating done until the car was repaired, but the owner said that he had already ordered the coating and couldn't refund me. Instead, he told me to let insurance know about what I paid him and show them an invoice and they'll reimburse me. Is this actually a thing? Out of network for primary insurance, in network for secondary insurance Posted: 09 Aug 2019 01:29 AM PDT Due to a costly mistake, my wife gave birth in a hospital that was out of network for her insurance (BCBS). We just got a bill for $8000 (BCBS is covering some of the $14,000 bill). Since my wife is leaving her work for the baby and is therefore losing her insurance, I put her on my insurance (an insurance company called Independence Blue Cross). Therefore, I realized my wife was covered by her insurance and my insurance for that month. I had the hospital submit the bill to my insurance as the secondary insurance and set up the coordination of benefits with my insurance. I know I need to wait right now for everything to get handled by my insurance, but that $8000 bill over my head is freaking me out. Does anyone know what I might expect from this? Is my secondary insurance going to possibly cause an issue because we used an out of network hospital for the primary insurance? (Hospital is in network for secondary insurance). Here is the paragraph on Coordination of Benefits from my insurance benefits packet. It's somewhat impenetrable, but that statement about not maximizing my benefits under the primary plan has me concerned. Effect on Benefits When the Program is secondary, the benefits under this Program will be reduced so that the Program will pay no more than the difference, if any, between the benefits provided under the other Plan for services covered under this Program and the total Covered Services provided to the Member. Benefits payable under another Plan include benefits that would have been payable had the claim been duly made therefore. In no event will the Program's payment exceed the amount that would have been payable under this Program if the Program were primary. When the benefits are reduced under the primary Plan because a Member does not comply with the Plan provision, or does not maximize benefits available under the primary Plan, the amount of such reduction will not be considered an allowable benefit. Examples of such provisions are Penalties and increased Coinsurance related to Precertification of admissions and services, In-Network Provider arrangements and other cost-sharing features. I've seen various job ads looking for unlicensed people promising to teach newbies how things work, to get licensed, etc. I've already passed other professional licensing exams so I'm not stressed about that - but I'm curious if there are companies or arrangements that are considered especially good (or especially bad) within the industry. I don't need immediate cash flow, so I can be flexible about 1099/w2/etc. If you could start your career over again, are there things that turned out great that you're so happy you did .. or things that sucked that you wouldn't do over again? Need advice after being rear ended Posted: 08 Aug 2019 11:06 AM PDT Hello, I'm hoping to get some solid advice. This is the first time I've been through something like this and it is really stressing me out. This whole thing has been a goddamn mess and probably the worst month of my life. I was rear ended on 7/10/19. Police report was filed, and the other party was at fault. This takes place in Iowa, USA. I went to the ER and had tests done, was diagnosed with whiplash. Doctors also found a 'nodule' in my throat that they referred me to a specialist for. More on this mess later. The other party's insurance offered:
I am planning on getting the car fixed. I've done a good amount of research on this and believe I will come out okay in that aspect. As for the medical and lost wages/pain/inconvenience, this is where I really need advice. I've already contacted a few personal injury lawyers and most are not interested in taking the case. Back to the previously mentioned 'nodule' that the ER found in the initial visit:
My question about this- Would it be out of line to ask for the at-fault party's insurance to cover these visits? It's upwards of $2,000 + lost wages. The way I see it is, I would have never gone to see these specialists if I had never been rear-ended. I can't say for sure if they were directly related to the accident though. Lost wages/pain/inconvenience: So they offered $1,000 lump sum. I feel like this is a slap in the face.
If I'm trying to negotiate with the insurance agent, do they have a ceiling on how much they can pay out? Do I need to ask her to send me to someone higher up? I would really appreciate some help negotiating with the insurance. This is all completely new and kinda scary to me. I'm seeing all these medical bills rack up, my s/o have been on the rocks ever since this stuff started happening, I'm worried it's affecting my job, etc. Please don't hesitate to ask more questions. My insurance bill came for it and they are covering $0 and charging me in full since I haven't met my deductible for medical equipment yet. I understand that. The issue is they are saying their rate for it is more than 3 times the actual retail cost of the same exact nebulizer anywhere else (both online and in stores). They're saying there's nothing I can do as that's their rate for it. To my knowledge, no one was hurt and he exchanged info with the other driver. I left it up to him to handle that. Neither him or the other party has filed a claim. He doesn't want to because there wasn't a lot of damage. Before then we were talking about changing insurance providers. And I still want to because of the cost. Car Not Totaled - Repair Cost Question Posted: 08 Aug 2019 12:01 PM PDT Hey everyone, I just had a quick question. My sisters car got hit by another when driving. She's fine but her 2014 Subaru was not. It took some time but eventually the car was deemed "not totaled" and a mechanic shop is currently fixing it. Well, while was getting fixed, the repair cost was actually more than originally thought. It's costing actually more than the number the insurance company was using to determine if the vehicle was to be totaled or not. Just curious if there is anything my sister can do now. I mean she'll like her repaired car but I guess I don't know if there is any recourse for her or what. I don't know what would even be best for her. I was the first car hit in the collision, and then pushed into another car (same with all of the 3 other cars). I called my insurance company while waiting on the officer, so now there is a claim under my name. Today I called the insurance company back to get more information, while I'm waiting on the police report to get the insurance information. I gave my insurance company a statement. I'm 99% sure my car is totaled as all air bags went off. I already told my insurance company this morning that my only injuries at the time were a ringing in my ear and slight deafness from the air bags ( I already set up an appointment with a ENT to get an audiogram). Now as the day has gone on, I'm starting to have some neck and back pain, and it is painful to turn my neck. My parents want me to see their chiropractor, who works with a lawyer that can take care of the claim for me. I have not filed any claims yet with my insurer or the guy who caused the collision. Other driver backed into bumper Posted: 08 Aug 2019 11:49 AM PDT NY. Was stopped at a light on a hill, bit of an incline. The car in front of me starts rolling back, I blow the horn as I see them coming into me and they back into my front bumper. Part of it detached (which I sort of popped back in at home, but do have pictures before the "fix"). Bumper wasn't in the best condition dude to prior incident years ago, but which he hit me that part did detach. Police come, his wife tries to say they are not at fault and my bumper was already like that. Then a story of how I drove into them (no damage to their car btw). It was just me in my car, there was at least 3 adults in theirs (maybe some kids i didn't see) and I know she was telling them to go along with this story of hers. Won't get the report for a few days. Any chance filing a claim will actually benefit me in the end or worse they flip this on me with the extra accounts? OH - Lowball offer from at-fault's insurance, won't budge on prelim estimate. Posted: 08 Aug 2019 02:51 PM PDT I was hit by a Farmer's policy holder, damage only to one door. Submitted pics through their app, but also obtained 3 estimates from local shops. The estimate from the app came in $700-1200 below all of the shops' estimates on a $2500 job, with big gaps in much of the work (no R&R for quarter glass or moldings, etc., time which is on all 3 shop estimates. They're 5-9 hours short on a 20 hour job). I grew up in the auto repair industry, understand the business, and most likely will repair it myself. However, I'm getting screwed if I take the prelim offer and don't take it to a shop. I sent the estimates to the claims dept, and they refuse to budge, only telling me, " it's a prelim offer, take it to the shop and, if there's more damage, we'll work with them." While I understand their position, it's underhanded to not estimate the true full cost initially. Do I have any recourse on this? If I have them send an adjuster out, would I get a more comprehensive estimate? Looking to Get Private Insurance Posted: 08 Aug 2019 09:41 AM PDT First time poster, so sorry if this violates any rules/doesn't contain enough information. I'll try to be as thorough as possible. I am a 20 year old female in the United States (Florida) looking for private health insurance. I would like to have coverage for therapy, OBGYN, vision, and dental (if all four are not a possibility, I can settle for one or two). I have been paying out-of-pocket for EVERYTHING including crowns,. fillings, OBGYN visits, etc. and it's kind of blowing my savings account out of the water. I figured that the monthly premium for private insurance will be less than what I'm paying for all of these services. I do not want to be on my mom's insurance plan as dependent because of privacy and personal reasons. I have looked for insurance before, but I'm not exactly sure how to apply without being taken in circles from site to site. Here are my questions:

In a collision with someone on same insurance company, getting screwed? Posted: 08 Aug 2019 01:22 PM PDT I'm looking for insight, please: On the 29th I was in a collision. I was driving in the right hand lane of a two lane road and he was merging onto that road from a merging lane on the right. I had vehicles boxing me and could not have avoided the collision. He was cited for negligence. We both use the same insurance company. They made a decision within 4 days, solely off our statements, that neither party could be proven at fault. He told his adjuster that I was in the left lane and merged at the same time. They did not have a police report at the time they made the decision. My adjuster has convinced me to temporarily file a claim on my policy, because I couldn't afford a rental vehicle myself. That decision was made the morning of last Friday. I was able to obtain the report and turn it in that same evening. Now, my adjuster says it's not enough to overturn the no fault decision. Basically, I need video evidence to change it. The police report states, without mincing words: 1. I was in the right hand lane. 2. He was "100% responsible for safety during his lane merge." 3. He was cited for negligent driving 4. He stated that he saw me in the right lane. With those 4 points, how can an adjuster still find no fault? Not only has the county recognized him as at fault, he gave a statement, on body cam, that supported a different version of events than he gave his adjuster. When I asked my adjuster this, he gave me the number to the other guys adjuster. Shouldn't my insurance be fighting for me harder? I'm now out a deductible and at risk for a higher rate. I don't know if I have a reasonable complaint or am just angry. Before he ran into me, the other driver looked me in the eye, flipped me off and started yelling. He wanted to merge but I was in lane with no where to go. He endangered my children and that makes me angry. I have no way of proving that, so can't go after him on it. Does disability insurance for professional Posted: 08 Aug 2019 12:32 PM PDT Agents are encouraging me to purchase addition DI but I'm thinking it's unnecessary. A little info on me, I have a DI policy that would pay 39/year, my base expenses are 27k/yr, I earn about 120k. (The bulk of my income goes to savings, charity, or some dining/travel costs which I don't consider base expenses. I also consider my roommate income as offsetting house expenses.) If I was disabled, I would still make 50-80k in residual income so DI wouldn't even kick in unless I increase coverage. My current policy pays to age 65. At that time my current accounts should have grown to a number where I could retire. The agents keep saying I need to lock in insurability because I might increase my spending when I have kids as an example. My current policy has a crappy exclusion for mental health issues exceeding 2 years and I do need a functioning brain to work(not for residuals). I might want to switch policies just for that. Scary Car Accident Injury Settlement Questions - California Posted: 08 Aug 2019 12:41 AM PDT TRIGGER WARNING : INJURY DETAILS Figured this would be a good a place as any to get some information. In late 2017, I recently moved to a new city in California to be closer to my girlfriend who received a job in said city. After moving, and living in town for a week, I was hired at a local Hotel, due to having an extensive background in Hospitality, and was told to start the next week. The same night I was hired, I was involved in a serious car accident. The other driver lost control going 55/60 in a 35, going around a winding turn, overcorrected, came into the other lane and fishtailed our car, totaling it. I was the passenger in the front seat of our vehicle, my girlfriend being the driver, not severely injured (thank goodness, already settled, finished and moved on ). I, on the other hand, unfortunately suffered a non displaced fracture of my Coccyx, and a Traumatic closed fracture of my Sacrum. Now, the damage to my car was so severe, that the EMT had to classify the car crash as "traumatic", something about the indent of the frame being bend in more than 11 inches? I don't quite remember the details, anyways, because of this, EMT's were forced to transport me to 60 miles away to a different city, because the hospital in the city I live does not have a Trauma Unit. 60 miles on potholed country road, flat on my broken back, and ass. No amount of Morphine could make me forget that hour, believe me. Let's fast forward. Sorry if I skip around, lot's to cover! Since the car accident happened the day I was hired, that made working my new job very difficult. Long story short, I lost that job without even working my first day. That's just the start! Let's move ahead. Around a 40 days bed rest. Several months of Physical Therapy. Bladder problems. Pain Urinating/Pooping. Urologist. Cystoscopy reveals damage and new scarring of my bladder. Blood in urine for several weeks after procedure. Blood in Urine ceases. Resume sexual activity after a month of healing. Blood in semen. Fun. Further healing needed. Pain during defecation subsides eventually. Decide against further surgical procedure to test Bladder nerve function. Fast forward more. Well into 2018, still not working, due to new numbness and pain radiating down into my left leg. Legs behaving strangely, losing strength. Still have not closed medical treatment, so see doctor again. Sent to Neurologist. Neurologist confirms nerve damage in S1 L5, as well as Lumbosacral Radiculopathy. Neurologist gives me an option of back surgery. I ask for Chiro. He agrees. Insurance approves Chiro twice a month. It helps. 3 more months of Chiro and my own personal workouts, and pain is starting to become somewhat managed. (I would take this chance to point out during this entire time I never allowed the doctor to prescribe me pain medication. The family I moved from was addicted to drugs.) Now, the time has come to close out, and settle. I live in California, and I have Medi-Cal insurance, as I was unemployed during my initial move, and signed up to cover myself while I was unemployed - (could you imagine if this happened to me without health insurance, my god) - which will effect the pricing of my bills due to their unique negotiating. I basically just want to make sure that I can continue to live my life after this accident. It's becoming pretty clear that my level of physicality has been significantly decreased. My employment in hospitality has always been based around my size, and strength, which I would say I am only at about 65% at best. That's nothing to say about the sheer anxiety I feel around vehicles now, let alone angry or unsafe drivers, and let's not even talk about the nightmares. I am just very curious what to keep in mind when their adjuster offers a settlement. The other driver was completely and admittedly at fault. Thank God, through all this my girlfriend has stuck with me, and has been keeping me afloat during this time, she saw me at my lowest, struggling to regain my strength just to walk again, and I just want to make sure I can do right by her. I would like to make sure I have enough money to cover all the bills that my insurance will want me to back pay after my settlement, but I am not entirely sure how to calculate my "pain and suffering". There is just so much over the past year and half.. What do I include? We can't exactly afford to get an attorney, we've spoken to a few, and most seem disingenuous unfortunately, so I would prefer not to involve one if I can avoid it. My only problem is, the claims adjuster has been a little shady to me throughout this process, trying to get me to settle early, and without finish treatment. I don't like the feeling that everyone is taking advantage of me while I am hurt. Now that it's over, I just want to make sure I get treated fairly. Surgery Coverage Denial Question! Posted: 08 Aug 2019 08:19 AM PDT So my dad has been prolonging his hip surgery for years because he does hard labor and the surgery meant not working. This also means he is in constant pain. Until recently he had been dealing with the pain but it has gotten to the point where he just can't handle it anymore. Just for an idea his doctor has been telling him he needs the surgery for 3 years. After a couple of months a slot finally opened up for the surgery but we just found out today (less than a week from the surgery) that the insurance is denying coverage because they dont think he needs it. They want to talk with the doctor doing the surgery on the phone to determine if he needs it. The hospital is saying they can't schedule that due to how busy the doctor is. If my dad doesn't get this surgery it could be another 6 months and his hip could completely dislocate by then. We don't really know what to do and there isn't a lot of time to do it.
