Posted: 14 Jun 2019 07:42 AM PDT To be clear, this is not New York City. TL;DR: Wife and I let an old friend of hers who is going through a hard time stay with us for a while. When reminded that he'll have to move on soon, he made a pass at my wife and flipped out on her when she declined his advances. He then had a locksmith install a deadbolt on the door, despite not presenting them with a lease or deed to show that he has a right to get locks installed. Now what? Questions at the bottom. A childhood friend of my wife's (call him Pete) moved back to the area after the death of a parent and losing his job. We offered to let him crash in our spare bedroom for a month or so while he gets things figured out. Pete moved in on 3/28, and we had him sign something that said that he'd split on 6/30 whether he had his shit sorted or not. This was partially to put a hard limit on the amount of time he'd be living with us, but primarily because my brother is going to spend about six weeks in town for work starting in mid-July, and will be staying with us. Pete didn't seem to be in much of a rush to find a new job, let alone find his own place, but he's in a bit of a funk due to the whole situation so we'd been giving him the benefit of the doubt. On 6/1, my wife reminded Pete of the fact that he had to go at the end of the month, he said not to worry and that he'd definitely have something figured it out by then. She gave him the same reminder this Wednesday (6/12). I'll spare you the details, but this time Pete countered by confessing that he'd always been in love with her, and that she should leave me and i could find a new place while they stay in the apartment (which is sort of funny because while I consider this to be her apartment as much as mine, I purchased it before we met and her name isn't on anything). Anyway, she obviously shut this down immediately, and Pete did not respond well. At all. No violence but a ton of shouting, insulting and attempting to guilt trip. It was intense enough that my wife just cut out to her mother's place, where she called me to fill me in on the situation. I went home from work and told Pete that we'd stick to the agreement despite his behavior, but the sooner he was out, the better. I spoke to my wife later that evening and we decided till Pete fucks off, she'll stay in an investment property of mine that is luckily vacant right now, but I'd start working remotely and stay at the apartment more or less 24/7, both to make sure Pete doesn't do anything stupid and because my presence in the living room would hopefully be more than a little awkward for him. So this morning around 6:00 I left to run to the office to grab some stuff I'll need while working from home. I got back to the apartment about half an hour ago, and as I stepped out of the elevator I saw a guy with a toolbox leaving my apartment and immediately noticed that a new deadbolt had been installed in the door. I tried to explain the situation to the locksmith but he basically told me that the lock's already in and he gave the only key to the guy in the apartment, so it's between the two of us now. LOVELY. I asked him for a card and he said he didn't have any, so I asked where he works. He told me that it isn't any of my business and reiterated that this is between me and Pete. I followed him downstairs and luckily he was in a van that had a sticker with the company's name and info on the side. I called the number, asked to speak to the boss and told him what had happened. He more or less did his best to not answer any of my questions - "I'm sorry but I don't have to inform you of our policies." Fun. So this is where I am at now. I called the police just to get a report filed, but I am 100% sure that when the officers show up they're going to tell me that it's a civil issue. I'm not expecting them any time soon, as this is a pretty small potatoes deal in the city where the whole thing is taking place. I was actually all set to offer Pete a cash for keys deal if he wasn't getting his shit in gear by 6/23, but I have a feeling that I am going to have to evict now. I own a few investment properties and have gone through the eviction process before, so I know that will not be a fun process given how tenant friendly my state is, but it is what it is. We've got that vacant rental property to stay in while everything gets sorted out, so that's covered as well. My only questions now are about who I can go after for what. ------------------------------------------------------------- On that note, here are my questions: I am going to lose money on the rental that my wife and I will be staying in while the eviction gets handled. In fact I've already done so, as I had just started advertising it and will now have to pull the listing on a few sites/drop a "sorry but" on anyone who responds to print ads I placed. Is this something I can sue for? In my mind I'd name both Pete and the locksmith company in a suit and let the judge decide who owes me what, but since I am making the decision for us to occupy the space, do I technically have damages? When I got a deadbolt installed at my old rental, I had to show the locksmith a copy of my lease before they'd even touch the door. Was that just a company policy they were following or is that mandated by law? If the latter, is there anything I can go after them for? I don't care if it's trying to get criminal charges pressed or just going the civil route - I am not hurting for money so frankly if I were to sue it would be more about taking the pound of flesh that I feel I am entitled to after they locked me out of my own home, but I'd be just as happy seeing the pound of flesh extracted in a manner that does not end with me in possession of it. Anything else that I should be thinking about in this situation? I am planning on asking the police to do a civil standby or whatever it's called so I can get a few important things out of the apartment. I am a little flustered and pissed off right now to say the least, so I just want to make sure that there isn't anything I should be considering beyond that. The landlord was also renting out those same acres to a man with cows. She was double dipping. The man that owns the cows shot both of my mothers dogs. My mother was given two tickets per dog and a court date. The man says that the dogs were chasing his cows around, my mother says differently, and the police did not record much in the police reports. My mother moved out of the property breaking the lease because she couldn't live there any longer after what happened, she has videos of the property before she left. The landlord is trying to charge her 10,000 dollars for damages when nothing was wrong with the house when she moved out. She has hired a lawyer but hes from the area and she feels he isn't actually trying to help her and that he may just be buddy buddy with everyone. A neighbor stated that the guy that shot the dogs does this all the time. She is lost and upset and doesn't know how to proceed and I am hoping you guys can help her. This happened in Cheyenne Wyoming. One dog was shot directly in the head and it looked like the dog had just walked right up the man. My boss's husband is a jeweler, so I gave him the ring for repair and a clean. I assumed it would be a quick re-tip and voila, all better. He informed me that the center stone is not, in fact, a sapphire as I told him, but an indicolite. I pulled the receipt for the stone, and it says that the stone is a "true sapphire (blue)". My husband had the stone set at Kay Jewelers in 2014. Do we have any legal recourse here? I just want the stone we paid for. I couldn't find any paperwork other than the receipt, but it doesn't say anything about an indicolite on it. A family friend (40s) slept in a guest room with his family because they got drunk. He ended up in my room touching my genital area/butt over my pants/blanket. I told him to leave. He came back 10 minutes later and was stroking my friends arm. We screamed and saw him crawl out of my room with his pants down. I've been staying with my friend from school's family for a year and a half now, so these aren't my parents, but my guardians that took me in during my senior year of high school. The next morning they calmly got the guy and his family out not confronting him. He's a very big guy and they didn't want to do it in front of his children. Lucky for us, we have video cameras in the house. They watched the videos, but wouldn't let us, and explained that he was tiptoeing around, but came out of the room with his pants on. They were very skeptical of our story and seemed to be trying to convince me, my friend, and my friends parents not to press charges. We ended up reporting it anyway. So after reporting it, I was asked by them to hand the case over to the state and not to be involved anymore or I wouldn't be welcome at their house. The reason being, that the father that I've lived with could get his son taken away if his mom finds out. I'm unsure of how that would work as the boy wasn't even in the house when it happened and their names/address aren't part of the case. They even asked the police what would happen if the videos from the night somehow got deleted... Well the cherry on top of all of this mess came yesterday. My friend and I met with the detective and he received the videos from that night. He allowed us to watch them with him. The videos clearly show the guy undoing his pants and then reaching in and playing with himself before walking into my room and then pulling his pants back up as he leaves. The couple I've been living with told us that it could've possibly been nonsexual and just him wanting to hang out with us, they questioned us, and they tried to convince my friend's parents that it wasn't bad just to keep us from pressing charges when they knew the videos proved our story right the whole time. I just don't know what to do now because the family that gave me support when my own family kicked me out has turned on me because of this perverts actions. I don't know how to work this out with them. Could it even effect the dad's custody over his son?! We did a walk through and were given keys of the finished unit on Monday, and everything was fine. Today was our move in day, we showed up before the movers. Only to discover ~2 women sitting on blankets in our living room. They got extremely defensive and claimed they paid to rent it, and i called the police. I walked around the back and the patio door looks like it was shattered. The police came and i I provided them with all the paperwork showing we are the owners. However he came back with a "Residential Tenancy Form" that was apparently they both signed (half of it seemed to be blank). The landlords name is someone who i have no idea who they are. On top of that the kicker is that apparently their monthly rent is "only" $250/month. After about 2 hours of back and forth of this, the police officer gave us a report number and recommended we seek legal aid. However he cannot remove them from the premises until he is able to talk to the "landlord" who apparently no-one can get a hold of. After he left one of the women came up to my wife and basically told her they would leave for $15,000 no questions asked. I offered them $500 and she laughed at me. From when we were in there the entire house already stinks of cigarettes, and i am pulling my hair out because of this. I am trying desperately to get in touch with our lawyer, we talked briefly to building company and they told us as soon as they gave us the keys it isn't their problem. This can and does happen at all hours of the day and night and has persisted for several months. I've had enough. When it happened again yesterday I jumped in the car and tracked him down to his house, about 2 blocks away, confronting him about his actions. He stated he honks because, "those cars are always parked on the street." That's right, he honks his horn because he dislikes my neighbors (legally) parked cars across the street. Rather than say (or do) anything incriminating/stupid, I left. Since then, he has escalated this honking, to the annoyance of my family and our neighbors. Legally, what can be done about this? They asked to only get their clothes 3 times in as many months. Conflicting schedules prevented this. After 3 months I told them they needed to get all their things. I found out they have sneaked in (still had a key) and have only taken what was convenient for them to. I feel like my privacy has been violated. For the 8 months they lived here they didn't pay rent or utilities. I'm wondering what rights they have and what rights I have when it comes to the rest of their things. Edit: this is an apartment. I meant that I let them not pay rent or utilities because they were in a bad plane. That being said, they never offered to pay for anything either and they moved out because I started having trouble paying my bills. I never wanted their stuff to be in my place after they left. I don't want to keep any of it either. I'm just tired of feeling like a storage unit at this point. I tried to have them get it multiple times while they only wanted to get their summer clothes. I know it was them because they admitted to it. I had the locks changed this morning. Posted: 14 Jun 2019 08:45 AM PDT Hi all, (In Oregon) My wife was driving when she was hit on the driver's side by an uninsured driver who ran a red light (driver was cited for running the light and for no insurance). The injuries to her are pretty significant as well as they found fetal blood in her which means something happened to the baby (but it's nearly impossible to determine what with ultrasounds). It has been some time from the accident and my wife is recuperating. Baby is due shortly. The other driver has no assets so it is just us and our own insurance company to work on a solution. We have the max coverage for everything including uninsured coverage ($xxk per person). I've had enough experience to know that insurance companies want to protect as much of their money as possible. They said they'll put the driver into collections for everything. The main question I have is, does the unborn child count as a person? A high risk doc mentioned that we may not see injuries for up to 3 years (at the developmental stage). The insurance has already started using the word fetus rather than child. Two concerns I have is the cost associated with going after more money may be a wash (from some searching online I don't see a precedent). Secondly is the concern of being dropped by the insurance (I assume that means we will pay a higher rate going somewhere else. I lean to getting a lawyer if there's a significant chance of getting anything just so that we can have it in a growth fund to hopefully grow to help if anything happens. I guess a final question is, does my child have the right to go after the at fault driver in the future (or open up it's own so insurance claim once it's born (I've read minors statute goes to 18y/o+ 2 years) or is this a grey area? I didn't really mind that much, because the pay was still great. But now its summertime in Utah which means occasional thunderstorms. This has me kind of worried because we work pretty high up and are expected to just work through them. For example, last night we all got an alert from the National Weather Service about a severe thunderstorm warning, but my manager sent us out anyways. We were out for like an hour and a half as lightning was striking every 5-10 seconds sometimes as close as two miles away. Is this legal? I wouldn't be that bothered if my manager was also working outside but he wasn't, he was being extremely flippant and told us if we were worried to "knock on wood". We have 3 children together. I got a vasectomy after our third child. We got into a shitty situation with drugs and dcfs took my kids and placed them with my mother. After almost a year my ex and I split up but we are still married. She got with a few other guys immediately after we split and ended up pregnant. Well last night my case worker came to my mom and asked her to take the baby when it's born. My mom said that the baby is not her grandchild and she will not take it. The caseworker informed her that even though biologically the baby is not mine, I will still legally be the father and will end up having to support a child that I had absolutely nothing to do with creating. I just found this out about 20 minutes ago and I'm going through a whirlwind of emotions. I got a vasectomy because I knew I didn't want to take on the responsibility of another child. This just doesn't make sense to me and I honestly want to cry I'm so pissed off right now. Will someone please try to help me with this? Basically he paid me 10k via quickbooks then had me to wire the balance to this other vendor and paid me a percentage for my troubles. Yes this sounds shady and I didn't ask a lot of questions. Then, I had to make a copy of his drivers license for a contract and saw that he was born in 1963. The Vietnam War ended when he was 12. There's no way he could have been in that war. He acts/looks like he's about 10 years older, which is why everyone thought that was plausible. If I know the truth and allow him to keep lying to everyone (especially to clients who are actual Vietnam veterans), can I get in legal trouble? How should I report this? It all started when I was asked to help with ideas with process improvements within our department. After sending ideas to her and her manager, who I'd also had this conversation with, my supervisor took me into a room and yelled (yes, screaming) at me for "going over her head to her manager" about the process improvements, since one of the ideas unintentionally made her look bad. Fast forward to this past Wednesday. I do enrollments for Federal COBRA insurance, I work for a TPA. There was an issue where the account rep for this client notified us of a COBRA enrollment that was over 90 days retroactive, with a carrier who has a 60-day retroactive guideline. During this process that started in March, I was notified that the Department of Labor was involved on the case. I was not given any additional information besides that. So I had made sure to be responsive and follow all guidelines during the process. Last week, the insurance carrier asked for the signed medical election form, which we did not have, but another team had wrongly updated the account to reflect that we did. Since the account showed that we had all the information, I sent the enrollment to the carrier. It was initially denied since it was too far retroactive (this is when DOL got involved). We sent another request with an exception letter signed by the company. Last week, the carrier asked for the signed medical election (which we did not have) and the account rep asked me to send the client and member an update via email. Our TPA does not license us as brokers, so I sent an email to my supervisor for assistance on the email so that I didn't say anything that would get myself or the company I work for in trouble. I also explained how the members account was updated incorrectly by the other team and we did not have the medical election, only dental. She then got up from her desk and came to mine to verbally tell me that I should cut the members signature from the dental election and paste it to the medical election, as if the member completed it (note: to avoid a paper trail). There was an internal email chain where the account reps and other supervisors were on. After she left my desk, I sent an email to that team saying "I do not feel comfortable cutting and pasting a members signature onto a new form, because the DOL is involved and this is not something we usually do." We sent the original form that was actually signed by the member and it was accepted and processed. I know that cutting and pasting a members signature is insurance fraud. I'm going to our HR department on Monday to let them know about this situation. I think my supervisor asked me to do this because she is trying to get me fired for making her look bad, and she has never liked me personally. There is an in-app money transfer tool for Bank of America called Zelle, which transfers money to another Bank of America user using either their phone number or email. Well, since I was overseas at the time, I asked my landlord if it was possible to send her the money using the tool. She immediately agreed and told me to send it using her phone number. Well I sent it using the phone number, screenshotted the confirmation with the correct phone number visible and sent it to my landlord. 4-5 hours go by and she informs me she did not receive the rent. I call my bank and talk to them where they inform me big transfers can take up to 12 hours (the amount deposited was 2200$). My landlord proceeds to tell me after all this that her husband had not added her current phone number to her bank account so it must have went to the wrong account. 12 hours go by, so I give the bank a call, and they say they can file a dispute. I try to explain to them that it went to the wrong account due to my landlord not updating her phone number on file. They told me to wait 15-20 business days and informed me there was no guarantee I would get the money back. I asked them what would happen if the person it got sent to uses all the money, they told me there was nothing they could do in that case. My question is can my landlord charge me rent a second time due to her mistake? Some background. 10 years ago I was charged with a failing to report an accident/failing to stop at a PI incident. I layed down my motorcycle on some gravel when I was 19 years old. I didnt report it because I was unaware i needed to since I had the lowest form of insurance and I only damaged my $2000 motorcycle and myself. I called my brother to take me to the hospital and had my bike towed home, but Somebody called 911 for me and a sheriff found my bike and had it impounded and they called me and asked me to file a report to get my bike back. I went to the county building i was asked to go to. I was told to pay money for my bike and that was it. I was never told to talk to an investigator or officer when I was there. I got my bike back and that was it.... 3 months later I got a arrest warrant in the mail. I paid my bond and went in for the hearing. I plead not guilty claimed I didnt know. They took half my bond and gave the other half back and let me go. 10 years later, I receive an "Order for Fingerprints" from THAT case!! The letter says its so i wont have Charges shown on my record if an employer record checks me. My question is: am I legally required to do this or can i just ignore it and go on about my business? This doesn't add up because she started withdrawing the money the day I was laid off despite having full severance pay and benefits for the next 3 months. Now she's demanding a divorce, and suggesting shes going to be very aggressive about it. It seems pretty obvious she was siphoning off money to somewhere else (another account, cash?) preparing for this . The account and the funds in it were mine and existed prior to getting married. She never discussed withdrawing money from this account. No Prenup. Is this legal ? Assuming it's legal what options do I have for recouping this money, does someone have a right to know about all assets and bank accounts their spouse has? Any general advice ? Thanks! (QUEBEC) New neighbor TEARS OFF our hedge for parking spots Posted: 14 Jun 2019 12:51 PM PDT To start of, I know my english isn't perfect. I am enraged. Recently, we had our neighbor move out. She was nice. Some company replaced her house and made it a triplex. Okay, that's fine except that now they can see our backyard from the second floor. Whatever, they're not that bad... that's what we tought. After this winter they started doing their parking spots. Now here's where stuff gets criminal: in Quebec (Canada) we have a limited parking place. Let's say they got a mysterious "license" to have more space. They began calling and basically said that they will "cut" our hedge and send us the bills. That's already illegal to do. After that, my mother had an agreement with some guy in the company and he said that he would first make my mother sign something before the company tries to do something to our hedge. Today, while I was watching reddit videos I heard weird sounds. Whatever, they're doing something to the parking I guess. My mother came home from work a few minutes ago and said "Where you there when they cut the hedge?" Fuck. They did. Not only that, but the hedge-remover company thing did'nt even make my mother agree something. If it's like that then I guess I can just say "Hey CAT bulldoze that building next to us thanks" and they will? Also, the agreement-thing guy said "That's not my problem, I have nothing to do in it.". My mother took pictures of the conversation and she's having a shower to calm down now. She also thinks that the company is part of the Montreal/Italian mafia (they are italians). I'm not racist, just that the city confirmed that the "license" they got didn't exist and these guys are rich. Picture if interested. The fence you see was leaning on the hedge (Also our hedge wasn't rare or anything.) Please help Edit: I just learned that they did it when my grandma wasn't here. She lives on a appartement over our house (weird building, I know). Basically a company I pay a monthly fee for, to run my website used my main company logo and my business name to promote their site/service. This was not ran by me, or discussed with me. Additionally there was no agreement, or anything signed it just was a service I paid for (that isn't exactly cheap either) I contacted the company by email, and they responded within moments and we had a phone call where they described their ads as an exposure campaign to offer to potential other costumers and I was a test of this. This was them building ads FOR ME, and it also linked their website. They had framed in a sense of they better ask for forgiveness sense. I agreed, as long as it was exactly that. Fast forward a few days, some of my friends and family and followers are sending me the ads. They're only targeting those who look at my content and purchase my things, and none of them link back to me. In fact it is solely an ad campaign for their business. I contacted them insisting they stopped and told them as a paying customer this wasn't right. I either join them in partnership, or they cease this. I basically received a "wow you were so nice on the phone" response and nothing else. The ads have stopped but this still doesn't feel right . What do I do? Being sued after filling chargeback for fraud in KY? Posted: 13 Jun 2019 05:34 PM PDT Long story short, I was traveling for work and went to use my card to buy a meal at the airport on the way home at the end of my week long trip. The cashier told me the transaction was declined so she tried again and same result. I called the credit card company PNC bank and asked them what was going on? They said they detected fraudulent activity and needed to verify some of my recent transactions. They went through a list and it was mixed with legit transactions I had made during my business trip but also many transactions that I didn't recognize in California. The lady on the phone cancelled my card and issued me a new one. She told me I'd had to fill out some paperwork to chargeback any of the charges that went actually through. I get home and am pretty tired so I unpack and settle in for the weekend. On Monday I fill out all the paperwork and check off the boxes that I attest to not making or authorizing the charges and I still have the card in my possession. About two weeks go by and I see the credits on my account for the disputed charges and I think all is good. That was in February. In March I get a letter from the credit card company PNC bank stating that one of the merchants, Lord and Taylor, has disputed the chargeback for $5345.90 and what evidence can I offer that it wasn't me. I wrote a letter explains that the charges before, during and after this purchase where a country away and I sent a copy of my airline boarding passes as proof that I was no where near California at the time. Sent all this info off and didn't hear anything back until early May when I got a letter from PNC that stated the credit to my account was final. I thought the matter was resolved. Today a sherrif knocked on my door and I have been served with a law suit from Lord and Taylor for the $5345.90 plus lawyers fees and court costs. What the hell should I do besides contact a lawyer? This seems totally insane. Update: the latest info I have points to the idea that this could actually be a second fraud on top of the first as the location given in California doesn't seem to be an actual Lord and Taylor. Obnoxiously Loud Apartment Tenant Posted: 14 Jun 2019 03:41 AM PDT My girlfriend and I have lived at this apartment complex for a year and a half. We never had any issues until about 6 months ago when we resigned the lease and a new tenant moved in above us. This new tenant blasts his tv volume at ridiculous levels (we can hear him scrolling through menu options on his PS4, so you can imagine how loud it is when he starts playing shooting games), he also runs his laundry machines and dishwashers after 10pm. We have filed multiple complaints and were told that he is not allowed to make loud noise after 10pm, however it continues to happen. We are looking for a way out of our lease, but don't know if we have any legal ammunition to fight the leasing contract with. My gf has severe ocd and having to hear everything he's doing in his apartment has taken a toll on her quality of sleep and caused her tons of unnecessary stress. side note: turns out the guy also got a part-time job working for the apartment complex that we live at.
