    Insurance payout negotiation advice

    Posted: 18 Jun 2019 08:25 PM PDT

    Hi folks,

Apologies in advance for the naiive question. This is pretty much my first rodeo with an insurance claim and I want the thoughts of people who think about this a lot.

SO. I was in an automobile accident this morning. I was crossing a busy intersection when someone blew through a red light and t-boned my work car. The driver has already claimed responsibility and their insurance is moving fast. The car in question in my 12 year old coupe. I don't even know yet, but I assume it's totaled. I figure it's worth $2,500.

Complicating matters is the fact that my 19 month old son was in the car. He's okay -- he was checked out by both the EMT and his pediatrician. However, the fact that he was there is making emotions run high on my end. My father-in-law, in particular, is pressing that I negotiate for a sum significantly larger than that of the car because of this fact. My gut is that my father-in-law is simply being shystery and I should ignore this. However ... I am ignorant on this subject. Is there any legitimate rationale that I negotiate with the insurance company in this way?

Lesser points: I will not be buying another $2500 car, and I realize that this is a decision that I am making. However, I did hope to squeeze another couple of years out of this car. Is there any legitimate and ethical argument that I negotiate for a fraction of any interest or depreciation I may accrue as a result of prematurely losing a depreciated asset?

    Thanks!

Ghosted an agent after an accident

    Posted: 19 Jun 2019 01:56 AM PDT

Back in the fall of 2015, I was hit by a car while riding my bike through an intersection. There was minimal damage to my bike and although my body's impact broke the driver's windshield, I was not seriously injured. In fact, I denied an ambulance ride and instead took an Uber to the ER to save on potential costs (I do not believe this was the smartest decision, but I don't think it's super important to my inquiry).

There was a police report filed and there were bystanders, along with the driver herself, who all believed the driver was in the wrong. I did not have car insurance at that time since I didn't own a car and had no intentions of driving, so her car insurance was handling everything. There were two agents I was dealing with, one was designated to work on my medical bills and the other was designated to work on my damages (or at least I think that was their roles, it was a long time ago). The damages guy met with me and offered $1,200. I didn't accept or deny it at that time.

Now, during this time of my life, I had pretty bad anxiety which was made worse due to the incident and feeling overwhelmed. I had a drinking problem (undisclosed and I was not drinking when this occurred), and I was having panic attacks frequently. I stopped answering my phone, I stopped looking at my email, I stopped checking my physical mail as well. I was a mess and didn't want to deal with anything and spiraled into a pretty major depression. I never accepted the $1,200 and I don't think my medical bills were covered either because I ended up having some of my tax rebate taken from me due to unpaid bills.

Fast forward to now, I have my life back on track. I stopped drinking 2.5 years ago, met someone and got married, I started seeing a therapist and psychiatrist, I worked on my finances and brought my credit back up, and I am finally happy and am no longer afraid to face the world.

Sorry for all the unnecessary background info. Now to my question. It's been almost four years since the incident and I was wondering if I am still eligible to receive anything from the accident since I completely disappeared off the map and never responded or communicated to the insurance company for such a long time. I don't know what protocol is for a situation like this, and although I am doing much better today, I am still a bit scared to call and would prefer to have an understanding of what to expect prior to calling. Thanks for reading and for any advice!

Hail made tons of paint chips, GEICO says hail couldn`t do it

    Posted: 18 Jun 2019 08:57 AM PDT

    Hi everyone!

Please please need your sage advice.

Hail happened, not big not small. My other car is fine, but Honda Accord 2016 got tons of paint chips all over hood, trunk and roof. I couldn`t find any dimples. We took a video while we were in the car on the highway during hail, made photos when we came home and exited the car.

Made a claim with GEICO, went to adjuster appointment. After 5 mins looking at the car without me - adjuster says that they found 3 dimples and it will cost ~$300 to fix (and I have $1000 deductible) but all the paint chips they are not going to cover because they are not consistent with the mark that hail leaves. Adjuster says that they are educated in hail damage and based on all the research my paint chips don`t look like from hail. After some discussion she says the investigator will be assigned to my case.

Investigator didn`t reply or reach out and after a week wrote a short email saying he concluded investigation and I can ask adjuster any questions. Adjuster just said that investigator concluded the same that its not hail damage. I called investigator and he says that all he was investigating is if I had an intent of insurance fraud and he can`t look at the damages. It was upsetting.

They are not giving me any options at this point and I feel helpless and really upset because I don`t see any way to make them hear what I am saying.

Just in case - all those paint chips appeared right after the hail, it is absolute fact, not trying to game them. There is a lot of them and they have weird shape, not like from rocks. What can I do?

I also asked for copies of photos adjuster took and it was really upsetting too. They took just one photo from the hood and the rest of the photos are around the car from a distance where you cannot see any of the damage.

UPDATE: here`s the video we took on the highway https://youtu.be/X44H8uX67qc. Still working on photos.

Stroke survivor at 61 1/2. Go back to work, use short term disability, long term disability, or just retire. What would you recommend?

    Posted: 18 Jun 2019 10:21 AM PDT

Asking for an aged family member. Father in Law (FIL) had his second stroke at 61 1/2. After 2 weeks in the hospital, he is living with us temporarily and is talking about returning to work. He can make it to work, but even the walk from the car to the building exhausts him, and he won't admit it but is not 100% there mentally right now.

He's got enough to retire reasonably well right now, but I didn't know if he could switch over to disability insurance for a while before he did so.

What considerations should be taken about taking disability, retiring early, or returning to work? Any assistance or just links to similar discussions or suggestions would be greatly appreciated.

Going on my own car insurance, high premiums

    Posted: 18 Jun 2019 09:49 PM PDT

I'm adulting now, and buying my own car, and insurance. 2 months ago a deer hit my car and I used the comprehensive claim to fix it up. $2300 was the payout. I currently am on my parents insurance and pay for my car which is $740 for 6 months. I found cheaper rates online, but when I get to the end they ask about the claim and jack it up. Now the cheapest I found is $1000/6 mos. Does anyone know a way around this or do I just have to wait for the comprehensive claim to go away? Seems crazy that we have insurance, but then when something happens it goes sky high.

What information am i entitled to when on my parents medical insurance?

    Posted: 18 Jun 2019 01:02 PM PDT

Hey everyone I need some help. I'm recently estranged from my parents but I'm still on their plan for now. I am disabled and frequently have questions to ask insurance. Well I got around to my eye issues and am hoping to get special contact lenses for photophobia as I get severe migraines and have a neurological issue that causes issues with my pupils contracting with light differences. My vision insurance is through a third part from what I gather? So I called them and they said the only way to verify I'm on the account is to give them my dads social and birthday as he is who my insurance is under. I message him reluctantly asking him for that info he responded with "everything you need should be on the card". His birthday and social are not on the card for obvious reasons.

I'm hoping to figure out if my dad has to give me that information or if there is another way. Mind you my question for insurance is if a contact lenses fitting will be payed for and if they will cover a certain brands new product. So it is a somewhat specific question. Thank you.

Do I need to file an insurance claim and how?[TN]

    Posted: 18 Jun 2019 07:51 PM PDT

Last week I was in an on the job car accident. I wasn't at fault, the other driver ran a red light at the intersection I was crossing, causing the impact that totaled the company truck I was driving. I have a few minor injuries, some cuts, bruises, and general soreness, but no broken bones and nothing life threatening. The accident has also effected my job in the days since the accident as I have had to miss a day of work and after that day my hours have lessened as 1) There is no company truck to drive at the moment and 2) l am not allowed to drive (essentially do my job) for the foreseeable future while corporate investigates the accident. Also my job is seemingly in the balance right now because I was made to take a drug test after the accident as part of corporate's investigation, and it more than likely will come back positive for weed.

Now with that description, my question is do I have a legitimate case to file with the at fault drivers insurance? This is my first time in this kind of situation, dealing with insurance and whatnot, and I'm not sure if trying to file would be a waste of time considering my injuries were minor. If I lose my job is that valid to consider loss of wages or is that more my fault than anything else? Should I not do anything and let corporate and the company's insurance handle the situation? If I do need to file do I need an attorney?

Thanks in advance for any help, this is my first car accident, and I need a clue as what the proper steps are for this.

    Car insurance questions: Pennsylvania

    Posted: 18 Jun 2019 05:20 PM PDT

I'm awaiting a call back from my insurance agent, but I'm hoping to get some insight before talking to them. The car is not behaving the same as it did before it was hit. There's play in the steering wheel, there's a weird pulsating noise, and there's a horrible metallic grinding / scraping sound when I make a sharp turn. I'm not driving it until it gets repaired.

    Can anyone tell me:

    1. My car is less than a year old. Can I insist on OEM parts?
    2. What criteria should I look at when determining whether "diminished value" is relevant?
    3. I'd like to get the car repaired properly, even if it means trading off some convenience or cost. Is the dealer's bodyshop usually the best option? Or should I look around?
    4. If there's damage to a major component, such as the transmission, do I have the right to request repair / replacement with new parts?

    Thanks!

    Help regarding car insurance PA

    Posted: 18 Jun 2019 04:37 PM PDT

My friend owns two cars and I recently moved for a job temporarily so he loaned me one of his vehicles in the interim. Two issues:

I called Safelite to address a tiny crack in windshield only to realize that the insurance lapsed on this vehicle and was cancelled due to several missed/non payment issues, to the point where the insurance carrier will not reinstate. This car is not insured.

Plus. I also realized that he has over $10,000 in parking violations, mainly on the plate for the vehicle he uses; the car I use had one violation on file for about two hundred dollars.

I called and sent text to address reinstating the insurance but he is ignoring my communications.

I am curious to know possible outcomes.

It is in PA. Will the car be suspended and made to be brought in for suspension? Once that happens will the car be taken because he has 5 parking violations to the tune of $10,000?

Will he be able to transfer the title to me, assuming he gets over his embarrassment or shame and agrees to transfer title? We had tentatively talked about me buying it.

I really liked the car, has low mileage and was in good condition

I am appalled that he didn't inform me that it was not insured. Had a cop stopped me what would have been the outcome; would have towed away immediately?

Does his uninsured one vehicle affect the insurance on his other vehicle; assuming that vehicle is insured..

Thanks so much for any information.

Health insurance trying to bill $50,000 for pacemaker Illinois

    Posted: 18 Jun 2019 04:26 PM PDT

    Hello,

I'm posting this for a family member. They recently (February) had to have a pacemaker put in. The surgeon placed a subcutaneous pacemaker as opposed to the line in vein (standard) type.

Subcutaneous is safer and less invasive. Because the patient and surgeon opted for this type the insurance company is stating they will only pay for the other type of pacemaker.

MD and patient have appealed once already to the insurance company which was denied stating that medical records do not show medical necessity for this type of pacemaker.

Is there anything that can be done or suggestions anyone can offer to negotiate this? Of course they will appeal again once they can get a hold of the surgeons office. Is it worth getting an attorney to appeal to the insurance?

    Thanks in advance.

Geico Sent me to an independent Doctor - They call back today, saying they wont' cover me anymore

    Posted: 18 Jun 2019 03:48 PM PDT

I told the doctor, I was at 90%. Pain levels at 1-3. Told everything honestly. Not trying to scam anyone or anything. This is an accident 5 months ago on January. My shoulder got messed up, as well as my neck. Nothing broken though. Been going to Chiroprator, and doing Acupucture. Getting better slowly.

Most of my pain comes and goes random days. If I do heavy stuff, it hurts, my neck gets stiffen up as well as my shoulders. Even my chiropractor is wondering why its taking so long to heal up. I don't know what's wrong with my body either. I just want to get to 100%.

What should I do here? Stop going and just let time heal my wound? I been in accidents before, and it took 4 months max, to heal. I don't know whats going on this time with my body, but I know this isn't how I am suppose to feel.

    Auto Insurance AZ

    Posted: 18 Jun 2019 03:48 PM PDT

Hi Everyone, I was in an accident over the weekend, the other driver reversed into my stationary vehicle (he backed out of a car spot and came directly into my right passenger fender - damaging the fender, and front bumper and it appears there is a leak now from that side as well although I'm not too sure what it is). His insurance has accepted 100% liability and is willing to pay for the damages to my car, however they have given me 2 options - 1 to use their app to take some photos and send it directly to them for review, or 2 to take my car to a shop and have the work estimated.

I'm somewhat new to the U.S. and this is my first accident, so not sure if one option is better than the other? Anyone in the industry or anyone with experience know which option is better (or are they both similar) and should I be expecting to be out of pocket for any expenses at all. And everyone I have spoken to makes it seem like they will cut me the check personally? Is that common, or will they send it directly to the shop that does the work?

As a side note - I originally made the claim with my insurance company (but I don't have full comprehensive insurance on my vehicle) - so they basically said call the other drivers insurance and file a claim with them as they didn't want anything to do with it.

Replacement Cost - Line of site

    Posted: 18 Jun 2019 03:36 PM PDT

    Hi all,

I am looking for some advice. I am in Texas and had some flood damage in my house. I have a section of house with 3 rooms, 2 rooms with a common area in the middle. One room was totally flooded and it went into the common room some. It all has the same contiguous carpet. Insurance does not want to replace the carpet in the unaffected bedroom to be uniform. They just say you can shut the door.

I really do not think this meets the pre-loss condition standard but I cannot find if Texas has a line of site law like other states. I also feel like insurance is low balling me on replacement value and also possible not including the material for waste you get for doing the job. The just keep giving a dollar figure with no itemization of how they got it. Are they required to provide supporting documentation like I am. From what I understand on replacement cost they should not be adding depreciation.

Any advice here? I hate dealing with insurance companies and I think 1 room by itself with different non matching carpet would look stupid since the door is open most of the time .

    TIA

    Car stolrn at gunpoint (CO)

    Posted: 18 Jun 2019 11:45 AM PDT

Hey guys, any advice would be much appreciated here.

Firstly heres a little background. I was working for a bank and about 3 months ago there was a robbery at my location. The individual ended up using my car as a getaway vehicle after stealing my keys at gunpoint. Cops show up file a report, they are unable to get any sort of description of the individual as he was dressed head to toe in all black.

Fastforeward 2 weeks, i get a call from the FBI (they were involved due to the fact that the car was stolen during a bank robbery) and they say that they have my car. They also say that they apprehended the individual and need to retain my car because it contained evidence.

They released my car to my insurance company (progressive) about a week later after i inform them of what contents of the vehicle were mine, all my belongings were gone. Progressive then had it moved to a dealership not far from me. They had an adjustor take a look at the vehicle, who then sent it to the collision department for repairs and the repairs were finally started after about 2 months of waiting around for the insurance company to authorize the repairs to start.

There was about $4000 in damages caused by the individual that stole the vehicle, my deductible is $1000.

My question is this, due to depreciation in value of my car caused by the theft, would it be possible to file a claim to make up the difference in value pre and post the theft.

This is probably the wrong subreddit for this other question, but is there any responsibility on the thief to compensate me for damages caused by the theft eg. my deductible, rental car costs, and missing items from the car?

Car got totaled and $1,040 was subtracted from my car for condition. Agent said this would have been the cost to make it dealer ready.

    Posted: 18 Jun 2019 02:36 PM PDT

I'm confused why this amount gets subtracted and I keep getting conflicting answers. From what I've read online dealer ready basically means that since the car was used they subtract for the condition of it. If this is the case then is it a standard amount regardless of the vehicles condition? My car was 4 years old but it was spotless on the inside and outside prior to the collision. I used to take it to the car wash once a week and had custom mats and covers. People used to come in and would ask if my car was new. Is this amount essentially standard regardless of condition?

21 years old applying this week for my own health insurance and have questions before doing so.

    Posted: 18 Jun 2019 02:16 PM PDT

Hello everyone, I am typing this on behalf of my girlfriend as she doesn't use reddit but she wants some advice.

She is 21 and living in Bakersfield, CA with me (boyfriend) in my house along with my parents and baby nephew.

Her parents are self employed and make a good bit of money (ages 57 and 60) and are now having to pay a ton for health insurance as of this month and she (gf) is not on their plan anymore. Her parents suggest that she gets insurance on her own because she makes about $15/hr and won't be charged much (in theory). They're also suggesting she claims she is homeless and going couch to couch. They don't want her to tell the insurance company that she lives with them or with me because they think it'll jack the price of her health insurance up. The insurance is called medi-cal and she is applying through the cover California website.

My question is, what do you suggest she does? Pardon the even more ignorant question but do any of you lie within reason to get the rates down? Should she claim to be homeless or claim she lives with her parents like her car insurance/bills say she does or claim she technically lives with me.

    Thank you.

    Insurance policy question

    Posted: 18 Jun 2019 02:06 PM PDT

    Have a policy quote question.

I currently have USAA and have 100/300/100, 5k medical payments with $500 deductibles for comp and collision. Me and my fiancée are listed on our policy.

I quoted through Geico yesterday. I went up to $1000 deductibles and declined medical payments. It comes in about $37 dollars a month cheaper.

I quoted for changing my deductibles and no medical payments through and it's only $14 more a month.

Does anybody think it would be detrimental to leave a company I've used for about 4 years for $14? Also, are medical payments needed?

    Farmland insurance: Added insured?

    Posted: 18 Jun 2019 01:29 PM PDT

I am trying to get a parcel of land insured in Washington state, but am running up against an odd insurer and I need a reality check from you fine people.

The land is half woods and half farmland. The farmland is farmed by a neighbor (he grows alfalfa). My neighbor has coverage for himself, but I am looking for general liability coverage for the entire plot of land. My insurer keeps pushing for me to be added to my neighbors insurance as an "added insured". This makes no sense to me: I cannot force my neighbor to pony up more cash to add me to his own insurance policy. I just want my own coverage for those cases outside of his own liability.

    What am I missing here?

Progressive insured rear-ended me - adjuster won't do anything - help?

    Posted: 18 Jun 2019 03:47 PM PDT

I was rear-ended by a Progressive insured driver. I made a claim with them, as did the other driver the day of the accident. I gave my statement to the adjuster a week later over the phone (took them that long to call me back!). This was about two weeks ago. I hadn't heard back from them, so I called them today. The adjuster tells me that their insured has ignored all of their attempts to contact them to get a statement, and since they haven't talked to their client, they won't move forward with their claim until they do so.

She recommended going a claim with my insurance, but then I'll have to pay my deductable - and that's bullshit.

My car is still drivable, however it's got extensive damage to the rear bumper. I've been experiencing some stiffness in my left shoulder that has made it difficult to sleep on that side, but I haven't gone to a doctor.

I'm feeling like I'm getting hosed here, and think that maybe I should retain an attorney to get my car fixed? I'm pretty peeved that the Progressive adjuster didn't give a shit about addressing my claim, and I won't be getting satisfaction from them unless their insured decides to give a statement - which apparently they don't have to and it's not in their best interest?

Please, just a bit of direction of you don't mind.

    Thank you in advance.

Question about using a non-preferred shop for repairs

    Posted: 18 Jun 2019 11:16 AM PDT

I was recently involved in a minor accident where there was front end damage to my car. There is the expected cosmetic damage to the bumper. I also hear some scraping when I turn the wheel hard to the right so I believe there is something rubbing in the wheel well that can't be seen from the outside.

The other party has accepted fault and I am going through their insurance (Farmer's). They gave me the choice to use a preferred shop or choose my own shop. Now in the past I've only dealt with State Farm and they have a preferred shop locally that I trust. However I took a look at the Farmer's shops and they all have pretty bad reviews, so I'm thinking of using my own shop.

In that case they said I need to download their app to take photos for an estimate before they will approve the repairs. Is this a way for them to lowball the estimate, since photos won't show hidden damage? I'm pretty sure once the shop starts taking apart the car they'll find additional damage, but can the insurance use my photos to refuse additional payment?

I also asked about rental coverage if I choose my own shop and they would only say, once I've done the photo estimate and they approved repairs then we can talk about that. Whereas they said from the start if I use their shop they'll pay the rental while the car is being fixed.

TLDR: If I choose a non-preferred shop Farmer's says I have to use a photo estimate app. Can they use this to refuse additional payment if the shop finds hidden damage? Also, will they cover the rental while my car is in the shop even at a non preferred shop? I am located in California if that helps. Thanks!

Healthcare provider refused payment during grace period?!

    Posted: 18 Jun 2019 07:26 AM PDT

In December 2018, I suffered from a severe heart palpitation episode and had to be rushed to the ER. I'm under my dad's health insurance package (?) (Blue Cross Blue Shield) he tried to pay within their 30 day grace period prior to this in October (the deadline was November 1) For whatever reason the agent he spoke with would not take his payment. I moved out last year so I was not immediately informed of this mishap with the BCBS agent until I'm in the ER being told that my insurance wasn't going through (note: I never experience this type of medical emergency so my father probably didn't see notifying me as a priority) He told me afterward that they refused his payment on October 25 and the agent essentially told him this was because he was paying outside of the grace period, which is categorically false. In January, when trying to make an appeal, the Marketplace and the billing department claimed that they could not locate record of my father's attempted payment. However, in March my father and I had a conference call with an agent in billing who saw a notation of an attempted payment but said there was little he could do. We're getting the runaround by these people and I have been driven mad over this entire ordeal since the beginning of the year and I'm getting little to no help from my insurance company...

How do I resolve this? File a complaint to the Georgia Department of Insurance? Is there anything I can do legally? Because I'm not being sent to collections by the hospital over this. Any help is appreciated.

Cancel and re-instantiate my car insurance for 4week Europe trip?

    Posted: 18 Jun 2019 08:46 AM PDT

    State: CA; Wawanesa

    Insurance gurus,

Is it a bad idea to cancel and re-instantiate my car insurance given I will be out of the country for 4 weeks? Saving over $100 sounds good to me as the car will be parked at a pretty safe garage spot (tandem parking spot protected by another car)

Let me know if I am missing something or am running the risk of any legal violation or increased premium on return. I actually just switched to this insurance last month.
