(Update) Neighbors child has disabilities and won't stop climbing the fence, entering my house and "freeing" my dogs

    Original post: https://www.reddit.com/r/legaladvice/comments/b93dx3/neighbors_child_has_disabilities_and_wont_stop/

I'm sad about this update for the kid, I took the majority of the given advice and called the police non-emergency number and asked for an officer to come out because I had questions about an issue I'm having and briefly explained it.

Officer shows up, I invite him in and explain the whole situation. He isn't really sure what to do about it right now so he asked for a supervisor come to his position. Supervisor shows up and I go over the whole thing again, we go upstairs to my computer where I have all the videos clipped and saved (9 times of her entering the backyard and 4 of her entering the house through the garage).

We watched each one and he gets on his cellphone and goes back to his car. A few minutes later he comes back with 3 flash drives and asks me to copy the videos over to the drive and had me fill out a piece of paper stating what I put on the drive and then signed it, I repeated it all 3 times.

About 45 minutes later after we have been talking and he's been on and off his cellphone the entire time, 2 CPS workers show up and review the videos again and take a complete statement from me going back to the first time it happened. This took about two hours because they wanted it to be precise and as accurate as I remember it and left out anything I wasn't 100% sure on.

The officers and CPS workers head next door to talk to the parents, parents apparently shut the door in their faces and said they didn't want to talk but because of my statement and the videos of her climbing over, getting stuck, having to be carried back over the times I'm at work or gone and just entering the house they had probable cause to enter the home anyways.

After they were inside their house for about 10-15 minutes another cop car shows up followed by another a few minutes later. I'm in my garage so I don't know exactly what happened inside but after more officers showed up the father was put in the back of a car and the daughter was put into the CPS workers van and they left. The father was driven away about 10 minutes after that, then about an hour later the mother is also put into the back of a car and they drive away.

I talked to the initial officer that showed up and asked for a supervisor and he tells me they found drugs (pills not in prescription bottles/not their prescriptions) and that the home was just not being taken care of inside and definitely not a safe environment for a child. Said they found drugs not secured and in areas the child had access to them.

I haven't seen them since the day after the post, I feel bad for the kid being in that situation and me being a neighbor not even knowing and my not wanting to call the cops (I didn't think it was anything like they found, I just figured it is really tough raising a kid and add on top of that severe mental disabilities and it's even tougher). I should have called them earlier once the CPS reports I was doing over the phone didn't ever do anything.

I adopted a dog. They said they gave me the wrong dog even though the photos match. Now the adoption clinic is trying to sue me.

    Posted: 24 Apr 2019 08:08 PM PDT

I live in Texas and I recently adopted a puppy from a humane society several hours from my house. Before arriving I paid the adoption fees via a phone call and then arrived and filled out adoption papers for the good girl. However the next day the clinic called and said that they had accidentally given me the wrong dog and that I needed to return her as some other family had also filled out the adoption papers for her to which I refused. they then said they were going to press legal action on the basis of "stolen property" if I didn't return with her within 24 hours. The dog I adopted is clearly the dog within the online photos that were posted for her and they handed her over to me without checking her chip..They said that they could be sued if I didn't bring her back and they didn't check the tags so are they not at fault for giving out the wrong dog?

The puppy I adopted is clearly the same as the one in the photos posted online and I've already bonded with her, taught her tricks and introduced her to my entire family over the last several weeks she's been staying with me. They say that even if I return her they still want me to pay their attorneys fees. Please help me anyone I don't want to lose my dog and I don't feel like I'm at fault for their mistakes.

Edit: the large amount of responses is greatly appreciated. It's an incredible help to me to be receiving many different perspectives on the scenario as well as slightly reaffirming to know that many believe the courts would be sympathetic to my stance in the situation. I am a young man recently graduated from high school and have never faced such a level of legal threat before and was honestly in a panic about what to do. I'm doing my best to read yalls responses and get back to you with any additional information you may have requested about the scenario.

[NewYork/employment law] I do nothing and get paid, am I breaking the law? It’s been years now.

    Posted: 25 Apr 2019 12:18 PM PDT

    Hmm. Ok locationbot.

    New York City?

    I recently posted this.

    https://old.reddit.com/r/confession/comments/bhayt8/due_to_a_screw_up_with_my_employer_i_earn_money/

Long story short, I work for a company that doesn't ask me to do anything, but regularly pays me anyway. I complete 100% of the tasks they assign me, which are none.

Am I committing fraud or "something" by getting paid to do nothing? It's been a decade now.

Is it my legal duty to seek work to do, or am I perfectly fine waiting to be assigned something to do? Nothing seems to matter, I'm irrelevant to the company, but they pay me.

Neighbor continuously harassing my family. Crosspost from r/neighborsfromhell

    Posted: 25 Apr 2019 09:25 AM PDT

I have a neighbor from hell, who has made the past 5 months of my life, a complete nightmare.

We are homeowners in the US. NH to be exact. We have a few acres of land, with about a half acre of fenced in area for our dogs. Our house sits directly downhill from theirs.

It all started when we respectfully asked her to not have children sledding directly into our 4 ft wire fence while our two dogs are outside, as it was a safety concern, and causing the dogs distress. This resulted in her placing a multitude of calls to my partners place of employment, and writing two belligerent reviews online.

Following that, we placed 'beware of dog' signs along our property, which resulted in her angrily screaming at and attempting to physically assault my partner, property damage, and police involvement. The police even thanked us for trying to be neighborly.

Following this, she has taken it upon herself to swear and scream at my dogs, if I let them outside and she is outside. Every single day. I have no way of knowing beforehand when she is outside, with how the house is positioned. I have since taken it upon myself to go outside with the dogs, which shuts her up. Up until recently, I have avoided the backyard altogether (outside of stepping out with the dogs.) I have instead opted to take my dogs and toddler out places instead.

Yesterday was the first time in these past 5 months that I decided to use our backyard with my toddler. My kid deserves to play in the backyard. She promptly comes outside, loudly complains, storms back inside, comes back out, decides to go for a walk, screams that I'm a c*** after she's passed my house. Then, when she gets back, she blasts the song "crazy bitch" by buckcherry at full volume (uncensored and outside btw) on repeat, until my toddler, dogs and myself go back inside.

I've documented everything over the past few months. I've tried doing what I can to reduce this type of behavior and not engage.

Police are hesitant to help (I feel), stating she's not technically breaking any laws. I am curious as to how this type of behavior isn't considered harassment by law enforcement at this point, and feel I am out of options.

Any legal advice would be greatly appreciated.

I’m 18 years old, and a coworker lied to his parents and said I’m selling him drugs.

    Posted: 25 Apr 2019 05:03 AM PDT

This caused his dad to come in to my job while I was working and threaten me, and then the cops searched me when I got off my shift. Out of anger and indignation I impulsively sent him the following message, let me know if it's not a good idea to send him this and if I should unsend it:

"Why did you lie dude. Why. I got searched by the fucking cops on the way to my car after I clocked out, and they're launching a full investigation and won't be leaving me alone for a long time. Your dad threatened to "take my fucking head off" in front of all of [place of employment]." Fix this, man. Do the right thing. I don't sell drugs and I don't deserve this. I did nothing to you. And if this bullshit continues I will be taking legal action against your dad for threatening my life and against you for defamation of character and false accusations."

Edit: took out name of my job

Edit 2: I live in Texas.

HELP!! I have encountered the most insane situation over the last week in my small biz.

    Posted: 25 Apr 2019 02:41 AM PDT

A little background- I own a small e-commerce business that sells custom design work. I have over 20 women who work for me and our clients are 95% women. We have really amazing relationships with the people we work with, and almost never have any real client issues beyond standard stuff. I'm located in New York.

Two weeks ago a man purchased something ( he also happens to live in New York), was unhappy with the first design proud, demanded a refund. I kindly explained that he still had 3 revision rounds left and also that he purchased a custom piece of art that was non refundable. He writes back, acknowledges he was aware of no refunds, and then proceeds to spew hateful, threatening emails at me telling me he's going to make me pay, shut me down, etc etc.

At this point I notice that he has started to leave REALLY bad reviews on many sites, claiming I'm running a fraud ring and that my "team of women thieves" and I need to be prosecuted for our crimes.

I write to him, ask him to please stop, and offer that despite his conduct we will absolutely still work with him to get his art finished for his wedding.

Now he takes it up a notch. He starts leaving fake reviews that call me racist, "sloppy woman in her home robbing people," and on... and on... and on. He posts my home address on rip-off report.

At this point I refund him out of fear, and hopes he will stop. He reminds me that I "need to learn a hard lesson" and that he won't stop until he shuts me down.

So this has been going on for 14 days now. He leaves bad reviews every day, often many times a day. I had to turn Facebook reviews off, but I cant stop the google reviews. Google has been really non-cooperative in removing almost any reviews, beyond the ones that use racial slurs and hate speech.

I just want him to stop, but I don't know when that will be. What can I do? Does anyone have experience with this many fake reviews? He's left 36 so far, the last one just a few hours ago...

OH I forgot to add a few things! I have reported/flagged the reviews and had many others do so as well. I've called Google 3 times and posted in the online forums for Goggle my business as well. I even went to the police to see if I could get some kind of criminal complaint, but because no direct threat of physical violence, they couldn't help me (but were really nice and sympathetic, as I cried in the detectives office).

And the kicker... this guy is getting married ON SATURDAY. How does he have so much time for this?!?!???

Social Security gave someone else my Identity

    Posted: 25 Apr 2019 10:29 AM PDT

I 1st made this discovery at the age of 17 going to the DMV to apply for a driver's license. They told me there were 2 people showing up for my Social security number and that they would launch an investigation, that never happened. 2 years later I go to apply for financial aid for college. And this other me is still showing up under my social security number and that they couldn't give me any financial aid until we got it squared away. After discovering this we spend the in thing next 6 months at they saw security office trying to get this problem fixed. Discovering a was a problem on social security's fault seeing that they gave it to me 1st and the other me 2nd. So after doing a mountain of paperwork and waiting for the process to take chorus I finally got my new social security number. I thought now would be the end of it but in the past year or so I've been noticing the other me Still showing up in parts of my life. After doing a little digging seeing how far this whole thing actually went. Even though our social security numbers are different My insurance has been at mixing him up with me. My credit was getting mixed up with his. His student long debts are being sent to me. And I'm coming to find out he has a large criminal history mostly traffic violations but there are 3 felonies on his record including armed robbery, Possession of illegal substance with an attempt to sell, And manufacturing of an illegal substance. This whole affair has cost me year of my life and several great job opportunities. I've invested in life lock so hopefully he won't be able to do any more damages. I've contacted identity theft services so that they can hopefully finally separate him and myself. While I am trying to make it through this I am finding it increasingly difficult to find decent employment with his felonies on my record. I'm currently living in Maryland trying to get this problem resolved but with my case being incredibly unique I can't seem to find any legal advice on what to do.

What can we do legally when a child refuses to go to school?

    Posted: 25 Apr 2019 05:56 AM PDT

    This is in Maine.

Let's start by saying, I started working with this family ~5.5 months ago. The young child (between ages of 7 and 10, but don't want to get too specific), refuses to go to school.

We've set up a 504 plan to support the child's emotional needs. The issue isn't school itself, it's being afraid they may miss out on something at home by being away. The child is very much a "mother hen" to their family and needs to know what, where, when, how, why at all times. We've done constant check-ins in school. Part-days if and when needed. The child has been very well accommodated in terms of meeting those needs, but to no avail.

They've also been linked to a therapist, one with a PhD that has been going to the home for observations and in-home therapy before and after school.

It took me 4 months to get this child re-enrolled with a 504-plan, and we all thought everything would be OK. However, since returning the child has maybe gone to school 3x in the last month.

The family has no control over their child, and the child knows this. If they don't want to go to school, they won't. And then the family blames the school, and myself, and the therapist for not doing enough to get the child back to school. They've threatened reporting the school to the state education board. But the issue lies within getting the child on the bus and off to school. The issue starts at home, and making sure this child is going. We've all done our part in helping to accommodate and support mental health and emotional needs.

They haven't been in school all week. And they just texted me again to let me know. I know I shouldn't feel this way, but I want to scream what do you want me to do!? We have had this conversation over and over and over again!

We don't have truancy officers in this state, so what can we do? Is this something reportable to CPS or DHHS? Have a local police officer take a visit to the home? Something needs to be done to hold this child and their family accountable for not getting their child on the bus in the morning. This is serious, and I'm tearing my hair out trying to help but I'm at a loss.

Oil change shop didn't update their records. Now my truck is listed under someone else which in turn threw a red flag on my Car Fax as an odometer roll back which will not allow me to trade it in. Michigan, USA.

    Posted: 25 Apr 2019 06:27 AM PDT

I found the truck of my dreams and was ready to pull the trigger. As the dealership pulled my car fax on my current vehicle (I planned on trading it in), they found a red flag. A potential odemeter roll back. I thought to myself, " no way, that is crazy". Upon further research I found out that the owner that had my current truck prior to me visited a mom and pop oil change facility and apparently when they got a new truck, the mom and pop shop didn't update the VIN number to their current truck when they brought it in for service. So now under my VIN it shows the truck went from 67,000 miles to 18,000 miles resulting in the car fax red flag.

I'm currently working with car fax and the mom and pop oil change place to resolve this. But it is not an easy nor is it a timely process. So now, I play the waiting game and am worried that my truck of my dreams will be sold and slip away because of this massive error. Do I have any legal ground to stand on? I drove over 3 hours round trip to test drive/buy this truck and can't until this gets cleared up which could take weeks!

My mom found out my dad cheated on her and had him change his number and cut all contact with his mistress. Now she’s harassing my entire family.

    Posted: 25 Apr 2019 11:04 AM PDT

Obligatory I do not agree with any of my parents actions and very much resent them for putting myself and my siblings through this. Also, this is in Illinois. So my dad has had a relationship with this woman (let's call her Mary) for about a year now under the guise of her being a friend. My parents are both in their 60s and my mom didn't really care as she thought it was innocent since this woman knew my dad was married and has 4 kids. My mom even offered to invite her over for dinner on more than one occasion. Recently my mom started to notice he's gotten even closer to Mary. They constantly call each other and talk throughout the day, go out for food often, and she even bought him a lot of expensive gifts. They've gotten into a lot of fights over this but my mom refuses to leave him and decided she'd be fine if he would just leave Mary. She got him to end it with Mary, which ended horribly with Mary calling 50+ times a day off of a private number saying she wants all the money she ever spent on him back. He said no and changed his number. Now in an attempt to contact him she started harassing my siblings and I. She even found out where I work and called them. She got on the phone with my boss telling him that my father owes her money and hasn't been returning her calls and for my boss to give me her number to get in touch with her. I am so incredibly embarrassed and I don't even know how she found out where I work. I really don't know what to do here. My parents won't listen to reason and just want to pretend like nothing happened and think it'll all go away, but now it's affecting my siblings and I. What are my options? I know Mary is very well off financially, while my family is not. She also knows where we all live and work. Can I get a restraining order from her so she could stop harassing my siblings and contacting my place of work? Does she have grounds to sue my family for the money she paid for gifts she previously bought for my dad? Thanks in advance.

[CA] My car, my roommates car, and three other cars were ruined by our drunken senior neighbor. My insurance won’t cover it (not my fault though) but I’m worried his will max out and not be able to compensate us all. What can/should I do here?

    Posted: 24 Apr 2019 09:11 PM PDT

5 cars were hit, 3 almost certainly totaled (due to age and repairs guestimate). The guy is like 88 years old with an oxygen tank. He threw 5 beer cans out of his car onto the street after trying to drive away twice. He had two sets of keys I had to pull out of the vehicle. Police came and noted everything. I've got photo and video proof.

As the title states, I'm worried his insurance may max out and not be able to cover all 5 cars.

    Any advice is appreciated.

Erotic content that I recorded and hold copyright is being used on online to make money. [CA]

    Posted: 25 Apr 2019 06:49 AM PDT

I am a photographer and a videographer and I provide a service for nude/erotic content as well. There are several pricing tiers (e.g. personal where I own the copyright and they have access for personal use, I own copyright and they hold the right to monetize online, they own copyright, etc). There are contracts that precisely reflect these.

This couple got the personal tier which only allows them to use it for their own personal use however I've discovered that it hasn't been true at all. Several of the videos that I recorded of them are being used online (both for sale on manyvids and monetized on popular free websites).

I've contacted them about upgrading to a different license or buying the copyright and never heard back. After the email, they have both defriended me on Facebook. The content are still up.

What is the best course of action for me? Should I contact the websites to take down the content and sue for damages? Do I need a lawyer?

    Daycare parent not paying.

    Posted: 25 Apr 2019 05:20 AM PDT

I (25F) own an in home daycare in wisconsin. I have a contract, handbook, references and an LLC. I had one parent come and tour my house (after being 45 mins late) and decided that they wanted to bring their child here. On the first day of care, she dropped off the signed contract but didn't fill it out completely. The missing info was the days and times each week they would be needing care. Not a big deal to me because she was going to work from home and could make her own schedule. She gave me the days and times of needing care on Facebook messenger. She didn't fill out the rest of the paperwork ie: daily routine, permission slip to leave the property, immunization records. She dropped off late the first day and then when she picked up, she basically grabbed her kid, talked for 2 mins then left. They had that Tuesday off so I texted her and told her that payment for the week is due on the first day of care and told her I needed it Wednesday morning to avoid late payment fees. In my handbook it has that in italicized writing. Then she told me her car stopped working. On Wednesday I texted her 30 mins after her start time asking if she was bringing her child and it took her 2 hours to respond saying that he won't be here today. Then the same thing on Thursday except that he wouldn't be here the rest of the week. On Friday I sent her an email that told her that unfortunately due to communication I was unable to continue caring for her child. I gave her a two week notice so now she owes for 3 weeks. She said she understood as a business stand point and that she needed time to save up the money. In the email I gave her one week to come up with the money. It's now been a month and I've texted her and sent her reminders that she needs to pay. Her bill is over $500. I have applied one late fee because she will not text, email or message me back.

I'm not sure what my next step is. Do I tell her I'm taking her to small claims court or just leave it alone as I just started this business in November and don't make a lot of money to afford going to court over this. My husband thinks I should just chalk it up as a loss and move on but he doesn't realize it's this amount of money.

Any and all advice will be appreciated as I've never had this experience before and I don't want to run my daycare into the ground.

Financial Exploitation of a Disabled Couple

    Posted: 25 Apr 2019 07:48 AM PDT

My daughter and son-in-law are both disabled due to mental illness. A few years ago, they moved to a small town in Northwest Kansas where her father and step-mother live. Two years ago, they were in an automobile accident, and my daughter sustained serious injuries. She was life-flighted to a level one trauma center in Denver.

Her father drove to Denver (a three hour drive) and spent a couple of days with her, and when she finally got out of ICU, her drove her husband and daughter out there to see her. While she was in the hospital there, he would look in on her husband, and then call her and yell at her about all the things he thought her husband should be doing and wasn't. After a couple of weeks in Denver, she was transferred to the hospital in the small town where they lived, and she spent about a month recovering there.

After she was released and able to go home, her father and step-mother sent them an invoice and a bunch of receipts to be reimbursed for their "expenses" while she was hospitalized. Some of these items include:

    • gas, mileage, time, hotel, and food while her father was in Denver.

    • gas, mileage, food and time for bringing her family to see her

    • an expensive cooler and $70 worth of Italian food he bought to take home to put in his freezer.

    • $1000 for checking in on her husband after work for about 5 minutes each day while daughter was in hospital in Denver

    • some bedding that her step-mother bought for my daughter that she never asked for, and some assorted food items the step-mother purchased for herself

    • books from a book sale and ice cream the step-mother bought for their daughter and some neighbor kids that my daughter had no knowledge of

All of this added up to about $10,000. They are already barely making it on their disability as it is.

Her step-mother grew up in this town and is well known. My daughter is afraid that if they fight back against this that the step-mother will poison the town against them. All of this is causing my daughter a lot of stress to the point it is aggravating her mental illness, affecting her sleep, and making her physically ill.

I have never heard of anyone treating family this way. It would never occur to me to send my child a bill for taking care of her after and accident, it's just what families are supposed to do.

It's obvious that her father and step-mother are taking advantage of them for their own financial gain. Is there anything they can do to fight this?

    Scott's law accusation

    Posted: 25 Apr 2019 09:17 AM PDT

In illinois. Just less than an hour ago I was driving my old 98 Honda with my 2 year old toddler in the back when I approached a cop pulling someone over on a three lane road. The car pulled over was on the right shoulder, the cop was on the right lane, I was on the right lane. I tried to get over to the middle lane, but the road was a bit busy and I had to slow down and pull up a bit behind the cop before someone let me in to the middle lane. As I entered the middle lane, I observed the officer rapidly walk from in front of his vehicle to the driver seat. He scared me as he did it so rapudly. I basically yelled out at him, although he did not hear it. A minute or two later he pulled me over and said that I almost hit him and he's going to give me a violation for Scott's law. I apologized profusely because I was talking to a cop but deep down I felt like he was the idiot walking into oncoming traffic very rapidly while I was going maybe 15-20mph. Nonetheless, he gave me a citation. Now that I'm at home, my heart has sunk. The fee is 10k. I'm dumbfounded. I don't think I did anything wrong. I even told him that I thought it was dangerous to pull over in the lane instead of the shoulder and I told him that I was pulled up behind him before entering the middle lane, but it's his word against mine?

How do I protect myself from this? I'm literally on food stamps, not like I can afford a lawyer.

(Oklahoma) Sewage backup flooded our apartment, landlord claimed it would take up to a week to fix, refused to compensate, claiming the apartment was "habitable"

    Posted: 25 Apr 2019 09:40 AM PDT

Sorry for the poor formatting, I am trying to get this situated for them. Posting for a friend because they are too stressed out.

They live in an apartment complex in Oklahoma, which about a week and a half ago had a sewage backup that flooded their apartment. The entire apartment reeked of sewage, the carpets were damp to the point that if you stepped on it, you could make a puddle of water. (This is all on video) A few days ago, a couple more friends helped them clean up and broke into hives afterwards. I could not even walk into the apartment without gagging. It was bad.

This event happened on 4/18. They put in several work orders, and finally the manager called them and told them a plumber could not come in to fix the backup until Monday (4/22). They did not even send anyone to replace the carpet until today (4/25). They had to tear up all the carpet in the entire apartment.

They had a meeting with the landlord where they asked if they would be prorated for the time in which they had to find new living arrangements. The landlord refused, claiming the apartment was habitable. Meanwhile they have stayed with various friends over the week(+) because staying in that apartment seemed to absolutely be a health risk.

My friends spoke to a legal representative for the University they attend, who told them they had no chance of winning, and could even be countersued if they tried to pursue this.

Is this correct? The apartment was absolutely disgusting for a week, they were expected to live in it? I need some help, as well as any recourse to fix the situation. It does not seem right to me that they are expected to find and pay for their only living arrangements when their apartment flooded (through no fault of their own), when it took the landlord a week or more to fix it. I can provide any more needed information in case I missed anything. Thanks for the help!

Signed the contract for the job, gave my 2 weeks at my previous job, now they are saying they hired more than they wanted

    Posted: 25 Apr 2019 10:45 AM PDT

Not me but my friend (she doesn't have Reddit). So a staffing company was hired to find and hire people for a 12 month contract. This company (that she would be working for) is a fortune 100 company. My friend got the acceptance letter, signed the contract, did all the HR paperwork, passed the background test and the drug test.

She had to take the drug test twice because the first time the sample had "too much water" and the second time they did the wrong test. She and the others hired were suppose to start this Monday. But since he drug test too longer than most they said all the spots were filled and that she would have to wait to see if any they have any other openings. Spoiler: They didn't. The reason the staffing company gave was that the fortune 100 company hired more than they should have because they thought some wouldn't pass the background check.

So now she's unemployed. Is there anything she can do legally? Location: Texas

Rotten Ex-boyfriend Keeps Showing up I need Legal Advice

    Posted: 25 Apr 2019 06:53 AM PDT

He's a thief and a liar and good at both. I've made it very clear I want nothing to do with him but he keeps coming around. he doesn't knock, just comes right in. Yesterday, he brought his girlfriend and some other guy into my backyard and they just helped themselves. He swears it wasn't him but I saw him. Can I call the police about trespassers on my property if it happens again?

Property manager is trying to kick my wife and I out of our Lease 6 weeks before having our first child

    Posted: 24 Apr 2019 03:47 PM PDT

We live in Denton, Texas, USA

My wife and I trying to decide if we have any legal grounds to fight being kicked out of our Lease that we have already signed to last until June 2020.

We have been renting this house for two years, and just like last year, our landlord sent us a lease renewal, which we signed electronically and submitted. Same exact process as last year to renew our lease.

    March 5, 2019

Lease Renewal Notice requiring I respond by March 19, 2019

    March 7, 2019

    Lease renewal email

    March 19, 2019

    Signed Lease Documents:

    In Dxxxxxxxx Property Management Portal

    Screenshot of Sign and Accept

    March 20, 2019

We received notification from Dxxxxxxxx the property manager's secretary Jxxxxx via an e-mail, that the house was being put on the market. Jxxxxx assured me through text message that the new lease was until June 30, 2020 and would be honored even if the home sold.

Screenshots of our Text Conversation with Jxxxxx 1 2 3 4

    March 25, 2019

This was the day where things started to get weird. House is listed online. The listing doesn't mention anything about the June 2020 lease. We have several showings in just a few days. I reach out to Jxxxxx (Dxxxxxxx's secretary) and Txxxxx ( Dxxxxxxxx's Listing Agent) about correcting this.

    Text With Secretary

    Text With Listing Agent

    March 26, 2019

At around 5:30pm without any notice a young couple and their realtor shows up to look at the house, under the impression that our lease is up in June 2019, so we contact the listing agent again.

    Text Conversation with Listing Agent 1 2 3 4

After that the Listing is corrected to reflect that there is an active lease until June 2020.

    April 4, 2019

Since they updated the listing, the house had zero showings, as no one is interested in buying house with a year lease attached to it. Curious about the listing, we check the online listing again and discovered that the listing changed to show that the lease was only until the end of June 2019.

My wife then called Dxxxxxxxx of Dxxxxxxx Property Management himself, and had about a 10 minute conversation with Dxxxxxxxxx in which, in my wife's words "He stated that I did not have a lease, but only ' an agreement to pay a certain amount of money ' and had no contact with Jxxxxxxx or Txxxxx during the time they were updating the listing and assuring me my lease would be honored, but Dxxxxxxxx assures me he can get the "owners" (his father) to complete a 'lease extension' since according to him I do not have a lease in place. He said he would be happy to complete a 'lease extension' but could not do it without the 'owner' who is out country. He assures me he will contact me in one week, when the owner is back in country. I tried to reach out to him three times, but I did not hear from him for 19 days"

    Proof of Phone Conversation

We know he lied about not having contact during that time because of this email that Jxxxxxx his secretary sent us an-email back on March 24th, offering to sell us the house (for an inflated amount) on Behalf of Dxxxxxxxx.

Proof of Knowledge Back on March 24th

    April 12, 2019

    First E-mail

    April 15, 2019

    Second E-mail

    April 17, 2019

    Third E-mail

    April 23, 2019

After not hearing from him for 19 days, we finally received an e-mail notifying us that they are terminating our lease giving us 90 days to vacate the property.

It is our sincere belief that Dxxxxxxxxx is lying about the validity of his own lease documents and forcing us out of our home and lease. My wife is pregnant with our first child and is due in mid-September, 6 weeks after we would be forced for our home. We signed the lease deciding we would rent one more year and have our first child, then focus on a big stressful move. It doesn't feel right that because he is in a financial jam that he can force us into a stressful life change after we singed a lease and made our plans. We were about to start getting our nursery ready next week.

He and his staff were fully aware that we signed a lease until June 2020 but this is interfering with the sale of the house, which he stated on the phone he "needs money quick so they need to sell a property".

Is he trying to get away with breaking a legally binding document?

Is there some loophole that he can exploit to kick us out?

Is it worth the fight? Is the evidence on our side?

We are actively looking to buy property/a home but if we don't find the right one we want the option to fulfill our lease.

TLDR: Shady Property Manager needs to sell a house for some quick cash and is claiming we didn't sign an actual lease so they can kick us out six weeks before our first child is born.

Thank you all for your time.

Can a business owner force managers to test employee owned vape pens?

    Posted: 25 Apr 2019 06:56 AM PDT

The business owner of a restaurant (USA, NC) has been concerned that employees are using illegal substance in their vape pens to possible get high during work hours. They have implemented the following changes in an attempt to police this:

    • Managers must sample each employee's vape pen before it is used on a smoke break.
    • All employees must use see through "clear" bags while on premises.
    • All employees must consent to a personal item search at least once daily.

How can this be legal? It doesn't seem that you can force a manager to inhale a possibly toxic or illegal substance just to verify that it is a normal vape pen. That aside, what if the manager doesn't smoke? Seems like a lawsuit waiting to happen, but they are adamant and claiming it is a condition of employment.

Additionally, what are the feelings on the clear bags and personal item searches?

    Thank you for your help.

Mother-in-law died and sister won’t produce the will (NC)

    Posted: 25 Apr 2019 10:20 AM PDT

    North Carolina

My mother in law died in February. She owned 50% of a house in Harnett Co., without survivorship, with her daughter. Her daughter has sole possession of the house. The house is owned free and clear and is worth $59,000 according to property tax records. My husband is the only other child. There is no spouse or parents or interested parties.

In all likelihood, my mother in law died intestate. It fits with what I know about mother and daughter. If there's a will, it's holographic. We asked the daughter to see the will. She says she has it but won't show it to us. When asked if she filed it with the court, she assumed we were "suing her in probate court," and told us to have our lawyer contact her. She's diagnosed mentally retarded and she has an IQ of 70, so that does play into what's happening here.

I want to discharge our interest in the property, in a every scenario other than her selling the house right away (which she says she's doing), and then I want our share of the cash from the sale.

I think she thinks that if she just lies to us and says there's a will, that when she sells the house, she'll just keep all the money because we won't know or something. She doesn't think the state or county have any part in this.

Should I talk to a lawyer? I worked in property tax and I know that if the mother's 50% is listed on the deed as "heir of mother," then the sister or brother are jointly and severally liable for the property tax until proven otherwise. And that the county will just collect from the person most able to pay, which is us. She's not paid her property tax in the past, so this is a pretty real concern.

Got a letter from my neighbor threating to sue me for harassment because I called the cops on her in Florida

    Posted: 25 Apr 2019 02:12 PM PDT

My neighbor has 2 dogs. She keeps the dog inside and never take care of them. Naturally, the dogs bark all day. When she is not there, they bark all night.

I had to record the barking and send it to the HOA. The next day she confronted me telling me to never film her house again yada yada.

I spoke to the HOA and they did jack shit.

So I started calling the cops every time it became a nuisance. The first time I called the cops, she banged on my door and confronted me once again. We got into a heated verbal argument.

The cops straight up told me to keep calling them because they can fine her. It does not matter if it's at 8AM or noon. If it's a nuisance, they will fine her.

Today, I received a letter from the HOA/lawyer stating that if I don't stop "harassing" her, they will take legal action. They don't mention how I harass her or anything. The letter is very vague actually. It's just asking me to stop "harassing" her or they will take legal action. I never once approached her myself regarding the subject. She was always the one who confronted me.

    What should I do?

    Thank you,

Scammed out of money that was won on a bingo app?!?!

    Posted: 25 Apr 2019 08:36 AM PDT

So currently unsure what to do.

I'm from the England. My mum frequently goes on a bingo app that she has on her phone and she has won a good little sum of money over the months that she has played it. The most that she had won is £800. Today she was playing it and she ended up winning the jackpot which is £2,500,000.00, while the app was adding all the money, the app crashed, (this is the first time it had ever crashed) she then rang the people that run the app and the first person told her that she has won no money (my mum thinks this person was lying to her) when she rang again another person answered and told her she has won money but then went back on his word and kept slipping up. My mum now thinks these people are lying to her to so they don't have to pay. We have contacted a Lawyer but we are unsure if there is anything else we can do.

Boss touched me. I have no proof and I don't think anyone saw.

    Posted: 25 Apr 2019 12:27 PM PDT

Georgia. I'm typing on my phone so I apologise for any typos and bad formatting.

I work for a small sales subsidiary of a very big Korean company, and it is very common for us to have dinner after workshops/meetings.

Well, I tagged along to one of those last Wednesday, and the boss offered to pour me a drink. He was hammered already and ended up spilling some on my pants. So he starts dusting off my leg to get some of the liquid off my pants, and that's when it happened. He moved his hand over and dusted(?) over my privates twice or three times.

Now, there were people from headquarters that had flown out from Korea and Koreans can be a little touchy with like pats on the butt and stuff... So I didn't want to cause a scene and tried to laugh it off. But when he saw me laughing he said 새끼 엄청 좋아하네 which is along the lines of 'this kid likes it so much' (sorry. Shoddy translation, but it's kinda complex) and he went in for a couple more touches!

I was shocked, but still didn't want to cause a scene because I'm the youngest employee at the company and he's literally the big boss (I know. Stupid.), so I tried to laugh it off again. Then he asked DIRECT(translated) QUOTE: "are you a homo by chance" as he went in for another feel. I made an excuse that I had to go to the bathroom, got up and went to a different table.

Come the next day, I called the restaurant to see if they had any camera footage. They said there was only one camera in the room, but they asked exactly what I was looking for. I told them loosely that I was touched, and they told me they would call me back if they see anything. They confirmed my number and name (caller ID) before hanging up. I worked Thursday because I had some stuff I needed to finish, but I avoided big boss - not that he remembered anything since he was super hammered. Then I called out "sick" Friday.

I didn't get a call back over the weekend, and I showed up to work Monday. Big boss calls me into his office and asks if something happened at the dinner. This caught me way off guard because he should have no recollection of it. But it turns out that the restaurant owner is related to someone high up in the headquarters (Korea) and basically gave him a heads up. So then I told him what happened and he said he was sorry but that he didn't mean anything sexual, and that's just how they show friendliness in Korea, and it won't happen again. I didn't feel comfortable being in his office so I just said sure and walked out.

I asked around the office and this isn't his first time. He's touched like almost all the men. But nobody had bothered to say anything. It's a weird dynamic with the whole Korean culture and all... Anyway, I tried to forget about it but when I came in and saw his face Tuesday, I felt like punching him. I decided that remaining in an environment where those actions are overlooked as something trivial. I sent my resignation letter to HR, and told him what happened.

I'm not expecting anything to happen from HR, because he knew about all the other instances too. Nobody has formally reported it before. I don't think I'll ever get any footage from the restaurant, and I highly doubt that the camera even caught anything since they said there's only one camera in the room and we were all sitting down, so the table probably covered it. I can't expect anyone to testify, I don't even think anyone saw? And they didn't even report their own instances...

Do I even have a case for a lawsuit here? With no hard proof? And would it even be worth the hassle to try to escalate this?

    Thanks in advance.
