This is in Chicago IL, I posted initially to r/legaladvice and they recommend I post here before considering legal options My wife left her previous job back in November after giving 2-3 weeks of notice that she was leaving. She was to be enrolled with her current employer on 2/1/19, but received a call from her new HR department saying that they could not enroll her because she was still covered under her previous employers plan. We thought, that can't be, she's not getting paychecks or paying any money towards that plan (or using that plan). She contacted her previous employer asking them to immediately remove her from their health insurance. They didn't get back to her until early March (they're a mess of a company), saying that "It was taken care of." Come April 1, we assumed she would be fully enrolled in her new company's insurance (if it matters, both companies use the same provider). Turns out, she was still covered under her old company's insurance, despite them telling her otherwise. She called the Insurer, was put on hold for 30 minutes, during which the rep had called her previous employer. The answer they got was that the previous employer was that they, and I'm actually quoting here, "refuse to remove her from their insurance plan." I don't really get how my wife can't simply opt out of their plan on her own, but that is what the rep told us. The rep said that they would keep trying to get the former company to remove my wife, but for the time being, recommended that if she need to, to just use her former employers insurance plan. We wanted to begin trying to have a child, but now feel like her future and health are being held hostage, and aren't really sure what to do next. We don't want to use that plan in case that somehow causes us legal complications down the road. Ultimately I guess my question is - what options do we have here? It's necessary for me to keep health care in the mean time, as there are some regular medications I need and doctors visits I need to be able to make. How do I cover the 3 month gap? Will the medicare work with me to provide me health care until I am eligible for my employers plan? What other options do I have? [link] [comments] |

Posted: 06 Apr 2019 06:01 AM PDT My sister is 19 and has been in more accidents than I can keep track of. She has rear ended all of them and also has had a speeding ticket for doing 90 in a 70. I turn 18 soon and have been thinking about doing this for other reasons but this is really making me want to. My mom gets angry every time and threatens to kick her off the insurance yet her does. I would rather get my own and it goes down yearly then having my rates consistently go up. She pays the difference when the rates go up but I find it frustrating. Also, if I get my own policy but live with my mom, do I need to list my mom or sisters as drivers? Will it matter if I don't considering none of them will ever be driving my car (getting a car after I'm 18). [link] [comments] |
My car was hit by a bus and now I'm being sued by 7 people on the bus. KY Posted: 06 Apr 2019 09:50 AM PDT My Prius was hit by a city bus and sustained $3k worth of damages. The bus' front bike rack was dented less than 1/4 inch, which was the only damage. I have several pictures of both cars damages. The accident happened in January, it was immediately reported to my insurance (progressive, in Kentucky but I live in Indiana), and there were police on scene. 1 person on the bus requested a medical evaluation and when I asked the buses insurance agent, he said that the guy was probably taking a dive. He told me "you know how it is, whenever there is an accident suddenly everyone's back and neck hurts out of nowhere", or something to that effect. I received a letter from my insurance today saying that 7 people on the bus are now suing me for personal injury. The guy who took a dive is claiming $50k worth of injury. My policy covers $50k per person, $100k per accident. I'm sure that they chose their claim number based off of my insurance max and that my insurance will negotiate a more reasonable settlement. Am I able to increase the policy at this point to cover more or would that be a bad idea? The letter I received let me know that the other people have attorneys but have not claimed a number yet, so there is not a total but they were letting me know it's possible that my insurance wouldn't cover all of it and I'd be liable for the difference. In my 7 years of driving I've never been in any kind of accident or received so much as a parking ticket. Does my clean driving record have any bearing on a decision? Of course their attorney is trying to paint me as a negligent driver. Do I just sit back and let my insurance handle everything? I'm very worried at the thought of having to pay thousands out of pocket. Should I hire my own attorney or let my insurance's attorney handle the case? Do I have the ability to counter sue the bus for the damages to my car? My insurance covered the cost initially but I did have to miss a day of work due to the repairs. [link] [comments] |
Grundy Auto Insurance - any experience? Posted: 06 Apr 2019 09:31 PM PDT RE - https://www.grundy.com/collector-cars/ I have an impeccable '94 Miata. My current carrier, Nationwide, stated that in the event of a loss they would start at Blue Book value and discuss from there. The problem is that Blue Book is around $4K. Private party my car is likely $8-10K. Someone I met turned me on to Grundy Insurance. They've been around quite sometime and will do ~$171 per year for Comp and Liability at a $10K value. This doesn't seem to be apart of their offering, and means that I myself would be liable for my own medical costs. That's concerning as my current policy lists this as "state required - $40K". How can I get car insurance as a high risk driver? Posted: 06 Apr 2019 09:22 PM PDT I'm 18 and I became an addict and made stupid choices and I'm trying to clean my life up now. Anyway I got my license suspended for 90 days, I have a DUI on my record, 2 car accidents at my fault in a matter of less then a year. I called allstate insurance but they denied me. Posted: 06 Apr 2019 11:24 AM PDT Will I have to pay back the tax credits I got? Will I be ineligible for the ACA next year and have to try to get medicaid? I'm thinking I'll just not take some deductions and pay the extra tax for having a bigger income. It seems like the easiest thing to do, especially since my state didn't take the medicaid expansion so I'd probably fall in the gap where I can't get any insurance. [link] [comments] |

I let a friend of mine borrow our family's extra car for a few days and at some point he fell asleep behind the wheel and hit what he insists was a stationary object, completely messing up the front of my car. It's an older SUV and the Blue Book is like $1,800 so it might end up being a total loss. When I told his I was going to need his driver license # and other info for the insurance claim he said he'd just buy it for $2,000 and said that he wouldn't even answer his phone if I gave his phone number to Geico. I'm so frustrated, can anyone help with telling me:

Apparently there was an error and they had to add an endorsement to keep my house insured. My premium went up by over $100. Vehicle Appraisal showing Frame Damage Posted: 06 Apr 2019 10:51 AM PDT I was rear ended last year in August and the other parties insurance accepted fault and paid to repair the vehicle. I was told it was mainly cosmetic damages and specifically asked the collision center if there was any frame damage. I took my car recently to carmax to get appraised and they're saying there was frame damage. Do I have any recourse with the insurance or collision center? Is carmax reliable when it comes to these appraisals? They explained it was classified as structural damage due to the bar in the bumper being replaced and welded. [link] [comments] |
Should I file an insurance claim for damage to my own car? Posted: 06 Apr 2019 03:19 PM PDT Long story short I hit a median/curb driving which caused some tire damage/axel bend and shifting underside. My car is 7 years old, 120k miles, paid off, and blue book value of about 4K before the accident. I had it towed with triple a to a shop and they say the parts and labor will be about 4400$. I have collision insurance, but I'm confused if it will even cover it. If it does is it worth to file a claim? I was planning on starting to look at a new car in a few months anyways, but will obviously lose any trade in value I may have gotten. I'm already upset at my self for causing this issue! I was thinking something like an investor will pay a a semi-annual, quarterly, or monthly premium to insure their stock investment completely (i.e. ONLY if they lost money on their investment they could cash in and get it all back). This seems slightly similar to a credit defualt swap but on stocks not bonds. I have a hard time believing this has not been thought of and is not being used on a grand-scale if there is not some fundamental flaw with the idea? Interesting situation with roof claim (TX) Posted: 06 Apr 2019 12:52 PM PDT I recently bought a house. During the contract period I had an inspection done. The home inspector advised having a roofer look at the roof due to concerns about damage. The sellers had a roofer come out and look. The roofer of course said it needed to be replaced due to hail damage. The sellers filed an insurance claim. The insurance adjusters said there was minor wind damage to one section of shingles and minor hail dents on the vents. The insurance cut a check for ~$200 dollars. The insurance said there was no major hail damage on the roof. I buy the house. I then have a door-to-door roofer look at the roof and advise me it needs to be replaced. I told him the insurance already said it was not damaged. He laughed and couldn't believe me - he said it was guaranteed a total loss. He told me it was definitely damaged. He went up top and took photographs to show me. Since there was a hail storm in my area just a few days prior to him inspecting (and also a few days after I bought the house), I went ahead and filed a claim. The insurance adjuster came out and said the roof is totaled and needs to be replaced. (This was approximately 2.5 weeks ago). I still have not heard back from the insurance company. I called and spoke to somebody at the insurance company (not the official guy that will make the final decision) He was reading the notes on the claim and said they are claiming no hail storms were reported in the area and that the damage I claimed is pre existing... but here is the kicker... I have the same insurance company that the sellers had. I called the original roofer the sellers used. They said the insurance company was borderline "criminal" when they denied the first claim citing no damage. TL:DR. Sellers insurance says no hail damage. I buy house and file claim. SAME insurance company says roof is totaled, but damage is pre existing. What are my options ? [link] [comments] |
Car Accident - other driver is a minor Posted: 06 Apr 2019 09:10 AM PDT I posted this in Reddit legal but didn't receive a lot of response so maybe some of you who are familiar with insurance claims will have knowledge how a situation like this could proceed. I retired from my job at the beginning of the year and having time on my hands I helped a friend out with a few occasional jobs where I would borrow his truck and drove on his insurance under permissive use, I don't have a policy of my own. I had an accident where I rear ended another car, there is insurance cover but what I did not realize is that as I was not named on his policy I was only covered up to state minimum (State: CA). The driver of the car I rear ended is a 17 year old who had basic minimum insurance cover. Her car was totalled and she has some minor injuries. She is aware that I only have state minimum insurance coverage. In a letter I received from the girl she states that she is still receiving some therapy treatment for her injuries though this should be completed shortly. She also states that as her car damage, medical expenses and some pain and suffering will exceed my insurance coverage, she will be claiming the amount above policy limit from me directly by whatever legal means she needs to take. From that, I assume that she means she will be suing me for damages, if so, I wondered that with being only age 17 and effectively a minor, if that might prevent her from suing me. However friend who's truck I was driving advised me that suing me through one of her parents is one route she could take and even if that was an issue, the statute of limitations gives her time to just wait until she reaches age 18, and she will then have the simpler option of suing me herself.
