My mother said she would kill herself the day I graduate high school (WA)

    Posted: 02 Feb 2019 02:36 AM PST

She told me this 4 or 5 years ago, that when I graduate high school that she would put a gun to her head and kill herself the night after I graduate. We have never had guns in the household, but the time is coming in a few months for me to graduate. To say that this has had a toll on my mental health would be an understatement, but that's not what I'm here for. Is there anything that I can do preemptively to have her not commit suicide? Even if it's a threat, I would rather be safe than sorry.

    Thank you for the help!

Edit: I just woke up for work, I'm reading through the comments now!

I have work now, give me two hours when I'm on my break and I'll reply to the rest of you all. Thank you for the kind words :)

[TX] I (14F) do not feel safe at home and am convinced i need to leave. Where do i go? What do I do?

    Posted: 02 Feb 2019 05:59 AM PST

For some time now, I've felt uncomfortable around my mom's boyfriend. They've been going out for a month and he's over 3-4 times a week now. He makes sexual remarks to me and has tried to catch me changing a few times. I've told my mom how I feel and she said I was "overreacting".

Last night I heard them having sex. I usually put my headphones on and ignore it, but before I did I heard him say my name and thrn my mom laugh. I quickly pit my headphones on and blocked my door.

I want to leave but I don't know where to go. I don't have any family I could go to and I don't want to be homeless or go to some group home or anything like that. I have no idea how this works or what to do.... please help me.

Edit: I have decided to take the overwhelming advice and contact the police. A friend of mine has a car and she is taking me to the police station. I have a back back with a few days of clothes with me just in case. I feel sick.

[NY] Epileptic and can no longer stay in apartment, can I get out of the lease?

    Posted: 02 Feb 2019 06:01 AM PST

Hello everybody, and thank you for taking the time to read this.

I have Temporal Lobe Epilepsy and my seizures have been controlled until recently. Something's been going on in the past three weeks, and I've now been having random, longer seizures, never going more than two days without one. I am currently in the hospital as I have sustained a concussion and a broken orbital bone during a grand mal. All of my doctors are trying to figure things out, but in the meantime I have not been able to go back to my apartment. I live on the third floor, and needless to say, there are a lot of narrow, steep stairs to get up. Problem being, I fell down the stairs during one of my seizures and sustained a concussion during that spell as well. I feel very unsafe going back to my apartment due to the stairs, especially as I am alone and fear falling when nobody is around (thankfully my neighbor found me during my first fall).

I don't know how much longer this particular "flare up" of my condition will last, and fear that I may have to break my lease. When I told my landlord about my concerns, he immediately got upset and tried to accuse me of taking legal action against him for falling down the stairs on his property, which I would never say or do because that's stupid. He then said that I was required by law to tell him of my condition ahead of time, which I also know to be untrue. He said he will not let me out of my lease without a fight because I'm a con-artist. I have a year lease that I am five months into, and I've never once had an issue paying rent on time, being loud, etc.. I also hardly ever ask him to repair things as I do most repairs myself. He's demanding a payout of $4,000, and he'll keep my security deposit.

What are my options here? I can't afford to stay in the apartment, let alone the payout, as I can't work at the moment, and qualifying for disability has been a long, arduous process. I'm living off of savings at this point. I'm paid through February, but I just don't know what to do if this continues. Any advice and/or recommendations would be much appreciated!

Also, I am located in Upstate New York.

Michigan Tenants in Common, have had half of their family home/business property sold out from under them.

    Posted: 02 Feb 2019 07:09 AM PST

So close friend of mine called me up, hysterical last night. Three years ago, her adult daughter walked away from their home. Mom and daughter own the property as tenants in common. In those past 3 years, the mom has paid all the upkeep, taxes, insurance and heating costs of the property. She also started a small business off her property to help offset the costs.

the mom was fine, having it this way, and hoped this small argument with her daughter would be fixed and that her daughter would come home. Well it did not get fixed and the daughter decided to do a partition sale, and sell her half of the property to some weird guy from new york.

The weird guy called up my friend and started telling my friend, that he wanted to see all the income from the past 3 years of her business, so he knew how much they would have to pay him...every month..for them using his half of the property.

He also claimed he would be there on Monday to get an idea of the layout of the property so he could choose his half of the acreage for his own use. He also said if they don't start paying him living expenses for them living in his half of the house, he would sue them or he could just move into the house with them.

My friend has no money, and no way to get an attorney. What can she do. Does she have to let him into the house on monday when he comes? He claims to have a partition sale contract signed by her daughter and that the daughter has been given money for her half. He refuses to show my friend the contract of sale, but the daughter did answer and email saying, yes I have sold my half of the property. So it's not a scam.

This is bad and my friend is scared...please help!

    Who owns the dog? CA

    Posted: 02 Feb 2019 06:23 AM PST

A month ago, my daughter and her boyfriend (20's college kids) were at a cafe doing homework and a homeless lady came in dragging a small dog. The homeless woman left the dog at the cafe, kicking it and telling it to go away, and disappeared.

They stayed until closing feeding the dog scraps and giving it attention. When the woman did not return, they took the dog home. After two weeks of looking for the owner, they took the dog to the vet, got his shots and regular vetting done, and licensed him with the state.

Yesterday, while sitting at the same cafe, the homeless lady showed up and tried to grab the dog back. The police were called, and they took the dog from my daughter's boyfriend and gave him to the woman. She told the police that she didn't have a regular address. The police said they "established ownership" and the dog belonged to the woman.

At no point would they look at any of the paperwork that my daughter's boyfriend showed them of the licensing, vetting, etc.

Do these kids have a leg to stand on? I know pets are considered property and a rather gray area. Honestly, if this woman doesn't have a regular address I don't even know how theyd go about finding her to take the dog back. I just thought I'd ask.

Friend was assaulted at job [NY]

    Posted: 02 Feb 2019 08:49 AM PST

I have a friend in New York state who was attacked by an older, larger man at her job. He pushed her into an elevator and forcibly kissed her. This was caught on tape and the individual was fired from the nursing home the two worked at.

Later, the company realized that they were legally mandated to keep the maintenance position filled that the man was fired from. Instead of finding someone else, they rehired him and fired the girl.

What course of action can she take?

Husband has spent $20,000+ on video games putting us deep into debt. Am I liable for the debt?

    Posted: 01 Feb 2019 06:53 PM PST

Divorce is imminent, but before I talk to a lawyer I kind of want to know what to expect.

To sum up the last year, I learned that my husband has spent a lot of money on in app purchases for a video game. He drained our savings, over drew our bank account, and maxed out his credit card. He then took out a substantial loan using my vehicle as collateral (in both of our names, I'm pretty sure, but I primarily use it), paid off his credit card then maxed it out again within a week from in app purchases to the tune of $6,000+.

The final numbers aren't clear because he is pretty good at hiding things, but it is at least $20,000 over the last year. Probably more.

Side note, through this game he has a virtual girlfriend, for lack of a better phrase. He has sent her gifts and spent money on her through the game. He has never met her in person, as far as I can tell.

I'm in Oklahoma, but different people I have asked have given me different answers about my liability.

The question here is... Am I responsible for his credit card debt and the loan he acquired by using my vehicle as collateral since we are married? Is this considered marital debt or will he be responsible for all of that since it did not benefit me or our children whatsoever?

Apartment Complex Evicting for Helping Suicidal Friend

    Posted: 02 Feb 2019 05:33 AM PST

U.S., Texas, Arlington. I will try to be blunt and to the point. This past Tuesday evening my fiancée and I received a call from a friend stating they had shot themselves. He, in a panic, would not listen to our pleas to stop and call the police to his location. Instead he drove to us, we prepared for this by having the police here when he arrived. We had already informed them he had a weapon, but it was unloaded in a bag in the backseat. The police got him out of the vehicle and into an ambulance. No issues, he wanted help and not to harm anyone (regretting harming himself). We have been unable to see him as he was in ICU. Yesterday (Friday), we finally got to visit him. After sharing some sad times and smiles we returned home to find an eviction notice. The complex claims we breached our contract by "guest with gun and police involvement on the property of the ******* bear building **". Is this legal for them to do? I feel like we should be protected by the Good Samaritan law as we were saving his life?

Moms ex-boyfriend says hell have my mom arrested if she puts his stuff on the lawn for him to collect

    Posted: 02 Feb 2019 09:56 AM PST

My mom's just recently broken up with her abusive ex boyfriend, who lived with us. He left her, she didn't kick him out. After a lot of back and forth, she finally told him to come and get his stuff, that she'd put it outside, and if he doesn't get it by Tuesday it'll go out with the trash.

He texted her and said he'll have her arrested if she does that. Would he have any legal standing to do so? Does that even make sense?

    Edit: this is in NY

Backed into someone's car & now they're trying to get cash from me (keep refuting going through insurance).

    Posted: 02 Feb 2019 06:00 AM PST

Last week I mistakenly backed into someone's car in Burbank, CA.

My insurance deductible is $1k. The estimate was $2.5k. They want to avoid going through insurance (after I offered my insurance).

After telling them to go through insurance when I saw the $2.5k quote the person is "willing to accept $1k outside of insurance even though the estimate was more than double that". Now they are trying to give me reasons why I shouldn't go through insurance.

This is not my first offense & I know my monthly payment will significantly increase. (I received a DUI 5 years ago, so this is not a good mark on my already tarnished record).

My question is: Can I be protected by a signed, notarized statement if I pay the person $1k via check? I really cant afford more than $1k & my insurance might drop me for this offense after the DUI and other incidents. Thanks in advance.

Is it illegal to hand out pamphlets outside of a pet store (more inside)?

    Posted: 02 Feb 2019 12:22 PM PST

I am doing a school research project on commerical breeding facilities (aka puppy mills). Specifically, I am trying to ascertain the level of awarness regarding CBF's in the USA. I plan on standing directly outside of pet stores on the sidewalk and asking people to take a brief survey. I also plan on offering informational pamphlets to be given out after the survey has been collected. Would this be considered illegal? Is it trespassing? I live in Virginia.

    Thanks!

Being told I cant take other jobs as a private contractor.

    Posted: 02 Feb 2019 09:13 AM PST

[MI] Currently one of the private chefs for a Fortune 500 businessman. I have an NDA so please don't ask who. Most of his staff lives where he is full time, I live where he has second homes that he visits maybe 12 times a year for about 4 days each time. Its a huge production when he comes in, working about 17 hour days when he does. I am a private contractor making $25 an hour, Ive been with the family for a year and a half now. About 6 months ago I bartered with them to be paid for 25 hours a week regardless if he comes in or not. I was told I have to be available at the drop of a hat, so I cannot take side jobs. I was even told that. So basically I have to be available for full time work but only being paid for part time. Ive had to cancel and turn down side jobs because he either came in or he was potentially thinking of coming in. Last night I asked for a $10 increase to be paid at least a living wage. They were very wary about it because some of the staff where he lives full time get paid $25 an hour, but they also work full time and get benefits. Are they allowed to tell me I cant take other jobs while being a contractor? I don't think i'm being unreasonable.

Company is making me a 1099 independent contractor, but claims my non-compete will still be valid. Advice?

    Posted: 02 Feb 2019 08:05 AM PST

    Cross post from r/Advice

Pretty much as the title says. I have been an employee with health insurance for a year, and my company is forcing all sales staff to become 1099 independent contractors. They claim that the non-compete I signed as an employee will still be valid, and they will make all employees sign a similar non-compete when the change is official. Everything I've read says that non-competes for independent contractors are mostly un-enforceable. Does anyone have any advice on my options? I intend to leave the company and work with a competitor before I lose my health insurance. I also don't 'plan on signing anything the company gives me.

Lied to by a rescue group

    Posted: 02 Feb 2019 10:17 AM PST

(MD) My husband and I are avid animal lovers and have several of them. When we take in a new animal (almost always rescues) we plan to keep the animal until death. However, sometimes animals just don't get along and one has to be rehomed. We brought a kitten into our home eighteen months ago and while she got along well with most of our animals she terrorized one of the other cats to the point that rehoming became our only choice. We did research and chose a place that came highly recommended and paid an astronomical fee to have the cat rehomed, this was less than three weeks ago. Yesterday the place was raided and all of the animals confiscated because of neglect. I was able to get the woman to tell me where the cat is, and that she never took her to a vet or used the money for the agreed upon reasoning for demanding it. We cannot bring this cat back into our house, my husband and I spent hours last night trying to figure out what to do. My question is, do we have any legal recourse against this woman? I have everything documented about the situation. I am at a loss as what to do, if anything. We are so angry and feel betrayed and obviously lied to. Any help would be appreciated.

[OR] My dad wants me to commit insurance fraud

    Posted: 02 Feb 2019 09:26 AM PST

Hi all! I was recently involved in a car accident where someone hit me from behind at a stop light. Luckily, no one was hurt at the scene, but even though this whole thing wasn't my fault, I've been going through a lot of grief for it. The other's insurance totaled my car because the damages outweighed the value of car, and now I'm scrambling to find another car to get me to school.

When I told my dad about the whole thing, he immediately started to tell me to get a lawyer, say I have back pain, and sue the people that hit me. I told him that I don't have any pain as a result from the accident. It's been three weeks now and I still have no pain.

He's still bringing it up over and over trying to put it in my head that "I don't know if I'm hurt or not and I could feel pain 5 months from now as a result of the accident". Over the phone he started to insult me, calling me an idiot and saying that I was inconveniencing everyone around me for not lying about being hurt. I don't want to lie, and all the responsible people around me are saying that I could go to jail if I lie.

My main question is: could I get in trouble for pretending to be hurt? There's no way I'm gonna even attempt suing, but my dad kept repeating how I'm an idiot who doesn't know the law. I figure you guys do, so what would you tell him?

(WA)My 3 year old came back with half a front tooth chipped off and says (her moms bfs name) slapped her.

    Posted: 01 Feb 2019 07:39 PM PST

This came out of nowhere. I asked if she fell down or someone hit her. She said someone hit her. I said who hit you and she said, "not mom, not (sisters name)....(moms bfs name)" I did not coach her or mention my kids moms bfs name.

I dont want to drop her back off on monday after hearing this. Should i call cps on monday or go get an emergency protection order or should i call cps and still follow the parenting plan? Should i take a 3 year old serious?

Talking to her mom is out of the question. Shes a pathological liar. My poor baby :( this is so messed up.

Edit: thanks legal advice. I have called cps and someone is going to come over today and then a report will be forwarded to the police (crime check noted it and will wait for the cps report since i had already called them).

[LA] Was wrongfully accused of being drunk and belligerent, my promotion was terminated, and a manager tried to intimidate me into putting in my two weeks.

    Posted: 02 Feb 2019 10:14 AM PST

    Hi all,

So I work as a bartender at a hotel chain. I've been in the middle of a transfer/promotion to be the bar manager of another outlet in the hotel.

This past weekend I was working a particularly slow night. My manager cut me and I approved with him that I could go have a drink with friends who were already at the outlet that I'm transferring to. I have three drinks over the course of two and a half hours, chat with my friends, and head home by 12:30. Pretty tame and uneventful evening.

The next day I get a text from my beverage director, who is my supervisor's supervisor, asking when I would be on property next. He asked me to come in and meet with him on my day off. I agreed thinking I would finally be signing my paperwork for the transfer, but I asked him if he could tell me what the meeting was about anyway, and he told me no.

I show up to meet with him and am brought into a private office with no witness and no cameras. I am asked to recount what happened "on Sunday" and I was so absolutely lost about what was going on at this point I just responded with "what Sunday?"

He proceeds to tell me that the bartender at the outlet had complained about me. He said that I was progressively more loud and outwardly aggressive towards him throughout the evening, that I came in already drunk - I never drink behind the bar, also - and that I eventually fell asleep on the bar. I'm dumbfounded and blindsided by this, and I asked if they had pulled the camera footage because at no point did any of these things happen. No one had checked the cameras, and wouldn't do it for another two days after this meeting. My beverage director then turns on the guilt trip. He tells me the bartender was offended about me making pointed remarks about "white male privilege" - I didn't make any remarks about any privilege - and hung the fact that this bartender was a victim of a hate crime over my head. He told me I had fucked everyone over because him and another manager would have to pull more hours since my transfer had been put on hold indefinitely, and other folks looking to move up at my own outlet weren't going to get the hours they were counting on now that I wasn't moving. He told me I should consider putting in my two weeks because of all of this.

At this point I'm confused and devastated. I go home and contact my two direct supervisors who, conveniently, were off property for a training as all of this unfolded. They immediately started working to rectify the situation, but not before these accusations against me made it all of the way up to the GM of the hotel. Meanwhile, not a single person has done their due diligence in verifying that this story is even real.

My managers get security to pull footage of the events four days after they had occurred. It was the first time the security director had even heard of an incident happening. They went over footage of my shift before I went next door, and my entire visit to the other outlet. They verified that I didn't have anything to drink on my shift, that I only had two beers and a cocktail next door, and at no point did I fall asleep or appear erratic in any way. Not only that, but the two people who had corroborated the bartender's story weren't even on the floor for the entirety of my time at this outlet.

Now my career is on the line. While I know ultimately my name is clean in all of this, I fear there will be no meaningful recourse for the people that allowed this to get so far up the chain of command without first confirming it had ever happened at all. And I am especially upset with my beverage director for cornering me and attempting to intimidate me without HR, a witness, or even any paperwork. Even if my transfer miraculously goes through, he is not a person I would feel comfortable working anywhere in the vecinity of again.

My direct supervisors are still working to get to the bottom of this on my behalf, but I'm fearful that their best efforts won't be enough to rectify all of the damage that's been done. I'm not entirely certain what my next moves should be.

Edited to clarify that I didn't say anything about white male privilege to bartender or friends.

    Dog destroyed rental floor

    Posted: 02 Feb 2019 07:05 AM PST

Hey legaladvice, I'd appreciate your input.

I live in a tiny cottage, and I have a 1 year old dog, about 70 lbs. Right now I'm just waiting out the end of my lease in August to rent a house that has a fenced in back yard, because this dog came with a set of problems that has made it nearly impossible to get him out to exercise in public. I'm not really looking for advice on the dog, I'm trying to change his circumstances as fast as I can (unless you have any advice for MAJOR chewers who lose their chewtoys within seconds).

This dog has completely destroyed the linoleum in the cottage. He's dug/chewed up several layers of huge patches. I paid a $600 dollar deposit and an additional $250 pet deposit. Obviously I'm not getting this back but I need to tell the management property and figure out the best way to approach this. I want to do right by the landlord but I have basically no money (full-time student) and I don't want to be a bad renter. Any advice from lawyers or landlords would be appreciated.

    Edit: In Florida

Our apartment complex has been acting real shady about our lack of heat. Do we have something to be concerned about? In Ohio, if that helps!

    Posted: 02 Feb 2019 08:21 AM PST

We moved into what we thought was a nice, "luxury" apartment in July of 2018 in the suburbs of a large Ohio City. Third floor, one bedroom, vaulted ceilings, all appliances including a washer/dryer, and AC/heat. Our AC/heating system is apparently a water based system that's hooked up to the water heater and disperses cold air throughout the apartment through vents in the ceiling.

During the summer, we had major issues with our AC. The apartment wouldn't get cool below 72 degrees. We were desperate for it to get cool and we were constantly calling the front office/maintenance for them to come send someone to look at it. They would sent people out to "recharge" the unit, it would be fixed for about a day, and then fail again. We'd call about it and start the whole cycle over. Eventually, they just gave us one window AC unit. That helped (but you know. Those things are so loud sometimes you can barely hear yourself think. We never complained about it though). Our electricity bills were OUTRAGEOUS because the AC was just constantly running, trying to get down to the temperatures set it to.

Now, it's winter and we can't get the heat to go above 58 degrees which made the polar vortex very uncomfortable. We called the office, explained the issue, and they sent someone up who cleaned out the hoses connecting our hot water heater to the unit that controls the heat. It helped for about 3 hours and then we were back down to 58 degrees. We've spent the past few days calling and being the run around by maintenance and the front office. Finally, we stopped by the front office to let them know we still barely had heat and wanted it fixed. The woman in the office said that a pipe had burst in the apartment complex and that after they dealt with that, they would send someone over. She also mentioned that they would send a contractor up to come look at the whole system because she knew we had had issues in the summer too.

No one was able to look at our heat that night. They did send someone over with a space heater (the size of a small amazon box). That was Thursday.

Friday afternoon, I get a text from the front office asking to update my renter's insurance so the apartment complex would be listed as an interested party, something that was not required when we moved it. I updated it.

Today (Saturday) the maintenance guy came up to try and fix it again. He replaced the thermostat reader, but as he was doing so was telling us that another apartment had had a burst pipe and it was the apartment across the way from ours. Their fire suppression (sprinkler system) pipes had burst and ruined a lot of their stuff. And not just theirs, but the two apartments below them. The maintenance guy also said that the reason the Sprinkler systems burst was because there was no insulation in the ceiling above us.

I'm concerned that the apartment complex is being shady and wondering if we should consult legs counsel because the apartment complex seems to be aware of the fact that the lack of insulation in the ceilings is causing apartments to be too cold in the winter and too warm in the summer. And they seem to be aware of the fact that because the apartments get too cold in the winter, the sprinkler system pipes burst and they want to make sure they're going to get a cut of the money if they do. But they won't fix the problem by insulating the ceiling properly. It kind of seems to me that they're just leaving tenants open to this huge risk of pipes bursting and ruining their stuff.

I hope that's clear enough. Is there anything we can do to remedy this situation, to let the apartment complex know that we see what's happening here and we want a real fix to this? Not just a replaced thermostat replaced? We have renter's insurance, but that doesn't always cover all your assets and doesn't always pay to replace everything you've lost. Also, WE ARE STILL COLD and I cannot even imagine what our electric bill will be this month.

TL;DR: Apartment complex knows they aren't heating apartments correctly, leaving tenants open to the risk of burst pipes and cold.

Maryland, Gaithersburg usa. Landlord wants us to clean/pay for cleaning on 4 story townhouse gutters.

    Posted: 02 Feb 2019 07:09 AM PST

Here is our landlords proof that the lease says we must clean the gutters. https://imgur.com/a/Xl9tIjf

He told us we either have to buy a ladder and clean it ourselves or pay someone to clean it. He said the cheapest person he found was $150 and he is Willing to split the cost. The fact that he is Willing to split the cost makes me think it is his responsibility because he is the cheapest person i ever met and is always trying to make us pay for stuff. An example of this is when our heater stopped working in October and he said we must of broke it so we need to pay for a new one. It literally took us untill took weeks ago for him to finally have a guy come in and install a new unit. The repair man said the unit was over 30 years old and probably the original.

Sorry got off track, in the part of the lease he sent us he is claiming gutters are considered plumbing or drains. From reading the lease im pretty sure that refers to sinks/showers not roof related stuff.

Please let me know if i am im the wrong or if he is wrong. Ill happily pay the $75 to shut him up but if im right id prefer to keep some groceries money. We have been dealing with this nightmare of a landlord for 3 years and are finally moving into a real house so we need to save as much money as possible.

Thanks for reading and helping if you do.

Wife is going to be a nanny, and the family wants to pay under the table

Ohio. I've read enough stories to know that this is a bad idea for both sides, but would it be an alternative option for my wife to set up a small business for herself and consider herself an employee of said business, charging the family the amount they would be paying anyway?

Are there any benefits of this for her? Or would it be just more hassle for her, with no benefit to her or the family?

Need help with dealing with this Uber incident

    Posted: 02 Feb 2019 09:59 AM PST

I'm wondering if there's any legal action that I can take after my Uber driver was noticeably drunk while driving us home. He was so bad that he couldn't follow our verbal directions on which way to go and we were annoyed so we told him to pull over and he tried to start back up and drive away with us in it so we put the car in park and threw the keys into the snow outside the car so we weren't stuck in his car.

At this point the cops are on the way and he's literally falling asleep in the snow after doing snow angels so the cops don't even field sobriety test him because he's obviously demolished drunk, they arrest him and have his car towed. While the cops were with him in handcuffs the driver tried to charge at my friend which ended up with the driver getting suplexed into the street and him promptly driven to the can.

I'll give more details if need be, but at welcome to suggestion.
