I was rear ended... told I’m at fault by police

    Posted: 07 Feb 2019 02:37 AM PST

Hello, I was rear ended today while driving. After the police spoke to the other driver I was ticketed for making an unsafe lane change.

The story goes: I made a left hand turn into the left lane, then made a lane change into the right lane and drove approximately 60 metres and signalled to turn into a driveway. As I was executing my turn I was hit by a vehicle. The damage was to my passenger rear bumper and the damage on their vehicle was to the passenger side front. After a 3 hour police investigation I was charged and the officer told me he deemed me at fault for making an unsafe lane change. The other driver claimed I cut her off causing her to slam on her brakes and that she slid into me.

I have several problems with this: I do not believe I made an unsafe lane change considering I had enough time to proceed in the right lane and signal again to execute my turn and made it partially into the driveway.

Could he irrelevant but I feel there was some bias on the police officers side since I am a 26 year old male and was calm throughout the incident whereas the other driver was a 17 year old female crying with makeup running down her face. Even I felt bad for her totalling her parents vehicle. Thankfully nobody was injured.

I contacted my insurance and began the claim process but am extremely stressed out. I explained to them what happened and they stated they will contact the witness. (Who saw the whole incident and told the officer I did not cut the other driver off.) I plan to go to court and fight my ticket. (More to help plead my case to insurance as opposed to the 100 dollar fine). My claim adjuster was extremely helpful and told me I absolutely should go to court. He was shocked when I told him I was charged.

I took pictures of the damage but did not take pictures where the accident happened unfortunately. As the other driver was blocking the right lane of a busy road and moved into the parking lot to wait for police. I took pictures of the scene when both vehicles were moved.

What should I do? Who determines fault? Insurance agency or police? Can I obtain a copy of the police report?

I'm located in Ontario... thanks in advance.

Transferring large amount of money from one bank to another bank fastest way

    Posted: 06 Feb 2019 10:01 PM PST

    Hello,

I got into a car accident couple of weeks ago and I am finally getting the physical check tomorrow from the insurance company, $9k.

I am planning to purchase a new car and I actually got a good deal for this weekend. However, here is the problem: the car title was under my dad's name so I am actually getting the check under his name (going in together to pick up the check). What is the fastest, best way to transfer a large amount of fund from one bank to another? (I am using Chase and my dad is using BoA).

    Thanks in advance.

    CHIP Insurance Question

    Posted: 06 Feb 2019 07:17 PM PST

Someone from r/breakingmom suggested I post this here.

We live in Texas. I submitted our renewal for my daughter's CHIP in late January. She is almost 3 and I saw today she was denied. All of my information (income, job, etc.) is the same. The only difference I can think of is I have health insurance (which my employer covers). Could this be the reason she got denied? The app says my application was sent to the Health Insurance Marketplace on January 29, 2019 but I didn't submit my insurance card until February 1, 2019. My income is too high for Medicaid but low enough to fall into the middle-tier CHIP plan.

I plan to call tomorrow, but hoped someone might have some insight. Thanks!

Letter from BCBS after accident wanting to investigate claim

    Posted: 06 Feb 2019 07:51 AM PST

Essentially I was involved in an accident a few weeks ago that caused me to break some bones, dislocate my ankle, and tear a bunch of ligaments. I had been drinking but was definitely not drunk as I had eaten a hearty dinner and only had 4-5 drinks over 6 hours. On my way out of a friend's apartment I tripped on his stairs and this is where the accident occured. I received emergency room treatment, ambulance ride, several follow ups, invasive surgery, and prescription medication. Almost all of this was covered by my insurance (Blue Advantage HMO). I have maybe paid $200 for everything.

This is where my question comes. I received a letter from my insurance asking me to call 'Equian' to determine if another party is responsible. I know better than to lie and commit insurance fraud. But I am concerned what will happen either to me or my friend who rents the apartment where this happened. I haven't asked him yet if he has renter's insurance. Should I give him a heads up? I don't blame him at for my accident and don't want to see him fucked over. Has anyone dealt with this before? Can I ignore BCBS letter?

    Illinois

    Thanks.

Car in front braked in an automatic wash causing a collision

    Posted: 06 Feb 2019 11:17 AM PST

This happened in NJ but my plates and insurance are from VA.

I was in an automatic car wash (car was in neutral and the track was moving the car) when the guy in front of me hit his brake on his high-rise jeep (caught it on dashcam as well as on the car wash video footage). The track pushed my car forward and hit the jeep in front of me. I did not touch the steering wheel, brakes or accelerator during this entire time.

My car sustained damage on the front grill and hood from his rear tow bar hook whereas the jeep had no damage.

I have notified my insurance and started a claim. Car wash manager told me to involve police in order to get an incident report so that he can provide me with the footage.

Anything I might be missing or will aid my case? And what can I expect in terms of result or the worst case scenario?

Thank you so much in advance.

Root car insurance renewal policy rates went up about 44%- Cancel renewal and reinstall the app?

    Posted: 06 Feb 2019 11:29 PM PST

I registered for Root auto insurance and got a good rate (For an international, young student in a high auto insurance state). However, my policy is almost up and the renewal rate is about 44% higher. Is it a good idea to cancel the renewal, reinstall root app and take the driving test again?

2017 Porsche Boxster S - USAA Total Loss Settlement Negotiation

    Posted: 06 Feb 2019 10:56 AM PST

USAA has notified me that they are considering my vehicle a total loss after I was rear-ended a few weeks ago. I have been determined to have 0% fault in the collision.

CCCOne's current Adjust Vehicle Value is $57,201.00, and after 6.25% tax comes out to $60,776.06

I have read a bunch of articles and posts in this subreddit, many of which seem to contradict each other. It was suggested that I use KBB to determine the value of the car, and that came out to an average of $62,000. But then other responses, including the one from USAA, say that I shouldn't use them as a gauge for the value of the vehicle.

I also attempted to research comparable vehicles in my area on the various websites (cars.com, autotrader.com, cargurus.com), however, there are not any within several hundred miles of my location. The comps that I was able to find have purchase prices of $63,000 - $65,000.

After further contact with USAA they responded with, "When it comes to the vehicle we pay the actual cash value for your car. When you look at dealership prices those are going to be marked up, because they are trying to make a profit off of the vehicle. USAA does not give the highest amount or the lowest amount for your vehicle. We give you the average of what is selling in your market. If you are unable to see the comparable vehicle it is because they have sold within a 90 day period and shows what the average person is willing to pay for that vehicle."

USAA has provided the CCCOne report which shows the two comps at list prices $64,374 and $63,981. Which then after a series of line item reductions are lowered to $53,186 and $54,883 respectively. These line items are 'Make/Model/Trim', 'Options', 'Mileage', and 'Condition'.

    My vehicle had 13,232 miles.

This is my first experience with a total loss settlement, and it makes the concept of insurance seem so one sided in their favor. I don't have the option to actually purchase a car without the dealer or private party markup, nor do I have access to the data or formulas they are using to generate these numbers.

    Am I being unreasonable?

    What are my options?

minor traffic collision: who's at fault?

    Posted: 06 Feb 2019 11:17 PM PST

Got into my first traffic accident recently and I'm curious what you guys think the insurance company of the person who hit my car will say about this incident. After I have filed my claim how do I go about assessing any damages if I am deemed 100% not at fault? Can I just go to a local auto body shop and ask for an estimate or should I wait for the insurance company to contact me first? Nobody suffered any injuries (confirmed by the police officer who arrived at the scene) and only my rear passenger door was damaged.

    Thanks!

    https://www.youtube.com/watch?v=F44iMPzjN0A

(if it's not clear from the dashcam footage, I had a green arrow to turn left from a left turn only lane into a single lane road, opposite side of traffic had red lights)

will auto insurance pay out for recent repairs on totaled car?

    Posted: 06 Feb 2019 07:22 PM PST

My car was recently t-boned and I think they will consider it as a total loss. I put on new snow tires and did $500 worth of repairs last week (new plugs, headlights, etc). Do auto insurance companies include these things when they pay out?

Insurance Claim Appeal for Rejection Based on Anxiety/Nervous Disorder

    Posted: 06 Feb 2019 03:42 PM PST

I'm doing this for a friend since I figured this might be a place to get potential answers. First off she's from Colombia and was visiting her boyfriend in the United States when she had a panic attack for her very first time. Not knowing what was happening she took and Uber to the emergency room where she was given an EKG and anti-anxiety meds. A few months later she receives a notice that her claim is rejected since the insurance policy does not treat mental/nervous disorders and her bill stands at about $7k. My question is can a one time panic attack automatically be considered a disorder? Is there any merit to their rejection?

    Their language specifically:

"Mental or Nervous Disorders: Any mental, nervous, or emotional Illness which generally denotes an Illness of the brain with predominant behavioral symptoms; an Illness of the mind or personality, evidenced by abnormal behavior; or an Illness or disorder of conduct evidenced by socially deviant behavior. Mental or Nervous Disorders include without limitation: psychosis; depression; schizophrenia; bipolar affective disorder; learning disabilities and attitudinal or disciplinary problems; any disease or condition, regardless of whether the cause is organic, that is classified as a Mental Disorder in the current edition of the International Classification of Diseases as published by the U.S. Department of Health and Human Services; and those psychiatric and other mental Illnesses listed in the current edition of the Diagnostic and Statistical Manual for Mental Disorders published by the American Psychiatric Association. For purposes of this insurance, Mental or Nervous Disorders does not include Substance Abuse"

I'm trying to get my drivers license and for proof of address I can have my mother come into the dmv and confirm that I live at her house. But her concern is that if I dont have car insurance and I get into an accident, the other party can go after HER or the house, because she does have insurance.. is this possible?? Seems a little far fetched... but she refuses to help me because of this paranoia

Car Totaled, Insurance Offering $300 For New Hybrid Battery Worth $2300

    Posted: 06 Feb 2019 11:00 PM PST

My car (2006 Honda Civic Hybrid) got totaled, the other driver's insurance has accepted 100% liability. My insurance company gave me an offer but they only added $300 to the ACV for a brand-new hybrid battery pack which cost $2300 last May and still has over 2 years on the warranty. If I had put the car up for sale before the accident, the new battery would have been a major selling point. I've provided receipts but they won't budge from their offer. Is it worth hiring an independent appraiser? Should I bother with arbitration? Small claims? Anyone know how to get in touch with Judge Judy? Not for the show, just figured I'd take her out to dinner and dancing if I win the case. How can I find out if there are any legal precedents related to this short of sleeping with the ghoulish crone? Is there an online resource? How would I look it up at a law library? What is this type of law called? Insurance law? Anyone wanna buy a 2019 Ruth Bader Ginsburg bikini calendar? What's a good book to read for procedural law related to arbitration in CA?Thanks

Can I just renew my deceased uncle's homeowners? What do I need to do to be responsible and handle the insurance?

    Posted: 06 Feb 2019 06:11 PM PST

    Florida.

My uncle passed and left me as my sister his house. His best friend is the trustee and personal representative of the estate until it is distributed to us, which will probably take a year. The house is currently in the trust. Probate has been filed with the courts.

The home owners policy expires 2/9. Can we just pay the renewal and have coverage if something happens?

We are there at least a few times a month but it is vacant.

What am I supposed to do about that?

How did my auto insurance get lower with a name fix error??

    Posted: 06 Feb 2019 10:22 AM PST

Long story short I was with Nationwide and the renewal was crazy expensive almost being $1,000 for 6 months paid in full. So I changed to Progressive and the quote that was given to me was $524 for 6 months paid in full. The agent I spoke to noticed there was an error in my name fixed from Steven to Steve (as it says in my birth certificate and ID) and he tells me that my quote has been lowered to $251. Not that I'm complaining, but how something like this makes the price change that drastic?

    Totalled Car, question regarding value?

    Posted: 06 Feb 2019 05:10 PM PST

It's that lovely time of the year in Canada where the roads are absolute garbage. A few weeks ago after heavy snowfall and freezing rain, I flipped my car.

The insurance company has since declared it a total loss. Here is the issue...the declared value of the car (that the insurance company is going to cut me a cheque for) is more than I paid for the car. As part of the paperwork before they write the cheque and send it to me, I have to fill out how much I paid for the car when I purchased it two years ago.

For example, let's say they're giving me $8k but I bought the car for half of that. I'm wondering if they will change the payment settlement once they see I paid less, and thus I'll end up screwing myself over? To be fair, I did get a really good deal on the car when I bought it, as the owner was moving across country very soon and wanted the car gone ASAP, so it was worth more than I paid.

Is this just me being naive and paranoid, or?

This is my first experience with an auto insurance claim, so thanks for any insight you could provide!

    Help with oral surgery insurance

    Posted: 06 Feb 2019 02:56 PM PST

The oral surgery clinic has quoted me $3200.00 for my wisdom teeth removal. This is the price before insurance.

My insurance is anthem and I have a family plan. 750.00 for individual and 1500.00 for family deductible.

Would i only pay 750.00 out of pocket or are their other things I need to look at?

Also I thought most businesses run it through the insurance first and give you a price. This place wants 1200.00 up front and then they will see how much I owe with insurance and credit or charge whatever I owe or get back. Is this normal practice?

Please help. My wife is fucking freaking it out but I need this done.

My teacher gave us a challenge

    Posted: 06 Feb 2019 02:44 PM PST

Hi all sorry I'm typing this on mobile. So my teacher gave us a challenge today where we have to find a way to insure a property that we don't own. I know banks can do this in a way but I don't know how a regular person would because of the moral hazard it creates. Can anyone tell me how we're supposed to do this? If location matters it's Pennsylvania and we are trying to insure a condo where the owner currently pays $600 per year for their insurance.

    Health insurance Lasiks question

    Posted: 06 Feb 2019 10:34 AM PST

Hey everyone! I have very minimal understanding of how insurance works so I'm hoping y'all might be able to help me with this. I am currently under my dads plan with Anthem. I have been denied a job under my degree field because of my vision and I just found out I'm not eligible for a lot of jobs in this field until I have lasik surgery. My insurance considers it cosmetic and doesn't cover it. Since it's preventing me from continuing my career path is it possible to get like a waiver since I'm not getting it for cosmetic reasons?

I recently received a United healthcare OTC network card in the mail and all it really said is that it gives discounts on certain products which is great and I would totally use it but I can't find any other info? I was mostly wondering if it would affect my insurance at all and if it would cost anything to use it? is it basically just a rewards/benefits card? or what?

    Car Insurance; Worst luck.. HELP?

    Posted: 06 Feb 2019 03:31 PM PST

BackInfo Yesterday afternoon I changed my policy from $500 deductible to $1500.. and this morning I got into an accident. Just my luck. I immediately changed my insurance back to $500 deductible after the accident.

It's not major damage on either car. It was sort of a side swipe on his car but my front end needs to be replaced. When the accident happened all we did was exchange insurance and DL info. No cops were called. No report filed. I told the other driver if he could get a quote first at a shop to see if maybe it would be cheaper than going through my insurance since I just changed my deductible.

I guess in short, how likely would the claim get approved if we lied and placed the incident date as the date after, once my insurance deductible drops back to $500?

To what extent will a claim adjuster go to prove the claim different. It will clearly be fishy that the day after I drop my deductibles back down. Help?
