Need advice if l can make a claim through superannuation (car crash)

    Posted: 06 Jan 2019 01:13 AM PST

Doing this on a throw away as l don't want this linked back to my main account so its not identified. Just a quick note im from Australia so if anyone from there could give me advice l would really appreciate it. Roughly 1 year ago l was in a car crash. I had purchased the car the day before and registered the car in my name the day before. The very next day l had the car crash. I hadn't sorted out the insurance yet or even called them to even set it up, as l was planning to do it the night when l got home. Unfortannely l never made it home that day. I was driving home with a friend, l wasn't speeding and the accident was later determined to be caused by "road conditions" It was raining really bad that day which caused me to spin out on a slight bend and go side on into a pole. My friend was uninjured thank god but l got all the injuries. I broke my leg, degloving of my arm, shattered and broken bones in arm, skull fractures, eye socket fractures nerve damage the whole lot. I was covered through the greenslip of my car from me transferring the registration in my name the day before luckily. I was never charged with any fines due to the accident as they put it down to road conditions so l didn't have to pay for the pole. The car was a write off as it was pretty much in 2 pieces, im lucky to be alive. I was off work for 9 months roughly doing physio and learning to walk again. It was hard but im fine now back at work. I was told by someone that l may be able to make a claim from my superannuation company for my injuries. Im able to walk now but l do have some pretty likely permanent issues being nerve damage in my leg/foot drop. Could anyone please give me some advice on if l could make a claim through my superannuation as even if its a small lump sum payment it would be very helpful for someone my age (im 19 currently) whose looking to save for a house. If anyone needs any aditional information l can provide it. Thank you for anyone who replies to this post as ill read every single one of them.

TDLR - Had car crash got covered through my greenslip in australia. Have some most likely permanent disabilities foot drop and nerve damage. Want to see if l can make a claim through my superannuation

[CA] Disabled adult son, aging out of my employer-provided insurance

    Posted: 05 Jan 2019 12:11 PM PST

long story short, my son, who has been disabled since he was a toddler, is about to age out of my employer-provided insurance. i have started the process of certifying him as disabled (i've been there for six years, but was repeatedly told by HR that i had to wait until just before his 26th birthday to certify him - and even though for unrelated reasons i had to certify him so i could take FMLA three years ago, when he was turning 22, for his brain surgery, that apparently doesn't count and as such, i am forced to start the process over).

my question is, and i realize it's a long shot that others might have experience with this, is, are there any steps i should be taking to ensure he is 'approved'? i do anticipate a fight (even though i actually WORK for the insurer), especially since they require ICD10 codes, and since i work in healthcare, i've learned that if the physician doesn't include exactly the right one, we could get denied. so apart from requesting his physician fill out the required form, any advice on what i can do to ameliorate the inevitable pushback?

for context, his disability is cognitive. the official diagnosis is "mild mental retardation," which i absolutely hate, but it is indeed the reality, even though i don't think of him in that way. (btw, to complicate matters further, his original illness that resulted in this disability is so unknown that it doesn't even have an ICD10 code; i tried to look it up myself.) he is high functioning, but will not be able to live independently, nor is he likely to ever get a job wherein he will be able to procure his own insurance. (he does work part-time in manual labor, and has obtained an AA that he still needs to petition for.) he was on SSI as a toddler (until my income priced us out) and again as a young adult, but in late 2016 at 23 was approved for SSA disability, so the system is aware of his issues. (he does get medicare through SSA, but i am uncomfortable relying on that because they frequently reassess and it's a fight every time - so i would like to keep him on my insurance as a first resort.)

any thoughts or advice in navigating this system?

Will insurance cover faulty diy resulting in leaking shower pan onto ceiling below?

    Posted: 06 Jan 2019 01:57 AM PST

Two years ago my brother in law was in our finished basement directly under an upstairs toilet when it was flushed and he heard dripping above him. He put his finger on the ceiling and it was soft so we made the repair in the plumbing and replaced the toilet. This facilitated us remodeling the bathroom upstairs, including new floor, tiled shower, vanity and toilet. I called insurance but never made a claim because my husband tore out the bathroom while I was at work and never took pictures or saved anything.

Fast forward to tonight.. I was downstairs while my husband was in the shower and I could hear a trickling sound directly beneath the shower drain and noticed the ductwork on the ceiling had brown drip marks (dried) coming from between 2 pieces. Directly next to that I noticed the ceiling is cracked almost in a large circle pattern like you'd see mud dried in the desert. To make matters worse, about a foot away from where the ceiling has the cracking pattern is the electrical panel with all of the breakers for the house. Also I need to add that the shower upstairs doesn't drain properly after the remodel and there's always a wet spot about 10" in diameter directly next to the shower drain.

Is this something insurance covers? If so where do I start?

My husband wants to tear out the bathroom again but I think we need to wait and have insurance come look at it. Any advice? I'm dreading going through this again.

Obscure (U.S.): Insurance for Affidavit of Support

    Posted: 06 Jan 2019 01:02 AM PST

I'm wondering if there's an obscure insurance plan for someone who accepts financial responsibility of an immigrant. When petitioning to support an immigrant through the Fiancé Visa process in the U.S., the petitioner is legally financially responsible for 10 years, even if the couple divorces. Is there such an insurance to cover this?

Auto insurance premium doubled - North CA

    Posted: 05 Jan 2019 10:16 PM PST

Recently I just received my 2019 auto insurance bill and found that my premium is almost doubled from $4XX to 8XX

I have no accidents, no traffic violations and no claims at all. The coverage is exactly the same as last year. The only minor difference is that the insurance company automatically increases the vehicle annual mileage by 800, which they normal do every year. I will definitely contact my agent but before that I just wanted to see if there are some possible legit reasons they double my premium or it's just simple BS. Thank you

    Ride-Sharing Insurance Dilemma

    Posted: 05 Jan 2019 01:07 PM PST

I rented a car from a ride-sharing service early last year. When I returned it, we noticed there was a small scratch about 3-4" long, likely from a rock chip. They billed me saying it was roughly $780 to resolve the issue. Whatever, I paid them and figured it was all said and done.

Fast forward 6 months after I paid them, and now they're coming back saying the total amount to fix the small scratch was actually $4k. Since I paid for basic insurance through them, they claim I am now liable for $3k of those expenses.

Has anyone ever had an experience like this where they bill you and then half a year later come back and say the price quadrupled? I find $4k to fix a small scratch on a car to be wayyyy overpriced. Any advice is appreciated.

Insurance for "long-term borrow" of grandparent's car

    Posted: 05 Jan 2019 07:13 AM PST

My grandmother (in western PA) has a car she no longer uses. (Well, never really used, as she hasn't driven in 40+ years. She has a license and insurance, but the car itself is used once a month by my parents to keep it from deteriorating in storage.)

I live in NYC and rent cars for a weekend a month on average. However, I'll have an upcoming stint where I'll probably be renting a car for several weekends in a row in addition to a couple of weekly rentals over a period of three to four months. Since it's winter, if the weather turns I generally upgrade to a 4WD/AWD vehicle, which adds to the expense. (My grandmother owns an early '10s Subaru Forester.)

Instead of giving $4k+ to a rental car company, I was thinking of just borrowing my grandmother's car for a couple of months. However, I want to make sure that I do it entirely above board so that there's no negative impact on her should anything go wrong.

I do not own a car and do not have insurance.

What steps should I take before borrowing the vehicle? Should I be added to her insurance, or should I take out my own short-term policy since I'll be using it another state.

And, this is probably a question for another forum, but I figured I'd ask here since it's another concern - should a contract be drawn up for the duration of the borrow?

Can someone explain thoroughly what an insurance brokerage firm does? As well as an insurance producer/broker.

    Posted: 05 Jan 2019 09:49 AM PST

Basically what the title says. I'm currently looking at an internship for the summer at Arthur J. Gallagher which is the worlds third largest insurance brokerage. I am still a little unsure as to what they do exactly so any information would be very helpful. Thank you!

lost an old car I loved in an accident -- Can I expect anything back?

    Posted: 05 Jan 2019 04:54 PM PST

    Hello,

I lost a 1993 mercedes-benz 190e in an accident this week that I cared about a lot. If I get a payout because I am not found liable, I am afraid that they will try to give me $800 and walk away. The car was in great condition.

Is there anything I can do to prove the value of the car? I really just want to replace it.

Could someone please confirm for me my copay on urgent care?

This to me reads that an urgent care is $10 for any visit even before hitting my $200 deductible. I had to leave work today and go to an urgent care and they charged me $175. I showed this to them and they said that this is only for wellness visits/preventative care. I'm calling my insurance company on Monday but can someone please let me know if I'm just reading it wrong?

    Appeal an Incorrect Vehicle Suspension?

    Posted: 05 Jan 2019 12:05 PM PST

    (cross posted with r/legaladvice)

I recently (November 2018) switched auto insurance carriers, as my old carrier wanted to up my rates. Switched without any hassle and no lapse in coverage. In December, I received a letter from PennDOT (PA Department of Transportation) saying it was reported to them that my coverage ended, and I had to submit proof of my new insurance. Easy peasy - I emailed them a copy of my new insurance card that included my name, vehicle information, and start date of insurance.

I received another letter from PennDOT today, saying that they either (1) did not receive my information, or (2) what I submitted was incorrect. I have triple checked I sent the email to the right address specified in my letter, and the insurance card is specifically listed as one of their acceptable documents. Because they "didn't receive it", my license will be suspended effective 2/11/2019, unless I pay a $500 fine. I can apparently file an appeal with my Court of Common Pleas (in this case, Montgomery County), but I have no idea how this works (I need to file a "Petition", a "Order Verification", using a "pro se appeal form" that I can't find online anywhere).

Does anyone have any experience dealing with this? Do you think I can call PennDOT on Monday and they can rectify it themselves, or am I stuck going to court (and do I need to pay a fee then)? Do I need a lawyer for all of this?

Post Car Crash: Car in Tow Lot - but Insurance Appraiser has not yet appraised it

    Posted: 05 Jan 2019 03:28 PM PST

I was in a car crash and my car (late 90s CR-V) was towed to a tow-lot because it was no longer driveable. I am concerned about being put on the hook for the hundreds of dollars it will have cost to keep my car in a tow lot.

Given that the car has not been officially totaled by insurance (though it should be), I have been holding off junking the car so that it can be appraised by the insurance companies. I am scared to junk my car before it is reviewed by the insurance companies. I am accruing daily fees ($27/day) for the car storage, but I have no where else to put it. It has been one week now.

I live in an apartment in a dense city with no official parking spot of my own. I can't tow my car to a street corner, because it will be seen as an abandoned vehicle and be towed again. Nor do I have friends with ample enough space to accommodate my piece of crap. :( What in god's name can I do so that I can be seen to have been "mitigating costs" (a term my adjuster has used frequently) without spoiling evidence (as in getting rid of my now useless car)?

I have not been able to find this sort of information on the internet. I thought the internet knew everything.

Anyone's help is appreciated - thank you.

Commercial Auto vs Non-Owned Auto Question

    Posted: 05 Jan 2019 02:31 PM PST

    Hey everyone,

First thank you to everyone sharing their knowledge, pretty cool of you all.

I was hoping someone could help shine some light on the separation of a commercial auto policy and a non-owned auto policy. I am getting agents telling me I will need a separate commercial auto policy for my vehicle but not for the employees who also will use their own vehicles(currently everything I am finding is ~$5k a year) and I am sure they are right because they all seem to agree but they are vague on why. My general liability was quoted with non-auto included so that would be the source of it.

Some details on use: I've started a new business and will be using my sedan to go on sales meetings and maybe some supply runs for the service I provide. No employee other than myself will use my vehicle. This vehicle is owned by me personally and not my LLC, I will continue using it as a personal vehicle when it is used for the business as well.

Ultimately what I am trying to figure out is what is different about the following scenarios that a non-owned auto policy is enough for one but not the other?

    A) I, the owner/employee of the LLC get in a crash while working while having a personal auto policy.

    B) One of my employees gets in a crash while working while having a personal auto policy.

If I have left out anything important please let me know, this is definitely not my forte as you can tell! Once again thank you all for spreading your knowledge!

Leasing a car with my parents?

    Posted: 05 Jan 2019 01:14 PM PST

I'm looking to lease a new car. I live in NYC, have a NY drivers license, run a small business here and also have my current car registered to NY. But, I've found that the insurance prices are unbearably high in this place ($200/ month for 2019 Toyota Rav4 ...what kind of a sick joke is this?!)

I had the thought to lease the car in my mom's name in Maryland (or both of our names if need be), register it in Maryland and add the car to her insurance, where I would be listed as an additional driver. I would obviously pay her for all this.

Talk to me, what are my risks? Is this a bad idea?

Mother's (69, FL) Medicare cancelled after being added to ex-husband's insurance without her knowledge- Need Advice!

    Posted: 05 Jan 2019 11:52 AM PST

My mother, who lives in Florida (I do not live in the same state), was notified this week by Medicare that her insurance (BCBS) was cancelled because, according to them, they had been notified that she recently joined Aetna. After doing some digging, she determined that her name was added to her ex-husband's insurance policy without her knowledge. He is insured through the New Jersey Teacher's Union, which had switched from DirectNG to Aetna as of January 1st. Her name was removed from his insurance policy when they divorced 4 years ago; we think that when the switch to Aetna occurred, her name was erroneously added to the policy (pretty sure her name would not have been on the policy this whole time, otherwise Medicare would not have allowed her to be covered by BCBS).

BCBS/ Medicare is refusing to reinstate her insurance until Aetna removes her name from the policy. Aetna is refusing to allow her to remove her name from the policy because her ex-husband is the policy-holder. Mom's ex is a nasty piece of work, and furthermore has completely addled his brain with alcohol- he's definitely not competent/smart enough to have fraudulently added her name to the policy, but he is malicious enough to refuse to comply with taking her name off the policy. We reached out to his daughter(ex-DIL), with whom Mom is on decent terms, hoping that she will fill out the Aetna cancellation paperwork instead (not sure if she's even allowed to since she's not the policy holder either). Even if we can get the paperwork filled out without resistance from the Ex, Aetna says the paperwork must be sent via snail-mail, and expects that the cancellation will not take place for at least 2 months. My mom sent ex-DIL the cancellation paperwork from Aetna this morning and will follow up with her on Monday, but even after sending in the paperwork and waiting for Aetna's response, who knows how long it will take Medicare to reinstate insurance after Aetna's cancellation goes through.

I'm looking for advice on how to help my mother escalate this issue. She is currently uninsured for at least 2 months due to what appears to be a clerical error on the part of Aetna. She's spoken to 7+ different people from BCBS of Florida and the State of New Jersey and has hit a wall. She's worried about even getting in a car in case she gets in an accident. Isn't adding her name to a policy without her knowledge/consent considered fraud? Also, for both our peace of mind, how can I help my mom get some sort of health coverage while this gets resolved?

Thanks for your time and advice!

First time driving 31 months after DUI suspension - SR22 policy USAA v Progressive?

    Posted: 05 Jan 2019 11:00 AM PST

    Hello All,

What a great subreddit. I've been reading through as much as could be found. Here's my situation, any advice would be very much appreciated.

Made a bad decision in the summer of 2016. USAA did not drop me. Now, 2 years later I'm ready to drive again. I need an SR-22 policy.

I've been with USAA for a while, they have always provided great rates (for my age) and amazing service. Just got a quote from them for $777 ($129.58/month) for barebones liability with the required financial responsibility coverage. Progressive is quoting me $421 ($70.16/month). I've spoken with both companies on the phone to verify these quotes, verify they have taken my driving record into account.

Do I go with Progressive, the cheaper option, and hope they don't hugely jack my rates up (and if they do, figure out an alternative who can electronically file the required financial responsibility document with DMV before Progressive's document shows as terminated at DMV)? Or go with USAA who will (from past experience) likely not increase rates? If the Progressive rate will increase to the neighborhood of the USAA rate I'd rather just buy the USAA policy and not deal with the DMV lapse.

    Thanks much.

[WA, USA] Auto policy owner without an insurable interest?

    Posted: 04 Jan 2019 09:23 PM PST

    Hello,

I'm wondering if there's anything amiss or potentially fraudulent about how my auto insurance is set up. I'll try to give all necessary info in one go:

    • Title is in my name only at this time. I own the car outright.
    • I am an adult and I live at the same address as my dad.
    • The car originally came to me when my mom passed away. At that time my mom was still making payments on the auto loan. When I took possession of the car, my dad co-signed a new loan with me so we could keep the car. Now the loan is paid off and it's only me on the title.
    • The policy owners are me and my dad (has been that way since I originally took possession of the car when my mom passed). My agent explained that this benefited me because of the multi-line discount, as my dad has auto and home lines with the same insurer.

Since my dad does not have an insurable interest in the car, is it correct for him to be a policy owner for the purpose of multi-line discounts? I want to make sure everything is on the up-and-up, even if it means I pay more in premiums.

    Thank you!
