You made my blood pressure go down significantly over the weekend until I could talk to the insurer. I got a customer rep on the phone this morning, and she said what several of you advised - that I just needed to get the hospital to submit a retroactive preauthorization. "A step was skipped," in her words. It's not a problem and they can get it taken care of. I wish they would spell that out in the EOB and not give us damn heart attacks. We were seriously panicking. Posted: 27 Jan 2019 03:16 PM PST So I posted this several days ago, but deleted the OP after getting worried based on some comments that posting it on social media may not be the best idea... Turns out it didn't matter, so here's an update that's probably boring for you, but that's good news for me :) So to recap, I was the standby diver while one of my co-workers was checking animal pens. She became entangled in the net, so I went in to untangle her. The water we're diving in is basically zero vis so we have to operate by feeling around. Several hours after the incident, she accused me of "touching her inappropriately and making her feel uncomfortable" so I had to have a meeting with our supervisor and an HR representative the next day. As it turns out, nothing came of it. I don't know if she recanted after having some time to process it, or if she already spoke to the supervisor/HR prior to my meeting. But when I went in they both just said they wanted to get my narrative of the story for the incident report, and give me a quick debrief in case I had any questions or concerns. Ultimately they said that they think I acted appropriately and to the best of my abilities, and that any other standby diver would/should have responded in the same manner and from the best they can tell I did absolutely nothing wrong. I did not specifically mention anything at this time about requesting not to dive with this person in the future (as a couple people recommended), and I kind of assume that that might be the case from the management side anyway. But our dive schedules are usually posted in advance so if I see that I am scheduled with her I will still probably request a new partner or dive day. Figured there's no reason to rock the boat any more right now until it becomes a potential issue again. So ultimately I came out of the meeting feeling pretty good about myself and feel that I have nothing to worry about now. As for the co-worker it seems pretty business as usual. Dog killed by aggressive dog at the dog park- owner wont respond to my calls Posted: 28 Jan 2019 08:19 AM PST As the title states, I had taken my dog (a sweet little rescue fluffball who we think was some kind of miniture poodle-bichon mix) to the dog park. There are clearly posted rules stating that aggressive dogs are not allowed in the park. I took him to the small dog area (he's only 15 pounds). After we had been there for a while, a man entered with a smaller dog and a full grown lab. The lab started lunging at the other dogs and then my dog (who is very friendly and thinks everyone is his friend) got too close and the lab attacked him. It all happened so fast. I got the owners name and number and then rushed my pup to the vet where he passed away overnight. I'm devistated at the loss of my little fluffball but when I contacted the lab owner to ask for his info/vet records and told him what happened he blocked my number. I guess I'm not sure what my next steps should be? I'm planning to contact the park to see if he goes there regularly and hopefully they will ban him for bringing an aggressive big dog into the little dog park, but aside from that, are there any legal repercussions he can face? [Maine] Can my employer refuse to let me take 4/20 off? Posted: 28 Jan 2019 08:39 AM PST Hi, 4/20 is my anniversary and I requested to take it off this year so I can celebrate with my girlfriend. I was told that I wouldn't be allowed to take that particular day off or the day after because the management "knows what 4/20 means". I'm not taking the day off for anything marijuana related but my manager still assumes that I am. I use marijuana lawfully and outside of work and it's not a secret to my boss and has never been an issue before. According to this series of Maine's laws governing the use of marijuana by adults, it's unlawful for somebody to be punished for their legal marijuana use by a business or otherwise. Am I understanding this law correctly? If I call out on 4/20 and I'm fired for it, would I have any recourse against the business? Posted: 28 Jan 2019 03:27 AM PST Location: California This is going to be a long one but I'll do my best to condense it so if possible bare with me as I am very stressed out right now, out a lot of money, possibly homeless come tomorrow morning, and could really use some advice... So I rented a bedroom in a 2 bedroom house from a man who found my ISO ad on Craigslist. I paid the man $1,500.00 upfront via my paypal business card thru Venmo to secure the bedroom and the next week I moved in and everything seemed fine. Come the next week the guy asks me for a security deposit that matches the rent amount of $1,500.00 so even though it wasn't agreed upon before it didn't seem like that unusual of a request being that I only had to pay for the first month upfront to move in. I paid the amount and at this time have paid him $3,000.00 total. Well tonight around midnight the homeowner showed up with police who were being very aggressive and told me that if the landlord wanted me out right then and there that I would not be able to stay the night and I would be forced to leave. They said that the man took my money and that he had not paid the home owner a dollar of it. I was in complete shock and I think they recognized that I was genuine and was the victim here and so the landlord said he would not kick me out during the night but is coming back in the morning around 10am to talk to me to see if him and I could make a deal so that I could have the place in my name. After this statement the police said that if we can't work a deal and he wants me out tomorrow that I must move out tomorrow otherwise he can lock the house with all of my belongings in it. Shortly after this they all left and I'm stuck here stressing out not knowing what my next move should be and what rights I have right now. Here are some of my questions: 1) Do I have any rights to this apartment right now? Can I seriously be thrown out in the street tomorrow if the home owner claims he does not want to work with me or is there a time period I have until I must be moved out? 2)Do I have any legal recourse to getting the money back? Should I claim it as fraud to Venmo or even PayPal? (This is what the police said I should do for Venmo but they also said they don't know how Venmo works so there is that) 3) When the guy moved out he left some belongings here saying that he was coming back to get them (some electronics and other stuff) and so being that they are left here and nobody is coming back for them and I may be out in the street tomorrow are these technically my belongings? Am I allowed to go outside without my parents permission? Posted: 28 Jan 2019 10:05 AM PST I'm 15 years old, and I've been begging my parent to let me go outside on my own or at least with my sibling and only us. Everyone I know is allowed to go outside, walk around their neighborhood, go to stores that are like 5 minute walks away. Also to clarify I mean during the daytime hours, not at like 12 am (obviously that wouldn't even be rational). So I've been, as I said, begging since I was 11 to be let walk outside like a normal human. I'm also trying to nag my parent to get a job but I'm not sure whats going to happen with that. I've been kept inside so much at this point it's a really high chance I have anemia since I went to the doctor a year ago and he told me that was the lowest vitamin D and iron deficiency he has seen in a long time. I want to be let outside for my physical and mental well being because I'm also going insane. TL;DR - Can I go outside during daytime hours (no not running away) without my parents consent? $10000 Water bill due to misinstalled radon mitigation system Posted: 28 Jan 2019 07:06 AM PST Location: Michigan, USA I received a water bill for $10000 in the mail. We had the city come out and check our meter, which was working perfectly. We also had a plumber come check the situation. Here's the background: I had a company come out and install a radon mitigation system in the water sump after we found high radon levels in the basement. They installed the system in July. I noticed somewhere in the October time frame that they hadn't tightened a hose clamp and water had been spraying everywhere and the sealant had never dried on the sump cover, and the vacuum created from the radon fan created some holes in the sealant. After fighting with them a bit, they agreed to come back and reseal the sump cover. Fast forward to January, we get a $10000 water bill. We have a plumber come out, and he says they people who installed the radon equipment had to uninstall and reinstall the sump pump and backup water powered sump pump and that they had installed the components incorrectly, including misplacing the gaskets that turn the backup sump pump on and off. So the backup sump pump had been running for that length of time. There were also a few more loose hose clamps... So after talking to the city, they say they don't care who pays for it, they just want it paid. They did however offer a form to fill out to ask for some relief, but I doubt it will be much. And after talking to the radon mitigation company, they pointed to a clause in the contract we signed for the install stating: Flooding/Water Damages/Sump Pump Homeowner agrees to release SWAT Environmental from any all liability related to flooding, water damage, or moisture problems that occur at any point after the installation of the radon mitigation system. If there is a sump basin and/or a sump pump on the home, it is up to the homeowner to make sure that the sump pump is functioning properly at all times. Furthermore, the homeowner agrees to accept all responsibility and liability for any flooding, water damage, and/or moisture issues that occur at any point after the installation of out system regardless of the cause. This includes, but is not limited to damages caused by malfunction of the sump pump, failure of sump pump to activate, or water leakage within the plumbing system. I re insulated the area the pipes in so it wont freeze again but it's still dripping a few gallons per hour. Nothing illegal has happened yet to my knowledge, but I want to take necessary steps to protect future girls he may seek out. My friend is married to a man who she recently discovered was talking to underage girls through an app on his phone. I don't know the name of the app, but she described it as similar to Chatroulette and Omegle in that it connects you to strangers you can chat with (just chat, no video I believe). When she confronted him with her discovery, he said he had met a 13 year old girl who had body image issues and he just wanted to build her self confidence. However, he posed as a 15 year old boy (he's 24) and said he wanted her to be his girlfriend (again, he's married) to do so. He let his wife (my friend) read all the messages, and there was never anything sexual. She thinks his heart was in the right place and that it really did just seem like he was trying to help her. My friend made him write the 13 year old girl a message and confess who he really was and delete the app from his phone, and she thought that was the end of it, until a few months later she discovered he downloaded a different but similar app and was now talking to multiple teenage girls. She read everything, and again, nothing sexual. According to her it just seemed he was building their confidence, so again, she made him confess to the girls and delete the apps, but she also decided to finally tell me about these events after the second discovery. She doesn't want to do anything about it, and I don't want to betray her trust, but I also don't want her husband to keep grooming underage girls. There is no reason for a man in his mid-twenties to be seeking out tween girls to talk to online about their body image issues - and I feel obligated to do something before this goes further. What is the appropriate course of action here? It would seem he hasn't done anything illegal at this time, but I would like to let someone know this is happening and prevent 13 year old girls from being harmed. Would calling an agency tip line of some sort be appropriate? Additionally, would his wife be in any legal trouble if it was found out she knew he was grooming young girls and did nothing? I love my kids, more than anything, I don't want them to live a life of neglect in the hands of her and her absolutely toxic (abuse, alcoholic, drug addicted) family. My wife has severe refusal to work syndrome, she has since the day we moved in together. Always an excuse as to why she couldn't get a job, at first it was because she didn't have a GED, then she refused to get her GED (For three years), then it was because of a lack of car, or because we lived in a remote location, always a reason. She spends all day on WoW / League of Legends, and neglects to take care of our home, or our kids. I work all day, come home, cook, feed and bath the kids, then put them to bed. I was going to school full time for a while as well, but had to put it on hold as I couldn't handle the work load, plus school, and the burden of taking care of the family all at the same time. For the last 3 years, I have lived with her, angry and neglected, trying to get through to her, trying therapy (she wont attended / makes excuses), trying to appease her by letting her buy things I know we can't afford, letting her spend money, etc. The only things she cares about or pays attention to are the things she can use to manipulate me or hold over my head. I buy a car that isn't as reliable, or the therapist says something about not yelling (she refused to acknowledge anything she did wrong if I even remotely, just mildly spoke loud, not even yelling, and she dismisses her own behavior as if it no longer mattered). I can't do this anymore. I am likely going to ruin my own life, forced to pay child support, forced to live the rest of my life in pain because of this. I have ruined my relations with friends and family defending her over everything, I have given up my military career, walked away from so many opportunity, and let my mental health reach a state where I am constantly considering taking my own life. I just want to know what to do. I am a man trying to find a way out that doesn't seem like the absolute end for me financially, and just need real advice. What do I do. [NYC] I have had no heat for two weeks Posted: 28 Jan 2019 05:11 AM PST As the title says, I have had no heat in my apartment for two weeks now. It's only my apartment and no other units in the building are affected. I have been in contact with my landlord and they claim to be working on the problem. Here is a timeline/summary: Sunday Jan 13th: I returned from a weekend trip to find my heat wasn't working. I sent an email to my landlord and opened a work order on their website 1st thing Monday morning. Mon Jan 14th- Wed Jan 16th: A repair company cited too much traffic on Monday, that it was "too cold to fix" on Tuesday, and no showed on Wednesday. I was provided with a space heater. Thurs Jan 17- Fri Jan 18th: A new company was called and reported on Thursday that they were ordering a part for arrival on Friday. I returned from work Friday to find the heat seemingly working, and left for another weekend trip. Sunday Jan 20th: Returned home to find the heat not working again. Reported the issue right away. Monday Jan 21st- Thursday Jan 24th: The same repair company came out each day to refill the roof unit with Freon (at least that's what I'm told). Each day I was told my issue was resolved only to find it in the same condition when I got home from work. I can't report further issues until the next day because my landlord does not answer the phones after 5pm. I stayed home from work Wednesday to see the repairs for myself and confirmed that the heat was working right after repairs, only to stop again after 2 hours. On Thursday I was told they were unable to do any work because of rain. I warned my landlord that I'd be traveling again for the weekend and I expected to be updated as work continued. Friday Jan 25th- Present: I received one update on Friday that they suspect a Freon leak. How this took almost two weeks to diagnose is beyond me. Since then I have had no updates as apparently my landlord only operates 9-5 M-F. No work has been done this weekend as far as I can tell. The landlord has been particularly hard to get a hold of. If I was not emailing and calling multiple times a day I'm positive I would have no response at all. They never proactively reach out to me. They've reported multiple times that the issue is resolved when it's not. And I've been told that I "need to relax and let them follow their process of elimination". I know for a fact that every day I have been without heat they are in violation of NYC tenancy codes. I've reported them to the city department of housing and development and hope to have an inspection done any day now. However, Today we're at two weeks and I'm ready to pursue legal options if that's what it takes to get them to prioritize my issue. I understand that this will likely ruin the relationship between myself and my landlord, but I'm at my wit's end. I don't plan on staying past the end of my lease on June 30th. It was also bought with the intention of my mother can live there until she passes. Recently my mothers been saying that she wants the property in her name, I think her intentions aren't good as she probably wants to kick me and my siblings out. We've told her she can live there but it's not going into her name. She does however pay all the bills and council tax as it is her home, she's just not the homeowner because it is our inheritance for when she passes, she's threatened to take legal action but I was wondering if she's got any right? A couple of months ago my father died and he had a will that left everything to me and my siblings but it wasn't properly signed by him so my mother signed a deed of variation as an old will was valid which left everything to her but she knew that wasn't my fathers wishes so she signed one, and now she's threatening to take it back, I don't think she can but just needed some advice. This does not pertain to me but I have concerns as a few of my fellow ushers need to use handicap spaces as they cannot walk long distances up hill which is where the designated usher parking requires us to do. Once they actually start volunteering they can stand for 4 hours walk the building etc. Can an usher be dismissed or barred from volunteering for using a handicap space? Email: Please remember that if you are volunteer ushering for an event at any of the ****** venues, you may NOT use your Handicap parking permit to park in Handicap/ADA parking places on the ***** campus. It has been reported to **** Services that ushers are showing their Handicap parking permits to the Parking attendants and insisting upon parking in the Handicap parking spaces that are designated for our patrons. Posted: 28 Jan 2019 10:19 AM PST I am in my third trimester, i live in California, and I have had chronic back pain for three years. I had a prescription for NORCO that I used through the first half of my pregnancy. When I ran out, I was given what I was told was also NORCO from my trusted friend, and took them for about 1 and 1/2 months. (Yes, stupid I know, that's why I'm in this position) It was brought to my attention that they are actually not the same thing, and what I was taking was Percocet. (Also stupid, I know. They look the same, I never checked the markings) I was on a low dose, taking no more than 5-10 mg every few days. Just when the pain got to be too much. Now, I've been very up front about my pain management with my doctor, i have been going to physical therapy, and have a chiropractor appointment set up. This was never about taking the pills for anything other than pain management. I am not addicted, and have since stopped with no issue. I am currently 33 weeks pregnant, and haven't taken any pain pills since December when we took the next step to get me into physical therapy and chiropractic care.I went to the ER because of a car accident in early December, and that's when I learned I had tested positive for the other type of pain pill. I can't help but fear that they will take my child from me when I give birth because of a stupid mistake I made... what can I do to make sure this won't happen? [US, CA] Posted: 28 Jan 2019 04:22 AM PST Approximately six months ago, my girlfriend was "sold" a very cheap ($800) used car from a friend, who never actually transferred the title to her. She was very inexperienced about how car sales work and never thought to actually get the title in her name. Flash forward to this month, and she now is having trouble passing the mandatory smog check to renew the cars registration. She asked the friend if he had any idea why it wouldn't pass smog, to which he replied that the repairs needed would be too costly to be feasible for such a cheap car, and that she should go to a certain shop to have the car pass using an illegal smog test. She was unwilling to do this and offered him the car back for $500. Now he replies back that the car is still his and he wants her to return it within a week. He claims the money she paid him was for "rental fees". She has texts showing these claims to be lies and "paid" for the car over venmo, but besides that has no other way to prove that the car is hers. I am also wondering if the sale is even technically legal in the first place, as you need to smog a car (legally) in order to transfer ownership, at least in CA. If that were the case he would owe her the full $800, no? I'm tempted to suggest to her to just write this off as an expensive lesson, but money is money and I hate to let this grifter get a free pass on this. What are her options? I'm talking 5, 10, even as many as 21 calls every single day. I have found the website that lists it, and as far as I can find, it is only listed when using the search engine Yandex (a Russian Google, I guess), and the page is originally in Russian. I have gone through the site's "edit information" and put in a couple submissions removing my number, with a message saying that it is my personal phone number, and I have no relation with that business. Our education system here in Brazil is completely diferente compared to the US. We do not have a ACT/SAT test. I finished hight school in 2018, and I decided that I would apply to the US. I started with a very expensive preparation program here in Brazil, that prepares people who wants to study abroad and need to do the ACT/SAT. Everything was doing fine, and I planned to do 2 ACTs tests. One around April/May just to get to know the test, and then the one "for real" in August. The first test was ok, everything turned out fine. Then, a few months before August, I subscribed for the act's August test. However, it was full in my city, so I had to schedule in Rio de Janeiro—I live in São Paulo. São Paulo to Rio de Janeiro is about 35 minutes by plane—I said: ok, I can't complain, let's do this— A few weeks before the test, I logged in ACT's website, and I was able to change the location of the test to São Paulo, off course I had to pay a fee. After a week, I received an e-mail from the act telling me that the location of the test was changed to Brasilia, Brazil's capital about 3,5 hours by plane. I was furious, but I couldn't do anything about it. I tried to call the ACT support but they couldn't do anything. Since it was a few weeks for the test, I bought another airplane tickets to brasilia. I booked a hotel suite for 2 days, since the test is in the morning, I had to be there one day before. Also, I had to book two chauffeurs, one for the first day and the other one for the second one. Everything was fine. I arrived in Brasilia one day before the test, as planned. Went to my hotel, got it a nice night of sleep, and in the next morning, I was ready to ace that test! I arrived at the act test location 1 hour before the test. There was no one there. Ok, maybe I arrived too early... After an hour waiting, no one came for the test, not other students, not act staff, no one. I called ACT international support, reported everything that happened. They just told me it was a error in their server and I was the only one who had a "non existed" test that day. Everything was matching in my account, test date, location, time... however, in their act system, there was no test happening that day. They said that it was their mistake and I had nothing to do with it. I wanted to a apply early decision, and I really needed that test! The test was in August and the early decision deadline was in November!And I couldn't do it! Act couldn't figure out what to do! I just found out (have copy of check) that my ex husband who was the subscriber of her health insurance cashed the check and never paid the medical provider. Perjury in a small town court. Posted: 28 Jan 2019 07:04 AM PST I am aware of a recent legal case in the state of NC, where a witness for the prosecution committed perjury under oath. Basically, the witness denied having taken photographs of the alleged criminal act when in fact, they did have photos and probably video. The local prosecutor most certainly new the witness was lying under oath and had seen these photos. How would someone pursue getting charges placed against that person? Couple of days ago I was on our computer and notice her email was open and something about claim #. ( we were rear ended 6-9 months ago, everyone is okay ) I notice she already negotiated and settled for a a amount for kids claim . Adjuster ask for her and I BOTH. sign a release form and fax it back for the amount that was agreed upon. ( I never seen that form. ) Then after adjuster received the form back ask my wife for fathers (my) Full name so she can issue the check in BOTH my wife and I names. Well I didn't see the checks either so she just have signed my name behind my back and deposited the money. In her account. Obviously iam not thrilled about this. Ex employer is vaguely threatening legal action for bad Glassdoor reviews (US, TX) Posted: 28 Jan 2019 08:42 AM PST Me and a few of my ex coworkers left this company on somewhat bad terms a few months ago. A few of us also left bad reviews on Glassdoor (not anything untrue). Yesterday we got emails from the CEO of the company asking if we could have a "brief chat" about some feedback on how to improve the company, as well as mentioning that someone has been leaving "multiple negative reviews on their Glassdoor with different logins which violates their legal agreements" and saying that it was hurting their ability to recruit and was saying we might have to "cooperate with law enforcement". I do know that this company had also been asking their employees to leave good reviews (and essentially fake positive ones) to counteract the bad reviews. Isn't that also against the rules? Is there anything they can do if the person deletes the reviews? Should I reply at all? [link] [comments] |
Posted: 28 Jan 2019 02:35 AM PST Every Friday and Monday at 3:30 am the plaza next to me empties their dumpsters. Glass bottles smashing, extremely loud crashing, etc. for about an hour. I wake up for work at 5:00 am, but I can't fall back to sleep with these dumpsters. Even earplugs don't block out the sound, they're so loud. I'm starting to wake up at 3:30 am even on the days without the dumpsters. I barely get any sleep anymore! This has to be against some kind of law, right? We've tried talking to someone at a town meeting, and he told us that many people have tried to get them to stop but they can't. Apparently they're a private company or something? Is there anyone I can talk to or anything I can do that could stop them? Any help is appreciated. I'm going off 5 hours of sleep a night, it's killing me. TLDR: really loud dumpsters across the street are waking me up at 3:30 in the morning, how can I stop this from happening? [link] [comments] |
Got called into court for revocation hearing, should I get a lawyer? Posted: 28 Jan 2019 09:13 AM PST Location: Austin, TX Overall I'm not super worried about this, since it's a minor offense, but I'm slightly paranoid since I've never been in front of a judge. I was ticketed for speeding a few months ago and opted with deferred adjudication to avoid points on my record. This required me to not have any moving violations for 90 days and complete an online class. I thought I did everything correctly, but a few weeks ago I received notice to appear in court. Long story short, when the defensive driving site sent my certificate of completion, it contained a typo that said I took the class for insurance reasons. I got this corrected and have an updated certificate to present to the judge. Is there anything else I should have? Should I hire a lawyer? Am I thinking too much into this? [link] [comments] |
