Posted: 07 Jan 2019 06:26 AM PST To keep things straight, I was sexually assaulted by a military service member and I was referred to CID by the United States Military Academy to report the alleged crime. I was told or rather, USMA assumed, that I had to be of the military or a dependent of a service member, and CID failed to let me know under 10 USC 1044 that I am not entitled to the VLC (Victim Legal Counsel) which is essentially free attorney that will represent me in the case against my attacker. I was also unaware nor did CID mention to me that the investigation would go on with or without my involvement and that as a non-DoD civilian, I am entitled to reserve my rights to not participate. I understand I should have perhaps researched all this, but the special agent told me, "We aren't like state law enforcement who drop cases based on the desire of a victim. We are a federal unit for investigation of service members and the investigation will go on with or without you." Not disagreeing, saying what I was told. My issue with this is that I would like to have a say and feel my interests are not being considered in this (unfortunately, I conceived due to the attack, and would like to establish paternity, currently second trimester). CID told me that they are not involved with speaking to command based on my interests, and that I have to contact command myself. Their sole purpose is to investigate claims and submit findings to the applicable command. Understood. After contacting USMA, they have not let me know how to contact command myself, nor have they allowed me the opportunity to speak on behalf of myself more so than treating this as a routine assault case, unfortunately. Another issue I have with contacting command myself is it may come off as retaliation and that is something I would like to avoid entirely. I understand I could hire my own counsel, but it is completely out of my budget.. to consider, I am at a loss as to how I can even attain free or even discounted counsel based on my situation. Thank you all for the help, and for the kindness. *I learned a lot thanks to Avvo, but the Reddit community has so many knowledgeable folk out here so I am asking for your good vibes and your expertise, please. Bless y'all. Edit #1: So WP Victim Advocate told me to speak to the Fort Hamilton Sarc to see what my options are but "civilian counsel is my best bet." However, again, out of my budget and for those wondering about the pregnancy, my utmost concern about establishing paternity is to pin the assault to him, anything beyond that is not my utmost concern - nor do I want that to be a debate at this time. I reported in Fort Hamilton as I reside in downstate NY. Edit #2 To answer why this case was only reported to CID and not local law enforcement agencies: The current mailing address for the cadet is a PO Box and his parents' are also military, meaning their address changes every three years as they change bases. My local law enforcement agency told me it would be best to contact West Point because WP can and is able to efficiently track the cadet down while the local precinct would have to do a run around to locate him between his multiple residences and a PO Box on campus. Either way, the police would have to go through MPs to reach him. Edit #3 Currently waiting on the Ft Hamilton SARC to let me know which resources I have available. I will update as I move down the list. I have contacted Orange County for legal aides as well. Edit #4 I will attempt to file a police report once I speak to the SARC. Edit #5 Establishing paternity is not for child support. I am linking the assault to the accused rapist by proving paternity aka his DNA is shared with the fetus. Protecting my interests is ensuring I can get a Non-Invasive Prenatal Paternity (NIPP) done prior to 24 weeks regardless of my choice, in order to support my claim that a sexual act occured that day: the gestational age of the fetus matches the date the fetus was conceived. This means I conceived the fetus on the day of the alleged attack. I hope this makes sense. Edit #6: SARC got back to me. They're ordering a rape kit aka paternity test to establish what I stated in edit 5. Edit #7: I got a lot of inboxes of folks being concerned I am a minor, and I am not! @_@ Just had to put that out there. Edit #8: I have to put this out there because I want to try to be as unbiased as possible but this is a claim I made which can only be proven in a court of law. The person I am accusing is innocent until proven guilty even if I personally claim and know he raped me. While I appreciate the support and kindness, it does not make me feel better to receive dms about sending him death threats or wishing him ill. Quite frankly, it stresses me out. T___T I came on here to advice for legal aide, and I am thankful for everyone who reached out to help me. I think I got all the resources I need and will update as I go through the process. Edit #9: Thank you everyone for helping me figure out a way to report this to the police. I have received a lot of inboxes in addition to the public comments here with suggestions. I will try to update within 48 hours. Edit #10: Sheesh, Reddit, thank you! I was able to attain the cadets' command contact so that I am able to advocate my case - BUT I will await having a victim advocate before initiating any contact! Edit #11: I have successfully found a few options for pro-bono counsel and should connect with them tomorrow in-person. I asked CID to pause on information because getting calls and emails all day became super overwhelming & I believe it is pertinent that I have a lawyer at this time. Thank you, folks. I will leave an update as to my case elsewhere-ish, for anyone who wants to follow me on my journey. Bless you all for the kind regards. [link] [comments] |
Missouri. Neighbor climbing over fence with family to use my lake. I don't want him to. Posted: 07 Jan 2019 10:22 AM PST I'm chilling at my lake, on private property, in rural Missouri when suddenly a group of 4 adults and 5 small children crest over the hill carrying supplies and a wagon full of shit. Apparently my neighbor's family was in town and he intended to 'show them the lake'. I've never seen this guy before, and I've never given him nor his family permission to come on my property. I told them to leave and then watched as they meandered through woods and mud in order to climb over the fence where it's lowest in a wash out. It was very obvious that this wasn't a first trip. I'm not hoarding my treasure out of selfishness; there are plenty of people who have free reign to fish or whatever, but I KNOW them, they don't bring small children, and they always ask for permission first. I'm wondering how much litter I've blamed on my friends that's just from this guy trespassing. I'm mostly concerned with liability when one of these small children drown or get shot by someone I allow to hunt here. How can I protect myself from liability from trespassing neighbors? Or keep them out entirely? I've put up signage and marked trees with paint along the fence line with his property, but someone crawling over a fence probably isn't going to respect that. Edit: Thanks all, for the great insights. I'm gonna follow through with everything except the certified letter... It wasn't a particularly aggressive interaction, and if he wants to approach me in the future to fish or whatever, he's welcome to. I just need to know when someone is on my property and who they are -- I can't have someone strolling through the woods looking for mushrooms when someone with permission is shooting a firearm. And no kids. I don't need someone having their kid drown. I can't afford to be haunted and I don't want my dog in danger of some misguided sense of vengeance. [link] [comments] |
[Update] - Virginia - Found the hidden alarm loudspeakers Posted: 07 Jan 2019 11:44 AM PST Original Post here - https://old.reddit.com/r/legaladvice/comments/ad0jrg/virginia_i_purchased_a_house_with_a_home_security/ So I took the advice from the group and went looking around the house. There is an outlet about 1 foot from the main floor level return duct, I opened it up and about 18 inches up inside the return duct I found the first loudspeaker. I killed the power to the main floor, and disconnected the power line that ran to the loudspeaker's little transformer to the wall socket. It had a small backup battery on it too. I then removed the loudspeaker from inside the return and put some caulk on the holes to plug them up. Went into the attic, which was a super pain in the ass to get up into, and searched and searched for the better part of an hour. My attic has blown in insulation, so yeah...needle/haystack. After smacking my head for what seemed like the 100th time on a cross beam, I went back to the attic opening and had a long hard think...where would I put this thing if I were a lazy installer, but wanted to ensure that the upper level of the house could hear the alarm? Turns out, my laziness exercise was literally "at arm's length." So the attic opening is in the main hallway on the upper floor, buried under like a foot of blown in insulation, I found a junction box that carries the power to somewhere else in the upper floor, and to the now disconnected loudspeaker. I get the reasoning behind why the alarm company did not want to give me info, but I "was their customer" for 6 months when I first purchased the house. Well, "their customer" on paper as I got rid of everything ASAP, the previous homeowner transferred the remaining contract into my name post sale of the house. In the end, this is resolved. Thank you to everyone who helped me out. [link] [comments] |
Posted: 07 Jan 2019 06:43 AM PST I contacted a non-profit organization that gives advice for victims of domestic abuse. I explained to them what happened between me and my brother. I was concerned that I was wasting my time since I had no photographic, audio, or video evidence of my brother's attack, but they said to file with family court anyway. I should document everything that happened, writing everything down, including dates and times. They said that family court judges are extremely sensitive to victim testimonies and that my written word should be enough. I told my wife what I wanted to do, but she was hesitant. I explained to her that I needed to do this to make sure that we were safe. I did not want to force her to do anything that made her uncomfortable, so I did not ask her to go with me. She hesitantly agreed that I go to court. I went to family court and filed for a Protection from Abuse against my brother, which is Delaware's equivalent of a restraining order. The application gave examples of abuse, including throwing a glass bottle at someone, even if it doesn't hit the person. Of course, my brother threatening to kill me and swinging a hammer at me fit the description for abuse. The judge did not grant an immediate hearing, so I had to wait about a week. I did not tell my parents or my brother that I was doing this. The day before the hearing, my parents called asking if I had filed a restraining order against my brother. When I explained that I filed for a Protection from Abuse, my dad asked, to my utter disbelief, "What abuse?" Apparently, swinging a hammer and threatening to kill me does not count as abuse in my dad's eyes. He then said, "I hope you can prove it." Once again, my parents made me feel like I was the one in the wrong here and that I just needed to let this go. On the day of the hearing, my brother and I met individually with a mediator who explained the Protection from Abuse, as well as what would happen if the judge determined that abuse occurred. In Delaware, the court will also order that the abuser surrenders any firearms after the hearing. We entered the courtroom. I explained everything that had happened. I had no witnesses, but my brother had brought his neighbor as a witness. My brother proceeded to lie about everything. He admitted that he was angry and that he blamed me for getting drug tested at work, but he never attacked me or threatened me. He said that he had the hammer in his hand and that he yelled at me to get out, but that he never swung the hammer at me or threatened to kill me. The rest was a character assignation against me. He said that I was an ungrateful and unstable individual. His neighbor admitted that he never saw or heard anything happen, only that he heard shouting from inside my brother's house. The judge did not issue a Protection from Abuse. She said that I had failed to produce a preponderance of evidence that abuse had occurred. She said that this incident sounded merely like an argument between two brothers, and that if she was going to recommend anything, it would be for us to seek counseling. She ordered nothing official and dismissed the case. It was the most helpless I had ever felt. I still second guess myself about what I could have done differently, other than recording something. The only people I could have brought with me were my parents or my wife, none of whom witnessed my brother's threats or attack. Bringing them to court would have caused even more of a rift between us, forcing them to take sides, or in my wife's case, asking her to do something she wasn't comfortable doing. After the hearing, my brother told my parents that I tried to take his guns away from him. I have not seen or heard from my brother, other than texts wishing us a Merry Christmas. He and my parents are still pretending like none of this happened. As far as the courts are concerned, this did not happen. I know now what gas lighting feels like at the deepest level. Moving forward, I refuse to be alone with my parents or my brother. I will always use voice recording if he is around. I will purchase security cameras for our house and dash cam for our cars. Unless something drastic changes in my family, I cannot trust my parents or my brother ever again. Thank you for your time and your advice. What should I have done differently and what should I do moving forward? [link] [comments] |
Posted: 07 Jan 2019 07:59 AM PST I've made a throwaway for this because I don't need to coming back to me and I'm going to keep this brief. So last night my parents house was raided by the FBI. They have apparently been investigating my brother for creating and distributing pornography involving animals and children. They arrested him and confiscated everything they could. 3 of my computers that I use and have used were taken. I know 100% that my brother is probably guilty considering the scale this was on. My question is, how do I protect myself here? [link] [comments] |
Neighbor threaten to "slash my throat" need advise please Posted: 07 Jan 2019 04:38 AM PST Long story short, I have my neighbor recorded on tape threatening to literally kill me. I did not do anything specific to trigger that, we are having a 3 months argument over his loud music and had a few stand offs but I haven't done anything to him other then calling the landlord and the police about the music. I was seating outside on the porch reading a book and he approached me and started threatening me. I called the cops and they said there is nothing they can do but I can go to the court and ask for a restraining order. I am really afraid cause I know that he is insane and has a drinking problem but feel like there is nothing I can do. I have installed 2 security cameras and got a baseball bat. Any advice is greatly appropriated. Thanks. Edit: I am in FL. So you can say a Florida Man. Edit II : So it seems like the recording is going to do no good since audio recordings are an issue. Seems like I will have to go vanilla and simply tell the story at the court without the audio proof. [link] [comments] |
Posted: 06 Jan 2019 08:36 PM PST I thought this was a security alarm going off originally. After 4 days and several conversations with the police I have been informed it is not. It is a siren installed by the owner to deter homeless people from sleeping around the property. It sounds every 4 minutes for about 30 seconds and it sounds like an air raid siren. The police told me they're allowed to install it because it's an industrial area. However, there are also houses and apartments next door. I live a quarter mile away where everything is residential and it's so loud I can't sleep at night. Where do I go from here? Location: Fresno, CA. ... reposted to remove identifying information. EDIT: Resolved! Resolved? I think resolved. The owner has just called and was very apologetic. Big change from the prior conversation we had. The siren has been turned off. Also he confirmed it was an actual WWII air raid siren. I am both angry and impressed at that. Thank you all for your help. I was in the process of collecting signatures, contacting councilmen, and attorneys, but this is a much simpler solution. ... there should be a RESOLVED flair, btw. Mods? [link] [comments] |
School denying the bus to me and my siblings (NC) Posted: 07 Jan 2019 05:44 AM PST Me and my siblings have taken the bus from our neighborhood to our high school for years, until we missed school for almost two weeks. We missed the bus for ten days, and then we tried to get back on to go home it said we couldn't do it. Apparently our school says that if you miss the bus for ten days in a row, you are taken off the bus roster and have to reapply (a 30 day process) and can't ride the bus. We can't get to school anymore and we never get home till seven cause that's when our parents are able to pick us up. We have to take Uber most of the time. We've been getting rides from neighbors and stuff but it won't last forever, and now that we're doing sports and clubs and tutoring and stuff it's going to happen again and we can't keep applying for the 30-day re admittance process. Is this denial of equal access to education? Is there anything we can do? Many other students have this issue, where they have marching band or sports and miss the bus and then when they don't have practice they have to wait 30 days for the right to get home. We're just tiring of staying at school for hours to get home. Right now, we can't get to school because we're still in the 30 day process and we can't find a ride to school and it's affecting our grades. Is there anything we can do to give us an exception or something so we can just get to school? Could this be encouraging students to not do extracurricular, because some extracurricular only have a set number of practices or meets you can miss before you're kicked off, and if you have to miss one every 10 days to keep your bus rights it could get you kicked off these teams or groups. Sorry if this is confusing is you need me to explain further I will [link] [comments] |
My boss took a design that I drew and now sells it as a t-shirt without my permission. Posted: 07 Jan 2019 06:50 AM PST They may read Reddit, I'm not really sure, but also kind of don't care at this point. Let me preface the company real quick: it's a small online company that sells pet supplies with less than 20 employees out of South Carolina. With those pet supplies, for whatever reason, we also sell "custom" dog t-shirts that we print in-house. My mom also works here, this matters later. When I say "boss" and refer to "them" in the same sentence, I'm talking about the 3 people who all share an office and run the company. About this time last year, I drew a picture. I wasn't planning on it being a design of any sort, it was literally just a drawing. Well, my mom loved it and thought it would be cute on the shirts we sell, so she took a picture of it and sent it to the boss without me knowing. I guess the boss liked it too, because they didn't hesitate to make a vector design for it and make it live on the website. I had no clue of any of this until I saw an order pop up for one. At first I was kinda peeved at my mom, but she felt absolutely horrible once she saw how upset I was, which in turn made me feel like shit. She was just trying to do something nice for me, I understood that, so I forgave her for not asking. However, I did not forgive my boss - nor has he apologized for it OR told me I could have any kind of compensation for it. They just took it and have made several hundred dollars off of it so far. Even if it was sent to them, they could've still asked me to use it. Just a simple, "Hey, we like this. Is it cool if we use it?" would've sufficed. When I confronted the boss about it and asked him who designed it, he said, "you did" and that was literally all that was said about it from their end. I was just furious every single day and even kept a spreadsheet of how many they sold a day. I'm just upset that no one asked permission to use it, and in a selfish way, pretty upset that I didn't get paid for it. Instead they just raked in about $600+ dollars for something I drew without giving me a dime. Is there anything I can do? [link] [comments] |
Posted: 07 Jan 2019 02:30 AM PST This is in NB, Canada but legaladvicecanada is not nearly as active as here. They put it here 3 months into my lease. They gave me the go ahead to unplug it at night but that hasn't worked as people keep turning it on in the middle of the night and/or early in the morning (often at 5am). I've barely slept in a month. I'm losing it mentally as I already have PTSD, insomnia and a ton of other disorders. When I say I'm losing it I mean I'm really losing it and my Peformance at work is suffering big time. I made just one sale all of December when I usually do 2-4/month. I need help. It's been a month now and mentally I'm going to get checked into the hospital if it keeps going like this. [link] [comments] |
I was asked to take a paternity test roughly 5 years after birth of a child. Posted: 07 Jan 2019 09:41 AM PST Basically I met a women that I worked with and we had a pretty casual thing going. Not a real relationship but were sleeping together. She had apparently just broke up with her boyfriend but I later found out they were still sleeping together. Things end and then a couple of weeks later she tells me that she is pregnant and that it's mine. Through numerous weeks it is decided that I'm 100% in or 100% out. All communication comes to and end when I tell her my decision (out). I wanted a paternity test but she never agreed to taking one. She gets back with her boyfriend and he begans to raise the child and from what she told me in recent messages she has him on the birth certificate but now wants me to take a paternity test 5 years later. She previously messaged me about a year ago asking if I would take the test. I agreed after a lot of thinking but then didn't hear from her again until a couple of days ago. She is claiming all of this is just to get her now ex-boyfriend (I believe she is now with another man) off of the birth certificate and if it is mine to sign over all rights of the child and that we are 100% done. I'm not sure if that is legally possible once the test is taken? I know this has been painted in a way to make it seem like shes just out to get me but I haven't been the best person either and there is a real chance the baby is mine. I assume getting a lawyer is the best way to go but since I am not on the birth certificate do I even have to take a paternity test at this point? What courses of action can be taken after the test as well? Edit: This is happening in Michigan. Sorry. [link] [comments] |
My dad wants to sue me for rent because I left (WA) Posted: 07 Jan 2019 12:25 AM PST In short, my verbally abusive father told me in mid December that I had 10 days to find another place or he was going to kick me out. So I actually did. I moved out on the 29th of December. Important to note: I was the sole person paying rent, and I did leave it unpaid as I would not be living there (I needed the money for my new place). It was a month to month but my name was on the contract or lease whatever because all adults had to be on it. The actual house was in my dad's name. He's threatening to sue me. He's threatening to have them come to my job to serve me. I left because he was abusive and I couldn't take it anymore. Does he have any legal case? Was I required to give notice? [link] [comments] |
Is “stealthing” legal in Nevada? Posted: 06 Jan 2019 07:41 PM PST I had consented to protected sex with a guy, he removed the condom without my knowledge. I didn't realize this until he ejaculated inside me and I felt it. I asked him what he had just done and he said "oh, it's this trick that guys do". I made him leave because I was extremely distraught and crying. I texted him and asked him what had happened. He kept changing his story. At first he told me that he took the condom off, then pulled out. He told me that what I had felt was just it leaking onto my vagina. After I had told him that I feel as if I was sexually assaulted, he changed his story and said that he never removed the condom at all. I only consented to protected sex. I did not consent to unprotected sex. He came to my house with plan b about 2 hours later and held it captive until he got on video that I consented to protected sex and that he never removed the condom. I HAD to. I had no other means of acquiring plan b because I am only 16. Would this even stand in a court of law? I have all the screenshots as proof, saying that he removed the condom. Plan b is only 95% effective. I feel raped. I have a heavy sense of grief and anxiety. I'm only 16 and this was my first time. Is there anything that could be done legally? He has blocked me on everything and made me delete his number in front of him, I still have his number because he doesn't realize it still shows up in recents. [link] [comments] |
Posted: 07 Jan 2019 08:36 AM PST A couple of months ago my grandfather passed away. My grandmother is sill alive so she started the process of transferring everything into her name. Among those things was a safety deposit box with what was supposed to have $20,000 cash in it. We went to go clear the box out and to our much surprise it was empty. We asked the bank wtf happened so they went to the cameras to see what happened. Apparently the day in which the money was taken out "the camera wasn't on". We filed a police report and such but they are saying they can't do anything without evidence. My grandfather was severely disabled in the last 15 years of his life and nobody else had access to the box. There is no way anyone else in the family could have gotten to it. What can we do on the legal side? Do we have any sort of claim here? USA - Connecticut [link] [comments] |
My SIL has set up a doTERRA wellness clinic. To report or not report? Posted: 06 Jan 2019 03:47 PM PST My sister in law is an essential oils enthusiast, to put it lightly. Years ago she began by sharing how she uses essential oils to balance her children's lead levels and how she uses cinnamon oil as a contraceptive, then I heard from my sister how my SIL claimed to have cured a child's brain cancer through faith healing and how she had offered to heal my niece's kidney infection. Last week I found out she has started a doTERRA based wellness clinic in the Salt Lake City, Utah area. When it was her own children being impacted by her anti Western medicine leanings I felt I didn't have grounds to make a complaint, but now she has expanded to providing services to the public. She isn't explicit on her website, but in Facebook posts my sister in law has discussed her "fertility clinic." and helping women conceive. I cannot help but fear that she is putting a particularly vulnerable and desperate population at risk by portraying herself as a medical professional (Doctor of Pastoral Medicine) and by making claims about the medicinal value of essential oils. She fails to address the particular danger essential oils can pose to pregnant women and infants and advertises services for them in particular. Though she has all the proper FDA disclaimers at the bottom of her website regarding not providing medical services, included on one page is the claim that essential oils can rewrite and transform DNA. I believe this is an explicit medical claim and from my understanding making such claims is illegal as it moves oils from a cosmetic to the drug category. On her clinic's public Facebook page she also claims to have "supported the reversal of major thyroid conditions". However, on the FDA's website I cannot find how to report a bad actor, only adverse reactions. I would like to prevent future harm, but since I have not personally been impacted negatively I'm not sure how to proceed. I live across the country in Virginia and while most of my information on the situation comes from my sister, my sister doesn't want to be involved in the report since she'd face greater familial backlash than I would, so that leaves me with no negative impacts and no witnesses other than publicly available information. I know alternative, holistic and faith based medicine is a weird grey area legally, with many loopholes. For all I know she is acting super shady, but completely legally. Is it worth reporting her potentially illegal claims about services she provides and if so, who do I report it to? The Utah medical board? The FDA? Are there legal repercussions I might face for making a report, such as defamation? [link] [comments] |

Eviction after 3 days, stemming from a single noise complaint? Posted: 07 Jan 2019 07:31 AM PST My brother and I just signed a 12 month lease to a condo. We just received our keys on Thursday and started moving stuff in on Friday. Saturday night, some of our friends and family came over to see the new place and throw a little house warming get together. We went out to a bar and came back just after they closed, around 2:30 am. We were talking and laughing on our balcony (we weren't even playing any music), when the police rolled up. They never even left their car, (our balcony sits over the street), but they rolled down the windows and shouted up to us that they apologize for the inconvenience, they know it's a Saturday night, but there was a noise complaint and they asked for us to quiet it down. We apologized and they left without incident. Afterwards, everyone went home. The next morning, (yesterday), our landlord (who we haven't even met yet), tried calling me a few times but I was still sleeping. We received a call from our grandfather (who wrote the checks for the security deposit at the lease-signing a few days prior), that the landlord called him to inform him that she received a call from our neighbor the night before complaining about our noise levels and that she will immediately begin an emergency eviction notice to us. He informed us that she was on the way. About an hour later she knocked on our door and we let her in. We explained that we had a little get together, that drinks were involved, and we apologize and that it won't happen again in the future. She was very upset and told us that she received calls from neighbors about our loud partying. We told her that the police stopped by and told us to quiet down and we did. She then started going on about eviction, or if she decides to let us stay, we'd each have to sign an addendum to the lease, which was obviously already signed at this point. In no way are we going to sign an addendum, and to be talking about eviction from a single noise complaint seems a bit absurd. This was the first time this occurred, it's not as if we are constantly keeping our neighbors up at night or partying late every night. We had one little get together, got a little loud, and the neighbor (who as it happens is one of her best friends), called her directly to complain about us. No one was arrested, there was no damage to the property, and no charges were filed. She said she would sleep on it and meet with us today with her decision on if we're allowed to stay. Is she within her rights to be talking about eviction from a single noise complaint? We only been at the property a few days, is there any way to pull out of a lease without serious ramifications? What should/can we do? Any advice is greatly appreciated. Thank you. Edit; We located in Springfield, Virginia, which is part of Fairfax County. Update; The Landlord emailed my brother and I today with an ultimatum; either a 60 day notice to vacate the property and forfeit our security deposit, or we sign an addendum in which we agree that if there is any complaint going forward from a neighbor or otherwise, whether or not police is involved, we would immediately have a 7 day period to vacate with forfeiture of security deposit. We never received a Cure or Quit Notice from the landlord, and the entire legality of this seems a bit questionable. We're not signing anything so we reached out to a lawyer whom we're going to meet on Wednesday. [link] [comments] |
Posted: 07 Jan 2019 08:27 AM PST I'm from Canada Alberta Back story :So basically I broke my old pair(I had them for 1 year) so I decided to get a new pair so instead of going to the usual place I went to the one my school suggested because it's the only place I could use my school insurance for . I decided to get new lenses which cost 300$(normal lenses cost 200$ but they decided to up sell me on some shitty anti fatigue lenses which cost 100$ more but I clearly didn't need because the optometrist at another store that I went to after I purchased the glass said I didn't need them since I was so young(19)) . Since I couldn't afford new frames I just asked them to use my frames from my old glasses(I had these for 2 years ) they say fine and charge me 20$ to put in the lenses into my old frame. So I get them back and the lenses feel like garbage since only like 70% of what I see if clear while everything else on the sides of my glasses seems smudged(because that's how anti fatigue glasses apparently work) . I complain but they say to wait a week so I can get used to them,I wait a week and then come back and complain since I saw no difference so they decided to switch me to normal lenses which cost 200$(I don't need to pay anything) , I'm fine with it even thou I should of originally had those lenses and basically lose out on 100$ since I paid 300$ and get 200$ lenses , The story:This is where they fuck up they tell me to come back in 2 days to pick up my glasses but then they send me a email a few hours later that says they accidentally broke my frame on my glasses . They offer to give me 25% off any frames in the store or if I want 'complimentary'?frames which cost like 50$ but they would give me them for 'free' , the frames they broke cost me 299$ 2 years ago (Burberry frames) . Is there anything I can do ? I want frames just like the ones I gave them. They called the glasses old but I only bought them 2 years ago ? Can I do something to get the same frames back? TLDR:Optometrist place broke the frames of my glasses and they are only offering me 25% off any frames in store or 'complimentary' frames (which cost like 50$ but they will give me them for 'free') I originally paid 299$ for my frames two years ago is there anything I can do ? Thanks to anyone who responses ! [link] [comments] |
I’m out on workman’s comp but my employer wants me to sign a leave of absence. Posted: 07 Jan 2019 11:58 AM PST I'm in pa. I'm currently out on workman's comp after having surgery on my wrist. Prior to surgery, WC agreed to pay for surgery and wages. I spoke to my adjuster this morning and that's still the case. I heard from my hr person today who sent me a leave of absence form with the personal leave box checked off. Below, workman's comp hand surgery is written in. They are also having me use up sick time, vacation time and ESL. I was under the impression those would not be touched. I don't care if I use that time because I plan on quitting the moment I'm cleared to work. Is this being handled correctly? I just want to make sure I'm not getting screwed. I can upload the document if needed. [link] [comments] |
Cell phone tracking on children's cell phones from non-custodial divorced parent. Posted: 07 Jan 2019 06:42 AM PST My sons (13 & 12 yrs old) came back from their every other weekend visit with their mother, and said that she put a family tracking app on their cell phones. My wife and I have primary custody, and my ex only has every other weekend and Wednesday evenings with the boys. She set up a notification so that she knows when they leave our home. I feel that this is a huge invasion of OUR privacy and that I have the right to turn off the location services for that app while they are with us. Any advice would be helpful. Located in Indiana. Posted: 07 Jan 2019 02:13 AM PST I do presume this is legal as, previously, I'd never worked in a restaurant that did pay minimum wage during opening, but I'd like a bit of clarification on management's explanation. They said that the new minimum wage law (the one largely gutted by Michigan's legislature) provides clarification that it is legal to pay the tipped minimum wage during opening time. What text are they referring to? [link] [comments] |

Posted: 07 Jan 2019 01:20 PM PST So, my stepfather died of pneumonia on Sunday. (no condolences needed, he was an alcoholic jerk that treated my mom and I horribly). After almost 40 years together, my 75-year-old mom finally kicked him out of the house and she has been struggling to live on $1,650 social security ever since. My mother has wanted to file for divorce, so she can get some sort of spousal maintenance and support, but she could never afford the attorney needed to file a divorce in California. My stepfather was cheap and lived frugally and has almost a million dollars in his savings and retirement accounts yet has never given my mother anything since he moved out. Now to the drama... When my stepfather moved out, he rented a house nearby and after a few months, his estranged daughter miraculously showed up out of the blue and took control of his life and affairs. She sold every possession he had and moved him into her tiny trailer in Kentucky. My stepfather called my mother last week and was crying on the phone. He said that his daughter is milking him dry and has used his money to remodel her house and buy almost $100k worth of stuff. He also said that he has been so sick for the past few weeks, that he couldn't even function. My mom told him that he needs to go to the hospital if he is feeling that bad, which is when his daughter picked up the other phone line and said, "Dad is fine, he just has a cold." and hung up the call. During the phone call, my stepfather apologized for everything he has done over the years and he told my mother that he loved her very much. The next day, the daughter called my mother and told her that my stepdad has passed away from what she believes is pneumonia. My mom asked her if that's what the doctor said that he had, and she told my mom that he never went to the doctor nor was ever treated for pneumonia. Furious, my mother asked the daughter why in the heck was he never treated, and was told that, get this, "Your husband has a form that says DO NOT RESUSCITATE so she said it was obviously against his wishes to be treated." This backwoods country redneck thought that a "DO NOT RESUSCITATE" meant that he did not want to be treated for any illness. My stepfather's death could have been 100% preventable if he was treated. Now he is dead, and this woman is trying to gain access to all of my stepdad's accounts. I have called multiple attorneys and every one of them said they need $15-$20k upfront to handle this for my mother. Nobody in our family has the upfront means to pay these attorney's fees and the local Legal Aid society says they don't handle cases like that. Because California is a community property state, I believe that my mother has a legal right to half of my stepdad's estate, but she has no way to fight that and will lose her share of a large estate. We are not sure there is a will, and if there is, we are almost positive that the daughter had it changed in the short time my stepfather lived with her. Sorry if this rambled on. Any advice would be greatly appreciated. [link] [comments] |
Nonexistent safeties on patient records Posted: 07 Jan 2019 04:54 AM PST Oklahoma City, Ok, USA Currently working for a nurse staffing agency that seems to have absolutely no concept of securing patient records. Or employee info, for that matter. Employees use an app to clock in and out. Our user names are our name, plus our social security number, and our town we live in. The app also displays patient names and records in the app. None of this is encrypted. Everyone using the app has the exact same password. And it's real easy to guess. Patient and employee records are stored on a Windows Vista desktop with no firewall. HR responded to my concerns with 'This makes it easy for me'. Are there minimum requirements for storing these records digitally? [link] [comments] |
