    Kid was drinking, got arrested an all. I bought my truck for about $5,000 but I got a really good deal on it. Looking online ones in similar condition (there's not many) are going for $6,000-$8,000. It's a bad market right now to buy used cars. He has insurance and so do I. I have a $500 deductible for collision. His father might pay me $6,000 to "make the whole thing go away."

    My concern is I won't be able to afford a suitable replacement for that amount of money. If I ask him to file through his insurance I believe he will without issue. Will the insurance company offer me more given the current market? I've never been in an accident before and live on my own.

    edit: I am just trying to figure out what is in my best interest and how to proceed.

    Metlife saying there's an accident I was never in.

    I'm shopping around car insurances and looked with Metlife who offered a really good rate. Unfortunately, the site shows I was at fault in an accident in 2016 that never occurred. I have no idea what to do and if it's identity theft or something else? Please help

    What will my boss be able to see results from my life insurance health exam? State of New Jersey

    I work at a local insurance agency and my boss is making me get life insurance to meet the goal by the end of the year. I however am feeling really uncomfortable about being pressured into this.

    Tomorrow morning I have the health insurance exam, getting urine and bloodwork testing done. I know that they screen everything which makes me nervous.

    I took adderall last night to study for an exam and now I'm worried about what's going to happen. I would like to note that by no means do I do hardcore drugs; I'm just your average college student who occasionally needs to focus on studying—especially with finals approaching.

    Will my boss be told what came up on my results? Can I get fired?

    An accident that was determined not my fault is now costing me more than the other driver included

    I'm 24 from NY and I have Geico, have had them for about two years. I've also had my license for the same amount of time. On 10/17 of this year a lady ran a stop sign trying to beat me through an intersection and I clipped the rear quarter panel of her car. On the street I was driving down there was NO stop sign, only on her street. I was driving the speed limit, or barely because my friend lives on the same block and I had just picked him up. The whole front end of my car was destroyed (I drive an 05 Hyundai Tiburon made of fiberglass so you'd imagine).

    After all is said and done the insurance determined its 85/15, meaning 85% her fault and 15% mine. It also took me 2 weeks for Geico to get me a rental (2 weeks of uber) and I only got one because I spoke to someone who knew what they were doing finally. Around the time of me getting a rental my car also finally got taken to a shop. It is 12/2, and my car is still not fixed, my rental expires on 12/5 and I feel as if the person handling my claim hasnt handled it correctly with how long this has been drawn out. I didnt get refunded for my uber rides, I had to pay to extend my rental due to how slow theyre moving, they raised my insurance to 400$ for absolutely no reason which I cant afford, they told me i cannot cancel my insurance unless I turn my plates into the DMV and I have not been getting straight answers about anything.

    Is there any way I can fight this so that I am 0% at fault for this accident, as there was no indication for me to stop nor was I breaking any driving laws and also is there any way to receive a reimbursement to anything that had to come out of my pocket due to them being slow?

    Left over FSA funds if next year I have HDHP

    Considering a hdhp next year. Do I need to use all of my FSA dollars before I start funding the HSA? I might have about 500 left. I'll have dental and vision expenses that I could use it on either this year or next but I'm running out of time to do it this year. OPM has a LEX FSA Which seems like what I need, I just can't tell if I can roll over money into it.

    Premium skyrocketed after an accident...is there any way I can bring it down?

    I paid 143 a month, was in a small non-serious car accident last month, and now it's up to 307 a month. I know they increase after accidents, but not this much as far as I know. I called my insurance company and they told me it was a combination of car insurances going up in my state as well as the accident. I googled this information and it also doesn't justify a 160+ increase even when combined with the accident. Does anyone know why this is and what I can do to bring down my monthly payment? Am I just gonna have to look for another insurance?

    Unexpectedly went over Medicaid limit for 2018, but will have less income in 2019 - will I have to backpay expenses covered?

    I'm currently on medicaid, and all that's reported on it my actual job, because the other money I make from odd jobs and things, or random things like selling on ebay, can be anywhere from a loss to a decent profit each month. I didn't think it mattered because it wasn't stable and I didn't expect to make enough by the end of the year that it would get a 1099 form (paypal), so it was like "side cash". But I just barely hit it, and I'll be sent a 1099, which will show on my 2018 tax return.

    After expenses it doesn't drop my down low enough due to the income from aforesaid job. I didn't plan on this, or I would have contacted medicaid had I thought I would've had excess income, but life was also busy and I didn't notice until now.

    This was an honest error and I had no idea how to report to medicaid what my actual expected monthly income was because there was no way to know in advance. Will I be liable for fraud, and will I have to back pay all the medical expenses from 2018 because I technically went way over for the overall year, even though I won't have those side jobs and income in 2019 and will go back to only actual job income aka what's already reported?

    I had a lot of medical expenses this year and there is no way at all I can afford to back pay their full expenses (it would probably be something like 50-90k, I had a surgery, ER visit, and several tests and many dr visits, monthly meds. But I didn't even make 50-90k income).

    Bad Faith Insurance - Home Birth - Oakland

    Bay Area, CA, posting in both /r/legal advice and /r/insurance

    Do we have a bad faith insurance claim?

    My wife gave birth to our son at a birth center using a Licensed Professional Midwife (a legally recognized medical professional in CA) on July 17th, 2017.

    Here are the details in chronological order:

    • January 2016: switched our health insurance plan to Cigna PPO with 50% out of network coverage during open enrollment

    • February 2016: find out that the only midwives accepted through our plan were all Certified Nurse Midwives which are required to deliver births in hospitals. Used our LPM's medical biller to file a gap exception to cover our standalone birth center birth.

    • June 2017: Cigna denied the gap exception on the basis that our plan only covers in-network services. We find out that Cigna never changed our plan in January to the new PPO and tell them about the mistake.

    • July 2017: Our son is born

    • Aug 2017: Cigna fixes their mistake and retroactively changes our plan to the PPO with out of network coverage. They reprocess the gap exception and deny it again stating that it's because they "offer midwife services in-network. Two issues with this. (1) Our son was born before they reprocessed the claim correctly, giving us no recourse to seek appeals or other care providers. (2) Their in-network midwife services only covered hospital births which is what we wanted to avoid by using our LPM at a stand-alone birth center.

    • Spring 2017: We communicate with our midwife and learn that she has not received payments from Cigna that we expected them to cover at 50% due to our plan and gap exception denial.

    • Spring 2017: We ask Cigna to reprocess the claims at 50%

    • Spring 2017: We file a claim with the CA department of Insurance about all of this.

    • Spring 2017: CA Dept of Insurance gets back to us and says they could not help us because our plan was employer-funded and falls under the scope of ERISA

    • August 2017: We learn that Cigna has reprocessed the claims and states that they negotiated a 100% discount with our midwife. We contacted our midwife about this yand she says she had zero communication with Cigna and even if she had heard from them, she never negotiates with insurance claims.

    • September 2017: I contacted an ERISA lawyer but he was hesitant that the money was too low (Bill is 13k total) and he wasn't willing to review our case without a large deposit.

    • To date, Cigna has paid out about $1800

    So do we have a bad faith insurance claim? Is it worth it for us to get a lawyer and pursue this?

    Does Airbnb's own public liability insurance cover damages caused to hosts' properties?

    Hi

    Since public liability insurance for a business is their protection if they are found legally responsible for personal injury to a third party or damage to their property, any damage caused to customers and their properties are covered. Does that mean Airbnb's own public liability insurance cover for all millions of hosts that use the platform (I believe they call it the Host Protection Insurance programme)? In fact, both guests and hosts are Airbnb's customers (third-party). That's a pretty good deal for Airbnb if that's the case given insurance premiums for software developers are fairly low.

    EDIT: Suppose the state in question is CA, where Airbnb is headquartered.

    Licence expired, cannot renew for now

    So, my licence just expired a few days ago and I can't renew it right now because I lost my birth certificate and a replacement is going to be sent to me from another state soon. It so happens that my auto insurance policy comes to an end in a few days from now. Do I avoid a lapse and renew my policy anyway? Im thinking about adding my significant other who I live with as a driver (I don't intend on driving myself until my licence is renewed). I want to know if its likely my insurance provider would allow me to renew with an expired licence so long as I have an additional driver with a valid one on the policy.

    Travel Insurance for Expats

    First post on Reddit, hopefully somebody can help me.

    I'm a permanent UK resident, with a UK address and am eligible for NHS Healthcare. However, I spend on average 10 months per year in Mexico. I have a work Visa for Mexico, and private health insurance cover in Mexico, but am not a permanent Mexican resident.

    I frequently travel to the US, Europe, and will soon be travelling to Asia. I've been looking to buy travel insurance (ideally long term insurance to cover my multiple trips) but am struggling to find anything that would cover me. UK policies tell me my trip has to start and end in the UK which they generally don't, Mexican policies tell me I have to be a permanent resident or offer very low levels of cover. I've found a few policies which cover single trips, but I'd ideally like something for multiple trips where I just pay a yearly fee.

    Has anyone found themselves in a similar situation and found an insurance product which would cover them?

    What are the options for a no-fault, unattended car accident claim in California?

    Hi, My Brand new Mazda6 Grand Touring car 5 days old with 208 miles on the odometer, was hit by someone in the parking lot. No frame damage but the entire rear end of the car was damaged. Other party's insurance is Farmer Insurance and my insurance is Geico. I went through my own insurance coverage as Farmer insurance took 100% responsibility of the accident and it won't impact my insurance history(as per California law) expecting Geico will be more supportive(wrong assumption). Geico estimated the car repair for $20000. I bought it for $26500 but the market price is $29000. Geico is reluctant to make it a total loss as they are considering the market value and repairs are only 66%($20000/$29000) of the market value. I don't want to have 20k repair history on my brand new car.

    1) Can I ask Geico to consider purchase price($26000) instead of market price? then the repair cost will be 75% and it is eligible for total loss

    2) If I am unable to get a total loss, Instead of repairing the vehicle, can I request the insurance company to salvage the vehicle and settle the claim with a certain amount?

    3) If even salvaging is not possible, how much this repair going to impact my car value? (Body shop is saying there won't be any report as it is only rear part mostly cosmetic, no serious damage and no airbags popped out, is it true? anything more than $5000 must be reported? )

    4) If nothing works out, the last option is Diminished Value Claim as it is a brand new car. Who is liable for the claim - Geico or Farmers? How successful my claim will be?
