    I own a home in New Jersey that has (had) a 100 year old oak tree that sat right on the property line between myself and my neighbor. It was literally 50/50. I came home to find everything but about 12' of stump left. I had absolutely zero prior notice.

    I purchased the property about 3 months ago. This was a beautiful tree and I know this will have an impact on my property values. What can/should I do? Thanks.

    It was an 79 year old pine tree. 70% his property, 30% mine. The town deemed it a hazard because it was slanted and near an industrial power line. Received notice on 12/5 that the tree would be removed.

    Neighbor has me served for a $65,000 lawsuit because the tree removal devalued his property.

    I know this is completely ridiculous but my wife is freaking out. Does my neighbor have any recourse w me?

    Obviously the debts/loans I had as a minor don't exist on my credit.. But the biggest problem is that my freaking credit is sitting at a pretty 200 and something. I can't access my ACTUAL credit and only base it off credit karma. She opened up so many things in my name that the security questions are so, like, wtf??? I didn't open this when I was 13, etc. I have never owned a car in my life, etc. I know this sounds fabricated as hell but this is actually weighing down on me. I can't dispute anything, my mom is dead, i didn't update my living address until one of my best friends actually helped me get my state ID. I don't have any bills to prove I lived else where. Would it just be easier to pay them off? They're a bunch of 200+ish$ collections that I could pay off within two-three years, but it really won't help my score if I do that anyway, would it? Like what the heck do I do? I just recently cut off the rest of my immediate family because they were trying to use me as a form of payment for their own bills. I'm really lost and don't know what to do. I'm sorry if this is so jumbled... I'm drunk and mad and dont know how to get rid of all the stuff my mom put into my damn name

    Can't get itemized bill from hospital

    Location is California.

    I had medically-necessary surgery about 6 weeks ago. It was with a well-known doctor at a very large hospital.

    I've had a handful of surgeries over the last ten years and I always get ahold of the itemized bill from the doctor/hospital before I pay. I've never had an issue, I just like to check the bill, the coding, etc.

    I've been trying for weeks to get the itemized bill from this most recent surgery, however, and have been unable to. Nobody answers the billing department phone number at the hospital. I even waited on hold for over an hour once and didn't speak to anyone at all. I've called other customer service numbers at the hospital and all they will do is give me the same phone number for the billing department. *edited to add that I have also requested this bill in writing through my patient online portal account with the hospital, and in the customer service text box on their website. I received an answer in the patient portal that they would mail the bill out over a week ago, but I never received it in the mail.

    On top of that weirdness, I recently learned (through Google) that the doctor who did this surgery was once convicted of insurance fraud. So I'd really like to see this bill before I pay.

    I plan to go in-person to the billing department today. If I'm unable to get the itemized bill, though, what would be my next step? If I call my insurance company, would they be able to request the bill for me from the hospital?

    I was arrested for preventing my property from being stolen. Police refuse to release my car from impound without impound fees.

    I was at northpark mall in Dallas this week with a friend when I noticed my car keys and wallet were missing. I do not know where or how they went missing, but I immediately walked out to my car.

    My friend told me to come 5 lanes over and watch for someone pinging my car.

    Sure enough about 20-40 minutes later I saw the lights and horn honk on my car a few dozen times before I saw someone come over to it.

    I walked up to interrupt the guy and he stopped and turned around to walk away. My wallet was in his hand and so were my keys so I drew my gun and told him to stop. My friend went the other way and blocked him from the other side.

    Well anyone who knows north park knows where this is going. About less than a minute later police officers were yelling at me to drop the pistol and to get on the ground.

    The police detain the 3 of us and soon determine that the car, wallet, keys, and 500 in cash the guy had on him was mine. They saw the LTC I had in my wallet and told me that since I pulled my gun when I did not have my wallet on me, I was not properly licensed to carry a pistol.

    I call bullshit on it as it is obvious they were making that up. I am arrested anyway. My friend is free to go but since he is not insured on my car, they "have to tow it." Even though he could have driven it himself.

    I was taken to the station and put in a holding cell for about an hour or two before I was released with no charges.

    Not one police officer talked to me while there outside of telling me I could go.

    They hand me my phone and wallet back. They told me my gun was in property and gave me a location where I could go request it back. The car is in the impound and will require impound fees be paid.

    I went Friday and was able to head to the gun store where I bought the pistol and got a reprint of the receipt. I made an appointment and was able to get it returned with very little hassle.

    I was told on the phone I would need an insurance card to get my car released from the Dallas auto pound as well as my driver's license.

    I arrive with my insurance card and license only to be told I would need a copy of the title as well.

    I head back to the tax office and get that only to learn it is now too late to get the car back. Will have to get it Monday while fees are being racked up...

    I am beyond furious here. Obviously I am going to be out of pocket on everything. My question is how do I recoup this money? Since my pistol and all other property was returned to me, I am guessing that I am pretty much free and clear criminally as the police usually do not release firearms if there is an ongoing criminal case.

    I am mainly concerned about the money. Its not going to break my bank, but 4 days worth of impound fees are going to get expensive real quick.

    EDIT: I figured I would have to do this. I could have legally shot him in the back if he tried to run away with my property. Its Texas.     My 17 year old sister has just escaped an abusive household and my mother is threatening to call the cops and report her as a runaway. New York State

    After a big blowout with my abusive mother, my 17 year old sister packed her things and left home. She is currently staying with my dad.

    My mom has threatened to call the cops on my father (they're divorced) and reporting him, saying he's harboring a runaway. My sister has a ton of proof that my mom is emotionally and mentally abusive(videos and recordings) and she wants to emancipate herself. First and foremost, can my mom do this? I've read the police will just return her, but my sister has left for good reason. If the cops are called and investigate, will a child abuse investigation take place? Also — my mom has a warrant out from Florida and id think calling the cops wouldn't end well for her overall...

    Can someone inform me of the laws in New York State for this situation?

    Update to: Grandfather has Alzheimers, grandmother won't take care of him.

    Even though my post didn't generate a lot of popularity, I thought I would make an update to this post

    I called the local adult protective service, and they were so kind. However, before anything could happen, my grandfather passed out outside and was taken to the hospital where they found he had colon cancer. He does not want any operation or treatment.

    He's currently being made comfortable by hospice care, getting everything he needs. I spoke to him yesterday and he seems... Happier than he had in a long time, which is odd but good.

    So, in all a bittersweet update. Thank you for your advice, LA.

    (GA, USA) My fiance's ex wife just totalled the car that he was required to pay for in the divorce

    His divorce papers allowed his ex wife to keep his Jeep until May 1st, in which she was either required to give it back to him in the same condition he gave it to her or give it back to him once she acquired another vehicle (whichever came first). He's required to make the monthly payments and pay the insurance.

    She allowed her boyfriend to drive the vehicle and he totalled it. He was not covered under the issuance and my fiance is now out a vehicle that was his. What recourse does he have? What do we do next?

    Amazon just fired me for being on an approved military leave for my drill as a Marine Reservist.

    So I started working at Amazon in late October. When I started I had mentioned to them I am a Marine Corps Reserves and will need to take periods of time off each month for drill. In November I put in my military leave request from the 8 Nov - 11 Nov which was a approved just as my drill was approved from 5 Dec- 9 Dec. But even though a week prior to this drill i verified with my site HR that both forms through my AtoZ and MyLeave where approved, I was still marked for UPT (UnPaid Time) for every day I would have worked. Which at the end of my drill sunday night brought my total balance of acquired UPT to a negative balance. As of right now I have called my ERC and they have made an open ticket which is supposed to make my site HR contact me. If this does not get resolved what can I do?

    Ex was formerly arrested for cyber stalking, now I think he may be doing the same thing to me

    I'm sorry if this is a little long but I'll try to keep it short.

    Me (F20) and my ex (M20) had dated for 7 months. During the relationship he had told me that he had to go to court on a case where he had cyber stalked a girl that had broken up with him. His story of what happened, or at least what he told me, was that her parents had her break up with him for reasons I dont know. (I think he was 17 at the time) She had a second phone and he started texting and calling her hundreds of times trying to get in contact with her again. Her parents found the girl crying in her room and discovered the second phone. They ended up filing a case against him for cyber stalking and harrassment. He went to court and was put on probation for 15 months and was done with it. He told me this about 4 months into the relationship the day before his court appearance. By that time in our relationship I really did trust him. He seemed like a genuine guy, really down to earth and goofy so I didnt think too much of it and let it go. Towards the end of the relationship things started to get bad. He became extremely controlling and insecure. He started saying I couldnt be with certain friends anymore, (sorry if its tmi) but during our relationship I changed to birth control so we didnt need condoms anymore. I had leftover packs of condoms in my drawer and later I found him counting the packs to make sure I didnt sleep with someone behind his back and the same number of condoms were there. I have no history of cheating or doing anything to break his trust but his insecurities were becoming more real as we went on. Down the road I discovered a fake instagram that he had. He always avoided accepting my request to view the page and ignored me every time I asked. We got in an argument over trust and how I felt like he didnt trust me and I brought up the instagram. He scrolled thru it quickly, showing me what was on the page. All I saw were pictures of his ex's, and nudes from random girls. I dont know if these were recent pictures, old saved ones or how he got them. I was definitly disturbed. Skip towards another 2 months and I ended breaking things off. I had lost trust for him after the instagram and after I caught him explicitly texting one of his exs. He made this huge deal of me making something out of nothing. He was screaming and would raise a hand like he was threatening to hit me and then started screaming again. I was already tired of all the manipulation, I told him I'd put his things outside my door and he can get them in the morning.

    During me and his relationship there were a lot of other things that were concerns as well. It seemed like he'd intentionally start arguments. I also got a puppy during this time and I caught him opening the bathroom door quickly, hitting my puppy and he would chuckle an "oops". I know this was intentional as well because he always was telling me how much he hates my dog and I'd catch him doing other things to Creed that wasnt necessary or that was harmful.

    Anyways, after he got his things he started texting me on my cell number, instagram, snapchat, wherever he could. I blocked him from everything and haven't heard from him since. For the first couple of weeks after the break up, I was looking over my shoulder because I was afraid he was going to be looking for me. It's been a few months and last night my mom told me that she got a snapchat request from him. She doesnt know the full story of what happened but she knew he was a dirtbag and denied the request.

    I've had a past situation where I was being stalked and I had to file a restraining order. I dont want to be acting out of fear because of that, but I also dont want to ignore this behavior if it's something to be concerned about. Any advice or help will be welcomed!! Sorry for the long post

    I was given a traffic violation in NY state for something that wasn't illegal, I live hours away in Ontario, and the DA is refusing to drop the charge

    The incident:

    So, a few months ago I was returning from visiting friends in the States and was driving through NY state on my way home to Ontario. About 10 or 15 min from the border, much to my surprise, I was pulled over by a police officer. He told me that I wasn't speeding (which I knew, as I had been very carefully monitoring my speed) but that I had a headlight out. This was news to me, because I had checked my headlights when I started my drive that morning (they were both working then) and it was still daylight outside, so I had not noticed that there was less light than there should have been. I expressed surprise (politely) and handed him my license and registration as he requested. He gave me a ticket for "No/inadequate lights" and sent me on my way. I crossed the border very shortly after that, found a safe spot to pull over, examined the headlight myself, hit it once, and it came right back on.

    The relevant laws:

    When I got home, I started looking up NY traffic law, because I was pretty sure that NY doesn't require daytime running headlights. Turns out I am right. I found the wording for the law and it specifies, according to the Department of Motor Vehicles New York Safety Laws website, (https://www.dmv.org/ny-new-york/safety-laws.php) that the current law in the State of New York is that headlights must be on:

    • When visibility is reduced to 1,000 feet or less.
    • 30 minutes after sunset until 30 minutes before sunrise.
    • Whenever using windshield wipers in rain or snow.

    None of these three stipulations were the case at the time I received the ticket. I called the court and they told me to write up my explanation and send it. I did so, including the above information, citing the exact time and date I received the ticket, and then looking up and including the official sunset time in that county on that day (to prove my ticket was received well before 30 minutes after sunset) as well as the actual reported weather conditions for that county on that day and time (not just the forecast, but the historical "this is what happened today" report) to prove there was no precipitation at all, nor any conditions that would have resulted in reduced visibility. I wrote it all up politely, included the various documents on sunset time, law wording, and weather conditions, and sent it off.

    The first DA letter:

    It happens right now that Canada Post (our mail system) is on strike, which is delaying the mail arriving. So I called the DA when I hadn't heard back in a few weeks, to make sure they received my explanation and see if they had made a decision. I was told over the phone that they had received it, and had made a decision that no reduction would be offered; they had mailed that decision and it would arrive at my home shortly. I was also told this was the "final offer" and if I didn't like it, I should call the court to schedule a court date. Incredulous, I did so.

    Long story short I was told to wait for the official letter from the DA, and was given more time to make a decision how I would respond (I am currently unemployed, which I told them, and making another trip to NY for a court date to fight this ticket that I shouldn't have received in the first place would be a lot of gas money.) I received the letter, and called the court to schedule a trial date but no one answered, so I left a message as the answering service stated to do.

    The second DA letter:

    The very next day (before I heard back from the court) I received a second "final offer" of a plea bargain from the DA. This one amended my charges from "No/inadequate lights" to "Parking on pavement." I feel the need to point out here that I was driving on a highway when I was pulled over. Also, it does not appear to be a lesser charge. Both charges have 0 points attached to them, and I was told, when I called the court confused, that they have a similar sliding scale of fine, though the second charge may have a lesser "surcharge" attached to it. (Because apparently I have to pay taxes--the person I spoke with at the court used that word to describe this surcharge--on my fine for something I never did after it was amended from something that wasn't illegal in the first place.)

    And then... "it's not possible that this could be overturned":

    I asked at this point (given the distance I live from the court and the fact that I am currently unemployed) whether instead of appearing in person to fight this ticket if I could submit my written account and have the judge make his/her decision based on it. I was told no, I must appear. I then asked, just to be sure, is a possible outcome of this court appearance that the judge could decide to throw the ticket out. I was told no again, that the judge just "sets the fine." I expressed more incredulity at that (politely, I promise), pointing out that if a "not guilty" decision isn't at least a possible outcome of any given court case than it's not really a court of justice, is it? To be clear, even the documents they have sent me use the word "trial" not "sentencing." The person on the phone became flustered and admitted that perhaps the judge could throw out the ticket, but stated that they weren't sure.

    My questions:

    That's where things stand now. I have until mid-January to make a decision. I have two questions for this subreddit: 1) Is it actually true that the judge can't throw this out, that all he/she can do is set a fine? (Am I screwed because the DA refuses to admit the ticket was issued in error) and 2) Is there anything else I could do to get this thrown out, or, if I do suck it up and go to court, is there any advice I should follow?

    Hospital Nurse Will Not Stop Blowing Up my Phone

    I was hospitalized a few weeks ago and there was a nurse that was taking care of me during my stay at the hospital. The nurse accessed my information and has been harassing me non-stop via phone. I went to court already and got a restraining order, but it was temporary. It is now over and I have to go to court again to extend it. I am currently being harassed and I feel really lost right now. I tried to Google anything that was close to what I am experiencing and I cannot seem to find anything. I just need some help in the direction of where I am supposed to be looking. I'm pretty sure he may have violated HIPAA, but I'm not 100% certain if he did nor not. This post is probably poorly written, but I'll try to answer any questions to clarify my situation.     Grandparent Rights- Ohio

    Hello!

    Issues with my MIL have come to a head and we are going no contact with her (as of now that is the plan). I won't get into the nitty gritty but she has mental issues (extreme paranoia about everyone including us, large part of why we're heavily considering cutting ties). She is functional.

    I have looked at all of the laws and want to make sure I am understanding Ohio law correctly.

    My husband and I have a 3.5 year old and a 15 month old. We have been married for 6.5 years.

    According to Ohio law a grandparent can only be granted visitation if:

    1- The parents are divorced. 2- One of the parents dies. 3- The child was conceived out of wedlock.

    Given that we do not meet these criteria we SHOULD have no concerns regarding grandparents rights if she decides to go that route, correct?

    Additional information that may be needed. We never lived with her. Never needed her for anything. She doesn't even babysit. Husband has a good job at a hospital, goes to school full time and is in the reserves while I am a stay at home mom. We own a home. We have moved a number of times due to the military but there are no more moves in the foreseeable future. We live 15 minutes from MIL.

    Any and all advice is welcome!

    My gf had the power go out in her room, and the landlord says she has to pay for it

    She rents a room in the house her landlord lives in. He does not allow her to use the kitchen or the heater, so she has a small refrigerator, hot plate, and space heater in her room. Today the power went out in her room only, so they checked the breakers and no problems there. Landlord said he will call electrician tomorrow, but she has to pay for it because she was misusing electricity. Isn't this something he should be paying for? If so, what can she legally do? She lives in California

    My former college has suddenly closed, now my employer says I no longer meet the job requirements

    Myself, my former college, and my employer are all in Maryland.

    I graduated from college in 2004, and began working shortly afterward. Until now, my only post-graduation job within that field has been with that same employer.

    At the time the college was independently owned, but since then it has changed hands multiple times. The latest owner lost their accreditation on Wednesday of last week, and as of Friday the college is shut down permanently. (Not sure if names or media links are allowed here, but the parent company is a nationwide chain based out of Birmingham Alabama.)

    My employer is now saying that because the college lost their accreditation, my degree is no longer valid, and I no longer meet the stated job requirements. I have been offered a demotion to a minimum wage warehouse position (a severe pay cut), and if I refuse that offer I will be fired.

    The invalid degree will prevent me from getting anywhere near a comparable position elsewhere, and the demotion and/or firing will be a major red flag on my work history even if I found an entry-level position.

    What are my options here? Are there any protections for this sort of situation, or should I accept that the past 15 years of my career are gone?

    Update: Thank you all for the advice, I am definitely fighting this and having a layer look over my employment contract. My primary concern was that refusing the demotion could be seen as quitting. I've now refused the demotion and cited the accreditation issue, and I'm being told that they'll have a clear answer for me by the end of the day.

    I don't want to make any definitive comments about finding a new job or seeking unemployment, since nothing on the internet is truly anonymous, but I will say that I am definitely keeping all my options open.

    Since there is some uncertainty regarding my contract, I was hired when the company was relatively new and desperate for workers, so I ended up with a completely open-ended contract.

    Employer requires carrying cell phone and answering it whenever it rings...

    I work in Tennessee, specifically Sumner county for a storage unit facility. I am still fairly new here but their instructions were quite clear, always carry this cell phone on you 24/7. Because I am the only employee that works at this site so when the office is closed, all the calls are forwarded to the company cell. Shouldn't I be getting paid like a nurse on call if I'm required to carry that phone and answer it 24/7 and if there's a problem at the location, they want me to physically go and clock in and fix it then clock out and go back home if after office hours.

    [TX] the owner of the coffee shop I work at is illegally keeping all the employees tips. What recourse do I have?

    This has been happening for atleast a year. It was brought to his attention that it is illegal to take any of the employees tips. He threatened to pay us a tipped wage if we didn't drop it. We don't qualify for a tipped wage so I know he can't do that. But I don't know what to do with out getting fired, having my hours cut a huge amount or getting a pay cut. At this point it is well over $1000 per person worth of tips he has taken.

    More info for people asking. We are payed more than minimum wage but a huge portion of our work is non tip generating. From my understanding of state law only 20% or less can be non tip generating. The cash tips are put in a communal bowl or given directly to the employee by a customer and then put into that bowl. The rest of the tips are all card tips.

    Neighbor called the cops on me twice, hours before the noise ordinance. Am I in the wrong?

    Been living at this house for a year in a suburb of Cleveland. It was in my girlfriends family since the 60's and this neighbor has been there the whole time her grandparents lived here so he's probably in his 80's. For being 80 he's in incredible shape so I see him frequently raking leaves and cleaning his gutters and what not. We have always been friendly and I've helped him out with little stuff like loading things in his car and bringing in garbage cans when it's windy. I see him at least once a week and he always seems joyed to see me and always offers his help with whatever he can.

    Now for at least the last six months my band has been practicing at my house no more than once a week, usually on Thursday. The noise ordinance isn't til 8:30 PM and we always wrap up before 8. This week we practiced yesterday, on Sunday, because I had to work late.

    We started at about 4:45 PM and at 5:30 he came to my back door and started pounding on the door. My friend opened the door and old man immediately started screaming and swearing (my friend is black). He's said some low key racist stuff to me before and my friend went back and forth to his car a few times which was in my driveway. I think he saw a black kid with a durag next to his house and just went psycho. My friends' natural reaction was tell him to promptly fuck off but I jumped in front and told them to stop. As soon as I get face to face with him I try to ease the situation and talk to him but he keeps walking away furiously. I keep saying I want to talk but he goes back inside. I know he's gonna call the cops so I stand outside and wait for them to show up.

    The cops show up and talk to him for maybe two minutes before making contact with me. The officer said that old man told him this has been going on for months and he can't take it anymore. I have talked to old man at least once a week for the last year and he has never said one thing about it. The officer then said that I'm not doing anything wrong and I can get back to what I'm doing and to try and settle with him later when he calms down. Made it very clear we have to be done by 8:30 PM and I told him we'd be done by 7. I go back inside and tell everybody to turn their amps down a little just to be sure.

    So now it's 6 PM and I see a flashlight on the window. Open the door and the cop is back. This time he said that it's causing too much of a problem and if I don't stop he's going to give me a citation. We shut it down but I'm not going to stop in the future if I'm not going to get in any legal trouble. Had he handle things differently I would have worked it out but he made a new enemy.

    Am I legally the wrong one here? If I'm not violating the noise ordinance then can the police actual stop me or cite me? If so what laws am I violating?

    On October 15th, I began working as a seasonal temp worker for a major shipping. Upon hiring, they inform you that working for this company qualifies you to be apart of the union, after you pay the union dues. I was told when I was hired that the union will be taking $30 out of my paycheck every week until the $500 fee was paid off. Then I would officially be apart of the union. Well this past week, countless workers at my warehouse received absolutely no paycheck. So I contacted the union representatives to see exactly why. They told me that they "don't know why they decided to, but they took all of the initiation fee at once". So apparently now I am officially a part of the union, but am out $300 and an entires week of work. Are they legally allowed to change how they take our dues without informing us? Is this a violation of minimum wage law?

    Neighbors threaten to tow my legally parked car

    I live in a residential neighborhood with single-family homes in San Jose, California. Every house owns several cars so it's normal for neighbors to park by the public curb. This morning, I came out to a note on my car saying to not park in front of their house on Mondays because they need to put their garbage bins in that spot for Tuesday garbage pick up. If I park there again, they will call a towing company to tow my car away. I am not blocking their driveway (there is enough space from where the driveway starts to my car) or anything. It is legal to park there and if I don't park there, someone else will because my neighborhood is extremely packed.

    I still have the handwritten note. Is it legal for them to tow my car even though it's legally parked? They constantly bother me and threaten to have my car towed.

    I've spoken to them countless times about the spot being legal for me (or anyone) to park but they refuse to listen. They've come to my front door several times to tell me or my parents to move a car that's parked by their curb until we tell them it is not ours. I've tried my best to emphasize that the space is legal but they continue to still bother me. I've asked them to stop coming over to my front door several times, yet they still do.

    Is there anything I can do legally to stop them from harassing me about the parking space and is it legal for them to tow away a car that's legally parked there?

    My wife is losing the battle to cancer what do i need to do to prepare on the legal side.

    My wife has been fighting cancer for six years. We have talked about her wishes but stupidly have always figured we would get to a will and other legal documents done later. The only one we have actually done is a living will for medical decisions.

    We were caught off guard this week as she went from 80% normal (how she's been while on treatment for a long time) to around 25% normal (sleeping 22 hours a day and only coherent for 5-10 min at a time.)

    What is the minimum legal stuff I can do with her during those 5 min blips that will be wise? Right now we are thinking she could pass on sometime in the next month but the tumor has started pinching off her heart so it could be any day.

    My work provides some kind of do it yourself will, is that good enough if she just establishes me as her sole beneficiary and I later meet with a lawyer for a full will? Is there something like a power of attorney that survives death long enough to get titles out if her name? I don't really remember what we put in her name alone (thinking it's just one car that we were planning on putting up for sale last month but haven't yet but it may be more.) I don't have time or energy now to figure out what needs to be transferred.

    If I'm in the wrong place please point to where this question might be asked. I'll get with a lawyer, I just don't know that I can before she goes.

    Would it help if she does a video and states her wishes? Main thing is she doesn't want the kids to go to certain family members if I die as well and they may fight.

    TL;DR wife is passing away and I want to do the minimum I can now to make dealing with legal stuff after she goes easier. What would that minimum be?

    If it helps I'm in Utah and we have 4 kids under 18, a home, some cars and joint savings. I don't think she has any financial accounts of her own (retirement etc).

    Officers says I won’t be charged just wants to question me

    Some one who I know may have damaged up to 400,000 in property and will probably be charged with criminal mischief. I was there but not in the vehicle that he used to damage the property. I did not advise him to do it or did not even talk to him about it before hand. After the fact I told him he should not have done it. The police have now contacted me and told me I will not be charged but they would like me to come in and make a statement. I have already sorta told them what happened over the phone. The officer I spoke with told me I did not have to make a statement but would help with the investigation if I did. Should I go to the station or not to speak to them? Are they just trying to bait me into incriminating myself? This is in Texas in case someone was wandering. Also there is video proof of the person damaging the property and me being nearby in another vehicle.

    Nightmare roommate

    Im in el paso texas. So I have a roommate/tenant that needs to go. She moved in back in september and signed a month to month lease agreement. 500 dollars rent and 500 dollar deposit. Since then it's been nothing but problems. She doesn't clean up after herself, she pretty much moved her boyfriend in, she doesn't respect the house or me, she uses the hot tub and does not re set the equipment so that if I dont check up on it, we will end up heating the pool for 4 hours a night. They are loud at night on weeknights, and eat my food and drink my beer and never replace any of it. Octobers rent was late, novebmers rent was late, and decembers rent has never been paid. All of this is in violation of the lease agreement.

    I have talked to her multiple times about all of these problems and offered solutions, but it's always some sort of excuse. A week into December, having not received rent, I told her I want her out by January 1st. I am currently pro rating the rent for December from her security deposit. Today is the 10th and she has made no effort to leave.

    My question is, at what point can I simply kick her out? Like put all her stuff outside and change the locks? The lease simply says that I have to give 7 days notice before terminating the month to month contract, but if she is continuing to violate the lease rules, can I kick her out early? Can I have a cop on site? I'm concerned at this point for my home and my things. I'm not always home, and she could totally screw me.

    HUGE layoff in CA at Fortune 500 company last week.

    Buckle up folks layoffs are coming. The company I worked for 6 years laid of approx 20% of its work force. The folks who live in Ca get paid til end of Feb with a signed NDA unsigned til mid Feb, Out of Ca folks cut off completely by Dec 31.

    Lot of us are still talking to each other and one question is the violation of the WARN act here in Ca and Federally. The WARN acts states that employees should be given notice of a MASS layoff and we were not. We were walked out like criminals.

    Just curious as to what our legal stance should be if any.
