Indian Health Service question. [Alaska USA]

    Posted: 08 Dec 2018 10:19 PM PST

Someone from /r/legaladvice suggested I might have better luck here so I thought I'd post here too.

In the past my employer has covered insurance at 100% and offered a stipend to people who turn down coverage.

It's looking like next year it's going to start costing money for me to keep my workplace insurance.

I am allowed to turn down coverage and take the stipend, but someone at my tribe was telling me that if you turn down alternate coverage you lose IHS Direct and Contract eligibility.

I was reading on it and it seems like IHS is talking about Medicaid and not private insurance, but does occasionally reference private insurance.

Do I have to pay for insurance to keep my IHS healthcare services?

    and

    https://www.ihs.gov/ihm/pc/part-2/p2c3/#2-3.8G

Was what I was reading, but I don't understand a lot of it.

Not at fault in car accident - other driver's car "self-insured"

    Posted: 08 Dec 2018 12:44 PM PST

I am located in Maryland. I was hit by an auxiliary police officer driving a police car (oh the irony) belonging to the University of Maryland. State police was called and I was given information on the driver, but it says that the car is insured by the college and the policy number field simply states "self-insured". I thought my insurance company would handle this, but it seems that because I do not have collision coverage (it's an old car), they told me that I would have to contact the other driver's insurance myself.

So what happens now? I'm not sure what being self-insured means. How does UMD determine how much to give me for repairs? Do I need to bring my car to a workshop for a quotation?

Any help is much appreciated, thank you!

Not at fault accident but no collision coverage

    Posted: 08 Dec 2018 10:44 PM PST

As the title stated I was just involved in a big accident and I do not have collision and comprehension coverage. I was reducing my insurance and sick of paying $500 a month under my own name for insurance. I haven't been in an accident in over four years and finally insurance was cheap again, I figured I would pay this year for just liability and of course 8 months later (today) I get into an accident that caused my car to be totaled. I drove a 2010 camaro and the entire thing is ruined and I'm lucky to be alive. I'm 100% certaint I will not be at fault in any way because I was driving straight and was hit by someone cutting across traffic to turn into a parking lot. If this is the case and I have zero fault but no collision insurance, will their insurance pay out my car if it's totaled? Do I need to prepare to go to court? I am obviously so far into my own thoughts but I am worried and unsure how this will play out. I also went to the hospital with my girlfriend with back and chest pain, the lady was transported in a neck brace but seemed ok. Any advice or thoughts will help. Thank you.

An uninsured motorist drove up the hood of my new 718 Cayman GTS - any tips?

    Posted: 08 Dec 2018 10:38 PM PST

Long story short, I just got a 2018 Cayman GTS in July. A home care aide taking care of my elderly grandfather left his house, climbed in a Chevy Trailblazer, and backed up the front of my Cayman parked in the driveway. Turns out the Trailblazer is her daughter's car, and the daughter doesn't have insurance.

    Photos: https://imgur.com/a/7A6u1O5

The insurance estimate came in today, just under $10,000. They are replacing the front bumper, front end panel and lamps, the hood, and front fender. (BTW: when did headlights become so complicated??) On the plus side, there does not seem to be any frame damage, and since it's a Cayman, the engine is thankfully behind the driver, and therefore undamaged.

My insurance is paying for the repair of course, but here are the things floating through my mind, would appreciate any guidance:

    • I wasn't at fault, obviously, as I was inside the house and the car was parked. It all happened on private property. Do my insurance rates go up?
      • If I change insurance companies in the future, do I have to report that I was involved in an accident?
    • Now the car will likely have an accident reported on Carfax. In addition to having to pay my insurance deductible, I'm being told that I will have trouble getting proper value for the car when I go to sell it because it's been reported as being in an accident. Is that likely?
      • I've heard you can hire a lawyer to pursue damages against the party at fault for loss of value due to this. Has anyone heard this, and/or done this?
      • I don't think I've got much chance of recouping anything here; the woman had already gotten rid of her own car because she couldn't afford to keep it, and I'm guessing that if the daughter hasn't paid her insurance bill, then the daughter likely doesn't have any money to pursue either.
    • What else aren't I thinking about?

Thanks for any tips and guidance. (I appreciate sympathy posts, but I'm trying to get past the anger stage and focus on what I can actually control...)

When to cancel insurance after trading in car?

    Posted: 08 Dec 2018 06:10 PM PST

As the title say, I just traded in my old car for a new one. I traded it into a dealership. Can I cancel the insurance on the old car right away? Or do I need to wait until they file all the paperwork with the DMV?

    Insurance claim denied [NJ]

    Posted: 08 Dec 2018 06:36 AM PST

I was in a parking lot coming down one of the aisles to find a parking spot. A guy is coming up the other aisle and cuts between cars into my aisle and hits me in the rear passenger door.

The guy was a veteran of war and had USAA insurance, so I stupidly didn't contact the police. He admitted fault, he held up his license for me to take a picture, his insurance and registration also. Also pictures of his license plate, damage to my car, none to his.

I told my insurance company about it and contacted his.

They sent me to get a repair estimate.. $2115.

They said they tried to contact their driver and got no answer. I got different answers from everyone I spoke to. First they said they received the repair estimate and to wait XX days, then they said they didn't receive it, then they received it and based on the pictures provided they might approve my claim because they couldn't get in contact with their driver, then one lady says a check would be mailed in 7-14 days, then they said no check was ever mailed and they were still reviewing my claim, then they finally sent my claim.

Whole thing took like 2 months.

Do you think their is anything else I can do? Should I get on my insurance company about contacting them again? I mean what am I paying insurance for if I have to do all the leg work.

Denied material coverage, insurance asks to submit maternity-related documents to the prior carrier

    Posted: 08 Dec 2018 07:18 PM PST

I just found out that my wife's insurance claims have been rejected from the very beginning of the term. We were visiting OB for her pregnancy since this September. She got pregnant in April and after that, we were abroad. Not being an expert of the healthcare system in the US, I never knew this was the case until we received a bill today tantamount to my paycheck. Having this bill on Saturday made me unable to reach anyone who can help too, which is a bummer. I had repeatedly asked the customer representatives if her pregnancy is covered and they assured me that it is each time. I have no idea why this is the case now.

My wife is eight months pregnant right now and we should have our baby in three weeks. The document simply states that I should submit the maternity-related documents to the previous carrier. But she did not have any coverage the last year and she became insured after she is pregnant.

Any input on what lies ahead for us will help. Thank you.

Home Fire Claim Help: Am I doing this right?

    Posted: 08 Dec 2018 02:37 PM PST

I own a duplex. I live in the upper and my rent out the lower. This week the upper caught fire. The 'structure' guy that the insurance person sent says he wants to gut the entire upper. My upper is about 700sq ft. 1 bed, 1 bath. No fire damage to the bath or bedroom, just tons of smoke damage. I am in the process of finding a couple contractors to get quotes from and AAA (insurance company) has put us in a hotel.

Impulsively, I let CRDN take all the textiles and electronics for cleaning yesterday. The public adjuster I spoke with says this was not a good move and that I should have them simply store things until he can look at them. Looking at the seeming incomplete contents list they left me with, I agree. (By incomplete, I mean I know I own 3-4 bathing suits, but none were on the list, so I don't really trust them.)

The public adjuster wants to charge me 10% to take care of the contents, including going to CRDN to look at the contents they have of mine. He thinks because of the smoke damage we should argue a total loss for all the items, especially since the contractor agrees the entire place should be gutted. He suggested getting an itemized quote list showing the cleaning costs. He says those numbers are likely to be crazy high and that will help us get AAA to let me write them as a loss. (Example if they are going to charge AAA $25 to clean 1 shirt, I should just ask AAA for $15 to replace the shirt instead). What do you think?

My goal from all of this is that I want the upper re-done well enough that I can can rent it out in the future. It doesn't have to be top of the line. The biggest concern to me is receiving as much of cash as possible from the personal property coverage as possible so I can decide what items I want to replace. We have Personal Property - C - $140,000. I know I won't get anywhere near the max. ($1,000 deductible, $1,200 advance sent so far) Again, what do you think?

Lastly, If the fire was Sunday, how long do you think it would be before the personal property check comes? Can someone help me understand the timeline?

chances home insurance will pay for these damaged items?

    Posted: 08 Dec 2018 05:02 PM PST

I had a basement flood last month due to a failed sump pump. Home insurance paid out 8k to the restoration company that did the cleanup. Carpet and furniture damage is estimated at $5500. Insurance paid out $1300 towards carpet and only $700 towards furniture due to depreciation (10 years old; hard to find set). No way I can replace a similar set for that low. They said for me to submit the receipts and they will investigate and let me know whether they will pay out the rest. Coincidentally furniture and carpet are very close to $5500. How likely will insurance pay out the $3500 difference to me?

Stolen car hit my legally parked car and did excess of 3k damages, illinois

    Posted: 08 Dec 2018 04:57 PM PST

As title states, a stolen car hit my legally parked car, did an excess of 3k damages, and fled the seen of the crime. The police eventually caught up with the owner and suspect and he was caught, but the owner is now claiming that the car was stolen and their insurance is claiming that they are not liable to the damages to my car, my liability only insurance is claiming they are not liable for the damages to the car. Now, this is when the situation gets complicated, the owner is/was dating the suspect and lied about the car being stolen, as i have video surveillance of him driving the car before the night he hit and ran on my car. What are my actually courses of action here? The cars ownet, that damaged my car, insurance is claiming i can only sue the guy that is looking at 3 different felony charges.

I didn't send photos of this damage to my neighbor's condo insurance... Should I? Should I have?

    Posted: 08 Dec 2018 09:17 AM PST

Long story short, upstairs neighbor leaked water through our ceiling and we are in the middle of a claim. I have two areas on my wood ceiling, about 5 feet apart, in the bathroom where there are water spots from water dripping through and moving the stain with it. These stains are both occurring around pipes from the upstairs bathroom.

One is definitely from the water damage that happened recently and sparked this claim- My boyfriend has photos of that ceiling wood when it was drenched with water. However, I am pretty sure the second one at least slightly existed prior, although I don't know if it existed when I bought the property a year ago (I am very much a perfectionist and usually notice something like that, but perhaps I am mistaken). When asked, my boyfriend stated that on that day he didn't notice that this second stain was wet in any way, so he took no photos and wasn't looking at that pipe.

The insurance of the guy upstairs asked us to submit photos and we submitted everything except that second stain. I was going back and forth on it and we decided not to because we didn't have photos of it wet and because we were worried they might think we are trying to scam them and we would get screwed on everything. They have now told us to go get quotes on repairs and send them to them. I have been doing that for more than a week now but haven't sent any yet.

My question is- Should I or should I not be submitting the dry photos of the other water stain? As stated, I only have photos of it dry and I'm really not sure any changes occurred to it due to the leak, I think it may have already been there. It's definitely obviously damage that occurred from their pipes, whether or not it occurred at this time is debatable though. Another reason we didn't send it was because my boyfriend was also slightly worried that the building engineer who came out to turn the water off and saw where the leak was, might be contacted and say there was nothing happening at the pipe around the stain with no wet photos.

I'd like to get some advice. The damage is definitely FROM them, it's just a matter of whether it happened this time or not and whether I should send a follow-up email with a "hey, we just realized we forgot these two photos!". I know nothing about dealing with insurance, and definitely even less on dealing with someone else's insurance so all adult advice is greatly appreciated, thank you.

I damaged a brand new rental car

    Posted: 08 Dec 2018 04:32 PM PST

I fucked up real bad and I'm freaking out. I want to my local Hyundai dealership to test drive a 2019 Hyundai Veloster Turbo Ultimate. It was great. At the end of the drive I the salesman, who was awesome, asked if I wanted to test drive it for 24 hours. I said yes and was given the keys. Then a few hours later I scraped a curb. I know I know I'm a fucking idiot but now I don't know that to do. I was going to try and fix it myself today but I've been very sick. I only left my bed to return the car right before they closed. They'll do the damage check on Monday and I don't know what to expect. I've tried to see how much a new wheel will be but the customer service hotline is closed. Could my insurance possibly pay for this?

Removing risky driver from policy, premium still goes up

    Posted: 08 Dec 2018 10:09 AM PST

I'm trying to comprehend auto insurance and their risk assessment.

My full coverage auto insurance premium was around $550 / 6 months for just myself and my new sporty car with higher than standard coverage limits. When I added my gf and her new car to the policy it went up to $1200 / 6 months for both of us (we are both in our young 20s). Seemed fair since it was way cheaper than anyone else.

Then the unfortunately happened and gf totaled her car. We are still waiting for the check but since the policy was about to renew we went ahead and removed gf's car and herself from the policy since we aren't using a rental and I'm doing all the driving in my car now (she's traumatized)

But now insurance company is quoting me $670 for just myself and my car. Gf's accident is the direct cause for my premium to go up but I'm questioning why is it? I wasn't involved in the accident and she was covered as a driver for her vehicle. It makes sense for her premium to sky rocket. But why am I affected by it?

Got into an accident last night and I have some questions regarding the insurance check.

    Posted: 08 Dec 2018 09:24 AM PST

So, basically, I was coming out of my neighborhood and had a solid green and a girl turned in front of me. I have a dash cam so I'm not even worried about that at all. Fault seems pretty clear cut.

Also, side note, they also appear to have active car insurance. Small victory considering every accident I've ever been in, all have either fled the scene or were uninsured. So... yay?🎉

The police filled out a form, but we have to go down to PMO (military police) to get an actual report written, which I'm going to do today.

My question/problem is that the title is in my step moms name. They leased the car and then bought it, and they ever went through the lien release process and also never paid the remaining taxes from when it switched from a lease to a purchase.

I bought the car from them in 2015 and paid them directly and it's been paid off for at least two years. I've been trying to get it in my name for a long time. They've just been too buzy/lazy. Well, recently my dad and step mom went through a nasty divorce. Thankfully I think we are in good terms but it still makes me nervous.

I read online that if their is a lien, the other party's insurance may write the check to the lien holder and/or the "owner" . I can't find anything about if the person who technically owns it (me) is not on the title. Is it written to the lien holder and name on the title, or lien holder and person who filer the claim?

What can I expect as far as the insurance check? I am going to call my stepmom today, and call Toyota directly and see if I can pay for a lien release to be sent directly to me. I know they can't give me an info but... Fml basically.

[ON, CAN] What to do with written off vehicle?

    Posted: 08 Dec 2018 08:55 AM PST

Hi all, my Mercedes (value approx $15k) was hit and now deemed to be a total loss. The claims rep is asking to move the vehicle from the tow yard where it is incurring storage fees. Should I have it moved to my property, or allow the insurance company to take control of it?

I haven't been made an offer yet, but a local body shop which I trust said they could fix it so I'm wondering whether I should keep the vehicle afterwards to repair, salvage or let insurance have it?

Is there a general rule for this, or is it dependant on the variables of each situation?

    Diminished Car Value

    Posted: 08 Dec 2018 10:29 AM PST

    Dear Redditors,

My wife was recently in an accident where the other part was determined to be at fault. Is it worth seeking the diminished car value? The vehicle is a 2017 Ford Edge Titanium which Kelly Blue Book lists a value of $23,100.00. The total to repair the vehicle was $11,000.00.

    Any advice would be appreciated.

    Thank you!

Car insurance is screwing me over!

    Posted: 08 Dec 2018 08:06 AM PST

    Hi guys,

I need advice. I got a Mirage 2018 (brand new) from a Mitsubishi dealership on November 5th, 2018. 86 months at 0% financing. Altogether, it was $23k. I registered my car with SAAQ (Quebec) on November 11th, 2018. On November 19th, I got into a collision and my car was considered a write-off. I lost my car literally 2 weeks after I financed it. Now when I made the claim, they said I had "value at brand new" with my car insurance. Perfect, that means I would only have to pay my $1000 deductible, or so I thought. Now after almost a month, they finally get back to me and say "We can give you a settlement of $14k+tax because that's how much your car is worth brand new right now." I look it up online and yes, the Mirage 2018 has been heavily discounted so they can get rid of them for the 2019 models. However, when I first made the claim, my car was still valued at $23k (with tax)! I told him there's no way I'm accepting this, and he said he will get back to me after her checks the dates and stuff on the purchase. (Because he admitted that he hasn't done so.) So I call the Mitsubishi financing and they said to keep bugging your insurance for more money, but if they can't go higher, once I get the payment, I'll only have 30 days to pay the remaining $7000 or else it goes into collections and my perfect credit suffers.

I'm at a loss of what to do. I don't want to file for bankruptcy over this. I think my car insurance (Intact insurance) are fucking me over.

What do I do? Call a lawyer?

    Hit a pole

    Posted: 08 Dec 2018 08:03 AM PST

I live in the US, FL. So I was turning into work and side swiped a pole. This happened yesterday. I wanted to get an estimate first and I have not contacted my insurance company yet. Since this would be my fault and there is damaged done to my car. I have an estimate close to 1600 but my collision is only 500. This has never happened to me before and I have been accident and violation free for the last 3 years. Generally, I'm a good driver. I know its case by case and usually depends on your insurance. Its only 7 years old. I can still drive my car and my door still shuts. I just really don't know what to do at this point. Besides cry.

Working on A Total Loss Claim: Any Adjusters Here

    Posted: 08 Dec 2018 05:39 AM PST

Working with a claims adjuster on my claim and had a couple of concerns. (Theyre calculating the value of my car using comparables)

    1) For all comparables, theyre knocking 6% off the list price as a "typical negotation adjustment" is this reasonable? Is it negotiable? When I was shopping for a replacement, A lot of the dealers in this area for used cars are typically not willing to budge that much, and if they are, theyre adding additional nonsense fees like "inspection fee" or "marketing" to bump the price back up.

    2) one of the comparables has a decent pre-adjustment value, but they are making negative adjustments because of the cars additional features. Problem is that comparable CANNOT have those features without jumping a trim. After these adjustments this becomes the lowest comparable. They refuse to drop this comparable, arguing that if the listing had it, the car must have it.

    3) My car is a 2014 mazda 3 hatch and they are using a sedan comparable as well. I paid $1500 more for the hatch, I get the 1500 value wont retain, but shouldnt there be a positive adjustment at least?
