The driver who hit me, her insurance doesn't want to "accept liability" for the accident and refuses to pay even tho I was rear ended. I have over 5K in damage to my car. The car that hit me has well over 10K in damage due to them traveling at a high rate of speed. Her story differs from mine, according to the adjuster. I do not have collision insurance, only liability. My insurance is covering the person I hit and them only. What do I do? Posted: 26 Dec 2018 10:24 PM PST So I Drive a 2016 Corolla LE and my sister went out to practice with it with my dad and the other driver failed to yield and wrecked the front passenger side of the car. Now some weeks go by, and my insurance is saying it is a total loss my car is worth i'd say $10,000-$11,000 right now and the repairs ended up going to around $8,500, [WHICH THAT MEANS ITS A TOTAL LOSS :'( ] Now here's the thing the car is a leased car, so i'm still making payments on it I've payed about $9,000 of it and still have $13,000 dollars left in payments if my insurance company pay's the value of the car which is around $10,000-$11,000 I'd still have to pay $2,000-$3,000 out of my pocket correct? I'm relativity a new driver been driving since the begging of 2016 when i got the car so i'm not that intelligible on how insurance works. Do I get any money to go for a used car relatively a car that was like the one i was driving or am i stuck with paying off the rest of the car and left with no car at all which would really suck that i have to deal with all this since i wasn't the one in the accident even though it is my car. :/ ( my policy includes Collision and Comprehensive and i'm not quite sure if i Have gap coverage or not) [link] [comments] |
Posted: 27 Dec 2018 04:03 AM PST I spent Xmas in the ER with a case of the flu, getting pumped full of IV fluids and antivirals. The next day, I have a message on my phone telling me that if I pay my $2700 bill before the end of the year, they'll take 20% off. I almost ignore the message, but then start to get angry. I call them up and ask WTH? I've met my out of pocket maximum for the year. They said they hadn't checked, just saw my name on the list of patients and that if I had paid it, they would have had to refund it. I said that could take months. All of this at a time of year when money is tight for many people. I got to thinking about that: how many people, especially elderly people, would empty out their bank accounts, in order to pay the bill, all to avoid an even larger bill, when they absolutely didn't have to, because they weren't on top of their health insurance billing status? I pointed that out to the billing department person, and said, "that's wrong. It's just wrong"...and they said, "yes, you're right." Jesus H.... I'm positive this is SOP for this hospital. And I haven't had anything similar happen at other hospitals. Here are some legal issues that spring to mind: -they are billing (by demanding payment) for money that the patient does not owe them. -they will not likely reimburse costs associated with the unnecessary payment (interest on loans, early withdrawal penalties from savings, etc.). -double billing and collecting the interest. Home insurance roof replacement—best chances? Posted: 26 Dec 2018 11:07 PM PST Hi, Earlier this May I noticed a small water stain at the edge of a very high ceiling in my parents living room (exterior wall, next to chimney). I called a roofer out and he fixed a couple things like slipped shingles and some bad decking, as well did some maintenance on the gutter. At the same time, we also walked around the house and found no other water stains. This was early June that he finished the work (reputable, highly rated larger local company). Fast forward, a few weeks ago I noticed that the water stain had gotten significantly larger, and also that I can now hear a dripping between the walls where the stain is during very rainy days. I've also noticed water stains on the wall below the original stain, as if it had dripped down into the wall. Originally, I thought he just did a bad job, but we have had some really nasty storms over the summer (Julyish) in Atlanta here that had small one inchish hail, and I've also found THREE other water stains in completely separate parts of the house (two upstairs rooms and on the opposite side of the original stain, all the way across the hall in another high ceiling). So in total, four visible leaks in completely different spots in the roof. I can not locate the water leak in the attic at all. I'm having the roofing guy come back out in early early January to check what's going on. My question is, should I be thinking about insurance replacing the roof? It's 12 years old on a new construction. If so, what's the best way to approach this; should I say that we had the roofer come out for the original water stain and now that stain is larger? I'm afraid they'll say that the problem already existed and deny it—I legitimately think the roofer did an ok job fixing it, but it has been damaged afterwards. At the same time, the roofer also said the roof was in ok shape otherwise when he came. But I'm wondering if it actually helps our case if I say that the roofer inspected it back in May and there were no water stains back then. I'm not suggesting fraud or anything—I just don't want to give them extra reasons to deny a claim if it comes to that. Thank you for your time. Please help me navigate this, I'm trying to help with my parents home as best I can buy we cannot afford it if the whole roof needs to be replaced out of pocket. But I'm not sure if that info is up-to-date. Even if BCBS considers is non-coverable, maybe there could be some weird workaround to have it covered anyway? Help appreciated. They wanted to offer me some cash so I wouldn't make an insurance claim. I said no, and I made a claim anyways. I took my car to the insurance recommended collision center for an estimate and got a estimate for about $1400 to repair the car. Its just scratches and a little denting. How does this work if I don't want to repair the car? Can I just get a check and do whatever I want with it? Or use it to fix it myself? I passed a car on the middle lane that was driving slower than me, then I let my foot off the gas pedal because I had to make a left turn at the next intersection. About 2-3 seconds later, the car in the middle lane scraped/grazed my car. The shock did not seem too bad but my rear fender and the right rear passenger's side was scratched up. The other party suffered minor scratches on the driver's door but his damage is not as severe as mine. What would the outcome be in this scenario? Benefits of Switching from Captive Insurance Co. to Independent Agent Posted: 26 Dec 2018 10:09 PM PST My car was hit by an uninsured motorist (UM), and fortunately, I have UM insurance. Have a vehicle that is considered fairly high end My insurance co. is State Farm (SF), and the adjuster has bickered with the body shop over every little thing. My car has been at the shop for more than two weeks with no work being done due to the adjuster not agreeing with the work recommended. The work that should be done (replacement of a bumper due to sensors in/near the damaged areas) is not allowed by SF even though the difference in total cost between replacement vs sand and repair is $175. SF told the body shop to do the sand and repair and if the sensors did not work correctly that they would THEN authorize the replacement. In addition SF would cover only the rental of a car that is not even close to the same level as what I usually drive. (First world problem, I know) All the drama from SF has me thinking I should probably switch to a company like Chubb. Is that something I could regret? If I do make the switch will the premiums for combined home/auto be significantly higher? Should I contact an independent agent and ask for Chubb or let them make a recommendation? Posted: 26 Dec 2018 06:50 AM PST I drive a 2011 Crown Victoria and pay a $1100 6 mo premium for liability only coverage with an admittedly bad history of speeding and tickets. I am looking at getting back into a corvette and my insurance estimated it would lower my premium by over $300. I can understand how the car would influence your rates if you carried collision and comprehensive, but for liability only, why would my rate significantly drop in a car that I would imagine would be seen as more of a liability compared to a crown victoria? Do insurers base rates off of overall statistics for vehicles rather than individual risk? i.e. crown victorias are involved in x% more accidents than corvettes? I live in a city and the car keeps getting minor and not-so-minor body damage (major scrapes, bumper, side mirror damage) just from being parked on the street (I don't have a garage). It has low mileage (115k) and was cared for meticulously and garage kept by a close friend, the original owner, for the entire life of car until I bought it, 2 years ago. I'm considering getting comprehensive insurance - so if I get seriously hit while parked on the street, or get other damage (like tree branches falling on windshields, which happened near me) -- I can afford to repair the car. I'm on a tight budget and can't afford major body repairs in addition to other normal repairs. I plan to keep the car for a long time and its appearance is getting worse with time. BUT -- I've heard that because it's older, if it gets any serious damage, the insurance company may just deem it totaled.
The car is worth much more to ME than the Blue Book value, since I really can't get another car in such good shape whose history I know, for the Blue Book value. Need to renew Liability or get new insurance by end of January. (I don't drive a LOT, so the lower cost pay-by-the-mile insurances may be an option, if deductibles aren't too high... not sure). Got a call during work saying the adjuster looked at it and deemed it totaled. Talked to him on my lunch break and got the amount. $7100 after deductible ($3900 left on payments). After work went to the autobody shop and talked to the owner who was interested in buying my car. So I can either get a check from the company or buy it back. I don't really understand most of this. My dad said he was going straight and the other driver swerved into his lane (improper change lanes) and damaged the side of his car. Some of the black paint got into his car as well. The driver drove a newish rental car and provided his own insurance. My dad only has liability while the other side has both collision and liability. Anyways my dad spoke to our insurance and the other side and the driver's insurance said both side of the stories are different and no witnesses so they're not going to do anything about it. My dad doesn't wanna go through small court claims so he dropped the case. Now the other driver is insisting that my dad pays for the damages of the rental car and send him an estimate of 1.2k. So what can my dad do at this point? Does he have to pay? Can our insurance do anything? There were no witnesses and the driver's insurance already send a denial letter. [link] [comments] |

Their car had a few scratches and bends, and a broken door handle I think. My car came out worse with a broken fender, and a bent tire. Our lifestyle is such that we don't have many big ticket items between us and in any event we would consider most household items under the HO umbrella. Posted: 26 Dec 2018 10:51 AM PST I recently was involved in a minor car accident and I was found 40% responsible for the accident. I don't feel that this decision makes any sense. A diagram of the accident is here. I am unit 2. I believe that because I was already on the right of way and turned into my own lane, while the other guy was leaving a private business parking lot and turned illegally into my lane, that he should be found completely at fault. Further, the police report added that Unit 1's "Driver inattention" was a contributing factor and listed nothing of the sort for me. The insurance company told me that because I have a yield sign that I should have yielded to him. I don't believe that the yield sign is to yield to traffic leaving a parking lot. That makes no sense. The yield sign applies to waiting for cross traffic going westbound not not vehicles exiting the parking lot. Further, even if it did apply, he made an illegal turn into my lane of traffic. Lastly, don't vehicles exiting a parking lot have the requirement to wait for the public road to be clear of all traffic before entering the right of way? Some background: we both have the same insurance company. I'm wondering if they agreed to share fault because it means each of us have to pay a partial deductible and the insurance company saves $500, plus they can jack up both of our premiums. Breast cancer screening for dense breasts - 2nd screening not covered under insurance Posted: 26 Dec 2018 12:56 PM PST Hi, I had my first ever mammogram this year and was told my technician while getting it done that due to my dense breasts I would likely be asked to return as their machinery wouldn't be able to get a good look. As she predicted, i was asked back a couple of days later and told to prepare for a mammogram... i questioned this and asked if I could forgoe it as the technician had already told me I was not a canditate for the mammogram and asked if I could just get the ultrasound. They said I had to get another mammogram but immediatly after told me I should get an ultrasound. I was given the all clear but 7 months later I have recieved a bill for $1200 for the services recieved the second day. I checked EOB and my insurance paid 2/3 the amount for the services on 2nd day. As this was all part of the process for a screening and nothing was ever found, am I really liable for $1200 -- it seems really unfair. Parked car damaged in a hit and run Posted: 26 Dec 2018 10:24 AM PST TL;DR bad lady hit my moms car which caused moms car to hit my car. Me stupid and have no insurance. Sorry if this isn't the right place, but I'm seeking advice on what I need to do next. The vehicle I own is currently inoperable, and I don't have the money to get it checked out by a mechanic and is sitting in my apartment parking lot. I'm still making payments on it. I had insurance on it but canceled the policy in my name in September because my mom was going to help me out by having her husband (Step-Dad) add me to their policy to save me some money. Well my mother and I found out right before this accident that Step-dad apparently forgot to pay the bill causing the insurance to lapse and therefore couldn't add me until he got the insurance reinstated. Unfortunately, due to the craziness of the holidays I still wasn't added even after they got back up with their insurance. Fast forward to this passed Sunday in the early hours of the morning, a woman left the apartment she was partying at after an argument she had with the residence of said apartment, got into the car she was borrowing from her girlfriend, backed out of the space and rammed right into my parents parked mini-van. She hit the van right at the back wheel. We didn't really have anything in the back of the van so it was pretty light so the force of the hit caused the van to swing right into my parked inoperable car, and even moved it a few feet over and straightened the tires out. (Not that this matters, but when the tow truck dropped my car off they backed it in and it was angled to the left with the front of my car almost touching the left line. Now its completely centered in the parking space. My step-dad had turned the tires all the way to the right to test something once , and now those too are lined up straight with the car.) We know all of this happened because my neighbor that was hosting the woman came over later in the morning and told us the whole story. Apparently the woman was trying to sober up at his place and they got into a fight or something and he asked her to leave. He followed her out and watched her trash his motorcycle, then get into her borrowed car and slam into our vehicle. He gave statement for our police report, and we're waiting until we can go pick it up. My question is, what do I need to do since I don't have auto insurance through all of this? I only have GAP insurance right now for the vehicle. Do I need to go out and get an damage appraiser to my car? My parents have already filed the claim and reported that my car was struck by theirs in the accident, and like I said, we're waiting for the police report. We are currently 2 adults, 1 baby, and 1 more coming early 2019 with 1 house, 1 car - house & car insurance, with an umbrella to top it off. And we live in the Bay area, California. Do I just call up random companies and see what they can offer or use their websites? Posted: 26 Dec 2018 09:23 AM PST Hi everyone, I'm in a real crummy situation and I was hoping to get some advice from you kind redditors: A while back I needed to rent a car and the only affordable option was a pick-up truck, so I went for it. Also I declined the insurance thinking I was covered through the insurance on my credit card. Well, I was driving in a parking garage, and being not used to the turning radius I grazed a poll - this didn't cause just a scratch mind you, but a fairly deep dent/gash on the door (there must have been some sort of bolt on the pole that was jutting out, didn't penetrate through though). This has never happened to me before and I was flipping out, but I eventually found solice in the fact I was covered by my credit card (VISA) - I was wrong. I'm new to this particular credit card, and it wasn't until I started submitting the paper work for the claim that they informed me that pick-up trucks were NOT covered. Now I have a bill from the rental company for thousands of dollars that I can't afford (it's a lot more than you would expect) that I am expected to pay out of pocket. I don't own a car so I don't have any other car insurance; I still started the claim process with my credit card company, but they will likely reject it. I haven't spoken to the rental company yet, I wanted to ask around first. Does anyone have any ideas or advice on how I can find my way out of this nightmare? How should I approach this with rental or my credit card claim dept? Someone at a body shop told me that some rental companies may agree to have you pay the insurance deductible (on their property insurance I presume?) which I would gladly pay assuming it's a grand or two.
