I wanted to give you an update since so many people gave advice and said such kind things. I'm sorry I didn't respond on the other post, I was just so completely overwhelmed, I still am really, but I did read every comment and message and I appreciate everyone that took the time to comment. I was able to find some legal help and we are working on sorting out the mess my family is in. Things were far worse than I even knew when I made my first post. All together, the debt that was accumulated is close to half a million dollars. At this point I have no idea how much I am going to end up responsible for. The lawyer has said it could take years to sort everything out. No matter what happens, we are going to be losing the house. I am working on finding us somewhere to stay before they actually foreclose so we don't get evicted and have that on my record too. I want to try to answer some of the questions and advice people mentioned in the other post. I have 3 kids, so that is the we that I keep saying. The older two are from a previous relationship but I have contacted social security to get benefits started for my youngest. Thank you to the user who mentioned that. My husband's business was a computer/tech repair company he ran by himself. He had a few people he would call in to help with larger jobs but 95% of everything was him alone. The last year or so it appears he wasn't doing any actual work and there was no money coming in. He took money from the business to cover what he took from our personal accounts and then took out loans to cover the business and pissed it all away on gambling and other illegal activities that have come to light over the past few weeks. Sorry to be vague, it's just embarrassing and hard to talk about. To the people who said that maybe the crash was intentional, it is looking increasingly likely that it was. Nobody else was involved, his car went off the road and hit a tree. He had life insurance before, but he stopped paying the policy months ago. I am in contact with the police about the credit cards in our names and the other things that were discovered. All in all, things are looking really bleak at the moment but I have faith that eventually it will work out. I have a few leads on jobs and have picked up a little temp work here and there the last few weeks so that we have something coming in. I have signed up for food stamps and Medicaid so once that goes through it will be a bit help. I applied for AMHA as well but they said the waitlist can be a few years wait so that is a kind of longshot. Someone has suggested asking family/friends for help or loans and they absolutely would help me if they could but none of them are in a financial position to be able to help. My sister will hopefully be able to let us stay with her temporarily until I can sort things out and get us back together. She is my only living family and has been my rock through all this. So yeah, I guess that's it. Thank you all again for listening and helping. I was driving near my friend's house, when I remembered I had something in the car I had been meaning to give her, so I stopped at the house. A strange woman answered, and I asked if Sarah was home. The woman said she was Sarah. I thought maybe it was just a coincidence, so I said I meant "Sarah Jones, the Sarah who lives here." The woman claimed she was Sarah Jones and that it was her house. My friend's real last name is uncommon, there's no way this woman happened to have the same name, and my friends definitely didn't get a roommate and not mention it. I told her that I knew she wasn't Sarah and asked again where Sarah was but the woman still insisted she was Sarah. I thought maybe Sarah's husband and son were there so I started calling their names, and the woman told me to leave or she'd get her husband. Obviously I was pretty freaked out and I left because I thought the woman or the "husband" could be dangerous. I called Sarah and her husband but they didn't answer. I didn't know what else to do, and it sounded crazy but I thought the people in the house might be robbers or maybe had my friends imprisoned in the house, so I called the cops. It turned out my friends were okay. The woman turned out to be a substitute for their regular house cleaner. The cleaner thought I was delivering a package for ups and decided it would be fine to just say she was Sarah so she could bring in the package. She said she got scared when I insisted that she wasn't Sarah and for some reason decided that I was some creepy stalker (because there's no way they could have friends who recognize them) so she made up the husband to get rid of me. To say my friends are pissed at the cleaner is an understatement. They called the agency she works for and told them not to send her back to their house. Obviously I'm glad my friends are okay, but what I'm questioning is the cops response. One of the cops lectured me that 911 was for emergencies only and that misuse of 911 could result in fines and jail. But he said that he would let it go just this once. Is it true that I could have been charged with misuse of 911? I know if you call for something obviously stupid or just make up lies that's one thing, but can you really get in trouble for misuse of 911 just because you happened to be wrong about the emergency? (California) Decade long legal case...Is this normal? How can I switch lawyers? Posted: 10 Nov 2018 12:00 PM PST (Location: California) I was injured at work 10 years ago. (I was 25, working for a window cleaning company that did not follow OSHA standards. I fell while working because I was following negligent training. I had dozens of fractures and a traumatic brain injury. I was put in a coma for several weeks while surgeries were performed as possible. I will never fully recover from some of the injuries, including those to my arms and legs, and persistent effects from TBI. I am permanently disabled. My employer didn't have worker's comp insurance.) The case with California's Uninsured Employer Benefit Trust Fund (UEBTF) to get some workers comp benefits has been open for a decade. A decade of not being able to do what I used to, being in pain every day, and experiencing the financial hardships of being unable to work and eventually able to work in limited fashion. Every time there's movement in the case, it seems like my file with the UEBTF gets passed to a different case worker who starts the whole process over, or the adjuster will go out of town for weeks, or they'll need to run one last physical test (which is always scheduled months ahead, requiring out-of-state travel on my end). My lawyer seems to accept these delays without question. In the past, my lawyer has gone silent for months or years at a time, even after I reach out for an update. After 10 years, I've finally received an offer letter for a settlement from the UEBTF, and I've signed and returned it. That was three months ago and the UEBTF has gone all but silent. I reach out to my lawyer every two weeks. He then contacts the case worker at the UEBTF and forwards me the response. The reply is never more descriptive than: "I'm waiting on my adjuster." Or, "Still waiting." Then I repeat the process. Most recently, after sending him three emails, my lawyer's office sent "We have reached out to the UEBTF and haven't heard anything. We'll let you know when we hear back." I've asked the lawyer for a copy of my case file and I have not received it, though asking the question seemed to result in the lawyer being more active in moving the case forward. I have asked my lawyer many times if there's a legal way to pressure the UEBTF into expediting the case, and have received no reply. My questions: This isn't normal, right? This case, following a procedure intended by the State of California to provide immediate assistance to injured workers affected by law-breaking employers, is 10 years old. However, if I switch to a new lawyer, will I still have to pay the current lawyer who has been attached to the case for ten years? I am absolutely happy to pay legal fees, but the settlement will be small enough that paying two lawyers (when one of them was not competent) is ludicrous. Is it possible to drop this lawyer without also having to pay him? Also, how do I go about switching lawyers when the case is all but complete? After he recovered he obtained a lawyer and legally took the house back but he signed it in good health over to just me. So the houses deed is in my name and he did this willfully of sound mind. I now take care of him and live with him in this house. His cop friends are convincing him to sue me for this house. Recently, I branched out to other social media platforms. To my surprise, it has had some modest success. I was notified by a follower that a YouTube channel has several videos exclusively of my comic and has been monetizing off it. One video has over 1 million views and while at first I was flattered, it's sinking in that the poster is making money off me. I should note that in the video description the person does link to my instagram account. I am aware of YouTube's copy right claim but honestly when I started this, I didn't think I'd experience this kind of success. I never gave thought of formally having it copyrighted or the process in general. Did I fuck myself over? Is there some kind of legal registry I need to submit my work to? Posted: 10 Nov 2018 08:42 AM PST Hello everyone; I'm an amateur film maker in Illinois looking to make a short horror film revolving around a creature living in a cursed T.V. channel. Upon further research, I am now confused as to whether or not I can get in legal trouble for having a product without paying royalties. My plan for the shoot was to get an old T.V. from a thrift store and edit in post flickering white noise onto the screen, taping over any possible corporate logos with black duct tape. There is also a short scene involving a character looking at their phone. For that, I was hoping to, again, purchase an older phone at a thrift store and work with the exterior casing to make it look a little more modern. Will this avoid any troubles? I have been living in Mexico over the last year but when I searched for my roommates, I told each one of them specifically that I was looking for roommates and that I still lived there. Over they past few months one of the roommates has been building an unjust resentment toward me over plumbing but that was resolved and the fault of the plumber (who even took the blame but still the roommate blames me) Well she has been spreading her resentment with the other roommates and When I told them I wanted to come home they told me that since they paid that they felt like I shouldn't have access to the house. Im really upset about this because I've not done anything wrong and I'm only coming home to stay and my room and chill and do a bit of housework. Last week my wife and I went to a popular local shelter in Columbus GA to find a dog to adopt due to us moving into a new house We saw a 11 week old puppy in her kennel (who was covered in her own feces) with the paperwork stating her name, age, and breed. We felt bad for the puppy and she seemed like a good dog so we decided to play with her. After about an hour of playing with her we decided that she was a good fit and we told the staff of the shelter that we'd like to adopt her. I filled out adoption application paperwork which asked questions pertaining our lifestyle, activity level, and past history of owning dogs. During the time I was filling out the application, I was talking with the staff and the topic of pitbulls came up. They said that they don't label them on the paperwork as Pitbulls, but rather label them as American Bulldogs so they're more appealing to potential adoptees. I'm Active Duty Army and live on base therefore there restrictions on the breeds we can have on base; pitbulls are banned. After they scanned my ID's, they approved my application and I paid the $95 adoption fee. After having the puppy for a week we've obviously became quite attached to her, given her a name, and started training basic obedience. This has turned into a huge problem because the paperwork that I signed at the shelter had the puppy listed as a "lab mix". They stated that the mother of the dog gave birth in the shelter so they know the exact age of the puppies as well as the breed of the mother. They told my wife and I that the puppy's mother was a Labrador Retriever (its on the adoption papers too) but that they don't know what breed the father was due to her arriving at the shelter already pregnant. We found out that this was a lie because the local veterinarian office said that the mother of the puppy used to be a patient at their clinic and was without a doubt "a full pitbull". The Vet clinic staff couldn't show us the mothers paperwork due to HIPAA (or whatever the animal equivalent is) but they said that while they knew the mother personally and knew it was a pitbull, the paperwork showed the mother labeled as a Bulldog. The problem is that I have to register the dog on base and since pitbulls are a restricted breed, I cannot have the dog on base. I don't discriminate against any breed of dogs and I believe that it's the owner who makes the dog. I understand that pitbulls are powerful dogs and can really hurt somebody or another dog if they felt uncomfortable/threatened, so I get why they're a restricted breed. I just want to be able to take my dog to the dog park without fear of getting in trouble because of it's breed. I plan on paying for board and train/obedience classes when I go on leave in December. I really don't want to get rid of my dog because I was lied to by the shelter. Is it possible if I'm forced to return the dog, which I don't want to, but I'd rather keep my house than my dog, am I entitled to a refund (I really don't want to return the dog to the shelter. I like her a lot, and returning her would be my last option)? How can I go about making sure this doesn't happen to somebody else looking to adopt from that shelter (somebody said I should go to the news network to see if they'd make a article about the problem with that shelter)? Should I just go with what's on the paperwork, and play dumb? Which was naive. He said this guy only needs $40 because his debit card doesn't work. The guy gave me $40 cash. I didn't sign anything, but my card got put on his contract, which he signed. They charged us $45 to apply, but it seemed like we'd get it, we both work full time and make plenty enough money for rent, and don't have anything bad on our background or what have you. Then we get a call back, and the person on the phone tells him that we cannot rent the apartment as 2 people cannot live in a 1 bedroom apartment, and they do not have any 2-bedroom apartments available to us. As is, I thought it was odd, but was just disappointed we can't get out apartment/lost $45, and moved on. He and a Co-worker talked about it though, and they think it might be discrimination, as 1 person to a bedroom has never been a rule we had heard of and know of plenty of straight couples who are able to share a bedroom. Just wondering if people here think this might be a discrimination case and if there'd be any grounds to go off of. We live in the U.S, in TN, if it matters. However, I am providing for my family (parents bankrupt) so I know I'd better quit after finding a job. But i just feel so sick of it and I know I will suffer every second if I still work there. The property owner rents out this house as two separate units - the basement where my roommate and I live, and the 1st and 2nd floors where this tenant lives with some others. There is one parking spot in the driveway at the side of the house. I confirmed with the landlord that it is my spot. One of the upstairs tenants crashed his car a few weeks ago. He limped it home and parked on the street. The city told him he can't keep it on the street, so he backed it up into my spot when I wasn't home. It has a flat tire and the bumper is falling off, in addition to lots of minor body damage. It's been sitting there for weeks. I spoke with the property owner, who spoke with him and told him it's not his spot. The tenant then spoke with me over the phone, giving me a sob story about how he's a student, he's strapped for money, he had a death in the family recently, he lost his job a while ago and is just starting a new one now, and if I would be so kind as to let him keep his car there until he can afford to get it fixed. I was fine with it for a week or two if he was getting the money together, but it's been 3 weeks at this point and he hasn't shown that he will move the car. I personally don't believe the sob story. Mom has mostly full custody, except this past summer my dad came down from Alaska and my little brother (11) stayed with him for two weeks for visitation. Mom and the rest of us were uneasy because Dad's history of abuse and basic lack of sense regarding parenting. Everything went fine we thought, but yesterday after getting a physical, my little brother was making jokes about how the doctor was squeezing his privates checking for irregularities. Asked mom when he could watch the 'puberty' video—she hasn't exposed him beyond the sex ed in school, but she answers his questions when he has them. Mom said they could watch it soon, but little brother said he already knew how it worked, talked about how his penis gets hard, and stuff comes out of it. Mom asks how he knows this, little brother says while his dad was in town they watched porn together. He started sharing graphic details about how the woman had two holes, was touching them, etc. Says he was shown a woman masturbating and then a man masturbating. Little brother says he said he didn't want to watch it, but had to watch it anyway. Says he was traumatized by it. She's just been diagnosed with colon cancer. She has roughly 360 hours of sick leave. She's applied for FMLA. She's just been told by her boss that onc FMLA is over she'd simply be terminated if not back at work. We don't know if chemo will be required or exactly how long it will take her to be well. If the cancer's metastisised she might have chemo then surgery. We live in WA state which has FLA, a state equivelant of FMLA which per their site can be used after FMLA. Her manager did not mention that. She called HR to ask about it and they said FLA is only for birth or adoption. Per the state website it's not; the same 3 events qualify. Birth or adoption, serious illness or caring for a spouse or legal partner. Should I consult a lawyer regarding wrongful termination if her treatment takes longer and this occurs? [link] [comments] |

My daughter and her 4-year-old son have lived with me since 4/2018. She has borderline personality disorder and, until recently, was actively seeking treatment. Since ditching all treatment in 8/2018, she has begun verbally, emotionally, and physically abusing her son. I called CPS after he told me she punches him on the top of his head and kicks his legs "because I'm so rude to her." During the CPS investigation, she was the perfect mother. The bruises on her son's legs disappeared and he was bruise-free the whole time, except for the normal rough and tumble bruising of a 4-year-old. Incidentally, she is aware that I made the call to CPS and is working very hard to alienate me from my grandson. The CPS investigation was closed 3 days ago and she's back to being borderline. If you know anything about BPD, then you know that children of BPD mothers are at high risk for physical, mental, emotional, and verbal abuse. She's never physically abused him in front of me but he's got some new bruises that can't be explained by "rough and tumble." And she's back to ignoring him, belittling him, etc. Can I install a hidden camera with audio in my home to document what's happening when I'm not present? I suspect she locks him in his room for long periods of time, rages at him, ignores him, and probably hits him. Will the footage be admissible as evidence? Thank you. edited to add: I gave her 30 days notice to move out. That date is 11/26/2018. She has told me she plans to move out of state and cut off all contact with me. [Missouri] Am I obligated to hold property that was left at my house? Posted: 10 Nov 2018 10:12 AM PST A friend of mine was kicked out of their home and asked to stay with me for a few weeks while they figured out what the were doing. I let them do this and we brought a few boxes of their property over, mostly clothes and a little paperwork. While they were staying with me they started trying to have a romantic relationship with me that I was not interested in. Apparently the rejection made them snap and they stole my car as well as a handgun, while I was showering, and went to go do some crazy shit. The car has since been recovered, the handgun is being held for evidence and my "friend" is in jail. Their stuff was not supposed to be at my house for more than a few weeks. I called the jail in an attempt to talk to them about any family I could take the property to and the officer said I wasn't allowed to communicate with them because I was the victim and also said I'm not allowed to remove the property. Posted: 10 Nov 2018 10:15 AM PST I'm posting with a throwaway account. A few years ago I was with a woman on the east coast. She suffered from serious alcohol and pharmaceutical addiction and would not get help, becoming increasingly erratic and dangerous to the point that she tried to convince me to beat her up in a busy restaurant and threatened that she could tell people I raped her and no one would ever believe me and everyone would believe her because no one ever questions rape claims. I started to fear for my life and started planning my getaway. One day I met an incredible woman through work, fell in love, left the troubled woman I was with, married the new woman and had a baby, also we moved to the west coast. Not long after I moved I started receiving harassing emails from the ex. She had given me some money years earlier to help me through a problem and verbally offered that I never had to give it back. I foolishly felt bad for her though and re-paid some of it when I left her. In her emails she started ranting that I owed her money and if I didn't pay her right away she would contact everyone I know and work with (I am prominent in my field) and ruin my reputation. She also threatened to call my wife's job and tell them we had stolen money from a holocaust family and other crazy threats. I received the emails typically once a month, usually around the end of the month when she had bills to pay. Genuinely out of fear I started sending her money via PayPal and not only gave her back all the money she had given me years before but I gave her above and beyond thousands of dollars. At one point a friend of mine died and left me his estate and one of her threats was that if I didn't give her money she would contact my friends family and tell them just terrible things to screw up my life. When my child was born the threatening emails stopped. She did however contact my deceased friends family and now I am drowning in legal bills because they think I somehow abused him which is a really painful thing to have to deal with. I saved every single threatening email and have PayPal records of the about 21k I paid her to leave my wife and I alone. I looked online and it appears this :MIGHT: be blackmail or extortion on a federal level because she harassed me via email and over state lines. I spoke with a detective at my local small town police station and he told it just sounded like run of the mill harassment and that I didn't have any recourse because I acknowledged that I was repaying her for money she had given me years before and that basically nullified her vicious threats against me and my wife. In light of the fact my ex is still harassing me through a third party I'd like to act upon what I feel is extortion or blackmail from 2 years ago. I need to know if she did in fact commit a punishable crime? I thought she might kill me when I left her (not an exaggeration) and she is still a shadow lurking in my life years later, beyond the possible extortion/blackmail. My parents gave me more information over the identity theft situation Posted: 10 Nov 2018 10:52 AM PST [Texas] Some of you may remember from my previous post. I have since gathered more accurate information over the situation and my parents consulted a CPA. Apparently what my parents are saying is what really happened was when they first got the loans, they applied with my dad's information and his ITIN and not my social security. That being said, they mentioned that there was a mixed file situation since my dad and I have the same names with not even a Jr. to distinguish us, and the loans somehow went over to my account which they never even noticed. Originally I had thought the loans were taken out using my ssn purposely, but they said that was never the intent. The CPA told them she could dispute it for them to have it fixed, but I'm scared it's gonna lead to some sort of investigation... what should I do? [link] [comments] |
My mother is my POA in a lawsuit. How much “power” does she actually have? Posted: 10 Nov 2018 06:42 AM PST [WA] I am going to try to explain this the best I can without revealing too much of the nature of the case, the whole thing is very traumatizing for me. Events that occurred to me when I was 16 lead to a lawsuit worth 600k in damages, I am currently 19. Basically, at the time my lawyer suggested to appoint POA to my mother because I was a minor and it would help the case move along, personally I wanted nothing to do with the case, I just wanted to heal and move on with my life. Here we are 3 years later and the case is coming to an end. My question is since my mother is POA, how much power over this money is she going to have?This money is supposed to be for me, to help me get the life back that was taken from me. I want to use it for medical bills, college, maybe get my own place. And I'm scared that since she has POA she will have control and use it for herself. My lawyer said that due to the nature and the amount the judge will most likely appoint a fiduciary to handle all the financials. Is there a chance that it could be my mom since she is POA? [WA State] Fired for using Sick Leave Posted: 10 Nov 2018 11:41 AM PST I have a part time job. I have been sick for 2 working days and called in for being sick. My employer thus decided to fire me. I read up on the sick leave laws in Washington state, and read that they are required and employers may not take retaliate against employees who use them. However, Washington is also an at will state. I also believe that my employer is trying to fore me and not let me use my paid sick leave hours for the time I missed. What are my options?
