We were able to come to a signed agreement where she agreed to vacate the property within 7 days if i refunded her last two months of rent. (~4200$). Which i did. Honestly between this and my other legal fees i am basically in the hole, and i would have been better off not having anyone rent my apartment. I talked to someone who is doing a story on Jane, and they were able to confirm that she apparently works for a company rents out places on AirBNB (said person who was doing a story basically told me they weren't going to pursue this anymore due to time concerns). She isn't a grad student nor is she even a student. I don't feel like i won, and honestly i just feel absolutely infuriated with the entire situation. AirBNB to this day still has my place being listed on AirBNB. Who knows why she doesn't have keys anymore. My apartment is a disaster right now and from what my property manager has stated it seems like people definitely did smoke in my apartment. There are burns on my couch from cigarette, my dishwasher is broken, and pretty much everything needs a desperate deep clean. But my apartment is safe more or less. I let her have control of our finances a while back because it was causing issues in our relationship which I've been fighting to keep alive. Two days ago i found out shes been cheating and last night i found out that she had taken out a 10k loan from the bank earlier this year, and my credit card, which I thought was paid off in full, is almost maxed out at a little over 10k. I had recently received a check from my father for 5k from my grandfathers death and deposited it all in my savings to not be touched. Which now only has 1k in it. I dont know what to do. She does not know that I know about all of this yet. She is just strutting around the house like everything is peachy. Am i responsible for everything? Will i have to file for bankruptcy? My income is ok but nothing great. I want to get out of this situation as cleanly as possible but dont know how. We also have 2 kids, the older one not being mine and the younger is. I have Hashimoto's which makes me really intolerant to cold. It's the worst in my hands and feet. I work as a receptionist so I can't really wear gloves or mittens all day, plus that isn't the best idea working around sick people all day with the issue of containing germs. My employer refuses to let me leave. I am currently sitting here in my winter jacket and hat and I am still losing feeling in my fingers and toes. I am thinking about getting a note from my primary care doctor that says I need a climate controlled environment. My major concern is that when this happened last year it went on for two weeks before they did repairs and I got very sick from it. If my doctor writes me a note can they still fire me if I tell them I can't come into work because of this? She threatens staff with bodily harm, threatens to have us fired, threatens to pull out her central line and bleed out, threatens to sue, has attempted to strike staff and actually struck staff, harasses her assigned nurse and CNA by following them to patient rooms, sat down in the nurses station and refused to move (despite that being a potential HIPAA violation), and generally has been an unholy terror. She's still ill, so discharge is not on the table as of now. She is alert, oriented, and consentable. My unit director has been in her room multiple times to tell her that her abuse in unacceptable. Our hospital representative has been in her room to speak with her and tell her that her behavior is inappropriate and if she were to continue, the hospital can potentially press charges. We've been told to file event reports every time she acts out, but we've not heard anything back about those reports. Nothing has made a dent, and her behavior has continued. The hospital has not taken any further steps to protect staff. We are all sick of being abused over the last two weeks with no end in sight. My question is, do we have any recourse here? The hospital has failed to address the physical and verbal abuse towards staff, and providing care for this patient is a game of Russian Roulette. She can be agreeable sometimes, and Satan incarnate other times. Some of the staff have talked of skipping the usual event report the hospital has asked us to file when she acts out, and instead calling 911 the next time she is abusive towards them to pursue charges. Others have talked about legal recourse against the hospital for failing to provide a reasonably safe working environment. I'm just curious if we have a leg to stand on. My son is almost 2 years old, me(22) and his mom(21) have been split up since he was only 3 months old. We have no custody agreement within the courts but do have a schedule that makes it so we rotate having him at each house. The only thing is I have him much more at my house than hers because she values time with friends and partying over staying home with our son. The problem I have is she has had a very bad tendency of bringing him around everyone new guy she talks to. He has slept at multiple different guys houses and apartments instead of her own so she can spend time with these guys. Some have lasted just under a month to 3 months. She recently met a guy that resides in NJ and wants to take our son there but said she was going with her friend 'Christina' when in fact it was a lie. This guy I found out has a history of drug problems and a violent past. We both live in CT and I'm not sure what I can do besides going to court for a custody battle, which would take time. But anything now to prevent any harm towards my son I'm not sure what I can legally do. I don't want to stop her from seeing him as she is his mother and I value that. I requested the proof of the claimed damages. Lyft support forwarded me two photos with an open bottle spilling some liquid on the backseat. I have inspected the EXIF metadata of the photos and discovered that it was taken nearly three hours since we were dropped off. I shared my findings with Lyft along with the instructions on how to verify and confirm the details. While waiting for the response from Lyft's support team, I filed a complaint with the TLC and informed Lyft about that. Shortly after Lyft dismissed the charges and refunded $50. TLC process was fairly straightforward, I was contacted over the phone to go over the details. I shared all relevant information such as receipts, correspondence with Lyft support team, photos of the "proof " and the details about photos' metadata. A court hearing was scheduled for the beginning of November. As the complaining witness, I was able to testify over the phone. The driver had to be present in person. During the hearing I was asked to describe the ride and answer some questions in regards to the bottle with liquid. After my statement, I was free to disconnect and go on about my day. The reason I (their daughter) am posting for advice is because this situation is effecting my life negatively and I cannot take it anymore. I want to become more knowledgeable on the subject and hoping to get some advice as to what to expect if my father does file for a final divorce and how I can make it so my mother doesn't become homeless (if that even could happen). My mother is 60+ years old. She is unemployed and has been for years. She is part of a housing program, has medical problems that would prevent her from comfortably working (but has not filed for disability because she claims it would not provide her with enough money to pay rent, etc), she has no extended family to help her financially, etc., she has no friends, and she has no hobbies. The only income she receives on a monthly basis is from my father - alimony and child support (which he no longer legally has to provide since I am over the age of 18 & no longer reside with her). She pays bills and gets groceries from the money he gives her. My father is also 60+ years old and has retired early due to health issues. He left my mother ~19 years ago and they filed for a limited divorce. My father has been living with his girlfriend ever since. However, he sneaks behind his girlfriend's back to call my mother every single evening for the past ten years at least. He even has her number in his phone under my name. He used to visit me every other weekend which his girlfriend was aware of but didn't know he was also visiting my mother and that my mother was there for every single visit. He continues to tell her he visits me but it is to visit my mother and give her money and do whatever else. When he does visit me at my home on days that aren't the "other weekend," he has to sneak around. He had to sneak and lie to his girlfriend when he came to my wedding even. His girlfriend knows of me and wants to be involved in my life but does not know that I have moved out of my mother's house, that I am married, or any other similar life event. This constant sneaking around is because my mother claims that if his girlfriend knows that I am out of her house, etc., that she will force my father to file the final divorce (which sure, makes sense I guess) and thus, forcing my dad to stop his monthly payments, and then leaving her homeless. She will guilt trip my dad and I so we will continue all the lies, etc. My father has no independence and as much as he can't stand my mother, he is still letting her manipulate him for some reason. I don't know what exactly happens after a final divorce, but wouldn't my mother still get alimony at least? And would she obtain anything from his retirement or no? I don't see how after so many years this would be such a huge issue and I can't see her being completely penniless with all these government programs such as the housing one she's already under. This whole situation is a confusing cluster of nonsense so apologies if I wasn't clear on some things. I am hoping if this final divorce goes through soon (which is likely) that I don't have to worry about my mother being homeless because there's no way she's moving in with my husband and I. Sits in his car for a bit, comes back and tells me I'm under arrest for domestic violence assault in the 4th degree. Spent a night in jail, out on own recogniscence the following day. But with the stipulation of a no contact order with my gf Fast forward 3 weeks to this last monday. I'm sitting at my apt, when my ex texts me she is coming over to get her stuff. I know I can't be around her, so I grab some stuff and go to leave. Her and her new bf greet me in the parking lot with general douchebaggery, trying to be as intimidating as possible towards me. At this point in so tired of this circus with her I want out. Head over to my mom's house which is about 5 miles away, as I pull in cop pulls up right behind me. Officer says my ex called to report I broke the no trespassing order. By her coming to my apt while I'm there I'm still at fault so I get arrested, officer stated the state ties his hands he has to make an arrest. mom's crying all the while big scene, I gotta try my best to calm her down, even the officer telling her he didn't believe I shud be arrested. Spent Monday and most of Tuesday in county jail. I got out last night, to find that her and her new bf are literally squatting in my apt with my possessions and refuse to leave. I have called my managers, the police dept, and several local lawyers and all of them said I am basically screwed. Apparently when the cops questioned her she claimed she lived there, and in the court records her home address was now the same as mine. Even though she is not on the lease, or any utilities in her name, I have been told she cannot be force out without going through the long eviction process.....on myself. Landlords said they would have to evict whole houshold, so I'd get screwed too. So currently she is sitting in my apt, with the utilities I pay for, with her new bf, while I'm stuck at my mom's. This is the craziest thing I have ever had happen, i can't believe she has the right to force me out of my own home that I pay for. I'm in a suburb of north Austin TX I've asked them to at least turn the volume down and they said "Who doesn't like Christmas music?" And shut the door. The apartment owner hasn't ordered a new furnace, but was planning on having his maintenance crew install it once they had it. In the mean time, they gave me two space heaters and told me it's safe to run them when I'm not home, which is obviously not safe, so I have only been running them when I'm home. I have lizards that will die if they get too cold, so I've been more concerned with them than myself. Last night, a light switch caught on fire in my apartment from running the space heaters. It was 15 degrees outside last night. The fire department came out and told the maintenance crew that my apartment is uninhabitable and that they needed to move at least my bed and pets to another apartment or hotel. The fire department had to disable power to half of my apartment, but left power on in my bedroom bc the fire wasn't on that circuit and I was trying to keep my pets warm in that room before we moved them. The maintenance crew called the owner to tell them what happened and he said that because my room had power, that I should continue living there with one space heater. The maintenance crew ignored him and moved me to the new apartment anyways, against his will. So my question is, what can I do about not paying rent or getting out of my lease? I don't want to pay rent when I am told my the city I can't even live in my apartment. What resources should I be reaching out to to help me with my case? There are other tenants without heat and the owner is obviously not going to do what's right if he wanted me to continue living in my apartment. I paid the bill obviously. Last July, we closed the account since I moved into a dormitory where the internet is included. We wanted to return the modem and the WI-FI router. After several calls they ended up sending us a bag so we could send them the equipment, which we did. A week later we had the confirmation thanks to the tracking number that the package arrived safely, but the company sent us a bill for the equipment they say they have never received. So we called to settle this, but every time the employee says that everyone is settled, that the bill will disappear (except that it does nothing) it will even confirm that the devices have arrived home. This lasted for several months, now a collection company calls for my mother to repay this "debt". They have been called but nothing seems to work out, every employee changes their speech in the middle of the conversation and nobody seems to want to solve the problem. Our 18-year-old daughter (still in highschool) passed away in a car accident on October 12th. She was living with me while our other two daughters reside primarily with their mother. Our 18-year-old was still considered a financial obligation in regards to child support and health care until her graduation date. I hate that I'm even having to discuss this being that I wish all that I had to do was grieve... but with the grieving I am under a tremendous amount of financial stress. This includes my child support going up due to her death and now having to pay on her totalled out car that insurance didn't even come close to paying off due to it having a salvage title. I'm going to sink fast. I had a $10,000 life insurance policy on my daughter through my work. This will nearly cover all her funeral and burial expenses. If I only had to pay half of these expenses, I could use the rest to pay off her car with a little left over to pay on my 14-year-old's knee surgery and other outstanding medical bills for my children. This would not provide me complete financial relief but it would help keep my head above water. When asking my ex-wife if she could pay for half of our daughter's funeral expenses, she replied "That's what her life insurance is for." This policy I was paying for was not mandated upon me. I chose to carry it and I know the funds are not strictly for funeral expenses. My first priority is my daughter and paying off the funeral home because they gave her a beautiful service, but if I can get help from her mother... Is her mother obligated to share these expenses? On November 18, 2018 (Sunday), my 17 month old baby and I took an Uber with a driver named Elizabeth. I have her license plate and car make. The ride was approximately 7 minutes long- starting from Venice Beach (25 Windward Ave, Venice CA) and ended at our hotel Le Meridien Delfina (530 Pico Ave, Santa Monica). We got off and as I was checking my things on the way to our room, I became aware that my phone (iPhone XS Max in a Mous shell case) must have dropped at the Uber as I used it to FaceTime with my husband. I checked to see if the Uber was still at the driveway but she had already left. I informed the valet and bellmen who were there and saw us get out of the car of what happened and asked that they be on the lookout in case she's still around or comes back to return the phone. I went back to the hotel room with my baby and used the iPad to contact my husband who was driving home to San Francisco with our dog at the time. We both tried to call the number several times but found that the phone has already been turned off immediately. That was suspicious as I used it to FaceTime with my husband during the ride and know it was on. My baby and I's airport transfer (SafeRide Transport) was arriving at 10:30am to take us to LAX for our flight to SFO at 12:55pm. I was not able to pursue the issue some more until I returned home and was able to procure a temporary phone to use with my own phone number. I have left her voicemails through the Uber call relay system as well as filed a complaint with Uber from 11/18 Sunday evening to 11/19 Monday. No response from the driver. On 11/19 Monday afternoon, I left the driver a voicemail and Uber a message that I am filing a police report with her license plate and that I have evidence that the last location of my phone on was on the ride with her. I told her the valet and bellmen at the hotel can attest to the fact that I tried to see if she was still there. Also, that my phone had been turned off immediately and Uber can pull up if she had any passengers as early as the time the phone has been turned off. I also said that if it's found and returned, there will be no questions asked. Uber contacted me several minutes later with a message that she contacted them and confirmed that she has my phone. Although everything pointed to malicious intent, I was just happy that my device was found as this was a 3 year wedding anniversary present to me from my husband. I had informed Uber that since she is not returning my calls and voicemails to make sure she knows to drop it off at the hotel (Le Meridien Delfina) as I sent a shipping label to the hotel to ship my items back. It is now 11/22 and the driver is still refusing to take/return my many calls and voicemails. She is knowingly withholding my personal property with no show of intent to give it back. I am 100% willing to pay the Uber fee for returning my item and I even said on one of my voicemails that I would do an additional tip (reward) for her for the trouble. I have checked with the hotel and still no device has been dropped off. Additionally, Uber just escalated the issue 11/21. It is my understanding that they have not been able to get a hold of her either. As of 11/21 evening, Uber is now saying "if the driver still has the phone and is willing to return it"... as well as "Uber and drivers bear no responsibility about things left at a vehicle past the ride". Withholding someone's property and showing no intent to return it is theft. Is Uber abetting a thief? There is no repercussions or pressure for the driver who I'm willing to bet is still driving for them. I get that they're private contractors which Uber likes to advertise BUT is that license to commit criminal activity without fear of punishment? Where is the line drawn? I plan on pursuing charges after the police report is filed. Its a matter of principle to me now. At this rate, wondering if Uber should also be held accountable for fostering an environment where their (not) employees are encouraged to choose whether they want to return someone else's property or not. It started after she lost her full time job. She would have lost her house due to having no other children nor a spouse. The issue is basically she states I cannot have a dog even though I pay for her house. I'm wondering if she can legally do anything if I bring one home. The thing is, I know the money isnt mine to keep, Im sure this was some sort of mistake on Ubers part, and I generally live paycheck to paycheck (college student), Im worried that at some point Ill be tight on money, lose track of my spending and not leave the full amount in the account, just to have them finally charge it back the next day, leaving me with a negative balance and stacking overdraft fees.. Ive posted this to all the uber subreddits and got some interesting theories as to why it happened, but no clear explanation and no way to directly contact Uber. So heres my situation: I recently noticed that almost $500 of rides have been refunded into my account. Not that Im complaining, that would be fantastic, but its obviously a mistake of some kind, I never asked for a refund for one ride, and they refunded 24 separate rides that happened over a period of around three months.. Its even weirder, because when I went to the app to check on these rides, all of the costs had been reset to 0.00. I couldnt find a customer service number to call (apparently they dont have one for riders, convenient), and could only find help.uber.com, after writing out a thorough email detailing exactly what was going on, this is the canned message I received back: After replying to this email for more information, I got another canned response telling me that this would be pushed to a "special team", that was weeks ago, I still havent heard back. Last week I tried again and I got the exact same response, word for word, mentioning it would be pushed to a "special team". Uber's terrible customer service has been absolutely no help. All Ive gotten is automated responses, every time, without any sort of follow up from a real person. Youd think they would be more interested in getting back the money they obviously mistakenly refunded me.. Has anyone ever had anything like this happen before? What am i supposed to do here? I know the money isnt mine to spend, but at this point its been weeks and I havent been able to contact Uber at all. Its starting to be really irritating that I have to keep track of and go out of my way to return this money they accidentally refunded into my account. I have no way to actually contact them and I really dont know what to do about this. What can I do to solve this? Is there any point where this money just becomes mine? Or do I have to keep this amount sitting in my account for an indefinite amount of time until they finally figure out what they did and charge me back for it? [link] [comments] |
