(OR) Posted: 01 Oct 2018 04:01 AM PDT Previous post here TL;DR of last post: Got a letter from a firm to prepare for a lawsuit for battery to someone i preformed the Heimlich on. Well, I took y'alls advice and went back to the restaurant, i spent about an hour and a half waiting and then speaking with a shift manager who called the general manager who called the owner, and they swore up and down that no one had come to ask for a tape or anything of the sort. Then i started looking for defense attorneys but I wasn't sure exactly how to proceed, honestly this week i've been mortified and really on edge. Finally when i told my friends about everything one of them fessed up to the fact that it was actually them and they made it up as some kind of prank. Pretty twisted joke, I wasn't laughing. I'm pretty pissed and seriously reconsidering my relationship with him. I appreciate everyone's support, excluding the people who made fun of my mother's death or tried to figure out where i lived. When he filed his taxes in April 2017 he claimed that he had no taxable income and actually received a refund from the IRS for the entire amount his employer withheld from his paycheck throughout the year. So obviously he did the same thing with his April 2018 filing. The only problem is it's October 1st, and he still hasn't received a check from the IRS. Instead, he received a letter from the IRS this summer indicating that they were reviewing his tax return and would be holding on to the refund pending their review. The IRS letter also asked to please follow up with them if he had not heard back from them by a certain date . That seems unusual to me, but then again I have never gotten a naughty letter from the IRS. Anyways that date has come and gone and he does not plan to call them, hoping this whole thing will get forgotten somehow. If it is not forgotten, his plan is two-fold: #1. Challenge the IRS (in court if necessary) and argue that his income is not taxable. #2. If a judge sides with the IRS, he can just say "Sorry I was confused and got some bad info online" and just pay the money back and any penalties. He is thinking that the penalties and interest will still be less than the interest he made on his tax refund which he has kept in an index fund over the past year. So his reasoning is that worst case scenario he still comes out on top. I asked if he's concerned at all about going to prison or significant penalties. He is confident that "no one goes to jail for making a mistake on their taxes" and that the penalties will be small. I don't know where he is getting that information, but I also didn't have any specifics to rebut that line of thought. However I did tell him that it's unlikely that any judge would consider what he's doing as a "mistake". Anyways, that is the latest I have for now. NYS - Called CPS on a acquaintance over significant drug use Posted: 01 Oct 2018 08:01 AM PDT As the title states, I "anonymously" called CPS on an acquaintance over her substance use and disregard for her child. about 5 hours after I contacted CPS, I received a cryptic message from said associate stating; "I know what the f-- you did, don't ever talk to me again." The phone call I made was via the states hotline. I gave no identifying information, and gave the worker on the hotline the facts. Can NYS tell the individual that they received a phone call from my number, or give any general information in regards to who the received a call from? Renting a room, do I have a right to a door? Posted: 01 Oct 2018 02:51 AM PDT Located in California I've been renting a room for a year, no agreement signed however all of my checks say rent in the memo. So I do believe I have rights as a tenant. That being said do I have a right to a door? My landlords girlfriend put a substanial hole in it, and now I have no door or privacy. It's been almost two months now and I've made multiple, oral requests for a replacement. Knowing my landlord if I were to buy one, I can expect to not be compensated. I understand that in some cases tenants have the right to withhold rent or at least a fair amount of it. Do I qualify to do so? Also what are my options in general? Posted: 01 Oct 2018 11:09 AM PDT Back in August, I had arranged for a consignor to come to my home and pick up some designer clothes and fur coats to be sent to the company located in California. I had consigned with this company before, even with the same woman, without issue. It takes about 3 weeks for the consignment process to finalize; to ship from MD to CA, to evaluate my items, to photograph and list them on the site, etc. The 3 weeks come and go, but I still don't see my items listed on the website. I figure they're just running behind, so I wait another week, but still nothing. I try to reach out to the woman, but cannot get a hold of her, I email her, call her and text her. I start to worry, so I reach out to the company. I am told that the woman no longer works for the company. I do not know if she quit or was fired. I tell them that she had my consignment items in her possession when she left the company. They open a case and give me a case number to refer to. I tell them to please keep me updated. I want to hope that this is just a big misunderstanding and that my items have just been misplaced in their warehouse, but since the consignor is no longer with the company, I am assuming the worst. I wont get into the details of previous nonsense on this post but she's been awful. My apartment is on the second floor and directly next to her office where she also runs a "hair salon". I recently found out that I have been paying her electricity for that space ever since I moved in. I contacted my electricity provider and they are conducting an investigation because in NYS without a written agreement stating that I would be paying that electricity (there is none) shes in big trouble. Since then I conducted a little experiment and shut off her breakers so that when she asks me to flip them back on I can initiate the conversation and ask why her lights are on my breaker. Well no such luck.. she instead has made up a fake story about a flood in the restaurant below me and that the electrician need to get in there to check the breaker and move anything that "might be on there off". I don't want her to do that until after the electric company does their inspection so can I legally refuse to let that electrician do the work? If her electrician gets their first and does the rewiring then I have no claim and I wont be refunded the money that I have paid for her bills so far. Posted: 01 Oct 2018 10:11 AM PDT My local power company installed a new power line without an easement and clear-cut a 40' path through an old Walnut Grove and Watershed that was about to be enrolled in a federal conservation program. This is in Kentucky. I have photos showing that power line was not installed and that the grove of trees was there as of August 18, 2018. I have two witnesses that spoke with and observed the crew on September 28, 2018 clearing out the trees. They asked who owned the property, were given my name and then proceeded to work. The trees are all gone, and the permanent creek has been destroyed. I found the damage while meeting with a state conservation resource officer to discuss a grant application for sustaining the environmental quality of the land and watershed. I have not been contacted by the power company or the tree service that they hired to do the work. I purchased the property a little more than one year ago and know for certain that no easement exists for this new construction. Questions: Should I file a police report for the lumber that is missing? Should I notify either the power company or the tree service before contacting a lawyer? It is likely that the now barren land will leach silt into the creek. Is there an agency that needs to be notified about this? If the damage to the creek limits my application to the federal program would that be considered as part of the losses? What is the best way to find a tree and easement law expert in Kentucky? He had been added as a user on my bank account for several years prior to the split but never actually used it. He was just on there in case of an emergency. Bad decision I know. The even worse decision was to leave him on there after the split because I didn't want to go through the hassle of having to meet up with him amd remove him. Before we split he was thinking about filing bankruptcy but hadn't actually gone through with it. I guess since I left he has filed. On Friday I got notice that my bank account had been garnished by a law firm for the entire available balance. None of my credit cards are in collections so I knew it had to be something to do with him. Sure enough when I called this morning the law firm that entered the order could find nothing under my name and wouldn't talk to me about the account under my ex's name. I called my bank and they said the legal order entered on the account was soley under my ex's name so they couldn't release any information about it to me. I called my ex and he said he had no idea the account was even in collections, that he assumed it was taken care of because of the bankruptcy. He had never been served paperwork for a lawsuit, which I do believe because I searched our courts website and there are no pending actions against him. He gave me the number for his attorney who is supposed to be returning my call. My question is what other remedies can I take to get my money reimbursed or am I just totally screwed? Discrimination for donating blood at work Posted: 01 Oct 2018 09:00 AM PDT My work has a policy where if you donate blood, you get a few hours of vacation time, which you can accrue throughout the year to take some time off. The problem is that I'm gay, and the red cross doesn't allow me to donate blood. When I asked about it, they said that I just wouldn't be allowed to accrue the time off, and it's no different than someone who travels to a third world country or has a blood disease. Is this legal? I really could use some guidance on how to deal with my florist. I've already had my wedding about 2 weeks ago. The florist we went with was so helpful in the beginning, my FIL was talking to her a lot and was making his own requests (during this point, he had mentioned to her that we had an unlimited budget) but she always deferred to me. After our meeting, DH and I spoke to her separately without FIL and told her our budget is 3K (DH and I are paying for the flowers). She said, oh that's unrealistic, it's looking more like 5k-6k. We said okay fine...at least we know our range now. We wanted simple things - so we went with hydrangeas and baby's breath (but mostly baby's breath as we know that's a fairly cheap option). So every week we would talk to her and ask her to update her invoice so we would know how much to pay. She always had an excuse not to send it to us then (I'm not in the office, I have to do another look at the property, etc.). 2 days before the wedding, we went to drop off the centerpiece jars and she gave us a written invoice....it totaled 12K!!!!!! We were SO thrown off but we didn't want to deal with it, as we needed to concentrate on the wedding. I was also afraid if I said anything, she would cancel the flowers and we would be fucked. So now, we have to address this. We've brought this up to her attention and she got really defensive and said there's a lot of labor that goes into it. So here are the parts that bother me - She's charging us $8.75 per stem of hydrangea and $3.00 per stem of baby's breath. I've bought hydrangeas and baby's breath for 1/4 of her price.... The labor for just those 2 types of flowers - she gave $3500. I don't know what to do. This is so stressful. I don't want to pay her 12K because well....we DONT have 12k. I'd just like to preface this with I am diagnosed with bipolar/manic depression, major depression, ADHD, insomnia, and generalized anxiety disorder. I am pretty high functioning in all aspects except for social interaction, since I stutter and misplace words. Lately (over the past few months) my 55 year old father has been going out of his way to claim everything I'm doing warrants me being "evaluated" or "institutionalized". He's graduated to saying has going to call my Dr. And try and get me committed or at the very least get my medicine taken away. He has two other sons who have deserted him for these same reasons, but they don't have mental issues, thank God. It's gotten to the point where I think he's full on gaslighting me, in the sense that every thing I do (even walking out of the room while has yelling) is wrong. He also, 6 months ago, hit me in the left side of the face with a hammer and (I'm 100% idiot, I know) he then guilt tripped me into dropping the charges. They recently opened up an office in City B and are trying to grow that office. I agreed to move to City B back in June, planned to do so in late September. Negotiated with them to pay for my move, as it was going to be expensive. I rented an apartment in City A and had to break a lease, so that carried some hefty costs. Employer agreed to write a $3000 check to the apartment. Start date in new office was planned for October 1, today. I moved out of the apartment on September 15, because they found a new tenant. However, I am still on the hook for expenses. I have been staying with family in the interim. I have already secured a place to live in City B, but won't start living there until mid-October. Firm sends check to apartment around September 20. Apartment actually deposits the check on September 26 in the morning. That exact same morning, employer fires me without cause, and calls up their bank to put a stop payment order on the check. I find out this morning they were successful in stopping payment because it was done shortly after deposit. Now here I am, without a permanent place to live, and now on the hook again for $3000 because I moved out in reliance on the employer's promise. Do I have any options for recourse? They really screwed me by doing this and I only moved out because I relied on their promise to help out with the move. I have no written contract for this but have correspondence showing they promised and I relied on it to my detriment. The state of Tennessee where I do not even lived has combined my Criminal record with a felon and criminal who is actively committing crimes. It started many years ago when someone stole my ID out of my car. I was harassed every time I got pulled over for years and did not know why. Cops would make me sit in the back of the car and check me for tattoos. It was not until I tried to get a different job at wal-mart at all places because none would call me. I realized that the state of Tennessee merged my records with a criminal. I called them. They sent me a certified letter saying it was not me and I thought that it was over because I found another Job and quit getting pulled over until last week when I was reentering the country. It was the same old routine of them making wait until they could see that I was not the guy they thing I am. I arrived at the airport 5 hours early and nearly missed my plane. I have called everyone who would listen in Hamilton county. They said the person who changes records has a terminal illness and do not know when they will return. They told me I would need a court order to get them to change it. I do not know how to get a court order. I called 2 lawyers. One said it would be 3K for them to fix it. The second said that I should not need a lawyer to call them. I called everyone and finally talked to someone in records that said they can not fix it. During our time dating, she convinced me to turn to veganism and even shamed me for having originally eaten meat. I had a dog named Baker. Baker has been my family's dog for five years. My parents went on a cruise so I brought Baker to stay at my apartment temporarily. My ex immediately took to trying to convert Baker to a vegan dog. We had been having lots of problems but this was the last straw. Days in, Baker got sick and threw up the disgusting "vegan doggie meal" she made him. I told her to pack up and get out of my life. The following day, I wake up to find Baker had been taken along with all her belongings. I try to contact my ex, no response. On Facebook, she messaged me to say that she felt Baker was better off with her instead of monsters like me and my parents. I call the police. Cops tell me there's no evidence the dog isn't hers even though I had proof like the FB, pictures and my vet. They tell me it's a civil matter though they recommend I call Animal Control over the veganism thing. Animal Control come over. They tell me that my ex hasn't committed any abuse or crime. The AC officer then tells me to call the police and "force them to get the dog back". I call the cops the next day, and they basically tell me I'm SOL. I have no idea what to do. It's been a week since my ex took Baker. My parents return on Friday, and I haven't told them what happened yet. I don't know what state Baker is in now. How do I file to go to civil court? Posted: 01 Oct 2018 06:58 AM PDT I bought a 2015 Jeep Cherokee Trailhawk from a dealership, it was used with one previous owner and around 50K miles on it. Since the first few weeks of having I noticed that it had acceleration issues and would jerk going in first gear, I took it in to the dealership and they said it was a software update issue and they went ahead and took care of it. However this fixed the issue for a few days and then it was back to being as before. This has happened 2 times since and they give me the run around every time. I'm going in to the dealership again today, its still under the powertrain warranty so they said they would look into putting in a new transmission but I'm sure they will find a way to fuck me over still. [OH] How do I handle No Contact order against me when other party keeps contacting me? Posted: 01 Oct 2018 11:59 AM PDT I live in Ohio and am currently dealing with a Custody dispute with a woman. I'm taking her to Court to get some sort of custody of our son (joint or sole). She's prevented me from seeing him for some months, but I was able to secure visitation for some parenting time throughout the week. On top of this though, the woman has a No Contact "Stay-Away" order against me (for what amounts to trespassing, there's never been any violence between us, but at one point there was a fear that she was planning on taking the child outside the country). This No Contact order prevents me from even speaking to her or I could face possible jail time. That will be in effect for up to the next two years. With that in mind, we have an exception for visitation and we've been making our child exchanges at a police station with an officer present and have not been having any other face-to-face contact, no issues there really. However, this woman repeatedly throughout the week texts me and calls me at my work phone. If I respond in any way though, it's a possible violation of the No Contact order. It fills me with alot of anxiety all the attempts she keeps making to contact me, it's like getting poked by somebody constantly and risking jail time if you even so much as tell them to "Stop." I don't want to file harassment charges or anything like that, I just want to have open two-way communication, we're his parents, we need to be able to talk. She can drop the No Contact order at anytime if she wanted to, but chooses not to out of spite. She stopped working 10 months before we got married and i was ok with it because i made enough to support us. most of the money goes to her credit cards. roughly $900 per month just on her credit cards. I only own 3 credit cards. (her credit cards she had before we even got married, none of them have my name on it). i know i will most likely have to pay spousal support because i am currently the only one with an income, which i have no problem with because i also want to help her although we are separating. We have been living in her parents two family house paying rent. They are allowing me to still stay there untill i can find a place of my own. However now my wife wants to go back to college. she tells me this the day after we decide its better we divorce. we have not filed any paperwork yet or atleast i havent. will i end up getting screwed with this if she wants to go to college all of a sudden? will i get stiffed with the bill? and will i have to pay all her credit cards even though they are in her name and nothing in my name? We just had a baby boy (he'll be four months old on the second which is relevant due to the timeline of events). During her pregnancy I cheated on her with a coworker. (Yes I know im a piece of shit; you can't make me feel any worse than I already do.) Since then I have confessed and reconciled with my SO. Recently my AP (affair partner who was also cheating) has attempted to reach out to my SO through a mutual friend saying only that "they need to talk". We also have found out that she is pregnant and the timeline could possibly see me as the father. All pretty standard fare until this point. The twist on this story is that her boyfriend was convicted as a pedophile. (she has children already and that's who was abused). On top of that we're unsure but the rumor mill is claiming that she also caught a charge in either assisting in, or concealing knowledge of said activities. My SO and I want to do the right thing if it is my child and remove him/her from a potentially dangerous living situation, and raise the child ourselves. The child isnt born yet and we wanted to know what course of action to take before we communicate with my AP. As I see it we need to ascertain weather or not she was involved, and if the unborn child is infact mine. The pedophile is out of jail now and she is back together with him. We have no idea how to proceed and currently cannot afford legal representation (although I am just starting a new job so I will be able to start saving up for it.) Posted: 01 Oct 2018 06:39 AM PDT I took a look at the landlord/tenant wiki, and didn't see anything really similar, although our issue isn't really with the landlord, at least yet. Basically, our (me and my boyfriend) downstairs neighbors are absolute nightmares. There is always at least one gentleman in the apartment and one other female, although it is sometimes unclear which one it is, as there is both a girlfriend/baby mama and a sister in the mix. Over the past month, they have had the police called on them 3 times when we were home, once by us, the only wall-sharing neighbors. The other two times it must have been someone in the adjoining building, because while we considered calling, police showed up before we could. These people scream like you wouldn't believe, and get in the most ridiculous knock-down drag out physical fights I've ever heard. I described to police that it sounded like someone was throwing around a bookcase, that's how rough it sounded. This is now to the point where it's woken both of us from a dead sleep at all hours of the early morning (1-3am). I'm honestly a little afraid to go outside our apartment when I know they're home or fighting, that's how violent it gets. I'll go into more details if asked, but my main question is at what point does this affect them and their lease negatively? Or could it at all? I know when we called, the concern was domestic violence, but no one was actually taken in by police. The other two times that we know of for sure, one person was asked to go somewhere else in their own car, after which point they just came back after a few hours. It's just got to a place where we not only feel unsafe just by being the only neighbors sharing a wall, but by being home at the same time they fight, because we're worried they'll retaliate on us thinking that we called police every time they show up. Was sexually abused as a kid and case was dropped (ND) Posted: 01 Oct 2018 08:30 AM PDT So as the title states I was sexually abused by my biological father from as young as I can remember until I was about 12. I didn't tell my mom until I was 14 or 15. My parents are divorced and I would go to his house in NH every summer where a majority of it happened. It also has happened here in ND and when we used to live in VA. Naturally, my mom pressed charges. The cops here asked for a statement from me and wanted every single incident I could remember but 1. I was so young I didn't quite understand how detailed they needed and how they literally needed everything, and 2. I wasn't ready to tell random people that I didn't know the worst things about me in detail. I did tell them what I could. They proceeded to have my call my father and try to get a confession out of him. They figured he'd tell me easier than he'd tell someone else. Well it backfired like I knew it would, he screamed at me, called me a liar, told me I was going to ruin his life, my step moms life, and they're new son's life. CPS came and asked me some questions, I don't think anything came of that. We even tried filing for a restraining order but since the last incident had happened a few years prior they wouldn't issue it. So the case was dropped. I never knew why but I just wanted to move on and I eventually did. (well I thought I did.) My dad and I even started having a relationship after a few years and I was doing fine until I had a child of my own. I had him 6 months ago and I've been dealing with major PTSD, depression, anxiety, and probably ever other mental illness. I've been realizing how fucked up it was letting him back into my life, how he doesn't deserve to be in my life, my husband's life, or my son's life. So while trying to heal for real from all of this I asked my mom why the case was dropped and she said that they thought everything was just "he said she said" and basically wasn't worth their time looking into further. She wrote letters to the state's attorney and basically did everything else legally that she could. My therapist has been wondering if I've been wanting to explore this legally again and I've been considering it. If I do, what CAN I even do? I feel like the fact that my dad and I have had a relationship up until recently that it's going to get used against me. Especially since I'm 23 now and it's JUST starting to affect me like it probably should have a very long time ago. I'm scared to do anything about this to be honest but at the same time I feel betrayed, and like the legal system failed me terribly. Had a seizure while driving, got a DUI because of traces of THC in bloodstream. Posted: 01 Oct 2018 12:57 PM PDT This is Indiana. Woke up this morning in the drunk tank, very confused. I have no memory of what transpired so this account borrows heavily on eyewitnesses and records. After dropping off rent money at my landlord's house, my car(And I, I suppose) rear ended a minivan just three blocks away. There was no damage to my car, and I'm assuming only a dent in theirs as the impound lot said I did $1000 in damage. The police discovery says that I had trouble standing, was speaking incoherently, didn't know what was going on, etc. Said I was wandering around the scene in a confused manner, but not being confrontational. I was then taken to an ER for a blood draw/urinalysis and it was positive for marijuana and nothing else. No, this is not a legal state. I hadn't used marijuana for several days. This is my second DUI. The last one was fully deserved, and I completed everything required of me with no issues. I know that marijuana is illegal regardless, but I don't think the way I was acting very accurately represents that of someone under the influence of THC, especially trace amounts. It certainly wasn't the factor here. I have a history of neurological problems. My last seizure was in December 2017 and it affected me the same way as this one. I know that epileptic people often can't drive but I've been proactive with my treatment and driving privelige have never been questioned. I did however recently have a medication removed from treatment. Is my neurological health something that should be taken into account in this case? Or does that just make it worse? I just moved to a new urban city three weeks ago, my workplace is 20 minutes away on the highway. I have no idea what I can do about this.. possibly an exemption for only driving to work?
