Nearly every single time I go there, she is nearly nude or entirely nude. I've started to wonder if she even buys stuff to use it or to get us to come out to her house (common: people get lonely). Either way, I don't want press any sort of charges or embarrass her. I just want it to stop. My route is set in stone so I'm stuck with her but I thought I'd come here and see what my options are, if any. It's starting to feel like sexual harassment. (Yes, I've let my HR know). Also, I made the mistake of letting it flatter me at first which probably encouraged her. But now I just try to avoid all eye contact and get back to my car as quick as possible. Simply put, my brother believes he has been retaliated against for reporting a drunk tow truck driver and he has no clue what to do in order to end it. As the title states, my brother was involved in an apparent road rage incident involving a drunk tow truck driver. My brother had seen the driver in a Wal-Mart parking lot, and noticed that he was cracking open a bottle of beer and drinking from it. My brother parked in front of the driver and watched him for a few minutes before the driver drove off, and that is when he began following him while calling both the police and the towing company and providing them with details about the man and the ID number on the truck. The driver was most definitely drunk as he had been drifting all over the place, so my brother kept some distance from him until he could pull up to him at a red light. My brother got the man's attention, and informed him that he had been reported for driving drunk to which the man responded by first denying it, then swearing and screaming when my brother began recording him with his phone. My brother tried to keep calm, but he did get a bit vulgar by telling him that he was a piece of shit who was going to kill someone, and eventually the man threw his half empty beer bottle at the van which didn't break but left a decent dent and scratch on the driver side door. This is when my brother got scared and took off, stupidly running a red light, only to have the driver follow him and attempt to cut him off and brake check him several times. My brother then did another stupid thing by driving home as quickly as possible, leading the man right to where he lived. On the way there, my brother called 911 again to tell them that the man he had reported was now following him home while aggressively trying to cut him off. He asked if the police could meet him at his house, and while they said they would they highly recommended that he come to the station instead. I have no clue why he didn't follow this very solid advice. When he finally got home the police had not arrived yet. My brother parked in the driveway and tried to run inside before the driver did something to him, but it didn't matter in the end as the man drove by slowly, flipped him off, and told my brother that he knows where he lives now before driving away. This obviously rattled my brother and when the police arrived 30 minutes later he told them everything that happened and filed a police report while also showing the officers the brief video he recorded of the incident, and gave the towing company one more call to tell them what happened and that he filed said report. The dispatch worker apparently sounded as though he didn't believe my brother and refused to release the name of the driver, and then asked for his address/name/number and the number of the police report. Bro also informed them that he would be filing the insurance for the damage done to his vehicle and that he would send the invoice to them. My brother decided to wait on the insurance because wanted to wait to see if the police find out who the driver was so that he can invoice him directly. 10 days went by without hearing anything from either the police or the other parties. On that 10th day, which is today, he woke up to discover that his van was missing. He had parked it on the street the day before as he needed the space on the driveway to do some maintenance on his truck. There are no signs prohibiting him from parking on the road, not to mention that several neighbours of his park on the road everyday with no troubles at all. He originally thought that it was stolen and so he reported it stolen, after which his wife told him to call around to towing companies to see if it had been towed for some reason. After calling several companies, he finally called the very same company that this whole debacle started with and, surprise suprise, they had his van. The person on the phone was unaware of the situation that had occurred last week, but was able to tell him that the vehicle was towed because someone claiming to be a neighbour had called them to tell them they had parked in front of their driveway and that they were unable to get their vehicles off the driveway. This person also claimed that they had asked my brother to move his vehicle but my brother refused. This whole thing had allegedly occurred at 5 in the morning, and the van was towed promptly. The dispatch worker refused to tell my brother which driver had towed it, and being rightfully pissed he demanded to speak to someone in charge. This ultimately went nowhere as the "boss" refused to release that information as well. They couldn't provide the name and number of the neighbour, the ID number of the truck that towed it, and they claimed to know nothing about the road rage incident. They told my brother that he will need to pay $280 to get his vehicle back, to which he argued over and had some choice words for this "boss." He called the police station to tell them that his vehicle hadn't been stolen, but he did tell them about the previous incident and told the officer on the phone that he believes that his vehicle was towed illegally by the very same company listed in the police report. He was told by the officer that there wasn't much they could do as it was a civil matter. He then contacted all of the neighbours near his home to find out if one of them called a tow truck - and not a single person knew anything about it. So, my brother now feels completely defeated and has to come up with enough money to get his van back. He doesn't know what he can do to prove it was retaliation for the previous altercation, and is worried that this could possibly happen again. I'm trying to help him by seeing if anyone has advice to help him deal with this situation - whether it involves taking them to court or simply finding out who the driver is in order for the police to pick him up. I'm as much at a loss as him, and I really wish he wouldn't have to pay the fee but it's unfortunately looking like he is shit out of luck. Please help us figure out what our options are, if any. My girlfriend's parents watch her while I work, and have recently started to drop hints that my daughter is much happier and better taken care of at their house than with me. This past weekend they sat me down and told me that they'd be going after me for custody and that they had grandparents rights and that my daughter deserves better than what I can give her. The desk girl said "we don't release out records, it's our policy." I said, "HIPPA requires that you make patient files available within a reasonable time at a reasonable cost, is there a reason you're exempt?" and she said she'd have her supervisor call me back but I was too anxious to pick up the phone and explain the law to someone who was clearly going to argue with me about my rights. I figured I could skip it and I just found a new doctor and then asked them to send the file there since they would no longer be releasing the file to me. Turns out they don't even send the file to the new place, they just send a summary page. From what I've researched the only thing they do not have to provide are psychotherapy notes, as those are considered intellectual property of the therapist. But I've never had therapy, just a diagnosis and medication. Am I correct in thinking I have a right to obtain a copy of my file and that their policy violates HIPPA? Posted: 03 Oct 2018 01:02 AM PDT I live in Florida which has two party consent laws regarding recording conversations but as I understand it it contains something about reasonable expectation of privacy. Does a guy have that expectation if he's taking my vehicle on a I went into my dashcam to check out a clip of someone being stupid that I was considering putting online when I realized my visit to this brand name tire chain was on there too. Most of the clips were short and as expected but three caught my eye because they were the max 5 minute length my device will record. So I watched them. During this trip the driver didn't slow down for speed humps which is bad for my vehicles suspension and goes counter to testing the brakes. He ran or rolled thru countless stop signs. Again not testing the brakes. Speeding thru residential areas and at one point even road rages someone who is just going too slow for his liking. He guns my engine at every possible chance and then about half way thru he pulls up to someone's residence. I assume his. In my layman's mind this is the moment where a test drive becomes grand theft auto because he didn't have my permission to use my vehicle for his personal benefit. He doesn't just pull in which was easy, he does a slow three point type maneuver so he can back my car into that driveway. At that point he leaves the car running which allows me to hear stuff (though not well) but it leaves me blind as to who goes where and being able to see if anything of mine is brought into the residence. During this approx 2 minutes or so I hear what to me sounds like my glovebox & center console being gone thru and the lids on the plastic crates I keep in the cargo area being lifted and closed. Then I hear what to me is undeniably my lift gate being slammed shut and then they get back in and head back to the shop doing all the same illegal and abusive things with my vehicle that they did on the way there. There is no way the stop can be justified as legitimate and can only be seen by me as nefarious. Possible burglary. And the gunning of my engine as well as the abuse to my suspension can be seen as intentional to try and gain more business from me. Or he's just a 100% scumbag. At several points you can hear the guy speaking. Like when he cursed out the driver going the speed limit in a neighborhood and later he is either speaking on his cellphone or there is someone in the vehicle with him. Not sure bout that cuz my cane which I left on my passenger seat had been thrown into the back seat footwell. None of my services required anyone to be in the passenger seat so not sure but I'm now suspicious about everything related to this service. I couldn't understand most of the language spoken except the profanity laced ragefest. This entire episode has me really upset. Being upset is not good for me. I'm a disabled infantry combat veteran with PTSD so I have been known to blow my stack but that is more rare now. I'm 50 and I have Multiple Sclerosis which also effects my emotions, my mental sharpness etc. Nowadays if I rage it's like getting hit by a ton of bricks or doing a 100 mile forced march in full gear so I'm not sure which concerns me more, what I might do if I lose my temper or if I might just fall out right there at the tire place. I rarely leave home because of the PTSD and the MS. I work a crappy midnight shift job to keep from being homeless because the VA disability income isn't enough and otherwise I only go to medical appts I can't avoid and very occasional things like this service which I put off multiple times. I go nowhere because of the typical reasons PTSD wise and because of the many problems the MS has caused including chronic fatigue/exhaustion, extreme heat sensitivity, imbalance, irregular gait, etc, etc, etc. I bring that all up because it took a lot for me to finally go and get my car worked on and now I'm so concerned about how I may react if/when I'm fed a lot of bs by the tire place that it just compounds my normal trepidation about going anywhere, especially after the sun rises in balmy south Florida. If I can get some legal advise to help me understand where I stand as far as the dash cam recordings and if I'm on solid ground there and what my possible legal recourse is and how to go about handling things I might be able to calm down enough to venture out. Maybe I should just go to the police and hope I don't get arrested for unintentionally recording the criminal or criminals who were in my car during that Or maybe I have to find an attorney first but even that just leaves me more confused. What kind of attorney would know about dash cam, two party consent, expectation of privacy laws and what kind would know about when a test drive becomes grand theft auto and all the other nuances I described? Would that same kind of attorney/s be the same kind to help me bring action against the test driver &/or the tire place? I have no idea and no one I know has any idea either. Also, what would that stuff cost? I tried posing this question on Quora more than once cuz it's Quora but I'll be damned if I can figure out why my questions disappear so I gave up. I got a warning letter about having my phone on me and creating a "toxic environment", which was then followed with verbal warnings for minor things like wearing a hoodie or tights the next couple weeks (which are not rules I was aware of). Last week they let me go and said it "wasn't a good fit", they handed me a check for a month's pay and I packed my things. No exit interview, no signing any agreement, and no email with information about my release. Should I email them for documentation? Should I get a lawyer? I can't apply for unemployment without documentation, I think, but then breaking our contract is suspicious and I still have no idea why they would let me go for having my phone on me sometimes or wearing hoodies? We were able to provide the city government's animal adoption agency the necessary documentation for them to be satisfied that Chunky had been abandoned. They updated their database to show that we are the new owners. Once we had the documentation to show the city considered Chunky to be ours, the microchip company was willing to work with us. In addition, we had to provide them copies of the paperwork the original owner dropped off, screen shots of the text messages with the owner (including a matching phone number) discussing the abandonment, copies of vet bills that we paid (including updated rabies ID), and a current photo of Chunky in our care to match the one they had on file. As of four days ago, her microchip scan will now direct the contact information to us, rather than a ghosted owner who moved and just left Chunky behind. I had no idea it would be so difficult to get pet databases changed. However, I'm reassured by this as well—because it should be this difficult to take ownership of somebody else's pet. Last Thursday I was contacted by Texas CPS saying my 14 year old sister was in protective custody and as of 12pm that day her dad had legally signed over all of his parental rights. I was in a state of shock. The last time I had seen my sister was when she was 2 years old and my mom left her with her dad. Shortly after she gave up my 5 year old brother and then at 16 I was placed in a foster home after she no longer wanted to deal with me. I'll save you all of the family drama but long story short my mom is now in a long term rehab facility in PA and I live in FL with my fiancé and 2 year old son. We are stable and rent a nice home and have well paying jobs. When I got the call she asked if I wanted custody and I couldn't get the yes out of my mouth fast enough. She ran my background check and put me on her call list and I talked to my sister for the first time in 12 years. I never knew the sibling connection could be that strong but we now talk every night with her limited time and I'm happy to say even though she has been in a bad situation she seems like a capable and smart young woman. I submitted all necessary documents to the social worker Friday including my social security number as well as my husbands. Our drivers licenses and addresses. She asked me how our first call went and I did express to her I have some questions as she advised me the hearing for me to declare intent to file custody was on Tuesday. Oct. 9th. She didn't respond but figuring it was Friday I knew she must be busy. Coming to Monday I waited and waited with no response and finally reached out to her supervisor who was kind of nasty with me and advised if I didn't get a call back by Wednesday to call him again. So last night I reached out to my foster mom who has been very helpful and supportive and she told me how frustrating the process is but to not give up hope. I called the social worker again today where it rang once and went to voicemail. I left her a very nice voicemail but got frustrated again. I talked to my sister tonight who said her social worker talked to her yesterday and today about bringing her clothes and such. I told her I was glad she was getting some of her things but didn't express my frustration to her. Tomorrow will be Wednesday and if I don't receive a call by 12pm im going to call her supervisor again. My question is basically what could be going on? I knew she wanted to use it since she's 17 and I'm a week off 20. She said the whole time she never had it, but really did. She got into the festival and not long after she got in a police office said that they wanted to strip search her, when they did it they found 2 pingas on her. When they were questioning her she kept saying that the ID was hers and she was me. I just don't know what to do since I've already gotten a criminal record last year and have had heaps of negative run ins with the police for many years. This is her first time being in trouble with the police and has a court date in a few weeks. I just feel really bad for her and feel like I should take the wrap because all the shit I've put her through at home with my rebelliousness and drinking. Just wondering if she'll get let off since it was only 2 pills, she's underage and it's her first offence. The mutterings can be heard in the lobby (a public area, which includes a co-worker's desk) outside of his office and in my office right next to his. The issue is that R's language is super offensive and is not being dealt with. What I have bothered to catalog is not limited to racist, sexist, and anti-semitic. This includes threats towards specific racial groups and women, holocaust denial, and under his breath threats towards suppliers. I say "bothered to catalog" because as a result of this, I bought myself some noise cancelling headphones to drown out the mutterings. R was previously "warned" some months ago for similar comments that other people and I heard. R chalked it up to his "reactions to reading the news" that he "promised" to not do anymore. He did not. In this instance he was heard yelling the N word while reading the news. It doesn't stop with the offensive things R says He treats the female employees very differently from the male employees and as a result, they do not feel comfortable being around him. He likes to make jokes/comments about his "Britney Spears pictures" and having an island of 18 year olds. Whenever he complains about other drivers, he always makes sure to mention whether they're a Clinton or Bernie voter. So I recently reported him to HR and she has brought it up to my supervisor and the CEO. The CEO is concerned about possible discrimination lawsuit as a result of firing him. In a discussion with another co-worker, one of our supervisors said our complaints were being intolerant of R's "beliefs," and what is considered offensive is subjective Even though the rest of the office is about 99.9% sure it constitutes as hate speech. None of this being the fault of the problem co-worker, thereby putting the blame on us who reported him. Given the fact that I'm the one that hears most of mutterings, it should be pretty easy to piece together that I reported him. And given the aggressive nature of his comments, I am now mildly concerned for my safety. We have a meeting on Thursday with (hopefully) a neutral third party. I need help in reframing these concerns to force my supervisor to take action on this, otherwise I'm looking for a new job (which at this point doesn't sound like a terrible idea). My grandmother is a very wealthy widow/retiree and a high functioning alcoholic. She writes me and my sisters checks all the time for birthdays etc. My mother doesn't have a problem with it. My uncle however, hates it and even accused me of "cutting into his inheritance" (my grandmother's wealth didn't even come from their father, it came from her third husband). He is so covetous of her money that he harasses her about it to the point where she lies and tells him that she didn't authorize the use of her credit card for a gift she's wanted to buy me or that the checks she's signed where done while she was intoxicated. My uncle is a warden in the state prison system. He is only too eager to believe her testimony made under duress, despite having witnesses on several occasions where she's given me gifts, and is now threatening to have me charged with "elderly abuse" and "grand theft larceny". However, obviously I dont have witnesses or evidence for every single account where she's given me gifts. If he were to try and press charges and my grandmother doesn't tell the truth, how likely am I to be in trouble? And if he has absolutely no case, is he potentially committing a violation/crime by using his connections and authority as a law enforcement official to threaten and intimidate me from accepting her gifts? Seller of home won't sign release form. Posted: 03 Oct 2018 09:23 AM PDT Here's the deal. Ky based. I am in the process of buying a home. I find a house I like listed for 160k. I offer 140k. That apparently insults the guy. He comes back at asking price. I offer 150k. He comes back at asking again. I finally offer 155k with 500 earnest money. He accepts. So I send my offer over and we sign the documents. This is the part that gets me. In the document it states if there is anything I don't like about the home inspection I can back out. It does say in another section that the seller has the option to repair. So I get the home inspection. There are a few issues. Wires hanging in the crawlspace, slope of gutter is wrong in one area, a couple of plug ins in the living room aren't grounded (inspector said technically that is ok since it's not near water), rotting subfloor in one area, rotted main joist support beam in crawlspace. The main issue is with the water. My inspector found methane in the water. 160ppm. As soon as I walked into the house the entire place smelled of sewage. He recommends I contact a plumber about it. So I call a master plumber I know (family friend) and he recommends I walk away. Based on his experience and the location of the property he doesn't see any reason I should buy. Even if they are able to fix. Issue could come back over time, if they don't fix properly. So my concern is the seller will do a half-assed job and there I will be 90 days later. This will be my first home also, so I don't want to take any risks. So I tell my agent to back out and send release forms. I sign, stating I do not want the house. The seller comes back saying that my inspector is not qualified to say the water has methane. He has yet to sign release form. It's been about 3 days since the inspection. Regardless of what he comes back with I do not want to buy. I can't put in any other offers until he signs release. What are my legal actions? Can I abandon the offer without him signing. Neighbor trimming trees on my property [USA, WI] Posted: 03 Oct 2018 06:17 AM PDT My neighbor (or a contractor he hired) decided to trim my trees yesterday without my consent. There have been other egregious things he has done and seems to treat my property as he owns it. He trespassed onto my property with a ladder and cut a good portion of my tree in the back and went 3 feet onto my property and gave one of my trees a nice haircut. It has basically a biography about me, naming members of my family, occupations/where I've worked or work, pictures of me and my kid, where I've lived previously, schools I've gone to, etc. I know I can't link to the website but suffice it to say, the website exists solely to call me a "slut." What legal steps can possibly be taken to have the website shut down? Thanks for any help. EDIT— I should add: The website is claiming to be owned/run by someone else. The domain was initially registered using a third person's contact information but now registered privately. In case I'm not making much sense, suspected person A is running website, registered a domain using person B's name, and now includes contact information for person C, including person C's home address. My friend has been looking to buy a home recently, and while perusing some homes online, she gets an on-site message from a realtor who saw her look at a home he represents. They made an appointment to view the house, and during the preliminary tour my friend said she was interested in buying it. That evening, while driving, he sends her a contract that he says she needs to sign before they can move forward, and she felt pressured to do so at that time before reading it, so she did. Now they're finding out about a lot of issues with the home and have decided they don't want to pursue it, but the realtor says they're not allowed to go to any other realtor for the next 6 months because of this contract she signed with him. Can he prevent them from looking into other homes or other realtors legally? This all happened within a 24-48 hour period, and she says they haven't gone through the closing process or anything like that. I agree that she should have waited until she read through the contract before signing it, regardless of what it was, but since neither of us are experienced home buyers we had never heard of a contract forcing you to stick with one person even when you don't want the house they represent. Edit: Thank you all for your answers. I was pretty certain this was legal, but figured y'all would be better equipped to answer that question. Ultimately, I agree that it was stupid not to read a contract you are signing, and I'm hoping she really does sit down and go through everything word for word going forward. My pharmacy lost my prescription and I can't get my doctor's office to send another one. Posted: 03 Oct 2018 10:14 AM PDT I have klinefelter's syndrome with hypogonadism. I will need to take testosterone probably the rest of my life. I have recently gone off my meds, which was totally my fault because I forgot an appointment with my doctor. I went to that appointment around a week ago (Tuesday 9/25), and my endocrinologist gave me a paper prescription to refill my testosterone injections. Immediately after the appointment, I dropped the prescription off at the CVS Pharmacy I usually use, and they said they would have it filled the next day (Wed (9/26). I didn't get any text alerts the next day, so I figured they didn't have any testosterone in, and called the pharmacy on that Thursday (9/27), only to find they had no record of me dropping off my prescription. They lost it. After calling the pharmacy over and over again over the next few days trying to get them to call my doctor, they kept saying they had no record of me dropping the prescription off, and asking me "who" I dropped it off to and so forth. They ended up calling my doctor, only I believe they accidentally called my PCP, and not my Endocrinologist who works out of the same office because they said I couldn't get my prescription until I went to see the doctor. At this point my parents are calling the pharmacy as well, and trying to clarify that they need to call my endocrinologist (which would have been the doctor listed on previous testosterone prescriptions from the same place). I call my doctor's office, which is extremely difficult to get through to because they are one of those offices with more of a call center vibe when you call in. Like I'm talking 20 minute wait every time, which I can't afford all the time when I'm at work. Anyway, I get through to someone and they say they will contact my doctor, who will send another prescription to the doctor and I figure it's finally over. BUT NO, the doctor's office calls me back and says I need to contact the CVS to no joke, "verify that they did not receive the paper prescription," even though I had explained they lost it on the call before. It's obvious both parties are hardcore failing at documentation. So basically the last week me, and my parents have been playing phone tag with the pharmacy and the doctor, and both sides keep coming back with no help. My dad recently called the doctor's office while I was at work, and the person on the other end said they would, "send an emergency message to my doctor to try to get them to fax another prescription," but when we called the pharmacy they hadn't received anything. I don't believe my doctor would be refusing to fill anything. I just don't think any of these messages are getting to her. I am in the midst of severe testosterone withdrawal with muscle loss, and memory impairment (pardon any errors in this post) because I have been without testosterone for far more than just this week (It takes a lot of time to get doctor appointments with endocrinologists). I know it's only been a week, but I feel this could go on forever at this rate, and would like to know if I have any options. I feel like I'm getting screwed by the system, where a single person's action of losing my prescription has completely broken everything. Any ideas? [link] [comments] |
Breastfeeding in public -Georgia Posted: 02 Oct 2018 11:10 PM PDT I have someone telling me that I'm not allowed to breastfeed UNCOVERED in public. This means accidental slippage. Sometimes it's extremely hot, the cover makes my daughter fussy and I believe, regardless of opinion, its mine and my daughters right to comfortably breastfeed. Nursing shirts do an amazingly good job at covering me up so I'm not just popping the whole thing out bare, expecting everyone to stare at me. You can barely notice. Is this accurate at all? I have called the police 3 separate times for safety. Last night, however, they decided to start screaming at each other at 2 a.m. My brother called the police but I was wondering if there was anything that I could do for a more permanent solution. I'd suspected him of cheating but I never ever imagined this. I'm dealing with a flood of emotions but I'm also concerned legally. Am I liable to be prosecuted for bigamy? If I turn him in, will I also get in trouble? What kind of penalties could happen? I can't afford a lawyer as I am a SAHM. Does this situation mean that I am not going to get alimony or child support? I am a SAHM to our 2 children. He actively discouraged me from re entering the work force and wanted to support me. Now I'm stuck if I leave because I'll have nothing but some meager savings. Can I take half of our joint bank accounts or not since we aren't married legally? Posted: 03 Oct 2018 11:55 AM PDT Everything that follows it true, and unexaggerated. It all started in 2011 with the death of my fiancé's grandfather. In his will the company was divided evenly between his two children, his daughter, my fiancé's mother, his son, my fiancé's uncle who was also appointed ceo and trustee. My fiancé's mother's share was divided evenly between her mom, her sister, and herself. Along with dividing the company three trusts were set up for my fiancé's children. Two of them for college, and one as a special needs trust. At such time a tedra was created, my fiancé's uncle brought in everyone listed in the will and forced all parties to sign it without legal counsel threatening to cut anyone out if they refused to do so. With no other options all signed. Fast forward to 2014 when, according to a forensic accountant currently employed with the company having managed all accounts discovered money being funneled from the company accounts to the trustee's accounts to pay bills, non company expenses, and trips. They also noted the special needs trust was also withdrawn from into accounts also controlled by the trustee. A house and yacht was also purchased using some company funds. This continued until sometime in 2017 at which point the accountant says it stopped and has not resumed to date. During this period the other members of the tedra were supposed to be receiving dispersments on a monthly basis from profit sharing. This was not happening as the trustee was keeping it for themselves and issuing personal checks when begged by the other members to help in emergencies. The FBI was contacted in order to remove the trustee and appoint a third party as well as recoup some of the money taken. The FBI refused the case citing a low monetary amount (around $4 million) as well as the unwillingness of the accountant to testify. My fiancé has attempted to contact other law firms but due to a large retainer required has been unsuccessful in finding one. As of the end of 2017 to now dispersments are being properly sent out. The current issue is that in order to get married a prenuptial agreement must be signed or her stake in the company is forfeit. But in signing the document it includes somehow granting the ceo/trustee a controlling stake in the company which negates the need for a vote in the trust. We have no way to confirm this as we are not given financial statements when asking for them and are terrified to do anything for fear of reprisals. Is the way my sons school approached fundraising legal? Posted: 02 Oct 2018 07:03 PM PDT Hi There, I am wondering if the way my childs school approached fundraising is legal as it seems a little silly to me. A letter was sent home with the youngest sibling (7 years old in our situation), stating that the school will have a fundraiser by selling chocolates. The way our school handled participation was that if they did not receive the form back denying participation, they will assume the child wishes to participate. I now know all of this because today my son came come with a box of chocolates, 30 chocolates in the box to be sold for $90 or $3/chocolate. Another stipulation to this fundraiser was that the school will not accept any boxes which have been opened. So if the student could only sell 10 chocolates they were not able to return the remainder, instead they are responsible for buying the remaining chocolates. The way I am currently viewing this, is that the school defaulted my 7 year old son into a $90 contract in the event he had opened the box of chocolates as we had never returned the form denying participation. is this legal? can you default a child into participation?
