[Update] [Update] My brother hacked into everything and is trying to control my life. [CA]

    Posted: 08 Sep 2018 11:53 AM PDT

A second update. Still in California.

    https://old.reddit.com/r/legaladvice/comments/9bveru/update_my_brother_hacked_into_everything_and_is/

Without exaggeration, this was probably the of the worst of my life.

After getting served the injunction/temporary restraining order thing, my brother 1. told my parents and 2. chose to immediately violate it. He left me several messages that essentially was low key threatening to ruin my life and I was scared so I reported it. He was taken to jail and to my current understanding is going to get a type of misdemeanor charge for it if he already hasn't. I don't know if hes in jail right now.

I knew my parents were going to take his side but they have effectively disowned me for this. My parents are very religious conservative catholics (i'm not religious anymore but they don't know that) and they were very upset by me reporting it. Thats an understatement. I have enough scholarships where I will be able to continue paying for my living expenses/school with my part time job but they way they treated me was horrible. They're very upset because thisll probably screw up his college according to the talks we've had. They said i'm disgusting/not welcome home etc. My dad sent me a video of him and my mom burning most of the belongings i left at his house (not much important to me but still). they don't believe me about the camera and my dad said he specifically didnt care even if it was there. just screaming the entire time, i stopped answering my phone and checking my email because it terrifies me. i bought a new cheap computer because even though someone helped me wipe it clean i'm honestly too scared of using the old one at this point.

i haven't left my room in a week. the worst of it is over i think but i feel like i felt in a pit. I can't stop crying.

My family and I have been helping a woman and her daughter restart their lives after horrible abuse, recently found out it was a con. We have invested thousands of our own and money from a GoFundMe before unearthing the truth. Do we have recourse or legal issues wuth the GFM?

    Posted: 08 Sep 2018 07:21 AM PDT

(I am passing this along from my mother who is a much more concise writer than myself. If more detail is needed please let me know and I can provide more! thanks for your help, all)

Since mid-July, I have been helping a homeless, pregnant, abused 31 year old woman of color and her 11 year daughter who fled another state to escape the abuser. My efforts have been aimed at keeping a safe roof over their heads, food in their bellies, providing for clothing and personal care needs, medical and prescriptions needs (pregnant diabetic with high blood pressure), car repairs and registration, and other fairly basic needs. The process has been fraught with problems and complications, including suicidal ideations/potentially self-harming actions and various attempts by others to extort money from me under the guise of helping the victims or sometimes under threats causing them harm/misfortune. This week after committing a traffic violation, I learned that this woman was operating under an alias. When I researched her real name, I realize I had been conned into spending a lot of money to help someone who actually was acting with criminal intent. My concern is that early on I started a Go Fund Me, received $1300 that I spent on food, clothing, rent, and car repairs, and I now feel an ethical (if not moral and perhaps legal) obligation to notify the donors, as well as to refund their money to them. Looking for advice as to what to do and how to go about it. This has been reported to police and is currently being investigated.

*EDIT: the GFM has been closed and the police have been contacted already. Are there further actions that could help the situation?

[Phoenix] Went to a strip club drunk. Agreed to some charges, but blacked out and woke up to a bill for basically my life savings ($15,000). The strip club employees were serving me drinks illegally (no liquor license). Is this coercion? Do I have any legal recourse?

    Posted: 07 Sep 2018 05:19 PM PDT

So, here's the situation... I went to a strip club moderately drunk. I agreed to a private dance for ~$600. The strip club made me sign a paper, took my fingerprint, as well as a picture of me. I remember agreeing to additional time and then the dancers started giving me drinks (illegal in AZ because full nude strip clubs are not allowed to serve alcohol). The night got very fuzzy, and the last thing I remember is being absolutely dumbfounded when they handed me a bill for $15,000. I was there for less than 3 hours and I highly doubt that I would agree to those charges knowingly even while drunk. I briefly argued with the bouncer before going home. When I woke up the next day and realized basically my life savings was gone, I spiraled into an absolutely horrible depression, tried to kill myself several times, relapsed on heroin (after several years clean), and wound up in rehab. I'm doing better now, and have been disputing the charges with my credit card company, but it sounds like responses from the merchant are starting to come in, and I will need to provide some sort of proof or written statement corroborating my side of the story. Is it worth talking to a lawyer in this situation? My understanding is that someone cannot legally enter into a contract while intoxicated? Is there a coercion angle to this since they were illegally serving me alcohol?

Also, it might be worth noting that the establishment I went to is apparently notorious for doing this. If you read their yelp reviews, this is apparently a scam they pull frequently on customers.

[New York] I received a letter from a subrogation company for $77,366.00 in behalf of my former landlord’s insurance company. What can I do? (More details below)

    Posted: 08 Sep 2018 08:33 AM PDT

On July 20th, I went out for a 20 minute walk and came home to my house, a rental property, in flames. Long story short, my boyfriend and I lost everything in the fire including our dogs and my car. The fire investigators were unable to declare an official cause, but there was an electrical outlet found with arcing. A few weeks after the fire, I receive a notice from the landlord's insurance stating their right to pursue compensation if I were deemed liable. I had called asking the reason to this letter and the woman I spoke with had no information and said they would be in contact with me, but to her knowledge, it was a blanket notice they send out. Today when I collected my mail, I received a letter from a subrogation company requesting $77,366 on behalf of the insurance company.

As it is Saturday, I'm not able to contact local legal advice and am currently barely holding it together out of fear and anxiety from the situation and PTSD from the fire. If anyone can give me any guidance, I would be extremely grateful!

Also, we did not have renter's insurance to assist us in any aspect of this. (Yes, I realize that was a bad decision, I have learned the hard way.)

Thank you in advance for any advice you can offer.

TDLR: My house I was renting burnt down and I lost everything. We didn't have renters insurance and now the landlords insurance company is requesting compensation for what they've paid in his claim.

EDIT: Thank you all for the helpful advice and kind words. I really appreciate all of it and am still reading posts as they come in. While the situation will not be quick or fun, you have all helped to ease my mind as I wait for Monday to come around so that I may seek council/representation.

Was sent a drivers license when I only had a state ID

    Posted: 08 Sep 2018 07:09 AM PDT

State this takes place in - Maine

This past week I had to renew my state ID to my current address at the DMV. I do not hold a drivers license because I have a fear of driving with people I don't know - which I would have to do in the driver's test. I am getting older and my lack of license is starting to negatively impact my life.

Well, The lady at the DMV was acting very "out of it" when she was serving me, and seemed to not really care about her job. I asked her if she needed proof of residency and she said she trusted me. She didn't ask any questions and it took only a few minutes, which is rare for anything DMV related.

Yesterday I got a letter from the state in the mail. Opening it was a bit of a shock because instead of verification I reissued my state ID, it was an active temporary class C license. My husband decided to go on our state driver's record directory and paid $7 to receive my record and his (to compare- as he is a licensed driver). Sure enough, my record states that I am an active driver of a class c (passenger vehicle) license.

So I imagine any day now I will receive the actual license in the mail. I have no idea how this lady was able to do this (whether it be from lack of caring or not paying attention). The big issue is what to do about it. Everyone is telling me that I should just go with it, as it got me past the part I was fearing so bad. I can drive, but the fear of the test was crippling for me. I just don't know if there is anyway anyone could tell at this point. It's not worth getting into any serious trouble.

Booking company did not provide complete flight details and I missed the flight. They agreed to provide me $500 which I feel is little. But now they say they cannot refund me as my credit card information does not match the one in reservation. I am pretty sure I used that credit card for purchase.

    Posted: 08 Sep 2018 06:04 AM PDT

If this is not the correct subreddit please let me know where I should post this.

I booked a return flight from Kathmandu to Las Vegas on 20 August from an online booking company. When I purchased the two way ticket and when I checked my flight details it repeatedly showed only one transit in China. But When I went to the airport on August 20 to get my boarding pass, I was informed that I actually had two transit points in China since the beginning, and that meant I had to change from international to domestic terminals which required a transit visa (because of my passport). The booking company had misinformed me. But I had no information about my extra transit point, so I did not have a transit visa. I was denied boarding in Kathmandu.

I had some urgent business to take care of, so I bought an expensive ticket the next day and came back to Las Vegas. I asked the booking company for compensation, and they said they can provide $500 compensation. I feel like its not enough, but I did not have proper idea about the alternatives I had so I agreed to it. I even wrote an email to their account department saying if they issue me a refund, I will not make claims on financial value of ticket.

But now, after refund processing, they keep saying that the credit card information I provided to them does not match my reservation information in their database. I clearly remember I used the same credit card to buy the ticket and I applied specifically for that credit card just to buy the ticket. I even have it in my account statement. But they keep they cannot process refund because of account information.

This whole process has taken too much of my time and mental energy and I am really tired of it. Now they are asking for all digits of my credit card, cvv and expiry date over email. Is it safe to do so? Can anyone please let me know what I should do to get a proper compensation from them?

(CA) Am I required to tell my landlord that I am pregnant?

    Posted: 08 Sep 2018 10:51 AM PDT

My husband and I just moved to a very small resort town where housing is scarce. We've been searching for pretty much anything for months. A couple places I was emailing stopped responding after I mentioned I was pregnant (4.5 months, showing but only if you know what I usually look like). Its a landlord's market so they have the pick of renters.

So, I stopped telling people I was pregnant. Found a place that's pretty ideal for us (thank fucking god, my pregnant brain was freaking out at the idea of having to have our babies (oh yeah, its twins, ha) in our friends' spare room)).

We signed the lease yesterday but don't take possession for a couple weeks while work is being done. Do we have to tell him? When would we have to tell him? He doesn't live in town so he probably won't see me but if he does, its going to be obvious very soon. If we just like, send him a birth announcement to let him know there's now 2 more people in the apartment does he have the ability to kick us out?

    Thanks!

US, NC Are we being scammed, and what recourse do we have?

    Posted: 08 Sep 2018 09:48 AM PDT

TL;DR: Person accepts then rejects offer of employment before working first shift. We received a notice from state Dept of Commerce about Unemployment Benefits claim for this individual. Need help interpreting it and determining proper course of action. ———————————————————

    Full post:

I work for a small local business in Eastern NC. We did our most recent round of hiring in July to add two new employees, which would bring us up to 4 employees plus myself and the owner.

We extended an offer of employment to one individual in particular on 07/30, with intent to start training them on 08/02. They initially accepted the position, but called us on 08/01 to decline, claiming they could not take the job because they needed emergency surgery.

We got a letter this week from the N.C. DOC Division of Employment Security Adjudication Unit.

    "DETERMINATION

Claimant is not disqualified for benefits.

    REASONS

Claimant filed an NIC Claim effective 06/17/18 which has been continued through 08/25/18.

On 07/30/18, claimant was offered work with [MY BUSINESS] as a [POSITION TITLE] on 4:30-10:30 pm shift. (this is false, we had not specified what shifts the applicant would be taking as we only work them into the schedule after the training session.) The job paid $8.50 per hour and was located 10 miles from claimant's home. Claimant last work claimant last worked for [BUSINESS IN DIFFERENT INDUSTRY] as a [DIFFERENT POSITION TITLE] on 10:00 am to 6:00 pm shift, earning $8.50 per hour. Claimant's occupational classification is [CLASSIFICATION]. The prevailing wage rate is $9.00. The customary commuting distance is 20 miles, and the customary hours of work are 8:00 am - 5:00 pm, Mon-Fri. Claimant refused work because of her medical condition which required surgery.

    CONCLUSIONS:

NCGS 96-14.9 (f)(1) provides an individual shall be disqualified for benefits for the duration of said individual's unemployment if it is determined by the Division such individual has failed without good cause to accept suitable work when offered.

Based on rejected offer of work, it is concluded the work was suitable for the claimant. It is further concluded the claimant has shown good cause for failing to accept suitable work when offered."

We're somewhat confused about why we even received this letter. It goes on to describe an appeals process, but what are we even appealing? Are we going to be required to pay unemployment benefits to this person who never even worked a shift for us? The whole thing just seems weird and suspicious.

    Any help/advice would be appreciated.

Update: Parents (sorta) cut me off and are still witholding money

    Posted: 07 Sep 2018 09:02 PM PDT

    Here's my original post:

    https://www.reddit.com/r/legaladvice/comments/970wq9/update_parents_are_now_withholding_money_that/?utm_source=reddit-android

Things have kinda calmed down now so I'd figured I'd post an update about what went down. I went to the post office and changed my address to avoid my parents receiving anything of mine in the mail. I talked with an officer at my local police station, who told me that I didn't have to deliver the car to my parents since I'm not preventing them from taking it and stuff. I took pictures and a video of the car before locking the keys in the trunk and leaving it at my apartment complex. I called my parents and told them to come get it, and they did the next day.

I got my own health insurance and phone plan, but my parents still haven't cancelled it on their end and keep telling me that I'm wasting my money. I am pretty sure I will be completely financially independent once they cancel the car insurance they have for me, but I also remembered my grandma got life insurance for me a while back and I'm not sure what to do about that.

I also talked with my grandparents about the money my parents gave them from my savings, and I asked if they could deposit the money in my savings or checking account. My grandma was clearly uncomfortable about the whole situation, and she told me that my mother gave her the money to keep safe for me until I need it (which is not what my mother told me). So I don't think I'll be getting the money back from my grandparents.

I also remembered that my dad had withdrawn $1,500 from my bank account (he was a cosigner). That money was probably from me working/babysitting, so I contacted the bank asking if they could send me the receipt of the withdrawal which has my dad's name on it and the bank that he withdrew it from. I plan on closing that account once I download all of the past statements and stuff.

I also got married. I hope that I never have to deal with my parents again, and it sounds like the easiest and cheapest way to truly be independent from them. I didn't marry some random dude, we had been dating for about 8 months and had moved in together (still a little fast, I know). He's been extremely helpful and supportive throughout the whole situation, and I'm so glad he was there for me.

Now, my family is trying to act as if nothing happened. My mother wants to call me and talk about school and stuff, and wants my grandparents to come pick me up to visit for Thanksgiving. My mother wants to come visit me and take a day trip to a local park. Until I get a new car though, I don't plan on visiting them so I don't have to rely on them to get home.

Thank you guys for all of the advice. It's been a stressful month, but I think I will be okay. It feels really good being free from my parents control, and lately I've been a lot less anxious. I still feel uncomfortable while talking with my parents, but I hope that they get help with their control issues so we can have a better relationship.

    Edit: OH/IN location

My gym unexpectedly closed down and transferred my membership to a different subsidiary that they own. The new location is far away and they require me to go to the location to cancel and give a “30 day notice,” which means they will charge me another month. I feel like I shouldn’t be charged.

    Posted: 08 Sep 2018 10:33 AM PDT

[TX-USA]Does that sound right? It's not my fault that they closed down the location near me and therefore I shouldn't be charge an extra month because the language of the contract says I need to give a 30 day notice. They did not give me a 30 day notice that they were going to close down the location I go to.

[Massachusetts] Are incels a protected class?

    Posted: 07 Sep 2018 05:37 PM PDT

UPDATE- The HR rep we met with is the complainant's aunt. This was not disclosed during the meeting and I'm not aware that anyone in the company is even aware, since they have different last names. She was being physically affectionate to the goon during the meeting, holding his hand and rubbing his knee sympathetically, which isn't totally out of the norm for the rep as she's one of those older women who feels entitled to "fix" your hair if she thinks it's out of place. I didn't think to surreptitiously record that meeting because I assume it's a confidentiality thing, but I'm just going to bring this shit to my direct supervisor and have him deal with this because I'm just done with the both of them.

Involved in an HR dispute with a new hire at work, who is claiming that I am discriminating against him based on his incel status, that "flaunting" my relationship at work has created a hostile work environment. My state is pretty progressive, so I figure that mental illness is probably covered, which seems like incels would fall under?

Not interested in getting into the details since I'm actually fairly pissed. OBVIOUSLY all his claims are baseless, but during the first meeting with HR they were sympathetic to him. I'm a woman and he's a dude.

edit- So I figured the answer is probably an obvious "no," but HR is taking his side because they don't really understand discrimination law. If there's something legally sound I can cite to get them off his side, that's really what I'm looking for. Thanks folks.

Terrible smell coming from apartment across the hall

    Posted: 08 Sep 2018 12:06 PM PDT

Denver, CO: I live in a mediocre apartment building that has a fairly nonchalant management. The man living across the hall from my roommate and I had often been noisy and disruptive at odd hours so we already disliked him.

This week however, there has started to be a terrible smell coming from the apartment. It makes the entire building - shared hallways and sometimes our own apartment smell of fishy rotting sewage. I don't know if it's rotting garbage or what, but it's revolting. I tentatively don't think that there is anyone in the apartment - the lights are off, we haven't heard anyone go in or out , and there have been no response to knocks.

We have let the building manager know but haven't heard back yet. The mess of the tenant's broken objects that was on a shared balcony has been cleaned off so it's possible that something has been done. Even so, the smell persists and it's getting worse.

My question for legal advice is: who can we contact to deal with this if the landlord/property manager doesn't deal with it promptly? The city health department? The fire department?

[Ontario, Canada] How to deal with a snoopy night custodian

    Posted: 08 Sep 2018 02:38 AM PDT

I'll try to keep this as concise as possible, though there's a bit of ground to cover. I'm working in a public school environment as IT and I've encountered hints that my desk has been rummaged through several times over the course of the year. My office is behind a locked door (server room) wherein some of the staff had access to as it houses the paper supply as well. It should also be noted I do my own garbage collection in my room - there's zero reason for a custodian to get in there. All said, I eventually decided to put up a camera pointed at the server racks and my desk to find out what exactly is going on. The footage I got back the next morning (which does not record audio) shows a certain custodian going through my desk. Unfortunately, this is evidence I cannot use but at least I know exactly who it is - who is also notorious I've come to find while talking to the other staff about it (while carefully not pointing fingers myself)

I've tried to deal with this the usual way - by telling his bosses on him. Long story short, we got the locks on my door changed. The secretary being one of three people to get a key suddenly lost hers at the start of the school year. The tripwire security system I implemented on my desk registered an intrusion late at night around the same time. So that step is ineffective. I had already approached my boss about it (lock being changed being the result of that) but unfortunately since I cannot use the footage as evidence I was forced to make an extremely flimsy accusation (which I kept vague, but gave some strong hints as to who it was) so now my credibility is slightly damaged in the eyes of his bosses.

Lately I've noticed some property missing - namely keys to a laptop cage that was recently installed. I'm reasonably sure this custodian has the key both to my office and laptop cage now. I so badly want to use the footage I have. I've tried to find wording in the law to support me, but it all seems to deal with the employer recording the employee. Not an employee recording his own desk (there was of course no signage up indicating a recording device was active). Is there some way I can work this footage in as evidence? There's one possibility I've got: At the time I was testing something involving cameras in my office for official business. It could be said that I accidentally acquired the footage while leaving the project going overnight. Given that there's also a union involved.. I'm a bit hesitant. I also don't want to approach my own union rep unless I have more solid evidence. The only way to do that is to use the footage, as this guy is doing his thing under the cover of darkness - nobody around to interrupt him.

Anyone have any guidance for me?

    Thanks in advance.

Was given a salaried job. They requested a background check 3 weeks later. Now I'm losing my job.

    Posted: 08 Sep 2018 01:51 PM PDT

I have worked for a company for almost two years. Almost 4 years ago I was in legal trouble and have completed my parole. I have been promoted 3 times in two years for my hard work and dedication.

I was offered a salary position and started immediately. Three weeks later, they sent me a request for a background screening.

I went to HR and explained they would find my unfavorable past and they told me to stay calm and we would see what happens.

I got a call from corporate yesterday saying I had 5 days to respond to the pre adverse action. I am suspended and if I admit it is in fact my record, I will be terminated. I live in Pennsylvania, but corporate is based out of Canada, and they are who called me.

What I don't understand, is 1: why they didn't say it was a condition before giving me the job. And 2: why the check wasn't in fact done before I was given the position. Is this legal?

My manager is being let go for manipulating time cards, including my time card. I knew about it, is there any way it can backfire on me?

    Posted: 08 Sep 2018 10:06 AM PDT

I'm employed in a corporate chain in NY where I work a 'shift lead' type position where I get hourly pay in addition to a portion of a tip pool shared by all employees excluding the general manager.

The company I work for has a policy where if you go over forty hours, thus qualifying you for overtime, you receive a write up. Three of those and you're fired on the spot.

For the entirety of my employment with the company, my general manager regularly scheduled me for 38-39 hours a week as a closer. This is a service industry gig, and as most of you are aware, getting out at the exact time you're scheduled to while also getting the job done isn't always realistic.

So occasionally I'd go over the forty hour mark, nothing too heinous, never more than a few minutes here or there, but my GM said if I wanted to avoid a write up, (the write ups came from the district manager so it's not like he could just turn a blind eye to it.) he could just adjust my time stamp to say that I got out on time. I agreed and this happened a few more times.

I'm not sure if he was messing with anyone else's time cards, but according to the rumors I'm not alone in this.

He got fired today preceding an 'investigation', and I'm not really looking forward to the conversations that are sure to be had between my district manager and I, is there any chance this leads to legal trouble on my part? Or am I just going to be fired? Given my finances, a lawyer isn't a realistic option for me at the moment.

I've been thinking about stepping down for a while now to free up my schedule (we're required to have open availability despite only being allowed less than 40 hrs a week) so I can get a second job, and the drama surrounding this seems like a decent catalyst to do so.

Any advice on how to proceed or behave in the upcoming conversations would be appreciated.

    Thank you.

[Portugal] Family being abusive--they don't let me sleep, steal from me, invade my privacy, etc.

    Posted: 08 Sep 2018 06:33 AM PDT

Posting here on suggestion from a previous post, sorry for the broken English. I'm trying to keep it short and concise but it's not great.

I'm a 22-year-old male living with my aunt (early 50s). I have one other aunt, my mom, and an uncle. I also have a brother on my mom's side and my grandma. My location is a neighborhood in Lisbon, Portugal.

My family has had a behavior of being abusive my whole life. When I was 11 my brother became my legal guardian and I lived with him until I was 18.

My aunt has recently been having abusive behavior. Here is a list of the things she does:

She won't let me sleep--comes into the room, rocks the bed, makes noise and moves boxes. She goes through my things and reorganizes them or steals, I have a luggage and a backpack in my room. She exposes herself--she has never truly been naked but she walks around the house only using underwear sometimes. She also comes into the bathroom when I am using it and claims it is accidental. It must have been hours and dozens of times this past week that she spent doing this to me.

I suffer from fear of vomiting and she has also purposely left food out to make me sick.

I want to move out but I have no job and no money. Aside from the computer which I am using now I have very little belongings (a luggage and a backpack of things). I have considered changing the lock to the room but I would have to contact a locksmith. I can also count a time where my family locked me in (i.e., locked the door from the outside with no way to leave).

The house belongs to my family (my grandfather bought the house and when he died it went to my grandmother, who like I said has four children including my mom).

I'm afraid particularly because she can yell domestic abuse, vilify or falsely accuse me of something, etc. People that I talk to seem to be on her side (a lot has to do with her being a woman).

    What is my legal recourse?

    Posted: 08 Sep 2018 11:36 AM PDT

Good day, I'm writing this on behalf of my friends. Location is Utah.

My buddy purchased a house about 10 years ago. He got into some problems and his mother ended up living there as a tenant around 5 - 6 years ago. A month ago, she was asked to leave as my friend and his gf and baby will be moving back in. It's been a month and about a week now since she was asked to leave. She moved all of her stuff out and was going to be out today, but is now squatting instead, sleeping on the floor last night.

My buddy called the police, and being a civil issue, they could only write a report. Buddy is going to the courthouse Monday to file a 3 day eviction notice due to extensive damage that is beyond normal wear and tear.

I should note here that his mother has not paid the full mortgage/agreed upon rent during living there, with my buddy paying it for several months of her tenancy.

What is worrying him now is his mother talked to her friend, and her friend is saying because the mother is claiming she lived there for 10 years, instead of 5, that she can legally take ownership of the house. Is this correct? I found some statutes, but the wording makes it seem like only if the original owner abandoned the house it can be done.

Edit with more information. She is not, and has never been on the mortgage. She has lived there sporadically, the most consecutive is the past 24 months. Before that, his brother moved in while buddy paid the mortgage.

Landlord wants us to sign a new lease - no dogs allowed

    Posted: 08 Sep 2018 02:46 AM PDT

    Located in Florida.

I live with my parents, recently our landlord made an unannounced visit and has now sent us a new lease to sign, stating that we cannot have any dogs at the property.

My question for you all is this - the dog he met while on his visit is actually my service dog. I'm high functioning autistic, and my dog is there to clue me in on stimuli I'm missing (smoke alarm, other alarms etc) as well as to ground me when I start to get overwhelmed.

He is registered as my service animal, is perfectly behaved etc. Landlord just doesn't like dogs.

My parents have lived in this house for over 20 years. Obviously my issues weren't known when they first signed their original lease, so my service dog was added later in my life.

We will also be getting a second dog within a few months, as my current dog has gotten up there in age and my doc advises us to get the second dog while my first is alive so we can hopefully get the dog familiar with me and the tasks I require of her.

My question is, does my parents landlord have any ground to stand on at refusing to allow me to have my service dog (he's not an emotional support animal, I want to clarify that. He's trained as a medical service dog and is certified as such).

It'll make me feel a lot better knowing my parents wont have to look for new housing because of me. I've been a hardship for them, and would hate to add on to it when they've been amazing parents to me, even with how hard it was to raise me.

    Thanks in advance!

My landlord gave my damage deposit to my ex when he moved out over 12 months before me.

    Posted: 08 Sep 2018 10:31 AM PDT

This has been stressing me for a while and I have a history of people using me for money so it's really struck a nerve. This situation has really destroyed my trust in both of them. Anyways I will get to it. I just wanted to forewarn you if I seem a little worked up. From Alberta Canada.

So in August this year me and my current boyfriend moved in together, and out of my old one bedroom basement. Everything was going okay until she moved up our move out date (she did ask me first, but not really in a way I could say no to.) Saying she had someone lined up for a Month earlier than I had planned. I reluctantly agree knowing how much stress it would put on me. Kinda being bitchy and rude the last few days we were moving (I just wrote it off since we had been moving and not many people actually like moving).

Anyway, we have a few unrelated problems with moving. And finally get into our new place. I didn't even go see her for the final walk through because at this point she had done a few other petty things that made me a little angry. (Keeping extra money from having someone take a load to the dump, not letting me come back and clean.) about a week later she tells me that she gave MY 900$ damage deposit to my ex when he moved out the previous March, something which neither of them thought to mention until over a year later. I ask my ex about it (he's an absolute asshole but he does have morals and values and told me that if he had gotten it, he wouldn't be hiding it)

I think my question is, am I on the line for that 900$? Should that Come out of the fee for things that will have to be fixed? Am I really at a loss for 900$ she keeps saying "she can't find the cash withdrawal to prove she gave it to him". But keeps insisting she does. Without proof am I really at a loss for 900$.

Thanks for reading, if you can make anything out of this, or have any questions, please let me know.

    [NJ] My parents are divorcing

    Posted: 08 Sep 2018 09:35 AM PDT

My parents are divorcing and I want to know what to expect and what I can do to protect myself. They are both Israeli immigrants who got their citizenship a few years ago. I am a 19 yo male, born here, currently attending a community college. My younger brother is 15 and just started high school. I have a fair amount of money and some good inheritance.

Here's what I want: I don't want to live with either of them, they'er both great parents but I feel like choosing sides will just make this more difficult. My mother has a tendency of throwing grand maul tantrums every year-ish, and I don't want to live with a man who will constantly remind me of my amazing childhood. I understand that if I want to live alone I will have to work full time and my education might fall to the back burner. I am a computer science major and I'm already professionally skilled in this industry but without college qualifications I understand I'll have to get some lower level job to sustain myself.

    Here are my questions:

    • If I do decide to live on my own, is there any kind of welfare or government housing that can help me get on my feet without the financial support of my parents?
    • My mother has expressed interest in returning to Israel and she will most likely take my brother with her. In Israel military service is compulsory but I got out of it because I am too American, and I was given the choice. I fully stand by my choice to not enlist and I want my brother to have the same choice. How can I make that happen?
    • My mother is the custodian, I'm not sure what that means but it was the only way to cash in on my inheritance from Israel when I was 16. Should I be worried?
    • My parents paid for my college classes out of pocket, the end-of-refund date still hasn't arrived. Is there any way to protect my classes?
    • Most of what I own I acquired before I was 18. Is there any way to protect my property (such as cloths, jewelry, laptop, etc)?
    • What will my 15 yo brother experience?

I would also like to ask for you to keep your sympathy and stories to yourself, I'll be fine.

    HELP! Very weird situation.

    Posted: 08 Sep 2018 12:36 PM PDT

My girlfriend and I have been renting the home we are currently living in for about a year and 3/4. We've always paid rent on time or a few days late due to coordination with him coming to pick up the rent. After the year passed the property manager asked us if we'd like to stay at the house for an additional six month lease agreement. We gladly signed as he offered to lower rent by $100.

About 3 months into the agreement the actual property owner died from a heroin overdose. The house's deed is in her name. The property manager then verbally said we could stay there as long as we want until the property goes through probate. We continued to pay up until the 6 months agreement. This is where things became very sketchy. The property manager stopped answering our texts about receiving our rent money. As we were trying to pay the rent. About a week later the property manager texted my girlfriend and said his phone got shut off and he needed our rent money.

So we were inclined to investigate who should actually should be getting the rent money. We've ask for proof of who we should pay and have been left in the dark. So, we called the owners mother as she had to will and three children. The owners mother said not to pay anyone until she talked to someone. Needless to say we never heard anything.

My girlfriend received a call from the owners ex-husbands mother who threatened my girlfriend and her daughter for not paying rent. Even though the deed according to the .gov public records is clearly in the woman's name. We do not even know if the probate paperwork has been filed. This past week the mother of the owner left my girlfriend a voicemail saying the guy claiming to own the title to the house let the owner borrow the money so therefore the house is his. Even though the deed clearly states that the woman is the only name on the deed.

We've received a 7 day eviction notice but I'm not sure what is happening or what we should do. Also to note that the property manager has told me the security deposit is gone. He beat around the bush at how we'd even attempt to get it back. He was even offering to pay us out of his own pocket. Yet, how can that be when he couldn't afford to keep his phone on? The mother also said the property manager was stealing the money so we shouldn't pay him until she had spoken with someone. She also said in the voicemail that we should pay the "mortgage guy." Stating she doesn't want to get in the middle of he situation because the owners ex and some woman were bad people.

WTF. Help. What do we do? Currently going to the police station to see if they could help.

[North Dakota] How many on duty hours in the oilfield can you work legally and safely?

    Posted: 08 Sep 2018 01:39 PM PDT

I work for a service company in the oil and gas industry( don't want to give away to many details). Our guys regularly pull 24-60 hours on wellsites with little to no rest or relief for rest. Sometimes it can be several days without sleep in an actual bed with only short naps in the cab of a pickup. Once we do get 10 hours of rest we are required to go on another job right away or work in the shop for 8 hours.

Is any of this legal? What steps should I be taking to protect myself and colleagues?

A random company has been giving out MY phone number, for six months I've been harassed day and night with calls, I FINALLY found who posted it - what do I do?

    Posted: 07 Sep 2018 07:00 PM PDT

About six months ago I got a phone call at 4am, it woke me up and I answered it. It was a random delivery dude asking where to make the drop. I, having no idea who this was or why they called me, told him as such and hung up.

    That was only the start.

For the past six months, I've gotten calls at all hours of the day and night, 3 am, 6 am, 10 am, 6 pm, everything. It has interrupted my meals, my business, and my sleep. I have been woken up in the middle of the night more than 2 dozen times because of this.

The VAST majority of callers spoke little to no English (I live in California, most of our truck drivers are Hispanic so the bad English is fairly normal) and the few that did speak English were very hesitant to tell me who or how they got my number. Why I don't know. But none of them told me.

    UNTIL NOW!!!

FINALLY, this guy called and we had a good chat and he told me EXACTLY what company has done this to me. He gave me their address and told me that they have my number posted in MULTIPLE places.

Sadly, these bastards closed at 5pm so I wasn't able to call them directly right now. They don't open till Monday.

I have their website and a contact form that I can email them through.

I don't want to sue them or anything, I just want the phone calls to stop. But I want them to stop for good and for them to understand that if they don't fix this and fix it very, very quickly - I have no problem siking a lawyer on them.

    My questions are:

    1. What do I say in the contact email?
    2. What do I say in a follow-up phone call, either them calling me or me calling them on Monday.
    3. If I needed to - what can I sue them for? My main goal is just to get this to stop, but if I have to go to the trouble of lawyers, I want a pound of flesh.
    4. Anything else I should know/do?

Thank you in advance, please help me remove this blight on my life and return me to decent sleep.

[Australia] Bar confiscated my ID claiming it was fake and are refusing to return it. It's not fake, I'm just trans.

    Posted: 08 Sep 2018 01:33 AM PDT

I'm a 30 year old transman at the beginning of my medical transition. Because of this I look significantly younger than I am (most place me in early to mid 20's), and hormones have changed the shape of my face enough that I look a bit different to the picture on my drivers licence. I'm in the process of having my gender marker changed so even though I present as male my ID still says F. The law here is you have to ask for ID for anyone who looks 25 or under, so I get carded a lot and am often asked for secondary proof of ID which I'm always happy to provide. I know people have a job to do and the penalties for serving underage people are high, so I take it in stride. Never had any issues before now.

I attempted to go out to a bar to meet some friends a couple of nights ago. I came straight from work and had not been drinking. Of course I was carded when I walked in, and asked for secondary ID. I provided and entered the premises with no trouble. I went to buy a drink and was asked for ID by the bartender. He then asked for secondary ID so I showed him 2 credit cards I have. He said he needed to speak to his manager, taking my cards with him, which has never happened before. He returned with a bouncer who said that I needed to leave immediately as my drivers licence was "clearly fake". I explained my situation and even offered to show them photos from my social media accounts to prove it was me. He said no, I needed to leave. I kicked up a bit of a fuss and asked to speak to the manager, but was told that wasn't happening and basically to get the fuck out. The bouncer refused to give me back my ID, but he did give me back the credit cards and started threatening to call the cops for stolen credit cards. At this point we'd been arguing for a while with no movement, I just gave up and went home.

In the morning I sent the bar a facebook message asking for my ID back, and included photos of myself and other documents that proved it was me. It was seen but not responded to. In the afternoon I called the bar and spoke to the manager, who just laughed down the phone and said they confiscate all fake IDs and I would not be getting it back. He then commented that the bouncer said I was extremely intoxicated and causing a disruption and would not be welcome back on the premises....I was stone cold sober and only started getting mouthy when it was clear they were kicking me out and not giving me back my ID and saying I had stolen cards. The bar has since blocked me on Facebook.

What can I do here? Does this count as property theft? My ID is NOT fake and I would like it back, and I'm not happy about being treated like a criminal just for wanting to get a couple pints with mates, something I've been legally allowed to do for more than a decade. Trying to say I was intoxicated and unruly to deflect responsibility is just the icing on the cake. Does this fall under discrimination law? I don't care if I never go back, I just want my bloody ID and for this not to happen to someone else.

    Cheers.
