Mistakenly I put it next to the front desk with my friends backpack. I browsed for 15 minutes and when I came back I asked where my $120 work backpack was and they told me they sold it. They were rude and blaming me and I searched around town for an hour looking for it. After coming back in they told me it wasn't the first time it's happened and then I posted to a public Facebook forum where more locals told me about how it's happened before. They only offered me a backpack from the backpack section downstairs however none were even close to suitable for my needs for work. Is it completely my fault or is there a way I can ask for compensation? Edit: I am going to request compensation via written email and see where it goes from there. Posted: 06 Sep 2018 05:27 AM PDT I'm about a month returned from 3 months travelling in the U.S. I'm 26 and a British national. Whilst I was there I spent 3 weeks in the Madison WI area with friends. At that time I got close to one of their friends and I just found out I'm pregnant. I have PCOS and have been told that it's highly unlikely for me to conceive naturally when I was 19, I'd come to terms with this and thought when the time was right I'd look at other options. Well now I'm pregnant and I know that this could be my only chance to have a biological child so I'm keeping it. Right now the father doesn't know. I haven't been in contact since I returned to the UK and I don't know what to do. He's definitely the father. I'm not interested in pursuing a romantic relationship with him. Because I have no experience with the laws in the US and laws in general around co-parenting, let alone co-parenting across the world I'd love a starting point. I'm not eligible to move to the US. I have no interest in moving to the US. I'd like the child raised in the UK primarily for education reasons. I don't know how to establish paternity between the two countries. What's going to happen with custody? Will my child be eligible for dual citizenship? Child support? Will I be screwing them out of a loving relationship with both halves of their family tree? Basically I'm in a mess. This is 100% not the way I expected to have a child, and the whole situation surrounding it is making my mind go a million miles an hour. Posted: 06 Sep 2018 06:41 AM PDT I [25-29F] work for a major and well known public transportation company in Canada that has a previous sexual harassment case go public when the company failed to protect one of it's employees. All the victims involved in this particular story were forced (they would not start an investigation without one) to sign confidenality agreements. The man was taking photos of us at work and pornographically photoshopping them for his personal pleasure. He also did this with the social media photos. He shared these images with another male teammate, who, uncomfortable, did not come forward. He eventually confessed to the women involved, but no longer had the photos for proof. It was offered he would contact his cell provider to obtain them. An investigation was launched and the man admitted to taking photos of us at work. HR gave hand written apology letters to the victims from the harasser (I know), and he verbally apologized to others he hurt but weren't involved in the original investigation. They promised the women involved if he did anything sexually offside to anyone he would be removed. He was sending me shirtless photos along with perceived sexual images (one of what appeared to be a graphic vagina but zoomed out to be an elbow). He committed this after signing his agreement he would not do this again. My investigation was found true but the company still will not fire him and I have to the work with him. Their solution was I could work from home and they would "try their best" to make sure we aren't around each other. They said they could not guarantee it and there may be times a manager is not available to ensure it won't happen. After not feeling heard, I asked why he wasn't let go when he has two sexual harassment cases against him. The HR representative said, "You feeling like it is sexual harassment does not make it so." I asked her to clarify and asked if the company reported it in his file as sexual harassment. She said she couldn't tell me that due to "his privacy." I'm not sure what course of action I can take to get myself remove. They won't allow me to switch departments (I have to APPLY if a job posting is OPEN and only if the manager naturally wants me). They also won't allow me to work on another floor. Right now I am going to work from home, but I am still required in the office and still required to be near him. We have a whistle blower holine and Canada has a human rights violation office. I'm not sure if any of this would qualify, but I will be let go if I go to the whistle blower. TL;DR My company is protecting a man who was taking pictures of us at work for sexual fulfillment and photoshopping them to be pornographic. Also, both guys were going to ask our band teacher for college recommendations, but he is really mad that the marching band can't practice in the field, so now he might not. When I walked right across, after a few moments, the kids start following me, some of them stay behind though. I take one look and one of them, 12 years old, starts running. I, being the naive idiot I usually am, thought he wanted to ask me something. In retrospect, I don't know what I was thinking??? What could have he possibly wanted, directions?? I stop walking and turn around, and thankfully the kid was probably inexperienced with this because being still kind of far, he pulls out a knife. i immediately teach for my purse and pepper spray and try to show it so he stops approaching, but he still goes, so I start shouting and when he's finally near, spray him in the face, elbow him, push him away and run all the way to my house. The knife made a big graze right across my forearm. The other kids unfortunately saw where I was heading, and the next day the parents were knocking on my door. Now I find out I'm being sued for "assaulting" their kid, despite saying the entire story. Edit: sorry forgot to add because I was preoccupied in the details, I called the police and filed a report, but haven't heard anything since the lawsuit was filed, police didn't really say anything apart from "you wanna file that report or what" How can I possibly proceed?? She adopted me at age 2 but was emotionally abusive on many levels. I'm now 21 and in my last year at college. She called the cops, saying I was suicidal and took her documents. The cops understood I was not suicidal and I later mailed the copy of her documents that I accidentally took because they were in my own documents (FAFSA). She called my therapist many times and she believes I am hoarding pills and bipolar (I'm neither; she's actually the one with bipolar disorder). I know my therapist sides with me but is good about being neutral. My friend is in contact with my sister, who told him that mother may have found a way to get me back in her care or removed from college. The resident assistant director stopped by my dorm when I wasn't home saying he had a letter for me, according to my roommate. I got an email asking him to call but i did and he's not in the office since it's night now. What can she do? I'm assuming she'll try the mental health card since I have been hospitalized for suicide when I was 17, but I am not depressed now. What legality will she try to find? How can I stop it? State: From NH but attend college in Massachusetts Update: I have spoken with Dean of students, the registrar office, financial aid, student health services, the cops, and residence services. All I have left to do is call my bank to make sure my loan is ok for next semester. My mother can't do anything now that I've removed her and all of my University now understands how crazy she is. Skip forward a few weeks and I ended things. Several days after separating, she texted me telling me she's letting me keep the laptop and just asked that I factory reset it to remove all her info from it. I obliged and set the thing up with all my stuff and made it my own. About a week after that conversation, she saw me hanging out with a friend (who happened to be a girl). She freaked out and is now demanding the laptop back. I intend to keep it, as it seems she only wishes to have it back now out of spite and doesn't actually need it. So 1) Am I in the right, legally speaking, to keep the laptop? And 2) I've already told her to leave me alone; if she keeps bothering me about it, is it technically harassment? Apparently whilst getting in, our passengerside-door hit another parked car when opening it. We did not notice this at all, didnt hear or feel anything and drove off. Days later we get mail from the police. I made an appointment with my insurance and told the lady the exact same thing. We really didnt notice anything and I cant imagine hitting a car and just not realizing it. She told us they will get a professional to look at the damage on both cars, check if theres any dye etc. and we will hear back from them. Before this could happen, I now got another letter from the police that the driver of the other car sued me for a hit and run. I dont know what to do. I know I need to get a lawyer but if this goes to court, me proving that it wasnt me or that I REALLY didnt notice will probably be more expensive than just admitting it and let my insurance pay. How can I be sued for things that there is no proof of yet? I dont know where the damage is, how bad it is or how much it would cost, I know nothing about it. Posted: 06 Sep 2018 09:55 AM PDT Albuquerque, NM - About three years ago the wife and I decided to jump on the tiny homes bandwagon and bought a vintage 1976 Dodge Winnebago. Pretty good condition, but due to its age, it definitely needed some work.Fast forward to now, I've done quite a bit of work structurally and mechanically. Start to work on the brakes and discover that the rear brakes are a monster that I can't slay. I reluctantly decide to take it to a mechanic. Knowing a thing or two about labor costs and parts, I estimated that it would likely be around the $1000 mark. Ok no problem, find a truck fleet mechanic shop and take it in. They seemed nice enough and told me they would do a diagnostic test and go from there. Leave the r.v overnight and get a call the next day saying they need to order parts and gives me a pretty detailed rundown of parts/labor ( 10 hrs@$100/hr plus parts). Quotes me at $1700. Ok more than I wanted, but still need the work done and tell them to go ahead. Three days later another call stating that the quote wasn't at the "r.v. rate" ($130/hr) and that it would take an additional 7 hours to complete. So now the grand total is $2700! Fast forward another four days ( one of those days being labor day ) another call saying they had trouble finding a part so it was going to be another two day and more labor. It has been 10 days in the shop now and looking close to $3000. BTW, we are a small family me, my wife, and twin six year olds with all our possessions inside our tiny home. My main concern at this point is our possessions, so if I can't ( or wont ) pay this ridiculous bill, can I legally get all my stuff out and how? [TX] Very strange case of invalidated birth certificate Posted: 05 Sep 2018 08:13 PM PDT In 1976 my mother decided to change my name (I was 8)--she wanted my last name to match her and her new husband's name. Instead of just getting the court order to change my name, she decided to "invalidate" my birth certificate. A judge literally attached paperwork to my birth certificate declaring it invalid. She did this to try and erase any trace of my biological father. Unfortunately, she then forgot/failed to get me a valid birth certificate. Fast forward 42 years...and despite numerous attestations that I do in fact exist, I still do not have a birth certificate. I cannot begin to describe how difficult and stressful this has been for me. I even took the step of getting adopted--at age 44--by my stepfather to try and see if that would help. It hasn't. This is my question: how would I go about getting my original birth certificate re-validated? Can I even do that? I would prefer not to have my stepfather's name on my birth certificate, as he is not my biological father (I have never met my bio dad). I would like for it to be an actual, factual record. Both my mom and stepfather are still living and still married...but they are somewhat unhelpful. Do I need to involve them? Posted: 06 Sep 2018 01:31 PM PDT I sued my previous landlord for not returning my security deposit of $1500 within the 21 days required by the statute. The statute says that they are liable in damages for an amount equal to my security deposit of $1500 in addition to the full return of my security deposit without any deductions. I was also allowed a bad faith retention fee of $500 allowed by the statute so I sued for $3500 in small claims court. However, between me filing the case against them and the hearing my previous landlord gave me $1000 of my security deposit back and this was disclosed to the judge during the hearing. As such I expected a judgement for $2500 against them. However the case was ruled in my favor with a judgement for the full $3500 and yesterday was the last day that the defendant could appeal the decision and they did not. I now have a judgement that allows me to proceed with collections and collect a full $3500 from my previous landlord's assets if they don't pay it. So my question is, if the landlord pays me the full $3500 without thinking about it do I have any duty to return the $1000 I was already given and if not, if they later request the $1000 back do I have any legal obligation to return it to them? Also, if I wanted to (and I'm not sure that I do, it feels scummy), could I go after them for the full $3500 is they only agree to pay $2500 and are there any legal risks involved for me in doing so since they can no longer appeal the amount? He called the cops, I went to jail, at the first court appearance he requested all charges dropped but restraining order be placed. So they haven't dropped anything as far as I can tell, just gave me another court date in a month and the restraining order, plus random BA's. He's now constantly trying to contact me, he's filing for separation and says he's cutting off all support (I was a stay at home mom) but he wants to chat n asks if I need stuff. He calls with blocked numbers, texts from different numbers, etc. I answered him, stupidly, on snap, which he at least did not save or screenshot, but he asked if I'd be willing to hang out. I said not until you lift the restraining order, tho I'm horrified of what I've done n very sorry n don't blame him for the order, I will not risk going back to jail. He got defensive, aggressively said he would not be lifting it, and indignantly reminded me of what he had done for me (moving out himself so I could have the place we rent together). He also reminded me angrily that i had better take his name off our month to month lease or he'll get me evicted (landlord is his cousin). I said once again, I understand, I hope in time you forgive me, I wish you well. Then blocked him. I know he didn't save any snaps so there is no record of that convo n I don't intend to risk it again. He's still finding new ways to message me trying to get me to talk to him. He showed up at the house to leave some money on the counter while I was gone, I'm afraid he may get drunk n decide to come over when I'm here. What can I do, if anything? A month ago I received a $2120 bill from the municipality I lived in for a property tax bill on my vehicle. It was originally a $250 bill for 2005 and and $320 bill for 2006 that accrued interest at 1.5%/month until they just now decided to contact me through a debt collector and want full payment. There is/was a federal law that exempts military members from vehicle property taxes and I made use of that law and filed my paperwork with the state DMV office who said I was good to go. Apparently the city I lived in uses their own paperwork and I was unaware, oh well. The predicament lies in that I have to prove to this assessors office that I was active duty military in 2005 and 2006 but she will NOT accept a DD214 as proof of service. She wants a pay stub from 2005 or a copy of my military orders for the 2005-2006 time frame. I contacted military records and my old sub base and they stated I was SOL. I submitted a ticket for my pay stub but there is a 60 day wait and it might not happen anyway. I have contacted the city manager and mayor(waiting to hear back on both those). Divorce Attorney error cost me approx. $40K and I don’t know what to do about it Posted: 06 Sep 2018 08:28 AM PDT TLDR: My Attorney sat on crucial documents for two months despite her awareness of an upcoming crucial deadline. Her negligence caused me to miss a crucial settlement deadline and cost me $40K. I am wondering what if any options I have for recovering my losses. I am in the middle of a painful divorce in Oregon and my attorney has turned out to be a disaster. We have had communication issues since the day I signed my $4K retainer (up to that point it was all rainbows and butterflies). She routinely fails to return emails or phone calls, forgets the details of the case (I spend significant time and resources paying to refresh her memory on key topics) and when she does respond it tends to be significantly delayed, incomplete, and often times inaccurate in fundamental ways. I was willing to suffer through the above issues in order to have an attorney with a good relationship to the court, and because this area is short on qualified divorce attorneys. That said, I have now become aware of a huge mistake she made which has destroyed my trust in her, delayed my case by at least two months, and has cost me roughly $40K. Background: I have been crystal clear with my attorney that my intention is to settle this divorce as quickly as possible, as I believe the longer it drags out, the more damaging it is to me, my ex-spouse, and most importantly my children. In addition, there is a strong financial incentive for me to resolve the divorce by 9/15/18. I had a bad auto accident on 9/15/17, requiring multiple surgeries, lots of rehab, and a cascade of medical issues that eventually forced me to take a medical leave from work. My case is worth roughly $120K. My auto accident attorney has made it clear the deadline to file my personal injury claim is 9/15/18 and delay beyond that date is not possible. If I am divorced at that time, then my personal injury award is mine. If I am still married, then I would need to split the award with my ex-spouse which after my auto accident attorney takes their cut would be roughly $40K. I have been explicitly clear with my divorce attorney on this point starting when I first hired her in March of 2018. The Fuck-up: In late May of 2018, My Ex's attorney informed my attorney that his client was highly motivated to settle the case but would need significant financial discovery documents in order to put together an informed settlement offer. They submitted a Discovery request for financial materials with a requested date of 6/15/18. My attorney informed me of this in person on May 25th and I started collecting the requested discovery materials. I provided all the materials to my attorney on June 4th, well in advance of the deadline. I then followed up 2 additional times in June asking whether the discovery materials had been sent to my Ex's attorney. I received no response. A month later on June 29th ( two weeks past due ), my attorney's assistant wrote me and said she couldn't find the Discovery Materials. I told her I sent them to my attorney on 6/4, and forwarded her the original email. She did not explain what happened to the last month or why nobody responded to my emails, but she said she would review the files and send them over ASAP. Two Weeks go by, and I follow-up again regarding the status of the discovery materials, but I receive no reply. Then at the end of July, My Ex's attorney subpoenas my financial records because it was now almost 2 months after we were supposed to provide them. My ex-spouse also wrote me, very angry asking why are we refusing to provide the files, and how her attorney has been writing and calling my attorney asking for the files, but getting no response. I had been doing the same thing, and now I was pissed. My attorneys assistant finally sent the discover files over on August 3rd to my Ex's attorney and cc'd me. I then wrote my attorney asking why these materials were two months late? She was on vacation, and said she would review when she returned mid-August. I wrote her and said how frustrated I was, and how this 2 month delay may very well have cost me ½ of my auto accident award, which would be approximately a $40,000 loss. When she finally returned, she ducked my calls, and emails for 3 full days before finally agreeing to get on the phone with me. When we spoke she was incredibly condescending and dismissive. She said the past was the past, and that we should focus on the case moving forward. She also claimed she never received the materials on 6/4. When I asked why it took yet another month from 6/29 before the files were finally sent to my ex, she said her assistant was on vacation for two weeks in July and that it took a lot of time to review the files for thoroughness. She also said she didn't think it negatively affected my case and that I was overreacting. I reminded her again of the financial consequences of not completing the divorce before 9/15. At that point I lost all confidence in her council, and realized she was not only doing a poor job of representing my interests in my divorce, but was actually a serious hazard to my case. After an exhaustive search, I found a replacement attorney this week. Odd question about shoplifting and getting money back on a gift card Posted: 05 Sep 2018 08:31 PM PDT Tennessee: This was brought up by my significant other who works at a sports store in loss prevention. A woman comes into her store with around 400 dollars in items that she wants to return without a receipt. The items are obviously stolen and the manager believes some of the items are from a different department store. The store completes the return of "obviously stolen" items and gives the owed amount on a store card. The woman walks out of the store with the store card, and the store cancels it immediately. My question is, by completing the transaction, is the store entering into a contract in which they agree to pay a certain amount for specific items. Furthermore, once the transaction is complete, can they legally cancel the gift card even though the items are technically stolen? [link] [comments] |
Posted: 06 Sep 2018 09:40 AM PDT My mother recently passed away. She was fighting cancer since 1995. She has been paying for a life insurnace policy for $25,000 for over 40 years. Just about everyone in my family has a policy with this company. Shortly before she passed, the company changed their auto payment options, which my mother, in her weakened state, had most of her recurring bills set up for payment. As the auto payment was not an option, my mother missed her premium payment. The company failed to notify her of the missed payment and that the policy would be cancelled. We even received an email from the company appologizing that she did not receive the missed payment letter. After she passed, we attempted to contact the insurance company to get things settled, and the company flat out stated there is no certificate and will not discuss further without a court order. A year ago I sold my truck to a friend for $4800 zero down with no written contract. The verbal agreement we had was he'd pay a minimum $200 a month till it was paid off. For the most part he made payments either in cash or PayPal. We completed Texas title transfer paperwork to get in the truck in his name so I wouldn't have any liability. He is two month late on payments and has recently refused to pay the remaining balance of $2,050. He has no reasoning behind this and I feel he is trying to get take advantage of the fact I moved to North Carolina for work. All I have proving this sale occurred is text messages about the agreement, a document showing the title was signed over to him, and a few PayPal payments for the truck. My question is do I have any legal ground to repossess the Truck or file a small claims case for the remaining balance? Thanks in advance for y'alls help! [link] [comments] |
