Legal Advice Update: I didn’t realize I was pregnant (AZ)

Update: I didn’t realize I was pregnant (AZ)

    Posted: 09 Aug 2018 06:06 AM PDT

Update to my post here: https://www.reddit.com/r/legaladvice/comments/93zqvg/i_didnt_realize_i_was_pregnant_az/

I just wanted to thank everyone for all the advice and support. In addition to all the lawyer advice, I had people offering me diapers, baby stuff, or just someone to talk to! I haven't ever had so many people be so kind to me before. I also had a lot of people saying nasty things- those people can keep "going their own way", they are angry and bitter and taking it out on others.

Anyway, I just wanted to let everyone know that I am feeling a lot better, and I have a plan in place. I put in a transfer to a store in California, where my mom works. She's going to retire this fall, so she'll be able to help me out. I'll probably go there before the baby is born, even though I really like my high-risk ob-gyn here. I blocked my ex on social media, and I blocked his number. He hasn't left any more threats in my mailbox, but if he does I will call the cops.

I also reached out to my ex's mom, who he is estranged from. She was actually glad to hear from me, and she says she will help me out if she can. She says my ex has no business calling DCS, because he actually has an open case against him in Maricopa county. He told me he didn't see his 2 kids because his ex was being petty, but now I know there was more to that story.

So sorry for the wall of text and thanks again!

[NJ-PA] Just found out I have a child, 12 years of back child support?

    Posted: 09 Aug 2018 05:09 AM PDT

13 years ago I (PA) had a sexual relationship with a woman named Jammie (NJ). She got pregnant, "had an abortion", and dumped me. We haven't spoken since 2005.

Apparently the abortion was fake, and I have a 12 year old son. DNA has confirmed this, it's 100% definitely my kid.

I am prepared to step up and give my son the support he needs. I have offered her $5k a month going forward (10% of my net income).

She is not accepting this deal, and she says she is going to sue me for 12 years of "arrears". She claims she can get 1/3 of my income, retroactively, going back to when my son was born.

That would be over two million dollars. Can she seriously get the courts to order me to pay her that money? I would have paid if she didn't lie and hide the child.

I want what is best for my child, and plan on establishing a trust fund for him in the coming weeks. But at the same time, I do not want to subsidize her lifestyle after she stole 12 years of my child's life from me.

What are the odds of me getting visitation? So far I've seen my boy for a total of 3 hours in his whole life.

Am I going to have to appear in NJ court, since that's where she (and my son) live?

[FL] Left a Google Review because realtor screamed at me over phone. He just went to my place of employment

    Posted: 08 Aug 2018 04:01 PM PDT

A month ago, a realtor screamed at me over the phone. I left a 1 star google review explaining my experience. A coworker of his went my job and talked to one of my bosses, accusing me of making a fake website, but it was really just the Google Places review search engine results page.

I feel threatened and harassed. I want to cover my ass, should I contact an attorney?

    Update

After talking to my boss, I found out that it is the broker who went in behalf of the realtor which to me is screwed up. I sent him an email telling him to never contact anyone at work regarding this matter.

I am going to talk to an attorney tomorrow and figure this shit out.

    Thanks everyone!

    Posted: 09 Aug 2018 09:48 AM PDT

[FL]My wife does not like to spend the extra wearing makeup every day and her boss has always made snide remarks about her looks when she does wear makeup. Today she threatened to lower her pay from $20/hour back to $13/hour. It is a rather small accounting firm of like 8-10 people. Is this legal is there anything we can do?

Can I sue a car dealership for forging my signature on a warranty document?

    Posted: 09 Aug 2018 08:26 AM PDT

I leased a vehicle in 2015 in the state of Maryland, although I reside in Washington, D.C.. I opted to purchase the "Excess Wear and Tear" warranty because, well, I'd likely excessively wear and tear the car. Without the excess warranty, the monthly payments were around $440 (something like that, I can't remember exactly). With the excess warranty, the payments were $504.01. I paid this every month of my lease.

I turned in my vehicle in March, purchased a new one from the same manufacturer but not the same dealership (new dealership is in VA, don't think that's relevant)... all was well until I received a $2000 bill from the manufacturer for the 2015 vehicle's excess wear and tear. I told the manufacturer I had paid for, monthly, the excess warranty. They sent back scanned copies of the two documents they received from my dealership at the time of the lease. The first is my lease agreement, with my signature at the bottom. The second is a LIMITED warranty, with a signature on the bottom that is NOT mine. It's very obvious when you see the signatures that the handwriting is different. I also always include my middle initial when I sign my name (or even initial something). The real kicker is, and I'm sorry for the language but I am frustrated with myself for this: I CAN'T FIND MY ORIGINAL FUCKING DOCUMENTS. I have every single sheet of paper for the last 10 years except for the massive wad of papers and brochures I came home with after leasing the car. I've moved since, but still.

Anyway. How fucked am I? Can I do anything legally about the forged signature? Can I do anything legally about the money I paid into an imaginary warranty over the years? Help.

My husband got married to another woman before we have begun the divorce process

My husband and I have been separated for a few months after I found out that he was having an affair. I just found out that he has married the other woman, but we haven't even begun the divorce proceedings. Would/should I use this in court against him? Should I file charges against him?

Both partners in a same-sex couple want my sperm for procreation. Paternity lawyers, help! (New York, Clinton/Erie Counties)

    Posted: 09 Aug 2018 05:45 AM PDT

Greetings, lawyers of Reddit. Yes, I made an account simply to pose this question to a community I hope seriously answers questions posted here. Yes, it is a serious question. Yes, I am aware of how much like a porno plot this sounds but I assure you, it is all factual. A little background to start off. The characters in our tale are as follows:

    - Me, a man in his mid 30's.

    - A woman we will call Rain; I've known Rain for almost two decades, very close friend. She is also in her mid 30's and the first half of the couple.

    - Last but not least, a woman we will call Snow. Late 20's, and the other half of the couple. The only things we all have in common is we've all had or are going though a divorce and we have no children.

I am asked to dinner by Rain so I can get to know her girlfriend a bit better. She is visiting from out of town. I've only met Snow once before. They've been dating about a year long distance, but they're both in New York State.

We eat, we drink, we laugh, all that. The mood comes down, the serious faces go on, and I get asked a question.

"We wanted to know if you would give us both babies in 1 years time. Rain would be the first as she is older and has less time to conceive, but eventually we would like you to offer genetic material to both of us. You would not be expected, or even wanted, to be a father in any sense of the word. We will never ask for child support or expect you to be a father to the children. You are genetic material only."

A sperm donation? I'm honored. That's a big ask of anyone. This is is where things get iffy. They continue.

"We would wish to do things naturally; no doctors, no drugs, just natural insemination. If it doesn't take on the first try, you'll just have to keep trying until it sticks."

My mind comes to a screeching halt. I want to help them out; shes a good friend and the other obvious benefits for a man, but I don't know what legal responsibilities I have to these potential naturally conceived children. I would think that there is something that would specify between a conception at a clinic vs a conception at a residence. I would also imagine some document exists that I can draw up that would relieve me of fatherly responsibilities? I doubt they would renege on having me be responsible for children...but just in case. I know this can't be the first time this question has been posed to the legal system. There must be precedent, but I also know that things can vary by state. If my divorce showed me anything, be prepared for the worst.

So TL:DR - If I impregnate a lesbian couple naturally, no doctor involved, is there a document that absolves me of all paternal responsibility? Is it as simple as drawing up a document stating their wishes and having it notarized? Their request seems legit for genetic material only, but I want some protection in place. Any advice is helpful.

    Thanks in advance.

EDIT - Since Reddit will apparently delete posts such as this automatically via a bot; No this is definitely not a troll and I appreciate the advice so far. Rain is stable, I have no reason to believe that after 20 years she would go rogue and do something crazy. Knowing her, she would just deny knowledge of who the father is. Snow on the other hand...she is the unknown, then again, I am unknown to her. So keep the comments coming. It is invaluable knowledge to me in this situation.

[California] Roomate subleased my room without my permission and is making a profit.

    Posted: 08 Aug 2018 11:44 PM PDT

I live in a 2 bedroom apartment in Berkeley, Ca and I did not want any sublets while I was gone over the summer. I just visited my apartment in Berkeley and I found there was a sublet in my room. Turns out my roommate from the bedroom across from me is renting out my room and collecting all the money. I had to stay on the couch because my room was taken. He says because he found the sublet he deserves the money from the past 2 months. The sublet is using my dishes. Does my roommate owe me anything and what can I do?

(AB Canada) my employer requires I wear the store brand, at my cost.

    Posted: 09 Aug 2018 09:31 AM PDT

I recently got hired, during the interview process they asked if I'd be alright wearing only their store label clothes, to which I agreed. The store had a decent clearance rack, and many sales. This was doable for me. Upon hiring, I learn that I must only wear the new season items, which switch out every 3 months accordingly. Anything with a sale sticker is off the table. Once my new item becomes a sale item, I must take it out of my wearing rotation at work. I get a staff discount on purchases of 50%. In some cases that still makes it a 60 dollar top or pants. Im looking for whether or not they can even require this of staff, they expect us to keep a 15 piece wardrobe of new items to wear at work. We are expressly not allowed to just borrow clothes for our shift. Purchase or leave. Can they do this?

Made my laptop into a camera in MY room and roommate found it - now she's threatening to sue.

    Posted: 09 Aug 2018 11:10 AM PDT

    Hi all,

    I live in Minneapolis, Minnesota.

I recently had things go missing here and there in my room so I decided that when I went to a concert last night I'd secretly set up my laptop as a camera and hide the green recording light to see if I could catch her coming into my room. The camera was faced in a way that you could see into the hallway from my room but ONLY a wall and the camera only started if there was motion. Essentially, I was recording common areas - the camera was just simply facing so you could see the entirety of my room + the door into my room that was left open. We lease the apartment and both of our names are on the lease. While I was at the concert she texted me freaking out telling me that I can't have the laptop facing towards my door and it's illegal to record her. I told her that it only starts when you enter my room and she essentially told me if she sees it again she's going to sue me. I checked the footage when I got home and all I can see is her coming straight into my room and removing the cover I had for the green light and shutting the laptop ( she could have simply shut my bedroom door but instead she went into my room and stopped the recording so now I don't know if she snooped) again, the video camera was facing towards the entrance of my bedroom door and the only way she would have been recorded is if she was entering my room - does she have grounds to sue me if I were to do it again?

Wife not being allowed time to breast pump at work

    Posted: 09 Aug 2018 05:37 AM PDT

*edit : this is a large hospital in North Carolina

My wife works at night shifts as a labor and delivery nurse (you'd think they would understand the needs of mothers but nope)

It is a busy high stress job. But she has repeatedly been not allowed time to pump. Her charge nurse today said it "it is recommended but not required". She left crying and in pain.

It is my understanding this is against federal law. But I remember some rumblings that trump wanted to remove these protections. Did that happen?

Is this something we should be talking about with a lawyer? Or is this something that is more "go to HR"? I am. Just very wary of HR myself. But I thought it might give some leverage to say we had been talking to a lawyer.

Also more generally, is it worth suing a place you would like to remain employed at even if they are braking the law? Or..if it doesn't go that far is it a bad idea to threaten to talk to a lawyer?

Her hospital is awful but we have to a new baby and can't afford to lose this job.

Ex wife has possession of girlfriends cell phone and is using text messages against us

    Posted: 09 Aug 2018 03:34 AM PDT

    Long story short:

I live in New York State. I've been divorced for 6 years. Have a 10 year old daughter together.

I have had a girlfriend for 2 years now. She has a super healthy, loving relationship with my daughter. My ex wife hates her for this and claims she's unfit to be around our daughter.

Fast forward: last week my daughter found a cell phone at my house that was no longer used by my gf. She had taken it to Verizon a while back and they deemed it to be broken. So thinking that it was broken and wouldn't even turn on, my gf told my daughter she could take it home and play with it.

Last night my ex wife tells me that the phone turned on and she had all of my gf's text messages and pictures from like 2014-2016 which include some embarrassing / private texts. She immediately shared some of them with another ex of mine from a few years back as well as taking 'video evidence' of stuff from the phone of all sorts of stuff but won't tell us what.

She's agreed to give us the property back but insists she's going to use the texts she's saved against us.

So...What rights do we have here? Has she broken any laws? I am very lost here.

Thank you so much in advance for any help

[KY, MD] Fiancee's step-dad had a breakdown at the airport, now he's at the hospital and we're not sure what's going to happen.

    Posted: 09 Aug 2018 08:34 AM PDT

Last week, my fiancee's step-dad flew to Albany, NY for a get-together with his ex-Navy buds. He was there for several days and was set to return home Monday. On Monday, around the time he was slated to be back in town, he called my fiancee for a ride home from the airport. She went to our local airport and couldn't find him anywhere. When she got him on the phone, he was being very belligerent and he sounded drunk. Him being drunk wasn't surprising as he is a raging alcoholic. He said he was at our airport (in Louisville, KY) and he was standing in front of the airport by the taxis and she needed to stop wasting time and get him. She drove around looking for him and finally got him to describe his surroundings better which included a "Sheriffs car from Albany County" (meaning he clearly wasn't in Louisville.) He obviously missed his flight and she told him to go back in, find the ticket counter, and go from there.

She comes home and we don't hear from him until several hours later. He leaves a voicemail on her phone, once again sounding drunk, saying he was in Baltimore and he'd be coming to Louisville soon and he needed a ride. He didn't give any other information.

Tuesday rolls around and we still haven't heard from him and his cell phone was turned off. My fiancee's mom called both the police in Albany and Baltimore and explained the situation. We heard nothing further that day.

Wednesday: Fiancee's mom got a call from a hospital in Baltimore. Step-dad had been found at BWI in just his underwear, walking around delusional. He was picked up by the police and taken to the hospital. We were wrong about him being drunk, it was just the opposite. He was apparently detoxing and this caused the mental health issues. When fiancee's mom spoke to step-dad, apparently the police had given him some "paperwork" to "deal with" however he had already lost it before he got to the hospital. We don't know when he's going to be released, but fiancee's mom is already planning on flying to Baltimore this evening.

She's worried if he's going to be charged with anything regarding his actions at the airport (of which, the details are spotty, so we don't know exactly what he did if anything.) Would the police just take him to the hospital instead of jail if he were being charged with a crime? We're just trying to figure out a general idea of what to expect when she gets there.

    Healthcare Students Cheating

    Posted: 09 Aug 2018 04:32 AM PDT

A group of students likely cheated on exit exams. Adminisrators received a lot of information about how the cheating was done. Very anomalous scores were earned by several students. There is no paper trail linking any particular student to the materials (purchased test banks). This is a healthcare program, and students who are not actually prepared, should not be graduating. What legally defensible action can the school take against these students? Location: Florida, USA

[OR] Landlord won't fix AC, wants me to find new tenant, won't let me show unit until after moveout

    Posted: 09 Aug 2018 10:49 AM PDT

    [Oregon, Washington County, not Portland]

I recently bought a home and gave notice to the landlord that I'm planning on moving out. The landlord is the property owner and is an individual, not a company, so our lease is one he printed off the internet. (Google 'residential lease' and it pops up as one of the first options.) Air conditioning was listed in the Craigslist listing but not in the lease under appliances, which I didn't notice until it was a problem. There is also no early termination stipulation in the lease.

After telling him I bought a house and was moving, he responded that I'm responsible for the rest of the two year lease unless someone else is found and if I knew of anyone to send them his way. Shortly afterward, I told him the air conditioning wasn't working and it needs to be repaired. He responded that when it's 100 degrees outside I shouldn't expect it to cool below 80 and it's probably fine but he'd stop by to check it out. He came by with a temperature probe, the air blowing was 82 when set to 70 whole the outside temperature was about 95. After arguing with him about how ACs work he finally said he'd send someone over.

Fast forward several days, an HVAC guy comes by and there is zero pressure change in the compressor. The AC is basically a fan. The landlord tried to argue with him saying it's technically working just not optimally. HVAC guy says no, it's not capable of cooling. They leave and the landlord tells us he'll see about getting it fixed. Several days later we've heard nothing besides an email saying he's working on it.

It's now been more than a week, approaching 90 degrees inside the house during the day (I also have two pets that stay at home) and I can't be in the house comfortably until dark. I've taken photos of it being 86 on the thermostat and our communications are by email.

I've posted the place on Craigslist and have had several inquiries, one couple has come by and see the place and wanted to know what the next steps were so I directed them to the landlord. The landlord also said he found someone who would attend a showing on a specific day and showed up unannounced after being asked to confirm the day and time.

Now he still hasn't hired anyone to fix the AC, has said he's "waiting for parts to come in", I'm avoiding being at home until it's dark, and he just told me yesterday to stop showing the place until my stuff is moved and I've cleaned the house.

What can I do to make the place livable until I move and at least seem habitable to people who might be interested? Is the air conditioner required to work since the unit existed in the house when I moved in? Have I done enough to find new people (five inquiries forwarded to the landlord) that I can be absolved of the rest of the lease? Please help, this is getting overwhelming!

Edit: I'm also wondering if he's allowed to tell me to stop showing potential new tenants the property until after I leave; I know he owns it but I'm still living here and want to find a replacement ASAP.

Business threatening me for 1 star google review

    Posted: 09 Aug 2018 10:19 AM PDT

    Hello guys

This is my first time posting here,Apologize for any mistakes So the story goes like this, I recently moved to an area and was looking for a Lawn mower company to do my lawn so i called them first and the owner explains that it would be 50$ charge and 75$ if it was a double cut. I said i did not need the double cut as i just moved in. He responds back saying that crew will assess and talk to me first before doing the double cut. crew comes in and does the lawn mowing and leaves. Contrary to what the owner said on the phone, The welcome e-mail from the Company says that "WE DO NOT NOTIFY YOU IF A DOUBLE CUT IS NECESSARY AND UNLESS YOU TELL ME TO NEVER DOUBLE CUT WE WILL DOUBLE CUT IF THE CREW FEELS IT IS NECESSARY" i noticed that and waited for my invoice which showed up as 79$(charged for double cut) so i call them and leave voice messages and do not see any response. I went ahead and wrote a 1star review about the same scenario that they mixed up the words on the phone and e-mail. The owner calls me up today and threatens me to Sue if i do not take the Review down. We live in the state of PA and i have already paid the invoice

What do you recommend me doing next? Do i take the review down or keep it up

    Thanks

Ex won’t change address. Can his legal matters effect me?

    Posted: 09 Aug 2018 05:23 AM PDT

My ex has not lived at my address for years. I've repeatedly asked him to change his address so I would stop receiving his mail and having to coordinate with him to get it to him. A police officer came to my house asking for him. I told the officer he no longer lived with me and provided his contact information. The officer said it was in regards to a civil matter. I then looked online at our county's public index and found that he is being sued by a credit card company. I'm concerned because he has my address associated with him and I own my house. I don't want any of his personal choices to have negative consequences on myself. Legally speaking am I safe here? Is there a possibility anything could affect me, and if so what are my options? Any advice would be appreciated.

Massive foundation damage that previous owner knew aboit and disnt disclose

    Posted: 09 Aug 2018 06:18 AM PDT

My boyfriend bought our house last October (I was not involved in the process). There were some cracks in the basement floor, but other than that there were no obvious signs of foundation to an untrained eye.

Over time we notice doors sticking, cracks in the walls, and other signs. We call a couple contractors to come look, and the second, and much more thorough, one points out a few places in the house where the damage was covered up (covered cracks in walls and ceiling, cut and installed an out door frame crooked to cover a large crack, etc).

We contacted my boyfriend's realtor and she was able to get something from the previous owner where it shows he did $2,800 of foundation work in 2012. It was never mentioned or written down anywhere when the house was being sold (we looked through every closing paper, as did the realtor). We were also quoted $15,000+ by two companies.

This is a large amount of money that we don't have, nor will we anytime soon. Is there any way the previous owner can be held responsible for the cost if he did, in fact, know about the foundation damage and tried to cover it up?

Other possibly relevant information-the house was bought for $110,000 and estimated value was about $119,000. We're in eastern Missouri.

Girlfriend's housemate slashed her tires unprovoked, can you kick someone out of a house?

    Posted: 09 Aug 2018 10:19 AM PDT

My girlfriend lives in San Leandro CA. She lives with two other girls, one of them only for the last 4 months or so. This new girl seemed strange, and isolated herself from the others. Then my girlfriend's car tires were flat one morning, and looked slashed. She got camera footage from the neighbor, and it clearly shows it was her housemate. She filed a report, and gave the police the footage. They didn't seem to care, and said because of the cost of damage there isn't much they can do.

I told her not to confront the housemate yet. What can and should she do here? I know it's hard to kick someone out of a house short notice, but does this behavior make an exception? The landlord doesn't care, he only cares about getting paid and nothing else.

Edit: they are all on one lease together.

    Dissolving a partial guardianship

I have completed the dual diagnosis program and am healthy enough to move out. I cook, clean, work and am medication compliant. I am looking to dissolve the guardianship but don't know how to go about it. Thanks. -South Florida -27 years old

I've tried reporting this to their fraud department but I cant email them directly without access to the account. I know using someone else's email is technically fraud, but I dont know what to do?

    Right of Way (PA)

    Posted: 09 Aug 2018 11:49 AM PDT

We bought a building in a dense urban neighborhood with a landlocked backyard. Before we bought, our real estate agent got a copy of the deed and it showed that in 1992 two larger pieces of property owned by one family were subdivided into three smaller properties. The division split our property off from a small commercial building on the back of the lot. We front on the Main Street and the commercial building fronts on a secondary street. The third property did not change size but was modified by the addition of a 3 foot right of way needed by properties 1 (ours) and 2 (commercial building). We have been developing our property into a retail down/apt. up and the ROW is the only access into the upstairs apartment.

In the meantime the third property (no. 3) was bought by a developer. The developer tore down the old frame house and put up a VERY expensive townhouse with one off street parking space. Our ROW goes through their parking area and all is fine and good when there is one car there. The new buyers are parking two cars there and totally obstructing our ROW. Since the renovation on our property is not done yet we don't use the ROW very often. We haven't said anything to the new buyers yet but soon we will need it for construction on the back of the building and then we'll need it for access to the upstairs apartment.

I am terrified of a legal battle over this. Was the developer obligated to tell them about the ROW? When we told him about it while he was working on the property he didn't make a fuss but he claimed it wasn't on his deed. I am thinking that the deed he saw -- if he even bothered to look-- may be prior to the addition of the ROW in 1992. Before then, one family owned the whole package so there was not need to spell out a ROW. Maybe I am worrying for nothing and they'll say "OK I'll be happy to park car #2 on the street" but somehow I don't think that's likely. The ad for the new house only listed one parking place. They do have a curb cut and could park car #2 in front of the curb cut. That's what previous occupants did.

Workers rights after no call no show.

Construction worker in TN here. I'm about to walk out of this job because the work environment is absolutely toxic as hell. They want me to work 70 hour weeks with no overtime pay because "they can't", is that legal? Also if I do walk right on out of here will I be able to come to the site to pick up my last check?

(Europe) I rented a house for a week for holiday with dad. I got the bill afterwards where I had to pay €15 extra because I had masturbated in the bed. Can they charge me for that?

    Posted: 09 Aug 2018 01:33 PM PDT

Not a high enough price to do anything about it i suppose but yeah..

We paid x euro for the week itself (incl paying 20 eu each person for bed sheets, we had no option to bring it ourselves), and we paid a 500 euro deposit at the day of arrival, where youd get the 500 eu back if you didnt break anything or if you used their wood for bbq etc.

So we got the deposit back of 485 eu with a mail that they sent back our deposit minus 15 for masturbating in the bed sheets. I did that, but hey im 23 years old and i paid 20 eu to sleep under these bed sheets. They can clearly wash it out.

Can I do something legally against this even though its just 15 euro? The fact my dad and i had to read the mail was embarrassing enough but I feel mad about it

Father who owes child support is suing my mother for court costs

    Posted: 08 Aug 2018 04:58 PM PDT

Texas. Father abandoned us when I was 3 months old. Divorce final a few years later with court ordered child support. He paid a few times, but owes back payments in the amount of about $80k. My mother spoke the AG office and they opened a case to persue back child support, which we don't know the results of.

My mother received a notice today that he is requesting the amount owed to be reduced and is suing her for court costs, lawyer fees, etc. The paper says it is in my best interest that all of this happens.

I've seen the man once since I was 3. I'm 29 now. My mother struggles financially and is severely stressed. Please advise.
