Posted: 03 Aug 2018 04:47 AM PDT I know of a restaurant in Louisiana that takes the fee credit and debit cards charge businesses to be run, out of the servers tips. This may only amount to a few dollars every shift, but depending on the cards you get that day, and how many tables split their checks across multiple cards, it can be quite high sometimes (highest I've heard of is $10 for one server on a double) Is this legal? Clarifications: I'm fairly certain it is only being deducted from the tips, but will look into this. I'm not sure if it's being recorded properly, but will look into this as well. All the advice and knowledge given is mega appreciated. Thank you for all your time [link] [comments] |
My (14F) mother’s friend (35M) made me uncomfortable. Advice? Posted: 03 Aug 2018 10:38 AM PDT I'll call my mothers friend Ron. Ron comes around a lot, I've known him for a couple of years so I trust him. I was walking home alone around 3 pm yesterday. I see his car pull up close to me, and he offers me a ride because my home was a 10 minute walk away. Because I trust Ron, I get in the car with him. This is the first time we've been alone. We start a normal conversation, but it slowly changes towards boyfriends and asking me if I have one. When he pulled up to my house, my mother wasn't home. He starts rubbing his hand on my thigh while I'm in the passenger seat and asks if he can come inside and wait for my mom. I told him no because my mom will be awhile. He insists. When we went inside, thank God my older sister was there. When he saw she was there, he decided to leave. As he was leaving, I felt a little 'pinch' on my ass as he was walking from behind me. I was so nervous I didn't know what to do. How should I tell my mom? Should I just ignore it? I'm just really confused. I've always trusted Ron. Edit: I've also posted this on relationships, someone referred me to this subreddit & I live in Florida. TL;DR- my mothers 35 year old friend Ron gave me a ride home and caressed my thigh and pinched my ass. How should I tell my mom? What should I do? [link] [comments] |
Posted: 03 Aug 2018 09:27 AM PDT Connecticut, USA: This happened 8 years ago, but - when I was 16 my psychiatrist (who I had been seeing since I was 12) scheduled appointments with me 4-5 times a week, called me just to talk, said some sexually suggestive things, complimented me on my body and appearance, got an erection after hugging me, and ran his hand up my thigh after pressuring me to show him some self-inflicted injuries. He was doing this while also seeing me in psychotherapy, which I had done with him for years. So, now he's facing charges for having sex with an 18-year-old client after he behaved inappropriately with me. I spoke to the attorney representing her at the beginning of the week, but I'm anxious and in the meantime, I'm wondering:
Edit: I guess I'm mostly concerned with what charge I'd be trying to file against him. I don't know if touching my thigh or getting an erection constitutes molestation or anything like that [link] [comments] |
[TN] Woman in our complex is having cars towed frequently at the owners expense. Posted: 03 Aug 2018 03:13 AM PDT I live in a complex of individually owned townhomes, the owner of ours rents it to us through remax. Several months ago, a woman in our complex had my car towed for being parked on the street, claiming it was against the HOA bylaws, which I have never received a copy of. It cost me $155 to get my car back, so I contacted remax to let them know that I needed a copy of these bylaws to make sure I don't break any other rules. Our agent spent an hour on the phone with the woman who had my car towed only to find out that there currently is no HOA, and as such she has no list of bylaws to give him for us. Other neighbors have called the police on her, but they have told us that since our little complex is private property they can't do anything, which doesn't sound right to me. If anyone has any kind of advice on what the best course of action is, that'd be great, especially since she just had someone's car towed at 4:45 AM. I need to find a way to stop her. Posted: 03 Aug 2018 12:26 PM PDT Houston, Texas Basically the title sums up the situation: my wife has had a dull, lingering pain in her foot for months now, and her original doctor took xrays and never followed up with us. We called her numerous times and the staff kept saying she would call us back but never did. My wife ended up going to a new doctor because the pain would not stop and sure enough, the foots broken. My wife has been living with a broken foot for 4 months now. I know you typically need damages to sue but does pain and suffering count? Would this be considered negligence? [link] [comments] |
[UPDATE] my got drunk and raped me Posted: 02 Aug 2018 06:22 PM PDT [IL] So I submitted a copy of the court transcript where he stated that he was drunk when he raped me to the detective. A few days later, the detective told me that my ex was going to be arrested and I would have to come in and talk to the state's attorney to see if they want to take the case. When I went in to speak with the state's attorney, I ended up meeting with the assistant state's attorney to review my case. I told him everything that happened and went over the evidence presented. After interviewing one of my witnesses and making a few calls, they sat me down and told me they weren't pressing charges and not taking my case, therefore letting him go. They told me that because HE WAS DRUNK, he did not perceive it as nonconsentual sex and therefore didn't necessarily have the INTENT of raping me despite my actions. They told me that there is nothing they can do unless I provide a smoking gun in the future of him explicitly stating that he had planned on raping me. I'm honestly heart broken and emotionally shattered from this. My rapist was freed on the count that was drunk. Is there anything else I can absolutely do to get the state's attorney to take my case? Is there some sort of appeal? [link] [comments] |
[Michigan] Landlord is currently occupying property we are leasing Posted: 03 Aug 2018 07:59 AM PDT My roommate and I signed a lease that started August 1st 2018. The landlord of the property is moving to a new house and was supposed to vacate the unit a week and a half ago but the mortgage for his house is moving slower than expected, so he is still occupying the unit. Meanwhile my roommate and I have nowhere to live until the unit is vacated but no set date has been given and it keeps getting pushed backwards. The landlord says he will prorate rent for the first month for the days we are not in the unit, but that prorated rent isn't enough for us to stay comfortably in a hotel or Airbnb. Our lease says that starting August 1st we are the only people allowed to occupy the house. What can we do? [link] [comments] |
Sketchy Acting school keeps using my post-graduation success to promote their school? Posted: 03 Aug 2018 09:13 AM PDT An sketchy acting school I went to years ago has been using my success as a means to promote their school. I was unhappy with the program and how unprofessional it was (harassment, false promises...). They have been writing thinga like "congrats to ____ on his recent booking" and put me down under "notable alumni". I reached out to these other "notable alumni" and they all had bad things to say of the school. I personally do not want mt success to be associated with them nor do I want my image to be used as a means to promote their shady school and program. Is there anything that can be done? Also is it defamation if I say that I felt the school was unprofessional and did not find that it helped my career? In Canada,Ontario [link] [comments] |
[IL] IT at work is essentially outing me as transgender to coworkers Posted: 03 Aug 2018 06:31 AM PDT On June 15th I legally changed my name, first middle and last. IT has not updated my username and finally has said flat out that they're not going to do it. My boss and building HR are advocating on my behalf, but I'm sick of my user ID (first initial, first 7 of last name) and the name attached to it being my former name, which is undeniably masculine. Other coworkers need to know my user ID to be able to do their jobs correctly. The productivity report lists your full name alongside your user ID. My team has had 5 new employees join us since my name change, and while I'm not under any delusion that the grapevine outs me to every single one of them, official company documents should NOT be confirming it for anyone who doesn't absolutely need to know. My status as trans is medical information and, while unlikely, sharing it with the wrong person could lead to violence against me. I told HR on June 19th, and my boss sent the first email on my behalf on July 7th. Until yesterday, their response has essentially been "we're too busy, but we'll get to it eventually." Yesterday, they said "it's just a name change, we're not going to do it." Even if IT changes their tune and fixes it today, they've dragged their heels far longer than is reasonable after having been notified of the issue. Do I haven any recourse? Unfortunately, there IS an arbitration agreement that I was forced to sign as a condition of employment. What are the odds that even if I have a case that an arbitrator chosen by the company will even side with me? Edit: Before you start offering IT perspectives, please look at my post history. I have answered every question, given every explanation, and clarified every system nuance that I possibly can, but repeating myself ad nauseam is not productive. Edit #2: So I let my frustrations get the better of me because it's taken so long and all I got back after "we'll get to it" for a month was "no." There are a lot of points in threads below that I argued against or dismissed outright because they weren't really what I wanted to hear while I was still actively frustrated. Most of them are completely valid about this or that possibility. Only a few of them were definitely wrong, but those people were only wrong because they were working with incomplete information. With what they had, they were reasonable possibilities. I think the most likely culprits are that IT didn't give it enough thought to realize it was a more difficult task than it sounded like until they actually started to work on the issue, and that the system in question was probably designed in such a way that what seems like something that should be easy to do is actually extraordinarily difficult. What I am going to do is ask for more detail on why they said no, offer some alternatives and be open to reasons why they may not be viable, and ask if they can think of anything that might help resolve the problem, even if it's not what was originally suggested. You know, adulting. [link] [comments] |
I am being accused of stealing iPads from a computer lab at my community college [MI] Posted: 03 Aug 2018 09:38 AM PDT I got a call from two directors at the school yesterday requesting that I come in that day to review security footage and discuss an incident involving me. Having no idea what they were referring to I pressed for details and was finally told that they have me on camera going into an empty computer lab that is now missing some iPads, and that they would like to resolve the situation within the school since I am a student but will contact the police if I don't return the stolen tablets. I told them that I don't really care if they call the police because I didn't steal anything and that I am too busy to come in anyway, and that was the end of the conversation. Today, I get a call from an officer who was at the school and apparently had just spoken to these directors and watched the footage. He told me that it was obvious to him from the video that I had left the lab with the iPads tucked under my shirt, and that the school just wants me to return their tablets, and that he will submit the case to the prosecutor's office if I don't. He requested that I come to the police station to speak to him, and I declined, and the conversation ended there. The facts of the story: I stepped out of class to blow my nose, because there is no kleenex in my classroom and I knew from previous experience that the computer lab next door had paper towels available for me to use. I've gone in that lab for that reason maybe 10 times this semester; the doors are always closed but never locked. I don't really know what to do now. I've never been in any legal trouble and I hope it goes without saying that I didn't steal any iPads. I have not seen the footage myself but don't really understand how it can be obvious to a police officer that I was smuggling tablets out of the lab, when I didn't take anything and was wearing an untucked t-shirt and shorts. What should be my next step? What does it sound like will happen next? [link] [comments] |
USPS refuses to pay me for an insured package because I cannot prove it's value. Posted: 03 Aug 2018 09:31 AM PDT I'm an artist, it's artwork. 60 day notice to vacate, on a 1 year lease [OH] Posted: 03 Aug 2018 08:02 AM PDT So we came home from a wedding to find a 60 day notice on our door, no reason given. Every single neighbor has gotten the same notice. A new company just bought the complex and has been upgrading all the units. Our lease isn't up until December. What are our options here. We cant risk an eviction on our record, but we're not in a position right now to move. Any help appreciated! This is in Ohio. [link] [comments] |
New landlord evicted me out of nowhere, and didn't even use my actual name in the paperwork. Posted: 03 Aug 2018 06:41 AM PDT Location is KY. I've been living in my apartment for 2.5 years and the building was just bought by a new company. The new property manager is apparently an imbecile. But that's besides the point. Last night, as I'm laying on my couch relaxing, I hear my front door lock moving. I'm a woman who lives alone, and I fully panicked at the sight of a man I didn't recognize trying to enter my home, with a key, without notice or permission. He couldn't get in, as I had my door bolted, and retreated when he realized he couldn't get in. He never even knocked. A few minutes later, after I've composed myself and realized the only other person who could have a key would be the landlord, I called him and asked him if he tried to come in. He apologized and said he was trying to enter my neighbors apartment since she has moved out and he got the units confused. This is bullshit, considering the unit numbers are marked on our mailboxes. But I figured I'd let it go with a warning to him not to do that again. Come this morning, there's an eviction notice on my door. There's no reason for eviction in the letter except that I'm month-to-month at this point and they want me out. I pay on time and I'm quiet. And he didn't mention it on the phone last night (coward). Here's the thing: I have a unique name. It becomes a very common name if you switch the first letter. Both the outside of the envelope and the letter itself is addressed to this other, common name. My actual name is nowhere on this eviction notice. As much as I despise this guy right now and would love to move, I don't really have the means right now, which I won't go into because it's not relevant. I'd have a better chance of a successful move if I had a little more notice. So, between him trying to come in my apartment last night and now putting the wrong name on the eviction notice, do I stand a chance of getting more time out of him? Or should I start panicking because I don't have a leg to stand on? [link] [comments] |
Posted: 03 Aug 2018 08:48 AM PDT My boyfriend and I are looking for a rental home and we thought we found the perfect one. We met with the landlord yesterday and during our talks, she informed us that the neighbors sharing the duplex are old and retired and these people take precedent. She dropped a line about breaking the lease if our dogs are too loud which was a red flag, obviously. She questioned our social lives and if we have people over often. She stated these people are on a long term lease and them moving out is not an option. My boyfriend owns a bar and doesn't come home most nights until 3-4AM. The landlord asked about this and what his routine was when he came home (wanting to know if he normally makes multiple trips to the car when he gets home) and even went on to tell him he can't use the garage at night because it may wake the neighbors. Obviously, we are not renting here. But I'm curious if it is it even legal for her to ask this information and make these demands? Edit: for spelling. [link] [comments] |
Avoiding being served Order of Protection Posted: 03 Aug 2018 10:37 AM PDT I was granted an order of protection against an individual 2 weeks ago. When it was granted, it was turned over to the sheriffs office so they could serve the individual. The detective with the sheriffs office got a hold of this individual via phone and the individual told her "to go fuck herself and I will not tell you where I am or accept the paperwork" so the detective called me and told me that she was gonna notate it and send the order back to the court that issued it. Is there anything legally I can do at this point since this individual is being elusive? Not sure why it says I didn't include my location, it says I did on my end. Either way, Tucson Arizona. New Jersey. HOA board members have access to live video feed Posted: 03 Aug 2018 06:42 AM PDT Living in an HOA run community in N.J.. We have a Clubhouse, Gym, and Pool. We are run by a management company since the first home was built 10 years ago. We recently got new board members and they gained access to keys to the Management office and remote access to the live and recorded video feed that is in our clubhouse gym and pool. This was never told to the community. I found out about the video access and keys last night. We have been having community meetings in our clubhouse discussing removal of board members for other questionable acts. The president walks in stating he "forgot something here". After his entrance the meeting dispersed and one of the homeowners said -he must have looked at the cameras and saw us here. That homeowner installed the cameras 3 years ago and told me that they recently got remote access to the video feed. Is this allowed? They are able to log into our system at anytime and watch us? Previously the video was only used if something bad happened and it was usually viewed by management and police. Now they have full time access without letting us know? [link] [comments] |
US Army Enlisted - How do I get Gynecomastia Surgery? Posted: 03 Aug 2018 10:17 AM PDT I posted this on r/Army Figured I would throw it here as well, thank you for any feedback. I've been in the Army for nearly two years now, my rank is E-4. Long story short I started developing gynecomastia in basic training and it keeps getting worse. It started with itchy nipples and now I've got close to golf ball sized lumps under both nipples. I'm not sure what the exact cause is but I didn't have this issue before enlisting (I enlisted at age 22). It's painful and embarrassing and I'm also worried about my health. About a month ago I woke up to a spot of blood on my shirt (over my left nipple) and when I pressed on that nipple a stream of dark blood ran down my chest, so I'm not sure if these lumps could be cancerous or what. I don't have any signs of low testosterone: I'm lean and muscular, good at PT, I easily grow a beard and no I've never used steroids. I have not seen any doctor about this yet. I'm already expecting that the army will not pay for surgery, which is fine, I'm definitely willing to pay for surgery out of pocket. My worry is that if I see an army doc and tell him my concerns that they will just say its normal and lots of guys suffer from it (which is true enough) and would not condone me going into surgery with a civilian doctor, even if I pay for it myself. Maybe it's the wrong line of thinking but the Army has taught me that it's better to ask for forgiveness than permission. I know there would be some recovery time from this surgery but I could potentially take leave and get it done and not have anybody find out. I'm looking for feedback/advice from anyone that knows how the army would handle this or has gone through a similar experience. Should I see what the Army doctor would say first or just get the thing taken care of by a civilian surgeon and hope there aren't any complications/nobody finds out? [link] [comments] |
Doctors office making up additional charges for a colonoscopy Posted: 03 Aug 2018 12:31 AM PDT So my mom (65F) went in for her colonoscopy in April. She wasn't going to go (she had already done her mammogram, pap, ekg, and more and was tired of the doctors office) but her doctor recommended it and said it should be free, she checked with her insurance and they confirmed it was covered in her plan. She goes, I come with because she needs a driver. At the end of the appointment he says that she is clean, no polyps or biopsy needed. Great, we head home. Later, she gets a bill that shows that the colonoscopy was covered, but there's a weird additional charge for roughly $350 they say she owes. Obviously it's a typo because it mentions surgery at a hospital . She didn't have surgery, and it was done at a small clinic. So she calls and her insurance says they probably coded it wrong, no biggie they just need to resubmit it. The code they put in was for hand surgery. She calls the doctors office and they say it's her deductible but there is none. They agreed to resubmit and look at the codes. They resubmit and it's still showing she owes an additional $350 which they are now coding as a "facility charge" and suddenly this small clinic is also calling themselves a hospital. This seems fraudulent, because a colonoscopy is normally free, similar to your annual checkup (outside of copays that she paid when she got there [$50]). This amount seems like it was just pulled from the sky. If she needed additional testing, polyp removal, or other complications I would understand, but I was there, there was no such thing. She's also been talking with both the clinic and her insurance since she got the bill, and last week she received a notice to pay or call in 10 days or the account would go to collections. After her insurance told her they instructed the clinic to put a hold on her account for 90 days. She called the clinic as well to cover all bases. However, in under 10 days she received a letter from a collection agency. (Now potentially damaging her credit). It's becoming apparent that they are trying to scam her and/or her insurance company into paying more. They are plugging in this additional $350 under every code they can with no real explanation of what it's for. The insurance company will not pay the additional charge so the clinic is trying to make my mom pay it. Is there any way to contest this charge? I believe they're preying on elderly people who may not actually read their claims in detail. I'm sure there are 80 year olds paying these fees unaware they shouldn't be. We're talking about hiring a lawyer, would they be able to do anything? We live in NC. Edit: for any insurance or medical billing folk: My mom has Medicare Advantage The codes are: 45378-SG (posted under a different business name) 5378 (posted under the doctors name) Both were denied by insurance. Now that I have the codes I will cross post to r/insurance [link] [comments] |
Is it legal for an NDA to state that you cannot report the business to government entities? Posted: 03 Aug 2018 06:43 AM PDT I am going to avoid a huge wall of text here and I'm going to keep the company anonymous. I'm located in the US. Pennsylvania to be exact. My girlfriend works for a certain sudo-science supporting "child enrichment" company. Basically, their business practices are incredibly shady and while there's no big issues at her particular location, the company is a franchise and other branches could be abusing children, or worse. I have told her that when she leaves, she should absolutely try to get at least the FTC to investigate this business. The problem is her employee handbook, which she signed, states that you cannot speak about business practices outside of work, speak about learning methods, or report them. Otherwise, they will take legal action against you. Can an NDA really apply to government reporting? I don't think that's legal but I want to clarify. [link] [comments] |
[KY] What action can I take if a neighbor is damaging my property (Very low monetary value)? Posted: 03 Aug 2018 09:19 AM PDT A neighbor who moved in about a year ago next to me who doesn't really speak to anyone (I don't really either and have lived here for many years, FWIW), after I put up a small decorative fence about 1 foot high along my property line has run over it not once but several times now. It has been there for a few months without being disturbed and in the last week one of them ran over it, bending a few pieces of it and they've run over it a few more times since bending probably 5-6 pieces of it. I assumed accidental on the first time, but now am becoming suspect that it's intentional. It's a small wire metal fence, like used to decorate the edge of a garden. I feel they perhaps don't realize that is actually on my side of the property line and not on theirs because the original person who had the house built added on to their driveway right up to the property line so they have no yard on that side. I got tired of them running over and killing the grass on that side and put the fence up to stop them from doing that. These fence pieces cost about $5 a piece, so it's not a large amount of money but I'm frustrated on principle since they are damaging my property and have not owned up to it. I attempted to knock on their door when they were home to mention they had damaged my fence but they wouldn't come to their door. Our What should I do to resolve this? I have confirmed with our local laws that the small fence I put up was legal (larger fences are not allowed for front yards). [link] [comments] |
I bought a home and the seller has not settled a debt, while the selling agent wants to go to court. Posted: 03 Aug 2018 08:29 AM PDT I recently bought my first home in Ohio. During the negotiations the selling agent stated to my agent on the phone that he refused to pass along an offer to the sellers (illegal) because it was insulting. The home later sold for 0.67% above that offer. I never do this... but i wrote a review online for the agent, stating what happened saying he had 'claimed he would not pass along an offer'. As i expected he responded to the google review firing back at me for not know what i was doing and denying the whole thing because it's illegal. Whatever. Fast forward a couple weeks. I get a notice from the HOA detailing payments for the next year and i notice that an assessment that was agreed to be paid by the seller at closing (in the contract to purchase) had an outstanding value of $250. I get in touch with my agent who passes it along to the selling agent. He said he'd get in touch with them. two more weeks go by and we follow up. He calls my agent saying he will not get in touch with the sellers about the balance until the google review is taken down (ironic). My agent passes along the information directly to the sellers and we have not heard back over a few days. He suggests i go to small claims court. What are the possible outcomes here? I am only 23 and have no idea what is going on. I understand the selling agent could get in a lot of trouble for withholding offers. Would we be able to come after me for libel? What proof would I need to refute it? Is he acting illegally again by not passing along this unpaid expense item? Any advice please. [link] [comments] |
Posted: 02 Aug 2018 10:47 PM PDT I attempted to enter a bar in Chicago, IL with a valid SC identification. The bar back said it was a fake, handed it to the bartender who subsequently bent and twisted it, broke the laminated coating (punctured from a court stapling paperwork to it) and eventually returned it to my boyfriend. They destroyed my ID and we are flying out of town in 48 hours. What recourse do we have??? [link] [comments] |
Posted: 02 Aug 2018 06:14 PM PDT Location: New York As the title says, after terminating Fios internet, Verizon wireless disconnected all 4 phones in the family erroneously. This mistake was fixed, but according to Verizon, one phone number linked to an iphone 6+ is not recoverable unless a newer model phone is purchased. Phone numbers are linked to identity, as they are used in two step verification for many services including but not limited to icloud, banks, college logins, etc. Losing a phone number is a loss of a portion of your identity verification. And of course, contacts that have your original phone number saved can no longer contact you. Is this kind of behavior legal? Using a phone number as leverage to force a consumer to purchase a new phone despite the initial problem being an error on the verizon side? Is there any precedent to this kind of issue? Can legal action be pursued? [link] [comments] |
