    Update: 3 year old bit by a dog at a daycare

    My husband and I got home on Tuesday night about 430PM. And found that the dog had been in its owners car all day with the back window wide open. She has a Tahoe so the window on the gate on the car was open, could have easily jumped out. We were both very upset, one we had an agreement the dog would never be back so we wouldn't press charges. And two the 10 day mandatory quarantine(that she was lucky enough to do at her home) wasn't over. It hadn't even been a week! So my husband called animal control and went over to the neighbor's house(her employer) and ask how many german shepherds she owned. She instantly gave us this sob story about how they had some kind of inspection at their house and couldn't keep him at home that day. He told her that animal control was on their way so she wouldn't leave. Side note: animal control had already been there because it was 93° out and she had left the dog in the car all day so one of my neighbors must have called them. Animal control gets here again and she tries arguing with them about the quarantine rules are, she thinks her car is an enclosed pen for the dog, again the gate window is wide open. The officer tells her that she is breaking quarantine and she acts like the other officer didnt tell her the"rules", which are the dog needs to be kept in the house;if in the yard it needs to be in a completely enclosed pen, or on a leash held by the owner. And he must stay on their property. The reason I this is because the officer last Wednesday told her exactly what the rules were. She was cited and escorted home by the officer. The next morning the dog had to be quarantined af the vets office which made us very happy because clearly she isn't going to follow the rules and it's going to continue to put our child at risk, no one knows why the dog bit our child. Well we decided to get an attorney so we can sue and make her understand the gravity of the situation which I think she is oblivious to or just doesn't care clearly. We weren't even going to make her pay the medical bill if she just followed the rules and honored our gentleman's agreement.

    Update on the 3 year olds condition: she had bad diarrhea even with the extra probiotic, and now has to have medicated cream for diaper rash(she was completely potty trained before this ordeal) she seems to be in better spirits but still has bruising and swelling and won't let us wipe her face without a fight because it hurts. She used to LOVE dogs and would ask to pay every dog we came up to. She now doesn't even say dog when we walk past and has no interest in petting them it breaks my heart.

    I received a phone call earlier this week that our dog had been found hit by a car on the side of the highway about 40 miles from where we live and had to be euthanized shortly after being picked up by animal control. She did not have her collar on but they were able to identify her/call us based on the microchip we originally had placed.

    Animal control thinks based on where she found she was likely abandoned on the side of the road, as it's not close or easily accessible to any residential areas. On Animal control's recommendation, we had them perform a necropsy . They are reasonably certain she had given birth in the past month or two, was slightly underweight from nursing but otherwise healthy.

    Thank you everyone who offered advice and kind words. My wife and I read every last comment. A special thanks to those who reached out and helped us contact regional shelters and vets.

    In Ca. I was called in for a statement from a detective about reporting a crime and I was yelled at and argued with.

    I no longer want to speak to this detective but he is in charge of my rape case. He was absolutely vile. When I got there I was basically told I was a liar and that my case will go no where. After I left he told me he'd "be in touch" but I don't want to deal with him any longer. What are my options?

    Sold an $600 iPhone 8+ on eBay. Buyer returned a $10 shattered, broken Galaxy S2... Any recourse

    I recently sold an iPhone 8 Plus on eBay. The buyer got it, activated it and after about a week filed a return request.

    I was confused as to why they would want to return it... but eBay kind of ties your hands in this situation so I accepted the return request.

    I got the return; however, instead of a mint condition 8 Plus, an 8 year old, shattered & broken phone was inside of the package. I called eBay thinking this should be handled pretty easily. They couldn't have cared less, as they offer no help or recourse if you sell a diamond ring and get back a turd in a box.

    Since there was a tracking number showing "a package" was mailed to me, they fully refunded the buyer $600 and they still have the phone.

    I was robbed.

    Do I have any legit action here? They live in NY, I live in FL. The phone value was $600. I have the original packaging and item they sent me.

    Since they mailed it, is this mail fraud? Should I file with USPS?

    Should I call the police in NY?

    Should I call the police in FL?

    Should I file a lawsuit?

    Or do I just have to eat the loss and just let this person steal with no consequence?

    (Virginia, USA) Help, my landlord is blocking access to half of my house.

    I want to ask what I should do in this situation. I'm renting a two floor house in Charlottesville, Virginia, US. My partner and I are both on the lease for the entire home. Utilities are in the lower floor (including the water heater, internet hookup, and our washer & dryer) as well as general non-livable storage space. My landlord has decided to move into the lower portion of our house and now is locking and blocking access to our utility room by locking the exterior door. So now my partner and I have been unable to do laundry for example - he is refusing to give us access.

    Do I have any recourse? I don't know what I can do.

    Should sex with a minor be reported this far in the future? If so, how do you prove anything?

    I already know about the statute of limitations for the state (Montana), so I am good there, but....

    When I was 15, I used to babysit for a family friend. Her husband was typically the one who would come home first, and many times he'd invite me upstairs (or into their bedroom) and then molest me. A few times, we had sex - in fact, he was the first person I ever had anal sex with, and he was insanely excited because his wife wouldn't allow it.

    I think I only said something to one or two people ever about it, and just moved on, but I just learned today he's now a science teacher for kids that same age, and it freaks me out a bit. What if me never saying something puts those kids in danger? But... even if I'm in the statute of limitations, this was in the early 2000s, so how can I prove anything? I'm not sure what to do here....

    I just recieved a demand letter from Enterprise Rent-a-Car stating that if I do not return their rental car, I will be charged with Embezzlement and Grand Theft Auto. I never rented a car from them. (San Jose, California)

    I did not rent this car. The letter also states that I rented the car in Sacramento but I do live in San Jose. My drivers license has not been stolen and I do not have any credit cards in my name, and I just checked my credit reports online but do not see anything unusual. I called the manager who sent me this letter and they told me that I need to file a police report and email it to them as proof that this was not me. I told them I will do that but asked if they could provide more information that I can give to the police because in the letter, it says that the rental was made through a corporate account. However, they will not give me this info and I am posting to ask you all advice on what steps I should take to approach this before I file the police report this afternoon? I am waiting on my dad to get here to go with me to the station because I was with him all day on May 29th and he can vouch that I did not do this.

    UPDATE: Neighbor's Dog Kills My Dog [Kansas]

    Previously on...

    TL;DR: Terrible neighbors, separated from my mom's yard via a chain link fence on the property line. Mom has fence built 4 feet into her yard as builders refused to build too close to chain-link due to neighbor's aggressive dogs. Neighbors removed the chain link fence.

    Neighbor dogs regular attack and break 6ft wooden privacy fence, finally manage to grab my mom's dog and drag him through the newly dug hole under the fence, kill him in front of my mom. Police called, 1 dog taken by animal control (video proof that only 1 dog killed my mom's dog).

    And now...

    The killer dog has been legally labeled "Dangerous" by the city, so that's a whole bundle of shit the owners have to deal with, but it is still being evaluated on if it needs to be destroyed or not. We had a local Pit Bull rescue really fight to stop it from being put down, so it's at the humane society being watched (where, of course, it's not as aggressive because they actually care for the dogs there). I dream of a world where the city takes the dog away for rehabilitation instead of destroying it (and never letting it go back to the owners), but we'll see what happens.

    The other dog is still attacking and breaking the fence, rushing it while my mom gardens, etc. We have called the cops each time this happens, but so far nothing is changing. I have a camera pointed at the fence so we can kind of see when the dog rushes the fence, and they have cameras ringing their property so I assume they also have a ton of video of this. While I know we can sue them for damages to the fence (and dog death, etc.), they haven't even paid property taxes for the last 2 years so I can't imagine we'll get much water from that stone.

    My questions:

    What is the legal obligation for us to leave the fence up? What liability would we have for removing our fence completely? The fence is 4 feet into our property, they did not pay for any part of it being put up (nor any repair yet). They removed the property line fence on their own and have not replaced it, though they have said they would many times. If our fence were to completely disappear, and the dog to take off, is there a high chance that we are liable?

    Alternatively, if we remove the fence, do we have the law on our side if we call the cops each time the dog is on our property? I know some places have a "fenced in" law, so the owners of livestock/animals have to keep their animals in, not that others have to keep animals out.

    Also, if I want to bury a metal cloth "skirt" thing on the other side of the fence, on our 4 feet of land, could they destroy it or stop me? The only access to that side of the fence is via their yard.

    We have a lawyer friend talking to us about this, but they deal more with DOG LAW and less with FENCE LAW.

    Also, I know this is a moral shit move. I'm just wondering about it being a legal shit move.

    Previous homeowner registered a business at my home address on day of closing.

    Shortly after moving into our new house we received mail addressed to a business at my home address. I marked it "addressee unknown" and put it in the outgoing mail.

    Looking up the business name with the state comptroller I found that the it was a registered in the previous owners name at my new home address, on the day of closing.

    I find this highly suspicious that someone would register a business at an address they no longer own. What should I do? I cant find anything online with my state(Texas) about how to report this, or if I should report it, and to whom?

    I may have found someone trying to sell child porn

    Ok so I browse 4chan nothing too suspicious there, and a couple days ago I came across a snap code so of course added it to see if it was someone interesting. After I added what turned out to be a girl I checked through her story, it was the normal girl in a tight spot and trying to sell nudes nothing out of the ordinary right, well I figure I would look to see what kind of money a person can make doing this kind of work. I scroll through and all is normal, want to see my tittys 10$ like that kind of thing. But the last one on her story offers to sell her 13 and 14 year old sisters panties for money, but it keeps going from there. The next offer was to let you in fact stalk and rape them for a lot of cash. She offered their phone number, address, and schedule. All I have for evidence is a screenshot of the snap and her snap code, is there anything I could actually do to see if I can help those poor girls is this is real?

    EDIT. I reported this to the police, I just needed to know the best course I could take to get this sick fuck arrested

    (NYC) found out my employer has been monitoring my metro card swipes to track my location during work hours - can they do this?

    I do a fair amount of field work which requires extensive travel throughout NYC. I found out today that my work has been keeping track of my metro card swipes during work hours to make sure I am where I say I am when in the field. I have a HUGE issue with this. I pay for my metro card out of pocket through the transit check wage work program that lets u order an unlimited monthly pass through your employer before taxes. So i get my metro pass through work but it is paid for out of my check. i plan on leaving my job over this because I feel like it's a HUGE violation of privacy (my metro card is not only used for work. It's my personal metro card so if they are monitoring it during work hours I assume they have accesss to where I am outside of work as well and on sick days during work hours etc) but I want to know if this is actually legal. I have been at this job for two years now and I assume they have been doing it the entire time.

    I also found out they have been tracking my location via my work cell phone but they pay for that so I assume it's more legal. The kicker is I specifically turn off location tracking on the phone but apparently they override that so even though it looked like it was off... it was actually on the whole time and tracking. (It's an android so idk how they pulled that one but somehow they did).

    I was kidnapped and have 2 Identities

    I post this with a throwaway account to maintain my privacy.

    I will try to be as accurate as possible in this long story.

    The first thing I should say is that I don't have a lot of memories from before I was 7 years old, I think it is a psicological thing, but I have not and probably will not look into it. Things are as they are for a reason, I guess.

    I do remember however that around that time when I was 6 or 7, my mom took my siblings and myself on a long road trip. First we camped in the forest for a while, maybe a month, maybe less, maybe more. Then we drove a long time, and when we were done, I could not understand anything people said to me, so I had to learn spanish.

    I grew up in Mexico, I went to school, had friends, got my heart broken, got over it and fell in love again all in Mexico. I didn't have a mexican birth certificate untill I was 18 (grown-up age in Mexico) when I walked into the registro civil and got one, I took witnesses who had known me since we arrived to Mexico and got my papers. When I was asked about why I was never registered before, I never knew what to say, I always thought it was because my mom was just lazy and did't want to do it, or some other silly reason.

    I went through primary school, middle school, highschool, and college. I have a good job and I live a good life. In this good job, I am asked to travel abroad, so I went to get my passport which should be an easy 30 minute process, ut for me, it was not. I was asked to deliver additional documentation because of my birth certificate being created when I was 18, thought this to be reasonable and delivered what was asked of me, I underwent an interview, I was asked to deliver documents of my siblings and pictures of my childhood. I did all of these things and still did not get a passport. I was told that they have reasonable doubts about my identity and nationality because I could not have gon through primary and middle school with no birth certificate. I was told they did not believe my mother is Mexican.

    You must understand, my mom is a particular person, she is not always honest about everything and she is very secretive most of the time, its hard to talk to her and get an answer to anything withought fighting, and who likes conflict, right? So digging around, I discvered the truth, the whole thing, I was kindnepped by my mother and brought to mexico with a fake identity and have lived that way for over 20 years. I found out that there was even an FBI (?) investigation about my family's whearabouts at some point but it was closed, I think.

    Now, I know what my real identity is, I have my SSN and I even requested a birth ceritificate from the US. I want to be able to travel, leave Mexico and keep my job. I would like to not cease to exist in one country and just reappear somewhere else. I want to be able to keep my college degree and just be the person I have been all my life. Is there some way I can merge my fake identity that was created for me without my knowledge with my real one? I just don't want to have to start over at this point in life, I have savings in Mexico and I have always lived according to the law, I pay my taxes and am a good person, I just want to have a normal life.

    TL:DR: I was kidnapped by my mom and I lived in Mexico I'm an US citizen and I would like to merge my identities.

    Subway Manager schedules us to be "on call" but doesn't pay us for it. (GA)

    The manager of the Subway I work at makes a weekly schedule. On the days and times that we might get really busy he schedules a person to be "on call". This means that if it gets to busy our coworkers can all us in and we have to show up within 30 mins, or we get written up. However we don't get paid for this. We are basically forced to stay in town, and it restricts what we can do on our time off. Want to go to the movies? Nope, You wanna play on a baseball team? Nope. Because you might get called in.

    I feel like on the few days I get off of work, I still don't get to have a life. And theres no compensation for it.

    (Is this legal? Thank you for helping me and my coworkers)

    To make matters worse, I don't have a car and everyone knows this. It takes me 20 minutes to walk to work. So on the days that I'm off of work but "on call" I'm essentially confined to my house because I wouldn't be able to go anywhere and make it back in the 30 minute window that he gives us.

    [USA - MA] Exchanged phones with another user on Reddit who claims $949 phone is missing from the package

    Hi /r/LegalAdvice,

    Long story short, now the Reddit user is claiming that the phone was missing when he opened the box and that the box came in empty. When I first asked for pictures of the package, the box was intact (https://i.imgur.com/CcDdeZj.jpg). Now because for the USPS insurance claim they need the pictures of the inside as well as the outside of the box, I've asked the user to at least send those pictures so I can submit them to USPS for their investigation. However, this morning the user returned a picture of a torn up box (https://i.imgur.com/kdYG5QO.jpg), claiming that the he ripped it open upon receiving the package. Not only that, the user is refusing to send the other item that was in the package because that would be a waste of his time and money. He is also refusing to cooperate by sending the pictures of all the contents of the box as it arrived. I've already filed an investigation with the Postal Inspection Service. Now the question is:
    1. Who is responsible for paying the return postage for the google home mini?
    2. Whose local police agency should I be contacting? His or mine?
    3. What are other actions that would be appropriate for this case?

    EDIT: The user used a fake name for the delivery as well. Would this matter in the investigations at all?

    (Ohio) Attacked by Geese. Legal Standpoint for defending myself

    So, i'm a little ashamed to admit it, but I was attacked by 2 Canadian geese while i was at my mailbox. There is a small army of geese that are wandering around my apartment complex. I kicked them off and ran back to my apartment, but they are right outside. My question specifically is; If I am attacked by birds protected under the Migratory Birds Treaty Act or similar conservation laws do I have the right to defend myself without incurring the ire of the law? What if one were to die?

    Side note: I've been complaining to the landlord about the hostile geese, and they've pretty much shrugged and said they can't do anything about nesting geese till the goslings have left. I've even seen them threaten the postal worker a few times. I think they nest near the mailboxes. I also wouldn't go around trying to make nesting geese attack me for fun, thats freaking stupid.

    Stage 4 cancer insurance policies and suicide?

    Title says it all. I have painful tumors and I may want to leave on my own terms soon. I have a lot of life insurance (group via my employer) and it's vital my family not lose the money. Will they still receive the payout if I commit suicide? I don't have access to any details of the policy since it's a group offering via my employer. TIA

    Landlord sent notice to vacate now says it was a “typo” - VA

    The original lease was set from August 2017- July 31, 2018. Back in January, we declined to renew the lease, and were sent a notice to vacate (both in the mail and via email pdf attachment) stating June 31, 2018. So we planned to be out of there by end of June.

    Fast forward to now, they are saying it was a typo because there is no June 31 (fair), and that the original lease terms stand. The way I see it, is we have a written amendment to the lease stating and end of June move out date. They have been a nightmare to work with throughout the lease and we just want to be done with them. I'm guessing if we don't pay, they can pursue us in court but I'm not sure who is in the right. I don't think a typo on their part should be our responsibility. Any advice would help, thanks all!

    Legal Advice: Parents forcing their 19 year old daughter to stay at home.

    Her parents are super Christians and they say if she moves out, they will call the cops and call her in as a run away. They put so much fear into her and wont let her do anything fun. They are super controlling and over protective. What can I do from a legal standpoint to get her out of there? This in the state of Kansas.

    Gruesome grumpy great grandma predicament. Elder law advice appreciated! [MD]

    My elderly mother ("Sue") lives in an under-resourced county which is a suburb of Washington, DC. She has owned her home for 50 years. She has twice experienced extremely serious vandalism from her frail 84 year old neighbor "Patsy" (the grumpy great grandma), as well as years of verbal abusive behavior, paranoid accusations, and threats. Their neighboring houses are on a long shared driveway and no other houses are in sight. Over the last six or eight years,"Patsy" has gone from being "a bit off" into apparent dementia and paranoia. She repeatedly blames "Sue" for things that go wrong, like a tree branch damaging her car or not being able to find things in her home. Five years ago, "Patsy" intentionally rammed her car into "Sue's" AC unit, causing $9,000 of damage. In 2016 "Patsy" was found incompetent by the courts, and her granddaughter appointed guardian; however, "Patsy" still lives alone without supervision and the granddaughter visits infrequently, and has been arrested multiple times for drug dealing and identity theft. "Patsy" has a social worker who has arranged grocery delivery but in general "Patsy" is not cared for. She has been seen multiple times (outside her home) under-dressed for the weather, for example t-shirt and panties. There is a history of wandering.

    "Sue" returned home on Friday June 1st to find all of her windows broken and screens destroyed, and that an attempt had been made to flood the house with a hose. The security camera (game camera) had been aimed at the driveway and did not capture any images of the vandalism.

    "Patsy" is estranged from her daughters and claims that her granddaughter is stealing her money. The police did not even bother interview "Patsy" related to the broken windows. (The day the windows were broken, Patsy had repeatedly called the police alleging that "Sue" has stolen her property and damaged her house. Sue was in another state at that time.)

    "Sue" refuses to leave her home. "Sue" has never liked talking on the phone and is not able to aggressively advocate for herself. "The county" is kind if broke and does not seem to have many services to offer without repeated demands. I am able to put financial resources into this (for example, additional security cameras or a temporary place to stay) but "Sue" has refused these offers so far.

    I have called/emailed in the county, but APS seemed a little unhappy to take a phone call with 2nd and third hand information. [See above ...     My questions:

    1. in the case of mentally ill/dementia AND estranged family, how is the determination of "safe to live at home" vs. involuntary placement in nursing home? I understand that access to food and ability to bathe are 2 criteria. I also understand that the bar is set very high, legally, for involuntary placement, with good reason.
    2. Does the repeated harassment of "Sue" and vandalism have any impact on the need for placement?
    3. Is there any way to get communication from the county or social workers regarding eventual resolution of the situation and whether or not "Patsy" is being permanently placed?
    4. The desired resolution is to get "Patsy" to stop harassing "Sue". Is there any way a lawyer can help that happen?

    Any suggestions greatly appreciated.

    Neighbors driveway and garage are on our property. What can we do? OH

    We just found out last week that our next door neighbors entire driveway and 3 car garage are on our property. We do not want them to rip out the driveway or the garage. I believe it is probably grandfathered in any way as it has been there for 20+ years.

    The problem is we are paying around $2,500 a year extra in property taxes due to it being counted as a part of our property.

    They do not want to buy the land because they do not want to pay the property taxes on it. We offered to sell it to them for $1.

    We called the county and they pretty much said to figure it out ourselves because it's on our property.

    What can we do here? Do we need to contact a lawyer? Can they be forced to take over the property taxes?

    Ex boyfriend is posting my number on Craigslist and using my info for fake dating profiles, how do I make him stop without proof.

    I have no way to prove that he's doing all this. He used to tell me he does this all the time to annoy his friends and it won't stop even after I changed my number. Is there any legal way I can go to police about this? He won't respond to me as well when I try to reach out to make him cease. I'm located in orange county, California

    [MI] Maintenance came into my apartment (unannounced and not invited) while I was taking a nap in my bedroom. What can I do?

    So I'm a 21 year old female who lives in a one bedroom apartment. These apartments are for mainly students who attend the nearby university (they're open to non-students as well, this apartment complex is not affiliated with the university).

    Yesterday I was taking a nap (in just my panties mind you...I live alone after all) and woke up to 2 men knocking on my BEDROOM door (so lucky I had it closed, I usually leave it open so my cat can walk in and out). They were going from apartment to apartment changing fire alarms...I was given zero notice that this was going to happen. It wasn't even the landlord who came in, it was the maintenance people who work for the apartments.

    From what I understand, they should have given me some sort of notice before entering my apartment. Can they do it without a notice because they're fixing something important like a fire alarm? I looked at my lease and it says the only time they may enter my apartment without notice is if it's an emergency. Also to note, my fire alarms were working just fine before.

    To be honest I'm pretty upset and feel like my privacy was just thrown out the window. Is there anything I can do to make sure this never happens again? I'm going to go to the office today and talk to the landlord, but I want to make sure I have some footing to stand on before I go and talk to them.
