It made me feel so much better knowing that there are great people out there willing to help. On Saturday I contacted the dealership. They were no help and told me even if it was there grandmother there was nothing they could do. After the phone conversation I felt my next move was to go to the dealership with my grandmother. At the dealership I spoke to the sales manager and the conversation didn't go well. I explained the situation to him and he said there was nothing he could do because they did everything legally. He said they could not discriminate based off of mental complicity. Then he went on to say that it was the same as him not being able to discriminate based off if someone was "Black, Asian, etc..". He then went on to compare it to them asking a woman to speak to her husband. At that point my younger cousin got upset and began speaking to him and he got annoyed then stated "You are making me not want to help you" and that "If this is the case where were you when she was here". I told him that we needed to step outside to continue this conversation. Outside of the room I explained that what he said came off extremely disrespectful and that the dealership came and picked her up so how would I know this was happening. A few minutes later I realized speaking to this guy was a waste of our time. I did find out on the bank paper work it said $3,000 ssi a month which is way off. I confronted him about the number and he said my grandmother confirmed it. I asked her in front of him how much she makes and she had no idea. I asked if he verified her income and he said he did not need to. After I left the dealership I had a friend of mine who sells cars look at the paper work and he discovered they had her sign up for a $1700 service agreement even though the terms of the lease would have that car covered through the car manufacturers warranty. He informed me that it seemed they padded the lease as much as possible and that I should inform the bank that she can't afford the lease because it is almost 50% of her fixed income. I called the bank which is through that car manufacturer and explained the entire situation. The lady on the phone asked me if I was trying to break the lease early. I explained I was just trying to get the lease nullified due to unethical business practice and the fact she not afford it. She transferred me over to customer care and I explained the entire thing there as well. The lady was helpful and escalated the issue to the regional customer service person. She said they would call me the next day (Tuesday). I recieved a call on Tuesday but missed it due to being in a work meeting. I called the guy back 3 times yesterday and left messages. I also called him this morning and have not heard back. I then called her county APS office and explained the situation. They said they could not help and that I should seek out legal help. Posted: 07 Mar 2018 06:06 AM PST Our house has been on the market several months now, and a few months ago our neighbour's daughter put in an offer. We had a better one at the time, which fell through. She then reoffered at substantially less, assuming that since the house had been on the market awhile we would be becoming desperate to sell and would go for whatever. Our agent tried to negotiate her up, she got angry and abused our real estate agent over the phone, and eventually we gave up and said no. Fast forward a few weeks, we have changed agents and relisted the home. Her and her family showed up, yelling at our new agent about how desperate we were, abused her apparently quite aggressively before being asked to leave. They then went back to their house and started blasting music directly over the fence. The worst part is, this was our first major home open since relaunching. We had six potential buyers in the house, and I can't imagine any of them will be interested now. They are clearly trying to get us to fail in the market so they can buy the house cheaply. This seems like extortion or something - Do we have any legal options to stop them? And, just so people know, we genuinely aren't trying to screw over potential buyers with neighbours from hell here. We barely interacted with them when we lived there. They played some music every now and then, they had a pet goose that was noisy, but that was years ago. As neighbours they've been fine for years. [CA] Can I get wood in public? Posted: 07 Mar 2018 09:25 AM PST I recently picked up whittling as a hobby. Recently, one of my friends asked if I could carve a walking stick for them. But trying to source natural, uncut wood in a city (Oakland/SF) is pretty tough. I've tried looking up the rules for state parks, but they're kind of ambiguous about whether it's okay at any particular park I can reach. Is it legal to take fallen branches in city or state parks in Alameda or San Francisco counties? What about fallen branches from the big oaks trees lining the sidewalks in parts of Oakland? Can I take small amounts of driftwood from any of the public beaches nearby? I wouldn't cut a living branch. I'm really just interested in things that naturally fell from the tree, or were deposited on a beach by the ocean. Edit: Thanks to phneri for providing resources for relevant state laws! I was born in Seoul, South Korea in the 70s, and then was immediately adopted by two US citizens, my father which was in the US Army. I arrived in the US when I 1-ish, and I have a green card. My birth certificate is a Korean one, that shows I was adopted by my parents - US citizens. My alien number is confirmed by E-verify. I do have a social security number, and pay taxes. I've served jury duty. I have voted (the NC DMV said I was a US citizen when I turned 18, and I went with it.) One USCIS employee told me to fill out the N 400 form, for Naturalization. Another USCIS employee told me to fill out the N 600 form for a Certificate of Citizenship. When I tried to fill out the form online and went through the questionnaire, it sent me to the N 600 form, and suggested I try for a US Passport. I'm very confused. Do any of you have any advice? My teenager told me that she does not want to go over her mom's house ever again. She said that she feels on edge the entire time she is with her mom and has reported behaviors that are very close to emotional abuse. I left the mom when my daughter was about a year old as her mom caused me so much stress, I began having physical symptoms. Every legal address my daughter has had has been with me. Her doctors wouldn't recognize mom as my wife and I handle all medical stuff. I pay for health insurance, medications, etc. This is causing my daughter a lot of distress and she has told her therapist that her depression is so bad at mom's, she thinks of suicide constantly. I'm concerned that a court battle would result in mom getting custody or would have mom taking out her anger on my child even more. Options? [link] [comments] |
Posted: 07 Mar 2018 11:56 AM PST So, my fitness-minded son decided to go to the gym in the Dallas, TX area late at night after his night shift. The gym we're members of shares a parking lot with several other businesses which are all closed after 9pm. Since he got out of work at 11:30pm, he got to the gym around 12:00am. To get an early warm-up, he decided to park as far as possible in front of the gym's door, closest to a major street. He's in there over 2 hours working out and shooting the breeze with the staff (who know him fairly well). When he gets out, the car's gone. After recovering from the semi-heartattack he experienced thinking the car was stolen, he researched and found out his car may have been towed. He got the towing information down, came home in an Uber, and decided he'd have us (his parents) help him sort things out in the morning. (This is important for later). Once we all wake up, he tells us about it. We assume that our knucklehead-of-a-son didn't read some sign about parking or something along those lines, so we call and get the explanation. The first lady we speak to says there's some signage about cars getting towed at the entrances (more than 25 feet from the spot where he was parked) and that the gym was supposed to have had signage about not "parking too far away" from the gym after certain hours. Since he needs his car for school and work, we go pick up and pay nearly $300. Then I start thinking about the gym being a 24-hour establishment. I'm a member there as well and don't remember seeing any signs about parking/towing. I decide to call the gym and investigate about the signage. The manager tells me there is no such warning or signs nor is there anything outlining what is or isn't parking for gym use. This prompts me to call the vehicle storage facility and inquire about a refund. I decide to go for broke and ask to speak to a manager or owner. I get a lady who decides to tell me that "isn't it funny" that my son didn't think to call for information about the car for 5 hours which would lead her to believe that he wasn't even in the gym at that time... which would them justify the towing of the car. All this after I told her that he had proof from the gym website where he checks in as well as staff who would be willing to call as witnesses. She was annoying to deal with. She was aware, that I took them and consented to it beforehand. We were both legal adults at the time. (18+ years old here in Germany) After the breakup I honestly just forgot about them. A few days ago she claimed in front of her new partner, that I was using pictures I took of her without her consent to blackmail her into sexual acts/money - which is not true of course. After confronting her she threatened to report me to the police for blackmail. I immediately deleted all explicit pictures as she clearly does not want me to have them. If she does report me however, could there be legal consequences for me? And could the police produce a warrant to seize my electronics? It finally showed up and I cashed it. What I didn't notice was the check was apparently lost in the mail, as it was dated back in August. Unbeknownst to me, they had issued a stop payment as they considered it lost. I got hit with a returned check fee as did work. My work is issuing a new check but is deducting $15 for the fee they got charged. Is this legal? It does NOT bring me below minimum wage. If this isn't a legal I would appreciate a direct, solid link I can show them to the law in question - I haven't had any luck googling as it's mostly for who's at fault and in this case it's down the middle. Since our baby was born, my wife's productivity on her research is less than before, but she is still a fine phd student. She finishes works on time. Her research is on the right track and moving forward. But her advisor is very unhappy about her motherhood affects her work performance. Her advisor said this many times "You should send your baby back to your country, let grandparents take care of him for one or two years, then you can concentrate your study here." My wife replied "This is not an option." and we both know we would never do that. Her advisor is not an American but has worked in the US for more than ten years. She is a tenure professor. She is single so we guess she doesn't understand how difficult to be parents. She told my wife that she knew some students left kids at their own country with grandparents, only went back to visit at winter or summer vacation before getting the degree. I went to register my vehicle and they told me, "you did not pay enough sales tax when you purchased your vehicle. To register your truck in SD, you'll need to pay another $842 (decided by the current year, type of vehicle and current condition, though they use good for all vehicles) on top or registration fees ($117)." How is this legal? What/who decides what states aren't charging enough sales tax? Is there any way out of this fee? Obviously I wouldve just kept my registration in South Carolina had I known this would've happened, but it expired. Any help would be greatly appreciated. Assult charges were filled . Since then it has been constant harassment and threats. Went to get a restraining order and found that the girls parent was using the grandparents address to get her into the school our daughters attend. So the address on the police report and the address I included on the restraining order were incorrect. Does it matter? Due to the mother having a bunch of guns in Facebook posts I also asked to have firearms confiscated. Posted: 06 Mar 2018 09:03 PM PST This all happened a few days ago. A friend of mine received a phone call that his ex-wife had been murdered and her body discovered, most likely drug-related. Besides the 3 year old daughter that they shared, his ex-wife also had two other children with two different men, both of whom she had full custody of at the time of her death. She was married (but separated from) another man whom she had no children with. My friend and his ex-wife had a joint-custody agreement for their daughter, which was outlined by the courts as part of their divorce decree, and since their divorce he has at no time been deemed an unfit parent or had his custody altered in any way. Here's where it gets even crazier… After contacting a detective working on the case to see what steps he needed to take in order to get his ducks in a row for gaining full custody of his daughter, he was informed that his ex-wife's parents had visited the courthouse with her widower, and were looking into gaining full custody of all three children through her widower. My friend has talked with her parents since the murder, and they have expressed their desire to keep all three half-siblings together, which he reasoned is their rationale for filing for full custody of his daughter along with the other two children, since he lives 5 hours away. What are the chances his ex's parents and her widower are successful? Is there anything he should be cautious of that could potentially endanger his chances of gaining full custody? What factors does the court take into account when determining who gains full custody in a scenario such as this? *Edit: Updated widow to widower, as he's male. *P.S. My friend lives in Florida and had to go to the dentist for an emergency. One of the forms that she received details billing, authorization of patient records, yada yada, oh and that she agrees to pay $7000 for any and all negative or disparaging comments, reviews, etc. that she puts on social media. This is the direct quote from the form (I don't know how or if I can attach an image of it): Patient agrees that he/she will not disparage ______ Dental, any of its doctors, or employees by any means of communication (written or oral, etc.) to any individual, organization, or any other entity, (i.e. online reviews, insurance carriers, etc.). For purposes of this agreement "disparage" shall mean any negative statement, or communication in any format. In the event the patient disparages ______ Dental, its employees or doctors at any time, Patient acknowledges and agrees that it would be impractical or extremely difficult to ascertain the amount of actual damages to ______ Dental. For this reason, Patient agrees that the event it disparages ______ Dental, its doctors or employees the imposition of liquidated damages, and not as a penalty, in the amount of Seven-Thousand Dollars ($7,000.00), per each occurrence, to be paid by Patient to ______ Dental, which represents the reasonable compensation for the loss incurred. Nearly a month ago, the owner of the property attempted to get an insurance policy (interior and exterior line maintenance warranty ) through Home Serve. I was told he was going to wait 30 days from the beginning of the policy and submit a claim to have the leak fixed. Once it was fixed, I would be able to take the work order to the water company and they would pay for some of the overages. The owner says he will pay the remaining percent of overages. The property manager called me today. I was told today that Home Serve would not give the property owner the policy because they do not have an active water account. I was then asked by the property manager to:

[GA] Posted: 07 Mar 2018 11:48 AM PST I am a professional freelance marketing consultant and content writer. 7 months ago I started working with a client and in that time our business relationship has grown to the point where he is my only client and I am basically working for him full time. I am not an employee. He pays me via a phone app. He filed a 1099 for the work I did for him and I filed what he paid me on my taxes too, so that's all legal. A few things I have learned recently has made me question whether he is doing things that may be seriously illegal. I don't have evidence of anything concrete, just weird, sketchy behavior that makes me think he is hiding something BIG. He is an immigrant, and he once told me that he was a visa overstay but his immigration status is now good. Recently he has been weirder than usual. Making random trips out of state for reasons he tells me he can't talk about. He wouldn't let me make him an admin for the Facebook page I made for his business because he didn't want me to link his personal FB account to his business. He told me he couldn't tell me why. Afterwards I noticed he has himself listed on Facebook as living in a state out in the midwest. The rest of the account is totally locked down. He's been overpaying me by large amounts. (He isn't asking for the money back, so it's not a bank scam). When we first met he was really relaxed and had a lot of free time. Now he is always harried and stressed, even though I know the business can't account for his lack of time. We used to meet often to discuss business issues. Now he refuses to meet with me for more than 10 minutes at a time, and always outside somewhere. He has been talking about signing over portions of the business to me, and letting me take the profits entirely even though he will still manage the employees for me. I am feeling kinda weird about it all. If he is doing something illegal, could it come back on me? Everything I am doing for him at the moment is 100% legit, and not even remotely questionable. [OH] Can the township flood my yard? Posted: 07 Mar 2018 12:25 PM PST So ill keep this short. Location is Ohio, USA outside of a town so we are dealing with a township. I made a shitty MS Paint for you guys here. On the right is the farmer's fields which he rents from the township. There is a natural, spring fed pond owned by a private citizen which he agreed with the town that the fields can drain into. The pond remains at a full state due to its spring fed nature. Whenever it rains however, the pond floods and flows through the first houses back yard and then it pools between the two houses. In our backyard there is a sway like valley that once the makeshift pool of water in our backyard reaches 4 feet deep it flows across our yard and down a row of houses into the river. To be clear, this is not a river, this is a recent flooding issue, the water is not coming from the sky onto our yard, the flooding is coming from the pond. Our previous home's owners paid out of pocket to install a drainage pipe underground but in recent months this has been wholly inadequate. I advised my parents to contact a lawyer before this flooding becomes the status quo as that would make it harder to complain in the future. Before contacting a lawyer I wanted to see what your guys' opinions where on what we should aim for, what information we should bring and if there are any previous rulings what cases should we be aware of. We are worried of flooding damage, yard damage in the case of a sinkhole (we know the ground has sunk a little) and the money we are spending to operate a water pump 24 hours for 4 days straight. Animal shelter made a mistake and give my dogs to rescue an I want my dogs back Posted: 07 Mar 2018 09:47 AM PST I got arrested at January 30, 2018 and I had my 2 dogs with me so they took me to the jail and they took my 2dogs to animal control so I got Released at February 28 and I went to animal control to pay the fee and take my dogs back but they told me my dogs are gone and they already give my dogs to the Rescue I talked with the supervisor and They were thinking I got released at February 2, (and their policy is if owner of the dog currently is in the jail they are going to keep the dog until the owner get release and owner has 1week to pickup his dogs after the release date if owner didn't show up they can adopt the dog or whatever they wanna do. So the problem is animal shelter employee made a mistake with not paying attention and I think the person didn't have a training to the gathering information about pet owners so how that possible they didn't check my release type which was IN CUSTODY RELEASE mean I didn't get released on that day I got transferred from this jail to another jail so I were still in custody So they made a huge mistake Why I have to loose my dogs I got released at 02/28 I have all my paperwork's and I the next day I went there to pay the fee and take my dogs back How or what I can do to get my dogs back? The docter is the owner/operator and her boss. He has been cutting her personal checks, instead of legit paychecks and has failed to withhold anything for taxes. He is claiming that this is an error on his account's end, and they are now saying she needs to sign a 1099. Obviously this is unethical as hell, as she wasn't hired as a 1099, isn't compensated accordingly, has no liability insurance, and has not had the ability to save reciepts, document expenses...etc for any writeoffs. WA - Daughter won't stop using our address as hers Posted: 06 Mar 2018 11:35 PM PST Washington State - Our adult daughter, who moved out of our home almost two years ago, keeps using our address to have various pieces of mail sent (which we of course write 'not at this address' on and drop back in the mail box) but now she has had her drivers licensed reissued with our address on it. She asked someone to do it online for her, which they let me know as they were going to e-mail her the temporary copy, and I asked them not to. What can I do with the license when it shows up at my house? Return it to the DMV? Will that void her temporary license? Posted: 06 Mar 2018 07:54 PM PST Greater Philadelphia Area / Pennsylvania My family has been fostering a 14-month girl since she was 4 days old, born with opioids in her system. Earlier this week she stumbled reaching to open a door in our house and got a cut on her face. We immediately sent a picture of it to the caseworker, as the baby had a visit with her bio mom (in an in-patient rehab facility) later that day and were wondering what steps we might take to tactfully handle the situation. She's had bumps and bruises like any other toddler before, but we wanted to manage expectations going into the visit. The caseworker immediately told us that the cut was a cause for serious concern and that the bio parents would have the right to decide if they wanted the baby taken out of our care and within an hour or two, the caseworker texted again to confirm that they did, in fact, want her moved. The driver came to pick her up shortly thereafter with her night things packed, and we were informed that the baby would probably not return. As of now, the baby is in respite and has been confirmed that she is not returning to us ever. A little backstory: both bio parents were seemingly out of the picture for a window of time last year, to the point the agency asked my family if we would consider adoption if the bio parents did not satisfy the judge's asks (at that point, it seemed unlikely that they would get it together). We agreed as a family that we would go all in and take the baby as our own. We've regarded her as part of the family for over a year now. We don't know the timeline the bio parents have laid out for satisfying the judge's requirements. There was a court hearing last week to reassess the parents' status and we were told nothing of what happened. It may also be worth noting that after we shared a closed letter with the judge at the time of a previous touch-base hearing, the caseworker reprimanded my mom via text message and instructed her to not provide the judge with closed letters because it is forbidden, even though we had gotten a letter from the court explicitly inviting us to do so. In our closed letter, we had expressed our clear hope and intention to love, financially support, and adopt the baby into our family. My main questions: 1. To the best of our knowledge, there was never a child abuse investigation conducted. Could they have conducted one within under an hour without us knowing, or is it within their jurisdiction to permanently remove her from our care without conducting one at all? 2. If it is required that an investigation is conducted for the baby to be removed, does this mean my parents (the registered foster parents) may have abuse on their records? If they do, is the agency required to inform us of this? Overall, my entire family is devastated. We're in absolute shock. This child has been a part of our family (and an integral part of our future family planning) for about a year now, and she is (was?) extremely attached and thriving in our care. We love her to pieces and our heads are spinning as to how the rug got pulled out from under us so quickly. At this point, my mom has decided that she cannot emotionally handle having the baby back in our home under the condition of fostering (we would readily adopt her). She knows the caseworker, her supervisor, and the child's attorney are all close friends and feels utterly defeated. Since we no longer intend to foster (mom can't handle the stress of fighting the system any more), I'm trying to evaluate if it would be worth it to seek legal representation to issue a petition or motion. Non-Legal Additional Information: It's been about three months since my wife's passing. I've seen my daughter once since the service, and I had to beg for that. I attempted to set up a meeting with the father in order to hammer out some details, such as would I continue to carry her on my insurance, phone plans, spotify plans, clothing, field trips, anything that I can do to stay in her life. Unfortunately, he couldn't make the first meeting, continued to ignore me for a week, and then when I chased down his mother, he called me back. This was around Christmas time, and I asked to see her, as my family and I could really use that. He suggested the day after Christmas, and I agreed. Then continued to ignore my requests for confirmation and pleas, until 7:30 P.M. Christmas, to which he asked if I still wanted to see her. I spent two and a half hours with her at my parents home, and it was just wonderful. I felt like her Dad again, but it was too short of time. In that time, I wanted to talk to him about things such as the Life Insurance money going into the college account, additional money and time spent, and he said we'd talk about it. New Year's eve, I sent a message over, wishing them a Happy New Year's, and letting them know if she wanted to call, I'd be up. No response. A week later I traveled for work, and wanted to check in to see how she was doing in her new school (he pulled her out of her existing school and moved her into a new one). And that's when I found out I was blocked from any text or phone calls. And pretty much at that point no one in their family would take my calls, so I started to send her letters with pictures. Nothing negative sent in the letters, just keeping her in my thoughts, hoping she's doing okay, keeping her updated on our pets, little and minor changes, etc., but absolutely nothing negative. A friend of mine suggested a law firm local to the area that might be able to help, and they suggested that we go forward with a suit in an attempt to mediate resolution for any time available. He was served last week, and the trial is set for two weeks. They've made a motion to dismiss. Legal-Relevant Additional Information: As for the point of this post, because I wouldn't write here if it weren't additional requests for legal information. We're attempting to mediate a resolution, however in the event they don't go for it, we're attempting to make a case that under KRS 403.270, I could be considered a de facto custodian. It's a long shot, but I want to make sure that I have the relevant documentation or witnesses or information that would help my case. Anyone have any clever ideas or suggested avenues to help? So far, I've come up with Bank statements reflecting: deposits into lunch accounts, school supplies, etc.; Insurance documentation showing I carried her; any conversations between my late wife and I that might reflect monetary plans, vacations, etc.. But if there's anyone else that might have any good ideas, or suggestions that might help--I'd appreciate it. I know it's a long shot, but it's the only shot I've got. [link] [comments] |
[Las Vegas, Nevada] Pharmacy "lost" my script for a Schedule II controlled substance Posted: 06 Mar 2018 10:25 PM PST I dropped off two prescriptions on Sunday, one for a fairly benign drug and one for an ADHD medication that is Schedule II. While there, I asked how much they would cost and got the prices for each. I was told to return later to pick them up since it would take a while. As I was leaving, I texted the two prices to my parents because I'm on their insurance. Because of my memory of being quoted these prices and the text that I can pull up and look at, I know beyond a shadow of a doubt that I gave them both prescriptions. Today, Tuesday, I returned to pick up the prescriptions. The pharmacist told me that they only had one prescription under my name, [Benign Drug]. I corrected her that there should also be [Schedule II Drug]. After 30 minutes of them searching and occasionally asking me questions like "what day did you come in" and "who was working with you when you came" they came up completely empty-handed. There was no proof that my script ever existed--no physical copy of it and nothing in the computers. They told me there was nothing more they could do. I know the next practical steps: call my psychiatrist tomorrow and have them talk to the pharmacy. This will probably resolve pretty quickly. BUT I also feel very skeevy about this. Straight up losing a prescription for a federally regulated drug is really unacceptable imo and I have to wonder if it's illegal. I'm not looking to start a lawsuit or get anything, but is this worth reporting to someone? Are controlled substances as controlled in pharmacies as they are in life? (I've had a lot of trouble with getting this medication in the past because of things like moving across state lines.) Is there some kind of regulator I could make a complaint to? Thanks.
