We had a hearing 2 weeks ago and they granted the variance for them to keep it where it is WITH THE EXCEPTION that the second story is removed. I am happy with this outcome, as the second story has really been the issue. I don't mind them having a garage, and I think this is a fair compromise. [OH] Trying to get my girlfriend a state ID, but can't - Final Update, 1 year later Posted: 25 Feb 2018 09:17 PM PST See here for the original post. Basically we were stuck for 15 months unable to get her an ID so that she could get a job, take classes, or get on public assistance. The toughest challenge was proving her SSN. She never made it past 8th grade before her mom kicked her out at 14, and didn't have any actual doctor visits. Her mom had tossed all of her identifying documents (old passport, Social Security Card, birth certificate, etc). We tried what seemed to be everything (feel free to read the original post above). In the end, she suffered a massive panic attack in March 2017 and I had to rush her to the hospital in West Virginia. We were assigned a case worker because they wanted to make sure I wasn't hurting her or anything, and we were lucky to have the nicest lady. We had no way of proving my girlfriend's identity, but we gave her SSN to the case worker and she was able to look up in the system and verify that the SSN was accurate (she said that she technically wasn't allowed to do this, but wanted to help). When my girlfriend was discharged, the case worker provided an extra form that had all of her information on it (address, SSN, etc, and again she said she wasn't supposed to do this). We drove back to Ohio the next day and went to the BMV to try again to get the state ID. We provided her birth certificate for proof of citizenship, a fishing license for proof of residency in Ohio, and the hospital form as a copy of medical records to prove her SSN. The worker at the BMV had their manager look at it and finally after 15 months, were able to get her an official ID. We went to the Social Security office and ordered her Social Security Card. The next month it came in. She signed up for Medicaid and had her Emergency Room visit covered. 1 year later we're now doing great. She's working (very close by) and should be getting her actual driver license in about a month. It's been hell but we got through it. The state's legal rep I met with before my hearing dropped the ticket when they heard there was footage countermanding the officer's testimony (without reviewing it, interestingly). The legal rep seemed really annoyed that I didn't tell the officer I had a dash cam when I got the ticket, but I didn't want to bring it up for fear of escalation/confiscation I've read about so often. We had some articles about ridiculous policies the city was considering to put into motion and ridiculous crimes that took place in the city. In the about section we had it listed that the site was a work of fiction. An overwhelming amount of people in our city stated that they enjoyed the website. The local news interviewed the mayor and she was upset but said "we were protected under satire law". When the next bigger station interviewed her she said she wanted to get the local police tech guy to track the site. Needless to say, some of our city's local officers drove all the way to MO to interview my friend and they stated we broke a computer fraud law. I haven't had a good hot shower in over a year Posted: 26 Feb 2018 06:32 AM PST I am currently renting an apartment in Overland Park Kansas, if you dont know Kansas, this is an upscale neighborhood (not that it should matter). I have been living in this apartment for about 2 1/2 years now. About a year ago (sometime last February I think) they did something to the water tank for the building. The building has 12 units and uses 1 large hot water tank for the whole building. Since they did, whatever it is that they did, I have not had what I consider to be hot water. I can turn on the hot water tap at any faucet or shower in my apartment, at any time, and I will never need to turn on the cold water to cool it down. I've measured the temperature, and it is always right around 100 degrees. I've complained to the management office on many occasions now. The last time that I complained they actually put notices on all the doors saying they were turning off the hot water to fix the issue. It's been a week since then and the water is colder now. I'm fairly sure that water at that temperature is not killing any bacteria, so washing dishes sucks. But really not being able to take a hot shower in the morning is killing me. Any advice who I can notify of this or what my rights are in regard to basic services. I am pretty sure they are required to provide me with water of a minimum temperature, and they are failing to do so. I just dont know what to do. Any help would be appreciated. Posted: 26 Feb 2018 08:24 AM PST Hi everyone, I have been in a relationship for about 1.5 years with a guy and he moved in with me after a few months of dating (stupid I know). He has cheated on me multiple times and I have asked him to move out many times more, but he just won't leave. He just verbally harasses me (not verbal abuse, just repeating his excuses over and over) until I can't take it anymore. My mental health hasn't been the best because of this (and other reasons), so he just keeps wearing me down until I give up. Anyway, I rent a home (been here for 4 years), and I am the only one on the lease. I'd like to make him leave, but from what I understand, he is a tenant as well. I am in Arizona and have only found a landlord to tenant 30 day notice. Would I use this? He doesn't pay rent but his small paycheck (he pays alot for child support each week) goes to things like food, etc. I know I messed up and I have been paying for my mistake for months, but I really need to do this. Wife sent me a sketchy custody agreement (Texas) Posted: 26 Feb 2018 08:30 AM PST Long story short, things suck with my wife, I moved out after she got physical, then I made a threat (told her to start saving up, implying legal actions) because I want joint custody and now she wants me to sign this document from her attorney. She claims she and her attorney worked this up ONLY to reiterate our CURRENT agreement that we're sharing custody and the baby stays with her except once a week and every other weekend. Standard stuff, right? Except this is the sh*t she sends me in the first paragraph: "The mother shall have sole and exclusive custody of the child and all final decision-making authority related to significant matters impacting the welfare of the child, including but not limited to, matters of education, religion and health care." If I'm not a complete idiot, this line is stating SHE GETS ALL CUSTODY and I just happen to be allowed to see my baby sometimes. Is that correct? We're not divorced and won't be filing yet, still trying to work things out. This contract also doesn't list an expiration date or anything. My first reply after reading this was to ask her to please reiterate the contract's purpose and she said that we will share custody and can rework things if there's a divorce. She states this was worked up by her attorney. So either she's an idiot and bluffing about an attorney (this was sent to me at 4:30 this morning by the way and yesterday was Sunday), or they're trying to trick me into signing over my shared custody of my child. Right? I have a lawyer in mind but would prefer to save a ton of money and confirm right here and now that this is sketchy, a trick that proves her mal-intent, and (since Texas doesn't recognize separations I hear) we're legally sharing custody and there's no reason to sign anything. What can she try to do to me if I don't sign this like she wants? She's threatened legal action but short of divorce, what can she actually do? Is this document she's trying to trick me on something that a judge needs to see later? Thanks in advance! My lawyer told me that the plaintiff has a little time left to refile the lawsuit if she wants, but she doesn't think it'll go anywhere if she does. It turns out the woman suing was one of my brother's ex-girlfriends. My guess is that he owed her money and died before she could collect. She was claiming that the police were called and there should be a report, but the police department in the town say they have no record of the accident. She also didn't go to the ER or her PCP until almost six months after the accident supposedly happened, so it's hard to say if it was really the cause of her injuries (bulging lumbar discs). My employer is trying to screw me out of my PTO. Posted: 26 Feb 2018 10:18 AM PST So today was my last day at my current job, and they just told me that they do not pay PTO on separation. The problem is, this is not only against the written policy in the employee handbook, but also specifically in the vacation policy of our perks and benefits forms. I am quite mad about this, as I have over 95 hours of banked PTO, which accrued so high because I was never able to use it other than for a few individual sick days. Otherwise, I was unable to take any kind of vacation or extended time off, due to management always having me training someone, and "about to" starting training of my own, which was something they dangled over my head but never actually started (part of why I left, but irrelevant). My state's law says there is no law about PTO itself having to be offered, but that if it is the company must pay it upon seperation unless otherwise specifically stated in policy. Our policy specifically states that it will be paid unless certain conditions are met. Do I have any options here, and is this worth fighting for legally (should it go that far)? I am not happy with the returns on the video, as it had been getting a lot of hits and being used in many areas, yet I was only seeing tiny returns on the video despite negotiating a 70%(me)/30%(them) split on profit. 3 years have passed and now the video arrangement can be terminated, but they sent me an agreement to sign for the termination that absolves them from providing compensation, while still allowing them perpetual use based on prior agreements. They also specify that binding arbitration is required if I find they're responsible for breach of rights after I terminate the agreement... So do I need to sign this agreement to terminate my video? They did specify on my original agreement that the termination of rights had to be a mutual agreement with me & the company. Is this a thing that happens regularly in video licensing? Is the company likely to keep using my video even after I sign the termination? Or should I just continue to have them manage the video's rights and then address issues if I don't see revenue for it's use? This happened the night before last (2/24) She was at a club in Southern California and blacked out until 4am when she came to on a couch in a stranger's apartment and immeadiately tried to leave. He tried to shove back down to the couch but she bolted for the door and called an uber. The next morning she felt strangely sick. She had an extremely small amount of alcohol over a span of 3-4 hours so she knew it wasn't due to a hangover. She went to the doctor for a urine test and it came back positive for GHB (a date rape drug). She doesn't believe she was sexually assaulted, though she couldn't say for certain. She does however remember the attacker's apartment complex as it is a fairly new and large one in downtown Los Angeles. This is confirmed from her uber receipt. So what should we do next? Is it possible to get security footage from the apartment/club from that night? Is this basically just a lawyer up scenario? Being told two completely different things by two CPS workers. Posted: 26 Feb 2018 01:01 PM PST I am in Knox County, Indiana. My fourteen year old step-daughter has been having major behavioral issues (has been admitted multiple times into mental health for children facilities). She recently was busted for having alcohol at school that she got from another student and placed in her locker, and failed an alcohol test. She was placed on one week probation. During this probation period a CPS officer and a police officer showed up at my house at 11 PM, asking if we wanted her to remove the step-child for the safety of the other two kids. We were told it would not be held against me or my wife, but against the step-daughter since her behavior was risking harming the other two children in the house. The CPS officer claimed they wanted to put her in a youth village, the same area probation would send her if she failed to comply with their demands. My wife and I told her no, that we would work with the probation system and see what happened. Inside the one week probation, the security cameras I had installed caught her smoking on the front porch. We were told to report anything, no matter how minor, so we called her probation officer. While on the phone with her probation officer, she went in her 17 year old sisters room and took an entire bottle of her perscription prozac. She went to the hospital, and actually had to have a shock (not sure the exact term) done to stabalize her heart. After 3 days in the hospital, she was sent to another child mental heath hospital, who are now wanting to release her after only 3 days, even though the workers say she is still disruptive. I am not being given a good reason why she is being released, except for them to make room for other patients. She has told both the nurse in the hospital and the mental hospital workers that she took the pills in order to get out of going to the youth village. At this point, we called both CPS and the probation office, stating we would like her to go to the youth village, because we feel that if she does not go, it is teaching her that if she attempts to kill herself, it will get her out of trouble. Probation has not gotten back ahold of us after 48 hours, and multiple phone calls. CPS is now telling us the only way for them to take her is for us to not pick her up, and that they will file charges against us for abandonment. When asked why their stance has changed from what was told to us earlier, they simply said that they do not handle abusive or disruptive children, just abusive adults. I repeated myself, saying this was not what was told to me when I was woken by a CPS officer at my door at 11 PM, and was given the same answer, that they do not handle disruptive children, and the only way for them to get involved is for us to abandon or abuse her, in which case charges will be filed against us. I am hoping that the probation office can assist in this matter, but they have not contacted me or my wife, and we now have to pick up the stepdaughter in less than 21 hours. Essentially, her job lost their cleaning lady. They offered her the spot for a few extra hours during the week. However, due to this being over time, she said that they'd be willing to "hire" me but she would be working and Id receive the paycheck to distribute. She said she would be making more if it wasn't overtime so she doesn't want that option of doing OT. I told her I would mull it over and research how this could affect me. Posted: 25 Feb 2018 07:21 PM PST My ex has primary custody of our three year old son and I have partial, allowing me one week visitation per month. The divorce was finalized in December 2017. Up until now I didn't have a permanent address for several months while I made an unexpected move into the city from the suburbs (former roommate had a life-threatening emergency). I have been in complete contact with my ex-husband regarding this situation and have kept him updated accordingly. He knew I nor anyone else was at the suburban address and did not yet have a new one to send paperwork to when he had his attorney send a document regarding him taking our son out of state to live with his family in New Mexico. It apparently went to the suburban address and I had x amount of days to respond with approval or denial. Had I actually received this form or been aware of its existence, I would have arranged to get it and deny him the ability to move my son out of state as it completely usurps my visitation rights and makes the custody case more difficult. He intentionally manipulated this situation and withheld information about it so that the required time had passed without response from me, knowing I wouldn't agree to it. Now he's telling me that he legally can and will take our son out of state and that he wasn't obligated to tell me about the paper in the mail. I wasn't anticipating anything but I realize I'm not blameless here as I should have set up some kind of forwarding P.O. box or something to be able to catch something like this, or made a more concerted effort to make the court aware of my situation. It's my first court situation, a divorce, and it was a very toxic relationship. I did not want to give him primary but had no choice at the time due to a completely impromptu homeless/move situation that I didn't want my toddler to suffer from. I'm in Southern California, the case is in San Joaquin County in Northern California. I have a legal consultation on the 3rd regarding this, but I wanted to see if any of you folks here could contribute some advice on what I can do to keep my manipulative ex from moving my son away. Just looking for info that might encourage the family to take action before it's to late. The mother died in December with three hefty bank accounts and a house. The house was to sold and the money divided between eight children, which takes time. The bank accounts were to be divided equally as well. One brother was made executor and the money has yet to be paid to the other family members. 2014 Ford Focus is a lemon - what are my options? (Massachusetts) Posted: 26 Feb 2018 11:45 AM PST Hi, I purchased a used 2014 Ford Focus back in Sep. 2016 with 40k miles on it. Within a couple of weeks of driving the car I noticed a shudder upon acceleration. It was annoying for a while and then grew into dangerous. I wouldn't be able to safely accelerate from a stop without massive shuddering. I took it into my local ford dealership and they reset the transmission module as well as put new seals on it (I am not a car person so my explanations may be off). That was covered under warranty and the car drove ok for another few months, until the shudder slowly came back on. It got progressively worse until about a month ago at 70k miles I lost all acceleration on the highway with my son in the car. Luckily I was in the slow lane so I was able to glide off safely. An error message of "engine fault service now" appeared. I brought it back to dealership and they said it was the mass airflow sensor. They replaced it, again under warranty. I picked it up and the next morning when I got in the car the check engine light was on and the car just wasn't driving right. I would give it gas and it did not want to kick into gear. So......I brought it back to shop and they said that the old mass air flow sensor contaminated another sensor. They replaced said sensor and everything seemed ok. Fast forward 2 weeks to today and while driving the car I can just tell something is fundamentally wrong. I still experience shudder, sometimes severe, upon acceleration and it seems as if the car really struggles to even accelerate at all. I have done some research and my understanding is that the transmission in this particular year of ford focus is faulty. I am aware there is a massive legal battle going on over these cars. I have since contacted a lemon law lawyer and am in the process of faxing over documents for a case review. Just looking for some insight and advice. In need of advice over a stolen phone Posted: 26 Feb 2018 12:20 PM PST Hi there, for clarity. I live in Ontario Canada. About a week ago I lost my phone. What had happened is I got out of my friends vehicle and it must have been on my lap and I dropped it. I realized 5 minutes later that I had dropped it went outside to pick it up and it was gone. I managed to pull the meta data from my device using Google Location Tracker because my location on my phone was always on, and managed to get the Latitude and Longitude coordinates of my phones location between the time I lost it, and the time it was missing. I lost my phone at 7:50PM. When I went outside to grab it was gone. When I pulled the meta data from my phone onto Google Earth it shows the exact location of each minute, and from 8:00PM to 12:00AM it is in the exact same spot which is my neighbors couch is, then goes dark from there. My question for you guys is what should I do? I have filed a report with the police and I have proof, and know he has it. Should I go up to him and just try to level with him? Thank you in advance!
