I will call her "Amy", not her real name. Amy moved into an apartment in September after a "mix up" at Rutgers left her without a dorm. So this apartment is NOT a dorm or affiliated with the school. It's in a bad section of the city, rumored to be crime riddled. However, there was no other choice since she needed something close and cheap. On January 1st, a new tenant moved into the unit downstairs. I'll call him "Joe" for simplicity's sake. Amy introduced herself to Joe as she came home after class. She says he seemed awkward but friendly at the time. A few days later, Amy returned from class to find Joe in front of his unit. He asked Amy to help him with a problem he's having with his sink. She politely declined, and told him she had no idea how to fix anything, and suggested he call the landlord. Joe claims the landlord won't help. At this point, he tried to usher her into his unit, Amy tried to decline again. Joe then took her by the arm, and insisted again. Amy broke free of his grip, and ran to her unit. Joe banged on the door for a minute before leaving. Amy called the police, and they arrived to take statements. Joe claimed he didn't even know who Amy was. The police told Amy that nothing could be done because "no crime was committed", and left. She told me what happened, and I called the local police station. My dog's injuries were so bad that he had to be put down at the vet the same day. The dogs broke the metal fencing separating the business from my backyard and is now prone to have one of the dogs come through. My family and I immediately called the police and animal control since 2/3 dog's were still roaming my backyard and they were detained and sent to a shelter. The other dog managed to get to the other side, thus animal control could not detain it. Animal control says since the dogs didn't attack any humans, this is considered a civil matter and they can't do anything legal wise to the owner besides the fees he already has to pay to get the dogs back. I'm planning on first talking to the business owner before taking any legal action to see if I can be compensated for my dog being euthanized plus the consultation and the cremation, the cost to fix the backyard's fencing, and emotional distress if possible since I know some small claims courts don't really consider emotional distress. Should I ask for their dog to be removed since it is listed in the state as an aggressive dog and I do still have another dog that was thankfully not hurt in the process. Probably not as exciting as you'd hope, but I'm just glad it's over with. To clarify from the previous thread, the holes were made by thumbtacks. They're super tiny. We probably only made 15 in our time living there, but I guess they found more. We probably fixed these extra holes in our hustle and bustle of cleaning and moving out. I got mixed advice in the thread and decided to talk to an attorney that specializes in landlord-tenant law. He looked over our lease and said it was one of the most tenant unfriendly leases he's seen. Because we attempted to repair the holes ourselves, we were SOL as far as the actual repair costs were concerned. The $2,000 bill was obviously way too much and was just a scare tactic in an attempt to keep the deposit. He suggested that we offer them to keep the rest of our deposit ($200) if they let this go away. In the conversation with the landlord (which I recorded after he was insistent on talking over the phone, not over text), he claimed it cost their maintenance person $300 to patch the holes. Something about having to let the patches dry and come back the next day? They expected no less from us to cover their costs. That amount still seemed absurd, and a handyman I talked to agreed unless they had to repaint the whole apartment. We countered with our lawyer's advice (let them keep the remaining $200 from the deposit), and the landlord said that if we didn't hear back by Friday morning, then they've accepted our offer. We haven't heard anything, so I'm hoping that's a good sign that this ordeal is done. This was a learning experience for us. First, we're going to thoroughly read our future leases. If we find anything questionable, we'll ask for clarification and possibly as an attorney. Secondly, we're going to video document the state of our apartment when we first move in to show any pre-existing damage. Things escalated and she was asking me about my behavior. She asked me if she could call in the school nurse to look at my vitals (blood pressure, pupils). I agreed. Some time while I was waiting to go back to class she makes the decision to call an ambulance to take me to the hospital because I wasn't "acting right" and "looked sick" I instantly opposed to this- literally my top priority being that I knew off the top of my head the insurance wouldn't cover it and I'd have to pay about $500. I checked the balance this week with the courthouse, the bank, and my employer plus have a log of every payment down to the cent. Everything says I had paid the judgment last month. They (the bank) are continuing to withhold and want an additional $3,400 that was not awarded. I have the original judgment documents. It shows the amount sought and awarded plus court costs and gives a total awarded. The interest lines for rate and date are blank. No interest is accounted for on the judgment. The amount they want to continue taking is half the original amount. If it was figured as interest that seems insanely high. But regardless, they didn't seek interest. Can I recover the over payment? He then asked if we could change the electrical panel which we then made a second pricing of $4000, includes materials, permits, and labor for just the panel. After we had started the rewiring he the owners and him wanted to add recessed lighting to certain areas of the kitchen and a second living room they were going to add, this meant we had to change the general pricing of $5000 to rewiring the kitchen to $5900 to compensate for the new wires we had to run. Then the owners wanted some outlets added and some repaired that never worked, we didn't add them to the pricing out of courtesy since we had charged them a lot and it wasn't hard at all to fix them. After the job was done the GC started to answer our emails slower and cut off communication for weeks, wouldn't answer phone calls and intentionally answered and hung up if he did get the call. WOW Airline has left me stranded in Belgium for 8 days with no assistance. Please help! Posted: 08 Jan 2018 11:26 AM PST I am American and was on a trip visiting my boyfriend whom is of Belgian nationality and lives in Belgium. I flew into Brussels about 10 days ago. I was supposed to fly home to Chicago on Sunday, January 16th. My flight was at 11:35 AM (Belgian time) but was then delayed until12:35 PM. This flight was going to land in Iceland and then I would take a connecting flight to O'Hare. The layover time in Iceland was 55 minutes, but due to the delay I would have landed after my connecting flight was already scheduled to take off. The WOW Airline employees at the gate told me that I would have to stay in Brussels overnight but assured me that I would be able to get on a flight home the next day. They then told me to go to the Swissport desk in the departures zone for further assistance with receiving vouchers and to arrange a new flight. I thought it was a bit strange that I would be speaking to employees from a different company but assumed they were owned by WOW Airline or vice versa, so I didn't think much about it. I later discovered this was because there are no WOW Airline employees in the entire airport, with the exception of the flight attendants at the gate. When I went down to speak with the Swissport representatives they told me that I would receive an e-mail from WOW Airline as to how to reschedule my flight. They asked me if I needed a hotel or transportation but I told them that my boyfriend lived here so it wasn't necessary. However, I asked for food vouchers and they refused. I also asked for a flight voucher and they refused. They informed me that any further help I required would only be available virtually as there are no WOW Airline employees in the airport other than flight attendants at the gate through security. I left the airport with no answers, no help, and no e-mail from WOW Airline. My boyfriend returned to Brussels Airport and we drove back to his apartment in Antwerp, which is about 40 minutes away. I kept refreshing my e-mail waiting to hear from WOW Airline and finally after about 4 hours I received an e-mail asking for my booking number and whether I wanted a refund or if I wanted the next available flight home. Of course I chose the option to be sent home immediately. After another 3 hours I received an e-mail stating that the next available flight was on January 15th but no further instructions were included as to how to actually receive my ticket. Both my boyfriend and I laughed and assumed the date was a mistake. We called WOW Airlines customer service, were put on hold for an hour and then hung up on. We called again and the same thing happened. Finally, we called again and got a hold of someone and they said, "If the e-mail says January 15th then that is the only thing we can do." No apology or explanation as to why I had to wait 8 days, nor did I ever get an explanation as to why my flight was delayed in the first place. I told them that this solution was unacceptable because I have two jobs and can't afford to lose 8 days of working. I also explained that I did not plan on an extra 8 days of expenses in a foreign country, especially because the U.S. Dollar is much weaker than the Euro. He told me he would put me on hold for two minutes to see if he could help me. Again, we were hung up on and never heard from him again. In total, we were on hold for nearly 4 hours with no answers. This is not an exaggeration. I sent multiple e-mails to WOW Airline begging for help and have not received a response. They also have a Facebook chat service where I sent the same messages asking for help and never heard back. They have left me stranded here with no answers and no way to get home. The first thing we did this morning was drive all the way back to the airport and ask for help and the Swissport representative said there was absolutely nothing she could do because there are no WOW Airline employees in the airport and she does not have the authority to book flights through WOW Airline nor does she have the authority to give me a free flight through any other airline. She said the only way we can get help is by calling or e-mailing the customer service line of WOW Airline. So I'm now trapped here and cannot afford a flight back. I have looked up flights myself and also checked with an employee at the airport what the cheapest flight was within the next week and there is nothing available under $1,000 (including taxes and baggage fees). I cannot afford to pay for another flight when I already paid over $1,000 for the roundtrip ticket I already bought. He decided to move the store and have me start working from home, mostly doing sales. And drastically cutting all my other duties and ending my work in an office/shop. He said at the first of the year he changed my status to 1099 and is going to be paying me an extra 15% to cover the changes in my taxes due to being 1099. We both on occasion eat lunch at our desks but he frequently brings a PB&J sandwich and I have a very bad allergy to peanuts. My blood test showed I scored a 4.5/5 on the allergy scale, or close to that, i forget the specific info on the diagnosis, but it is considered life threatening and I've been prescribed epi pens My employer sent out emails in the past few months to the entire office making them aware than an employee has a severe peanut allergy but he keeps bringing it in. I've never had to use my epi, but my lips and eyes swell and it is painful and uncomfortable. He says it's all mental but I trust my doctor and science. I put no trespassing signs around the property but I still saw evidence of people trespassing. Next I set up trail cams all throughout and there's 5 different vehicles and many people that frequent. While i drove up there Saturday (1/6/18) to check the cams there was 2 hunters and i approached them to which they said my neighbor said it was okay to hunt our property. After i explained the situation they were very apologetic. After talking to my neighbor he denied such accusations. Anyways I was able to get a license plate number off of one of the trucks from one trail cam. What else can i do to deter these people? He gave a great sob story and asked for a 7 day refund option. All of our receipts on the bottom state "All sales are final". We allowed it and wrote a purchase order but the sales associate forgot to write "7 day limit" on the receipt per our discussion with him. The receipt from our credit card processing machine says "all sales final". Lonnnngggg story short, he paid for the ring, took it to his girlfriend, they came in and tried picking out a different ring but got into a huge fight and she stormed out, he chased her out. They never took the ring with them. Fast forward a few weeks later and he asked for a refund "per our discussion". I informed him that he had 7 days originally, not weeks. He filed a claim with AMEX who ruled in our favor. I told him that he can have the ring or store credit but he said he wants his money back. Now he sent a demand letter from an attorney demanding his money back. In this case, which document governs, the receipt or the purchase order. I was just detained for over 14 hours by homeland security Posted: 08 Jan 2018 05:31 AM PST Throwaway for obvious reasons, still at the airport while I'm typing this; I was visiting my dad in Abu Dhabi for the past 3 weeks, and was flying back yesterday, until homeland security took my phone and started checking through my photos. I've read about this on reddit before, and knowing that I wouldn't get on my flight if I didn't give them my password, I complied with all of their demands. The security officer pulls me over in the second segment of preclearance and asks me a couple of general questions, flipping through my pictures he sees pictures of me smoking a bunch of weed, enough to make him suspicious that I deal, so he went ahead and asked me for my password, I gave it to him. He tells me to come to the back with him where I sit down and wait for 2 hours without any form of explanation, I've already missed my flight at this point. 2 homeland security officers approach me and tell me that I'm not going to make my flight, and that the messages on my phone confirm their suspiciousons about me dealing marijuana, lsd, and mdma. I don't, my friend orders off the deep web, and I was simply telling my other friends overseas that this is the way I acquire my substances. They literally scrolled through 6 years of whatsapp messages, all of my photos, and I'll even go far enough to say that they've probably bugged phone. The officers tell me that I'm going to be sworn under oath, and that if I lie to a federal officer I could spend up to a year in prison. At this point I comply with everything they say because they have 100% of my personal life in their possesion, and there was no way I was going to get it back without being arrested by UAE authorities. They lied to me, telling me that everything I say is confidential and none of it will be shared with the UAE or Canadian governments. They suspected that I smuggled lsd over to Abu Dhabi as I bragged about it to my friends over whatsapp (I do this to fuck around with them and get them excited or shits and giggles) but they're not buying it. Eventually, after being held for 7 hours by them, one of them takes me into a questioning room for a one on one talk, where I told him everything. A full background check, where I live what I do where my parents are from, fingerprints and photographing, where I get my acid from, how I'm trying to quit smoking weed, how I don't need to deal weed because I'm already a spoiled Arab kid, the works. Turns out this prick was just trying to soften me up because eventually they tell me that I'm barred from entering the US until I get a criminal waiver. I don't even have a criminal record.. I've been arrested for possesion of marijuana but the evidence was destroyed and you can't even search it up on a police database. After this, they send me to the Abu Dhabi police, where they were given a full transcript of the interview I had with them, including a picture taken of my phone open on whatsapp talking with my friend about how I was successful in smuggling acid into Abu Dhabi. I asked if I can call my father, and they never gave me my phone call. At this point, my dad thinks I'm still on my plane on the way to Chicago. I spend the next 8 hours being interrogated by a bunch of locals who don't speak English, and had me translate the whatsapp message that was taken completely out of context for them. My SO's mother just moved across the country and left the family pets (cat, dog, two chickens) behind in an empty house in the dead of winter. Her mother said she was going to have the animals shipped over to their new home in a month or so, but has no actual plan in place. The movers took just about everything on the 29th out of the house and her mother and brother flew out on the 30th without a definite plan for how the animals would be fed. It snowed Christmas Day down there and has been freezing or below freezing since. We are all concerned that the animals won't survive the duration of their abandonment in that empty house but don't know what to do about it because their mother has ignored all requests for a better, more humane solution. My SO and her sister both visited their family home a few days following to feed and check on the animals but neither of them live close enough to do so daily. When they did visit, neither the dog or the cat were eating the food left out for them, the house was freezing, and the dog was becoming increasingly aggressive. Their mother now has their aunt and their dad (recently separated, also over an hour away) to check on the cat and dog, which happens maybe once a day and consists of refilling their food and trying to get the dog to go outside, which it has been too afraid to do. Also, their dad insists on keeping the dog locked in a small empty bedroom with nothing but a mattress, food, and water. The chickens were left outside to die in the snow with no food. So on January 1st, my SO's sister decided to take the cat home to her apartment. Since then, the cat has been doing much better but now their mother is harassing and threatening both my SO and her sister about the whereabouts of the cat and is insinuating that she will pursue legal action if the cat isn't returned to the empty house with threats like, "Did you know it's a felony to steal a pet?" And other such cryptic messages. Her sister also arranged for someone to take the abandoned chickens and I want to call animal control for the dog because the conditions it has been left in are inhumane. However, my SO is also concerned about the ramifications of the dog being taken away because her brother loves that dog and has already been stripped of his whole support system by that move. They have had this cat in their family for over 7 years and it is especially important to my SO's sister. I've done some research on this and know that pets are considered property, but it's tricky to figure out what our options are when the family cat is removed from an empty house by one member of the family and out of concern for the animal's well-being. So I guess my question is, if her mother does pursue legal action, what should we be prepared for? TL;DR: SO's mom moved across the country, abandoned family pets. SO's sister rescued animals. [Florida] Neighbor blowing her leaves into our yard, I'm dumping them back over her fence Posted: 08 Jan 2018 08:35 AM PST As the title says, my neighbor (with whom we've had numerous issues in the past) blows her leaves onto our property multiple times a day onto our property. We've recorded her doing this, we've called the city, the police, etc and nobody will do anything. Years ago we put up a fence and palms to try and prevent her from doing it but there's still a gap between it and the road that she blows them all through. I recently started raking up all her leaves and dumping them back onto the side of her house. Petty, I'm aware but it makes me chuckle knowing I'm annoying her when she's harassed my family my whole life. Now she's saying she's gonna call the police and I'm a criminal and blah blah blah. Am I allowed to continue doing this even if she continues recording me and threatening to call the police? Never once do I ever step foot on her property and I make sure to take any of our palm leaves out of the bucket so it's 100% of the leaves she blows over. [link] [comments] |
Life time software licensing agreement. Posted: 08 Jan 2018 08:23 AM PST I had a business that ran for some years 2009 - 2014. During that time at some point my partner needed extra money quickly and offered our product for a lifetime license. I was young and naive at what this actually meant for a software company. Fast forward. My business partner and I have split ways. I don't have a contract per-say- but I have in writing that I am responsible for the software to do whatever I want with. If i wanted to I could resell it, or recreate it under a new name and sell the packages again. I have done nothing with the packages we offered or with the company at all since 2014. The issues comes I am now having some of those lifetime licensing clients come back and need support on the software. The issue they need support with is a validation error based on the dates that we used as a security measure. They can not actually use the package with out me going into their system and fixing some DLLs after windows security updates. Am I able to ask that they pay a support fee for my time now that that company is basically gone or am I under obligation to reactivate the software package? Chain pet store sold me a "purebred dog" that ended up not being purebred. Posted: 08 Jan 2018 12:59 PM PST In June of 2016, my wife and I purchased a miniature Australian Shepherd from a chain pet store in our home state of Ohio. The pet store provided his pedigree and assured us he was a purebred. A month after getting him, his ears stood straight up, which is not common for that breed. He still has not reached his full size. All these factors prompted us to perform a DNA test at our local vet clinic. The results came back that he was mixed with another breed of dog. We paid an ungodly amount of money for our pup, but we love him to death. In everyone's opinion, would it be worth trying to get a refund? I don't want to give my dog up, however. Husbands estate cleared probate in May. Creditor that was denied claim trying to sue now. Posted: 07 Jan 2018 06:55 PM PST My husband had a plumbing company in his name only. When he passed in June 2016, it was part of his estate that was handled entirely through probate since there was no will. Everything was handled with a probate lawyer, and all creditors were officially notified of probate status, waiting period, and sent denial of claims letters as the estate was so small. We waited the allotted time after denial of claims letters were sent and received for claimants to dispute. When none sued the estate, remaining assets were dispersed and probate was closed. It is my understanding that any claims brought after that period have no basis. This is in Michigan. Saturday, I received a letter addressed to the business via a collection agency for one of the claimants. They are going to try to sue, want to subpoena bank accounts and business records, etc. I'm going to call the probate lawyer in the morning as well, but my question is... Do they have any basis/can they sue me, the spouse, after probate has been closed for months? And since I have no authority for the business, which was completely disolved before close of probate, what do I do with this letter if anything? [link] [comments] |
[NY] landlords complaining about heat Posted: 08 Jan 2018 07:36 AM PST I currently live in the basement of a house and my landlords live upstairs. They pay for the heat. When I moved in they said to keep the heat below 63. And to turn it OFF completely when I leave for the day. I said no ill keep it on low but I'm not turning it off. They keep their heat off or extremely low to the point they wear jackets inside. I've never seen the heat go above 61 no matter what I have it set as. My bedroom was 42 degrees last night. I had a sweater and three comforters. It's generally around 45-50. They came into my apartment for the fourth time unannounced since I moved in last month because a pipe froze (no shit). They saw my heat was at 63 and told me it was too high and they put it down to 57. Am I the insane one when usually the heat is kept around 68 during the day and 60 at night? Tldr; landlords keep telling me my heat is too high and won't let me increase it. Even if i do increase it it won't go above 60. Any recourse? [link] [comments] |

My mother confessed yesterday that around 3-4 years ago, an old 'friend' had taken out credit cards and loans in her name to the tune of $20,000 forcing her to declare bankruptcy. She is 60+ and has schizophrenia as well as at the time had pre-dementia, which has now progressed. When it happened, out of shame, she had said that this person only hadn't paid her back $400 for something. Obviously, this is kinda massively different from what happened. I'm seeing things that lead me to believe 2-4 years is the limit in GA on identity fraud. Due to her health and age circumstances however, is there anywhere I can look for to see if there are any other possible legal repercussions? This person knew of my mom's health and completely took advantage of this fact, and had stolen all this information under the guise of helping with her taxes. Any information on who I should try to contact, or what sort of lawyer to ask, would be very appreciated. (as a personal note - yeah, holy shit, my sister & I are working with my mother to take off her having to be able to handle her finances. We've never seen her to be very capable to, but now that she is open to handing it over we're thankful we can avoid trying to convince courts she's incompetent like we would have had to prior.)
