I rear ended someone, no one was hurt, damage was purely cosmetic, and both of our cars were still drive able after the bump. I went to court to settle the ticket, pleaded no contest, it was a ticket so I didn't get a criminal record or anything serious, and was in the court room for less than five minutes. One thing, though, was that after I stated what happened and the judged cleared up the ticket, he asked me if there was anything else I wanted to say. I said no, and he looked very surprised and was saying things like "really?" So he proceeded to ask me about school (I'm 20) and work instead. Did I do something wrong? We managed to get the offending site taken down. But now, people searching my little business first come across the hundreds of Pinterest stolen images linking to a now-dead site. Have filed 3 DMCA notices with Pinterest now and emailed 2. Not one response. Not sure if maybe there is a delay due to it being holiday season... We later decided to file DMCAs with Google to remove the offending images from search results. Google today removed our official business website links completely from their search instead, with no explanation. So now when you search the biz, my name, (or anything related), it's 100% stolen content on Pinterest and the official artwork/business links have totally and completely vanished from google search. This was a tiny business that I relied on very heavily due to poor health etc. and just feel like it's being destroyed for no reason other than being ignored/not being heard properly by these big companies. I don't mind at all people wanting to share my stuff on their blogs etc. and not knowing the source is understandable (lesson to other artists/biz owners: should have watermarked!), but what I do mind is that if someone out there sees it, and wants to buy my stuff, now it's virtually impossible for them to find me. Google search results is literally all stolen content now! Mostly from Pinterest. Not sure if this was done by accident, maybe Google misread the DMCA, and perhaps they removed the wrong website, but there's no way to contact Google directly, they have no direct support email, just a DMCA Takedown form, and have no idea what to do now to get in contact with them. Last night I traded in one of our vehicles (titled in MY name) worth -$21k for a new vehicle (sold to ME) for ~$47k. They did not ask me any information about the trade in vehicle, only asked my husband if it had ever been in an accident (which it had in 2013 but was fully repaired and disclosed) before I even arrived. The trade in vehicle has passenger side damage from a snowstorm last year. My husband did say there was a dent in the passenger side but the sales manager did not do a physical check of the car so did not know to which extent until he looked at it today. Problem: the sales manager is harassing my husband today about the trade in vehicle saying that they need to redo the deal because wth the damage the vehicle is worth $3500 less. KEEP IN MIND the new vehicle is in my name only and no one has contacted me. I have signed every single paper, I have keys, the new car is still at the dealer as my husband was having it detailed for me but is coming home today. I told him to let them know they need to contact ME and not him. AFAIK since I have already signed the contract that it's a done deed and they can't go back on it just because they didn't do their due diligence on checking the trade in. The title for the trade in is signed and in the process of being transferred by another sales manager who thinks the original sales manager is being ridiculous. I assume the child is approaching his late teens at this point. Previously, when the child was younger, it was easy to avoid the screeching by going inside and closing our door. When the child was home we avoided the usage of our back yard because of the constant screeching. We've never made a point to address the issue assuming both that the parents are dealing with a difficult issue and would also work to curtail the screeching. Now that the child is getting older he's spending more time outside screeching and the volume has increased to the point that it is now impacting our quality of life inside our home. When the neighbors are home, there is no quiet time inside our own home at this point. The child will cycle from gong inside to outside repeating all day. Do we have any legal recourse? Mistake by credit card processing company has practically ruined our mom & pop business Posted: 28 Dec 2017 08:01 PM PST We own a small business in Utah where we run our customers' credit/debit cards monthly for their monthly tuition bills (for music lessons). When we charged tuition on November 1st, our credit card processing company had a "glitch" and posted each transaction SEVEN times to each customers' account (so one of our customers used to seeing $300 come out, saw seven transactions totaling $2100 hit their account). We found out this happened when our customers began calling/coming in furious at the mistake. Once we began calling the processing company to fix the problem, it set off weeks of further unbelievable mistakes on their part, including multiple reversing, re-charging and drawing money from our bank account to cover the refund given to customers (despite us never having received the excess funds from the extra transactions). As a small business, this almost made us insolvent. We drew from our personal retirement to fund payroll and stay afloat, while continuing to call the processing company (and file complaints with the BBB and state attorney general). Each time we called the processing company through the month of November, it was like explaining it all over again to someone who doesn't understand basic accounting, and it was clear our issue wasn't getting the attention it warranted. The processing company kept insisting that they needed to "research the issue" before returning our funds, which they finally did on 12/26. In the meantime, they had also wrongly determined that they needed to charge our customers AGAIN, and did so to several of our customers on 12/22 (days before Christmas, completely depleting some of their accounts). They now seem to finally understand their mistake, as they have returned our funds and we expect the last of our customers will be made whole by tomorrow. But the impact of this to our business may well be devastating. Already, we have lost five of our students (monthly income that would likely have lasted years - for scale we have about 100 students total), and expect that we may lose more once people come back from the holidays. We have received negative reviews on social media. Our customers' trust in us has been irreversibly damaged. We live in a very small town, where it is difficult to grow a business and where word of mouth has serious repercussions. We easily spent 50 hours researching, explaining, and re-explaining the issue to the processing company and our customers. Our $22,000 was not earning interest for us and was instead (presumably) being used by them for over a month. We sent an email to the impacted customers today that explained the mistake and what we're doing to fix it, and also sent an email to the processing company to ask that they do more to make us whole for their wrongdoings (we specifically asked for interest on our money that they held for a month, compensation for time spent resolving the issue, compensation for actual lost business in terms of the number of customers lost and their monthly tuition, and compensation for potential business lost due to negative word of mouth and social media reviews). An FBI agent came to the house and some teenagers just let them in. The agent apparently looked around and talked to my daughter without announcing herself. My daughter only just now realized she was speaking to the FBI. In addition to the trade in, I put $2,000 down on the car. 3 weeks later, I was driving to work and got hit from the oncoming lane. Turns out the one who hit me was rear ended pretty hard by someone else which pushed her out into my lane as they were angled to make a left turn. The police report and everything shows that it is entirely the guy that hit her fault. He was speeding while not paying attention while it was raining and there was heavy construction going on. Throughout the course of the process, the car ended up being valued at $11,000 but my loan was for $18,000 leaving $7,000. My GAP coverage only covered $4,000 and the warranty covered the rest. Since this process took awhile to resolve (a couple of months) interest accrued so I ended up having to pay an extra $500 on a vehicle I no longer had as it was determined to be totaled. He, of course, had no insurance and apparently a suspended license. So now I have no car and no money. I am fresh outta college with only a part time job at my school. The car was a graduation gift to myself as I had some money on a credit card and my father was going to assist the monthly payments. I have never dealt with something like this before since the Oldsmobile was my first car and I paid for that in full using school money. It has completely ruined my plans to move downstate out of my grandma's house as I will need a car when I move. What can I do to recoup some of the money that I lost to this guy. Would I sue for the money plus the car that I lost or the value of the car? I spoke to one lawyer so far and he said that it would be impossible to actually collect from him. Am I just screwed? My Uncle works refilling ATMs, he goes store to store refilling the ATMs with cash from the bank. His car over the course of 2 years has been broken into 6 times, 3 times he has lost amounts of 35k-50k. while the other 3 times he was lucky and they didn't find cash. His car was broken into in front of his residence as well, which is a gated community. More over the 1st break in happened in front of the Homeland Security office, second time was at another relatives residential community(no gate). Each time he provided the police with camera, video evidence but nothing came of it. Each time he attempted to contact the police to follow up they would respond with "we are assigning a detective to your case, please wait for him to contact you" he waited months, years and when we call back and ask why he didnt receive a call they would say that they are still waiting to assign a detective. After the last break in my uncle decided to just go on with his day and not report it to the cops as they would just waste two hours of his life and not do anything. I told him that he needed to report it for future reference to them but he would rather not. Please tell me what He can do now, and if there is anyway I can help him. This is getting distressing and i worry the next time these robbers may be shoot him. She wants to live with her father and has for years, mostly because dad is party dad (no rules no chores no homework) and I'm strict crappy mom who actually enforces things. Recently she went on a visit with her father and now has come back saying they called child protective services and that she will be going back to his dads once they come for her. Basically she either a) blatantly lied about situations, b) exaggerated them, or c) left out critical information that completely changed the context. For example, she was recently stealing from stores. As a result, she got in MASSIVE trouble. She painted this as me just disciplining her unreasonably and made it sound like she's in trouble for nothing-completely changing context. She plays sports (soccer), which means from time to time she gets bruises and scrapes. She told them I have left bruises on her and that other people have seen the bruises. She mentioned we took off her door - but doesn't mention it was because of her theft combined with slamming of doors. She says she's not even allowed to draw - but leaves out the IMPORTANT CONTEXT that this is temporary grounding because she was drawing extremely graphic and inappropriate sexual things. She even wrote a whole fake story about being raped when she was 10 by a neighborhood boy (for context at 10 at NO POINT was she allowed alone with any neighborhood boys, heck she still isn't.) She was in counseling for 8 years. Recently we moved so we stopped, but at this point I've even contacted police about a scared straight program, something. We've been looking into counseling again. You get the drift. Stuff is crazy. So now I'm sitting here, my child is alleging abuse of all types at me, and I'm worried her insane allegations will wind up making me not just lose custody of her, but her 10 year old brother who has autism. Their father is a terrible dad (went missing for 4 years after the autism diagnosis, past drug charges, past domestic violence charges against multiple people, etc) and I'm worried if he got custody my 10 year old could never properly advocate for himself. Given his condition, I don't think he would be any sort of good witness either to affirm to authorities that my daughters allegations are made up either. I'm at the end of my rope. I'm ready to just give her to her dad. He's literally told her things like "If you behave bad enough for your mom, she'll get sick of you and you can come live with me." I want what's best for both my kids. But if my daughters actions and lies could endanger her brothers well being and she's really hell bent on going with her dad... maybe it's time to give up. Can just an allegation cause me to lose custody? What can I expect? Will they consider the character of her father and my daughters mental health history and propensity for lying? If I try to keep her how much danger am I placing our family in if this happens again? Giving her to her dad is essentially giving up on her future. On a side note my now husband (not the dad of the kids) is a government employee and worried about this affecting his clearance or his job if my daughter lies about him. It turns out the estate is half owned by his ex-wife, so we get 40% of 50% of the value of the house. My Aunt, the executor of the will, also said she had to take taxes and "other fees". She also had the house rented out for two years and didn't tell us so we get some money there (do we get some of the rent money?). so the house was sold for something like $160,000 CAD but is valued at $220,000CAD (up to $250,000 CAD). ( and the insurance redid alot for stuff to make it newer). How do we proceed? My father said we should be getting more and she under valued the house to be sold to the ex-wife so they can sell it for more and not have to give is money, and they are currently renting it out. I think the problem is that they haven't been tell us what they doing like putting the house up for rent or for sale. My dad thinks this: " she has broken the law by not inform us of what has been going on. and isn't fit to be in control of the will". Is that correct? My friend and I called it quits, we ended on pretty bad terms and I've tried to be civil and handle things like an adult but they've started threatening me. I've been working at a clothing store for a few years and I love my work, it pays the bills while I work on school and take care of my parents. My friend sent me a threatening message on Facebook saying that she was going to call my boss and report me about a situation that happened when we were young girls, about 13-14 or so. We were throwing rocks with her and a group of friends over a fence and not thinking of consequences, when one of the rocks hit a windshield. The police came and talked to us, we were forward and honest about the details but nothing ever came of this. They just told us never to do it again, and we did. She said her intention is to get me fired, and she won't respond to me when I plead with her to stop this. Do you think my boss will take this seriously? Or does me having been so young count at all. Super annoying, but ultimately not my problem as I pick up after my dog and do her daily walks elsewhere off the apartment property. This week I received an email that the management company is now requiring all tenants to submit dog DNA so that they can fine owners who do not clean up after their dogs. Apparently, DNA testing is cheaper than just paying a cleaning company to pick up the poop? Or maybe they think that they can recoup costs with the subsequent fines, who knows? All I know is that my lease says absolutely nothing about DNA testing, just some standard language about pet deposit and cleaning up after them on apt property. Do I have to do this, or can I fight it on principle? I don't know how accurate this testing is, I would be pissed if I started getting fines for false positives! Thanks in advance! He claims not to have the funds to pay her currently, and is likely using the "friendly", "local", atmosphere to guilt her into "helping out" by not getting paid. She's now thinking of quitting, and worried that if he fails to pay and she cuts ties, he will never give her the back pay. Recently my neighbour (old dude who lives alone, is always peeking through the blinds at people, has called the police for a noise complaint when I had 3 friends over and we were talking in my backyard at 9 pm etc) has started to move my garbage bins to block my driveway if I don't bring them in immediately. Our garbage is picked up Wednesday morning, if our bins aren't brought in by Thursday evening he will take one of the bins and move it into the middle of our driveway, blocking our car in. He does this with other houses on the street. I've never witnessed him doing it but it's very obvious to me it's him (footprints in the snow leading directly to his front door that weren't there before the bins moved). I understand this is extremely minor and that I could just bring them in but I don't feel like he has the right to do this. My front lawn is directly connected to the street, there is no sidewalk and this is in a residential area so I believe the bins are on the property, also I'm renting the house if that matters I do not own it. I am 16 years old, I live in NYC but I will often go to stay with my aunt and Uncle (still in NY) during summer break. My little cousin (their daughter) is seven, and it's common that I take her out to the park nearby. So I was just there, (this was a while ago) and some women came up to talk to me. Small conversation. I say I'm [aunt's name]'s niece. Moms are always there. They stare at me a lot. Like, more than they look at their own kids. Yeah it's probably just because I'm dark skinned whatever. (That's all I can think of) Now I am on winter break right now, so I went to go visit the Aunt and Uncle. Moms were over at the house. Cool, whatever. Cousin was out and my uncle let me play his Xbox. Moms come up to me. (Not all of them, like, a small sector) I pause the game. They're all "oh your the girl from the park right?" Yeah that's me. They act so weird after this. Making some weird conversation. Idk how to explain it. Then they ask me if I will go to the park again, I say yes. Following that, they were extremely patronizing and condescending to me. It's a one bedroom but we both work and each have a car. This was never a problem since there's abundant parking in our lot. A couple days in to this December we get the annual parking sticker application with the usual two spots for each cars info. Last week I receive one sticker with a note saying "We can only issue one sticker at this time". I just got off the phone with them and they stated people had complained about limited spots so new rule effective 1/1/18 is a sticker per bedroom. There are plenty of spots in our lot and I'm positive these complaints are in reference to the smaller lots down the street. I explained this but they didn't care. Is this legal? Can they up and change the rules without notice? What about taking the time to actually look into the situation? I'm not sure if I should get the town involved or not. Do doctors have the right to not release their medical records to their own patients? From online research, all I've found is that we are all entitled to copies of their medical records. The clerk at the front desk claims that she can only receive them when the doctor was there. Though, she went today for another procedure with the doctor, and they still denied her.
