Teacher called my friend a "loser" on Facebook and said "Asians like him have a small penis." (MA)

    Posted: 05 Dec 2017 05:11 AM PST

Person A first blocked my friend, then went on a rant about him on Facebook.

A teacher from the school we all go to commented that "Don't bother with that loser, it's not a coincidence that Asians like him have a small penis."

Then there are several other comments from other people mocking my friend and his supposed small penis due to being Asian. The Facebook post was only shared with some people, the poster says in a comment that "it's safe, nobody we don't want can see any of this" but he was wrong, because I could see it and I'm not even in that friend group.

I have confirmed that the profile was indeed the actual profile of the teacher, not a fake profile that other students made. I already have screenshots and printouts.

I'm sure being racist is unacceptable for a teacher, so is calling students names and commenting on their genitals. Who is the best person to go to with all of this? I want to make sure that the teacher gets consequences for this AND I want to make sure there's no retaliation by the school staff against me or my friend who was the target of the abuse.

Public high school in Massachusetts. Ages of all students (myself included) is 16-17.

I've received a bogus invoice from my Uncle's business because I refused to take his son on a road trip at the last minute to meet a cruise ship.

    Posted: 05 Dec 2017 11:05 AM PST

    The backstory part

My aunt and uncle have always been pushy people and their son (my cousin, but family stresses don't have me relating to him in any way) is a 19 year old painful entitled arse I never had much to do with personally.

I'd been planning a road trip from Sydney to Townsville for a while, and I posted details on facebook of when I was leaving in September this year. Aunt and Uncle caught wind of this and asked if I'd take their son with me, and drop him off in Brisbane in time to catch a cruise. I said no at first, but after a few pushy phonecalls from them I said I'd do it but I laid out conditions that he had to keep the attitude down. They know as well as anyone what he's like, and they promised he'd behave, so I agreed to take him. My mistake agreeing to that.

On the morning I had to leave I packed and went to pick up their son from their house. He was still asleep and hadn't even begun to pack. After 2 hours of waiting and putting my schedule behind, we got going on the road. We didn't get 20km before he'd insulted me about my weight, spat chewing gum out the window, and jammed his feet with shoes up on the dash. The whole reason for my road trip was to stretch the legs of my car, and it's a cheap but fun sort-of-classic I'm attached to. He'd already scored the dashtop with his feet when I pulled over, laid into him about feet on the dash, and I snapped when he came back with "babe, if you want this to be painless for the both of us you need to get the stick out of your arse".

So I turned around, and suffered 20 minutes of abuse before getting him back home, all the time with him threatening me with how pissed his dad was going to be.

After some trouble getting him out of the car when he was back home, I left him and his baggage in their driveway and went off on my trip.

    The legal part

I've now been back a fortnight, and yesterday morning I received an invoice from my uncle's business for a total of $9200 for 'Travel', and a final notice warning that it would be sent to collections if it wasn't immediately paid. I phoned my uncle and he broke it down that they'd tried to get their son on a flight to Brisbane but he never got on it and bummed about with friends locally without them knowing, and wasted opportunities they'd organised for him on the cruise.

I'm beyond annoyed and told him to jam it, posted a scan of the invoice on Facebook with the background story, and I've received nasty emails from both my aunt and uncle (I refuse to take their calls) threatening me to take it down, and also to pay it or he will send it to collections.

Obviously it's not a legally valid invoice, even though as far as I can tell it's a regular normal looking invoice his business would send out, but what can I do here that'll quickly get him off my back? It wouldn't surprise me if he did try to send it to collections if I don't do anything.

For all the stupidity of that act, which I'm sure can get him in deep trouble if I pushed back legally, he's knowledgeable of the law and I think he's expecting to take advantage of my lack of legal knowledge to make me pay. Is there a law I can quickly quote back at him in reference to the invalid invoice and fraud, without me going straight to a lawyer of my own, or would should I get a lawyer to fire back so he backs down? The cost of that would hit me hard at the moment but if I have to I have to.

[CA] Police searched and trashed my house in the middle of the night, detained myself and my roommates and we were never shown a warrant. We were cleared of any wrongdoing. Do we have any recourse?

    Posted: 04 Dec 2017 07:12 PM PST

This happened about a week before thanksgiving.

I woke up in the middle of the night to banging on the front door and yelling "this is the police from (city 30 minutes away), open the door, we have a warrant to search your house". I go to the door and open it, and a flashlight is shone in my face and I am told to come outside. I am immediately grabbed and handcuffed and the sweatshirt I was holding to cover my chest is thrown to the ground and I am made to sit on a wet curb (it had been raining) in only my thin pajamas in 40 degree weather.

They proceed to do the same to my two roommates and ransack our house. They do not tell us what is going on for the entire 40-ish minutes they are searching. I am shaking head to toe from exposure to the wet cold and my roommate asks about covering me with something. The cop watching us says she will ask about it when they come out.

They come out and finally they tell us they are looking for a "red toolbox containing a laptop and a power drill" that was stolen from one of their cars. They say GPS tracking is leading it to a closet in our house. They are questioning us as if we are criminals and we know what they are talking about when we are clueless.

Finally one of them has the brilliant idea to look in the trash bins outside our house and they find what they are looking for (along with my cat litter box waste, hah). Someone had dumped the stolen goods in there and we were obviously innocent. Finally they release us and say "thank you for your cooperation".

Our house was completely trashed, especially my bedroom. I was humiliated in front of my neighbors, exposed to the wet cold wearing only a thin layer of fabric and could've gotten sick. We were treated like criminals and they never even showed me a warrant! What judge would sign a warrant in the middle of the night for a damn laptop and power drill? [edit: I'm sure it was late at night because I actually remember hearing the trash bin around 10pm, normally not a notable occurrence] Do we have any recourse at all? Any advice is appreciated, thanks.

Landlord forcing us to pay utilities for squatters

    Posted: 05 Dec 2017 06:43 AM PST

My BF and I moved into a lofted two bedroom unit in a single-unit building in November. Upon moving in I was notified that a friend of the landlord was living in a bedroom attached to my garage below my unit. This was not discussed with me prior to moving in and I had no prior knowledge of the woman until going to collect my keys. The lease states that the entire address (not unit A or apartment 1) are under my and my boyfriend's name. This poses somewhat of an issue as the renter's insurance, and all utilities are in my name for that address. After moving in and finding out about this woman I asked the landlord if we have separate meters to determine the electricity usage and was told, "No, her place is much smaller than yours and you are expected to pay the entire electric bill." I was also told that there was one mailbox and that this other woman had a key to access our (shared) box. Both of these situations left a bad taste in my mouth and I was told by the landlord that I could, "work that out with her". When CenturyLink came to install our new internet they deactivated hers (same address) and I was contacted by the landlord saying that I needed to contact CenturyLink to fix the woman's internet and "that this was an issue with the last tenants" which told me that she had lived there before we moved in so we were definitely lied to about her existence. Finally over the past four weeks we have received a number of requests from this woman downstairs, most recently asking us to shut off our outdoor lights as they shine into her bedroom. The landlord specifically installed these lights because the courtyard is dark at night and I am on call during the week and routinely go in before the sun comes up and come home late at night, I've slipped on the stairs twice so it is definitely a safety issue. Finally yesterday my BF came home during lunch and found the landlord and this woman in our (private) courtyard complaining that our dog had left "four pieces of poop" outside. To be fair it is specifically in the lease that our dog will not poop in the courtyard and this was an oversight on my part. The landlord confronted my BF who reassured him it would not be an issue and when I got out of work I had a long email about penalties for the dog pooping in the courtyard. This seems a bit much for a first offense but I digress. Also last week the woman's boyfriend moved in with her so now four, unmarried, unrelated people are living in one building. Legally what can I do here? For what it's worth I love the building and I would like to find a way to co-exist but I'm afraid from a legal perspective this is not possible.

Additional Info: We live in Denver, Colorado. The landlord and her husband live in a separate building adjacent to our building. The landlord pays for sewage, trash, and water. The area of premises covered by the lease is the entire street address.

TL;DR "Started renting one-unit apartment in a single-unit building. Found out that landlord's friend lives in a garage attachment below my unit. Her only access is through the enclosed courtyard that is covered under my lease. She has no separate unit number, receives mail from my mailbox, uses electricity that I pay for (she has no separate meter), and she does not pay rent. And last week, her boyfriend moved in. What are my rights?"

[MA] HOA issue. I own my condo, my upstairs neighbor just installed a hard wood floor.

    Posted: 05 Dec 2017 08:11 AM PST

The condo docs specifically say that all units must have carpet except in the bathroom and kitchen.

I notified the management company, they did an inspection and found the hardwood floors, and the neighbor gave them a letter from their doctor that they are allergic to carpeting.

Management company is saying that the board has to decide whether to fight this or not, which I don't understand. If they don't fight this then what is the point of the dues, or the rule on carpeting?

One night stand got pregnant. What are my options

    Posted: 05 Dec 2017 08:08 AM PST

First of all, I get it. I was stupid and it is my fault just as much as hers, but I just want to know where I stand here.

I am a 22 year old male living in Georgia, I met a girl on Tinder 2 weeks back and we went out for some drinks and she stayed the night at my place that night. She told me she was on birth control and after the drinks I stupidly didn't use a condom. Afterwards as we were laying in bed she admits shes not actually on birth control. Ok no biggie ill take you in the morning to get Plan B. So morning comes around and she has to go and I said ok well at least take this (and handed her $50) to go get the pill. And I texted her later that day saying whats up and no response. Up until 2 weeks later this morning shes telling me we have to meet because shes pregnant. She says shell take care of it (im in college full time and working 2 jobs) and she wants monthly support for it. Im already broke as it is and I get it I will help the best of my ability but what are my options here?

Pissed off manager said she’s holding my paycheck until my next pay period because I called out sick

    Posted: 05 Dec 2017 05:17 AM PST

Hello! First I'd like to give a little bit of a back story : I live in NY and recently put in a month notice to my job on 11/30( I know they have staffing issues so I didn't want to screw anyone over)it turns out that they only need me for 3/4 weeks which I have no issue with because I'm transferring to a different office but still working for the same company. I work for a national brand insurance company so each office is independently contracted meaning the owner deals with and pays their employees. In my office my manager who is my direct supervisor is pretty ticked off about me leaving and has been out to get me since I have my notice however in all honesty she is the one who pushed me out the door(figuratively speaking). I sent her a text this morning that I can't make it in due to being ill(not bs I've been up all night vomiting) apparently I don't have any sick days which is crap because I have one day left that I didn't use this year. In any case her boss which is also her father preprinted the checks for this Friday (12/8) because he's going on a trip and won't be back until next week so apparently she won't be giving me my check until the following pay day which is 12/15. Now In the past if I had ever been paid more I could either work through my lunch hours to pay them back any over payment or they'd just deduct it from my following paycheck with no problem but it seems it's not up to my boss since he's not in is what I'm told. Is this legal? My boss could easily walk my manager through reprinting a check as they do it in the back office or by going to the bank. I don't want to take any legal action however, just want to have a leg to stand on for when I ask for my check on Friday.

TL;DR : I put in my notice at work and my manager isn't happy about it. I called out sick today and I'm being told I don't have any sick days which I'm 100% I have 1 left.My boss preprinted paychecks for this upcoming Friday since he's gone on a trip so my manager is saying she is holding my pay until my next paycheck the following week. Is this legal in NY?

Bought a house with a huge problem that was NOT disclosed during the sale

    Posted: 05 Dec 2017 12:42 AM PST

We bought our Southern California home in May 2017 and did the standard home Inspection and all that. Fast forward a few months of living here, have a few extra people over...next day the toilet starts bubbling...and then backing up into the bathroom and connecting shower. We call home Warranty for a plumber to come out thinking it's just a clog and end up fixing it before they schedule us. Cool. Well...Halloween time comes and we decide to have a party--bathrooms get a lot of use and in the next couple days...bubbling toilet and backing up into the tub and connecting shower on the other side of the wall. It's a MESS--just Great! Call home warranty and they come out and think they're just going to flush out the mainline until they put their camera down and discover some very bad news: there's a "sag/belly" in our mainline and home warranty won't touch it because it's a long standing issue that the previous owners HAD to have been aware of. Cost to fix: oh around $30K. I'm livid! The plumbers are giving me condolences for buying "a lemon" of a home and telling me that someone really ripped us on the disclosure part of the home sale. The sellers used a family member as their realty agent and I wouldn't be surprised if they BOTH knew what they were trying to hide based on how nervous they looked during the home inspection. So...What can we do? People are telling me it's their responsibility but What steps do we take To go after the previous owners for the cost of repairing the issue? I don't even know where to begin, aside from telling my agent and them being sorry and offering numbers of other plumbers-ugh! Thanks in advance!

Father's brothers wife is divorcing him and wants to take their land.

    Posted: 05 Dec 2017 09:02 AM PST

My grandparents left my father and his brother 5 acres of land with a house on it. My father has paid the taxes on the land for the last 3 years and his brother has not pitched in for it. Also my father has loaned him 22k. My father wants to buy his half of the land so he can own it all. We just found out that he is getting a divorce and it doesn't look pretty. What are her options, if any, to the inheritance land that my grandparents left? What can we do to prevent her from coming after the land if she can? Texas, USA

USPS messup and now I'm out $250, help?

    Posted: 05 Dec 2017 09:53 AM PST

    LOCATION:[FL]

This is long, bear with me.

-Mid October-I ordered a pair of expensive shoes online for a holiday party I have coming up. Christian Louboutin, box and all. Got them as a super steal off of Ebay and paid using Paypal. Priority shipping so they should have arrived in two days. Yay.

-A few days later, it says delivered. Cue me super excited, go to my mail locker (I am in an apartment so we have those), retrieve key for parcel locker 103, and go to unlock.

-Problem? Parcel locker 103 is already opened, and empty. There is no key inside of the locker so either it was broken into or left unlocked. I have ordered many packages online before (Ebay seller/buyer), and have dealt with theft, but the problem with this? Parcel locker looks virtually unharmed. Those things are heavy and sturdy, you'd have to really break it to break in. Cue me being very upset.

-Next day, call apartment complex, they say 2 other residents had a similar problem. Police came by, and couldn't even actually file a police report because they checked out the parcel lockers and say there was no crime committed, as there was no sign of theft. Say it was likely a USPS messup, left the boxes unlocked, misdelivered, etc.

-We have 6 total parcel lockers. With 3 of them having been left unlocked/misdelivered, that's a 50% failure rate. 50%. I am getting nervous at this point because I know USPS is terrible with any help and suggesting that it was their fault, even though it was, doesn't seem like it'd get me very far.

-I figure no problem. I've been a Paypal and Ebay customer for years so I thought they'd be okay with issuing me a refund as I never actually got the item. I was told on 3 separate occasions by 3 employees of Paypal not to worry, that I'd get my money back since I never actually got the item.

-My case was shut down by both Ebay and Paypal. Of course, since the item shows delivered. Are they liable at all for telling me I'd get it back and then shutting me down??

-Try to dispute it with my bank as I am running out of options here, am $250 down, with zero help. They also couldn't help as item says delivered. Suggest I see what Paypal can do. At this point everyone in sending me in circles. Ebay sent me to Paypal, Paypal sent me to my bank, and now I've been sent back to Paypal.

-Paypal suggests I claim insurance. I would have claimed insurance. I would have done that and taken the cards I was dealt. Except guess what? No one but the shipper can claim insurance unless they are a family member or friend. So now I'm down $250, unable to claim any kind of insurance as it's supposed to be the shippers responsibility, and everyone I've asked for help has said no. The shipper refuses to claim insurance or work with me. I ask Paypal what I can possibly do in this situation and they say they'll work on it. They elevate the case again.

-Of course, case denied. I I call USPS again. It is their mess and on their website it mentions that if loss occurs due to fault on their behalf, with proof of purchase I get a full refund.

-They transfer me to my local post office. The woman is very nice and opens up a case. She says she understands and will try to help me, locate exactly when it was scanned, and find out what actually happened. Gives me some kind of hope in getting to the bottom of it.

-I follow up and catch another guy on the phone. Tell him about my last conversation. He says he'll see if the package is still in a parcel locker, I tell him I've already been through the hoops but he can try. I ask him if he doesn't find the item, seeing as it was a USPS slipup, I would get my money back, correct?

-He says no because they don't cover stolen packages. I remind him that the police came by and said there was no sign of theft and it was likely misdelivery/failure to lock the parcels. a 50% loss rate at that. That is a huge misstep, and I'm not sure why I should be held responsible for that.

-He says the police were probably wrong, and my parcel lockers specifically have been messed up, so that's why they were probably able to break in without a sign. Pretty much flat tells me I'm without luck.

-Follow up again, USPS tells me they were actually vandalized and that's it. The initial police were wrong, but they called the cops again and they confirmed it was vandalism. I don't care as long as they send me the police report to prove it. She says she'll look for it and I'll get it in a few days.

-No reply from USPS. I'm beginning to give up.

-This week I go by my parcel lockers and they left the back panel open into the room where the parcels are delivered. I could literally reach in and grab someones package if I wanted to. Unbelievable. I took so many pics. This is really not leading me to believe that it was "vandalism" and clearly lack of giving a sh*t on the mailmans end.

Here's where it comes down to-I'm pissed. If they knew the lockers were messed up and did nothing about it, how is it my fault? If I can't even claim insurance on it, how is this my responsibility? If my package were stolen off a door stop I get it. That's not USPS's fault. But this just seems like it is and I don't know where to go from here. Should I just drop it or is there anything I can do? Aside from my own money, it boils my blood that there are probably people every single day who take the financial fall for incompetence, internal theft, or whatever else may have happened. This is not normal theft/lost in transit, this was either a huge rate of failure in locking the mailboxes, internal theft, or blatant negligence toward the existence of faulty mailboxes. I may be overreacting but I'm just upset. Please help me if you can. I can live without the stupid $250, but I'm having a hard time living with being out $250 because of a careless delivery person that continues to do things like leave the parcel panels open.

Rent is being Raised without a complete 60 day notice and during the middle of my lease, Details in comments. Seeking legal help/advice

    Posted: 05 Dec 2017 09:03 AM PST

I live in Georgia (Walker County), and i am already paying 510$ monthly to live in government assisted housing (Not really much assistance but what have you), and it is being raised to 540$ monthly (+30/month). The only explanation we received from the landlord was there were administrative expenses.

I read up on the laws and it says that I need a 60 day notice for this to be a legally binding raise. I was notified today with a note posted on my door, and it takes effect January 1, 2018. (27 days from now)

It also stated that some places have made raising rent mid-lease illegal. Is this the case for Georgia? I have searched but to no avail.

Is there any way i can fight this raise? It smells fishy and I don't want to be taken advantage of by some malicious system. Thanks in advance for any help, and I will gladly answer any questions that could help someone help me figure this out.

Went to court on scheduled day, they had no record of me?

    Posted: 05 Dec 2017 07:06 AM PST

    Hey guys.

So, maybe two months ago my boyfriend got pulled over with me in the car. The car had smelled of marijuana so they searched it, yadda yadda. There was a pipe and 1 gram of weed in the glovebook, so they decided to give me a possession of marijuana by a minor ticket since it was on my side. They suspected my boyfriend was high and wanted to sobriety test him. It was cold outside and he kept shivering which made it hard to tell if he was high or not (which he wasn't. He smoked much earlier that day). They decided they would rather sobriety test him in a more controlled setting and brought him back to the station. Long story short, they took him to the station, deemed him sober then and let him go home that night. He got a ticket for transport of drugs by a minor and OUI, despite letting him go. We went to court on the scheduled day and the clerk looked us up, the system had NO record of us or our tickets. She looked our names up on all the records they had and nothing came up for either of this. She said the officer must not have ran the ticket through the system and that we were free to go. what does this mean?? did those charges just disappear, nothing like this has happened to me before. should I be worried?

EDIT: i live in in Washington County Maine, and this all occured here for the rcord.

Promises in email but not in offer letter

    Posted: 05 Dec 2017 07:16 AM PST

    Hello Legal advice,

I just started working for a small company in the NJ area. When I was being recruited, they said there would be stock options included in my compensation package, but it would be explained to me after I signed my offer letter. I even have an email confirming that this was the case. One day after I signed the offer letter, they told me there was no change I would get any stock options. Do I have any legal ground to stand on here that I deserve compensation?

    Thanks, Actual adult 69

Bought a new car using a bank draft 1 week ago. Today I received a letter from my bank about a non conforming image.

    Posted: 05 Dec 2017 05:32 AM PST

The letter states that my bank received the draft but returned it unpaid to the payee's financial institute because of non-conforming image. The dealership filled out the draft. Will they be responsible for any fees because of this or will I be held liable. What is required from me now?

[UPDATE]: [CA] Landlord withholding security deposit to pay for carpet replacement with a twist (need advice).

    Posted: 05 Dec 2017 12:20 PM PST

OK LA, I've got an update to my previous post. although it's pretty crappy.

    Here's what happened.

I filed in small claims and had landlord served in person. I requested return of security deposit based upon 21-day rule which landlord violated. I prepared my case with all evidence showing landlord did not follow law. Landlord intended to keep deposit by not providing receipts or contact within 21 days (actually 32).

Get to court that day and it's not a regular judge, but a lawyer filling in as a temporary sworn in judge (uh oh....). Everyone there is asked if they would allow the temp judge to hear their cases otherwise the case would be postponed until after the new year. Everyone stays and agrees (including myself).

Our turn comes up and we present the facts clearly and concisely. LL did not return deposit or receipt within 21 days. LL only responded to certified letter after 30 days. LL indicated that she would be keeping all of deposit to replace 7-yo carpeting in the residence. We had printed out texts and emails between LL and myself approving removal of carpet prior to move out and that LL would be installing other flooring at a later date.

When it was LL's turn to speak, (LL) indicated that she had told me verbally that she would charge for the replacement of carpet if we removed it (lie - she did not and it contradicts emails/text evidence). LL indicated that she did not have our address (lie - we sent email and texts with this information upon move out and had proof) and that only after we sent the certified letter, did she have our address to notify us of keeping the deposit.

We countered these arguments with our own evidence (printed and shown to the court) proving all of these allegations false.

The "Judge" then said, I shit you not,

"in the interest of time and effort, I'm going to go ahead appease both sides in this dispute. I rule in favor of the Plaintiff but I'm also going to award the Defendant a depreciated amount for the removed carpeting and labor to install new flooring."

After quickly typing away on a calculator, the judge awarded my $1,050 plus $150 court fees and the defendant $1,300.

We left feeling defeated and cheated by the legal system and a "Judge" which didn't enforce the law.

We should have gone with Judge Judy...

Any other recourse here? I was under the assumption that we (Plaintiff) cannot appeal.

CA - Changed the Google pic for a local company years ago. Today, they called me about restitution.

    Posted: 05 Dec 2017 11:49 AM PST

A sales call center a friend of mine was employed with a few years ago gave him a hard time, then fired him. We both got a little tipsy and I put a funny image of a person with his smile photoshopped upside down (an old meme) in on their business on Google and since it was the only one as they didn't "claim" the business, it became the main image when you Google their name in my area.

Apparently no one noticed for a 4 years. Although oddly I do remember that night and still have the image in my funny pics folder. I totally did this.

They called me (no one claimed to be a lawyer) and wanted to have a meeting regarding the damage the image has done to their business. They were quite hostile. Dumb ole me have my posting name similar to my irl name (which is unique) and my number must be linked off somewhere. I told them I had to consider their request. They said it wasn't a request. I told them I've received no lawful order to appear anywhere but I would think about it and call them back tomorrow to continue the discussion when we've all calmed down.

So how effed do ya think I am? Or is this just sillyness? It sounds like a predatory thing. The company sells insurance and tricks fresh college grads into working for them and make them pay for training. I wouldn't put it past them to go after small fries for the change in their pockets.

I currently live in PA if that matters.
    Thanks!

[LA] My job's punch clock rounds up when you're early but doesn't round down when you're late. Is that legal?

    Posted: 05 Dec 2017 06:11 AM PST

For example if I punch in at 7:50 it rounds up to 8:00 but if I punch in at 8:01 it clocks in at 8:01. So the times I clock in early don't count for me but if I clock in once a minute or two late it counts against me. Can that be legal?

[TX] In Texas, if I'm under 18 and have a driver's license, I'm only allowed to have one minor who isn't a member of my family in the car. Does this mean I can have one minor who is part of my family as well as one who isn't?

Need advice! IKEA warranty claim roadblock: Renovated using IKEA Akurum cabinets in 2011 with 25 year warranty... Ikea discontinues line in 2015!

    Posted: 05 Dec 2017 12:45 PM PST

In 2011 we renovated our kitchen (and most rest of our home) with Ikea cabinets and appliances. We selected them because of looks and the 25 year warranty. Specifically, the Akurum cabinet system with the Nexus Black doors.

The world was a happy place for the first year or two. As things would break or need servicing, I'd take the piece over to the store, and they would replace it... no problem... everything we would expect them to be.

Then in September 2015, I tried to get other components replaced... but this time they said they would need to "setup a warranty claim" and search for the part. I acknowledged and provided them the info on the damaged parts.

Later, they reached out to us to let us know that the line was discontinued... and there were no more parts!

Next, we embarked on a 4 month journey of back and forth, with the end result that they couldn't locate the parts at any of the other stores and they would escallate the issue.

Escallation of the issue resulted in Ikea offering to replace the doors to our cabinets. We said fine. They provided us with a list of potential vendors.

We spent about $300 on samples from the vendors they identified... and nothing matched. Not even close. One vendor even said "if we could copy Ikea, do you think they'd let us?".

We let them know that all the vendors they identified did not yield a match and asked for additional options.

In April 2016 Ikea said they would replace the cabinets entirely (their new currently-in-production line is a perfect match, but we'd be getting rid of our wood-veneer and replacing it with vinyl veneer). We agreed.

Another month lapsed... and they sent their contractor to come take measurements. Then ikea contact us that they would replace the cabinets, but we'd have to find a contractor to remove, and then reinstall the countertops.

After speaking to various contractors ourselves including the original granite countertop supplier, we got quotes ranging from $7000 to $10000 for this part of the operation (just removing, storing, and replacing all that granite)

At this point we entered a deadlock... Ikea no longer has replacement parts for the cabinet system they sold with a 25 year warranty... They can't match what we have... and they will replace the cabinets if we pay an amount nearly as large as the original purchase price of the cabinets to enable them to make good on their warraty.

We tried escallating, and finally got to speak to the store manager (December 2017). He reiterated their position, and said they only exclusively deal with one contractor and that contractor will not touch the countertop.

So at this point I have the following options:

-Take them up on the door offer... but the doors won't match... and in the two and half years that this warranty claim has started, other parts are showing signs of wear and tear... for which they will have no replacements for either.

-Take them up on their offer to replace the cabinets... but we're out $6000-7000 out of pocket.

Also, in the process of going back and forth, we contacted the State Attorney General's office and filed a complaint and requested their assistance. After a few months they sent us a letter indicating that Ikea did not cooperate (specifically, they didn't return any of their calls) and they couldn't assist further,

Finally, in the most recent conversation the manager offered to refund the purchase price of the cabinets... but considering the $12000 we paid to get the kitchen renovated in the first place, I would still have to use that money to buy the new cabinets and another $5000-10000 to have them replaced.

Oh... and we're not alone in this boat. A quick google search of "Ikea - Warranty only honored if convenient" shows a similar case.

    Any advice Reddit?

Another YouTube channel took one of my videos, without permission, to include in a compilation.

    Posted: 05 Dec 2017 11:38 AM PST

A few days ago I was playing an online game and something particularly funny happened, so I uploaded a short video of it to my YouTube channel and posted it to the game's subreddit to share with the community. It currently has about 9,000 views.

A channel with 3 million subscribers commented on my video: "can we upload this clip to our youtube channel in a funny fortnite videos? we'd give you permission for letting us use it :)"

I responded: "You got that backwards, friendo: It's me who'd need to give you permission."

The other channel has since taken my video anyway, without permission, and included it in one of their highlight reels. Their video is monetized with preroll ads and has over 556,000 views.

Since I didn't give them permission, is there any I can get the video taken down or/and get my cut of the ad revenue? Thanks.

(I'm in California, if that matters. The other channel seems to be based in the UK.)

[NY] "Late fee if rent is not received by 4th of each month" If I pay on the 4th, why do I have to pay a late fee too?

    Posted: 05 Dec 2017 07:19 AM PST

I understand sometimes when it comes to contracts, the way is written isn't what is meant. Wouldn't this mean I have until the 4th of each month to pay, incurring a late fee on the 5th?

[CA] Subletter threatening to sue for the wages he missed during the time he cleaned his house.

    Posted: 05 Dec 2017 10:30 AM PST

    Hi.

So I stayed in a sublet place in CA. I leave some clutter, etc. that I assume would be deducted from my security deposit. Dont care, whatever.

Guy cuts entire deposit of 1000$ and now threatens me for more money for the days he missed work (?) getting his house cleaned.

There is literally NO way a cleaning job would've taken that much (small house, little to be cleaned that I left), but i let it pass. Now dude threatens me for 2000$ for supposedly him missing the opportunity to make that money (?) in the time he spent getting the house cleaned (?).

No such thing in the contracts we signed by the way. As in nothing indicating anyone paying missed wages or more than the security deposit being cut.

Guy knows I'm a foreigner. He's been saying he'd sue for a couple months now threatening me with hardships getting a visa, unless i pay him his "wages that he missed".

    Could there be any validity?

US, FL told a guy to Fuck Off for high pressure sale

    Posted: 05 Dec 2017 08:19 AM PST

I was roped into a high pressure sales situation to buy time share property today. When trying to leave, I told the salesmen to " fuck off." And the salesman at the hotel had the police called. We left the property immediately. If the police are called and show up at my hotel, can I be charged with anything?

Edit: my fear is that the other hotel employees in the room would fabricate a story about a physical assault opposed to a verbal one

[Ontario] might be charged with assault for throwing banana during Road Rage inccident

    Posted: 05 Dec 2017 06:34 AM PST

My dad was driving slow yesterday, it was raining. Some lady behind us didn't like the way he was driving so she decided to pull up close to him and cuss him off. My brother (20 yearold) threw a banana into the lady's car. She called the police, they called my brother they said something about a possible charge for assault. He's now requested to come to the police station later today. What should he do?

[CO] a friend of mine just turned 18, and is planning to move out of state with some friends. Parents are actively doing things to prevent her from leaving.

    Posted: 05 Dec 2017 10:43 AM PST

So, my friend in Colorado is having a really tough time with her parents and has wanted to move out for a very long time. She has a plane ticket and is totally ready to leave, but once her parents found out everything went south. She's currently staying with her friends, probably until the day of the flight. I have a lot of questions about the actions her parents have been taking.

    • They currently have several things of hers. Some they paid for and gave to her, others she paid for. Things like clothes and her laptop, but as well as a military ID and and birth certificate, all in an attempt to make this a painful process for her.
    • She is enrolled in an online academy in CO. The thing is her mother is the one who enrolled her, and her mother is also now threatening to try to prevent her from graduating. Would it be possible for her, an 18 year old, to have credits transferred to a school in the state she's moving to?
    • Her parents are lying to other family members about the situation, as to discourage them from helping her in any way.

Basically, can she call the police about any of this? Her future is on the line with that second one, and I believe that a gift from her parents would still qualify as her property once she's 18 and not under their roof. What can I do to help her situation? For the record I am in the state she is moving to, not CO.
