Bought a used pickup truck with a company logo and phone number a couple months ago. Just got a call from the seller saying i needed to remove any company info at my expense.

    Posted: 08 Dec 2017 08:07 AM PST

So a couple months ago I purchased a used f150 for a pretty good deal. However, yesterday I received a phone call from the seller stating that I have to have the information removed from the truck, or that he would consider legal action against me.

We had no agreement before sale that I had to remove anything, and it's not just a decal or wrap that is easy to remove. The guy had his logo custom painted on both sides of the truck, along with a phone number.

I can't really afford to have the truck repainted, and was wondering if this guy has any legal standing. IMO, he should have had the information removed before selling, but I'm assuming he didn't want to pay and is trying to offload the cost to me.

I've asked him to send me any demands he has in writing. I figure it would be easier to show to a lawyer if it gets that far.

Edit: this is in New York state

[ID] Landlord is charging us $50 per hole they find in the walls. They found 40 of them after we moved out and demand $2000 to repair them.

    Posted: 08 Dec 2017 09:29 AM PST

As title states, this is in Idaho.

In our lease, the landlord forbids that tenants put holes in the walls, so no nails for hanging pictures, decorations, etc. They reserve the right to charge for these repairs if they find any after we move out, and they'll charge us more if we attempted to repair them ourselves.

My wife is big on decorating, so of course we figured we could try to cover these holes up upon leaving, and if they find them, they probably won't charge much to patch the holes. In hindsight, this was very stupid and careless on our part, and it will definitely be a learning experience for us.

We did our best to cover the holes and moved out. They just sent an email stating that they found 40 holes in the walls and noticed that we tried to fix them ourselves. Their rate for repairs is $50 a hole, which brings the total to $2,000.

This rate seems extremely high. While I'm not too familiar with what it takes to patch a hole, I'm pretty confident that $50/hole is not a reasonable cost of labor and supplies. Do we have any recourse to lower this amount?

[U.S/UK?] Mate overstayed U.S visa... By quite a while and now wants out

    Posted: 08 Dec 2017 06:18 AM PST

    Hi guys,

I tried searching but couldn't find anything on here.

Basically - about a year and a half ago me and my mate set off on our dream, an American road-trip. We went around a shitload of the states and were planning to be there for just under 3 months.

Towards the end of our trip, I had fun, but was eager to get home to my girlfriend and job.

But my friend wasn't. We made some friends in Idaho who offered to let us stay and work at their bar - cash in hand - for a little while.

Well my mate got into a relationship with one of the girls there and decided he was staying.. He'd live with her and work as a barman to make ends meat.

Not too long ago... They split up. And he had to leave the job.

He's got a bit of cash, nowhere near enough for a flight, but I'll cover him for now to get him back.

He's crashing between mates he'd made out there but is eager to get back to England.

Obviously he's overstayed by quite a while...

What I want to know is (he only has his phone and spotty wifi connection) how buggered is he?

How much shit will he get in if I get him a flight? Will they detain him at the airport or just say "don't come back"?

    Cheers..

Edit: Ok, thank you guys. It seems to be that he'd be fine - just banned for a long time. That would be fine.

[NC] Is it illegal for a teacher to force a child to see gore

    Posted: 08 Dec 2017 11:18 AM PST

My sister (17) has a teacher at her public school who is a hardcore and vocal religious fundamentalist and found out that our family is on the left politically. She's passively sat by as he's left bibles and pro-life pamphlets on her desk (and apparently the lockers of every female teacher at the school) but last week he placed a picture of an aborted fetus on her desk without saying a word. I can't tell whether this is considered obscene material but either way it seems like it has to be against some law. I'm not sure if I'm looking to pursue anything but it seems like it could at least be good leverage to get some action from the schoolboard.

    Edit: typo

[UPDATE] good news about my competitors fiancee trying to set us up!

    Posted: 07 Dec 2017 05:37 PM PST

https://www.reddit.com/r/legaladvice/comments/7ghyp4/being_threatened_with_a_lawsuit_and_being/ Link to the previous post

First and foremost I want to say thank you to everyone who responded to me with all of the advice. And I want to apologize if I offended anyone since I didn't do my due diligence in finding out if this was truly illegal or not. I should have made an effort to double check this instead of assuming what my past bosses/work experience said. I fucked up, I admit it and I am very sorry. I now have an updated waiver which includes pregnancy which my lawyer helped me with.

Now for the juicy part you are all waiting for! The woman and her fiancee appear to be in some deep shit after I posted everything I had. Quite a few people had no idea she worked at a tanning salon herself, let alone she was marrying my direct competitor. Public opinion has turned on them big time and both of them have disabled their FB's as of today although their store page is still up. I even got a nice phone call from them screaming at me and threatening to sue me for harassment which I just hung up on after telling him to sue me. Fuck them, I welcome them to sue me and have to admit their own actions are the cause of this.

Also some people were misunderstanding when I was referencing Acutane. I know that it's highly unlikely for a mid 20's pregnant woman to be taking it. The only reason I brought it up was it was the first thing on the top of my head that causes you to have an increased chance of burning. There are a number of OTC medicines that can cause this issue. It's the reason why I have a specific spot on my waiver about using your judgement while tanning on any medicine and a list of specific meds/antibiotics that have known reactions on the wall of each room.

Finally, Facebook and Google have been absolute bros with helping me out with removing the false bad reviews. Yelp on the other hand is a different story and we are looking into what we can do. They have basically told me that unless I pay to advertise with them(again) I can expect absolutely no help at all. They have also hidden all of my good reviews, new and old, all you see are the negative 1 star reviews. NEVER do business with Yelp no matter how much it seems good.

Are bonus checks required to have child support removed from them in Texas?

    Posted: 08 Dec 2017 07:55 AM PST

Got my christmas bonus check from my work. No child support was removed from it. Should it be? There is a payment schedule for an exact amount to be deducted from my paycheck each week.

EX's friend learned of my check and informed her. She is screaming at me for the money. I want to know if I can legally tell her to get fucked pound sand.

EDIT: I am up to date on all of my payments.

my cousins ex husband and his family are cops in her area, she's being harassed by her ex husband and his family, and can't seem to get help

    Posted: 08 Dec 2017 05:50 AM PST

My cousin is in a custody battle with her ex, who's a cop. She has primary custody, but her ex and his family keeps threatening her. Her ex's niece keeps sending her texts threatening that my cousin is going to be arrested. Her ex brother in law is also a cop, and he sent a cop to their house and claimed she tried to run him off the road. Its absurd. My cousin is a 34 year old stay at home mom of 2, if she's not in church, she's at home with her kids. She has never been in trouble or arrested, she doesn't drink or do drugs or smoke. She's as church lady as they come. She called the cops because she was getting scared, but the one who came out was a friend of her ex husband and didn't really do anything. She's scared and not sure what she can do. They live in a small town. Her kids are afraid to go back to her husbands, but legally they have to. Her kids have even talked to their Dr at a check up about how scared of the dad they are. What are her options when his family and friends are all cops in the town?

    Edit*

Her ex husband is actually a sherrif, but his family are cops

[FL] A vehicle entered my lane, striking me, causing her to fishtail and hit a construction worker. I was issued a ticket due to witness accounts, now the driver admits to being at fault and accepted liability. She has no insurance...

    Posted: 08 Dec 2017 08:31 AM PST

There's a lot going on, and I need some advice. I am in the state of Florida.

I don't want to get into too much details about the crash, but the driver on my right side was following the vehicle in front of her very closely, the vehicle in front of her braked to make a turn, and she swerved into my lane striking the front of my car, which caused her to fish tail and do a 360 striking a construction worker. The construction worker didn't seem to be in critical care, but I am not sure of his condition.

The driver was taken away to receive care, before police arrived. A witness stayed behind to claim that I swerved into the left turn lane and then out striking her. The witnesses were in the same left turn lane yielding to the right of way, which means they 'saw' this through her rearview mirror.

I was issued a ticket for reckless driving based on the witness accounts.

My adjuster called today to tell me that the driver that hit me corroborated my side of events, and accepted 100% of the liability.

He stressed a few times to not waste my time filing through her insurance, because she has 'serious coverage issues'. I've heard "coverage issues" like 20 times in regards to the other driver. The policy that was given in the police report is the same insurance company as my own. She has her own adjuster as well. I am assuming that she may have been an excluded driver on the policy.

My first question is how am I looking in terms of liability, my adjuster is keeping the claim open until he finds out more from the police report about the condition of the worker.

My next question is the ticket, should I attempt to fight this? I have never fought a ticket before, I am not sure what type of evidence I will need. I called the FHP and the secretary emailed the officer that wrote the ticket my contact details. I heard that once a ticket is issued they can't void it. The ticket isn't too pricey and I can elect to do the driver improvement course to not get points or an insurance increase.

My last question deals with the 'coverage issues', my fender is bent as well as scratched up, and I can't open the door due to the bent fender. I am not too worried about my damages, I am still trying to decide if I should use my insurance to fix the car. Should I attempt a claim through her adjuster anyways? More importantly, is there anything I need to do to make FHP aware that she doesn't have valid coverage?

Did I break the law by not hiring a felon? OR

    Posted: 08 Dec 2017 10:52 AM PST

I'm the office manager for a cleaning company. We clean houses, office buildings, etc. Last week I interviewed a young man for an office cleaning position. Because all of these routes have banks on them, and our contract with the banks states that we will not staff felons to clean their buildings, I knew immediately that we would not be able to offer the position to him as he disclosed a felony on his application.

I should note that our office does NOT have any policies against hiring felons. One of our techs has a felony (although it is 30 years old) and this is in accordance with all of our contracts because he only works at the office. We do not necessarily discriminate against those who do, as we have had multiple employees with felonies in the past who have done great work. I proceeded with the young man's interview because I was planning on keeping his application if it went well if any positions we could offer him opened up.

At the end of the interview I told him we would let him know. This Tuesday I called everybody who I interviewed who did not get the position (including the felon) and let them know that we were going with somebody else. Today a certified letter arrived at our office from an employment lawyer basically saying that we have exhibited "disparate treatment" against him because of his felony status.

The owner is freaking out about this and our business' lawyer is coming down this afternoon. Obviously we'll do whatever he recommends but I am hoping to get some clarity on the matter before he arrives.

I should note, at no point did I tell the man that we were not hiring him because of the felony. I asked him a few basic questions about it - what was it for, how long had he been out, etc.

Questions: did I/the business commit any crimes/infractions related to discrimination?

From what I can tell disparate treatment means we treated to individuals with similar situations (felonies, in this case) and offered the job to somebody with a felony based on their color, gender, etc. This did not happen. We offered the job to somebody who did not have a felony record.

TLDR: Did not hire a cleaner because he had a felony (and also because he had a shitty interview). He's claiming discrimination. Did any occur?

TX - Can a boss make employees pay for parking at a required work event?

    Posted: 08 Dec 2017 08:58 AM PST

Someone I know has to go to a lunch for work, but there's no free parking. Her boss says that they won't get reimbursed. If that's allowed, is there something else she can do? It's not a lot of money, about $10, so it's not enough to affect taxes.

[NY] Studying abroad in a developing country. My (American) university denied us clean drinking water. Just wondering if my tuition is supposed to cover water...

    Posted: 08 Dec 2017 03:56 AM PST

We are told to buy our own water while abroad. Undergrads are provided free water filters, graduate students are not (I'm a grad student). Thought this was unfair but dealt with it, until recently, when I was also denied clean drinking water from a cooler on campus, from the school, where I pay tuition.

Tried to fill up a water bottle, was yelled at. Happened to a couple other students, also. We were literally turned away. Afterwards they put up signs next to the water coolers saying we cannot take-away water, we can only fill up cups to drink there.

I'm wondering if it could be argued that clean drinking water is a part of our university's safety policies? What, if any, legal responsibility do they have to provide students with clean drinking water while studying in a developing country? I would think it's included in my tuition, but it's not like they say "will provide clean water" in their FAQ, because the school is based out of the US and that's kind of a given, no?

Company starting to drug test for a drug I am prescribed (MD)

    Posted: 08 Dec 2017 10:18 AM PST

My company is starting a drug testing program that includes testing for amphetamines. I am prescribed both adderall and vyvanse by my doctor. The agreement states that my employer can still terminate employees who fail the test but have a valid prescription. The caveat is that they're only testing employees who they believe may be under the use of drugs at work.

Do I tell our HR department now that I am prescribed medication that would result in a failed test? Or do I wait to see if I am ever even pinged for a drug test? Would both options likely result in my termination? Is my only option to discontinue the medicine?

[CO] Required to sign ADA form for accomodations I never requested

    Posted: 07 Dec 2017 08:28 PM PST

    Hi legal advice!

I'm a physically disabled female working in a very specialized laboratory environment in Denver, CO.

I recently had a serious medical issue flare up that had me wheelchair bound for a long period of time and required multiple surgeries, that I used FMLA for. That's all squared away and I thought things were good at my workplace. Everyone visited, sent flowers, well wishes etc etc. I'm back on my feet now and while I'm in pain occasionally there have been 0 complaints about my work. I have another procedure that will put me out for 5 days (FMLA already approved) but will have me back on my feet and 100% healthier than I have EVER been before.

All of this is well communicated with my boss and supervisor. I disclosed my disability when I was hired, and have only had to request 1 accommodation (I needed a lower seat. It was as simple as swapping the chair with the tech next to me).

On Tuesday, I came in to find I had been removed from all the projects I was currently working on—no explanation given. I am no longer scheduled for any testing/science/lab work for the next 2 months, and am instead confined to paperwork only.

I approached my supervisor 'B' to ask if I had produced something unsatisfactory that resulted in the loss of duties, and she told me that it was an 'accommodation for my disability'. I never, ever requested any accommodation of the sort.

This is absolutely a demotion—I have lost a lot of responsibility here, and a lot of room to get published and further my career. I can do paperwork anywhere. I cannot develop novel gene therapies anywhere.

Today, B called me in to her office to tell me that since they have me doing strictly paperwork, I'm really not what they need and that it's putting a lot of pressure on the other technicians. She requested I fill out an ADA accommodation form (not yet provided to me) to 'cover myself' from any 'kickback'.

The kicker is I NEVER requested any accomodations. I have no idea where this is coming from.

My question is: is this discrimination based on my disability? Do I have any recourse? Do I have to fill out the form?

TL;DR. Disabled, demoted at work and told it is to 'accommodate me' but I never asked for any accomodations. Now told I'm not what they need and must fill out ADA accomodations form to 'cover myself'. Do I have any recourse?

ps. Yes I have a lawyer (seeing him for dinner Saturday, I nannied his kids and he specializes in wrongful termination suits but I hate asking him for legal help BECAUSE I AM NOT ACTIVELY PAYING HIM, he's a friend) and I already have 2 other interviews (like I said, highly specialized and competitive field so my skills are sought after). But this leaves a NASTY as hell taste in my mouth and I don't feel comfortable running if I can help someone avoid discrimination in the future.

FL - Many things happened during a turnover of our HOA and not sure everything they did was actually legal

    Posted: 08 Dec 2017 07:07 AM PST

    Hey all,

My HOA had a turnover meeting just the other day and something doesn't seem to be right. But I could be wrong here. Just a brief history, my HOA had 4 turnover meeting attempts in the past two years. We never could get a turnover as we didn't have enough people for a quorum. The amount needed for a quorum is pretty high. It's close to about 30% of the homeowners being present (or by proxy over mail) and according to someone I know who managed HOAs, that number was the highest he ever saw.

So on this night, they said there is not enough for a turnover, but will have a budget meeting. But before they done that, one board member of the board resigned and another did over the phone (they said board members were allowed to attend via phone) This meant two vacated positions were available.

Now they said per Florida Statute (and I can't see this statute) only one person in our development was interested in being director, so she was automatically voted in. She then took her neighbor and brought him in (without any votes or election process). They are both homeowners. Since multiple people did not run for the board, they claimed she was able to do all of this.

We then get to the budget meeting. They are raising our rates by $50 a year. They say that the rates are going up because of more common areas to mow. They then did a Q&A with us. I tried to see why the lawn care was going up by $8000 a year as the additional common areas did not seem that much more to me. But the property manager was useless and said she didn't have the info.

So the new budget is presented to the two board members and they approved it. It was shocking to me as they just got the information that the old builder controlled board had. So now our rates are going up and the HOA isn't turned over to the homeowners yet.

One other thing they mentioned is that they were trying to only need 10% of the vote by submitting paperwork to the county. But the county system was down. I'm puzzled how that is even possible since the bylaws say 30% vote is needed and how can you get around that without a quorum.

Does any of this seem skeptical?

    Failed drug test

    Posted: 08 Dec 2017 09:01 AM PST

I work in Virginia and recently failed a drug test for my place of employment. I have a prescription vyvanse(which failed me for amphetamines). I was sent him immediately - with pay - until further testing could be done to make sure it was vyvanse in my urine. The company does have a copy of my prescription, my doctors contact information, and pharmacy information. I was supposed to work last night at 7p. I received a call from an outside company saying they needed a copy of my prescription before I could be cleared. I sent it to them(though I didn't like doing that because I'm not even 100% sure the company was hired by my company). No one from HR has contacted me. My issue is I'm supposed to have a shift trade for 5 hours today so I can attend my wife's company Christmas party. If I miss tho trade I'll be forced to call in late and miss hours I need. Is being forced to stay home a violation of ADA even though I'm getting paid? How can they even test if it's vyvanse in my system versus another amphetamine without a blood draw?

[NY] Boss Constantly States That We Are Salaried, Refuses To Pay Overtime...Only Getting 400/Week Plus Commission...Is this legal?

    Posted: 08 Dec 2017 10:39 AM PST

    Hello R/LegalAdvice!

I currently work at a job in NY State (not the city, but not far from the city), where my boss states that we are salaried and therefore expected to work whenever he tells us to. The catch here, is that we are only paid $400 a week plus whatever commission we may or may not get ($30 every time someone shows for an appointment we set). I work in the office and pay for my own phone, computer (he recently forced me to get a new laptop so he could stay home and video chat with us at the office so he can ensure we are working), second phone line account, and any other things he tells us to buy for the job (we were filed for taxes under regular W-2). I have read that federal minimum to count as an "exempt employee" is $455 weekly, and it is more for New York, but I am unsure if there are some loopholes I have not found that allow our payrate to be what it is. He also recently took money from our pay on a day that the business was not open (Thanksgiving) and I have also read that this is not allowed for "exempt employees".

My other concern is that we recently found out that his business model, where we accept commission (the company) every time a person shows for their tour appointment at a school, is illegal if the school receives federal funding if the point is to increase enrollment rates. He discovered this, but shrugged it off because he claims we have nothing to do with enrollment rates...yet when attempting to get new clients he specifically states that we will increase their enrollment rates.

    Is any of this legal?

(Ohio) My wife died and I’m unsure how or what to do.

    Posted: 08 Dec 2017 01:09 PM PST

My wife died recently and did not have very much in the way of assets that were solely hers. She had a 401k (~$10k) which I am named beneficiary for. A bank account which bills are being paid from. A 2001 Oldsmobile with 140k+ miles. That's about it.

She was on my health insurance, but as I understand that, each person is a separate entity. We did not co-sign for any hospital stuff, and I have about $6k in bills all in her name from various places, one in collections.

My main question regards the 401k. Will I have to use the funds from that to pay the medical bills? A few non lawyer friends, with some experience in this, that I've talked to seemed to think the medical bills are now more or less not my problem, since she passed, and we weren't co-signed.

I had mentioned to one of the collections places that she had passed, as the lady was extremely rude, and I was in the middle of funeral planning when she called. They have not contacted me since.

I have gotten info from the funeral home as to lawyers in my area who practice probate law. I'm not sure if it's necessary, or really anything.

    Appreciate any help.

Landlord wants to charge us for calling fire department

    Posted: 08 Dec 2017 01:12 PM PST

(California Monterey County) Last night one of our sewage lines near our carport erupted, basically pumping out feces and toilet paper whenever we used any of the toilets in our apartment. My girlfriend called our landlord and she said she would have someone look at it tomorrow. We didn't think that not being able to use a restroom was healthy so we decided to call someone to see our options. We called Monterey sewage and they said that it was a health concern and dispatched the fire department to have a look. Upon arriving they contacted our landlord, talked to her I personally and I do not know what they told her but whatever it was worked because about 45 minutes later a plumber showed up and fixed our problem. Now this morning my girlfriend gets a phone call from the landlords boss, which is the owner of the investment group behind the apartments, and basically is told that we will have to pay for the plumber, cleaning service, and any fines from the fire department. What would our options here be? Are we actually liable for taking care of what the fire department deemed a health hazard? Thanks in advance!

[Canada] Contracted labor working for me on someone else's property?

    Posted: 08 Dec 2017 09:40 AM PST

Not sure if you guys discuss Canada too. It's unseasonably warm in Canada which bodes really well for a possible outdoor wedding ceremony if it stays this nice, but not at all well for the ground which is basically ice everywhere since the snow is all melting.

Should one of my self-employed vendors, photographer, decorator, etc. slip on the venue property, or hurt themself in some other wedding duty related way, who is responsible? Me as the one directing the work? The venue for having a slippery area? Their own business insurance? Luckily Free Healthcare! But there's still the whole WCB thing to go through I imagine. Thanks experts.

Is it a crime to impersonate a person who died 40 years ago?

    Posted: 08 Dec 2017 01:21 PM PST

I don't even know where to start with this. I don't even know what agency handles this kind of thing. You've heard about some sick, dysfunctional families before, but trust me when I say you're about to meet one of the sickest.

So: My mother's side of the family is ostracized from the rest of the family for very good reasons. My mother's side of the family, in brief, has variously been guilty of abuse, stalking, harassment, attempted kidnapping, fraud, check forgery, tax evasion, and several crimes of the sort handled under "domestic violence" and/ or "amber alert." They're kind of a religious cult. Collectively they have a rap sheet that goes on for miles, all hard time offenders. To make a long (crazy!) story short.

Recently this week: Several of them - I have proof of co-conspiracy - put up some unknown stranger to pose as my deceased brother and approach my immediate family. The story was strait out of a soap opera - "I faked my own death, but now I'm dying for real and need one last favor." They started out contacting my wife, mostly because they knew I'd see through it, and tried to convince her of some soap opera plot why she should keep this secret from me. She of course told me about it, and five minutes on the phone to this loser revealed him as a fake.

What law has been broken at this point? Who do I even go to about this?

These fuckers terrorize the rest of my family on a regular basis. We have moved to four different states to get away from them. Just when I think they've all died off, four, five years go by and they come back with another creepy plot. We've tried police, restraining orders, all legal avenues available to us. One thing we're told over and over is we can't seek protection unless said perpetrator poses immediate danger or threat to bodily harm. Yeah, but haunting me with the ghost of my dead brother doesn't fall under that, and they know that, and they just keep doing more shit like this!

All we want is for this to stop and for us to live our lives in peace. We're tired of running and hiding and being afraid of every stranger we meet. Are there ANY laws for situations like this?

Is it legal for me to have a nanny cam in my bedroom in the state of CA?

    Posted: 08 Dec 2017 02:16 AM PST

As title says. I've has some issues with a roommate coming into my bedroom. She's moved things around and admitted to going into my room once or twice on occasion. Things have gotten a little hostile and I'd like to have a camera in my room for protection. I keep my laptop, jewelry and other things in my bedroom, and it doesn't have a lock. She does also have quite a few people over, and sometimes people she has just met.

I couldn't find the laws regarding a personal bedroom, since California is a two part consent state.

Am I supposed to be taxed twice on my tips?

    Posted: 08 Dec 2017 09:25 AM PST

Hey guys, long time lurker here. I work for a local restaurant in Florida that a family friend owns as a server. Recently, we have switched over to receiving our tips on our paycheck the following week because its easier for the manager to do it from home. My question is, if i'm declaring all my tips for the week, why am I getting taxed for my tips that that OWE ME from the previous week? Any help and/or advice is appreciated. I really hate seeing hard workers get scammed out of their money. Thanks in advance.
