She asked me to help her somehow get out of that situation and if possible come to the US. She doesn't have a passport or a US birth certificate. I know there is one, but she doesn't have it herself. They came today and filled the tank up to 211 gallons. I called and they said "well we can't take the gas back out so we can work with you to pay it off". What's my legal recourse here? The bottom of the receipt they left us clearly has 50 GALS printed on it. I believe this is a scam they do often, that writing is clearly meant for the delivery person to see to know how much to put in. Hurricane Irma didn't hit her in south florida until the 10th. The line AT&T claims she damaged is at a random house ten minutes away. What are her options? They used to have an e-check option which meant no fees; however, this month, that isn't an option, and my only choices are credit cards that have a fee of at least $41.30. We're all just relaxing talking about life and how fun the escape room was, while (M16) decided to climb up a statue in the park inside the play area. Okay cool. It's not very tall and we take a picture of him on it and he's all "I'm king of the world!!" And great, awesome night. We go home and (38f) sees picture on FB and texts me saying it's illegal and disrespectful and i'm like we had no idea (honestly did not.. it's a public place and we weren't vandalizing anything, people and little kids climb on that shit all the time) and then says she's reporting the picture to the police dept and wants his name so I just stop answering at this point. We had no idea it was wrong, we didn't hurt anything, he's a minor. I only just turned 18. Realistically how much of a shit storm will this be? [NY] Landlord to keep Security Deposit after Fire that isn’t our fault Posted: 02 Dec 2017 05:56 AM PST Essentially our apartment that we rent, had a fire in the building which ultimately led to us not being able to live there anymore. Our lease is a pretty standard NYC lease. Our lease states that the security deposit is ours as long as we fully comply with the lease (we have). It additionally states that we do not have to pay rent while the apartment is not livable due to fire or other (we can't live there and can't even enter without signing a waiver). And it additionally states that the landlord must give us 30 days notice to make repairs and begin rebuilding (which hasn't happened yet). The landlord wants us to either pay December rent (which we won't be doing) or hold our security deposit and prorate the rent with the deposit until our stuff is removed. The stuff hasn't been removed yet as our insurance is in the process of having the adjuster come out and they will be removing our stuff within 30 days (which I think is fine because we haven't been given notice to vacate yet). What we want: no rent to be paid and security deposit returned in full. What are the next steps here? It's my understanding that small claims can handle stuff like this? Posted: 02 Dec 2017 08:23 AM PST Hello everyone, I'm looking for some advice on what to do about a sale my Step father entered into a year and a half ago. I tend to always give to many unneeded details so I'll try to just give to facts of this sale. We are located in WV. My SD ( step dad ) traded a older dozer ( he received 15,000 for it ) plus he was going to pay 25,000 in payments for a new dozer from a local buisness owner. They had known each other for years and the guy was very giving. There was no contracts, lawyers, signatures, etc. For this deal. My step dad DID receive a bill of sale from this guy bc my SD was wanting to try and get a loan to pay him the other 25,000. My SD wasn't able to get the loan so the guy just let him make payments. So my step dad gave the guy his older dozer and my step dad got the new one. My step dad was unable to make the payments for a couple months and called and told the guy that he could come and get the dozer if he wanted but the guy refused and told him that it was ok. I know my SD did make payments but Im unsure of how much he paid. A couple months ago this guy commited suicide and everything went to his wife. His wife is now wanting to sell everything at auction and has lawyers going around to collect all of his stuff. We haven't had any lawyers show up yet but my SD is worried that they will show up and take the dozer. If lawyers show up what should we do? The dozer my step dad traded is gone ( the guy might of sold it, we don't know ) and my SD did make payments on it, he just hasn't paid it off yet. Will my SD just lose everything he has already paid for this or should he just keep making the payments to his wife? Posted: 02 Dec 2017 11:02 AM PST The day before Thanksgiving the gas was shut off to (my) half of the rent-controlled building where I live in Brooklyn. A college kid put off calling in the problem until the day they left to go home for the holiday. Thanks, buddy! At first GF and I were told by the landlord that it would take a couple days to get the gas back on because National Grid would need to inspect after the work was done. The Friday after Thanksgiving the lines were fixed. Monday, National Grid came to inspect the work. We received no word on the return of gas. Yesterday, I come home to discover that National Grid has dug a hole in front of the building. There is a sign with a work permit/order that also says "Estimated complete date: January 2018" We have heat and hot water. But have no functioning stove or oven. Cooking is now limited to what we can do with a toaster oven and a two burner hot plate. The hot plate was purchased when we realised the gas wasn't coming back within a day or two. We're not completely fucked but it is extremely inconvenient and limits what we can cook. Are we entitled to any recompense for this matter? I'm not trying to make money off or take advantage of this situation, but if we are losing the use of a major appliance for a sizable portion of the lease I feel that we are entitled to some form of compensation. I accepted. Now that I've found a better position at another company, the company SUDDENLY found an error in payroll and is demanding repayment for my VP perks (auto allowance, parking pass etc) - despite the fact that my job description clearly stated VP. Do I have any recourse against this? Seems like the company is being vindictive because I am resigning under a year. Please help. Apartment Complex in Atlanta screwing over residents with parking (or lack thereof) Posted: 02 Dec 2017 06:52 AM PST Please help. Is our apartment breaking our contract agreement? When we first moved into this neighborhood we signed a lease that explicitly says "[Parking] rent is payable monthly to management in the sum of 00/100 Dollars per month..." Now, this used to include access to parking garages located at the base level of every building. About six weeks ago, management decided that they were going to start charging $25/month for parking garage spaces. Initially no one really minded as we believed that there would be plenty of other spaces to park... oh how naive we were. The first few nights were total chaos, there were people parked literally EVERYWHERE that didn't block cars from driving through the complex. Every single inch of curb, fire lanes, double parked cars, medians, weird nooks and crannies that didn't even seem possible. Managements response to this was... wait for it... booting. They've expanded the "fire lane" to incorporate everywhere that is not a parking spot and boot people for parking there. Although the situation is not as bad as it was initially, there are still far too few spaces for people to actually park. This is especially terrible for those who come home at night. Because my roommate gets home late from work, she regularly drives around 20 minutes to an hour to find a spot where they won't boot her car (again). Some residents park at local businesses OVER A MILE AWAY and walk home in the MIDDLE OF THE NIGHT. We live in a "nicer" area but come on y'all... this is ATLANTA!!! This is after they promised they wouldn't start booting cars until they passed out free parking passes to residents who don't want to pay extra. Surprise, no such pass has materialized. Management's argument is that there are several unauthorized vehicles parking in the (sometimes) gated community and they "believe" the booting will get rid of those vehicles. Meanwhile, residents (a.k.a people who pay to live here) are still getting booted regularly. Some with more than one boot at a time. The office claims that they are not responsible for the booting and blame the local police department. We have talked to actual police officers from the department and they have denied that claim. They also said that the so-called "fire lanes" in the apartment don't really qualify as such. This is because parking in those areas doesn't hinder the police or the fire dept from getting into buildings in the case of an emergency. Additionally, the police/fire dept would tow vehicles parked in fire lanes since booting them would only make it harder to move a car that was in their way. To add insult to injury, the only responses we get from management essentially tell us to stop complaining. Seriously, we got one that told us to stop calling corporate... We also just received an email from management telling residents to stop requesting reimbursement for booting fees. They say there are plenty of parking spots (793 free and 247 paid) for the neighborhood. They continue to claim that these freshly painted areas are legitimate fire lanes, which have to be approved by a fire official. They also have the audacity to tell RESIDENTS to pay for parking in garages to avoid getting booted or towed. "In closing, to avoid having your vehicles towed away or booted, you can purchase a guaranteed parking space. You can discontinue the garage permit at anytime. The cost to boot a vehicle is $75 (that is 3 months of guaranteed parking). To tow a car costs $150 (that is 6 months of guaranteed parking)." It literally says that parking is FREE in our lease... I don't know what to do. I've looked through our lease and my incredibly untrained eyes find some of the language seems to be on our side while some seems to be on the side of management. There are 480 units in this complex, with the majority being 2 and 3 bedroom apartments. It seems to me that there could easily be more than 793 people here who drive and need a place to park their car. My current and only plan of attack is to start a FB group, get angry residents to join, and crowd fund a contract lawyer. What else can I do if anything? If you think I'm exaggerating, google Arium Glenridge apartments and look at the reviews. Also, take note of an obviously fake review (posted 2 weeks before me writing this) and a genuinely confusing reply(?) from the management (posted a whole month before me writing this)...? tl;dr I'm currently living in an apartment complex that INTENTIONALLY removed access to parking spots, creating more demand than supply. [MO] Child telling me ex-wife is endangering him Posted: 01 Dec 2017 08:30 PM PST So to give you some background... My child's mother and I got divorced 7 years ago and IMO it was a huge ordeal and very expensive. The experience of going to court and the legal battle left a pretty bad taste in my mouth. In the end we ended up with a pretty normal arrangement with joint legal/physical custody of our son where I have him every other weekend with me paying child support. I have always stayed up to date with child support, provided him with health insurance and whatever else he has needed. For the past 6 years I have not lived in town due to needing to move to a larger metro for employment. Currently I am living 4 hours away, but I always make it down every other weekend to pick him up as long as the weather isn't dangerous. In the past 7 years my ex hasn't exactly made the best choices and it seems to have gotten worse lately. She has had 2 other kids with 2 different guys and currently has custody of all 3 kids as far as I know. From what I have heard, one of the father is divorcing her right now and is attempting to get custody of their child. My son, who is now 10, has recently started telling me about the issues between her boyfriends/husband/etc. and what goes on at the house. This culminated with what has apparently happened when I dropped him off last time. I could tell something was weird as his mom was sitting in the car in the driveway when I arrived and when I got out to help him with backpack I mentioned his report card and things just seemed off with her giving me a crappy answer and yelling at my son to get in the car. I thought maybe she was just upset with something and didn't give it much thought at the time. Fast forward to this weekend and my wife(his step-mom) was asking about the previous weekend and he spilled the beans. Apparently his mom was drunk with an open container in the car and she had locked herself out of the house. I guess she was driving him around and her current husband that she is divorcing was following her and at some point there was an accident and he says she just drove off. I guess his grandmother had to pick him up later that night so that he could sleep and make it to school the next day because his mother couldn't get him there... Really at this point I am at a loss of what I can do since it is just his word. I completely believe him, but from everything I read they really don't like to use children in court. When I look her up I was able to see she was arrested once a year ago for property damage or something but I don't think she was ever convicted of anything or went to court so there isn't anything official. Is there anything I can do other than keep track of what my son says? My ex recently got him a phone, I was considering telling him to call 911 if it happens again but am afraid about how that might turn out for him if things didn't go as planned. Posted: 02 Dec 2017 08:30 AM PST My roommate was drinking with her friends and set our kitchen on fire. She ran into my room screaming for help putting out a fire. I ran into the kitchen to see a fire so large it was already almost to the roof. She was screaming that she already tried baking soda with no luck. She used way too much oil. I grabbed the fire extinguisher but it wasn't rated for grease fires (didn't know at the time) and only made it sorta worse. I then tried smothering it with a blanket but it was too large at this point. Finally, with the blanket over the pan full of burning oil, I picked it up spilling boiling oil all over my arms and legs and threw it outside; containing the fire. Once the fire department got there they said my quick thinking saved the entire house. If the ceiling would have caught, it would have completed burned down. So now our stove, microwave, cabinets, and floor are burned up. She has renters insurance and filed a claim for the damage. Should I file a claim with her insurance for medical bills, missed work, and pain and suffering from my 2nd and 3rd degree grease burns plus saving everything? Also, how would I do that? We live in a condo complex in TN. Any advice is welcomed, thanks! FYI: I only tried to put the fire out because I don't have renters insurance. I cant think about anuyhing else. I realize its because of the way im treated and the culutural environment of my job. I work in male dominated industry (think car sales) for a multimillion $$ company that I've been with for almost a decade. Over time, I've put up with and allowed really disgusting behavior. Here are some examples: My direct manager has had pornographic dreams about me and on two occasions just HAD to describe them to me in detail. One occured when i was about 6 months pregnant, and he dreamt about my pregnant body. This same manager showed me freeze frame of a girl in porn video and said he thought about me when he watched it. The previous general manager would give me back rubs and put his hands on my neck when he'd visit my desk. Run his hands through my hair, real touchy feely guy. I've been asked what kind of porn i watch. If i shave my pubic hair. A manager once told me he wished he got to be the one who knocked me up. That same manager said he wanted to try my breastmilk "from the tap". A couple problems i have: Signed a forced arbitration agreement in the revised handbook that came out earlier this year Some of the harassment came from employees no longer working there. Police K9 bit my brother's arm several times Posted: 02 Dec 2017 12:49 PM PST Hi everyone, Last night my little brother was bit by a police's K9 which resulted in several injuries towards his arm. He was leaving his girlfriend's house and apparently the police were looking for a suspect in a Honda Civic (supposedly for car-theft), and my little brother was driving a 2011 Mazda 3. My brother was in his car (parked on the side) on his phone. Moments later he suddenly noticed a police car pull up behind him with the lights on. He opened the door to go out and ask what is happening, but before he could even step out of the car, the police's K9 was already attacking his arm (the arm that was opening the car door open). My brother was yelling at the police to get the dog off his arm, which they eventually did. They searched his car anyway and never apologized- only to say that he shouldn't be where he was yesterday night. They told him to get his arm checked, gave him their case file number and badge numbers. My little brother has never got into any form of trouble with the law or at school (valedictorian, volunteers at a senior home- that kind of guy) and was just heading out to visit his girlfriend after studying for his final exams. He's currently on his way to the doctor for an assessment and my dad plans on taking legal action. Thoughts? EDIT: From British Columbia, Canada. (Wyoming) Vicious Dog charge - pet snapped at police officer's child Posted: 02 Dec 2017 10:12 AM PST A bit of background first. We live in a very small town and just recently moved to a new house. My girlfriend's giant schnauzer - Aussie mix dog who I will refer to as J, has never had issues running away, but for whatever reason at this house he has jumped out and ran around town a few times. Each time a police officer has found him and we have retrieved him. He has always been very friendly so no issues with aggressiveness, but he is known for escaping. Now for the story: On November 4th my girlfriend and I took our dogs for a walk to go get coffee. We tied them up outside the shop, went in and got coffee. All went well, we got our coffee and went to sit with the dogs. We were sitting directly outside the shop on a bench, directly behind us there is a ramp to go into the shop. [also important to note the shop is owned by a town police officer's wife.] As we sat there, the police officer and his kids showed up to go inside. As they walked up the ramp, the first kid pet J, as he walked past the smallest kid (maybe 4 years old) made a short yip/yell while directly behind J. In surprise, J whipped around and snapped at the kid's leg. All in what felt like a half-second, J grabbed the kid's pant leg leading the kid to fall over, and the situation ended. While my girlfriend sat with the dogs I went inside with the kids and police officer to make sure she was OK. The kid had two very small scratches on her leg from J's teeth (was not bleeding at all). As they comforted her, I assured them we would of course pay for any medical bills if they wished to see a doctor. The police officer was off duty so he called a fellow on duty officer to the scene. I spoke with the police officer and gave him my address so he could swing by and get proof of J's vaccinations (which he was current on). At that point he said no charges would be filed as it was a one time, non-serious incident. Once the officer arrived to our house he informed me he had spoken to the mother (who was not present at the time of the incident) and vicious dog charges would be filed. The first court date was about 3 weeks ago. At that point, the mom had never put in her restitution claims. Because of that the judge suggested we plead non-guilty and another court date was set for early December (next week as of writing this). The police officer who wrote the citation was not present at the court date, nor were the parents of the child. Immediately after the charges being issued, we began behavior training for J and also put up a heavy duty run for him in the yard which totally prevents him from escaping. A few other things that might be of note: -The situation that led to the bite seemed like a perfect storm. The kid was maybe 6 inches behind him and in his blind spot when he whipped around and snapped. Also, he has never been aggressive other than your typical barking when someone arrives at the house. While all that may be true, there is still no reason a dog should ever bite anyone without cause, let alone a child. We are taking every precaution to ensure it never happens again. -The mom is the one filing charges and she was not present for the attack. We have heard gossip around town she is very unhappy and wants to hit us hard with charges (don't know if that is true or not, or what she has in mind). -An official statement was never taken from us. It seems all the info the police have is from the wife and possibly her husband (the police officer). -The next court date is next week and we still haven't heard anything about the grievances/restitution (not sure which is the appropriate term) she is planning on filing. -We spoke with an attorney very briefly after the first court date. He said we should hold off on actually hiring him until we learn the grievances. He also said because of who the dog bit, our best bet was to hope the prosecutor goes easy on us. We would likely look for a different attorney if we end up needing one. I think that about sums it up. We know his behavior was very wrong and not acceptable and are doing everything possible to ensure that was the first and only time it happens. We are just very concerned about the situation and feel the deck might be stacked against us. Small town, local police officer vs. a younger couple and their dog - neither of us have been in town more than a few years so we don't have the social standing they do. There's a signed bill of sale but I guess I had forgotten to sign off the title (will meet with buyer tomorrow to sign). I also left my cancelled license plates with the buyer so they wouldn't get pulled over on the way home (didn't realize that they're actually able to drive without a license plate 15 days after sale, and that I'm responsible for destroying my own plates). In my state, it is not required for us to return plates to the RMV, so I thought that whatever happened with the plates after my cancellation of them was not on me. Anyway, hadn't heard anything from the driver for a month or so and he messaged me today letting me know he went on a road trip with the car from MA to NC and drove through some toll roads without paying. But he offered to pay the tolls once they're mailed to me. That's not what I'm worried about - the license plate is technically cancelled but because I had forgotten to sign off the title (even though I have the bill of sale), am I still responsible for the legal issue of this guy driving with expired plates? Whistleblowing My “Healthy Eating” Employer Posted: 01 Dec 2017 02:58 PM PST Illinois. I took a job a couple years ago with an up and coming food delivery startup. We make the food, we tell you it's healthy, we deliver it to your door, you tell us how good you feel after eating it, blah blah blah. Over the past months, the entire company, from the CEO down, has been aware of massive flaws within our provided nutritional information and ingredient claims - not only lying directly and blatantly about the provenance of our ingredients, but going so far as to force our system (which calculates nutritional information) to "hide" certain issues with our menu that don't line up with who we want to be - for example, showing a salad dressing to contain 10% of the canola oil actually used, in order to drop the calories and fat count way down in our customer facing materials. I realize this is all highly unethical - it makes me totally sick. I've been told we don't even have to provide nutritional info, which may or may not be true. Is this illegal? What should I be doing? How can I protect myself if I were to mention this to a regulatory/government body? I really need this job, but I can't live with this anymore. [link] [comments] |

What to do when used car dealer claims trade-in car is faulty and demands trade-in value back Posted: 02 Dec 2017 11:09 AM PST Legal Transaction in New York City So yesterday, I traded in a 2008 BMW 650i with 145,000 miles on the car for a used 2014 Lexus LS460 at a used car dealership. They offered $6,000 for my BMW, which I felt was on the lower end of reasonable, and the Lexus price was very reasonable ($37,000), so we made the deal. The deal was signed, my BMW title was transferred to the dealer, the Lexus title transferred to the credit union that is financing the loan, and I left with the Lexus yesterday afternoon. Today, I get an angry call from the dealer, saying that white smoke is billowing from the back of the BMW that they have on the lot while they've been cleaning the car. They say they've driven less than one mile in the car to take it around the block. Now, the car is not new, and not without its faults, but I've never seen that much white smoke billowing out the back of the car since at 90K miles or so there was a problem with the engine that I had repaired, and repaired well. In the nearly 60K miles since, I have not seen an enormous amount of white smoke behind my car. I would have had it repaired. I should also note that the BMW went in for emissions testing a couple months ago. Now they are demanding that I take one of three steps: 1) take back the car and return to them their $6,000 of trade-in value, 2) admit that the car has a bad engine, and return to them some unspecified portion of the $6,000 of trade-in value, or 3) take the car to my own mechanic and have it repaired for them. I've never heard of this happening before to myself, or to my family, or any of my friends, so I am a bit shocked. Is this a scam? What can the car dealership do to enforce their demands? Posted: 01 Dec 2017 07:53 PM PST West Virginia. First time poster to this subreddit from a throwaway account. I work for a medical supply company as a delivery driver providing oxygen and durable medical equipment. Shortly after the start of my shift today, some coworkers were goofing off with one tossing some piece of medical equipment to the other using some metal pole as a bat and swung and impacted the object in midair. I was not engaged in any of the goofing off and was merely a bystander. When the object was impacted, a piece of it flung off and moving quickly, hit me in my head. I didn't even see it coming. It caused a small cut and my head to hurt a little bit at first. I began working on my delivery route with seemingly no symptoms except for a headache. After about an hour, I noticed my headache had become much worse and I began to feel nauseous. Then I realized I haven't ate at all that day and it was past lunch. The nausea increased and then blurred vision began. I knew I could no longer continue to drive and since I was already on my route, I drove myself home instead of back to the office to reduce driving distance. I had been attempting to reach my primary care doctor but have been unable to reach him. I had a family member drive me to an urgent care office that refused to see me and immediately referred me to an emergency room. In the ER, my head felt like someone had thrown an axe into it, the nausea continued, and I began to realize the lapses in memory I was having throughout the day. For instance, I went to the store to pick up a few things and nearly walked out of the store without paying simply because I almost forgot to pay. A CT scan was performed and I was diagnosed with a cerebral concussion. The ER doctor told me to take it easy, rest, avoid head trauma, and take Tylenol for pain. I called work and told them what happened and they seemed much more worried about me being able to be on call this weekend and work than my having a concussion due to an occurrence at work. My questions are, while the hospital asked for my insurance information, should I or my insurance, or both have to pay for the emergency room visit or is this something to do with workman's comp? I have no idea how workman's comp works and I've never had to worry about workman's comp before. My "supervisor" stated that in order for me to file a workman's comp claim, the office manager has to be with me during the trip to the emergency room which was logistically impossible due to me being a delivery driver and not necessarily having all of my faculties. The doctor said for me to take the weekend off but my "supervisor" is more worried about me taking calls and being on call and told me he's had concussions before and said to me "you'll be fine tomorrow" due to his long history of having concussions (he is younger than I am and was NOT present during the incident). The "supervisor" also wanted to know what I told the emergency room staff happened. I only told them that I was impacted from a piece of medical equipment. I think the trauma actually clouded my recollection of what happened when I was trying to explain what happened. I can tell that my faculties have not all returned because I typed the entirety of this text in the 'Title' box instead of the 'Text' box. (PA) Does my landlord have to change locks if he knows the neighbor walks in? Posted: 02 Dec 2017 12:20 PM PST I am renting a duplex. The former tenant used to live in this duplex but moved to the one next door. I have only lived here for 6 weeks. When I first moved in, I noticed strange things happening. While I was at work, I would lock the doors (of course) and the deadbolt would be unlocked when I came home. Just the bottom would be locked. Well, one night I came home very late after a dinner party. I opened the door and left my key in the door to run back out to my car. This is a quiet, dead end street with no one across the road. I walked in the kitchen for 5 seconds and back into the living room. My neighbor (the one that used to rent here) had opened my door with the key and was standing in my living room. He said to me "Your keys were in the door, do you know that?". I was so freaked out (live alone), I told him get out and piled up things behind the door. I didn't go back out to unload the rest of my car that night. A few weeks later, he knocked on my door. He asked if he left his fishing kit here. He told me to go check the basement. I said no, it's not here. He held up a toolkit and said "Well, I found this toolkit after you moved in and thought it might be there.". He OPENLY admitted to entering my place, taking a toolkit that has been hanging in the basement for weeks, and was okay with it. I wanted to call the police but don't have a time/date of the entering. I immediately contacted my Landlord. My landlord stated the tenant next door is a "good guy" and that since he turned in all the keys after moving, I will have to pay a locksmith $150 to change all locks. I do not want to make any enemies but this man has GOT to stop entering when I am not home. I can't really afford a home security system at this time. Do I have any rights?
