[AL] Friend was physically shoved at work by manager and fired the same week she reported it to corporate HR.

    Posted: 30 Dec 2017 09:26 AM PST

Friend worked for a popular mall retail chain in Alabama. Friend was working the register and helping a customer and a manager became upset at her for being too slow. Manager then pushed friend out of the way of the register and this caused friend to slam into one of the shelving units. It was a two hand shove and not like a shoulder bump, hard enough to send her flying and knock product off the shelf, causing some minor bruising. Manager has known anger problems.

Friend reports this to the other manager working that day and is told to let it go because that's just how the other manager is. Friend then reports it to corporate HR and gives her statement.

The store manager then let's her go at her next shift before she got a chance to hear back from HR.

Our questions are, can she report this to the police? She was talked out of calling for mall security at the time of the incident, but she's pretty shaken up. Also, is there anyone else she can file a complaint with or report this guy too? She doesn't really care about losing her job since she's still a student, but she wants to make sure this guy can't hurt another employee.

I caught my 16 year old daughter with a 30 year old man. I don't know what to do or how to proceed. (CA)

    Posted: 30 Dec 2017 10:56 AM PST

This is a throwaway account because my main account has identifiable info.

I called my daughter last night to pick her up but she wouldn't answer. I didn't think too much of it because she usually doesn't pick up on the first try. I went to the place she was supposed to meet me at 9pm. She didnt show so i called her "friend" she was supposed to be with and she wasnt at her house either. Eventually she shows up around the corner, stumbling. She was clearly intoxicated and her breath confirmed it as she got in the car. I questioned her and eventually got the truth out of her. She was with her boyfriend. Ok, i get it she wouldnt want to tell her dad about it but why are you drunk?. Who is this guy that has access to booze? How old is he? She revealed his age and my whole perspective changed. 31 yrs old. Older than my oldest son. It broke me.

As a father, and most importantly as a man, i assumed the worst. And sure enough, it was the worst. I opened up her phone only to sink even lower. I dont know how a 30 year old man can talk to a teenager like that. there was a plethora of sexual exchanges between them in writing and pictures. She met him at her job at a local furniture shop. She was doing good in school so we thought she would be able to handle a little more responsibility, she had the desire to work, after all. We started seeing a radical change in her attitude and persona. We caught her on drugs, skipping work, skipping school and all those times, he was with this person.

This is where my dilemma comes in. I am dead set on sending this guy to jail but i dont know how to proceed. Do i have something here? Should i contact the cops, a lawyer? What should i do? Im a little desperate and i feel like a failure. I know kids are supposed to be this way i just never thought they would be mine. Thank you in advance for you responses

TL;DR 16 yr olddaughter is dating a 30 yr old. He is a complete dirtbag who gets her drunk, gives her drugs, and im just trying to steer some sense into her.

My 70 year old mother who has major dental anxiety went in to have a simple mold procedure done...(the kind I’ve had for whitening trays)...The Dentist came in to remove it ,usually just a simple removal and they pop out. Well....apparently the person who mixed this must have used permanent cement.

    Posted: 30 Dec 2017 02:38 AM PST

The next hour consisted of a very upset dentist trying to remove this thing, popping her jaw in and out, my mother in a full panic attack crying from pain, her lip was cut in several places, and finally he ended up drilling the heck out of this thing to remove it. My distraught mother was given no explanation or apology,..and in shock pays the 700 dollar bill and leaves. She has to travel three hours to get to her provider because she has K.P. Needless to say, I'm livid. Not sure what to do but mistakes like this shouldn't happen. Thank you

[TX] Traffic lawyer failed to appear - warrant issued

    Posted: 30 Dec 2017 09:45 AM PST

I had my first traffic incident in ~10 years back in October, and was issued a moving violation. Due to some upcoming travel and what I generally thought was best practice, I decided to let a lawyer handle it. I hadn't needed such a lawyer in a long time, and none of my friends knew of anyone to refer me to, so I just google searched and picked someone that seemed reputable from reviews. I paid the lawyer, sent them the information that they requested, and waited for the results. All of this done online/via email.

At some point I thought it was weird that I had not heard anything from them, so I emailed them asking for an update and the response was simply, "we are handling it." The municipality has an online search tool, so I was able to at least verify that they had contacted the court and things were moving in the usual, albeit slow, manner.

Last week, I thought again to myself that it was weird that I had not heard anything in a while, but instead of emailing, I looked up the case online again, and found that I had a warrant for my arrest issued about a week prior because of failure to appear. So if I'm reading that correctly, my lawyer got a court date scheduled on the docket and then forgot about the case.

I emailed them a screenshot and they replied saying, "We'll get this taken care of once the courts are open again." This going down during the holidays is complicating things. I replied saying that I want to be looped in on everything as they are doing it moving forward. The lawyer's assistant said she'd be in touch.

Since then, I can see through the web search that there was an email correspondence entry added to my case and nothing else. I have received no further emails from the lawyer. As far as I know, I do still have a warrant out for my arrest.

Questions: 1) It seems like this is a really big deal to me and isn't a big deal to my lawyer at all. Which one of us is right? 2) I started receiving a huge increase in spam/unknown number/private number calls around the time that the warrant was issued. Is it likely that there is a correlation here? 3) I'm terrified of leaving the house this weekend. With the New Year's things going on, I know that there is an increased police presence on the roads. Not that I would drink and drive, but this does increase the likelihood of being pulled over, which in this case would result in my arrest. Is this a reasonable concern? 4) I'm overdue for updating the address on my driver's license. I've had HORRIBLE luck doing this online previously, so I've been going into the TxDoT location nearby whenever I need an update done. That would obviously be a bad idea for me to do now, right? 5) What recourse do I have with my lawyer? I know that the whole idea of traffic law is you can do them quick and easy and thus, in volume, but completely whiffing on my case seems excessive. The lack of communication I could understand if things were going completely normal. But when combined with ruining my weekend, making me terrified of the sight of police, and possibly ending up in jail if I get pulled over for anything, I'm more than just a little pissed at the silent treatment, holidays or no. But it isn't like I can threaten to not pay him or anything like that. I'm already out the money I paid him, so I'd prefer to NOT have to hire another lawyer to fix his mistakes.... Uhg, I'm just angry and confused and not knowledgeable and it's infuriating.

    So, help?

tl;dr: Traffic lawyer failed to appear. Warrant out for my arrest. What do I do now?

Was just given a ticket for driving without a license for backing out of my driveway and repositioning to the other side of my driveway.

    Posted: 30 Dec 2017 09:58 AM PST

So my parents are stating that this Garland police officer was just looking for any excuse to ticket anyone when he got me.

Short story is I am parked behind parents this morning. They wake me up to move my car and I throw on a hoodie with my pajama pants to cover up my bed head. It is obvious to tell by looking at me I just threw on whatever to move the car.

I move my car and as I am walking in through the garage I hear a police siren activated 2-3 times just to get my attention. I walk back out and see the officer walking up towards me with his digital pad.

I ask him if something is wrong and he asks me for my license. I tell him it is in the house as I was just moving the car. He says "thought so" and tells me to go get it.

When I hand him my license, he goes back to his car without saying a single word to me or my parents.

Five minutes or so later he comes back out and hands me a ticket for driving without a license on me. Now as far as my little bit of googling has shown, in Garland this produces a 25ish dollar fee in the court.

Basically I was cited for driving without a license. I showed my license to the officer at the scene proving I have one. So my course of action is to go to court with my license, get it dismissed, and pay the 25 dollar fee.

So the police officer knowingly wrote me a ticket that he knew would only collect 25 dollars.

I do not feel this is right. He basically wrote me a ticket he knew would be dismissed knowing that it would generate a small amount of revenue for the city.

My parents seem to think the ticket may be more severe than I think though. They say that there are separate charges for forgetting your license and for willfully driving without one. Then again all I did was move my car from one side of the driveway to another.

Very pissed off right now so if I rambled a bit I am sorry. If the charge is the lesser charge and the 25 dollars I know I should just pay it. But there is a strong urge to fight it in court. If it goes to court and gets dismissed, are the fees higher? Is there a fee if the judge rules in my favor?

How can I find out if this is the greater charge also? I would hate to present myself to court and find out that I am to pay much more than 25 dollars because I misread the charge.

The citation says the violation was operating a motor vehicle without a license.

[NY] I want to leave my current employer, but they are threatening legal action. The contract states that they can terminate me at will, but no clauses about me terminating the organization.

    Posted: 30 Dec 2017 07:12 AM PST

It's a two year contract. I want to leave due to issues with the organizations and family reasons. I'm part of a union.

I read the contract a few times. The only clause under the termination section is about how the organization can terminate and didn't say anything about me leaving the organization. On what ground can the employer purse legal actions? Any recommendations for contract lawyers in NYC?

(MA) Hospital placed a wire in my arm to track me, without my knowledge or consent. Photo included for proof. I have called multiple law offices but no one is returning my calls. Somebody please, please help me.

    Posted: 29 Dec 2017 02:27 PM PST

About three weeks ago, I was admitted to a psychiatric hospital due to various problems. It's a long story, but the short version is I have schizoaffective personality disorder and I was not taking my meds properly. After I was stabilized, I was discharged, but it has come to my attention that something is terribly wrong.

The hospital has placed a wire in my arm that I believe acts as a tracking device. It is quite obvious, especially when I flex my arm-- I can see it bulge in my wrist. I tried to take a picture but imgur is not letting me upload.

This has caused me great distress. I stay locked in my house because I'm afraid of going somewhere or doing something "wrong" and getting forced back to the hospital. I've also become concerned about my medications. If the hospital staff inserted a wire without my consent, what have they done with my meds? I have Zyprexa and haldol, but I dare not take them now.

I have a few questions about the legal aspect of all this:

    1. The insertion of the tracking device without my consent-- surely that's not legal? My understanding is the patient has to consent before a medical procedure is done.

    2. The distress caused by this, does that count as damages? Should I sue?

    3. How on earth do I get the wire removed? I don't have money to pay a surgeon to remove it. Can I get the psych hospital to pay for it?

I've called several law offices in my area and explained my case, but no one has called me back. I feel so isolated and I'm getting desperate. Please, somebody help me.

EDIT: Thanks to everyone who has talked to me. I guess legal advice is not really what I needed. I am calling an ambulance and getting help.

Wal-Mart messed up after oil change. Parts of car broken. Them saying they might not pay to fix (PA)

    Posted: 30 Dec 2017 06:33 AM PST

Earlier this week I got my usual oil change at walmart. The next morning on my way to work I heard a noise and the skid plate blew off and broke while I was driving down the highway. After I left work I went to Wal-Mart to file an incident report. Went back in today to speak with the auto service centers manager since he knew more about the process than anyone else in the store. Anyways during our conversation he said he would order a new skid plate. I told him to wait until I had an estimate done this Tuesday. He said nothing else should be broken. I told him that I'm just making sure nothing else is damaged since I was moving st 75mph when it broke off. He then told me if the estimate is over $500 it would have to go through their claims department and he said odds are they Won t pay to fix it. That my best bet is for him just to order it and put the new one on. I said I still want to have it looked at by s licensed shop.

Always to my point. If they refuse to fix it is my only chance at them fixing it is taking them to small claims? And if I do are they just liable for repairs? Or can they be responsible for any lost time at Work or any other lost time on my end?

    Coworker smoking cigarettes

    Posted: 30 Dec 2017 08:36 AM PST

I work in Virginia as an assistant delivery driver. The lead driver is a cigarette smoker who smokes almost a pack a day while we ride around in the truck doing deliveries. I guess I'm curious as to what my rights are? Can he be forced to not smoke in the work truck? Do I have the right to refuse to ride with him if he is smoking? I would like to avoid ruffling any feathers, as I spend about 8 hours a day in close quarters with him. But I am more concerned about not dealing with the smoke. I don't have any allergies that are triggered by cigarette smoke. I used to smoke cigarettes, but I worked my ass off to quit. Now I have to be surrounded by the smoke everyday and I go home smelling like an ashtray everyday. I do still use smokeless tobacco (dip) on occasion, if that matters. But I am trying extremely hard to quit.

    My invented character..

    Posted: 30 Dec 2017 05:52 AM PST

So I have a character I invented, the name of which I obviously can't disclose. I have invented this character an his name and recently hosted a comedy show under this character's name. Now the person who is running this show is trying to oust me and use another person with a bastardized version of the name i created to host the show. I do not agree with this. She says I haven't copywrited the name, which I haven't yet, and she can do whatever she wants. I need advice. How do I copywrite my idea as soon as possible before she can do it. Full disclosure, we were lovers and she is trying to put the screws on me and oust me completely from this idea. Sorry if this doesn't make a lot of sense, we just had this argument and I am very drunk. Time is if the essence. Please help.

Just moved into a neighborhood and got a surprise that we have an HOA without this being disclosed on our buying agreement. Now they want to collect dues...

    Posted: 30 Dec 2017 11:27 AM PST

My wife and I just bought a house in a neighborhood that has been around since 2002. After we moved in, we started to go around to meet the neighbors, and a few of them gave us a heads up that an HOA is trying to collect dues, even though they have never tried it before and it was not in our sellers disclosure statement in the purchase agreement. The dues are a measly $60 per year but they also put several restrictions on what we can do to the exterior of our homes. What's even better is that they just sent us the official information today and the dues are due on the 1st of the year. My question is, can an HOA who has been stagnant and not collecting dues for years, come in and start requesting dues even when a majority of residents bought a house under the understanding that there was no HOA? A lot of our new neighbors are pissed and I'm just trying to get more legal info about it. We live in Michigan.

Brother and I lied in court when we were kids. How can we fix that now? (WI)

    Posted: 29 Dec 2017 10:33 PM PST

I really feel like shit about this and I know I messed up big time. I am trying to fix it now and am wondering if there is anything I can do. So, basically when I was 10 years old and my brother was 8, my mom and dad split up. Apparently my dad had been cheating on my mom for several years and had finally announced that he was leaving her to be with his girlfriend.

I was really mad at my dad for leaving my mom. She cried a lot and was always sad. Well, then my dad wanted joint custody of me and my brother. We didn't want to see him because of what he did to our mom... But being our dad, he fought to get custody of us. Well, my mom told me and my brother to lie in court about some things that never happened. She said if we didn't lie and tell the court that our dad was violent and abusive, then we would be taken away and not get to see her anymore. Of course me being 10 and my brother being 8, this sounded very scary to us. So my mom told us what to say and we both lied to the family judge about my dad being violent towards us and our mom.

I'm 16 now and I want to go into law enforcement after high school. I haven't seen my dad since I was 10... Even if he did want to see me (I doubt he does), I don't think I could face him. Now that I'm older and understand the consequences of my actions (and my brother's), I am ashamed about what we did to our dad.

We live in the state of Wisconsin and they have this public website called CCAP where you can look up anyone's name who has ever had a run-in with the law. They also list things under people's names like evictions, small courts stuff, divorces, etc. I looked up my dad once and saw that there were restraining orders on him from my mom... also a couple domestic violence charges reported by my mom. My dad is not a violent guy. He was never an asshole to me or my brother and never did he ever hit us. He never hurt my mom either. He wasn't that kind of guy. He was just some dude who couldn't keep his pants up and we destroyed his life by making him look like a wife beater.

I guess if I am going into law enforcement, this is just something that has been weighing heavy on my heart. Maybe it's too late to change anything. I just want to know if there is anything I can do to fix some of the damage me and my brother caused to our dad's reputation. No doubt he lost some opportunities along the way if anyone looked him up. Any advice is appreciated, thanks.

Friend rescued malnourished, tick and flea infested, hair matted, parasite infested puppy on the street on the 16th. Original owners want the puppy back and said they lost it on the 15th. Need advice on how to go about this.

    Posted: 30 Dec 2017 11:36 AM PST

My friend found a puppy on December 16th. The puppy's hair was matted, it was scared of humans, wouldn't eat, had fleas and ticks, and on the same day he took the puppy to the vet they discovered that it didn't have any shots and it had worms in its stomach as well. I saw a local ad on Facebook the other day with this dog on it, saying it was lost on the 15th and that petfood express called them saying that the dog was in possession of a "Persian family" and last spotted in my hometown. This ad was updated yesterday. My friend is absolutely devastated as he has really bonded with this dog and nursed it back to health. He also feels like he's going to be racially profiled now because of the ad and feels uncomfortable walking around. He doesn't believe that he should return the dog to the original owners because the dog was reported lost on the 15th, but was in such bad condition when they found him on the 16th (how could a puppy be like this after only 1 day on the street). He also paid over $1000 in vet expenses for this pup.

Is there any way that we can fight this and perhaps keep the puppy? He has vet receipts, receipts from pet stores for parasite medication, etc.

[LA] my apartment complex threw all of my stuff away without my knowledge

    Posted: 30 Dec 2017 01:36 PM PST

Hey everyone! I'm in a bit of a bind and trying to figure out if I should file a lawsuit.

I lived in a large apartment complex for 4 years. I recently bought a house, and my lease ended in November. However, they informed me I had to also give 60 days notice, which is January 3rd. I paid rent through this date, but moved out of my apartment and into my house. However, I left a few things behind that I just didn't have time to move because of the weather. This included some hanging clothes and my wedding dress. Today I went to my apartment to finish cleaning up and move the rest of my stuff and Everything was gone. The apartment complex painted and changed my floors, so it was obvious they had come in. They did not contact me through email or on the phone.

The only information they provided me today was that they did Indeed through everything away, including my wedding dress and baby photos, and that they'd be sending me a bill for the labor of cleaning my apartment.

What can I do? I live in Louisiana and have never dealt with anything like this.

Orthopaedic surgeon told me the shoulder replacement he installed ‘may be the wrong size or placed incorrectly or I may have other rotator cuff injuries’ I want it replaced and the burden of rehab to be on the surgeon. Can I expect this?

    Posted: 30 Dec 2017 10:55 AM PST

Baltimore, MD USA-August of '15 I had finally had enough of the sporadic pain and limited motion of my right shoulder (dominant) and upon x-ray it was revealed I had no remaining cartilage in the glenoid was gone. The surgeon recommended a hemiarthroplasty removing my upper humerus and retaining the glenoid cup. I endured six weeks of shoulder immobilisation and over five months of PT when at the last monthly review with the surgeon he told me about the issues. I was shocked as I had endured far more pain than before the surgery. I now have a new orthopaedic surgeon who informs me the only option to repair this is a reverse arthroplasty and more rehab and immobility. The surgery will also reduce the lifting ability of my arm and have to be repeated depending on the length of my life. Can I ask the original surgeon to compensate me for the work I will miss and loss of use? Thanks to responders.

(WA) Bank involuntarily closed my account because of a fraudulent check and negatively reported me to ChexSystems.

    Posted: 30 Dec 2017 05:01 AM PST

    Location: Seattle, WA

Back in July, I opened a new account with KeyBank. In August I deposited a cashier's check I had received from craigslist sale. Unfortunately, at the time of deposit, I was not aware that the check was fraudulent. I deposited the check inside the branch with a teller. The teller did not inform me there was anything suspicious with the check and continued with the transaction. He did have to step away to speak with his manager (and took the check with him) but he did not mention anything being wrong with the check. When the deposit was finished he informed me that $100 was made available and the rest would deposit the following day.

It wasn't until the following week that I noticed something was wrong. I tried to make a deposit at the ATM but it kept rejecting my deposit, so I went into the branch where I found out that a) a block was placed on my account b) the rest of the funds never deposited and c) the initial $100 deposit was reversed.

I spoke with a branch manager who spoke with the bank's fraud department and confirmed a hold was placed on my account due to suspicious activity. According to him, the cashier's check came back NFA. I explained I wasn't aware that cashier's checks could bounce (supposedly, according to him, cashier's check aren't guaranteed funds?) and discovered I was the victim of a craigslist check fraud scam.

He said there was a hold while the bank investigated. He said that I should receive a letter in the mail with a copy of the returned check but that he was going to personally look into it to get it cleared up that he would call me back with the results.

I never heard back from the branch manager but I did receive a letter informing me that KeyBank had decided to longer continue doing business with me, was closing my account due to fraudulent activity and that I would be receiving a check in the mail for the remaining balance of my account.

Since I wasn't sure if I would be keeping the account (I ended up going with Wells Fargo) I just let it go. It wasn't until October when I was being added to a business account with a credit union, that I discovered that KeyBank has submitted a negative report to ChexSystems, resulting in me getting denied.

Fast forward to mid-October where I'm joining a credit union so I can be added to a business account as an authorized agent, and I was denied due to a black mark on my ChexSystems Report. The Credit Union explains to me that a negative report had been submitted from KeyBank.

What are my options for fighting this? I had called and spoken with a branch specialist who informed me that this apparently standard procedure to report all returned/fraudulent checks and there was nothing they could do to remove it. However, I don't understand why I have to be penalized when I wasn't the one who wrote the check. Is there any recourse available for those who are a victim of check fraud?

    Grandparent rights

    Posted: 30 Dec 2017 08:10 AM PST

We live in Richland county, Ohio. My son's (9) biological father didn't get involved in my sons life until he was 5, he stayed involved for about a year before he began steadily dropping off. In 2015 he kept him overnight maybe 5 times, when he is supposed to go every other weekend, 2016 he spent all of 8-10 hours around him never once keeping him overnight. This year 2017 he hasn't seen him once, he's talked to him on the phone three times tops all of which my son called him so he has not made any contact, so he hasn't seen him in over a year, since Christmas of last year. He has since gotten divorced this year leaving his wife and baby behind, and moving, none of which he has ever communicated to us, I found out through other people. Now last week out of nowhere he asked to see him, I had a feeling it wasn't really him that wanted to see him but his father, I spoke with my attorney and asked at what point Can I say no here I mean this is ridiculous and has had serious negative impacts on my son. The attorney said I could say no and if they did take me to court over it the court wouldn't do anything based on the last few years. This was a few weeks ago when I spoke to the attorney he is now on vacation and I am unable to talk with him.

Now his father has begun texting me, at first I was kind replied saying sorry but we hadn't heard from my sons father in months and that we had plans and maybe some other time. I have since just ignored his messages but now he is threatening to take me to court for grandparent rights, mind you he has seen my son twice in the past two years each time around Christmas so he can take his little family photo to make it look like he cares. I am fairly confident that he has seen my son less than ten times total since they took me to court 4 years ago. I'm sorry but if you truly wanted to be apart of his life and see him it'd happen more than once a year, his excuse is that he's busy, give me a break, we're all busy.

So now I don't really know what to do. Honestly I'm not comfortable with any of them seeing my son at this point, they have no idea what they are doing to him, he's been in counseling for over a year, he's been sleeping on our bedroom floor for months every night, he's having issues in school and regulating his emotions, his counselor believes a lot of his issues are stemming from feeling abandoned even though he doesn't realize it. I just want them to leave us alone, and stop hurting my child. His bio father has done exactly what I said he would from the beginning and I feel like his record these past few years proves that. His grandfather is a horrible person, who has talked bad about me in front of my child the few times he's been around him, his other children and drug addicts and convicts, it actually says in our court papers that my son is not to be around smoking due to his asthma, his grandfather chain smokes and now that's where his father lives so over my dead body will my child be going there. I just don't know what to do I don't want to have to go to court but I think at this point I should have the right to refuse to let him go.

I am the custodial/residential parent we have the standard rule 24 visitation so he should take him every other weekend which he hasn't done in over three years as I mentioned. Any advice would be appreciated.

My best friend might be doing something illegal?

    Posted: 30 Dec 2017 08:38 AM PST

I'm posting this because I'm actually not sure and my independent research didn't really help me much. I'm genuinely concerned for them but I'm not sure if my concerns are baseless or not.

I've known this person for years and they always have some sort of "get rich quick" or "make money without working" schemes cooking. I always found them kind of amusing but generally harmless until recently.

Their latest idea is going on dating sites or chat sites and catfishing with pictures of someone they found online. They have the person they talk to send them money or gifts from an online gift registry. Sometimes they go even farther, engaging in cyber sex for pay and (and this is what most concerns me) sending nudes of other people (all adults obviously) that they found on the internet to pretend it's them sending those pictures. This all happens on a messaging app, not through text. My friend told me all of this with a great deal of pride, apparently they are making some good money off of this. My question is, is this illegal, or just immoral? And if it is illegal, how much trouble could they get into? I don't want to be a buzzkill unless they are actually at risk of being arrested and having their life ruined over this. They live in [redacted] but they catfish people many different states.

Thanks to anyone who provides help, and feel free to ask for clarification if needed!

[NC] Questions about temporary custody and involuntary commitment

    Posted: 30 Dec 2017 08:44 AM PST

Hello everyone. My SO and I are in our 20s and have a 2 year old. My MIL has a daughter (SO's half sister) that is almost 12. MIL is mentally unstable and has bipolar disorder (which she doesn't believe) and is a narcissist and manipulator.

She is currently being evicted from her apartment with her daughter (she has full custody). On the last day she had to clean out the apartment she had to go to the hospital and said she had a stroke and 2 aneurysms (which we don't know if we believe or not). We went to help clean out her place and get out what we could since she was in the hospital. I cannot describe to you how disgusting that apartment was. There was piss and shit on everything and just nasty trash everywhere. You could barely walk and wanted to gag on the smell. SO's sister was recently in the hospital for a respiratory infection and I'd imagine it's due to the living conditions she was in. And this isn't the first apartment that has turned to shit like this that they've lived in.

SO and I cant stand to see his sister continue living like this. MIL said they were going to live in a car and we offered to take in sister. She stayed with us Christmas night and told us she was mad at her mother and didn't want to live in a car and would be okay staying with us for a while.

Well last night MIL tried to guilt SO because she wasnt offered to come live with us. She said she talked to sister and she doesn't want to stay where MIL is not welcome. CPS won't remove the child as long as she has running water, electricity and food. The tricky part is that MIL has been in a custody battle the girls whole life with her father. MIL said that her father molested the girl when she was about 2. SO doesn't believe that and we know MIL is a pathological liar.

We talked to her father and he wants custody and is going to talk to his lawyers. However, sister is terrified of her father and said she would kill herself if she had to live with him. She barely knows her dad so this fear all comes from MIL. So do we stand any chance of getting temporary custody of sister until she sees her father isn't a bad guy? Or is there anything we can do to get this child out. We can't just sit by while no one does anything. We took pictures of the apartment and everything already and they're bad but they don't do the smell justice.

Also, while we are mad at MIL for this, she really needs mental help. Anytime a psychiatrist has told her she's bipolar she leaves and refuses to go back. She's paranoid, and can't hold down a job or do much of anything. We just want her to get the help she needs so hopefully she can care for her daughter properly one day.

So pretty much if anyone has any idea what we can do please let me know. We can take custody of sister for the time being or we can help the fathers lawyers. And while I know MIL needs help, I don't know if it's enough to get her involuntarily commited.

Tl;dr- SO's sister (11) is in disgusting living conditions and her mother is bipolar and refuses to get help. Sister is scared of her dad due to allegations from her mom. We want to get sister out of the living conditions and possibly have the mother involuntarily commited.

I Think My Son's Mom Forged My Signature, She's Now Saying I Owe Her Almost $100K, and Won't Stop Trying To Collect "Debt" (OH)

    Posted: 29 Dec 2017 04:30 PM PST

Basically the title. I live in Ohio, my sons mom lives in Missouri. January 2015, I signed an affidavit stating I'd send her money every month, and had it notarized. The amount is not specified. This was for child support, and she said she needed it to get child support order rolling. July 2015, the child support order is established, and I begin paying, no problems. A bit pricey, but I try to make ends meet anyways. December 2015, I meet my son for the first time since he was born, and nothing about financial assistance was talked about. Fast forward to September this year, I get a certified mail, with this packet of documents from the mother, saying I agreed to the parenting plan enclosed, and I hadn't been paying the money I had signed an agreement saying I'd give to her. She says this is separate from the court ordered child support.

Among the documents was a copy of the affidavit I signed, then a 7-8 page "Parenting Plan for January 2015-Janurary 2020". It details everything, from how long it can be until I tell him I'm his father, to how my parents can interact with him (oh yeah, he doesn't know, she threatens to keep me from him if I try to tell him, and she says she'll just deny it until he's ready since he has a step father). It's only signed by her for 1/10/2010. I know this is false because she wasn't pregnant at the time. We had just gotten off winter break in college during that date, and she didn't get pregnant until a few months later.

The other document is what can be nothing other than a forged signature. It states I'd pay $40K in one year, and a lump sum of $10K if not paid for in a year. Then it details when this was signed, the exact night I met my son at a pizza place. It's typed out, and looks like it's been copied a few times. My signature is on it, hers, and her husbands as a witness. All three signatures are faded differently, and the time it says we all signed this was at 7:38 PM. Yet, I have pictures of my son taken at 7:37 PM, so the time can't be right. Also, when I signed the affidavit, I made a mistake and signed the last letter in my name incorrectly due to having carpal tunnel. That same mistake is in the signature on this document, and the signatures line up perfectly.

I've sent all the documents to a lawyer I know, but he's on vacation, and I'm trying to stay calm, but I'm in medicine, not law, I don't know what I can do to protect myself. She's sending letters, texts, emails, texting my parents, even sending me messages on social media now about this. I've completely ignored her, she keeps asking me to sign stuff and send it back to her, and I didn't trust her before, but after this, I definitely don't trust giving her anything. I called the family support division, and they said it has nothing to do with them, so it's between us. Sorry if this is a long post, I'm just nervous as hell, and having to sit and wait for my lawyer is driving me crazy. I've been told there's no case there, but idk.

Edit: Thanks for the responses. Yes, we got a paternity test a few years ago. It would have happened the day he was born, but circumstances and ignorance got in the way. He's 100% my clone (kids baby pics match mine hehe). I'm still thinking hard about custody with him. I spent 9 months near him this past year, and got evicted since I couldn't pay rent due to how much child support was getting taken out of my check. So on the one hand, I want a relationship with him, but at the same time, I never wanted a kid with her, and this definitely makes me want to distance myself even more. I'll talk to my lawyer, see what he says. You guys are blunt, but very honest, and I needed that.

Turning 21 and my license is expired

    Posted: 30 Dec 2017 05:17 AM PST

I have plans to go to a brewery today with my parents as a birthday gift for turning 21. I was planning to renew my license before I turned 21 but my girlfriend said I would have a grace period. That sounded right to me and I don't bother checking until last night when I found out that wasn't true. I tried to go to the dmv this morning but they were closed for New year's. Lucky me. So my question is would I be able to still try beer on this tour/buy alcohol tonight?

Not sure if this is the right subreddit or not sorry guys

Grandpa Passed, Grandma going to be left out most likely.

    Posted: 30 Dec 2017 12:11 PM PST

Will Has not been read. I know its a big thing but the rest of my family isn't getting ahead of this so I figured getting some questions answered is a good idea.

So my grandpa never technically married my grandma. Not sure why but they have been living together for 25 years. However, its Florida. I don't believe common law marriage is in effect. Now this is where its get tricky. My grandma has a place to live but had lived at this house for 25 years. They(Daughter and son) are gunna sell it for quite a bit think 2-3 mil+. Thank god no fire sale but she hasn't had any say in any kind of thing. I believe power of Attorney went to his kids (son and daughter) since they made all the decisions regarding his in home nurses and such.

My dad moved back from Africa to take care of my grandpa for the last year because my grandpa couldn't. Now its a year out of work with bills piling up and trying to get a job but this area is terrible for the tech/network admin jobs hes has in the past. Think CTO or the most senior network admin guy in your company.

The will be read on Tuesday the 2nd. Not sure whats going to happen because he never talked to anyone about it. The daughter and son are already going against his spoken wishes.

Once the will is read and they end up shutting my grandma out. Which is very likely to happen she will be left with next to nothing. The apartment she has to live at is paid by him for the last 20 years so I'm not sure whats going to happen there. My grandma has some money that has been doing well in the market but shes still in a risk on mode, her finances are another entire conversation. Not to mention my dad is now stuck because hes been out of work for so long and in a place with no jobs that are the correct caliber.

Im mainly looking for help in regards to Common law which doesn't exist in florida and how I can make sure my grandma at least gets enough to live for the rest of her life.

I'm just not sure what to do. I wanna tell my grandma to get a lawyer but shes a very submissive woman and will take whats given to her vs fighting for whats hers. Im not trying to start a legal fight over someones money thats dead but for the well being of my grandma I have to do whats necessary.

Underage Brother underpaid 400$ by boss (CA)

    Posted: 30 Dec 2017 05:12 AM PST

So my little brother and two of his underage friends had done work for a contractor on a house which consisted mainly of roofing. This work went on for the span of 7 days, about 6-7 hours or so a day (I need to ask him exactly) and before the job started they all were told and agreed on 700$ each for the job.

Now after the 7 days pass and the work is done his boss gives them each 300$ and claims this was what was promised when all three of them were told otherwise prior to the work.

Understandably they were pretty mad, and plan to go talk to him this Tuesday. As his big brother I wanted to go with him and help him straighten things out, but I'm not sure what we can do in this situation as: 1. there wasn't a written contract before the work began. 2. All of them are underage 3. The pay was under the table

He also tells me his boss was also currently contracting unlicensed as his expired or something like that.

So r/legaladvice, what can I do to help my bro?
