Semi truck reversed into me, gave me his written word, is now changing the story Posted: 27 Nov 2017 08:17 PM PST On November 2nd, at around 1 PM, me and a semi-truck were stopped at a stop light in Hayward, CA. He needed to turn right and I guess he decided that he didn't have enough space, so he reversed and reversed into my car. I tried reversing out of the way myself, but wasn't able to get out of the way in time. After reversing into me, he didn't immediately stop, but instead kept driving. Eventually he stopped and I took his insurance info as well as a written statement from him saying that he acknowledged that he reversed his truck into my car. He signed the paper and I have a copy of it and can attach a copy of it to this post if there is enough interest. I'm an Alberta driver, he's a BC driver. I submitted the letter to my insurance company. My insurance company says that he is now changing his story and claiming that I coerced him into signing this document because he doesn't speak English well. Further, he states that I tried to extort him and that I rear-ended him. My insurance company claims that because of his statements, they cannot process my claim any further. I'm worried I'll have a false rear-end on my driving record. This could impact my employment at future companies as well as my insurance rates. The truck driver and I speak both English and our native language (We are from the same region of South Asia). Reddit, please tell me what I can do to avoid any false charges on my record. TL;DR: Truck driver reversed into me, gave me his written word this was true. Changed the story once insurance was involved. Claims the written document doesn't count as he doesn't speak English well. Now claiming I rear-ended him. Please help! [link] [comments] |
Got hit by a semi tonight. He was at fault, but I can't contact his insurance to start a claim. (GA) Posted: 27 Nov 2017 06:31 PM PST A semi merged into my lane on the interstate this evening and swiped my car. I'm ok, but my car needs to be repaired and I have to replace two carseats and get a rental car so I can get to work while it's being repaired. I called my insurance company to file a claim and gave them all the info. I have the guys name, his company, addresses, insurance company, policy number, everything. I give them the info and ask how to start the process of getting things done, asking for reimbursement from his company, etc. I was told it was my responsibility to file a claim with his insurance, even though he was at fault. The driver exhange report the police gave me doesn't have the phone number for the insurance company. I google it but can't find anything but the insurance certificate for the trucking company. I google some more and get a number from the insurance company and call to make a claim. They tell me that they only do property insurance, not auto insurance, and they don't insure the trucking company. What do I do now? I have to take tomorrow off work to get my car into a shop and I don't know how to do this without the claims adjuster. When I called my insurance a 3rd party picked up and couldn't answer any of my questions about what to do next. I plan to call my personal agent tomorrow, but I'm trying to keep from having to take too much time off work to deal with this. I cannot find anything about the company info the police gave me. My wife was injured and tried to claim disability insurance, but was denied Posted: 27 Nov 2017 02:35 PM PST My wife and I live in Manitoba, Canada. She has two jobs, one full-time, one casual. The full-time one has group benefits, the casual one doesn't. She dislocated her shoulder while working at her casual job in Jan 2017. She's dislocated her shoulder a number of times over the years, starting in high school. Workers Compensation covered her for the initial injury and sent her for physio and an MRI. The MRI results came in in May, and indicated a labral tear and a Hill-Sachs deformity, with surgery required to return her to her previous health (she got a surgery date of Feb 2018 last week). Workers Compensation determined that the likely cause of the injury not healing satisfactorily was due to the previous injuries, and ended her coverage. At that time, she applied for her disability insurance. In July, they denied her claim. There were a number of points they listed as the reasons for why the claim was denied, including a form letter suggesting various treatments be considered (which they were, and dismissed). In early Oct she appealed the claim, and the indication is that it will be denied again. But some odd things have occurred. First, her main employer talked to her about light duties just last week, in spite of the doctor's note saying that she should perform no work until after the surgery and recovery. And now, just today, her main employer called and suggested that she resign since it's clear the insurance is going to deny her disability claim and they are no longer obligated to hold her position for her. It's worth noting that her casual employer has said nothing, and hasn't raised any issues with her not working while still being employed by them. The appeal notice also said that if the appeal was denied, we would have no other recourse. I feel like her employer, the insurance agency, or both are trying to engineer some difficulties with her claim, however, neither of us know enough about disability insurance to know where to start. I thought the appeal was straight-forward enough, but that may not be the case. Are there resources in my area (or on here) that would be able to help with this, or at least tell me where to start? My wife will be calling the Labour Board to see if there is anything questionable on the part of her employer's actions, but if there is anything else we can do to satisfy the requirements for the disability insurance, we'd like to get started on that ASAP rather than waiting for results on one side. We certainly don't have the financial resources to continue on just my income for the next 8 or 9 months. Thanks for any help you might be able to provide. tldr; wife injured herself, tried to claim disability, but got denied. Is there anything we can do to turn this around? [link] [comments] |
Rear ended a driver who didn't have insurance Posted: 27 Nov 2017 05:59 PM PST So I'm on the way home tonight, and rear ended a driver who did not have insurance. It was unavoidable, as several cars in front stopped abruptly and I slammed on the brakes. I am most likely at fault regardless. I would happily let my insurance handle this, however I am concerned that my insurance rate will go up or I will be dropped. I guess I have a couple questions overall… Is it to my benefit to not report this to my insurance company, and pay the damage to her car out of pocket? Does her not having insurance matter? I need my car repaired pretty badly, and that is essentially why I would put a claim in with my insurance. My big concern is that I have two speeding tickets and an at fault fender bender within the past three years. Are these big enough concerns that I will be dropped? [link] [comments] |

Involved in hit and run - do I file under my collision policy or my uninsured motorist policy? Posted: 27 Nov 2017 01:16 PM PST My vehicle was hit and driver of the other vehicle did not leave a note or any contact information. I have called Geico, and they have let me know that I can file the claim with my collision insurance or my uninsured motorist insurance. The deductible is slightly higher for uninsured motorist than it is for collision. I am not necessarily worried as much about the deductible as I am about my insurance premium going up. Is there any reason why they are giving me these two options? The damage is significant enough that I have to go through insurance. Any advice or tips appreciated. [link] [comments] |
Signing up for insurance on healthcare.gov when I'll be moving states between Dec 15 and Jan 1? Posted: 27 Nov 2017 09:37 PM PST Currently live in Texas and working a job that I will be leaving December 21 and will then be moving to a new state and starting a new job on January 8. Need to sign up for health insurance through heathcare.gov for 2018. The open enrollment period closes December 15 for that as far as I understand. Can I put in my soon to be address in the new state and my estimated income from the new job even though I'm not technically living there yet? I will be moving and have taken up residence in the new state before January 1. Any issue with doing this? I know that moving states qualifies you for a special enrollment period, but my understanding is that you need to have had insurance for at least one day within the 60 days prior to your move. I don't currently have insurance, so it seems that wouldn't apply to me. Also, my move date will technically fall within 2017. [link] [comments] |
Posted: 27 Nov 2017 08:59 PM PST I purchased my Auto policy when I purchased my car, 10/30/16. I called the phone number associated with their "Awesome Veteran Discounts" (If you're unfamiliar with this, they have a call center actually staffed by veterans, although after this situation, I don't think they value Integrity at the same level as one would hope.) I am usually the customer who accepts what is given and never escalate further than first level. After my monthly payment due skyrocketed from 118.00/monthly to 340.00, it raised some concerns naturally. During review I noticed I had been never credited with the Veteran discount, even when I had an alternate motorcycle policy with them that I continued to pay for months after privately selling the Liter Bike due to the discount for multi lines being greater than the cost of the Motorcycle policy. REALLY LONG STORY CUT SHORT - They said my account wasn't in proper standing with the company to receive the Veteran/Military discount. This is the supervisor explaining the situation after the lvl 1 agent, said it was NC Laws that were preventing me receiving the discount. I expressed that I couldn't afford 340.00 a month directly withdrawn from my account a month, they blamed the drastic increase to 2 standard >10 over speeding violations. Assured me that I would find no other company with competitive rates and that was their best. I am have the supervisor managers # for when I end my 3rd shift and try to find some solace? I paid my bill 7 days ago, and if my policy ended today, they would short-rate/pro-rate me with $58.00 return. Advice, tactics for my phone call after shift? (Already have progressive quoting me for 99.00 first month and 110 subsequently). GEICO tried to take advantage of a situation they assumed I locked into and have paid for the last 2 months. Finances are tight as I am single father of twin boys all income is important for my first Christmas with them at age of 3. Thanks for taking time out of your day to read [link] [comments] |
friend burned deck down with cigarette Posted: 27 Nov 2017 08:35 PM PST Unfortunately i got a call saying my house was on fire, and learnt that fortunately just the back deck burned down. Old house, so bringing it to code and what not brings the total up to 14k. The tenant's friend was smoking a cigarette, and it was concluded by the fire department that was the source of the fire. Here's the rub, tenant doesn't have renters insurance, let alone one with a fire clause. Tenant's friend does. Is it possible for my tenant and his friend to claim for my property damage for the deck? To be clear, the tenant and his friend are paying up regardless and haven't given any intention on not. I've had him for years and just trying to do the best i can to help him out with this (aside from paying it myself!) [link] [comments] |
Medicaid and structured settlements Posted: 27 Nov 2017 04:03 PM PST I have a structured settlement, that was invested as an annuity, because I was born with a brachial plexus injury. I'm almost 19 years old and Medicaid is about to expire for me. Medicaid asked if I'm going to receive money from a lawsuit, can they put a lean on my structured settlement, as the settlement was made in an effort to compensate for my injury? They've asked in the past but my parents have always said no, because I hadn't received any money from the structured settlement yet. I'm worried they will try and take my money from the settlement, just because my parents couldn't afford insurance. [link] [comments] |
Driver not cooperating NYC rear ended Posted: 27 Nov 2017 03:42 PM PST Hello, I was rear ended in NYC around a month ago in a company car by an Uber car service black car. No fault of mine at all (stopped at red light). My company asset management called and are asking for more information on the driver and said that person they were able to get in touch with says he was never in the accident or even drives in NYC. I only have the full name, License plate and a phone number. I know I should have gotten I.D. but I did not. I called him to ask for some more information like an address or ID and he got real spooked saying he can not talk to me except through insurance. I managed to calm him down and he agreed to at least send me his email address after I told him I will not go through insurance. I just wanted to keep him calm so that I can try to get as much information from him as I can and made no accusation or said anything about a claim. What should I do from here, try to get his info from the taxi and limo commission or should I tell the asset management all I have is his Lic plate, name and number? I also considered filling a 311 complaint with the Taxi and limo commission to try to find out more information on him and a complaint for reckless driving. TLDR; rear ended in NYC and driver is playing games, do I get involved or let insurance handle it even if I didn't get all the info I needed at time of accident. [link] [comments] |
HSA, TRS Dental, and FEDVIP (Vision) Posted: 27 Nov 2017 03:41 PM PST I am in a unique situation having access to FEHB and Tricare health benefits. I would like to start a HDHP insurance policy so I can contribute to an HSA while I'm young and don't have any really medical costs other than eyeglasses. I want to make sure I understand the policy behind an HSA. If I have a HDHP for medical, Tricare Dental, and FEDVIP (vision), will I be able to contribute the max amount to an HSA? My understanding is that I can because the only other health insurance I will be covered by is my dental and vision. Any thought? [link] [comments] |
Dealt a bad hand and now my [21F] car insurance is being cancelled in GA; Help! Posted: 27 Nov 2017 06:33 PM PST This is the background to the situation https://www.reddit.com/r/legaladvice/comments/78xa3x/hit_with_a_trifecta_what_are_my_options/ I bought my first car on 10/20. I started my policy on 10/20. My license was suspended on 10/25. I got a limited license on 10/26. I am required to notify my insurance of a suspend/revoked/reinstated license within 60 days and I did and they decided to cancel my insurance despite me having a limited license. When I look in my insurance docs revolving around termination there are only two applicable (to this situation) clauses.. see below. "We may cancel by mailing to the named insured shown in the Declarations at the address shown in this policy: a. At least 10 days notice: (1) If cancellation is for nonpayment of premium; or (2) If notice is mailed during the first 59 days this policy is in effect and this is not a renewal or continuation policy; or b. At least 30 days notice in all other cases.
I have probation in Atlanta once a month, and now though I'm legally allowed to drive again I'm not allowed to drive my own car? This situation has the means to end me in jail at every turn and literally cause me to fail out of medical school. I don't want to be bratty but this really is not my fault I was quite literally only out to make sure my younger brother didn't go hungry. I have a lawyer actively working to get my case overturned/sentence reduced, but what can I do? A hardship license is a license as limited as it may be so how am I supposed to use it if my insurance company/ insurance companies in general refuse to insure me? Does vehicle insurance cover my fifth wheel accident? Posted: 27 Nov 2017 07:39 AM PST 2 weeks ago we took the fifth wheel out to go see the in laws, it was a terrible trip. The gps had me go through a section or roads that were extremely uneven and I ended up crushing my tail gait and ripping the bed trim off the bed of the truck with the fifth wheel. Also when I was leaving the house I ended up scraping a light pole with the back 2 inches of the rv and it ripped the trim and back fiberglass sheath off the rv. To top it off a whole gallon of milk fell out the fridge and soaked in the carpet! Yea it was a bad trip. My question is can I file 1 claim for the truck and the camper with my auto insurance or is the rv insurance going to cover the rv.? I was under the impression the rv insurance was for when it was sitting and covered things like trees falling and such. Any help would be greatly appreciated. The damages aren't really that bad but the truck is a 2016 and the fifth wheel is brand new 2018 so I do want them fixed. [link] [comments] |
Posted: 27 Nov 2017 03:41 PM PST I read this thread awhile ago: My car was hit while parked, I am talking to the responsible parties insurance. I mentioned diminishing value and they said I would have to hire a certified appraiser which they said typically costs $500. Also told me it might not be worth doing if I plan to keep the car. Seems odd that I would need to pay $500 out of pocket in the hopes of getting compensation. Any knowledgeable people want to weigh in? Damage isnt a simple bumper or fender, they are going to weld in a new quarter panel. [link] [comments] |
Got rear ended. Am I at fault? Posted: 27 Nov 2017 03:17 PM PST My radar detached from my windshield and fell between the pedals. I braked to get it (probably from 40ish to 20ish) and got plowed from behind. She apologized and we exchanged info. Didn't see a reason to call the cops. After I gave my statement to my insurance (me and her use the same company) they said she claimed I pulled out in front of her. The thing is I was driving in a straight line for at least a minute before the impact happened. The damage is significant and it's obvious she hit straight on from my pictures of her and my car parked. Because it's basically her story against mine, and we share the same company, is there a good chance I get some blame for this? Anything I should be prepared for or do if it happens? edit: If it matters, her car is pretty old and had other dents on it. Probably not her first rodeo. Mine is (was) brand new over 30k mi without any incidents. [link] [comments] |
Lot of questions! Financed ar is a total loss due to hail damage Posted: 27 Nov 2017 02:49 PM PST Hello r/insurance! My car was severely damaged during a storm in May. I didn't have gap insurance and the buyout quote the insurance company (Travelers) gave me was $3k less that what I owed on the car, and the price if I kept the car was about half of my total loan. At the time I spoke with my finance company (capital one) and someone told me the remaining balance would be due immediately upon making a claim. I panicked and canceled the claim because I couldn't swing $3k at the time. I reopened the claim in August and have had an impossible time getting a hold of a claim agent. I keep getting bounced to different people who won't return my emails or texts. So now my car is due for a lot of routine maintenance at once, like new tires, pads and rotors, rear differential, etc. My main question is, will the time that has elapsed since my claim, plus the current state if the car affects the payout? Will they revalue the car now that six months have passed and take into account that the tires are very worn? If they go with the original quote, I'll only have about $1000 left on my loan, which I can pay off now. Also, who tf can I get someone to call me back?? Every time I call the main line, they tell me that they're putting me in touch with a new agent who invariably never calls me back or returns my emails. [link] [comments] |
[GA] 29 year male making $40k annually and ACA website cheapest plan is $288, does this seem normal? Posted: 27 Nov 2017 10:53 AM PST 29 year old male in georgia making around $40k annually and the cheapest plan on ACA (healthcare.gov) for me is $288 a month (the website says estimates a $50 a month subsidy estimate not included in the $288). That plan is classified as a catastrophic plan. Does this seem normal? I don't smoke. [link] [comments] |
Friend hit my car; what is the cheapest way for me to get it fixed (by a body shop)? Posted: 27 Nov 2017 02:34 PM PST My friend hit my car when backing out of the drive. The first estimate I got is for $1400. Would it be cheaper to just pay it ourselves, or should we go through insurance? I have accident forgiveness on mine with a $500 deductible, but I feel like my insurance company would subrogate through his anyway. Should we just file under his insurance? Would it make both of our rates go up? [link] [comments] |
Posted: 27 Nov 2017 04:41 AM PST Hi r/insurance! I previously posted in r/legaladvice but was recommended to post here. Throwaway for obvious reasons. A few years ago the topic of health insurance came up at workplace. My coworker said that before he got married, he was able to provide his fiancé with health insurance through work via domestic partnership. It's important to note here that my coworker is gay and I am straight; this matters later on. He and I talked about the process and it sounded like a great option for my fiancé and I (male and female). My coworker forwarded me a copy of the workplace affidavit he had to sign stating they met all requirements. Well, my fiancé and I met all requirements of that workplace affidavit, too. So we filled out the affidavit and sent to our HR and my fiancé got health benefits. Since my fiancé is not my dependent, this meant the cost of the benefits counted towards my gross compensation, and thus, were taxable. Yes, I paid all applicable taxes on the added insurance. I started a new job at a different company and when it came time to sign up for benefits, I was going to add my fiancé just like I did at the previous company. When I got a copy of the required affidavit, this is where I realized I may have previously fucked up. In reading the affidavit, we didn't meet the requirement of 1) being a same-sex couple, or 2) being an opposite-sex couple both being over the age of 65. We are an opposite-sex couple well below the age of 65. Perplexed, I looked further into this and NJ has specific rules for domestic partnership. Basically: same-sex couples, regardless of age, can be domestic partners. Opposite-sex couples, however, can't be domestic partners unless they are both older than 65. This age requirement isn't a new thing, it existed before I registered my fiancé at my last workplace. This was not mentioned on the old job affidavit; like I said, we met all requirements on that affidavit. At this same time, we received the standard COBRA paper from my old company and on that paperwork it had my fiancé listed as female. We thought it was a mistake at first but after this whole ordeal, it makes sense now (since we're not over the age of 65, the old company registered us as same-sex). Sooo... Did I unknowingly fuck up and commit health insurance fraud? Is there a state-to-state difference as to why this wasn't mentioned on the first affidavit but it is on the second? My first company was based in IN but my work location was in NJ. My new company is based in NJ and I work in NJ. If fraudulent, how would anyone uncover this? Now knowing what I know, I'm not going to bring this to anyone's attention and let sleeping dogs lie. I never had an issue with my old company and as I'm no longer with them, I don't foresee them ever finding out the error. Would the IRS be involved at all since I did pay taxes on the additional insurance? I assume the IRS would only make sure I paid the appropriate taxes. They wouldn't be responsible for looking any further, correct? I also assume the responsibility to look any further would lie with the old company (and like I said earlier, I don't foresee them pursuing it since I no longer work there and am no longer receiving any benefits). TL;DR: Might have fraudulently claimed my fiancé as a domestic partner for health insurance. [link] [comments] |
Posted: 27 Nov 2017 06:26 AM PST The only health issues I've really had have been a herniated disk which sometimes has flare ups and a few broken bones. I normally only go to Urgent Care or Chiropractors. A coworker mentioned that prescription drug costs can really screw you. I have no idea what I'm doing. No deductible seems like a good thing, but I can see how'd it'd screw me if I really got hurt or diagnosed with something horrible cause then I'd be stuck with my out of pocket max. Is my understanding of that correct? Right now, I'm looking at Blue Cross/Blue Shield Basic: $73/biweekly No Deductible $5500 Out of Pocket Max $35 Urgent Car In Network $30 Chiropractor In Network Retail Gen. $10-30 Retail Brand $50-210 Specialty $55-240 [link] [comments] |
Posted: 27 Nov 2017 01:01 PM PST I'm having one hell of a time finding a rental that allows pit bulls (in Arkansas). I've been told that, for some places at least, this is because their insurance does not cover pit bulls but we would be considered if we had our own coverage. How hard is it to get liability insurance on a 15-year-old pit mix? Anyone know of places that offer this kind of insurance or how expensive it may be? Thanks all! [link] [comments] |
Help finding providers out of state? Posted: 27 Nov 2017 09:10 AM PST I am on my step-fathers health insurance from his company which is through BCBS of Illinois although we live in Maryland. This is the first time my mother and I have had insurance in a little over five years, so we're eager to start looking for physicians, dentists, etc. The only problem I'm having is looking for providers in our state. Whenever I go to search through the official BCBS of Illinois website, it limits my search to just that state, and fails to show me any results in Maryland. I guess the main thing I'm looking for are resources that let me search with my policy's specific coverage in my state. Thanks again for any help! [link] [comments] |
Posted: 27 Nov 2017 06:07 AM PST Hello! Just passed all my exams for insurance licensing and now...I'm not sure what to do. When I go to "apply" for a license, it is asking for a NPN Number. I was reading I could not obtain NPN until application has been processed. This is a bit confusing. My state is Wisconsin and I was hoping for some advice. Tried using the NPN look up website to no avail since I technically do not exist yet as I have not applied. Tried searching FEIN as well, no results. [link] [comments] |
Customer Service stated we had coverage, claim was denied Posted: 27 Nov 2017 05:56 AM PST My wife had a fairly expensive procedure done last month. We knew that the procedure was expensive and may not have been covered based on some literature we had for our plan. Prior to going through with it I contacted Cigna three times just to see if they would cover anything. I contacted them two times via their Live Chat and once via phone. I provided them the information from the order, which included the CPT codes and the ICD10 codes. Each time we were told they would cover 80% of the contracted rate. The EOB posted online this weekend and sure enough it came back that it is "Not a covered expense as defined by your plan". We would not have done the procedure otherwise which makes it frustrating. I kept the chat logs of the two online conversations I had, I am assuming they have some sort of record for my phone call. I know our next step would be to appeal the claim, but I'm a little torn. If you read the plan, it does seem like the category this feel under was not covered, however, I feel that their statements to me stating otherwise should lean in our favor? Anyone have an similar experiences/insight? EDIT: I did called earlier and they sent the claim to a same day appeal and I just received a call that it was reversed! Changed our obligation from nearly $3k to $200. [link] [comments] |
