“Failure to give a two week notice will result in your final paycheck being paid out at minimum wage.” This is illegal right?

    Posted: 02 Feb 2022 08:24 PM PST

My girlfriend works for a preschool. We live in Texas. She was looking through her work documents as she is considering resigning from her job immediately because things have gotten really bad there. There is a paragraph that states "Resignation - a written two week notice is required. Vacation days cannot be used during your notice period. Failure to give a two week notice will result in your final paycheck being paid out at minimum wage." Last time I checked that is highly illegal to pay a different amount than what was agreed upon when the work is already completed. Can someone reaffirm this.

Her name is signed on this document but it seems to be such a weak agreement. The agreement states "I understand that this orientation is just an overview of all rules and regulations in the employee handbook. I understand it is my responsibility to follow all the instructions in this orientation as well as in the employee handbook. I will adhere to all of the rules and regulations of _________. Not doing so will result in disciplinary action up to and including termination."

Can someone please confirm whether this is legal or not? If so, what steps can be taken to ensure fair pay if she does resign immediately.

    Landlord photoshopped utility bills

    Posted: 02 Feb 2022 05:52 PM PST

Background- North Carolina. My little sister signed a lease in 2020 to split a 2:2 home with another roommate. In 2021 they extended the lease over text message until Dec 2021. In the original lease it states tenant is responsible for all utility bills (these happened to stay in the landlords name). They would Venmo each month for all bills and rent.

The last 6 months of utility bills have been backlogged by the landlord after repeated text messages asking. They have both moved out since Dec 2021. My sister reached out for their security deposits (1,800 each). Landlord replied there was damage (non document nor true). So my sister explained in screenshots that NC law says it needs to be document and returned in a timely manner.

Landlord then says if they pay all outstanding utilities they will get their security deposit back. Landlord then sends utilities that have been photoshopped. If you look closely the "amount due and price" has been altered on the bills compared to a real one. Different font/style. The lines are also whited out and don't line up. The roommate wants to pay the bills and move on. Which the roommate did just pay the bill and they sent their own security deposit back.

Should my sister pay her side of the bills in hopes they pay her security deposit back immediately too? Should she Ignore the bills have been altered?

Father died less than 2 months after secretly signing an outrageous loan online in California. How much trouble is my mother in?

    Posted: 03 Feb 2022 04:20 AM PST

I've taken over his finances and was initially relieved to find only very minor credit card debt until I discovered a bombshell $10350 unsecured loan with a $51799 finance charge.

Because of the shock I can't tell if it's the kind of loan that I can pay off sooner. I have access to 11K and could pay it off in a heartbeat but I'm horrified at the moment reading a section titled LOAN FEE which states: "The loan fee included in the prepaid finance charge/loan fee disclosed above is fully earned upon loan origination and is not subject to rebate upon prepayment or acceleration of this Note and is not considered interest."

I had no trouble getting into his other accounts, but this lender (LoanMe) seems particularly scammy and I've run into roadblock after roadblock getting into this one despite being adequately computer savvy. I'll be making calls soon but I'm stunned and don't know what to say to them.

He died under mysterious circumstances and his death is still being investigated. It could be weeks until we have a death certificate. He lived paycheck to paycheck for years. Died with virtually no assets, wasn't a homeowner, and had a negative bank account for which I believe he was the sole account holder.

My mother, his spouse of 28 years, didn't work more than a side job here and there until now. She really doesn't have assets either and just became a legal resident with a couple of promising job prospects, none of her own money, and no credit of her own.

I'm too stunned to immediately be rational about this but I really don't want to reveal this to my mother without a plan of action. The grief is already more than enough to keep us up at night. Are we trapped or are we trapped? Is my mother liable for every last dime?

Doctor did not perform procedure as described. Still suffering from condition. What are my legal options?

    Posted: 03 Feb 2022 03:12 AM PST

In December i had a surgical Procedure. the Surgeon Explained the procedure to me twice before it happened. However the surgeon did not perform the procedure entirely as discussed and i am still suffering from a part of the condition of which they were supposed to correct. During Follow up with the surgeon that portion of the condition, that was untreated, was blown off as a minor issue and i was not encouraged to seek further medical advice. Condition has since gotten worse and impacts the quality of my life. Am seeing another specialist and undergoing scans and tests to confirm the state of my condition as previously it was only noted based on visual examination.. Current specialist has requested my Medical files from previous surgeon multiple times now and has not received them yet. I myself have called to request my files be transferred to new specialist. They have not been. I live in Maryland. What can i do to make them give the medical files? do i have a medical mal practice suit against the original surgeon if it is confirmed the condition which i am experiencing is what the original surgeon was supposed to treat as described to me prior to the procedure?

Can a Welcome Letter count as an implied contract in the state of Georgia

    Posted: 02 Feb 2022 07:37 PM PST

My girlfriend and I are getting an apartment together, The place we agreed on gave us a welcome letter so my girlfriend quit her job in North Carolina and got hired at a local hotel.

We were told we could move in, in writing in the form of a welcome letter, on February 5th, with 780 as monthly rent, for a 6 month lease, and 250 for security deposit. Yesterday (February 1st. 4 days before move in) they called and stated that, due to company acquisition, rent would now be 875 a month, the lease would be for 12 months, 300 for the security deposit, and that the move in date has been postponed until February 7th.

My question is: Would this apply as an implied contract even though we had not signed paperwork. (We did sign for the application and paid all application/administration fees up front.) I believe this renting company is intentionally acting in bad faith.

I found a blackmailing email and I don’t know if I should believe it.

    Posted: 02 Feb 2022 06:39 PM PST

Today I opened the spam section of my school email and I found an email with a lengthy message. I'll copy and paste the whole thing:

    Hi. How are you?

I know, it's unpleasant to start the conversation with bad news, but I have no choice. Few months ago, I have gained access to your devices that used by you for internet browsing. Afterwards, I could track down all your internet activities.

Here is the history of how it could become possible: At first, I purchased from hackers the access to multiple email accounts (nowadays, it is a really simple thing to do online). As result, I could easily log in to your email account (insert my school email here cus I removed it for privacy reasons).

When I got access to your email - your password was: (removed for privacy)

One week later, I installed Trojan virus in Operating Systems of all devices of yours, which you use to open email. Frankly speaking, it was rather straightforward (since you were opening the links from your inbox emails). Everything ingenious is quite simple. (o_0)!

My software enables me with access to all controllers inside devices of yours, like microphone, keyboard and video camera. I could easily download to my servers all your private info, including the history of web browsing and photos. I can effortlessly gain access to all your messengers, social networks accounts, emails, contact list as well as chat history. Virus of mine constantly keeps refreshing its signatures (because it is driver-based), and as result remains unnoticed by your antivirus.

Hence, you can already guess why I stayed undetected all this while.

As I was gathering information about you, I couldn't help but notice that you are also a true fan of adult-content websites. You actually love visiting porn sites and browsing through kinky videos, while pleasuring yourself. I could make a few dirty records with you in the main focus and montaged several videos showing the way you reach orgasm while masturbating with joy.

If you are still uncertain regarding the seriousness of my intentions, it only requires several mouse clicks for me to forward your videos to all your relatives, as well as friends and colleagues. I can also make those vids become accessible by public. I honestly think that you do not really want that to happen, considering the peculiarity of videos you like to watch, (you obviously know what I mean) all that kinky content can become a reason of serious troubles for you.

However, we can still resolve this situation in the following manner: Everything you are required to do is a single transfer of $1780 USD to my account (or amount equivalent to bitcoin depending on exchange rate at the moment of transfer), and once the transaction is complete, I will straight away remove all the dirty content exposing you. After that, you can even forget that you have come across me. Moreover, I swear that all the harmful software will be removed from all devices of yours as well. Make no doubt that I will fulfill my part.

This is really a great deal that comes at a reasonable price, given that I have used quite a lot of energy to check your profile as well as traffic over an extended period of time. If you have no idea about bitcoin purchase process - it can be straightforwardly done by getting all the necessary information online.

Here is my bitcoin wallet provided below: 1LF99WG4P3Tp3pgyXMnYPHjeSCCAqLBhna

You should complete the abovementioned transfer within 48 hours (2 days) after opening this email.

The following list contains actions you should avoid attempting:

Do not try replying my email (email in your inbox was generated by me alongside with return email address).

Do not try calling police as well as other security forces. In addition, abstain from sharing this story with your friends.

After I find out (be sure, I can easily do that, given that I keep complete control of all your devices) - your kinky video will end up being available to public right away.

Do not try searching for me - there is absolutely no reason to do that. Moreover, all transactions in cryptocurrency are always anonymous.

Do not try reinstalling the OS on your devices or throwing them away. It is pointless as well, since all your videos have already been uploaded to remote servers.

The following list contains things you should not be worried about:

That your money won't reach my account.

    • Rest assured, the transactions can be tracked, hence once the transaction is complete, I will know about it, because I continuously observe all your activities (my trojan virus allows me to control remotely your devices, same as TeamViewer). #That I still will share your kinky videos to public after you complete money transfer.
    • Trust me, it's pointless for me to continue troubling your life. If I really wanted, I would make it happen already!

Let's make this deal in a fair manner!

Owh, one more thing...in future it is best that you don't involve yourself in similar situations any longer! One last advice from me - recurrently change all your passwords from all accounts.

I'm too scared to say the email address of the sender but it's from @noemail.com. That's all of it. I don't know what I should do? The email mentioned my password, however that's not my password for my school email but I use it for other accounts like game accounts and such. Is this real? This seems believable. To be honest, I do visit R18 sites (but I always use incognito if that does anything), so this email caught my attention. Google flagged this email saying "Similar messages were used to steal people's personal information." Is this real? Has anyone else got the same email? What should I do?

Daughter was in car accident and other vehicle passenger might pass away.

    Posted: 03 Feb 2022 06:02 AM PST

In December of 2021 my daughter (17f) was in an accident. She was turning left the other person was going straight, coming from opposite direction. We received a call from a person on the scene to inform us of the accident, the lady told us our daughter was not at fault. The caller said she did not witness the accident but heard two witnesses tell the police that our daughter had a green arrow to turn left. The police did not put that in the police report and cited our daughter.

The police report said both witnesses said the other driver was speeding. Our insurance in saying we are 70% at fault with the other driver at 30%. The new insurance person in charge called yesterday to tells us the passenger from the vehicle will pass from her injuries. The passenger is an older lady who suffered a broken leg.

Should I retain a lawyer or use the insurance company as my representative? Not sure what else I need to know or ask.

    Thank you in advance.

Requirement to be at work 15 minute before shift. (Texas)

    Posted: 03 Feb 2022 12:53 AM PST

It was recently brought to my attention that if I don't start showing up at work 15 min prior to being allowed to clock in I will be "formally reprimanded". That's 90 extra minutes of work per week i won't get paid for. the expectation is that I arrive early to receive "passdown information" from the person I relieve. Nobody else seems to have a problem with working the extra unpaid time but trading my time and labor for free doesn't sit right with me. Yes I'm aware that in TX they can just fire me for anything else but if they "Formally reprimand" me for not being at work when I'm not paid to be there is there anything I can do?

Hack at hourly reporting site is causing issues with peoples fmla leave due to reported hours not being the min required.

    Posted: 03 Feb 2022 05:06 AM PST

This happened last year for the company I work for. They use a 3rd party site to record hours worked. They were hacked from what we were told and as a result the hours for the month of December are not reporting correctly and its impacting the min hours worked for fmla leave. Some of the employees recently had their babies and with the issues of reported hours are now missing out on half of the overall time they can take off for their full maternity leave/bonding time. I my self just had an injury to my knee resulting in surgery to fix my acl and my meniscus. My last pay stub of the year shows more than enough hours worked for me to qualify for fmla but even I am being denied fmla leave. Hr is claiming due to the issues they don't have accurately reported hours and the hours they have reported stop early December. Not sure what to do in this situation. Company has usually been great to us but here it feels like they're not doing enough for the employees in this situation.

Left car at body shop and I think the shop is using my car for personal use.

    Posted: 02 Feb 2022 04:59 PM PST

    Need some advice here.
I dropped my car off at a body shop on Jan 15th to repair some damage to my car. I was rear ended at a red light about a month and a half ago due to no fault of my own, and the other person's insurance took care of it.

I forgot my Airtag in my car, which I have for the express purpose of remembering where I parked (NYC).

On Jan 19th, my car's airtag suddenly appeared in Nassau County about 40 minutes east of the body shop at what seems to a residential home. My airtag lost signal until sometime around Feb 1st where it showed up at the shop again. During that time where my airtag went dark, I somehow accured $40 in EZPass fees, going on the GWB and other bridges to New Jersey/Bronx.

From what I can figure out, this might be a violation of NY Penal Law § 165.05: Unauthorized use of a vehicle in the third degree. Do I have a case here for stealing my money (ezpass) and using my vehicle for a purpose other than fixing my rear bumper and trunk? I'm worried that I'll have a ticket randomly appear in the mail someday or some other violation show up. Or if some illegal/shady dealings occured using my car with my license plates on full display.

I called the owner and asked him what's going on and he seems unaware, angry, and says he's going to find and fire the person who did this.

What should my next steps be?

Took out a "Pay per result" agreement with a marketing firm and they are refusing a refund after being unable to secure a result.

    Posted: 03 Feb 2022 03:32 AM PST

    Hi and thanks in advance.

I recently wanted some press for my business and chose to go with pay per result (https://unlockdmarketing.com/pay-per-results-pr/). I had some video meetings where I was buttered up and reassured that I would be picked up and in the press within a week. I then paid £99 (they also never sent me an invoice) and had an article written up about my business (which was adequate) and then they have (supposedly) been sending this to the press. 2 months have gone by and there has been no press so they tweaked and rereleased the content for it not to be picked up again. I have now been asking for a refund which they are denying due to their terms which I will copy below.

Understand we aren't PR genies – for the amount we charge, we don't and can't guarantee press in any time frame. Equally, it's at the journalists' discretion what is published and when (including what is written, what photos are used, whether there are backlinks and whether other experts / brands are also featured). Guarantees can only be made by publishers, advertising execs and God.

Later on in the terms they define a result

Understand how we charge – we charge per published press request as long as they credit your business name. That means that even if your comments appear in several different publications (from the same press request) or both online and in print, you'll only be charged once. If a press request is published after a cancellation, it's still chargeable.

We have both now got very frustrated with each other and they are threatening to stop communicating and overall making it unclear on what I bought.

Please can someone advise on how I could report them to a regulator or resolve this?

    Thanks,

    Ollie

Landlord lied about serving summons is there anyway to prove it

    Posted: 03 Feb 2022 03:14 AM PST

So I was evicted but didn't know that there was even anything filed until the sheriff posted that I had a week to move out. I was never served a summons per the procedure required by law. I live in Washington state where you have to be served in person, by certified mail of by having it posted in a conspicuous location such as on the front door. What had happened was there was a folded piece of paper next to the door where previously there had been letters reminding people that you can't smoke in your apartment so I assumed it was one of those and their lawyer sent a copy using uncertified first class mail and was postmarked for the Saturday before the final hearing which was on Tuesday and the summons was dated for the previous Tuesday. They obviously told the judge that they had served me the summons in accordance with the law but didn't. Everything is already said and done so I just trying to find out for the future if there is anyway to prove that they didn't follow the requirements or would it be up to the judges discretion?

City saying that a house I own must have a rental license, is not being rented. (Ohio)

    Posted: 03 Feb 2022 06:49 AM PST

In order for my parent to move up closer to me as they get older I purchased a house that they could live in. They've been living in the house for over a year now, and to be clear, I have my own primary residence that I live in.

Recently I was contact by the city with them claiming that because I do not live there I must get a rental license. I am not renting this house to my parent in any way, I do not charge them rent, etc. I am worried if I go through the effort of registering the house as a rental, I would then be subject to fair market laws, and I have no intention of charging my parent rent. I imagine there would be many other implications with getting a rental license for the house.

Any information or advice would be greatly appreciated.

A national chain store (tire shop) street raced my car, destroyed it, lied and covered their tracks about it, and it was all caught on my dash cam

    Posted: 03 Feb 2022 06:48 AM PST

I have an attorney in this matter so a lot of fine details can't be mentioned. The tire shop in question raced my car and blew my transmission, the employees and manager are all heard in camera rehearsing their stories and never planned on telling me. They erased all the cars trouble codes so when I picked up the car there was no indication of an issue. I pull onto a very busy highway the store is located on and nearly caused an accident because my car didn't accelerate or drive like it should've.

Long story short; I have a dash camera and to my surprise there's 43 min of video of my car being abused and then destroyed (including audio) I've filed a police report and a comprehensive claim with my insurance, but the car is only worth around $5000. My dad retained an attorney, but I haven't been able to speak to him for more than 60 seconds. It been 3 weeks, and I don't have rental reimbursement on my insurance policy so it's costing me quite a bit of money.

I'm going to be suing this company for a lot of the financial damages I'm already incurring in the long term, but I need these people to be accountable in the short term.

I'm thinking of selling the video to a media outlet, because I'm getting desperate.

I'm wondering if anyone has advice on how I should proceed?

Aunt keeps trying to sell house while I'm living in it.

    Posted: 03 Feb 2022 06:48 AM PST

Ok well not me but my friend. There both on the trust but he lives there and pays all the bills all the maintaining and upkeeping he does as well.
However she is constantly trying to sell the house while he doesn't want to move out or sell the house himself.
Now this is the state of Oklahoma to make it easier for people to give some advice.
IS she even allowed to do this? If both are on the trust?
IF someone does have some advice if possible and/or you know exactly where to find it in some official legal book please let me know the section or where its from.
Sorry I don't have to much more information.
I'm no lawyer and didn't want to say something to my friends thats not exactly true I do plan to try and do more research myself as well.

    Expected outcome of this conviction?

    Posted: 03 Feb 2022 06:48 AM PST

Let me preface this by saying that I know every case, judge, prosecutor, state, etc. is different so it's impossible to say. But I know there are similarities in systems nationwide. Basically my brother was arrested in November after beating his girlfriend. He's being charged with felony domestic battery with a child present and felony strangulation. He has no prior convictions but he had has prior restraining orders and he has been arrested before 2 times for assault (charges were dismissed for one and for the second one he did court ordered community service and had his charges dismissed after). Now he's in a real hole. He did 30 days in jail after being arrested and then had our dad post bond for him to be released after much begging. He was released with an ankle monitor and no contact order but was actually charged with violating the NCO because of yelling at the girlfriend while in court (misdemeanor). Anyways, he's completely denying all responsibility and has pled not guilty to all charges. The prosecutor in the beginning offered him 8 months in prison with domestic violence counseling. He refused the offer and is taking it to trial. His attorney doesn't even want to go to trial. Coming from his brother he's totally guilty. The evidence is stacked against him with photos and witnesses. The max allowable penalty for his charges is 28 years. I know the prosecutor is trying to throw the book at him. If he refuses a plea agreement what do you lawyers think would be a likely outcome? Years in prison? Any comments are appreciated.

My boss maybe asking me commit fraud

    Posted: 03 Feb 2022 06:48 AM PST

    Based Manchester, United Kingdom.

I'm fairly certain my boss is asking me commit fraud and I'm not sure what to do about it.

Hypothetically, on two occasions I may have created a counterfeit COVID19 vaccination passport for my boss to use as he pleases.

I have read that if I had done this, then it carries a custodial sentence, as similar to counterfeiting a passport.

    Is this true?

How can I approach my boss and tell him I don't want to do these things? Can I be held accountable if I did do these things?

My boss is very arrogant and hard to approach. He lives in a different country, completely oblivious to the real world and isn't one to accept no for an answer.

This is really affecting my work ethic as I take pride in my work, and now I may be seen as being used to commit illegal activities.

Not sure with how to proceed with landlord

    Posted: 03 Feb 2022 06:45 AM PST

I have had an ongoing problem with one of my neighboring walls. Constant scratching and loud music all throughout the night and every night. I have documented each time this has happened. This has been going on for a few months. I've also been in contact with my landlord about the problem and sent him videos each time. Landlord has tried to talk with the neighbor about the problem but they've been telling him they haven't been doing anything, despite me providing proof. I'm a pretty reasonable guy and consider regular apartment noises but this is beyond regular apartment noise. After several times of communication I'm now not getting any response. Really don't know what to do here. I feel like I've done everything the right way and exhausted all attempts.
