The new owner's property manager just sent us an application and a letter saying we have to submit the application, along with the $50 application fee (per adult), and come in to their office by the end of the month to sign a new lease. They say starting in January, we won't be able to pay rent if we're not in their system, and they can't get us into their system unless we fill out the application, pay the fee, and sign a new lease. It was my understanding that the lease would transfer as-is to the new owners, and that they are not allowed to change any terms of our lease. If that is the case, why would we need to sign a new one? Isn't my original lease still a valid legally binding contract until next August? Can they force me to pay an application fee for an apartment that I'm already living in and have a lease for? Can they refuse to accept my rent payments if I don't fill out the application and pay the application fee? [link] [comments] |

We had no rooms left for us so me and hubby decided to sleep in the living area he slept while sitting on the one seater and I slept on the couch. After I while I felt something and someone was touching me under my skirt, but I was too tipsy and tired to see who is was. In the morning when I got up I was sure what happened to me, I was assaulted but I haven't talked about this to anyone yet. Should I report it or should I ask my husband to handle it? Upstairs condo causes water damage - insurance won’t cover Posted: 19 Dec 2021 06:54 AM PST My MIL lives in MA and lives on the 2nd floor of a 4 story condo building. A week or two ago, water started dripping from the ceiling and she has water damage to her drywall in the kitchen and around a sprinkler head. Turns out, the couple upstairs had their son (who owns the condo) replace their kitchen faucet and it started leaking. The HOA won't cover anything because it's not a common space/ you own "stud to stud". The upstairs neighbors insurance is claiming they won't cover it because it's not negligence. My MILs insurance wants her to hit the $1k deductible before they'll help. The neighbor on the other side of the wall who had more extensive damage said her insurance is covering no problem. Where do we go from here? I am baffled that the upstairs insurance won't cover because "no negligence" when it's clearly their fault and they caused the damage. My ex-boyfriend's mother stole a large sum of money from a sports fundraiser in their small northern town (Canada), she then took her kids and drove to the opposite side of the country and spent all of the money on drugs/partying. This was a very large amount of money and the fact that it was stolen from a children's fundraiser really rubs me the wrong way. She was never arrested. I smoked weed before he came once not knowing he was about to come in. He asked me if I smoked, I said I had. He then offered to start a drug dealing business with me. "Hey man, I'm a street nigga. When I see opportunity to make money, I take it. There's a lot of college kids in this place and we could trap out of your apt and make some good ass money. I got plenty of Xanax. You got a weed plug?" I told him I wasn't interested at all as I'm in school studying to be a teacher. He asked if I could hook him up and I said that I could try. I had no intention of doing so, but just wanted him to leave me alone as he had access to my apt 24/7. He kept calling me seeing if I had some or if he could smoke at my place. One day he called me and I texted him I was busy and at work. That morning I had a hard time finding my key so I left it unlocked. I come back after work and it's locked. I call him to let me in and asked if he had been there. He said no. Me and him are the only ones with keys…. And $400 in cash is missing from tips the previous two nights. So I talk to the complex to tell them. They get a log of the electronic key system and he indeed went into my apt and locked the door behind him. Probably not thinking. He was fired. But police are involved now. They talked to him and asked me to come in tomorrow to "clear up discrepancies." Recently tested positive for hantavirus following rodent extermination at my workplace. Posted: 18 Dec 2021 10:41 AM PST I work in an older building, and during September and October, there were major problems with rats in the building that necessitated rodent exterminators. Of note, there are rodent poison traps all over the place. Fast forward to the second week of November, and I ended up in the hospital for 3 days with chest pain, fever, and difficulty breathing. I was negative for covid. They did a CT scan, that showed my lungs were full of nodules with ground glass opacities. I was released, because I had stablized, and followed up with a pulmonologist last week, who tested me for a bunch of stuff, including rodent viruses. Yesterday my pulmonologist called me to say that I had tested positive for hantavirus, and that I was the only case he had seen in 30 years, as I live in a non-endemic area. My house is immaculate, and I have never seen so much as a mouse poop, and I have not traveled. Is this a reasonable workman's comp issue? [link] [comments] |

To start, I already have a pretty shitty relationship with my apartment complex. They lied about so many things (they left out a utility fee when I asked them to tell me all the fees I can expect to pay, they lied about me being able to pick my own room, they lied about me being able to keep my parking spot, they tried charging me a full month's rent for moving in the last week of July, they straight up deleted my lease at one point and I had to get with a manager to fix it, they couldn't get me a key to my room for a whole ass week because nobody knew how to cut it, etc.) so I'm already at odds with these irresponsible dickheads. Now onto the topic at hand, basically the way our doors are set up (for our individual rooms, not the apartment itself), you have to lock it from the inside. As in you literally have to push in the lock from the inside, and shut the door from the outside. There's no way for you to lock it from the outside. So basically they made it super easy to lock yourself out, since you can't lock the door from the outside with a key. My problem is the fact that they charge $50 for someone to unlock your door after hours. If I could lock my door from the outside (since I would always have my key on hand to lock it), I wouldn't have a problem with this. But because of how the door is set up, I feel like this is a scam. They purposely make it so it's super easy to lock yourself out of your room, then tag a huge fee for letting you back in. It happened to my roommate a couple nights ago and I was pissed, because he shouldn't have to throw $50 away just because he locked himself out of a room that only locks from the inside. After all the shit my apartment put me through, I'm considering taking some kind of action, because now I see how their shady behavior affects other people, not just myself. I was at my sister's house when they (sister and brother in law) got into an argument and he started throwing things and broke the mirror. She kept yelling and asking him to leave so I voiced that he needed to go and that's when he jumped on me. After he got off of me, I stepped outside to gather myself and call the cops. The cops took a statement from me AND my sister. There was video and audio, but my sister deleted it..... The cops say it's my word against him but they have body camera footage and the statement of my sister saying the truth and that he was lying. The court date is soon and what the advice I'm looking for here is how likely is it that with just the statements and my injury's and his lack of injury, will the court side with me? UPDATE: Notary Information Used Without my Knowledge (VA) Posted: 18 Dec 2021 11:56 AM PST I posted in here yesterday about my employer using my Notary information without my knowledge. I deleted the post because it picked up too much traction and I was overwhelmed. TLDR at the bottom, but original story below with updates underneath. Yesterday, I learned that my employer had electronically notarized documents without my knowledge. She has my Notary info because the company paid for me to get my Notary Public. I learned that since October, she has electronically notarized at least three documents. In the Commonwealth of Virginia, there are different certification to be able to Notarize electronically and I am not authorized. For context: This company is small and family-owned. The CFO is my "step-mom" (I'm not married to my partner, whose family owns the business, and she isn't married into the family.) I hesitated on taking action on this because of the family connection, but also because I'd gotten my COVID booster the day prior and was foggy. Thank you everyone for the help and advice. I DO recognize the gravity of the situation and after sleeping off the COVID booster fever, she has been reported to the Secretary of the Commonwealth and I'm seeking the advice of a lawyer. If anyone has any ideas what could happen now, please let me know. I have anxiety issues and like to understand what happens in these cases. Homeless man trashing apartment hallway (CA) Posted: 18 Dec 2021 09:08 PM PST Me, my gf and our roommate moved into our apartment in August, and it's been great up until last month. For the past month or so there's a homeless man who comes into our apartment building and has been sleeping in our hallway, aside from that he leaves his trash and uses the bathroom there now. He's also been using drugs and when he's on them he bangs on the walls of all the apartments, slams the hallway doors and threatens anyone who might be in the hall with him. We've tried complaining to our leasing office and they tell us to call the police who don't seem to come and security kicks him out but as soon as they leave he comes right back. We sent a complaint via email to the office once again asking them to put locks on the building or have a full time security guard on our floor since it's the only one he comes to and haven't gotten any response. Idk party hear to vent but I guess I'm trying to see if there's anything to legally force the leasing office to do something since the hall becomes unsafe and unsanitary on the weekends as they don't clean it those days. However, they're chronically short staffed (there's an entire shift of only supplemental staff) so my hours are pretty steady. This year I've averaged 48 hours worked per week. Because I'm technically supplemental they deny me the benifits of full time staff such as health insurance and PTO. I do get sick time, but they don't let me use it. Is this legal? When somebody decides they don't want a lottery ticket or want to change their numbers after the cashier already has rung it up, apparently they don't have a system in place to refund it, so they make their employees pay for the lottery tickets under threat of termination. Additionally, apparently an employee has been stealing money from the drawers lately and they can't prove who it is because there aren't any cameras, so management is charging employees over the shortage again, under threat of termination. I worked for a company (company a) for 1 year and recently left to accept a job at another one. While working for company A i tried using my pto multiple times and was repeatedly told I couldn't by management due to "others already taking that time off" or "being short staffed" or "being the only one they could trust to run things when management was away". When I quit I have my 2 weeks notice, offered to continue working weekends to help out until they could train my replacement, etc. Long story short I tried doing it the "right way". Instead of letting me finish out my time they ended my employment that day and are refusing to pay me out my unused pto (about 90 hours worth) or my monthly bonus (about 800). Posted: 19 Dec 2021 04:48 AM PST This occurred on a private parking lot in Texas. Sorry if long post. I paid for parking via text as requested by the signs in the lot. I received a receipt confirmation that included the correct vehicle information in addition to remaining time (10 hrs). I returned to my vehicle in approximately 3 hours to find it was gone. I asked a tow truck driver on the lot what was going on and all he told me to do was contact the towing company. I had my wife and kid with me and it was below 50 degrees outside, we felt stranded. As I was calling the company another tow truck from the same company was driving through the parking lot and almost hit me as it was backing up. The operator of the truck then proceeded to threaten to attack me and my family. I dialed 911 to report what occurred but they told me that since this occurred on a private lot there was nothing they could do and urged me to go to the towing company location to retrieve my vehicle. I proceeded to the location of where my vehicle was towed and explained the situation to them. They informed me that although I paid for the parking (verified in their system) that the transaction was in a "processing" status and had not posted and that is why they towed the vehicle. This clearly did not make any sense to me as the transaction could be seen on my bank account and I had a valid receipt stating the payment was successful. In the end the person that worked at the tow company made a few phone calls and they ended up returning my vehicle to me however I am still out parking and Uber fees for my family and myself. I am a new mom and recently married. I have an extremely strained relationship with my husbands parents for a multitude of reasons and all of this came to a head last weekend. They have proven time and time again they are not to be trusted especially not around our infant. I am NC with them and my husband is low contact. I am planning to screenshot all correspondence and email it to myself and a trusted friend and then block them on any and all platforms I can think of. I will not allow them near my child. I tried looking up grandparents rights after my mom mentioned it a few times and from my understanding, they cannot claim rights or force visitation with our child unless my husband I divorce, one/both of us passes away OR they can prove that somehow not having a relationship with the child would be detrimental. Is this correct? And if they DO try to threaten or come after us claiming grandparents rights, is there anything else I should do to protect myself, my husband and my son? There was a custody battle for this client, boss didn't want to deal with it, so he recommended me to the family for to give expert testimony. During the deposition, I said that the client's severity level is 1. Later I noticed that it says "level 2" in our reports that we presented to the court. The kid's original diagnosis is from yrs ago and now he actually qualifies for level 1 but I have no written proof of that. Ever since I have gotten fmla my boss has been telling me not to use it because we are short staffed and it puts us in a bad position. he has now taken my position away from me because I use my FMLA and even told the new girl on my unit that it's because of my call offs saying I'm unreliable. Reason for it being an issue is because im the only person able to work my unit on the weekend and me calling off makkes it hard on other staff. Is giving my unit away due to me using fmla something he is able to do? Hello, I'm not sure the best way to word everything so please bear with me. I work at a hospital as a part-time housekeeper and have had the same job/schedule for going on around 4 years now. Recently I was diagnosed with fibromyalgia and arthritis. I am younger (under 25) so a lot of time when I'm unable to walk or if I'm struggling to do my job nobody takes me seriously and my boss has told me plenty of times I need to just go to the gym and that I'm too young to be feeling the way I feel. I put up with this for a long time up until earlier this year (in july) when my doctor signed paperwork for me to have intermittent FMLA while we try to find something to help my pain. I'm allowed to have 2 days a month for FMLA and have never once used more than that. Upon learning of my FMLA my boss wasn't very happy because we can't find anyone to work on maternity because it's "complicated" and "gross" according to him. (it's not complicated the cleaning chemicals used on maternity are just different compared to other places and the beds are different) when I called off the first time it was on the weekend and was due to my hips being in so much pain I was unable to sleep. Later that week I was pulled into the office and told that I can't make it a habit to call off when I'm in pain especially on the weekend because I am"putting the department in a bad position especially when staff is short on the weekends" I was pulled in the office 2 times regarding my FMLA and the fact I put the department in a bad place and that if I'm going to call off on the weekend I should let him know a few days in advance so he can find staff. I'm not sure how I can do that considering I'm unable to sit down with my medical condition and schedule my flare-up. I have also been informed that on one of my scheduled days off my boss and a bunch of coworkers were talking about me in a bad way and that a few of them think I should be fired. Of course, I wasn't there for the conversation and was only told about it because 2 of my coworkers texted me and informed me of the conversation that was had about me in our morning huddle. That was a small back story and now brings me to one of the main issues. 2 weeks ago on Wednesday I was sick and was sent home for having a fever and suspected covid. So I was unable to return to work until I had a test result. The hospital's employee health unit called me and we discussed how i was negative for covid and they asked me about my symptoms. Due to me still having a fever of 101.8 I was told I need to be fever-free for 24 hours before I return to work and was told to see a doctor. I went to a local urgent care and was given another covid test (even after a negative one yes but the doctor said all of my symptoms point to covid) and that I need to be under quarantine until my tests come back i tried telling them i dont need another test and to please let me go to work but Sadly I missed the weekend. I did discuss this with my boss and as soon as I knew something about my sickness my boss was the first person I told because I didn't want me being sick to hurt staffing. Today was my first day back to work and I went in to find out that I wasn't working my normal unit and was assigned to work pcu instead and a different woman was assigned to my unit. I obviously upset about this tried to find out what happened and after talking to my friend (the girl assigned to maternity today) I found out my boss switched her days around so she could now be the part-time housekeeper for maternity because my boss told her I'm unreliable and that I call off on my days and he needs someone that can work. I found this to be wrong in my eyes for a couple of reasons but one of them was because I was never once informed about this. When I work on maternity I have to wear sterile scrubs provided by the hospital so if I knew that I wasn't going to be working on my unit I would have at least brought my regular scrubs. I also feel as if I have been treated differently by my employer since I got FMLA and I feel like I'm being punished for using it which I'm not sure but I don't think he can do that. I texted him asking why he never told me about this change and asked his reasoning on it and was told that it's because he needs to ensure there is covrage in OB and that my coworker is working on my unit now to ensure that because not having someone in ob due to call offs is a big concern to him. I also asked why i was never told about this and was told the following "I texted you on Thursday informing you about the change but you didn't reply to me." (He hasn't sent me anything since December the 3rd and I looked through our messages and he has never told me about this change happening. Once I told him I have not talked to him since the beginning of December i was told "Yes I did. I reminded you that you are scheduled to work this weekend and you will be in PCU and [coworker] changed her weekend schedule. If I may say so, you don't always reply to my text messages and I assume you received and was ok. You not receiving my text message from Thursday could be due to many things. I am not saying that you are not responsible for not receiving my text message, I communicated." He also said he would have told me in person bit I wasn't at work for him to tell me. I have worked the same unit for a very long time now with no change to my position but I am now having my position taken away from me because I have fmla and use it to call off when im in a lot of pain and I was wondering if there was anything I can do to get my position back or if this is just a normal thing that happens and if i should just quit if i dont like it. I want to "brand" my app but I really don't mind anyone else using my app's name. What I'm really worried about is someone using the same name and trying to sue me / take away the name of my app from me, even though I used it first publicly. Should I be concerned ? Mom gambled away most of her money within last 2 years, will be trying to qualify for Medicaid soon Posted: 18 Dec 2021 02:56 PM PST Mom is 76, had sizable amount of money put away, but we've found out she was making trips to the boat and just about all the money is gone. She's deteriorating to the point where she can no longer live unassisted and a nursing home is probably in the offing. I know that qualifying for Medicaid is an extensive process and they are going to look back at 5 years of assets and where they went. Is this going to disqualify her? How will Medicaid differentiate between "you spent the money" and "you cashed the money out and squirreled it away, or gave it to family members to meet the spend down requirements." Which just to be clear she has not done, but I would think it is not as simple as saying she suddenly spent all the money at the casino...otherwise everyone would be doing this to qualify rather than hiding money in offshore trusts and all the elaborate estate planning we hear about. Moved into my new apartment to find that none of the outlets work in the office... Posted: 18 Dec 2021 10:49 AM PST I just signed a lease for a 1 bedroom apartment and moved in on Dec 7th. Upon unpacking and setting up my office, my husband and I discovered that NONE of the electrical outlets in the office work. I work from home and I'm an avid PC gamer, so this is a major issue for me. I can't set up my desktop without running a long extension cord across a major doorway, which I refuse to do. I noted it on my move-in damage sheet, I called the leasing office and the lady there said she put in a maintenance request for me and it would be done "tomorrow or the next day." I followed up in person 2 days later, she seemed to not remember ("You had a request? I don't see it here...." then I explain, "oh yeah, you did have that....ok, someone will get to it Monday.") Monday comes and goes, I've submitted the maintenance request twice more via our online rent pay website - no response. She keeps telling me the maintenance guy is "very busy, and there's only one of him." He passed by on his little golf cart while I was complaining to my neighbors, and he stopped and let me know that a) he hasn't seen the maintenance request, and b) he wouldn't be able to do that kind of work anyway, they would have to call an electrician. My neighbors tell me that the last tenants went their WHOLE LEASE with the outlets not working, they just....accepted it and used it as a dining room instead. I cannot do that. The office area was one of the selling points, the reason I chose this apartment over a different one I was looking at. Important notes, they gave me a $500 move-in concession and $75 per month off rent concession, it was advertised as a move-in special, and they never disclosed that an entire room of electrical outlets didn't work. She even watched me on the tour say, yes, this office area is great because I work from home, this is what I need, and didn't say anything, when presumably she KNEW about it already (since the last tenants had the same issue and never got it resolved). What are my options if they keep stringing me along, or refuse to fix it? TL;DR - Got a new apartment, none of the outlets work in the office but I work from home and NEED it fixed ASAP. Leasing office was stringing me along on some "tomorrow, maybe tomorrow" shit and then stopped responding. They are now ignoring me, and the neighbors are telling me no one is ever coming to fix it. ::Edit 1:: I am in Arizona. ::Edit 2:: The first thing my husband did was to check the circuit breaker.
