Hit and Run By an ATV while Completely Stopped (with plenty of video footage)

    Posted: 03 Nov 2021 05:11 PM PDT

Hey there - hoping for some advice / guidance on my situation.

Over the weekend, I was driving my car down a major street in California. A crew of 50+ guys in dirt bikes / atvs (not street legal of course) starting coming down the street driving recklessly. They were weaving in between cars doing Wheelies. As two guys came on each side of me and barely missed side swiping me, one guy on an ATV was doing a wheelie and came down directly into my car, rear ending me. He completely smashed by back window and ruined the entire back of the car. Glass everywhere.

My friend happened to be video taping what was going on including the moment of impact.

The rider, somehow was able to walk/crawl and went off to the side of the street and into the alley way. Meanwhile, his crew QUICKLY moved his atv off to the side. They then had a sprinter van pull up and loaded the atv onto the car. He was laying in the alley way for a minute and they then picked him up on another bike and drove off following the sprinter van. This all happened in about 5 mintues from after the crash.

They left the scene completely. I called the police immediately and they made me file a police report online (to which they have not followed up and when i called to ask about it they said it'll be at least two weeks and that i can't send any evidence in the meantime and then hung up on me).

I'm insured with Geico and called them. They had me file a claim online. The next morning they had a tow truck take my car into the nearest shop. They had a rental pickup ready for me. While at the shop, they told me that because the car is relatively new and there is so much backordered due to supply issues, it could likely take 6+ months to get my car back. She also said its absolutely not safe to drive in the meantime.

Geico will only pay 1050$ total for car rental.

What can I do in this situation? I'm now on the hook to a) keep paying car insurance b) continue my lease payments even though my lease will be close to done by the time the car gets fixed c) either be carless or pay anything past the month or so that they'll cover me.

Obviously I have a 500$ deductible for this bc its a hit and run, but is there nothing that has them cover for loss of use of the car for these six months (or potentially longer)?

It's really just such a frustrating position to be in to not just have to deal with the neck / back pain of the accident but now the ramifications of potentially being carless and paying for a car I can't drive/use.

Also - the Police have been no help, but I did go to stores around the scene of the crash and collected video evidence wish shows the accident (plus my recording from in the car during the crash), shows the ATV driver leaving the scene with a clear face shot, and a shot of the van being loaded and leaving with a trucking company brand clearly visible and a license plate that is relatively clear.

Any advice here would be super appreciated.

Is my Dr at fault here?

    Posted: 04 Nov 2021 06:05 AM PDT

I recently had a baby and early in my pregnancy, my doctor provided a sheet that listed all the possible testing we could do - along with the CPT codes so I could pre-check with insurance and they also gave the out of pocket costs for them. We had to sign the sheet to verify we are liable for tests not covered (I didn't sign this until well after I already completed testing…they kept harping on it to save for record).

We talked about how I'm an Ashkenazi Jew so they said I should really consider doing the genetic blood panel. No further discussion. I spoke with insurance and saved the chat logs where I gave Anthem each code the doctor provided for this test and confirmed that no pre-certification or approval was needed. Great. So I do the tests.

I just learned my claim for this genetic panel is being denied because it's medically unnecessary. The problem is - the code Anthem is denying is not even what my doctor provided…and it's $2k higher than what I was quoted (which was already over $5K). My doctor gave me codes for each separate Ashkenazi disease being tested whereas Anthem is claiming it's this new single CPT code for the entire blood panel. So I walked into this agreeing to do the test, after doing my due diligence in contacting insurance, based on misinformation due to the wrong codes.

No one ever mentioned this new code to me or said anything about genetic counseling as a required part in order to assess medical necessity and be covered. Anthem is denying my appeal by saying when I did my pre-checks with them I never mentioned this new code. So I feel like I'm in this technicality loophole.

I reached out to my doctor asking why they gave me the wrong codes and they haven't responded. Yea I signed a sheet saying I accept liability but I did that months later and I did not sign liability for this new code.

Are they in the wrong? What can I do?

NYC Carriers Drug Test for THC

    Posted: 04 Nov 2021 05:15 AM PDT

Does anybody know if carriers (AIG/Chubb/Travelers/etc) drug test for marijuana for new hires in the nyc area? I know that some legislation has been passed locally and at the state level to prevent any testing for THC but I am looking to confirm that companies have actually stopped doing this. Any insight into this would be greatly appreciated.

car in shop, insurance told them to stop working on it

    Posted: 04 Nov 2021 04:56 AM PDT

My car has been in the shop for over a week getting the bumper replaced. My insurance scheduled the drop off date and I dropped my car off.

They called me 2 days ago saying they might not cover it anymore and they would call me back "in a little bit". They haven't called back.

My issue is i'm going on vacation in 6 days and when I get back I'll be getting surgery 2 days later. I can pay for the repairs out of pocket but I would rather not considering the cost was more than my deductible.

What should I do? Should I tell the dealership to work on it and forget about the insurance? Wait for the insurance? The the insurance I can pay for it? Go pick up my car until they're ready to work on it?

Why is State Farm so astronomically higher in auto insurance?

    Posted: 03 Nov 2021 06:34 AM PDT

    Hello,

I recently started shopping around for home and auto insurance to see if I can save money. I currently have Progressive/Homesite bundled. I'm located in Maryland and saw good rates for home at Lemonade but that would mean having to have separate auto insurance.

I have a 2018 Honda Odyssey EX-L financed and a 2007 Honda Civic LX owned. I'm paying $439/6mo right now and it will go up to $491 the next time it renews if I drop the home bundle. I got a quote from state farm and it came in at $1,090... just the Odyssey is $200 more than my current plan with the exact same coverages.

Did I mess something up in my quote application or is SF really that messed up?

Wedding venue charging us $900 to replace damaged table. What do we do now

    Posted: 03 Nov 2021 06:31 PM PDT

Our wedding was earlier this month at a restaurant. While there, a candle caught fire and burnt patches into a table.

The tables are solid wood and made by the Amish. We requested an estimate by the makers for the cost to replace or repair it. They were quoted $900 to replace it.

We have renters insurance through Lemonade, which includes liability insurance. We believe this means they will cover the damage to the table, but my question is, what happens to the old table? It's by no means unusable, just a little burnt. We've seen pictures and they could easily buff it out. Does the resteraunt have any duty to try to repair the table before replacing it completely?

Should they be filing a claim with their insurance instead?

Is this covered with comp? (Esurance)

    Posted: 03 Nov 2021 09:22 PM PDT

I came home from work last night and noticed my city issued garbage can was knocked over in front of where I would park my SUV on the side of the road.

I jokingly took a picture of it laying down in the road before coming inside for the night. I asked my boyfriend if he hit it, but he said someone hit it at a high rate of speed and took off. Made sense it was high speed, because it was about 30ft down the road from where I had originally put it for garbage collection.

Today during my lunch break, my boyfriend tells me there's damage to the trunk and bumper of my car. We didn't put two and two together considering how far it was from my parked vehicle. We rechecked the garbage can together, and sure enough, there's more damage than I initially thought there was. My car was parked in private parking just off the road.

I made a police report from the knowledge I had, neighbor being a witness while I was at work, but no physical proof other than it being a black Chevy SUV that has front end passenger side damage.

Would my comp insurance cover this type of damage to my vehicle or am I screwed? I'd rather not call esurance unless I 100% know it could be covered.

Tldr; vehicle hit garbage can that ricochetted off my car and caused damage to trunk and bumper. Would comp cover this or am I screwed?

Cross-posting from r/legaladvice: other driver’s insurance wants to declare total loss (New York)

    Posted: 03 Nov 2021 07:47 PM PDT

Other driver's insurance trying to declare my car a total loss (New York)

My car was parked outside my mechanic and was hit by a truck. This was on Monday October 18. I filed the claim that day and the driver's insurance accepted liability the following day on October 19. That same day the car was towed by the body shop doing the repairs and maybe the 21st they sent an estimate that was far below what was actually needed. I opted to have them pay the body shop directly. The insurance company was not communicative and it took maybe a week to connect the dots on amendments to the estimate and the insurance instructed the shop to start repairs. Yesterday an adjuster (?) went to look at the car and today they sent me an email with the "actual value" of the car and based on the new estimate for repairs and value they assigned, they want to declare the car a total loss and pay me out. I want the repairs done and do not want a salvage title (I have a nice car that I love, and the car is very much drivable just needs a new tire, fender, bumper etc) - do I have any recourse? I've also invested a significant amount in new parts over the past two years, including all new tires, all new brakes, new battery, new radiator. Thanks in advance for any advice!

When is it appropriate to use an adjuster?

    Posted: 03 Nov 2021 07:45 PM PDT

At what price range and when in making a claim does it make sense to hire an adjuster for car/home/investment property.

Auto Claim Expected Resolution Time? (waiting on subrogation demand from other claimant)

    Posted: 03 Nov 2021 07:06 PM PDT

    Hi there,

I was involved in a 3-car accident where there was no objection to who was at fault. The parties are as such:

    At-fault driver:

    - No damage to car

    - Infinity insurance

    Me:

    - Medium damage to car (around $7,000)

    - No insurance (I bought the car brand new 40 days before ** and an error caused it not to be added to my coverage)

    Other claimant:

    - Car totaled (2015 Genesis sedan)

    - State Farm insurance

I filed a claim through the at-fault driver's insurance (Infinity). The other claimant filed a claim through her own insurance (State Farm).

Within a few days, an adjuster estimated the damage to my car.

Since that point (~4 months ago) Infinity has been waiting on a subrogation demand resolution from State Farm regard the other claimant's damages. Infinity says they need this before they can authorize the repair on my car (which makes sense).

    My questions are:

    - Four months is a long time. Is that normal? I read that when a car is totaled it takes longer, but this seems excessive.

    - Are there any ways to speed it up? I call the Infinity agent every week. She calls State Farm and the answer is that it is still ongoing with no expected end date. The Infinity adjuster gave me the State Farm adjuster's number but I get the same answer with no hint on when it will be resolved.

    - I added the car to my insurance just after the accident. I know it isn't covered but should I contact my insurance (Geico) to get help or advice?

    - Is there a point when I should hire an attorney?

Any other tips would be greatly appreciated.

** While I would love to drive my new car this hasn't been too bothersome since I hadn't sold my old car yet. :)

How does Medicaid/Covered California work for people only living in California for a short period of time.

    Posted: 03 Nov 2021 06:30 PM PDT

I am currently considering moving to California for several months starting in January. I'd be moving from a very inexpensive city to a very expensive one. I'm currently on Medicaid in my state, which was expanded to cover all low income people. If I make too much money, I could lose my Medicaid and because of pre-existing health conditions, I may not be able to pay all the out of pocket fees of ACA insurance. If I make less than the minimum for Medicaid in California for the 6 or so months that I'm there, does it matter if I make more money in another state? Can I even get Medicaid or Covered California insurance if I'm in California for less than 6 months?

    Dental insurance

Question about adding a valuable item to my renters insurance

    Posted: 03 Nov 2021 11:43 AM PDT

    Hello friends,

I recently purchased an engagement ring. I took advantage of a 25% off sale that Kay Jewelers was having a few weeks back. I know I need to call my renters insurance agency (StateFarm) and add the ring onto my policy, however when I assess the value of the ring, do I use the purchase amount that includes the 25% or the standard retail amount?

Should I file claim for hail damage on old roof

    Posted: 03 Nov 2021 05:39 PM PDT

So we're getting our roof replaced. This is a project we've been planning to do for months/years. While getting estimates several things have come up. We should get a new ventilation system and replace the plywood because it is warped. Our planned project is now 2 times the cost (roughly 20-25k although we're still working on some estimates).

It also came up that our roof sustained widespread hail damage recently. Hurricane Ida spawned a tornado that hit our neighborhood and completely destroyed houses a couple of blocks away, so this wasn't completely surprising. But it's also a roof that's at least 15 years old, so who could tell the difference except for the roof inspectors, supposedly.

Would it make sense to file a claim with our homeowners to offset some of the costs of this? I don't expect them to pay for everything, but what could they end up potentially covering? The shingles? Materials are super expensive right now. Technically we can cover the cost of this out of pocket. Does that pretty much automatically mean that it's not worth claiming?

We have Liberty mutual in Pennsylvania. I think we have replacement cost coverage based on our policy documents.

Will I get penalized for a lapse in auto insurance? (California)

    Posted: 03 Nov 2021 05:31 PM PDT

I recently received my parents' old car from the 2000s as a gift (as listed on our title transfer application). Per California law, the car insurance policy owner must be on the title to purchase insurance. The title transfer won't be complete for another 3-5 weeks (DMV mail processing time is crazy), and my parents' policy on the car ends on Nov. 7.

I plan on letting their policy end, and will keep the car in my garage and not drive it until I receive the new title under my name and open my own new policy.

Is this wise? I'm reading that a lapse in insurance will cause rates to rise significantly - I'm unsure if this is by car, or by owner. I've never owned a car and I've never been listed on an auto insurance policy, so I as a policy owner wouldn't have a lapse in coverage but the car will.

I can also opt for my parents to continue the policy for another month, will just reimburse them in that case - just don't want to burden them with more work, etc.

    Thanks i'm advance.

Friend backed into my car, and told her insurance about it. Can I go through my insurance instead?

    Posted: 03 Nov 2021 11:26 AM PDT

So as title says my friend accidentally backed into my car. Her and her husband have done a lot for me recently and don't want to put them in a bind. She gave my information to her insurance and they have set up a day for me to bring my car into the auto collision repair shop. She just had a hit and run against her about 2 months ago and is sure that her premiums will go up with this claim against her. I feel a lot of guilt as they have done a lot for me. Would I be able to have her tell her insurance company that I don't want to go through her insurance and go through my insurance company and not tell them who hit me?

    Hoping for a Total loss...

My wife was in a wreck about a week ago. Located and registered in TN. She was not at fault. Looking at the car I assumed they would total it. Insurance told me today they think they can fix it for about $11k. It's a 2020 Jeep GC Limited with about 41k miles. Right now the same car is selling for 39-41k. Does anyone have suggestions to convince my insurance to total the car?

    Insurance for Game Prizes

    Posted: 03 Nov 2021 04:15 PM PDT

From what I vaguely recall, most of the large prizes offered for skill games (ie, sinking 3 back to back shots at different areas on a basketball court) are actually just insurance payouts, rather than the school or event directly paying out.

Which companies underwrite this type of insurance product? Are the premium payments over a specific period or on a per event basis?

[New Jersey, USA / maybe Virginia, USA ?] girlfriend had her car totaled, but still drivable, in an accident where she was not at fault. Can she keep her car while receiving compensation?

    Posted: 03 Nov 2021 03:40 PM PDT

My girlfriend, A, was driving back from a work trip and was rear ended in the Virginia Beach area by the at fault driver, B.

Her car is considered totaled as it's a 2001 Honda Civic but it still drives fine. This obviously means that A would like to keep her car if possible.

A's insurance agent told her that she would be able to receive compensation for her car from B's insurance company while still maintaining the rights to her car.

I feel like something is being misunderstood, on my end or someone else's, because:

    1. I am unsure if the fact that A lives in NJ and the accident took place in Virginia makes any difference

    2. This is not how things have gone in my experience, so I would like to tell my girlfriend if something is incorrect

    3. Wouldn't she be being compensated for a loss that technically never occurred?

    TIA.

Should I switch auto repair shop?

    Posted: 03 Nov 2021 03:32 PM PDT

My car was struck (hit and run) 6 days ago and chose an autobody shop through one of the allstate preffered networks. The front left bumper was damaged and the driver wheel doesnt move when I steer.I keep calling for an update for an estimate but they keep saying they will do it "tomorrow" or I will give you an update later today and no call will be made. Today I called them again and they still havent done anything, not even an estimate on the damage so my car has been sitting there without any progress for 6 days.

Is this normal? Whats the best course of action? Im thinking of calling my insurance and see if I could switch shop to another preffered shop but Im thinking the current shop might charge me storage and towing fee.

Pothole caused damage to my car

    Posted: 03 Nov 2021 03:11 PM PDT

So my car hit a pothole inside of a residential community a couple of months ago. There was no signs it was there, and it's not like I was speeding, there's road bumps all through out. The pothole to this day is still there. The damage on my car isn't severe, but it is a lease which concerns me. I attempted to contact the community/hoa directly and they told me to file an incident report with them, so I did. After reviewing it they told me to file a claim with my insurance, however I'm scared my insurance will go up and maybe it's not even worth it. Any advice on how to handle it?

Should I file a claim with my insurance? Any help is much appreciated!
