Wife wrecked car, claims department denied coverage.

    Posted: 08 Jun 2021 04:19 PM PDT

    Location: Tennessee, US

This doesn't sound right, but I'm no expert. My wife totaled her car that she is still paying for. She has "Full Coverage" because that's required when financing a car. Roads were wet, she hydroplaned, went off the road, hit a tree, and flipped back into the road. No other cars were involved and this was a single-car accident.

We filed a claim, and just got a letter back saying that they will not cover it, the reason being: Accident was not with another vehicle... She has Liability, Collision, and comprehensive coverage. Does that not cover almost anything that can happen. We are gonna call the insurance company in the morning but I would like a second opinion on what's going on or at least have an idea of what battle I may be fighting.

    /TIA

This is the letter, what exactly does this mean:

It is our desire to thoroughly investigate every claim that is reported to us and to make payment for those losses which are covered under the insured's policy, and for which our insured is liable.

After conducting a thorough investigation of this matter, we have determined that there would not be coverage for the above-captioned date of loss. The basis for our coverage denial is based on the following:

    • Accident was not with another vehicle.

Therefore, we will be unable to consider payment of your claim.

Please be advised that nothing contained in this letter should be considered as a waiver of any of Nation Safe Drivers's rights, and Nation Safe Drivers hereby expressly reserves the right to deny coverage for any other valid reason(s) which may now be known or which may be discovered in the future. If you are aware of any facts that are unknown to us, please bring them to our attention for consideration.

    Sincerely, Claims Department

Car crashed into my house and vehicles and the one at fault refused to go to examination under oath and now I'm not getting a single cent

    Posted: 08 Jun 2021 08:12 PM PDT

Title pretty much says it all , i live in Florida i have Geico and they have UAIC. It was midnight and they crashed into my house and hit my fence and two vehicles one of them being completely totaled due to the accident . I did not have collision and no one was outside at the time . We managed to get the police and make a report etc. Since I didn't have collision at the time my only choice is to go through their insurance which is a measly 10k for four vehicles (neighbors as well they have collision ) and property damage (ill only get a percentage ). But now they're saying the policy holder refuses to go to the examination under oath and because of that they closed the claim completely and won't pay me a single dime , since their was no bodily harm during this I can't even find a lawyer to file a lawsuit. Is there anything I can do at all?

    Inherent Diminished Value Claim

    Posted: 08 Jun 2021 12:57 PM PDT

While stopped at a traffic light, my brand new vehicle ($~49k) was rear-ended by a kid playing on his phone. A few months after the accident and subsequent repair, I checked the Carfax report and sure enough, a minor accident is on record.

I paid for a 3rd party appraisal who estimated ~$2,000 in diminished value due to the accident, which I sent to the kid's insurance seeking payment. Without providing any documentation to back it up, the kid's insurance says the damage was too minor and they won't pay unless I sell the vehicle to prove a loss. In my state, Iowa, the statute of limitations for this situation is two years and I plan to keep the vehicle much longer.

I filed a complaint with my State Insurance Division against the kid's insurance and they said my only remedy is to bring it to small claims court. I believe in my state, the kid's insurance has a duty to defend their policy holder.

Do I have a solid claim? If I file in small claims, what's the likelihood their insurance settles before it gets to court? What's a reasonable amount to settle for? TIA

Letting a neighbor store a large boat on my property

    Posted: 09 Jun 2021 04:44 AM PDT

They don't have enough room, but I do. If a tree fell on it, or something like that, does my insurance automatically cover the damage. I guess it would be similar to a guests car getting hit in my driveway.

Damaged bumper from small accident pay out of pocket or claim advice ?

    Posted: 09 Jun 2021 04:02 AM PDT

So my wife reversed into another car in the parking lot as he came round the corner and caught his bumper on the right side her bumper has some minor scratches on it and his doesn't look damaged at all from the pictures but he is claiming it will cost £200 to repair his front bumper he wants us to pay for it without going through insurance our deductible is £500 so we will have to pay either way but would we be better off just letting the insurance company deal with it for safety or paying for his bumper to be fixed we have never had to deal with insurance before so I don't really know what to do here plus I don't think our insurance would really go up for this.

Also I don't know if this helps but our deductible is a actually more than our insurance for the year £500 deductible vs £400 insurance for the year.

This is in the United Kingdom.

Dentist is in my PPO Dental Network - But I'm still under a waiting period. Do "In-network" rates still apply if I still choose to move ahead with Dental Work?

    Posted: 09 Jun 2021 03:07 AM PDT

    Hello r/insurance,

I have a question. I got Dental insurance coverage again about 6 months ago. A few days ago I went to the Dentist in my PPO network for a cleaning and check up (which is 100% covered by my Dental PPO plan). However, apparently I need work done to a specific tooth in the back of my mouth.

The Dentist quoted me saying it would cost $2200 dollars to fix the tooth. And I was told because I'm under an insurance waiting period for "major" services (such as Root Canals, Crowns, Implants, etc), I would be responsible for the full amount. I asked the Dentist how much would it cost WITHOUT insurance to do the procedure. He said it would still cost $2200 even if I had no insurance. Now...sure I COULD pay $2200, or wait 6 Months until the "waiting period" is over.

    My question is this:

I was under the impression that Dentist's have "in-network" rates with your insurance provider. That if they belong to your Dental network that you would be charged cheaper in-network rates. And that having any insurance is still better than not having anything at all. That uninsured are charged differently.

I understand about waiting periods.... but I thought I would at least be charged an "in-network cheaper rate" for being an insured Dental member. I'm not asking for my insurance to PAY for the cost procedure. I can do that. But I thought it would at least be a little cheaper than $2200 because I have Dental insurance, and they are 100% "in-network" according my insurance carrier.

In this situation with a waiting period....is it normal to be treated like you have no insurance at all? Is what my Dentist saying normal? That the cost of the procedure is $2200 dollars with or without insurance. What happened to "in-network" rates?

I would appreciate any clarification anyone can offer. Have a nice day!

EDIT: For clarification, I live in the United States of America in California.

I owe money for a policy I never had??

    Posted: 08 Jun 2021 08:03 PM PDT

I live in Cobb county Georgia and back in October I traded in my car and got a new one. I talked with my insurance company about switching over and cancelling the other policy for the sold car. I found out yesterday the policy was never switched over and now I am being told my new car was never insured at all.

After saying I'd probably be switching companies and wouldn't be switching policies after all (since this wasn't my first issue with them) they told me I would need to "pay them back that money" on an insurance policy I never had. Roughly $2,400 since they requoted me over $300 a month.

None of this sounds right to me and I was hoping for some advice or some explanation for how this can be the case. Please help.

    Fraud? FL resident, PA plates

    Posted: 08 Jun 2021 01:28 PM PDT

I am wondering of a collegue is committing car insurance fraud. She lives in Florida but car has Pennsylvania license plates. I joked how she should get Florida plates and she told me she keeps her car registered in Pennsylvania because the car insurance is cheaper in PA than in FL. She is not a snowbird.

    Is this car insurance fraud?

Tree Fell on House, City Contractor’s Fault

    Posted: 08 Jun 2021 06:15 PM PDT

My Uncle's house is deemed structurally unlivable. The city sent a contractor out to remove a tree and it fell on the house while my aunt was in the house.

Apparently, the contractors insurance company doesn't have enough money to pay the damage. The house needs to be completely gutted. The company wants my Uncles insurance to cover it instead.

What should he do? Can he sue or should he just bite the bullet and go through his insurance company.

Edit: My Uncle lives in Minnesota.

    Personal vs. Commercial Insurance

    Posted: 08 Jun 2021 07:29 PM PDT

Hey! I'm planning on buying a vehicle soon, I'm getting all my paperwork ready and don't plan on starting any jobs until the end of the year. If I buy the vehicle under a personal auto loan will there be any problems adding commercial auto insurance down the line? If I buy the vehicle under my LLC will I be forced to get commercial auto insurance right off the bat or can I get a regular insurance and change it to commercial down the line? & my last question is since this will be my only vehicle I'd like to use it for personal use, will commercial insurance cover me if I get into an accident while not on business use?

    Thank you!

Odds of Mr. Tire paying out for oil filter falling out?

    Posted: 08 Jun 2021 04:44 PM PDT

    Hello!

Yesterday, my oil filter on my 2012 Mazda3 with zero issues fell off while I was driving. Yep. 100% gone.

Background: I was driving home from work in Virginia and right at the exit to get off the highway, my vehicle shut off. Just straight off while at speed. No power steering, no brakes. Thankfully, it was not busy, so I was able to finagle a safe stop off the intersection. Car would not turn at all or even attempt to start. I opened up the hood and immediately saw oil in the bottom of the engine. All of it. I called the tow truck and off it went. Didn't even get to say goodbye.

I had an oil change about 25 days ago at Mr. Tire, and had driven about 680 miles on it. I had it towed to a local shop and they got back to me that the entire oil filter was gone. No sign of it at all. The oil dumped out while going 65mph and my previously awesome car was suddenly no longer as awesome. The Repair shop said the engine is toast and the cost of replacing it is more than the car is worth (~5k). This being the United States, and insurance is so cumbersome... I had a few questions.

    1. Will my vehicle insurance (USAA) be of any help? Do I get them talking to each other? Is this even something that my "Insurance" will cover?
    2. Mr. Tire's insurance left a voicemail asking for information, what can I expect when they get back to me?
    3. Best way forward from this? What are things I should ask, get ready for, or even worry about.

Any answers would be of tremendous help. Thanks! I appreciate it all.

    Car insurance lapse questions

    Posted: 08 Jun 2021 10:06 PM PDT

    1. Almost all states have a lapse in coverage penalty. Is there no way to avoid this, even if my intention is to store the car on my property for future use?
    2. The car will be rarley driven. I may only use it in certain seasons for touring or visiting another part of the country / property and only will only register temporary insurance during this time to legal drive it- how can I avoid coverage penalties between these periods?

Applicable for Michigan and Tennessee. The car will be a cheap disposable beater. The insurance will only be state minimum liability. I have little use for a car as my main transportation done locally is foot, bicycle, but I still want my car on my property for future long distance trips. Also - a car rental is not an option.

    Insurance Under Investigation..?

    Posted: 08 Jun 2021 06:16 PM PDT

I'm just going to start with the whole story. It's long and I'm sorry, but I don't want to leave out any details. A few weeks ago I was on my way home from work. There's an intersection; you can continue to go down the street which is a right curve, stop and turn left, or stop for ongoing traffic to go up the hill. The speed limit is 35 mph. I'm driving, and slow down because I need to go up the hill, there's on coming traffic, so I stop completely with my blinker on. And BOOM. Out of nowhere this red F250 slams into my Elantra. I heard tires squealing and he pushed me a pretty good ways up the road. I immediately pull into someone's driveway, and my car is ruined. None of my air bags deploy but my back glass is gone, my trunk is now open but smashed into my car, separate from my bumper. I call the police, it's an 18 year old that hits me. He files the report and follows me home to get my car in the driveway. I call the insurance and give them the info to file it under the other drivers claim, granted it was the Friday of Memorial Day weekend so they say I won't hear anything til Tuesday. Tuesday I get a phone call that the claim has to be cancelled because there's an "issue" with the other drivers policy, and it's under investigation, so I now I have to file this under my policy. They deemed my car totaled, and not giving us what the pay off is. So now I'm out of a vehicle and a decent sum of money until it's paid off. (I know now I should've had gap insurance but I didn't expect this to happen) Now the past few days, my husband has seen the kid in the same vehicle driving around AND flying, rolling coal, etc in the same spot he totaled my car. Is there anything I can do? I'm pissed yeah, but I also don't want him to hit someone else and them be in the same situation as I am. Can I call someone and let them know this kid is driving around with faulty insurance? Thanks in advance!

Editing to add- this is in Ohio

Car accident advice please, opposing insurance rules I’m at fault

    Posted: 08 Jun 2021 10:00 PM PDT

Got into a accident at a no stop sign intersection in a residential area. I saw other driver slowed/stopped so I continued forward. She likely didn't see me because she was test driving that vehicle (dealership guy was in the car with her) and she had 2 A4 pages stuck on her windshield. She even admitted to the papers and not seeing me at all on police report. Other driver rammed into me right into my drivers door. I was to the right of her so she should have yielded to me. The street she was on is only 2 blocks long while the one I was on is connected to major street. Police report claims no one violated regulations and no fault could be determined. I just got letter from opposing insurance that it was my fault.

What should I do? Lawyers don't want to take my case.

Auto body misinterpreted amount being paid by insurance company in ny

    Posted: 08 Jun 2021 09:19 PM PDT

So My truck was hit by completely at fault driver who pushed my car into another car parked while both me and the other cars driver was not in it. Drivers insurance sent me check and estimate and I brought it to the body shop for the work to be done. The day the body shop told me it was done the guys insurance company called me and said he only had a $10000 which was used up by the other party that was hit already and I am only getting $900 (the amount the insurance company did in a virtual estimate, clearly a lowball) total out of the $3400 in repairs it cost me. The auto body shop guy said he misunderstood the adjuster while talking to her and didn't realize I would have to pay out of pocket and is trying to refer me now to use my own auto insurance to get involved to pay it. I would have never even of bothered to get it repaired if I knew I would have to pay out of pocket, am I under an obligation to pay the shop that did the work without notifying me there would be a charge? I do not want to use my own insurance because it may increase my rates and I don't even know if I have uninsured Motorist coverage.

I purchased medical equipment from a supplier, they refuse to complete form for insurance reimbursement.

    Posted: 08 Jun 2021 09:16 PM PDT

I'm trying to get reimbursed from my insurance for purchase of a CPAP machine. I have not had many dealing with insurance and I don't know if I'm going about this the right way. I have already purchased the equipment and paid for it out of pocket approximately $2,000. I am trying to complete my insurance form from AETNA.

AETNA needs part of the form completed by the supplier of the medical equipment. I asked them to fill it out and they say that they don't work with insurance. The form needs a signature from the supplier so I can't complete it on my own.

Any idea what I can do here?

Suggestion to convince them to complete the form?

    Thanks in advance

How aggressive are insurance companies on collecting?

    Posted: 08 Jun 2021 04:19 PM PDT

So my car was hit while it was parked and the guy didnt leave any note. It was hit by a car which is clearly owned by a major company. The collision was captured on security video and the license plate was visible.

But my agent said he couldnt find the insurance when he ran the plates and is now turning it over to their subrogation department. Im a little salty because I had to pay a lot in deductibles and car rentals but telling myself they will get the money back since they also paid a lot.

Out of curiosity, even if it takes a long time, how successful are subrogation departments? Ive heard of stories where they arent successful because the other guy doesnt have insurance or money, but this company definitely has money and I doubt fortune 500 insurance companies are cool just blowing off a few thousand dollars. I am hoping they don't give up at "their plates didnt run correctly, guess we will let <Major Broadband Provider> keep the 5 grand"

Can I use insurance claim money to fix my car myself for cheap and keep the rest?

    Posted: 08 Jun 2021 10:42 AM PDT

    Ohio

Went to shops to get an estimate for repairs and it turned out to be $2000 for all repairs.

Let's say I want to fix the car myself, can I keep the rest of the money and buy parts myself with that? Sounds fair because that's how much it actually costs to fix the car, it's not their concern if I decide to get cheaper parts right?

Driving again after insurance lapse/license suspension... how should I do this?

    Posted: 08 Jun 2021 07:16 PM PDT

    Hi friends,

Last year, COVID put me out of work, and I was in a really messy financial situation for a while. I couldn't pay bills, so I let my insurance lapse, and thus my license was suspended. I was also unable to renew my tag due to the lack of insurance (I live in FL).

My car (Toyota Camry) also happened to completely kick the bucket around the same time... when it rains, it pours!

Anyway, I've got things back in order and am trying to buy a used car (looking at a Chevy Malibu), reinstate my license, get insurance, renew my tag, and start driving again. Trouble is I have no idea what order to do this in.

I'm guessing I should buy insurance and reinstate my license first (I've read you need a license to buy a car in FL), but here's the problem — I'm going to junk my car in the next week or so, but I'd like to buy the Malibu ASAP. Is it possible to buy an insurance policy for the Camry, buy the Malibu, sell the Camry, and then call the insurance company to update car information a few days later? I'm guessing the rate would change.

Maybe I'm making this overly complicated... apologies if this is a silly query. How would you approach this?

Any advice much appreciated — thanks so much!

Speeding driver rear ended me on purpose. Because this was intentional, will his insurance over it?

    Posted: 08 Jun 2021 03:17 PM PDT

    Edit: I'm in Illinois.

tldr; speeding driver rear ended me on purpose to get me to move out his way, police found him, got his insurance info. because this was intentional, will his insurance cover it?

My boyfriend and I were driving down a semi-rural highway. It's a two lane road; one going east, one going west. My boyfriend was driving my car. The town we were in is like right on the outskirts of the suburbs. Because we were getting closer to the suburbs, traffic starts to "pick up". So instead of one-two cars on this long stretch of straight road, there's like 15 cars.

We were going with the flow of traffic; there's a pickup truck maybe 50 ft in front us and an SUV about 200 ft behind us. My boyfriend looks in the mirror and sees this sedan Subaru aggressively passing vehicles behind us. The car manages to passes the SUV and then guns it, going about 100mph, coming within inches of my bumper. My boyfriend speeds up to avoid a collision and tells me "this guy almost rear-ended your car". My boyfriend at first thought the Subaru might not have been paying attention, because who tries to rear end someone on purpose? I look in the side mirror and he is still riding our ass. But there is literally nowhere to go because there is a pickup truck directly in front of us, opposite traffic to the side of us, and we were about to approach a stoplight so everyone is preparing to stop anyway. The guy then speeds up again, rear ending my car. My boyfriend goes into the dirt shoulder and lets him pass us. He didn't try that shit on the pickup truck and instead aggressively passes him as well. My car is a smaller sedan.

I'm about to call 911 and my boyfriend tells me that at the stoplight, there is a police station on the right. We start to turn right and guess who also turning right? Subaru driver. He didn't get that far from us and he stopped speeding when he got on this street probably because of the police station right on the corner. I tell my boyfriend to not lose him because now I want to take pictures of his license plate. We follow him for maybe half a football field when a police cruiser turns out on the street in the opposite direction. We see that the Subaru driver is headed into a residential area and I assume he probably lives in the area so I tell my boyfriend to stop and flag the officer down.

Officer tells me I have to call 911, but comes and looks at my bumper and sees the Subaru license plate number imprinted on it. I have the 911 operator on the line who is really confused that the officer told me to call 911. He calls in on his radio a hit and run, calls for backup, and tells us to go wait in the police station parking lot. He then turned down the street the Subaru went down and we wait for 25 minutes. They come back, get our insurance and IDs, and tell us that they found the car outside of the owner's home, but the driver wouldn't answer the door so they left a note for him to call them.

We also went and found his car, took pictures of it and the vin number. His car is less than 5 years old, but has multiple dents and scratches everywhere, missing pieces, bumper is misaligned, and more. It seems like he flings his car into things quite often.

The next day, the police officer called us back and say that the man called the police back and was very "cooperative" and left a voicemail for him first thing in the morning (this whole incident happened at 1pm on Saturday). He went to go speak with him and the drivers' words are "I don't remember hitting him, but if the guy says I hit him, then I hit him." He gave the officer his insurance information and the officer sent it all to me.

I'm an internet sleuth so I decided to look up this guy and his history. This guy has battery charges, domestic violence, his ex-wife has an order of protection against him, divorce in 2019 from said wife, foreclosed home in 2017, a shit ton of traffic violations (no insurance, driving with a suspended license, speeding). This man seems unhinged and dangerous.

I filed a claim with his insurance and with my insurance. According to his company, he hasn't notified his insurance of anything. Also, in my state, they require each driver to fill out a form about the accident within 10 days. If you don't, they suspend your license. But this guy seems like he has nothing to lose.

My thing is, this didn't feel like an accident. This felt intentional and road rage (I didn't tell his insurance that though since he's claiming he can't remember anything about hitting us). So will this be covered by his insurance (who is one of those small insurance places that takes on high risk drivers) or will my insurance have to do everything and end up in subrogation with him? We got an estimate for about 2k right now and I would have to pay 1k deductible.

Can my friend drive my car for a bit during a 4 day road trip?

    Posted: 08 Jun 2021 06:55 PM PDT

So I have this car and it's insured under my parents insurance. My friend and I are wanting to take a 9-10hr road trip (20hrs round trip) and was wondering if she could drive my car and what would happen on the off chance that we end up in an accident while she was driving. My parents do not want to pay for damages and are insisting that she insures my car under her insurance. (Note: she owns her own car and her insurance is under her parents as well) Is that a thing?

Other potentially relevant info - I live in NC and am insured under State Farm - we also found something about adding her as a excluded driver but can't really figure out what exactly that means?

    Thanks in advance yall
