I have uncontrolled seizures, mental health issues and I am on Social Security. Throw away account because of pending criminal case against the person in the story, not my real name in first part of username. Background on issue: My mom and her boyfriend was drinking about a month ago and they both got into a heated argument, he attacked her and when I came rushing in to calm things down by being logical, he came at me attacking me and punching me from the kitchen to my room, knocking various things over and causing me leg injuries in both of my legs with pain that persists to this day (it's so bad I have to take prescription strength Ibuprofen and Tylenol three times a day). He then ran outside and pushed my mother down to the ground which made her hit her head on a bus-stop pole and he ran off. Neighbors witnessed the outside assault along with other people who were driving through my street (which is a busy one) and called the police. Police came, recorded statements both written and on body-cams. Took pictures of my mom's head and other things. My mom was transported to the hospital by ambulance and received stitches. My mom's boyfriend was given a bail of $7,500 and at first hearing as it was a weekday, me and my mom was given an protection order against him. My mom bailed him out with the assistance of a friend. He has since been staying here and they have been getting in fights almost nightly (mostly alcohol-fueled with him being the aggressor). My mom has been working on trying to get the protection order dropped and since there is one for me too against him, my mom is trying to force me to write a letter to his lawyer and go to court to get the protection order dropped. She says if I do not, I will have to leave the house. At least $300 of my social security check is paid towards bills on the house. I do not want to be apart of their dispute, they have a very toxic relationship as far as I can see but unfortunately this protection order has made me apart of it. I want to give my testimony on how he is an aggressor and deserves to have the protection order and whatever jail-time they give him but I know that if I do. The landlord is of the belief because my dad got vaccinated he is a danger to her and can't seem to be talked out of that. She gave him verbal notice this morning that he is being evicted and that vaccination was the reason why. The lease agreement was verbal so nothing written down to help but he's been there for over 2 years. I've googled a bit and confirmed she at least has to give him like 30 days I believe to vacate. Neighbors stole half an acre of our land Posted: 08 Jun 2021 08:28 AM PDT My family owns just shy of 3 acres of land in Georgia and we've had these neighbors for about five years now. In the beginning, they were just parking over on our side, which no one really minded. My mother (the property owner) was a little concerned when they placed an above ground pool on our property line, in between the two properties, but decided to let it slide because it just wasn't worth it. Then, as the years have gone by, bit by bit, they've been taking more and more land. It started with cutting the grass on our side, creating a property line that about half and acre over from the actual line. Our grass was getting tall due to our lawn mower being out of commission, and my mother assumed they didn't want taller grass near their side, and just let it slide. Then they began construction. They began clearing out trees, graveling to extend their driveway into our land, and creating a literal farm next door. We live out in the country and there's a cow farm right behind us, so the farm itself isn't the issue. However, they had begun using our land as farm land, erecting a chicken coup, a cow pen, and have started clearing out more area for goats. Their property is about one acre, according to the local tax assessor website. When this began, my mother immediately went next door and tried to speak to them. She said that she didn't mind them using her property, but she wished they had spoken to her first and not to place anything permananent on the property, as she was planning on putting up a fence (at this point, we did not know they had cut down trees and already permanently damaged the property). She was met with anger and they talked down to her as though she was stupid to ask them not to use the land. "You aren't using it" is their main argument. My mother isn't a confrontational person, but I am. We immediately got a survey to place property line stakes and actually learned they were using MORE of our property than we initially thought we had. We saw the torn down trees and noticed they have been dumping trash on our side behind an old barn we have. The neighbors harassed the men that performed the survey and as soon as they had left, ripped the property markers out of the ground and began moving them over to where they want to property line to be. Everyday, they keep inching farther and farther past the actual property line. We contacted a lawyer who suggested we send a certified letter, giving them a formal 7 day notice to remove all trash, clear out all of their belongings, and remove all trailers they have now parked on our property. If they do not vacate we can seize their belongings and officially bring them to court for damages (or at least, that is what the lawyer had explained to us). We have sent the certified notice, and the 7 day notice is up, but the neighbors have refused the certified letter. It has attempted delivery several times and they have not accepted it. We aren't very well off, but we have to get our land back. They have done so many disrespectful and down right mean things to us since this has started. Including hiding the metal rebar that marks our property lines. They drove it deep into the ground and dumped saw dust chips and trees on top of the line. We also know that when they don't see any cars in our driveway, they snoop around our property and even get close to our house. I don't have video evidence of this so I don't think I can actually use this in court, but it is incredibly jarring to wake up in your home and see people hanging out on your back porch and walking their kids around your front yard. My mother had taken my car for the day and it looked as though no one was home and that's when I noticed them walking through our yard and barns, looking around. As soon as I went to call 911 and ran outside to confront them, they snuck off back to their property and laughed it off when I followed them to confront them. Claiming they had lost one of their chickens and were just searching for it. We are in the process of getting security cameras up but again. We are just very lost and would love any and all insight to what we can do legally. We have given them notice and that 7 days has come and gone and what should our next step be? Suing my wedding photographer update Posted: 08 Jun 2021 08:11 AM PDT Original post: (Tennessee) I'll try to make this simple: I signed a contract with a photographer on my wedding day that states the photos will be given no more than 28 days after the wedding. I paid roughly a grand to her, and waited 2 months before asking where my photos were. She had a lot of excuses and she never got back to me. I contact her again a few months later and more excuses. I email her one more time a year after the wedding and give her until may 31 to give me my photos or I'm taking legal action. I didn't get them, so on June 3rd I filed a claim at the small claims court and paid $150 in fees. Today I got an email from her saying she found my photos and she'll have them to me by the end of the night. My question is, should I continue suing her or drop the case after paying the $150 to file it? follow up: Photographer has sent me the link through smugmug.com after posting on social media all of our conversations, warning others about her shady business. She sent it to me at 10pm last night. I have since received these last 2 emails from her. I still plan on taking her to court, but at this point should I hire an attorney? Surely she can't hold my photos hostage, the link is disabled now and I can't see the photos anymore. Her last 2 emails said : "So in case you haven't noticed, since I am the owner of the photos, I can control what I do with them. I've decided this can go one of two ways. You can sign a contract stating you will drop all civil suits against me, and you can get the password to your photos to freely download them all as you'd like. OR we can go to court, I file for defamation and emotional destress having to deal with all of this and having my personal information be brought up on social media. And we fight it out. You pick. I offered you your money back. I sent the photos. And you still want to fight me? That's fine. We can do this the easy way or hard way. " And: "You wanted your photos. County is arranging wage fixing [IN] Posted: 08 Jun 2021 02:01 PM PDT My employer just told me that all their competitors in the county have agreed, in writing, through the local Economic Development Committee, to keep wages between 100% and 125% of the county average "so that nobody can steal each others employees." Each company gets a tax break for signing the agreement. How is this not a no-poaching agreement and wage-fixing? What am I missing? Edit: Is it legal because the wage survey is being done through a neutral 3rd party and no participating company is given any information about any other specific company, only the average rates? If so, seems like a loophole. Who cares what any one other company is paying in a crowded market? All they would want to know is the average if all the participants are agreeing to stay within a range of the average anyway. I have a day job that pays minimum wage. I'm struggling financially so I'm always looking for extra work but it's difficult when you have a record. My boss knows this and also he knows I'm a good handyman so he hooks me up with people who need work done in their house or business. They pay cash. Usually it goes well. Maybe they pay less than agreed but they pay. Lately though I completed jobs at two different businesses but when the time came to get paid the clients told me to fuck off. They didn't give me anything. They told me that they won't pay, and if I'm not happy with that they'll call the police and report that I've been extorting them for money and I assaulted them and who do you think the police will believe. I didn't do any of this, I just asked politely for my money, never was violent. When they said that I got scared and I just drove away without my money. Somehow they learned that I'm on probation and I'm supposed to avoid police contact. If they go through with this things will go very badly for me and they know it. People trying to screw you is kind of expected when you're an ex-felon but here I'm talking about 8 whole week-ends of work, 14 hours a day some days. They still owe me over $4500. I've tried calling a few times but they won't answer. I'd like some advice on how to navigate this. I want to be paid but I'm scared that they'll falsely accuse me if I insist and I'll get arrested, which really mustn't happen. What's the legal way I can request them to pay and protect myself? While he was here, a piece of mail arrived to our house with our address but with his full name. It was from a big investment firm (Morgan Stanley). My wife asked her dad about it, and he was vague, only saying "oh yeah those will come periodically from now on, just let me know when they come." No other info provided. Naturally, I was pretty curious about why he'd do this. I then learned that about a week prior, he had opened a new Roth IRA account w/ Morgan Stanley. The account is in his name but with our CO address. The account's value is currently in the neighborhood of 250k, all equities (big company stocks) transferred in when he opened the account. So my question is, what's going on here? It smells like impropriety of some sort to me, but I don't know finance that well so I'm not sure what benefit he might be seeking to derive from using our address in this way. And I'm wondering from a legal standpoint what wrongdoing might be happening here; could it be a tax dodge of some sort? I don't want to be implicated in any way, thus my post here to try and figure out what the deal is. My coworker T and I don't get along, she's disliked me from day one which was 4 years ago. We have been the only two working in the office for over a year since neither of us can work from home. Last week our printer/fax/scanner/overly large machine stopped working, so she tilted it back while I stepped behind to check that all the wires were connected properly etc. The area is very cramped and I'm pretty tall, so I had to cram myself into a very small area to see the back of the unit. While I'm checking everything out, she said "oops", we made eye contact, she smiled, and took her hands off the machine. I had no time to move so my right foot was caught underneath the machine, breaking all of my toes and shattering 3 metatarsals. I've already had major issues with and 2 surgeries (6 years ago) on that foot from playing soccer in school. This injury affected the previous surgical repairs. There are no cameras in the office, so it's my word versus hers. She said it was an accident, her hands slipped and she is so so sorry. Wcomp says this is not a work related injury. I've appealed it, but I know full well the time it can take for wcomp litigation to process. I can't drive, as it was my right foot that was crushed. I'm looking at more surgeries and even more rehab. I have no way to pay for this, especially if they fire me and I lose the paltry health insurance. Management is leaning towards believing her story since she's worked there 2 years longer than I have. I don't know what to do, I don't have family in the area, rather on the same continent. She didn't realize this until yesterday when she went ito the office after being remote for the past year. This gifts totalled around $400 and there was a love letter included in one of the packages saying things like he can't wait to meet her in person eventually along with other personal knowledge of her interests. We were able to get the individuals name and address by getting the origin of one of the packages in conjunction with a name we received by tracking down the sales history on an invoice that he accidentally left on one of the packages. I understand that possibly nothing illegal was done, but my girlfriend is understandably concerned. She has no idea who this person is and doesn't have any mutual connections to them. The gifts and letter were rather personal in nature so this person has clearly done their due dilligence. What's the best course of action? Does this fall under stalking? Will filing a police report do anything? If this person can afford to spend 100s of dollars on a stranger, surely they can afford to buy a plane ticket and pay her a visit at her office. We paid for the car in full, have all the signed purchase agreement, etc. I have a "GM Customer Incentive Acknowledgement Form" signed by both me and the dealer where they itemized all of the incentives. I acknowledge I received the incentives. They acknowledge that the information is true and correct and they have been proved to the customer" I believe the difference is $1500. Can they do this? When I came back, the outdoor area where I & other tenants lock our bikes was repaved & my bike was missing. My neighbor said the workers just started cutting locks & tossing bikes with no warning, and only people who happened to be home at the time were able to get theirs. No one received any communication, written or otherwise. After several days of ignoring my messages, my landlord returned my bike to the laundry room, but it's definitely scuffed in places it wasn't, and I obviously need a new lock at minimum. I get it may seem like I'm not a team player, but it is unethical to ask someone to work during their free time for free. In the past, I have been willing to check emails and do small things to prep for the next academic year, but this summer I'm fearful I could wind up working a lot of unpaid time. First it's a 2 hour meeting, then they want to meet again next week. Now they want me to pick up 3-4 hours a week, starting now, to coordinate an event that will happen in October. About 3 days later, he told us he decided to sell the building and we could either use our deposit for June and be out by the end of the month, or pay June and use our deposit for July and be out by the end of July. I asked if we could stay and just rent from the new buyers, but he told me that he doesn't know who the buyers will be yet and he has work to do on the apartment before he lists it. All of this communication has been through text. The rental market in the city we live in is insane right now, everyone is struggling. My partner and I are both on Unemployment at the moment, and I have a 13 year old son. Trying to apply for an apartment on Unemployment is going to be nearly impossible, and the time we've been given isn't going to be enough time to save up for a deposit and first and/or last month rent for a new place. Needless to say, I'm terrified. We have been perfect tenants, have never paid rent a day late even once, keep everything clean and are quiet. I understand the market is great for sellers right now so I can't blame him, but I have a feeling this is going to drag on and be messy because we just logically aren't going to be able to find a place and be out in a month and a half. If I'd known sooner and had more time to look, it would have been different. This is a service that ive been told is legally required, but at the drop of a hat they have me pay between 5 and 50 extra dollars because I have to pay my bills. I already have to pay an extra 20 dollars just in convenience fees though my other sources. How is this legal at all? It feels like extortion. That $5 doesn't sound like much, but that's my lunch for a day. They're asking me to give up 12 days of lunch for no reason. I have two ideas right now, approach the leasing office with a standard check that was issued to me when I opened my bank account, or try to get past the bank surcharges. I live in AZ. Large bag was stolen off truck containing very important items, some irreplaceable. The theft was reported to police and they used street cameras and found video of the theft. I never open them and I always contact Amazon and the police when it happens in case said person is looking for them. Both Amazon and the cops said to turn it in, so I did. Today I'm notified that no one claimed the deliveries, so legally it's mine. I went and got the packages from the police and started to see what was in them. I open up one package, and it has $5k in cash in it. Legally it's mine now? Is it earned income? Do I need to report it to the IRS? Should I just spend it slowly and never report a thing. All of her accusations lies and nonsense. It all got thrown out. He just got a paper in the mail that stated "the defendants Ex Partr Motion is NOT WELL TAKEN and the same is herby denied." We have no written lease everything is verbal. A few months ago our neighbor complained the smell of pot was finding its way into her 9 year olds bedroom. I spoke with my roommate about closing his window, he smokes in his room. The issue seemed to go away but a new complaint has come up. With summer coming on I think my roommate started opening his window again. He is forgetful so I will remind him again as a warning. However she has also stepped up her rhetoric and has stated legal action is a possibility. The complaint has also changed. Now it mentions her not being able to use her yard due to the severity of the smell. She claims while pot is legal it has to be out of view of the public. She also claims to not only be smelling but physically seeing the smoke. On one occasion we had friends over and smoked in the yard. Not a common occurrence but in the future I would still like to have the option What level of concern should I have? My step mother would rather have me leave the home than get into any legal action but I would like to better understand the argument. I've been in the foster system for nearly 3 years, but here recently my mother has found a way to enter back into my life. She requested phone calls with me every so often, and without hesitation the judge granted her permission for it. I'm tired of hearing from my mother or anything to do with her, it's draining my mental health just speaking to her over the phone, let alone shes the reason our case hasn't moved anywhere. I have a job, school, new friends where I'm at, improving my grades and behavior, all since she lost custody of me. When knowing it's around the time to be on call with her I get really shaky, I clam up, feel hostile towards those around me, cry, and just break down mentally and emotionally. I don't want to have phone calls with her anymore. I'm always told I HAVE to talk to her or else the court will take action, but what can they really do? I'm 17, close to living on my own, graduating in a few months, and holding two jobs. On the other hand, she's not doing well. Drugs, abusive marriage, controlling, playing the victim card and pretending she was a good mother my whole life... I don't want to go back down that path while I'm doing so good. They leave there packages everywhere and upon running the tracking number it seems my last name continues to be the one signing for these packages. Which is not the case Last week we had an 86,000 dollar check delivered to a wrong business which had my name signing for it. Logistically speaking I am responsible for these packages and have asked for my name to be removed from this auto signature feature they have to no luck.
