    Today me and my buddies went to a local restaurant for dinner. It's Friday night, so it's pretty packed. We sit down, order drinks, an appetizer, and our meals. We get our drinks almost immediately, but waited well over an hour and a half for our food. Being impatient, we paid for the drinks in cash, plus a $8 tip, and left.

    Five hours later, I get a call from police saying the restaurant is accusing us of dining and dashing, even though we didn't eat anything. I explained to the officer that the waiting time was insane and we paid for everything that was served to us... only the drinks. The officer said he has to "write up a report and send it to the prosecutors office" and wanted my side of the story. I went further to ask him to check the video footage and see us pay, as well as the time stamps for how long we've waited...

    Are we in the wrong here? Are we liable to pay for the food we ordered even though we never ate it? "Dine and dash" penalties are considered gross misdemeanors in Washington state. I really don't want to get in trouble for this. Any help would be appreciated!

    I BCC my lawyer in emails with my ex regarding our 5yo child

    I have physical custody and we live far away (travel by plane required). When I send emails that are critical of my ex's behavior, my ex says that the emails are lost or has not received them. My ex then proceeds to send an email on a new thread with malicious compliance and/or totally ignoring my recommendations (my ex indirectly addresses the issues in the email by making it look like it came out of her and not the emails I sent), also setting me in the wrong light. My lawyer have been BCC'd in all of these emails and I have not notified my ex of the BCC'd.

    My ex has been caught lying in court several times (the judge knows lying is occurring but is not proved) and my ex also hires lawyers that the court have found to be unprofessional.

    My ex is making me uncomfortable and I feel vulnerable to the emails I receive from my ex. My ex has tons of privilege against me but I have proven in court our child's well being is with me.

    In the last email I sent I told my ex that further updates to her relationship with our child would be addressed through court motions and/or hearings, as we cannot agree on her behavior towards our child.

    Could it legally backfire not notifying my ex of the BBC'ing? Is my ex acting like emails got lost a good argument? Do I have to worry about my response?

    My ex has been showing pornography to our 8 & 6 year old boys.

    Both of my boys, each at different times/days, have randomly told me this in conversation. The older boy told me first, months ago, I reported it & nothing happened. Now, just last night, my 6 year old and I were on our way home (just us in the car) and out of nowhere, he says "whenever I ask Daddy to watch YouTube on his phone he puts on bad videos and I don't like it." I didn't probe harshly for more answers. Rather, I calmly kept the conversation going and my child just unloaded this heavy weight that he's been carrying around.

    My question is...other than making an incident report, what can I do legally? I live in California, have 100% physical & legal custody of my boys. What more can I do so this monster can't hurt my, or anyone else's children anymore?

    [VA] - Defended my dog from a kid trying to poison her, and now their parents are pressing charges against me.

    Jurisdiction is Richmond County in VA if it matters. Earlier this week I was at the local dog park with my Husky-GSD mix yesterday and suddenly a kid around 3-4 was running to my dog with a red bag in their hand, and since my dog is friendly to children I let the kid approach her to play with her.

    He then pulled a cookie out of the bag and tried to give it to my dog, and the moment that I saw that the cookie had raisins on it I immediately snatched it, without touching the kid, as raisins is deathly poisonous to dogs, which caused the kid to start crying, and their parents immediately raced to where we were.

    They accused me of assaulting their kid and threatened to call the police if I didn't give them my contact info, so I gave it to them as I was afraid of them going through with the threat. Earlier this morning I got an e-mail from a person who claimed that he's the parents' attorney and that I had to pay $350.00 to cover their child's doctor visits and therapy otherwise he would press assault and theft charges that could land me several months in the slammer.

    I have no fucking idea what to do here as I don't have $350.00 to spare since I'm a college student and I can't risk prison time as I'm pre-med and it could kill any prospects of a career. What should I do here?

    Apparently I have a restraining order

    [CALIFORNIA] So I got pulled over, and when the cop ran my license he came back and asked about my restraining order, I don't have one that I know of, and have never been served or anything. I don't even know who would get one against me. I told him this, and he said "that's what came up so I'm asking you". And I said I know nothing about it or even know how I would have one. Was he just trying to scare or bait me into saying something, or could I have one that I don't know about. Is there a way to find out if I do. Any help would be greatly appreciated, because this will keep me up all night. Thank you

    Recruiter lied and said I was hired, made me pay $235 for my own osha training, then later told me I failed my medical exam. Now I'm stuck with the bill. Also was threatened.

    Happened in Massachusetts.

    Just had a nightmare experience with a recruiting agency. Before getting an offer letter or finishing my background check, the recruiter told me "you're hired!" and that I was responsible for paying for my osha 40, and repeatedly tried to gaslight me by saying "everyone else pays for it". So I looked up the law and showed it to them.

    Lo and behold, right after showing them the law, they agreed to reimburse me with my first paycheck. Luckily I recorded the whole phone conversation, but still a hig mistake for me to agree to that. I get my drug test and background test done weeks ago then did my physical late last week. The following Monday, the recruiter asks me to start the osha 40 and finish by Thursday (which would take over 13 hours a day, and I dont even own a laptop or computer). I stupidly paid $235 for the course anyways, then asked if I had passed my physical. She said she wouldnt know until 3 to 5 business days. I didnt feel comfortable starting the course without knowing for sure I'd get this job. So I waited.

    She gets back to me Thursday morning to say I failed the medical exam..... Just one day after I can get a refund. It seemed intentional but who knows. I tried contacting her multiple times, which she ignored, so she blocked my number and email. Tried calling from *67 later that day, and her husband said "I KNOW WHERE YOU LIVE XXX, YOUNG MOTHERFUCKER". I've had bad recruiter experiences but this is unreal.

    How do I get my money back? The recruiting company is also ignoring all my calls and voicemails.

    Selling a house in PA. Contracted buyers began repair work without permission before closing.

    Closing is supposed to be next week. The house failed to pass an occupancy permit inspection due to a sagging deck, so our agent worked with the municipality to allow for us to close anyway. Then the buyers have 30 days to fix it before occupying it.

    The buyers formally requested access to the property to begin repairs before closing, which we denied. Visiting the house yesterday I discovered they had already hired a workman who had begun repairs.

    Additionally, a week before this the buyers (a family) had requested to remove the gentleman's name from the contract. Apparently they are divorcing and this was requested by their lender. We already agreed to that addendum. Not sure if that is relevant but wanted to mention it here just in case.

    I am very upset about them trespassing to begin unauthorized repairs before we finalize our sale. Do I have to worry about a mechanic's lien or any other worst-case outcomes? Do I need a lawyer? What are my legal options? Please advise!

    Is the executor of the estate abusing his authority by having two memorial services?

    My children's father passed. He and I divorced 10 years ago, but have remained friends. We all live in Pennsylvania. He had a will naming an executor and leaving everything to our children. A funeral took place days later, costing about $15,000. Due to COVID, only 35 family members and close friends were able to attend. The executor is now also authorizing payment from the estate for a Celebration of Life this summer in an outdoor setting so extended family and friends can attend and pay their respects. Expecting 70-80 attendees.

    Our children (teenagers, but still minors) are the only beneficiaries of the estate and I would like to know if the executor is overspending from the kid's coming inheritance. I don't believe there is much remaining, maybe $20,000 left in the estate (though I have been kept at arms length from financial aspects so I am not certain.) The costs related to the celebration of life include reserving the outdoor space, catering of food and an open bar, and invitations to the event. Is it appropriate for the estate to pay for both the funeral and this upcoming party? This could use up most of the money that is left. I don't want to upset a grieving family by questioning the use of the estate, but I'd like to protect my children's interests. Everyone my ex-husband cared for was able to attend the funeral. If it is more than is normally paid from an estate, I'd like to sit down with my children and make sure they are aware that this is reducing their inheritance and see if they think we should question these expenses.

    Abandoned excavator/legal advice

    I live in Mississippi. I bought a property in October. As per the contract the previous owner was to remove all debris from property as a condition of closing. We agreed they would be finished by December. They did not actually finish until late February. Their excavator has remained on the property. It is now May. I have a text massage asking them to remove the excavator from the property within the week at the beginning of April. They acknowledged in a response text. It is still there. They have cost me thousands since purchasing the property and I would like to sell the excavator that was left. I have spoken to civil court, judicial court, tax assessor, sheriff, a lawyer, and an equipment auction and no one can tell me the law to claim this property as it is not a titled vehicle. Does anyone know the law in MS. The lawyer believed it was 10 days after I inform them to remove it, in writing, certified letter NOT required, and they acknowledged kn writing--i can claim it. He cannot give me the actual law that states that though.

    Builder threatening to cancel contract for not signing change order allowing them to increase price.

    Our builder is threatening to cancel our contract because we're unwilling to sign a change order that adds verbiage that they're able to increase price to whatever they want at their sole discretion.

    I've read through our contract multiple times and nowhere does it say they can increase price. Unless it's an impact fee or imposed by governmental entities or an HOA.

    They could easily sell our house for $200k more than is in our contract if we didn't move forward. They've made it pretty clear they want us to back out.

    My question is does this specific provision give them the right to do so? "In the event buyer and contractor have unresolved disagreements about construction of the improvements, the contractor reserved the right to terminate this agreement" The thing is, we agree completely about the construction. It has been delayed over a year, but we've been agreeable to that and everything else that's been discussed. With the exception of this requested change to include the option for them to increase price. Does "construction" also apply to additions to the contract?

    I do want to add there is another section in the contract that says any changes must be mutually agreed upon by both parties.

    Are they just trying to strong arm us, or do we have a leg to stand on and fight back?

    I'm worried because the market has skyrocketed so much since we first signed our contract that we'd be priced out of the home we want to build.

    Rental company won’t fix washer

    Hello, not sure if this is entirely the right place but here we go.

    Moved into this apartment almost three years ago. Went through a nice company, they were very polite and prompt with maintenance. Then my building was sold to another company less than a year later-I was never given a new lease and when time came to renew I was only sent an option to renew the current lease through email. I must assume this company is still using the old lease. They seem shitty. They don't mow, they just raised the fee for being able to pay rent online, and I haven't even met anyone from the company.

    Anyway, The washer broke over six months ago and I submitted two service requests to have it fixed which were both ignored. I'm very lucky to have friends living in a different company's building next door who let me do laundry there - I guess everyone else who lives here just had to carry it out and pay a laundromat.

    My question is, do I have any argument for trying to get my rent adjusted because this service has been taken away? Does anyone have advice for going about it? I wish I could get it retroactively adjusted going back to when the washer broke but I haven't much hope for that.

    Edit: I'm in Illinois. Already planning on moving after my current lease is up. Unfortunately there's nothing explicit in the lease about laundry or the company keeping up anything in the building at all, actually. It only says there's laundry on the welcome packet.

    My Wife Hit a Dog While Driving: Next Steps?

    [TLDR: Wife hit a dog with her car. In no way her fault. What is her exposure to litigation? Should she file an insurance claim and a police report despite possible negative consequences?]

    California, unincorporated Sonoma County. Last night my wife hit a dog that darted in front of her on a state highway, at the very least gravely injuring the animal. She was not speeding. She called 911, who dispatched CHP and Animal Control. She also tried to get to the dog, following the animal as it struggled up the driveway of its owner's property. But the dog became more agitated and she withdrew back to her car. CHP showed up, followed shortly after by the property manager and the dog owner's daughter. (On the property were parked a number of trucks with the logo of a local landscaping firm, which enabled Animal Control to locate a contact, at which point AC left.) CHP said they could not intervene further (as in helping the poor dog) because they could not go onto the property. Turns out the dog's owner was on vacation, having left the dog unconfined (although, apparently, with access to food and water). After chatting with the dog owner' s daughter (and only then), CHP asked my wife for her license and insurance info. They advised further that they were happy to take a report, but that it would result in a point on wife' s driving record and increased insurance rates, apparently because as a "single vehicle collision" liability rests solely with her. Wife's car sustained minor damage to bumper, under-carriage insulation and windshield fluid reservoir.

    Issues: My wife was traumatized and is no way at fault for the dog owner's gross negligence. And yet, we're concerned that the other party will litigate. Should we file a police report, despite possible negative impact to wife's driving record? Should we lawyer up in anticipation of a suit? Can they really come after us for this? Thanks so much.

    Complicated transaction ends with me having an appliance for zero dollars

    I am in Tennessee.

    I bought an appliance two days ago, they delivered yesterday, and after it was installed I noted that several of the advertised features were missing from the unit. I went back to the store and spent 5 hours trying to get it resolved. After an hour of hushed phone calls and sales guys whispering with managers, they found that the part number they put on the invoice (and delivery paperwork) was one character off the part number I wanted. The part number I wanted was actually a few dollars more expensive. I was very frustrated when they said that they wouldn't match the price I was sold at, but eventually I swallowed hard and told them I'd pay it. When I got the receipt, I saw that it was actually several HUNDRED dollars more expensive (they had already run my card again). I said, "wait, this is not the difference we agreed to". More hushed phone calls found that there was a price match in effect for the part number I paid for originally, and while the correct part was a few more dollars according to MSRP, the price match made the difference much bigger. I went back and forth with the manager who held a 15% restocking fee over my head, told me his "hands were tied on the price", so not wanting to be that customer I tried to think outside the box.

    I'm going to be in the market for some other things soon; if I was to buy something else could you help me with that instead of the appliance?

    Of course! Not a problem! We'd be happy to work with you on some furniture. At this point I'm 2 hours into this (after my wife spent an hour the day before trying to buy this thing in the first place), so I quickly pivot to trying to be happy shopping for new stuff. This is a good solution for everyone, right? We found some couches we liked, and decided to go for it. The purchase process took an additional two hours as they called warehouses, fat fingered prices, failed to use the worst PoS system of all time, etc. In the end, 4 hours later, we had refunded my original purchase, a transaction for $300 more than we originally expected to spend, another transaction for the in stock furniture -$300, and another transaction for the out of stock furniture for MSRP. I finally paid and got out of there.

    Last night I just laid awake in bed thinking about how much money I spent, how much time I spent, etc. It didn't sit right with me. I decided I just wanted to call the whole thing off before it got worse. The cancellation process obviously can only be done in store, which only furthered my resolve to cancel all of the orders. I drove in, and in relatively short timeframe they cancelled the order for the appliance and both furniture orders and handed me receipts.

    Here is the crux of the story: I still have the originally delivered appliance in my house. I have spent a net $0, I have an appliance I didn't want, and you couldn't pay me to go back there. QUESTION: What is my legal responsibility with the appliance that I have been refunded for?

    TLDR: I bought an appliance, unintentionally went through a receipt shell game, somehow ended up with a free appliance.

    Surrender Dog I adopted listed as lost

    Looking for some insight on how I should handle this situation.. I adopted my dog last year (MD) after the previous owner surrendered him to a shelter and I had found him on their website. The shelter had surrender documentation and a filled out questionnaire by the owner attached to the adoption contract.) I recently googled his chip number wondering what would come up and I saw a lost and found two Facebook posts with a picture of the dog. The post mentioned the dog had been stolen, another post said it was taken to a shelter by a family member, people commenting on how horrible this is and I'm here thinking back to the day when I adopted the dog and he had bad skin issues, was overweight, fear aggressive and overall in a very skittish condition. We've since worked with a trainer, he's on a great diet and all his health issues have vanished with care and exercise. Now. The owner had posted their contact information and I wonder what to do. I know he has a better home with me. He's well taken care off, healthy, happy. What do it do? Can I ignore I ever saw this? His chip information has been updated to me from day one, the owner could have googled it as well and seen it had been updated. Tyia!

    "You have to charge us whatever the sign near the product says" NJ

    Liquor store in New Jersey. A trashy mother-daughter team comes in insisting we charge them roughly 40 bucks for a handle of Henny. I ask them to show me where they got it from. It's a display of handles of Henny with no sign, behind it is a taller stack of regular size bottles of Henny with a sign that says "38.99 Hennessy 750 ml). I explain to them the stack of handles simply doesn't have a sign and that the sign they are looking at is for the stack of 750 ml and it clearly says on that sign "750 ml". They insist that legally I have to honor that price because it was near the handles and the handles didn't have a sign. Sounds like a total crock of shit to me. I tell them I simply cannot sell a handle for almost half the price and they take pictures of the display and say they are gonna call the Better Business Bureau. Are they full of shit or what?

    My dad is going to kill my family some day, I'm certain of it.

    I figured this would be the most appropriate sub to post this on.

    I'm going to be blunt. I think my dads going to murder not just me, but my entire family. I can't prove it, but I have a very strong intuition about this.

    My dad is unstable with an uncontrollable temper. Just about anything can set him off into a chair throwing rage. He's gotten into physical altercations with us on several occasions. He's shoved me into walls, hit me, kicked me, and at one point he pinned me to the ground and screamed in my face saying if he really wanted to he could end my life right there. He didn't, obviously. But I believe him.

    I've witnessed him push my 13 year old sister into a wall and drag her down the stairs by her hair. I've had to physically pull him off my mom because he was trying to bash her head in with a wine bottle. As a son and brother, it's really heartbreaking not being able to keep the two of them safe, what's even more heartbreaking is that the person hurting them is the man who swore to protect them in the first place.

    The worst part is she can't divorce him, he said he won't go through with it and he'd kill us if we tried leaving him. One time my parents got into a heated argument, my mom grabbed us and tried to drive to our aunt's house to get away from him but he cut the breaks to the car so we couldn't go anywhere.

    Now that he's older he's not as aggressive, at least compared to how he was in the past. He hasn't hurt us or made any threats in the last couple of years. Every once in a while he'll get angry and throw something, but now he'll try to aim for a window and not our fucking heads.

    I honest to God think he's going to kill us some day. And I think he's planning it too. Even though he hasn't attacked us he's openly talked about how much he hates us and wants us dead. Not only that, but last year he bought a bowie knife, he wears it around the house and takes it with him wherever he goes. He won't say why he bought the knife, or why he loves it so much, but it's become a part of him now.

    My dad takes a lot of pride in that blade but everytime I see it I can't help but think that knife will probably be what kills me in the future. Some might say I'm being irrational, but seriously, what's stopping him from killing us? He hates us and wants us dead, he's threatened us and has come close to actually succeeding. All it takes is one final outburst to send him over the edge. So again, what's stopping him?

    I don't know what to do, I don't think the police would believe me if I told them. How would they even be able to help? I can't prove he's planning to kill us. It's just my intuition they'd think I'm crazy. To add to that, what if my dad finds out or they tell him? Then he'd know and he might actually hurt us.

    I just don't know what to do, who to tell, or where to go from here. I'm completely lost. Any advice on what to do would be appreciated. I'm from Washington State.

    How do I evict someone who isn't on the lease and doesn't pay rent

    There's a woman who was brought over to our house 4 years ago by a family member who wanted to help her. The woman doesn't pay rent at all and isn't on the lease. She does get her mail here. She's been disrespectful to us and doesn't contribute in any way. She doesn't want to leave at all because she pays nothing. I've talked to my landlord about the situation of her and he's afraid of doing something because the woman can sue (I think he said that there's lawyers who do this stuff for free or something). I've talked to someone who has gone through what I'm going through about having an unwanted person living with them and the answers I got was giving her an eviction notice. I tried calling the courthouse to do self help, but they seem very busy to respond sometime. I thought to come here to get help because I and others don't want this woman here anymore. How do I go about this? And is there a template for an eviction notice that I can give to this woman who doesn't pay rent and isn't on the lease to leave? I don't want to get in trouble with he law. I want to do things the right way, so that I don't get in trouble.

    Can a prevailing plaintiff in Massachusetts small claims court file an appeal?

    My former landlord never made interest payments on my advance deposit of last month's rent. After I vacated, he failed to meet the deadline to pay.

    The statute has two requirements in this case. First, my landlord must pay a 5% yearly interest rate because he chose not to keep the deposit in a bank account. Second, the unpaid interest must be tripled because he didn't meet the deadline to pay. MGL c. 186 § 15B (2)(a)

    Housing court ruled in my favor for my small claims suit. However, the magistrate clerk told me he would pick an interest rate he thinks is suitable based on historic trends, and noted that interest is low currently. The one-sentence judgement I've CC'ed to me isn't explicit but it appears he chose 1.47% interest.

    I have an appointment with a lawyer soon but I'm trying to learn and set my expectations. Do I have any right to appeal, as a prevailing plaintiff in a Massachusetts small claims case? I am anxious that the court could undermine our legislature's authority and my rights, but leave me with no possible remedy.

    [CA-Santa Clara County] Received in the mail NOTICE OF FAILURE TO APPEAR AND CIVIL ASSESMENT or public urination citation from 2018I did not commit???

    In April 2018, apparently someone used my identity and gave the citing officer my first and last name (mispelled my last name), the address to the property management/leasing office of my apartment complex., and a birthday that was not mine.

    This past March 2021, I received the mail a NOTICE OF FAILURE TO APPEAR AND CIVIL ASSESMENT from the county court\I filed a police reports about the identity theft and attached a copy of it to a letter to the courthouse expressing that I am willing to make a court appearance to contest the citation.

    Week later, they sent another letter to inform me they vacated the $300 Civil Assessment Fee but that I still have to pay the $281 fine by May/14/2021...

    My question is do I actually have to pay to go defend myself in court? Seems unfair to me but was hoping someone familiar with the county might help me understand my options here.

    Dog bites (in North Carolina)

    So around two weeks ago, my brother (23yo) was coming back from a walk around our neighborhood and was in our driveway when our neighbor's two German shepherds attacked him and bit him on both knees, the wrist and the back. My brother managed to fight them off and get inside, but he was bleeding from his wounds. I took pics of his wounds then and we called 911. We gave a police report and they sent an ambulance to take my brother to the ER. He received tetanus and rabies shots that night, and he's received a series of other rabies shots in the weeks since.

    A day or two later, my dad went over to the neighbors and showed them the pics of the bites. The neighbors seemed sorry but did not offer to pay for the medical bills (ER and shots). But my dad didn't explicitly ask for help with the bills; he said he just hoped they would offer. Should he have asked then?

    Anyway, the police talked to our neighbors and the sergeant gave us his number to call if the dogs get out again and he'll have them taken away. So another night my dad was getting out of his car after coming back from the grocery store and one of the dogs started running up our driveway and barking at my dad. My dad started yelling and the dog ran away before he got up to my dad. My dad called the sergeant twice but he never picked up. My dad got in touch with the animal control guy the next day, who said that he knew our neighbors and would talk with them. (The animal control guy was out of town during the original attack and apparently he's the only person at our town's animal control). The dogs were never taken away and my dad can't get in touch with the animal control guy.

    Fast forward to today, we've seen extra cars in their backyard and they are putting stuff in their trunks, which makes us think they might be moving. We think they are renting the house so it would be easier to move than if they owned it. Them moving is ultimately good for us in terms of us not being scared to go outside (we now bring baseball bats with us whenever we go somewhere). But we still want them to pay for our medical bills (which we haven't received yet). Like I said before, my dad never specifically brought this up with the neighbors. He is talking with a lawyer on Monday but idk at this moment what kind of lawyer. My main question is if we should go over there ourselves and tell them to pay for the bills before they have a chance to move? Or should we just handle it through the lawyer? Would us going over there ourselves potentially make this worse? And if they move, we obviously wouldn't know where they would move, but can lawyers find that out easily if needed?

    I really appreciate any advice you can give! I didn't know what to flair this but 'Personal Injury' sounded close.

    Still paying rent but landlord changed the locks

    Hi everybody!

    I live in CO, I am renting an apartment and my lease ends at the end of June. I moved out of this apartment a month ago but am still paying rent because my landlord couldn't find a new tenant (under our lease agreement, I am financially responsible until the end of June).

    She wished to change the carpets and repaint, so we agreed over the phone that she could come in and do the repairs in exchange for removing the weeks she needs of my rent. I don't know exactly how long they were doing work.

    I was wondering if they were done with the work so I tried to go in today, and discovered she changed the locks. I didn't know or agree to that, I didn't get a final walkthrough and I didn't get my security deposit back. She is still expecting me to pay for May and June, and hasn't so far given me the discount we agreed on.

    I really want to tell her off (and just stop paying rent) but do I have any legal basis?
