I have been working remotely since march of 2020, I am moving to another state and my employer wants me to resign. State is MA.

    Posted: 01 Feb 2021 08:52 AM PST

    Hello,

I am not sure how to approach this situation. I work in IT and my job has been remote since march of 2020 due to covid. My productivity has not suffered and everything has been great. My partner has a new position at their job that requires relocating to another state. I notified my employer and they want me to resign, probably because of tax obligations in another state. My boss does not want to lose me, but HR is pressuring me to resign.

Am I forced to resign? Or should I wait for them to fire me? Will I be eligible for unemployment in either case?

How should I create a paper/email trail to best protect myself?

Can my landlord force me to be exposed to Covid-19? [Dillon, CO]

    Posted: 31 Jan 2021 07:57 PM PST

    Not me, but my sister.

Landlord informed her today 1/31 that the tennent moving into their shared apartment tomorrow 2/1 has tested positive for Covid-19 and still plans to move in tomorrow. A hotel is way too expensive to go stay at for 2 weeks, plus she is the one who has been living there for 6 months so her leaving the apartment for 2 weeks is not an option. Does she have any rights to stop the girl from moving in?

Edit: Thank you everyone for the suggestions. I sent her the info for the Summit County health department. Hopefully she can get ahold of them before the girl starts moving in today.

I also forgot to mention my sister works in a doctor's office and this girl moving in will leave her unable to work as well.

Update: I know this thread is dying down. The landlord will not give my sister the new roommayes contact information. And the girl could stay where she lives. she just doesnt want to according to the landlord.

My manager said it's a fireable offense to talk about wages, I know that can't be right.

    Posted: 01 Feb 2021 08:55 AM PST

Just had my first meeting at my new job that I've been at for nearly a month and the manager brought up that it is a fireable offense to discuss wages.

"You will be fired." was the statement he made before noting that it was in the contracts we signed as employees. This really threw me for a loop because as the spawn of a lawyer I take it upon myself to thoroughly go through contracts of any and all kinds that I sign.

Some of the kitchen staff quickly chimed in and mentioned how it was illegal to fire or even simply reprimand someone for discussing wages, but the manager restated it's in the contracts and that he just didn't want any issues with people being upset about how much others might make.

I plan on trying to get a copy of the contract again (I know I should have asked for a copy when I signed, I'm kicking myself but I've had 5+ jobs over this pandemic so I'm pretty over it right now.)

Aside from getting a copy and looking it over, is there anything I should do? I'm planning on speaking to my father (the lawyer) soon as well but I know he's busy at this time.

Edit: apologies to everyone, I'm in the USA in CO. I also talked with a management recently, when he said contract, he meant the employee handbook and there was no statement regarding discussion of wages.

Can I refuse to take the store keys unless my boss gives me the keyholder position?

    Posted: 01 Feb 2021 06:34 AM PST

I work for a retailer in the "hardware" industry in Ontario, Canada. They are a huge company in the USA with thousands of retail stores, similar in Canada but not as big.

I have been working at my location since August 2020 and I am maybe the only PT employee who isn't in school or on an immigration visa so I can work the most hours. I also drive and live near by so I work early shifts often.

Every store has a Manager and an assistant who have keys, any other employee who opens or closes would be a key holder and get a raise to reflect that. In fact I initially applied to this company for a key holder position in another city but transferred mid application process to this non keyholder position instead because it was close to home. The keyholder job I applied for was offering $17 / hour. I get paid $15.50 including the extra pandemic buck for being essential.

The store has started scheduling me for Saturday's and Sundays open to close and has also asked me a few times to open during the week when manager have been out sick. Each time it s "one time thing" "just take the keys cause you need them this time". Neither of the managers ever work weekend.

I have asked my managers to make me a third keyholder and they say they are "working on it" and need to convince their managers that one is needed. I have been warned that if the district manager doesn't think we need one then I won't get it.

There is a lot of responsibility with being a key holder, our store is located in a rougher part of the city and isn't fun to be around at 7am or 9pm alone. If you don't need to be a keyholder to earn the responsibility of carrying the keys and locking up the building, why does the title exist?

Can I refuse to take the store keys without getting an official keyholder position(and the raise it comes with)?

What should I do now because my lawyer is dead.

    Posted: 31 Jan 2021 03:08 PM PST

Throw Away Account just to be safe!

    Hi All,

I am located in Columbia, SC.

A few months ago, I won a big lawsuit against my employer for discrimination and harassment.

However, my lawyer who was a 1 man firm, (with an assistant) recently died of Covid 19 (RIP).

My previous employer found out he died, and are now appealing the judgment, because they think they can win, I don't have a lawyer familiar with the case.

Please help, I am not sure what to do next, who do I reach out to. Can they even appeal, cause my lawyer is dead?

Can a previous employer send false info to a new employer?

    Posted: 01 Feb 2021 12:23 PM PST

I have been working for a company for 8 months and have recently found another job. I turned in my 2 week written notice. However today, I get a call from my future boss at the new company stating that HR from my old company contacted her stating that I have "quit without notice" and "walked off the job". I get this call while I'm at work at the old job finishing my 2 week notice. So this is a lie. I confronted my manager about this claim and she brings up my work while there stating I'm lazy and rude and she doesn't like me. Okay, I'm leaving anyway. That said, the new boss is now saying she needs time to contemplate my offer due to this "drama". WHICH IS A LIE. Is there anything legal I can do about this?

Also, my current employer found out where I was moving to because she checked my work emails and found my offer letter in my inbox and used that email to contact the new employer.

    I am in TN.

My father owns a home that his original loaner tried to illegally foreclose and sell to another loaner; our county and lawyers stopped this and we kept our home, but 10 years later the loaner who tried to buy the house off of the original loaner has their name on the title

    Posted: 01 Feb 2021 11:58 AM PST

We are in Denver, CO, USA.

We believe that the original loaner was in the process of selling the home to another loaner when Denver county denied the request. After lots of legalities, the house was returned to my father and we were allowed to move back in. This happened in 2011.

[My father has been thinking about selling the home since most his children moved out. He got an agent to help with options.]* What's strange is that the agent helping my father told him that the loaner who tried buying the house 10 years ago is somehow on the title, even though the sale was canceled.

How would we go by removing the loaner off of the title? Personally contacting the loan company? Contacting the county of Denver? I'm a little confused. Any direction would help a ton. Thank you.

    Edit []*

Unwilling to claim property as an heir

    Posted: 01 Feb 2021 07:51 AM PST

Hi everyone, first time posting and totally legally illiterate, so thanks for your patience. My mother passed away about a year and a half ago. She and I were estranged, and she had no will. As a result, her house was left to me by default as her kid - something I didn't know about until my uncle called me to tell me!

I spoke to the city code enforcement person because the house has just been kind of sitting there in relative disrepair (also accruing taxes). Now, to make a very long story short, I would prefer to leave the house to her brother, my uncle, so he can set aside some money for my young cousin. I tried looking through the NH forms of estate and stuff but my eyes crossed. Is there a painless way I can sign the property over to him? Is this something I absolutely need a lawyer for?

Thanks so much for your time. I appreciate any thoughts!

[NC] University threatening to press charges over pocket knife

    Posted: 01 Feb 2021 09:15 AM PST

I accidentally left my pocket knife on a bench in the mail room after opening mail. It was found by a university that staff member, but apparently the pocket knife constitutes as a weapon because it's just over three inches? I have a pre-hearing about the "incident" this Wednesday. Is there anything specific I should say or do? I'm risking expulsion and getting kicked out of the dorms so I'm freaking out.

My mom made me sign a contract when my grandma died, a week after I turned 18. I signed away my inheritance to her. I didn’t know what I was signing. Was I coerced? Can I get out of it?

    Posted: 31 Jan 2021 09:56 PM PST

EDIT: I want to say thank you so much to everyone who has reached out to me and commented and given me advice. My mom has emotionally manipulated me all my life so I wasn't sure if I was overreacting. You've all validated how I feel so so much, thank you

Okay— this is a long story. But I really don't know what to do so I would really appreciate any advice. Thank you <3

My grandmother died days after I turned 18. I was left a large amount of money (I'm not being vague on purpose, my mother won't even tell me how much it is) that is kept in a private firm. Days later, while I was still in mourning, my mom handed me a small stack of paper and said "I want you to sign this." I said "what is it?" And she told me "it's makes me a co-owner of the account your grandma left you. So in order to take anything out, we both have to sign on it and agree." I said "Why do I have to sign this?" And she said "Because of your age. You're young." (This turns out to be NOT what I signed at all. Please wait and keep reading!) I didnt ask any more questions because 1: my grandma literally just fucking died and I couldnt really handle the situation that was being thrown at me 2: it was my MOM. I made the mistake of trusting her because she was my MOM. I feel stupid now not having asked more questions, but I signed away. Until yesterday, I was under the presumption that if any money were to be taken out of the account (which mom still won't tell me how much is in there—it's a lot, I'm about to explain how I know— or even where it's held) we would have to have both our signatures on a check. A week ago, she asked to borrow some money so that she could renovate a house. She's a realtor, and wants to get into house flipping. I say sure! She says she's going to pay it back with interest. I say okay. She says to expect a check in the mail to sign So here I am thinking okay, I'm gonna get to see the check and see what she's taking out, and it's gonna need my approval because I'm 19 and the account was left to me, and we are co-owners of this account. But then today I ask "hey when is that check coming so I can sign it for you?" And she goes "oh I already deposited it." And I was like "Huh I thought it needed my signature?" And she goes "I thought so too but it was made out to me so I just deposited it and it went through" Already I'm like okay great. So she has total unmonitored control of the money my grandma left me. I asked her how much she took out, and she tells be SEVENTY THOUSAND DOLLARS. SEVENTY THOUSAND DOLLARS!!!! I've never fathomed owning that much money in my life. And she took it from me just like that. I didnt have to see the account or check or anything. I dont know what I signed, but she's got total control of the account now. She could be withdrawing anything now and I wouldn't know, so I'm kind of freaking out It's not even about the money or anything...it's just that she took the account from me enough by making me need her approval (oh by the way, days later she told me that that lasts until I am FIFTY YEARS OLD....) but now it turns out she can just take out whatever she wants, and I dont even know the first thing about the account. I dont know what to do. Can I get her removed as someone who has access to the account? I'm scared she's going to blow all the money and leave me with nothing. My mom isn't the best with her financials. I was trying to be nice to her by saying she could borrow money (again, under the presumption that I would see it first and that we had to agree) but now I'm nervous that she basically has the whole account to herself. I feel so betrayed by her, honestly I dont even know if I signed a "contract" necessarily or if it was just something that gave her control over the account. Am I legally bound? Can I take her off the account? I appreciate any input thank you so much for reading, please please help me

TLDR; I signed away total control of my inheritance from when my grandma died, which happened right after I turned 18. She didn't tell me what I was signing. I trusted her because she was my mom. She told me when I signed that it made us co-owners of the account, and any withdrawal would need both our approvals. But I just found out she took 70k out of the account without having to tell me. Can i remove her from the account? I feel betrayed and robbed Thank you!

Can I start a lawsuit against a police department for how they treated me after I was raped?

    Posted: 01 Feb 2021 01:22 PM PST

    Denver, CO

5 years ago I was raped by a man who I was seeing at the time. The only reason I went to go see him that night is because I wanted to end things with him. When we met up, he was like take off your clothes. That's when I said "no, I don't want to and I actually am done with you and this." He ripped my clothes off my body (tore them) and choked me until I almost passed out. He also took a video of it all, and I was screaming and crying "Stop, No!" the entire time. I won't go into detail but he penetrated me. It was rape.

It took me 2 days to gather the courage to call the police. We talked about everything on the phone and they seemed supportive. They sent officers to my house to talk to me after that.

These 2 cops show up and essentially harass me. They asked me what I was wearing, they asked me why I didn't just "get up and leave". I tried explaining that the guy who raped me weighed 100 lbs more than me and was 11 inches taller than me. He had me pinned down and was choking me the majority of the time. I could not move.

The police ended up not believing me and said that I just couldn't "handle rough sex". They said they were going to start the process of charging me with filing a false report so I would be sent to jail. I asked them to please just go to the guys house and look for my torn up clothes and the video on his phone. They told me they'd call me tomorrow and we will do more questioning and an interview with some company that talks to rape victims? They also said that I would have to hand over my phone tomorrow and it would be their property after that. They said if I ever contacted the man who raped me after the incident, that I would get in trouble and I should think carefully about what I wanted to do.

They left and never called me, nobody from the police department ever contacted me again. Few days later the man got a hold of me through social media and told me the police came to his house and took a statement from him and that it was such BS and so on.

I'm happy to provide more details for clarity but seriously. Is there a way I can start a lawsuit against the police department? There is NO fcking reason a woman should have to think about this for 5 years nearly every day. It breaks my heart and I don't know how to get closure. I thought I did the right thing and it all backfired on me. I wonder how many other girls in my town have gone through this exact scenario. This is fcking unacceptable. The police never did any kind of investigation. What can I do???

TLDR: I was raped and the police's response was that I was a liar and they were going to charge me with a false report. There was evidence and they wouldn't look into it.

There's a group of friends harassing me spreading rumors that I'm a pedophile and now recently are falsely accusing me of r*ping a child. But I never leave the house and am always at home.

    Posted: 01 Feb 2021 01:55 PM PST

I'll try not to leave out any details if possible. I'm 27 years old and I'll be 28 tomorrow.

I live in Michigan. I live with my Grandmother and Aunt and me and my Aunt take care of her together. I'm pretty much always home.

This harassment has been strictly online from people out of my state so I'm not sure what to do. I'm not the first or only person these people have harassed. But they normally lob people into their group chat like usual and just send people to harass them.

I'm not friends with everyone they harass, aside from one person but even that person confirmed that the main two people in that group I had a falling out with because they tried to cyberbully my friend are flat-out liars and do this type of stuff all the time.

But when it comes to actual court issues that doesn't really matter I don't think. I've ran into people who lie before who started this dumb rumor to save their own ass after they do something shitty and the only reason they came up with it is because when I play Fortnite I don't care what age the people who come play with us are so long as they aren't annoying or obnoxious. I always tell my friends how old they are and they usually don't care if they stay.

But its easy to try and push and that someone is a pedophile if you leave out crucial details and just tell people anything.

One of the individuals recently made an entire thread on Twitter about how I helped a minor who was struggling financially and met up with them and had sex with them with absolutely on proof. But the groupchat they are in has about 30+ people so if enough people retweet it then it can easily go viral.

Not only do I not work aside from selling my digital art and doing art commissions. I'm always at home. And even my online friends confirmed I pretty much never leave my house and when I do I go around the corner to get pizza and liquor then I go home. Or I'm taking my grandmother to a doctors appointment.

I doubt they're going to stop harassing me honestly. I started to catch on that a lot of their guy friends are extremely creepy and give me vibes that put their hands inappropriately on women because they were very aggressive, so I told them that wasn't okay and I started to cut them off. And now their trying to flip it to make it seem like I'm crazy or a liar.

I've tired to do what my friends suggest and "just ignore it" but the people I'm dealing with literally will start something over nothing just for the sake of it. This group of people are all in their early 20's and they always try to label someone as a predator or groomer or pedophile with no solid proof.

I already reported the accusations to my local police station because even though I'm 100% innocent I was told if absolutely nothing is on record then that just looks bad.

If I ignore them I'm fucked, if I say something almost no one believes me.

It's really frustrating. People already found my address and won't leave me or my family alone.

I got an expensive package, but I didn't buying/order anything.

    Posted: 01 Feb 2021 02:53 PM PST

Hi. My family said I received a package (USA), but I wasn't expecting any packages (I'm at my college apt right now, but it was shipped to my family home). I told them to open it after confirming it was in my name and address and they did and said it's from Dior, but I didn't buy anything. I checked my bank accounts and they're normal. There are several items. There are 2 packing slips/receipts. One that stood out to me is for a Dior scarf, and it says that it was loaned and had a due date of feb 5th.

The terms say, "Client understands and agree that risk of loss for the product(s) listed above and loaned to client shall transfer to client upon receipt. Client agrees to be personally liable for any loss or damage while the product(s) are in Client's care, custody and control. If client shall receive the product(s) via shipment, the client agrees that confirmation of delivery by Dior's preferred carrier shall constitute proof of client's receipt of the product(s) and client acceptance of these terms and conditions of loan."

The address on the packing slip is a legit Dior store location. It says the other items was paid using a Link Mastercard USC. I don't own any Mastercard's. Am I being scammed?? What should I do? Am I going to be held liable for all these items and the loaned scarf?

Is it legal to invest in the stock market for my younger brother?

    Posted: 01 Feb 2021 01:14 PM PST

My brother is 16 but is super interested in the stock market, and wants to start investing. I am 21, and he's wanting me to invest some of his money under my name just so he can see how it all plays out. I don't know if it's illegal since he's a minor? (We are in Canada) It's his money, but he'd transfer it to me and I'd be the one doing everything. I would love to do it because I think it's awesome how interested he is, and he already knows a lot for his age! I just don't want to get myself into any legal trouble.

2 large dogs attacked me and my 11 week old puppy. What can I do. Please help!

    Posted: 01 Feb 2021 09:33 AM PST

    Located in Norfolk, Virginia

Story: I was walking my dog ON A LEASH yesterday. The owners of the dogs who attacked us let them out of their front door with no collars or leash. The dogs immediately saw us and charges.

I grabbed my dog and held her as high as I could. The two dogs managed to bite her legs multipul times. She screamed in pain. I was scratched on my face, my groin area and legs. There was blood. The owner eventually grabbed her dogs. Put them in her residence and then closed her door. She said absolutely nothing to me. Did not ask if I was okay. I filed a police report as well as an animal control report.

Animal control updated me with the dogs being up to date on their shots. I am concerned with my puppy being scared of other dogs. As well as them being negligent and having aggressive dogs.

Can I sue and if so is it possible to even win?

Made an honest mistake when selling a car for the first time, don’t know what to do

    Posted: 01 Feb 2021 09:19 AM PST

    • sold a car for $1000 in November
    • got confused basically and didn't do a report of sale cause I didn't do enough research and thought it was the buyer and that the bill of sale was the same thing
    • guy who bought it rallied it and left it on the side of the road
    • got a bill for $2K from the towing company
    • I have a copy of the bill of sale

What is recommended that I do now? I know I made a mistake, I had never done it before and should've done more research into it before I sold. I just am really scared and don't know what to do.

Selling House While In Property Dispute Lawsuit?

    Posted: 01 Feb 2021 12:16 PM PST

In the middle of a property dispute where a neighbor is trying to claim that they've established a Prescriptive Easement over a portion of my yard that previously included minimal landscaping of theirs. They're suing me, but are representing themselves in a lawsuit that is ill-prepared and doesn't seem to make all that much sense (they're also suing me for trespassing on the portion of my own property that they're trying to claim a P.E. over).

I'm waiting to see what's going to come of the lawsuit, but am not super worried about them winning an actual P.E. over my property for the landscaping they had.

What would happen if I tried to sell my house right now, while in this lawsuit?

I Found an irregularity in our company's finances while going over the books, and found out an employee was being paid under the table with checks still, while collecting unemployment. Should I bring in a Tax Lawyer to see what potential issues are going to be created if this is found?

    Posted: 31 Jan 2021 10:28 PM PST

[WA] This week, while going over our books, before our company has a shift in ownership, I found out that one of our employees, was being paid the same amount every week for two months for "reimbursement". It just so happens that said employee is also collecting unemployment this entire time. While it is almost certainly tax fraud and potentially embezzlement on his side, what repercussions fall to the company due to this issue? Should I bring in a tax lawyer to go over everything? According to the books, we paid taxes on his checks, so I am confused as to how this has not been found or checked on by someone in the ESD or at the IRS. As a relatively young company, we can afford to pay any fines levied against us thankfully, but I am still worried about legal implications for all of those involved, which as of right now, seem to be someone in payroll, and the employee collecting unemployment and a payday. Is this grounds for immediate termination of the employee? Washington State being an "at-will state", is it smarter to just terminate them without context?

*Edit) Employee was working 30-40 hours per week. Making 450-650 dollars per week in compensation from the company. *Edit 2) A former employee once told me that said individual was not reporting his income correctly, I will take note of that and look at every single check written to the employee referred to in the post, and make sure we at least deducted taxes and mandatory deductions from these checks. If we did, our necks should be covered. *Edit 3) Based off of what the ESD website says about TAX FRAUD, and UI Fraud, it seems like the gentleman may be in deep trouble. Will no longer provide updates.

Mortgage Servicer Hasn't Paid RE Taxes

    Posted: 01 Feb 2021 11:55 AM PST

    In Illinois, Dupage County specifically

My RE taxes have gone unpaid since September, despite my taxes currently being escrowed by my servicer each month. I have been calling since October to get this resolved, but my taxes are still unpaid.

As of last week, my RE taxes were sold by the county. I was assured by servicer that they would take care of it immediately, and it it wasn't resolved by the Jan 29th, I should call back and try again.

I'm really sick of dealing with this. I have no practical recourse, because I don't choose who services my loan. And to change my provider, I would have to spend thousands to refinance.

Is there any legal recourse I might have to get this resolved? I just want my taxes paid, but if there is some sort of breach of contract that might get my entire mortgage cancelled, I wouldn't complain one bit.

    Any advice would be appreciated!

Hi, I'm a 24M and I want to move out of my parents. They think I am going to try and marry my fiance and she's gonna take me away from the family, which couldn't be further from the truth. I am graduated and back in school, I am actually waiting until marriage to move in with my fiacee, even if I move out. The problem is that my parents won't let me take anything. They wouldn't even let me have my cell phone the last time I wanted to move out, so I recently just bought a new one. When I was trying to start my own plan with AT&T, my mom walked into my room and harassed me saying that there's an emergency until I hung up, because the AT&T people couldn't hear me. Anything they bought, even gifts they won't let me take. I don't want to bring much with me, just really my laptop, some clothes, and toiletries. I know I am not legally obligated to give gifts back, so I am asking how I can use the law to help me with my situation. They even tried to take things from me that I legally own and believe they can claim anything that is in their house. I really need some advice.

Is my birth certificate, Social security number, and passport actually mine?

    Posted: 01 Feb 2021 12:25 PM PST

Recently graduated and about to move out, mother says that I can get my own copy of my SSN, BC, and passport if I want them. I had taken all of those out of a folder she has at a desk because I wanted them in my lock box in my room for the time being until I leave the house. I thought because they have my name on it that it would be okay and that legally they're mine.

Well she comes storming downstairs demanding to know where I had put them and demanded them back. I hesitated and said that they're mine. They literally have my name on them. But she said "if you want them, get your own copy. I'm the one that paid for them. If you want your own, buy them. I will always have these"

I dont know if this is legal or not. I don't know how well her argument would hold in a court. Should I just take them and let her know that I've taken them when I move out?

    Frivolous lawsuit for defamation

    Posted: 01 Feb 2021 01:51 PM PST

So I am involved in an online group that buys/sells and trades collectable art. It's a close-knit community and one very rich member is constantly stirring up drama, breaking rules, and just generally being a jerk to everyone.

Recently it kind of hit critical mass and many members are upset enough where they started making memes of him and just sharing DMs of hostile messages he has sent, suggesting he should be kicked out of the Facebook group.

Here's where I come in. I am an admin for another parallel group (kind of a gossip side group) and that's where other people have been posting the memes and making fun of the rich kid. I have only had one negative interaction with him personally and I blocked him after that. Now he is threatening to sue for defamation... because he acted like a jerk and people made fun of it. I doubt this would be taken seriously anywhere in court, but I also don't want anyone to sue me. I do not have the kind of money he has at his disposal. If this case is obviously frivolous, how much legal pain in the ass could I realistically be dealing with if he did sue me for defamation? Would it be easy to get it thrown out?

To my knowledge nobody is lying about him, just sharing some of the jerky things he has done to them and laughing about it. Also, it isn't me personally saying anything about him, I'm just an admin for the gossip group, which mostly means I approve new members. He is located in New York.

[Dallas, TX] Unwanted orders sent to our house constantly, no idea who's sending them or why and it's been going on since April 2020

    Posted: 01 Feb 2021 05:18 AM PST

Since April 2020 I've ve had various sports bras, a set of Marvel comic books, 20 packets of potato chips and 30 bottles of Diet Coke sent in boxes to our house; often they're sent to names like "Yuliya (Russian surname here)" "Caitlin (Irish surname here)" or "Arianna (Mexican surname here)" and no-one of those names lives here.

I'm a 43-year-old woman living alone and I've never ordered these items.

Not sure if I should go to the cops or not.

It's been happening since April 2020 and causing me non-stop upset.

Legally, what can I do to stop these being sent to me?

Why would my address be used for these orders?

Some of them have the Amazon logo on.

I've also had 20 wickedweasel bikinis sent for a "Arianna Ana Velasquez" but no-one of that name lives in my house.

How can I find out who's sending them and get the whole thing stopped?

[29 F Alberta Canada] Condo flooded through fault of my condo building & they ripped apart my living room and are not fixing it - should I seek legal counsel & do I have a case?

    Posted: 01 Feb 2021 01:28 PM PST

    Hi!

So 1 month ago there was water seeping up from under my flooring in half my living room (1 bedroom condo) & the condo renovation company came and promptly removed the damaged flooring which was half the living room and also half the drywall on the main wall. It was then discovered that water was leaking in from the outside through the face of the building (which has been a known problem).

Fast forward 1 month later and I have had barely any correspondence, no one will tell me what's going to happen with my condo just that they are doing testing to find the root cause. So I have not been able to use my living room, which they tore up and left, and it is the largest part of my condo. I'm told that construction will take at least 2 months on the outside of the building which means they won't fix the inside of my condo for a very long time. I called my insurance and they said it would all come out of my insurance + $900 deductible to live somewhere else in the meantime and nothing is covered by the condo company insurance. This is a huge inconvenience and been extremely stressful and difficult to deal with.

Would it help if I had a lawyer to get more information & get them to do repairs to my condo back to livable condition or for the condo to at least pay for my $900 deductible if I choose to live elsewhere?

    Thank you so much ,

    Adrianna
