Someone has made a false insurance claim against me (UK)

    Posted: 07 Oct 2020 03:57 AM PDT

    Hey everyone,

About a week ago someone made a false claim against my car stating that I reversed into them.

Now here's the thing, on the day the person made the claim is the same day I bought my insurance on my car, that is also the same day I purchased my car from the dealer as well.

The car is second hand and already had some minor scratches but no dents or damage to the rear. At the time of purchase (27th Sep) my dad drove the car home and left it there until I did my road tax which was October 1st. So I have not driven the car (nor has anyone else since I have the keys) on the day that they are making the claim.

I contacted my insurer and explained the situation, they told me to send photos of the car and any receipts that are associated with it. They sent an assessor the next day to take a look at the car, he thinks it should be fine but he did mention about the minor scratches on the rear. He took some photos and sent his report to my insurer.

Yesterday I get another email from my insurer saying that they need to wait on the third party insurer that is making a claim against me. I called up and they basically said that this could take a while.

I don't know how else to prove that I was not the one that drove the car, and that no one else had driven it since there wasn't any road tax on it at the time.

There isn't anything else saying where it happened on the document that I received from my insurance.

If this helps anyone I am from the UK.

    Thanks!

Insurance: Maximum allowable amount "changes daily like the stock market"

    Posted: 07 Oct 2020 12:25 AM PDT

Hi everyone! I am living in California and am having a hard time with my new PPO insurance Mental Health Network (MHN). I have been seeing a therapist that I treasure because she's helped me make a lot of progress with my mental health. She was in network with my previous insurance. I recently graduated and switched to MHN, which is provided through my job. My therapist is not in network. Due to the pandemic, MHN currently covers out of network providers ($0 copay) and when I called to confirm, a rep said I am fully covered and just have to pay my therapist in full, mail a claim to MHN, and wait up to 30 days to receive a paper check. I just realized that MHN has a maximum allowable amount (MAL) for services, so I called to ask them what the MAL is and provided my therapist's specific Current Procedural Terminology (CPT) code, zip code, license type. The first time I called the rep said it's based on what Medicare covers and estimated they'd cover $100, but emphasized it's just an estimate and I can't be sure until I pay my therapist, submit the claim, and wait up to 30 days for a letter from them. The second time I called a different rep said I don't need to worry and i'm totally covered until I mentioned the MAL then they confirmed there is one. The third time I called a different rep said the MAL "changes daily like the stock market" and estimated it to be $300. I am worried MHN will suddenly drop their MAL to $5 and I'll be stuck with a $95/session bill or ~$400/mo. Because it takes up to 30 days for them to get back to me, I'm afraid I won't realize the MAL has changed until a month after I've spent $400. I am also worried that anything a rep tells me over the phone is inaccurate since it seems to change every time I call them. I really don't want to leave my therapist, but the thought of dealing with MHN's inconsistencies makes me very anxious that I'll be spending money I don't have on therapy because I assume insurance will cover it. Does anyone have advice? Thank you in advance.

Do I need car insurance before I purchase a car? How do I get it?

    Posted: 07 Oct 2020 07:13 AM PDT

I've never purchased or owned a vehicle, now I'm buying one. How do I get auto insurance when I don't currently own one? Do I need to purchase a non-owner policy or will the dealership walk me through it when I get there?

broker (travelers) vs direct (GEICO, etc) pricing

    Posted: 07 Oct 2020 05:55 AM PDT

I bought a co-op in NYC a few years ago, and I ended up finding a local broker who arranged the homeowner's insurance via travelers. They were actually quite helpful, and it was a complicated / fiddly exercise getting a policy that met the requirements of the co-op board, the mortgage lender. At one stage, I got a slightly lower price through GEICO / Assurant, but I stuck with the broker / travelers since I had more confidence that policy meeting all the particular requirements.

Fast forward to this year... I've gotten a car + house (COVID / lifestyle changes), and their quotes for auto + house insurance are like *double* what I'm getting from GEICO. For the car, I placed it with GEICO and told the broker lets look again after six months, and the house I need to finalize in the next day or two.

I actually don't mind paying 5-10% more for better service than GEICO / similar, but it can't be double. Is this kind of price difference typical / normal? Do I need to shop around with other brokers / encourage this one to try harder/try more carriers, or do I just need to give up and get comfortable working with GEICO / similar?

Car Accident Pain and Suffering Settlement (Texas)

    Posted: 06 Oct 2020 12:26 PM PDT

First off thanks to anyone who reads and comments on this and provides any help.

This past Saturday, I was a passenger in a car that was rear ended. No extensive damage to the car as we know of yet, and my wife who was the driver is fine..

I on the other hand have back and neck pain. I went to the ER on Sunday due to the pain being pretty strong. I left work early and used some sick time to cover my hours. The ER gave me a diagnosis of a neck and back sprain, gave me a prescription and sent me on my way.

We contacted the at faults driver's insurance (state farm) right after the accident to start the claim. They've been working with my wife on all the car information and getting it set up to be looked at and all. No issue there,

Yesterday a rep from State Farm contacted me about my medical. After giving her all the information she said she would send an inital offer of $941. $750 for pain and suffering and $191 for missed wages. I told her to send me the offer in writing and I would respond at another time.

The issue is, I'm still in pain and trying to set up an appointment with my PCP to get looked at and see if any other treatment is needed (PT, other exams). This might cause me to miss some time at work as well. I also need a physical capacity form filled out for my employer.

What is recommended that I should do? Family friend said I should contact a PI lawyer. Just seeing what others recommend.

Update: My PCP is not available to see me until next Monday. I can't get any referrals and other way since my health insurance (HMO) only allows me to see my PCP.

Why does my health insurance keep pestering me to get an annual health check (separate from my annual physical)?

    Posted: 06 Oct 2020 07:01 AM PDT

I get my physical every year but they call and say they want to help me get a separate health check done by one of their contracted network physicians to ensure the info they have about me matches my medical records.

I asked if it was contractually required and they said no so I said no thanks. Am I hurting myself by not doing it?

I am on HMO HSA Plan doctor annual checkup free but lab test is not

    Posted: 07 Oct 2020 12:14 AM PDT

I was wondering can I get a lab test myself by ordering it online then bringing it to doctor and showing it to him rather than have him refer me to one before my annual checkup? Usually my insurance only covers 1 free annual checkup and lab tests are not included. If I do it myself it is much cheaper while the same exact test the doctor charges twice as much

Home Insurance Quote for New Construction

    Posted: 06 Oct 2020 01:01 PM PDT

My husband and I are getting ready to close on land and start construction on a new home. The land had a very small home in need of repair on it that has been torn down. The title agent is asking that we provide a quote (not actual coverage - i know we don't need that yet) for the home insurance for what the coverage will cost annually for the total assessed value of the new home. I tried online quotes but those still assume the old home is the home we are trying to insurance. We already have the risk policy in place for the construction period. I've called two agents and they are stumped about this request.

Is this a normal request? Is there some other way I should be asking for this information?

Edit - I'm in The United States, Ohio. Thanks bot!

Can adjusters communicate regarding separate claims?

    Posted: 06 Oct 2020 10:34 PM PDT

Hello insurance professionals! I have a rather unique situation I would like to get your input on. I was involved in two separate auto accidents within a short time frame. The first caused an injury and the second made that same injury worse. I am using my own UIM coverage for both of these and have been getting some weird vibes on how it is being handled. One of the adjusters (separate adjuster on each claim) has been communicating with the other and discussing the claims, seemingly to their advantage, by downplaying the severity of their respective claim relative to the other (ie. saying how the other claim was so much worse). This seems like a conflict of interest, as my knowledge of how these claims operate suggests that they should each be 'standing in the shoes' of the other driver's insurance company, and as such not have the ability to communicate and share details of separate claims.

Perhaps this is legit, and if it had been presented as a means of simplifying the process I probably wouldn't have as much concern, but it seems like the sole purpose of the cooperation is to my disadvantage. Thoughts?

    State is California.

    Damages by contractor

    Posted: 06 Oct 2020 06:44 PM PDT

I hired a plumber to change my sewer and water lines through the driveway. They should have gotten a truck to put dirt in. They mixed the cut asphalt and dirt and had to put dirt on the sidewalk and my retaining wall. The wall wasnt in the best shape. The excavator dragged the dirt off the retaining wall and probably was too law and caught the too of the wall forcing a section off.

The excavator (subbed) also caught the handrail of the stairs, but as far as i can tell there is no damage. The excavator was riding the curb and sidewalk and the curb sank and is inward.

They say that whomever ripped the street open 11 years ago cut the curb and didn't repair properly. Said he would take pictures to file claim, but said he doubts anything will happen.

I will owe another 50% of the payment most likely tomorrow.

My thoughts are I should not pay until they make repairs.

Thoughts? Is there a better forum to post?

Truck Marked as total loss being Undervalued

    Posted: 06 Oct 2020 10:09 PM PDT

My truck was totaled (other party/ insurance took total fault) but I believe Gieco is under valuing my vehicle. They're estimate of its worth is at $2,000, however, Nada list the low at 3,125 average at 5,050 and high at 8,050. On KBB all the ones I could find were in the 3-5 thousand, but those were all from different states. My truck is very high mileage though. If anyone has tips on how/ if I could negotiate for more I would really appreciate it, thank you!

Its a 2015 benz with only around 17k miles and really well kept clean title. How can i make sure i get a fair offer if they decide to pay instead of repairing?

    Homeowner’s insurance roof issue ...

    Posted: 06 Oct 2020 06:49 PM PDT

After renewing our home owners insurance, I realized that our policy lists our roof as only being 2 years old. The problem is, it's actually 20 years old.

I know I did not intentionally mislead the company on the age of the roof. I worked with an agent when I started the policy, and I distinctly remember them calling and asking "is it still the same roof on that house?", as though they knew the last time it was replaced, and I answered "Yes".

I would like to let the insurance company know the records aren't correct, because certainly if we ever need to make a claim they'll find out anyway and reject any claim. However, I took a look around comparing prices for other insurance companies, and it seems like I can't even get a quote on the house if I put in that age of the roof. So, I'm worried if I let them know I'll get booted from the insurance.

Is my only option to get the roof replaced ASAP, then let them know once it's new that the house is re-roofed? The roof seems to be in good shape, so if there is the option to do the replacement later I'd like to know.

    I am in Colorado, USA.

    Geico vs Progressive

    Posted: 06 Oct 2020 08:59 AM PDT

Hey everyone! I (23F) am in the process of getting my own car insurance separate from my parents. I have two recent accidents that I was not at fault for, but unfortunately have to disclose to insurance company (one was pretty severe, one was not). Because of my two accidents and my young age, I'm finding that my insurance is a little higher than my sister's (she's 28), which is annoying but the way the world works I suppose. Progressive has quoted me for $84/month and Geico at $74/month for my five year old car. Any good or bad experiences from either of these companies? Are there any other companies I should check out? Does this seem like a fair price for someone with my unfortunate driving history? Any tips on how much coverage I should get?

    Car insurance question

    Posted: 06 Oct 2020 06:35 PM PDT

Hi so I just sold one of my old cars that was on garage insurance for the longest time. I called my insurance company and they inform me that removing the vehicle would increase my policy by $200 because I earn a multi vehicle discount if I kept it. Is it illegal to insure a car that I don't own? Couldn't find anything online... i live in michigan if it makes any difference.

    Bad Faith territory?

    Posted: 06 Oct 2020 05:22 PM PDT

I apologize because this is really long! You can skip to the bottom to see my questions and you can look at my past post for more details if needed. I am located in NC.

We filed a claim with our home owners insurance a little over a month ago. We had a pipe burst that was fixed the same day that it was found and had a water remediation bring a dehumidifier that night. They found mold the next day and our insurance approved mold remediation that started 4 days after we filed claim.

We had nothing but problems with the remediation company. You usually hear how these companies do a lot of unnecessary work but we had the opposite experience. Our crawlspace had mold but there was no visible mold inside when they started. 10 days after our initial contact, the manager came out and I showed him that we now had a lot of mold climbing up the drywall in the sink cabinet, where leak occurred. They finally pulled the base cabinets off the wall and the subfloor was soaking wet and had some mold. Two days later they came back and cut out the bottom of the drywall and said they would come back the following day to pick up the dehumidifier. They did and asked me to sign a document that was not filled out saying I am satisfied and authorized insurance to release funds. I refused to sign the blank document.

Three days later, we called our adjuster to see when he would be coming out. He informed us that he would not be coming out and he would wright up an estimate based on the mitigation company's measurements. We asked him if we could move the moldy cabinets into the garage since no one else was coming out to inspect our property. He asked us to send him pictures of the mold (thinking we were mistaken) so we took pictures and sent them of mold on cabinets and floor. He called the company back out to take care of this.

The mitigation company came back (4 days after they "finished") and took away the moldy cabinets and scraped (?) the floor. I overheard them say something like "this puts the insurance company in a bind". I immediately text my husband bc it seemed like he was implying that we are at fault for them not doing their job. The manager of the mitigation company ended up cutting our valves off in the kitchen all the way back to the drywall (completely unnecessary) and admitted that when they turned the water back on our toilet "somehow" started leaking. Our toilet was actually leaking from the base (this was a major leak that wet the bathroom floor and went through the wall into kitchen) and on the other side of the toilet, it appeared to be leaking from the tank or bolt. I am 100% sure that there was no leak before he came and I know that he purposely damaged the toilet to give his company an excuse as to why our subfloor still had a high moisture level reading.

This was the final straw for us and we had our agent (who has been amazing and the only one trying to get things done for us) to initiate this to be investigated. We have mainly spoke to our agent because our adjuster hasn't been as helpful. We sent the adjuster pictures of our dry subfloor that was taken the day before they came. But never heard back from him after calling and emailing him.

We had an investigator call us 5 days after our toilet leak. We told her our story and she said that she would reach out to our adjuster and would be talking to an engineer. She was very nice and after that our adjuster called us the same day. He finally told us about saving our receipts (bc we had no kitchen) and mentioned something about a "he said she said situation". Which I find ridiculous. Mainly because it seems that our adjuster was only communicating with the manager of the remediation company and not with us unless we called him bc we had a problem.

The following day we went into the crawlspace and it was covered with large green mold. We sent the pictures to our agent and the investigator. We also called a plumber to make sure we did not have any leaks just to protect ourselves. He actually told us to check our water meter to see if the dial things were moving... which they weren't. We told him that we didn't think we had any leaks so he gave us this advice to save us the fee he would have to charge for coming out.

I believe 2 days later, we talked to a different investigator or maybe it was the engineer but he requested some pictures. We sent about 20 pictures of how the kitchen was left, mold that was left, and mold still in the crawlspace. We got an email a few days later from the engineer saying he had a family emergency and that he turned everything over to another engineer. Well we get a text yesterday asking about scheduling an engineer to come out on October 20th. They said this is the earliest day that they can come. We agree (what else could we do) but called our agent to try to figure out why we're having to wait so long.

Our adjuster ends up calling and saying something about trying to find someone else to come earlier and to get another mitigation company out to do an inspection. This all sounds great but we asked what the engineer is needed for then. He mentioned our laminate flooring. This is the first time we heard anything about the laminate and I could have misunderstood but it sounded like the engineer was coming to check to see how/when the floor was damaged. To me it clearly seemed like we were being investigated about damaging our floor after the mitigation company left.

Well luckily, I have about 1000 pictures from this ordeal. I sent pictures of the laminate. I have a picture of the laminate from the very 1st day (of mold remediation, 4 days after claim filed) that the company was there to work. This day they set up the plastic things to seal off the entrances and they put tape on the floor. I have a picture of the laminate being cracked under the tape that they put down. On the other side (we have 2 entrances) I sent a pic showing the laminate underneath the tape lifted up. The tape caused the laminate to delaminate and lifted/separated the top of laminate. I sent multiple pics and on different days showing the laminate. I even sent a pic of the chunk finally breaking all the way off still with the tape on it (which occurred 7 days after they started). That piece stayed in the same spot for 3 more days until the mitigation people threw it away... so there is no way they didn't know the floor was damaged.

**So key points: - we initiated the investigation because the mold remediation company did not actually remediate/remove mold.

    • Mold remediation company caused a lot of damage to our property

    • Mold remediation company purposely damaged our toilet to cause it to leak and told the adjuster we had a leaky toilet which I believe they tried to suggest is the reason we still had a high moisture level in subfloor in kitchen and caused mold (which seems pretty impossible to happen since it had only been 3 days since mold remediation was "completed") we took pictures the day before on what appeared to be dry sub flooring with our moisture meter level reading high

    • Mold remediation manager said that the adjuster would come after he was done (from the beginning). So the adjuster never mentioned to us that he was not coming out until we called him 3 days after remediation was completed. The mold remediation manager also didn't seem to know that either because they didn't take any measurements until they came to get the moldy cabinets after the job was said to be finished.

    • Our adjuster had very little contact with us from the start. We called when we had issues with the remediation people and he did contact them quickly. No real complaint for the adjuster about that... this was our first claim and we didn't know what to expect but he always answered when we called (at first which was like a total of 3 times) didn't become unhappy with adjuster until we found out he wasn't coming out and left the remediation company in charge of sending over info on damages... which they apparently did not know this either.

    • We made complaints about the remediation company several times and the adjuster made them come back out to pick up the cabinets that he agreed was covered in mold

    • We were refused an invoice detailing what they did. So I refused to sign off on the blank document they asked me to sign saying I was satisfied with the work and authorized insurance to pay them. (I read the paperwork they gave me that was for someone else but when I told them that was not mine, they tried to get me to sign a blank one). I didn't sign but believe they have been paid.

    • Knowing the remediation company did not do their job since he made them come back 3 days later, our adjuster still did not talk to us (until after the investigator talked to him the following week). We know that our adjuster talked to manager of the remediation company though the same day as the toilet leak though.

I want to make it clear that we did absolutely nothing to cause further damage and we have taken pictures of everything from the beginning. I took pictures everyday after the remediation team left and documented their progress and damage. After sending pictures to our adjuster of the laminate he actually responded back asking if we would want to use one of their contractors and we politely declined, which he responded "LOL, I understand".

So I am confused on if it's a he said she said situation, why do we still have to wait on an engineer after showing him that the laminate was clearly damaged the first day that they started. To me, it is clear that the laminate was pulled up (as the pictures show) from the tape they put down. We are the ones that initiated the investigation but it seems that we are the only ones being investigated (which is fine, we have done nothing! But can it go a little faster!?)

My biggest complaints at the moment are:
    • Having to wait 45 days after the claim was made before a engineer can view the floor. We have no other info of what to expect or when to expect it. Our claim, I guess, has not been approved or denied. There is absolutely no reason our claim should be denied.

    • We are having to pay a lot for TV dinners and to eat out everyday because we don't have a stove or kitchen sink. Luckily we have money to pay for this at the moment but we have already been doing this for weeks! Just doesn't feel like our insurance company cares at all about us or the situation we are in.

    • Our adjuster seemed to communicate more with the remediation manager than us. That just doesn't seem fair because he is with OUR insurance that we pay for. If any accusation is made (especially after we already made one against mold people) does he not have a duty to speak to us about it? We had our agent (not him bc we could not get a hold of him) to reach out to the investigators.

    • We were refused an invoice and haven't been able to get one from our insurance yet either (it's been over a month since claim called in).

    • We initiated the investigation but it seems that we are the only ones being investigated. Our adjuster said that with everything he has seen it appears that the remediation company is in the wrong (duuuuuh)

    • Why do we have to wait 2 more weeks when I have provided proof (pictures and a video) that the damage in question was done 10 days before the remediation company left (if it's a question of it happening after they left!) I have a million pictures of everything!

    • Does a remediation company who is responsible for sending all info on damages usually include the damages they caused??.. seems like a conflict of interest!

    • I can't say we were aware of everything that comes with the investigation... I don't know but assume that this is the SIU? Does that mean, even though we initiated the investigation bc we were clearly being scammed, will our "file" or whatever be marked that the SIU was involved and we will come under scrutiny for the rest of our lives?? This is our first ever claim!

    • Once the engineer comes, that will be 45 days after initial claim (we have done nothing so I don't see what could delay us after their visit) but how long after for them to write up whatever and send it to our insurance company and then how long until we actually get our claim approved!?

    • I believe I have pictures that I can easily provide that shows everything... even pictures comparing the flooring around toilet before the leak and pictures of the flooring around the toilet after the leak (that they caused!) in my opinion, it is clear in the pictures that more of the flooring was cut out (even underneath the toilet) on the day that they came back for the cabinets! I have detailed notes of the dates and times that remediation company was at my home and what they did that day and also took pictures each day.

    • I don't see how the insurance company could believe anything the remediation company said considering they clearly didn't do their job and remediate the mold? I also don't know what pictures they sent and when the were taken. I have pictures that were taken each day that they came and have sent time stamped photos but have been limited on how many they want from me.

    • Why did the investigation seem to turn from them to us? We have done nothing and they can investigate away but I think it's ridiculous that we, the policy holder, is dismissed on whatever the remediation manager claims when (I believe) we can refute any ridiculous claim they make with the mountain of photographic evidence that I have.

*I would be grateful for any information or advice that could help in this odd situation. You can read my past post with more details if needed. I am located in NC. We do not have a lawyer and we have not hired a public adjuster. We are simply trying to get our claim settled so we can move on with our lives as quickly as possible.

Also want to add that I think this is a relatively small claim. I would think under $10,000? But I don't know for sure. Just wanted to put that out there.

Help! Lapse of coverage while I was rear ended

    Posted: 06 Oct 2020 04:11 PM PDT

Today I was in a very minor fender bender , in which I was rear ended at a stand still in a parking lot. It wasn't a real big deal, just paint transfer and a minor scuff on both parties, something easily buff-able so I wasn't really mad. Anyways, we exchanged our info and that was that. Later on I get a call from geico (my insurance) about a claim after she reports it to her insurance. No big deal, I talk to geico explain what happened but then I'm told I had a lapse in coverage due to non payment(I had moved from chase to BOFA and forgot to re add my new card to autopay) and my policy had been cancelled some days now. What do I do now? Will I have to pay even though she was the one at fault? Shouldn't her insurance cover her damages? I immediately restarted my policy after I found this out but was told by geico I wouldn't be covered for the claim. What do I do? I live in Los Angeles, CA

Upstairs neighbor's water leak caused water damage to my condo - is he responsible? (Northern VA)

    Posted: 06 Oct 2020 06:20 AM PDT

My upstairs neighbor's pipe burst under his kitchen sink (deemed a pipe he owns) and caused $7K worth of damage to my condo. The condo assn immediately handled the remediation but left my condo in need of repair. The owner upstairs (a straight jacka**) was remorseful at first and filed a claim with his homeowners insurance. But one month later they deemed they are not liable as their client did not act in negligence. My insurance company will cover but they say it's not their responsibility to do so - they blame the condo assn but since the cost is minor to them they don't feel it worth it to them to subrogate. They left it up to me to collect my deductible. Meanwhile my condo assn says the unit owner above me is responsible but will not prove it to me in writing - I cannot find mention of it in my by-laws. I went to my neighbor seeking reimbursement of my $1K deductible and he laughed in my face. ......it's one big circle - everyone is blaming the other party and I'm out of $1K. I am so frustrated. Anytime a water leak from my condo caused damage to the unit below me I immediately paid for damages, not questions asked and I only expect the same. Is it true that my neighbor is only liable for the damage to my condo if he acted in negligence?

    Homeowners insurance claim help

    Posted: 06 Oct 2020 03:50 PM PDT

All, I turn to Reddit for advice as I can't seem to figure out what to do here. A month ago I had a moderate house fire take place. I filed a claim, had cleaners come out and my kitchen is now gutted awaiting remodel. I received a check from my insurance company fairly fast. I tried to deposit it, as I need to pay down payments on some things such as counter tops etc. I have a contractor lined up to do the work. To my surprise I was told I can't deposit the check as it's also addressed to my mortgage lender (pennymac).

I called pennymac who advised I have to send a whole bunch of things along with my check to them, such as the adjusters write up, my contractors bid, a conditional waiver of lien, and a w9. Then it seems the money will be paid to my contractor.... this makes no sense as I need to pay for my appliances, counters, etc and now my contractor has all the power over my money and i??? I am beyond flustered as this will delay my repairs yet another couple weeks and absolutely complicate this already horrible situation. Does anyone have any advice or is this BS just standard procedure for the scumbag mortgage companies?

    Thanks in advance.

    Open enrollment and spouse question

    Posted: 06 Oct 2020 11:49 AM PDT

    Hi,

I have my "husband" listed on my health insurance through my company as my domestic partner. We meet all requirements of common law but I dont think that's recognized in California anymore or ever. Id like to list him as my husband/ spouse. We'd be filing returns separately. Can I even do that? My work has him listed as both my DP and husband but charging me the DP rate. Taxes aren't cheap with a $500/month plan. They reimburse me post tax and charge it as income...its expensive.
