Had to call CVS corporate office to complain about a pharmacist. She found out and is now withholding my medications out of spite. Need advice.

    Posted: 01 Aug 2020 08:37 AM PDT

Two days ago, I went to my local CVS to pick up a prescription. For the last year, I have been able to pick up my refills 24-48 hours in advance with no problem at all. This is so I don't run out of my meds and can take my first dose of my new script on the day that I would have been out. Simple enough right? well, this is where my story begins. This time, the pharmacist refused to refill my script and was forcing me to wait until I was completely out. I asked why the sudden change because I have always got my refill 24-48 hours early this whole time. She said that I never would have been able to which is a complete lie. I said check my records and look because it's always the way it has been. she didnt even bother and repeated that I would have never been able to do that.

Well, I went home without my new meds. Once I got home, I looked up the policy and indeed, it's company policy that I can indeed pick up my meds 48 hours early. So, I call them back and say, look, this is indeed company policy, and then she started to get pissed and told me to just go somewhere else then if I didn't like it. I called the CVS customer support group and told the support rep about this. The rep contacted the store and when the rep came back on the line, she said that the pharmacist has deleted all my scripts from their records at my request. Thing is, I never once asked them to do that. She was the once that said I can go somewhere else but i never even hinted that I agreed to that. They are now retaliating and refusing to refill any of my scripts because I had made a complaint. I called them this morning and the lady straight up hung up on me. I don't understand why this is happening and Ive never had an issue like this with a pharmacy ever in my life.

So, here I am all out of my very much needed meds and they are still refusing to refill my scripts because I inconvenienced them and now they are holding my health and scripts hostage. I don't know what to do or where to turn. Is there any laws that would prohibit them from behaving like this? it seems like their behavior is illegal. Is there any legal avenue I could take against them? Any advice on this topic would be much appriciated.

Giant dog, giant bite, giant mess

    Posted: 01 Aug 2020 06:34 AM PDT

Trying to keep it vague as we may be going to court.

I live in Ohio and I took my dog to a dog park last weekend. I have a giant breed and it was bitten by another dog. [Edited because my opinion, although unwaivering, is not fact]

I've called the dog warden and asked the owner to pay for the vet bills.

The owner states that it's only partially their responsibility as my dog went up to their dog in the dog park initially. The owner was throwing a ball for their dog to chase and my dog loves balls.

The dangerous dog, according to the owner, is very territorial and protective over it's balls and bit my dog. My dog yelped and tried to run away and the other dog kept biting at my dog. The other owner states that they won't pay the full bill.

My question is - am I partially liable? Are they correct?

The dog park clearly states that owners are responsible for their dogs actions. The owner went back to the same park and now has a second case against the same dog. I have picture proof of the dog bite. There were other fields in the dog park the owner could have taken the dog to throw a ball for.

Please and thank you in advance for any legal advice you can offer.

I've never even met my dad but he applied for sole custody of me. Can I tell the judge I don't want to live with him (KY)

    Posted: 31 Jul 2020 09:00 PM PDT

My dad left my mom before I was born and I've never even met him before. I'm 15. Their divorce even happened without him there because he never showed up and he's not ever given my mom support. He just applied for sole custody and for me to live with him permanently. I saw the papers. But I don't want to live with him so will I be able testify that in court? IDK if my mom can even afford a lawyer

In my efforts to initiate a plan to ultimately win custody of my child from her neglectful aunt, I've just discovered that my 12 year old daughter is not biologically mine, through way of a private DNA test. I'm NOT on her birth certificate, and only I know the results. What are my rights in NY?

    Posted: 01 Aug 2020 06:22 AM PDT

Okay, so first of all, this situation has more layers than an onion. Let's start here: I already know that the DNA test results from the private laboratory are inadmissible in court. But my goal is not to utilize them for custody purposes. But part of me wants to confront the mother because of the HELL she put me through. It's been too long. The child is 12, not 2. So I cannot just walk away from this girl. I'm the only man she knows as dad, but I'm also not on her birth certificate because I had doubts when she was born. I'm wondering if a paternity test is required to add my name to her birth certificate, and if I should reveal the results to her mother's side of the family?

I have so many questions, but my biggest question is what do I do, and what CAN I do?

    EDIT: FOR CLARIFICATION

This is where it gets even more complicated. The child was the victim of a high-profile assault case in another state. In order to be present in the court proceedings against her assailant, I had to sign an acknowledgement of paternity, OR take a paternity test. I didn't want to wait for results, so I signed it, albeit in another state. Although this wasn't when she was born, it was when she was still a baby. Not sure how that changes things.

    Also, some things to note:

-I have never been married. Not to the mother or otherwise.

-The DNA test was PRIVATE. I used an out-of-state address to get it done silently, for my own curiosity before I started down this path. I got these results two days ago. That's why nobody knows about the results in NY State, where I know you can't OFFICIALLY get DNA test results without alerting the court.

-I live 300 miles away from the child. The main reason why I don't have custody was purely financial, up until this point. The reason the MOTHER doesn't have custody is beyond me. What I do know is that the aunt gets a significant amount of money each month because the child is disabled and she is acting as the foster parent.

-There was a CPS investigation. But it's irrelevant to the case because the child was subsequently the victim of an assault. In any event, placing the child with the aunt was meant to be a temporary measure until the mother got on her feet when she and the child moved back to their hometown (300 miles from me). This occurred just before the child's 3rd birthday. Currently, the mother lives in the same city and has not since put in any effort into regaining custody. She lives in the same city and drives a brand new car. According to the aunt, I visit the child more often, which makes no sense whatsoever.

FedEx Truck crashed into my Garage door

    Posted: 01 Aug 2020 05:22 AM PDT

FedEx truck crashed into my garage and damaged my BMW and knocked down my Harley Davidson motorcycle.

Significant damages to Garage/BMW and Harley. I cannot ride the motorcycle to Harley dealer to get a quote. Harley charge for estimation, the FedEx insurance won't pay that.

It has been a week, after 50+ phone calls estimates are happening for FedEx outsourced a company called ARC and they are in favor of FedEx and adjuster quoted very lower than dealer.

Significant evidences are available (Police, Fire, Building Inspector) and witness from the scene and photos.

I feel, it is very hard to deal with these folks to get something fixed, i was told it a month to two month process.

    Need some advise.

Mother might not let me pick up my daughters

    Posted: 01 Aug 2020 08:04 AM PDT

So, kind of a long story but I'll try and just keep it to the highlights.

I have 2 daughters, and their mother has had zero involvement in over 5 years. The first 3 years of their lives (they're 8 and 9 now) they were living with my parents while I got my life together. About 4 years ago, they moved back in with me. Because I was a working single father, during the summers, they used to go back to my parents in Oregon for 3 or so months every year. Well, this year with COVID happening and schools shutting down (as well as the fact that I had another daughter with my new wife at the end of Feb) they ended up going back to my parents in early April instead of waiting for summer to start. I just talked to my mom earlier today about the date I'm planning to come get them to bring them back. She's now saying that she will not allow them to come back, because she believes her homeschooling them is safer than them coming back to CT and going to school here. Can she really prevent me from taking them if she takes a hard stance on this?

The one thing that worries me is back in around 2015 or so I signed a letter granting her guardianship so that she could enroll them into school initially. This was not a court document, rather just a letter that I wrote and had notarized. However, since then, they've lived with me, went to school in the states I lived (PA and CT - whereas they live in OR).

What's the best way to do this if she is adamant that they will not be allowed to come back, or she decides to get a lawyer to try and fight it?

Can my landlord turn a single family, home into a multi-unit home after we signed a lease?

    Posted: 01 Aug 2020 06:22 AM PDT

Wyoming. Interesting situation here friends. 5 months ago we toured a single family home. During our tour we were informed that we would be the only tenants on the property but part of the property has always been used for storage by the owner (basement and garage). Fine by us, we signed a lease to move in August 7th

Yesterday we were informed over the phone that renovations were occurring to the home to turn the previously uninhabitable basement into a second unit on the property. It is the owners intent to move another tenant onto the property during the time of our lease.

We had no intent of signing a lease for a single unit of a multi-unit home. The space was advertised as a single unit home when we signed the lease. No second unit existed at the time we signed the lease - it was never communicated at any point during our leasing process we would be sharing the property and/or common spaces, or that it would become a possibility.

There's nothing in our lease that would indicate we rented a single unit of a multi-unit home.

We are pretty frustrated - we were looking forward to having private use of the yard for ourselves and our dog. We leased 5 months in advance due to how competitive the market is. Now, it's too late to find a new place.

I'd love some legal advice - are we within our rights to take legal action if they add this undisclosed unit to the property & move someone in during our current lease period? I would assume their actions would be breaking our current lease as they have significantly changed the nature of the property we had leased.

I'm also hoping to understand the legal value of this situation so that if they accept a re-negotiation of lease terms, we have an idea of how much leverage we have at the table.

Friend's boss forcing her to do services that are illegal under the Ohio Medical Board's current covid19 guidelines and bulldozing any concerns she raises

    Posted: 01 Aug 2020 11:30 AM PDT

This is in the US in Ohio.

My friends works as a massage therapist and is very good at her job. She has genuinely helped a lot of people with mobility and pain issues, her regulars adore her and she otherwise loves what she does.

However, since the pandemic, her boss has revealed herself to be one of those that think masks causes CO2 poisoning and your immune system to fail (because apparently you need to be licking doorknobs all day for it to still function but whatever) and is pretty vocal about thinking it is just a flu. She is very dismissive and acts as if the whole thing is a joke. Since it is a spa and the Ohio State Medical board is making certain things required to stay open she has begrudgingly worn a mask when around clients (only started doing it more strictly because a customer brought it up at some point that they were concerned/confused when they went to schedule something and someone had taken theirs off) but everything and anything else has been a fight for her to even read the damn guidelines.

My friend asked about the aprons when they were discussing opening because they were in the rules and her boss laughed at her and said that was ridiculous and asked where it said that. My friend sent her a screenshot of the publicly available document with the part circled for her and her boss ended up messaging her privately to tell her not to say those things in the group chat because some of the other employees might report it or have issues with them not wanting to follow it. She makes jokes at my friends expense about her wearing a face shield, apron, and mask and even tried to tell her to stop changing the aprons as much (between clients) because it was too much laundry (she still does change them but now takes them home to wash them and bought her own since her boss wasn't quick to get any that actually did the job). There are quite a few other things she brushed off but that should give you an idea.

Now her boss started doing couple massages again (aka two massages at the sane time in one room and two therapists) and while at first she just did them herself with the other therapist who was willing she is now scheduling my friend for them instead when she isn't able to. She even asked my friend in front of the client she was scheduling if she would be okay with it and knew she put her on the spot and my friend is a pushover/scared of confrontation. She now has more scheduled and even the secretary is in on it and scheduling these when she has told them she doesn't feel comfortable and doesn't want to lose her license. She is scared to go against her boss since she isn't exactly professional and unbiased when it comes to dealing with people that don't go along with what she thinks. Plus it pays well and she would be unlikely to find another job like that since she is also limited to location due to a disability.

She is also afraid of losing her license since she was tricked into doing one by not disclosing it was a couples until they literally started. She is feeling defeated and scared about everything since she is also high risk but no one seems to listen to her. I don't want my friend to lose her license but I also hate her boss just bulldozing her and exploiting her shyness since she knows my friend is one of the best money makers there. What do I do? What can she do?

I don't know how to report it without risking my friends license and I don't want her boss to turn on her by her doing it herself. Please help. I need advice.

I also don't want her boss or coworkers finding out about this so yeah..

Edit: another idea of what her boss is like is that despite having a lot of elderly clients that frequent her business (and she works with herself) she is flying to Florida soon for vacation, not going to quarantine when she arrives or returns and doesn't intend on packing a mask. And she has been boasting about this too.

She also teases my friend and calls her "everyone's favorite welder " and constantly talks about her views in her presence despite knowing full well my friends stance, the legal risks, and how she is belittling anyone who takes it seriously (aka my friend and the clients she cares about).

Edited for clarification now that I was able to talk to my friend about this post.

Is it considered assault if a relative/parent/guardian rips out a minors piercing?

    Posted: 01 Aug 2020 12:19 AM PDT

This might sound dumb but I have a friend (F17) who went forward with getting a navel piercing with her mom's consent. Her grandma who doesn't have sole custody but she lives with was very much against it despite any reasoning or argument (i.e she would pay for it herself, she would take care of it, she wouldn't show it off ect.) When she finally found out about it she went and ripped it out and told her that she got what she deserved because she had told her not to get it. My friend ended up going go the hospital to have her navel repaired and had a resulting infection and since then has resided at her mothers. Her grandma told her that she deserved all the pain she put her through. I don't know what kind of rights would help her out in this scenario but I'm pretty sure it counts as a form of assault.

    We live in Ohio

Edit: Thank you everyone who replied, sometimes as a minor you just don't know where to go or who you can talk to in situations like this. It's been drama drama drama for the past week. She told me she isn't sure she wants to report this herself as she feels her grandma wasn't trying to be malicious. Obviously not many people would resort to assault that results in major injury over a piercing so the "not trying to be malicious" sounds like a load of bunk to me. From what I'm aware of mom is going to press charges and is going to try to get full custody back as she's pretty upset by the undermining of her judgment and authority to go do/consent to fun things with her daughter and the overall assault. I'm (F22) so I'm just trying to look out for my friends in their time of crisis as an unrelated party.

I have a controlling mother that acts like she has full ownership over everything of mine, gift or not. What's actually mine?

    Posted: 01 Aug 2020 08:49 AM PDT

I don't really know all the legal stuff around gifts or not, I'm young and focusing on going into computers in college, but this is an issue I'm concerned with. I'm not sure what the best way to word this is, either.

I'm 19 now and still live with my mother, which is unfortunately the best choice financially despite how much I dislike her. Nearly every time we butt heads she threatens to kick me out of the house or smash one of my things, and if I get kicked out she says she will not let me leave with any of my devices.

    I have a phone, an iPod, a PS4, a Switch and a gaming laptop.

The phone was a gift from her, I haven't put any money into it, but I've had it for at least a couple years now.

I don't remember who paid for the iPod and how much but I've had that for more years than the phone.

The PS4 was paid for with grade/gift money from my great grandmother, over the years she gave me usually $50 a year for good grades not counting any holidays. The PS4 was entirely paid for using this about 4 years ago, and last year my great grandmother unfortunately passed away.

The Switch was paid for using my step-dad's money, he's not legally my step-father however he was in my life more than my actual dad and my mom and him were together for over a decade until COVID. I helped him out a lot last summer with some things and at the end of it he paid for the switch and the large case for it.

The gaming laptop was paid for using my stimulus check, but since I have no bank account it was deposited into my mother's stuff instead. It cost about $700-800 and the rest of the check was used for..bills or something, I don't know.

As far as I know none of my family use reddit, especially her, so I'm not very worried.

If I need to provide any more info to get better answers, please let me know.

My mom is being forced to go to work while immune compromised

    Posted: 01 Aug 2020 01:38 PM PDT

My mom works with kids with special needs at multiple schools. Our districts back to school plan says that the students parents can decide to let there students go to school or stay home, however all of the teachers (including my mom) have to be in the school building.

My mom received 2 doctor notes stating that she is immune compromised and has to stay home. She emailed her boss, but the district says she still has to work in the buildings.

This is messed up she, the school district is risking my moms life for no reason.

    Any legal advise?

Edit: we've taken all necessary precautions sense this all started, and I don't want all that to go to wast.

Should I call adult protective services? What are my options?

    Posted: 01 Aug 2020 04:44 AM PDT

Posted this in another sub and was recommended to post here. Thank you in advance.

Edit to add: I am in the US, Texas to be exact.

Sorry for typos I am typing this from my phone...

So my husband has a friend R who has Down syndrome. He is in his late 50s and was once upon a time he was his step dad. (Long story his mom is coo coo and a hoarder and stole a lot of money from R) anyways R has a conservativeship thru his boss at brookshires. R has worked for brookshires for 30 years and they were only giving him 60 dollars a week but his rent was paid and so on. But here is the kicker. R got sick a couple months back not Covid and now they just stuck him in his apartment and won't tell him anything and he is not getting any money at all he had to ask fish ministers to pay his rent. And all he wants is a hair cut and a belt. His bed is all tattered and sagging. Like wth! His apartment is all messed up too like his stove only has one burner that works, leaking sinks and holes in the floor. Should I call adult protective services? Is that enough to call and have them come? He does have a nurse come during the week. He said he called his boss to ask for a haircut and he told him that he wasn't working so he didn't need a haircut, and he is using a shoe string for a belt. I am going over there tomorrow to clean and help where I can and give him a haircut. If he could live here I would definitely let him my husband and I have been married less than 4 years.I don't know if the court would allow him to live with us because of what my mil did.

Add: my husband loves R and has always done right by him. Both of us have a spotless background.

How do you drop parental rights after being raped?

    Posted: 01 Aug 2020 04:43 AM PDT

Male rape victim forced to take DNA test 2 years after being raped and the mother keeping the child after almost aborting and trying to commit suicide multiple times. Child support would not let him file a Good Cause case because he is male. During his pre-trial hearing directly after getting DNA results (99.998%) the judge is forcing him to pay for birthing costs, court costs, backpay for child support, future child support (17%), and health insurance for the kid. The mother of the child has harassed and threatened him, his family, and his friends so much so that he had to leave the area he lived to feel safe. The mother also lives with abusive parents and does/sells drugs. She is often seen with random men in public without the 1 year old child. Child support refuses to help him and the judge refuses to take the rape, threats, or harassment into consideration. He is also disabled (receiving workers comp from a severe work injury), practically homeless, and has many surgeries in the future. This all occurred in Wisconsin. A rape case was filed with the police, but there were no charges since there supposedly was not enough evidence even though there were 3 witnesses (including one in the adjacent room that heard everything). Is it possible to get a different judge on the case? Perhaps a more understanding one? This all seems so unreasonable. Are there any laws that could help him drop his rights so he does not have to be a part of the child's life? It causes him so much pain and trauma to even think about the mother and child. Any help would be greatly appreciated as he is going through serious trauma and stress. Thank you!

Selling my house didn’t work out, now I’m inadvertently a landlord

    Posted: 01 Aug 2020 11:29 AM PDT

    Throw away account.

I am in Texas, Williamson county.

Okay, so put my house on the market, there was good interest. I'm financially in a bad spot and selling my house would allow me to be debt free.

In a week there's an offer. Their financing was in the in works and they would be able to close by July 27th. They agreed to pay a deposit and rent until the closing to move in on July 1st. I received the deposit and rent in full, money went through, all documents were signed, everything was on the up and up.

Suddenly there were "delays." Delays with getting the house surveyed. Delays with the financing.

Well, the 27th came and went and they were not approved.

A sob story about how the original lender was a crook and blah blah blah. Well, the contract said they had to be out if they didn't purchase the house. I gave them until last night.

Long story short, they aren't out and appear to have no plans of leaving. Utilities and bills and mail is now in their name.

My agent has contacted a lawyer he knows who specializes in eviction, and we are holding onto deposit and have drawn up paperwork they were sent saying as much since they knew they were unable to purchase the house but were uncommunicative and acted in bad faith.

I just want to know what my options are. I currently have my mortgage in forbearance, but I will have to pay that back eventually. My bills are such that I cannot afford them. It's literally why I was selling my house. It was sell my house and pay off my bills or file for bankruptcy. And now I'm sort of like I guess my options is "or bankruptcy" because now I cannot even sell my house with them in it.

My landlord and a maintenance man have now seen me butt naked sleeping in bed and I’m worried it will happen again...

    Posted: 01 Aug 2020 08:37 AM PDT

Let me explain this slightly embarrassing tale which leads to my question. I work graveyard shift and my landlord is well aware of that. My wife usually works till about 10pm or midnight. So we both sleep when most people are awake, during the day. Whenever we put in a maintenance request, we add that we will be asleep in the bedroom until 3pm as a heads up to them when they enter. We got a notice taped to our door last month saying they would be entering on such and such day to inspect the pipes and change the air filter, nothing else. I called the office and spoke with the landlord and told him that we would be sleeping and asked if they could simply be quiet when they enter if it's before 3 pm. Landlord said okay and confirmed they would only be in the bathroom, kitchen, and hallway to do what they need to do. Well, the day comes when they enter the unit. I had worked a double and I was knocked out. And my wife was actually at work early due to a call out. I didn't hear the knocking but in anticipation, also had left a note on the door at eye level, specifying I am asleep in the bedroom and asking them to be mindful. Here I am sleeping like a baby....AND SOMEONE UNLOCKS AND OPENS THE BEDROOM DOOR! I didn't realize it was not my wife until I rolled over and saw the landlord and a maintenance guy staring at me. I screamed numerous expletives and threatened to call the police on them since they shouldn't have entered the bedrooms in the first place. It's not like there's pipes in the bedroom. They ran out of there so fast. Since I was told they would not be entering the bedroom, I simply had my wife lock the bedroom door when she left earlier than usual to work a double and I slept in my birthday suit like I always do. And they can't say they had no idea someone was in there because I had fallen asleep watching tv in the bedroom so they definitely heard the tv. Fast forward to a week ago. We get another notice saying they will be doing unit inspections as many residents moved out(we all have the same leases; we renewed ours so we weren't moving like some others). I immediately call and ask if they would be inspecting units with tenants who renewed their leases for next year. They said yes. So of course I speak with the landlord again and ask if instead of giving us that 21 day window where they can enter any one of those days to inspect, can he give us a set day. He said no. I told him yet again we will be sleeping till 3pm and told him they are more than welcome to just come on our off days so we can avoid another naked sleeper incident. He basically said "we come when we come". Today starts their inspections where they stated they would come anywhere between 9 am and 7 pm so I left a notice on the door again basically saying to come back after 3 pm or on Sunday or Monday any time as that's our off days.

Sorry that was so long but I figured y'all might need the whole back story before giving advice. Now here's my question...If I lock the door using both locks(we have one you can't unlock from the outside), can we get in trouble? I'm just trying to preserve some dignity at this point. I live in Nevada, USA. Are there even any laws that would have protected me from getting seen in the nude asleep after notifying my landlord I would be in my bedroom sleeping in the first place and being told they were only coming in for pipe inspection and to change the air filter in the hallway?

Landlord took and cashed my $1200 stimulus check without consent or notification

    Posted: 31 Jul 2020 06:43 PM PDT

I got a payment trace from the IRS because I never got the check which was mailed in April. The copy of the cashed check I got from the IRS showed it was addressed to me at the right address but was missing my apartment number. My apartment number was handwritten on the front of the check, and under the endorsement it showed the name of my apartment building and an account number that is not mine.

I got no notice from management that they received or cashed this check, the money was not applied to my account, and I have no outstanding fees or rent.

I know I can file a claim with the IRS (and I intend to), but the apartment management opened mail addressed to me and cashed a check addressed to me.

Should I also file a police report? Should I report it to USPS? Does it matter my apartment number wasn't on it?

I'm really concerned they did this to other residents too. Is there anything I can do to help others or find out if it happened to anyone else?

[OK] Wife has been fired from schoolteacher job because students found old camgirl stuff

    Posted: 01 Aug 2020 01:26 PM PDT

    Oklahoma

For context wife spent the early '10s as a camgirl while and after she finished high school to help sustain her income. It's a part of her life she's put behind herself though not with shame just maturity and moving on.

Some students at the high school where she teaches found some old videos and photos from her cam girl days and spread it around the school. The school did nothing and has now fired her for this (she secretly recorded the conversation and has other proof) and we're trying to figure out what to do.

Surely this is blatant sexual discrimination? And certainly victim blaming. What can/should we do and do things look in our favour if we get moving? Ty

    Direct Express card fraud

    Posted: 01 Aug 2020 06:54 AM PDT

So my mom is a direct express card user. She lives on disability and has no other income, we NEED this money to afford living, literally. In the last few days, she's had over $700 in 3 charges fraudulently placed on her account. 2 of which are from a random military jewelry store two states over, and the other of which is McAfee. We do not and have never purchased anything from these businesses. When contacting the businesses, they can't tell us anything because evidently the charges aren't showing on their end? We've tried calling direct express for two days now and after being on hold for several hours, my mom's running out of cellphone minutes. Like I said, we need this money to survive. We have no idea how long it will take direct express to answer but we can't just keep putting minutes on her phone for nothing. Is there nothing else we can do but wait for them to answer the phone for hours on end while we watch our money literally disappear? This has been an absolutely miserable past few days with not a shred of hope so far. Any help would be a blessing. Edit: Tennessee residents

2nd edit: We've spoken to both companies which resulted in nothing, and are now going through the chain of command at Direct Express..

3rd/final edit: Got through to a direct Express supervisor and they hung up with us after putting us on hold. We're 100% fed up with them. We're gonna take out the rest of the money on the account and close the card, open a new account at a local credit union, and dispute all the charges. Thanks guys.

My mom is keeping donated money for my sister dying of stage four breast cancer

    Posted: 01 Aug 2020 11:05 AM PDT

    Located in Texas (Robertson County)

My older sister is 29 and has breast cancer (stage four) and is also epileptic and diagnosed bipolar. That being said she needs a lot of aid for certain things (getting around because she isn't allowed to drive for example).

Anyways, my mother manipulated my sister into thinking that she NEEDS a medical power of attorney in case anything happens. Well, my sister is completely gullible and believes anything anyone says, so she agreed and signed that right over. On top of that there was a huge fundraiser that went on to help my sister financially with rent and necessities since she is unable to work now. It raised over 10k. Well, my mom also persuaded my sister to let her out all the money into her bank account in a separate savings so that my mom can "make sure that the money is used correctly". She claims it's for legal reasons and because my sister is "unfit to make decisions herself" because of her mental illness.

Well recently my mom and sister got into a huge argument over the fact my sister wanted some spending money for her birthday and that ended in my mom saying "That's my money and what about me?! It's always about you!" And then my mom telling her to find a ride to chemo on Monday because she's done. So now she's trying to kill my sister by withholding her from chemo that she needs!!

What can my sister do to take the money that is RIGHTFULLY hers? I already have the paperwork ready for her to sign to take the power of attorney away from my mom, but she needs that money to survive. She told me she only has $20 to her name right now.

My landlord did not return our security deposit or give us an itemization of deductions and it has been exactly 38 days since our lease ended. I’d like to sue in small claims but need to know my rights, their rights, and how to start the process. In Texas!

    Posted: 01 Aug 2020 07:14 AM PDT

My boyfriend and I lived in a terrible apartment complex for a year in Bryan, TX and I read on Texas Property Code sec 92.107(a) that if you provided your forwarding address to the landlord before you moved out then the landlord must either return our security deposit or provide a written description and itemization of deductions on or before the 30th day after the date the tenant surrenders possession. Therefore yesterday on the 37th day I called the landlord and asked for a refund of my deposit. She immediately starts being a bully and makes up a lame excuse as to why we never got our itemization through email. She goes on to say "well you owe $748 so I'll send you this email now". They've had mine and my boyfriends emails on file for well over a year and our forwarding address for over 3 months. I read out loud to her the Texas Property Code section that I stated earlier in this post and she starts interrupting me saying that's only if I'm owed my deposit. Not to mention $750 for what?!?! We had no damages when we moved out and we cleaned EVERYTHING and we made sure to take pictures of everything because this apartment complex has been known to overcharge on "cleaning expenses" and "damages". So when I told her we will not be paying that and instead I would take them to court she said ok I'll give your complaint to corporate and your bill will be sent to collections. I need help on where to start this process of suing her and/or just getting my deposit back. Am I in the wrong for anything?

My Sensitive Medical Information From When I Was A Minor Is Online.

    Posted: 31 Jul 2020 10:56 PM PDT

Hi everyone, I'm new to Reddit but in the past few days I've come across something concerning and was wondering what recourse I could take. So 4 years ago when I was 14 years old my parents decided to place me in a boarding school/care facility for kids with High functioning autism, Emotional Disorders, Anxiety and the likes in Utah. This place was horrible. I could write a whole book on the abuse I and other students had to endure from physical abuse to psychological torment to harsh antisemitism towards me and my Jewish peers, but that is not what this post is about. That was in the past, or so I thought. It turns out that confidential medical documents containing sensitive information on many students, including me, found its way online recently (in the last month tops). These documents include DOB, Full legal name of the student and parent or guardian (this is a minor care facility) and a list of their diagnosis'. It also goes into detail about each students' individual behavior and what the facility was planning to do to address that specific child. This personal information is supposed to remain confidential as per the agreement the Facility has made with parents/guardians. After doing some research I strongly suspect this could be a HIPAA violation, I want to contact the families affected by this individually, all of whom live around the US, to let them know about this but the fact that this is out there is very alarming to me, I don't know who has seen this, or how to make sure it's removed from existence because the internet is forever as the saying goes. What should I do? Thank you for reading to the end and I look forward seeing what advise any of you can offer me.

A friend of mine works at a nursing home in Cleveland Ohio. They have a policy of you leave without a 2 weeks notice they pay you out in minimum wage.

    Posted: 01 Aug 2020 10:18 AM PDT

As the title says, the place says if you don't give a 2 week notice they can payout your last check at minimum wage. Now I know Ohio is an at will state and employers can't touch employees pay checks so Is this legal?

Received a US Bank ReliaCard in the mail for unemployment benefits I did not apply for.

    Posted: 01 Aug 2020 01:49 PM PDT

I live in Ohio and got a US Bank ReliaCard in the mail today, saying it contains my Colorado unemployment benefits.

First of all, I have never applied for unemployment. Second, I live in Ohio, not Colorado. Third, this was completely unsolicited.

After some light research, it seems my identity has been stolen (again) and used to apply for benefits in Colorado.

I have frozen all 3 credit bureau accounts. I filled out a dispute on US Banks website and called them to have the card deactivated. I'm waiting for Monday for the CO unemployment office to open so I can contact them to let them know this is fraudulent.

When I called US Bank, they advised me to take all necessary steps for identity theft protection, including reporting it to the US Attorney General and filing a police report. Which police department would I file this with? Colorado or Ohio?

Can I just set my identity on fire and get a new one? After dealing with this for years, I feel like I have nowhere to turn.

*In 2015, my company was hit with a phishing attack. The phishing email came from an email address that was one character off from being my boss's actual email address, and went to our HR manager. The email asked for everyone's W2's, and instead of protecting everyone's sensitive information which is probably THE most important job she had, she put them all in a zip file and emailed them to "our boss". One by one, the scammers went down the list filing fraudulent tax returns on everyone's behalf and fudging the numbers so they would get tax return checks... The company bought us all 1 year of LifeLock protection and brought in a lawyer who told us we couldn't sue the company. That was it. Now, 5 years later, the company has since closed and hundreds of us are still dealing with the repercussions... Like this. I can't tell you how hard it was for me to get a credit card, how many credit lines have been opened and used in my name, tax returns filed on my behalf, and apartments rented in my name. Someone even had a whole ass job at a grocery store pretending to be me. Shit. Is. Wild.

Noise cannons near my house fire every few seconds every day

    Posted: 01 Aug 2020 01:47 PM PDT

I live in Ohio and my property is very near two corn fields (one about 1000 ft away, the other about 2000 ft) that belong to a farm nearby. From roughly mid-July through mid-September, they set off cannons to scare the birds away. They start every day at 7am and go until 7 or 8pm, firing in random intervals anywhere between every 2 to 60 seconds. It is non-stop explosions for two months straight, and it sounds like the Civil War is my next door neighbor. It's very loud in my house and ruins my otherwise beautiful and peaceful home. It's impossible to sleep past 7am. I can't open the windows when the weather is nice because it becomes that much louder. I can't have people over and hang out on the patio because it's so disruptive. And now that I've been working from home due to COVID-19, it's extremely distracting having constant explosions in the background while I'm trying to concentrate on my job and conduct meetings.

I've called the owners multiple times and they've either pushed me off the phone, not called me back, or have said "we'll move them," which doesn't help at all (if they even did move anything). I went to their farm market and talked to one of the owners in person, and while mostly pleasant, they said that they will not stop because that's the only way to keep the birds away. I find that hard to believe after talking with other people who grew up in rural areas around corn fields and never heard cannons like this. I've talked to my local councilman, who just said "I'll talk to the owners," but I've never heard back. I've looked up my city's noise ordinance, and from what I've found, excessive noise is not allowed between 9pm and 8am, so that doesn't really help me.

Multiple people who have come to my house and hear it have asked me "how is that possibly legal?" They have a great point, and I would like to find out if there's any sort of legal right that allows them to do this in an otherwise residential and recreational area, and if there's anything I can do to change it. I'm not sure what direction to go down to try to figure this out. What type of lawyer should I look for to help me figure out if there's anything that can be done to stop this?
