Auto Adjusters: What would you finalize liability at? CO / 3 vehicles / NO injuries /County Vehicle

    Posted: 21 Mar 2020 02:56 PM PDT

I had a Colorado claim recently where 3 cars involved (for sake of typing on phone, I'll summarize).

    IV - My insureds vehicle

CV1 - Dodge dually with Snowplow attachment (employed by county)

CV2 - Four Door sedan (insured by same company as IV)

Scene: ASSUME SOLID GREEN LIGHT ENTIRE TIME.

IV driving at 6:00AM (not light out yet & dimly lit area) down 3 lane each way roadway in far left #1 lane approaching an intersection of another 3LEW intersection. CV1 is parked on shoulder on right because they had a mechanical breakdown and somehow lost BOTH rear wheels on driver side.

One of the wheels of CV1 continued rolling and went through the front glass doors of a major business ACROSS the intersection about 200 feet away from the point of the mechanical breakdown. The other wheel rolled 50FT and came to a stop (laying on its face so the metal part of the wheel is touching the ground) in lane #3 right where the crosswalk would have been at the intersection.

ID (driver of IV) saw broken down CV1 but did not see the wheel in lane#3. IV enters intersection in lane#1 safely and CV2 driving in lane #3 slightly behind IV (timing wise) sees CV1 stopped on right side of road. CV2 has headlights on but did not see CV1's wheel due to it being dark out and the wheel laying in its face, all you could see was the black rubber. CV2 hits tire with front pass corner of CV2 and loses control and veers left towards IV.

CV2 crosses lane #2 and impacts IV in lane#1 on IV's rear passenger corner / 1/4 panel with the front driver fender of CV2.

MORE INFO: - no police report - no video - no Witness - tire had been in roadway for 5-7 minutes prior to this accident.

The claim has since closed. But looking for your thoughts on it.

Whose at fault? - CV2 for improper lookout and impacting wheel and losing control and hitting IV?

    • CV1 for their liability of wheel becoming road debris and possibly the proximate cause of loss?

    • IV because.... why not?

I can give whatever reasonable info you need but ask away.

    <- - - - - - - - - - - >

    EDIT - OUTCOME

So what happened was... I placed CV2 100% at fault for improper lookout that caused the collision and due to losing control CV2 subsequently hit IV.

My insured ABSOLUTELY REFUSED TO LET THIS HAPPEN. He complained to me. He complained to my manager. He complained to my managers manager... we all stated no, CV2 100% at fault.

My insured cared SO MUCH about the snow plow (CV1) being at fault that he took upon himself to file a claim with them and with NO ASSISTANCE from myself or my company, argue liability with the snow plow claim handler to the point they probably wanted him to just go away and accepted 100% liability as "the proximate cause"

My insured called me and told me this and I literally did not believe him... my insured had the claim handler for CV1 call in to me (I know, right?) AND HE ACTUALLY CALLED ME AND ACCEPTED 100%.

I was like WELP let's just let him have the win it seems and subro'd them directly and they paid it all without argument...

——— As you can see, this was not a typical outcome and just it makes such a great discussion.

Thank you all for contributing to the discussion!

What would you do? Stolen vehicle was determined as total lost by TD insurance and was found 9days later. They forced me to take back stolen vehicle and cancel new lease

    Posted: 21 Mar 2020 06:43 AM PDT

My vehicle was #stolen on Feb 23rd, 2020. I immediately called parking enforcement and they said they car was not with them, and then they transferred me to police. I started a case and notified TD Meloche Monnex right away.

It was REALLY HARD to get a hold on auto claim advisor (well let's call her MARY), and most of our conversation started with me talking to her voicemail or me getting her auto-replies. After thousand attempts trying to get a hold on her, she emailed me on March 3rd, 2020 with a template saying the vehicle has be determined as "NON-REPAIRABLE", asked me for trim levels, and ASKED ME TO FIND A REPLACEMENT CAR as my rental coverage will come to an end soon, and she will complete the entire process in TWO business days.

SEVEN days after receiving the "non-repairable"email, on March 10th, 2020, I went to dealership and signed a new lease, and made a $1000.00 non-refundable deposit towards the replacement vehicle. Later on the same day, I called MARY to update her with the new purchase, and she confirmed over the phone that my settlement value, excluding all the extra add-ons to my vehicle, is $33114.56. AT THIS POINT, I WAS PAYING LEASE PAYMENTS AND INSURANCE PREMIUM.

March 12th at 7pm in the evening, MARY called my cell and told me the stolen vehicle has been recovered.

With the COVID-19 pandemic and PM Trudeau's announcement, unknown damages and risks, and the new lease with non-refundable deposit…most importantly, with their "get a replacement" INSTRUCTIONS in our hands, we've decided to move on with the new vehicle and hope TD can keep their promise made on Mar 3rd. BUT THEY DID NOT! LIAR ALERT!!!

Instead, they keep adding pressure on us by asking us to CANCEL THE NEW LEASE and FORCING US TO TAKE THE STOLEN VEHICLE BACK (they don't even know when they can get it back).

I expressed my concerns to MARY and her manager…(lets call him TOM), rather than offering explanations and showing empathy, 90% of their replies are lines of highlighted insurance policies. What a great way to response! Its like I was talking to A BOT!

To seek for more help with someone who has higher authority and better understanding of client experience (I WISH, gosh I was too young to naive), I got in touch with senior manager (let's call him)JACK. JACK asked me to copy all three of them in the email chain (WHY??? ), and said that my concerns are not a valid concern, by cleaning the stolen vehicle properly, it is a safer space than most of the grocery stores, TTC, uber, and elevator- all of which were still opened. The risk is low as per JACK, BUT JACK, LOW RISK DOES NOT EQUAL TO NO RISK. I tried to report this matter to customer care, called couple times with no one answered and no call back.

Also, JACK emailed me three times asking me NOT TO PICK UP THE NEW VEHICLE, asked for a copy of my new lease agreement, and took away my rental. They asked dealership for penalties to cancel the new lease so TD insurance can make a COST-EFFECTIVE decision for the company (YOU SEE IT RIGHT, NOT FOR ME OR MY FAMILY, IT IS FOR THE COMPANY).

And later in the other email, JACK mentioned "since you have not pick up your new vehicle, we will need to return the recovered vehicle to you" WOW NICE TRAP! You really plan ahead didn't you!?

It has been three days after the last communication happened between dealership (new lease) and JACK. I called MARY, left her a voicemail, emailed all three of them again looking for updates, and NO ONE, NOOOOO ONE has ever get back to me. I have also confirmed with Finance company and dealership, NONE of them have been in touch with TD insurance in the past couple of days.

During the waiting period, I have confirmed with Insurance Bureau of Canada of my rights as a client in this circumstances. I was advised by IBC that since I was following the instruction from TD from the beginning, and I have email as prove, I have the right to REFUSE to take back the recovered vehicle, and TD cannot force me to cancel my new lease. They have also advise me to find legal assistance and take this matter to court in order to guard my right. I have also got in touch with York Regional Health Line, as they said the virus is wide-spreading and recommend me not to travel, stay home and not to touch anything before knowing the source.

Is there anything else I can do?

    Travel insurance during Corona Epidemic

    Posted: 21 Mar 2020 07:37 PM PDT

I have a trip planned in December and made my first deposit to the agency 2/24. I am looking to buy a policy but notice that I am beyond the date I'd be eligible for trip cancellation. Are there any policies that would cover the portion of my trip paid after today? Would a plane ticket I buy after the effective date be covered at all? Any suggestions on best course of action are welcomed. I am hoping to buy a plane ticket soon while prices are low.

Not needing to drive any car for a while--can I let insurance lapse?

    Posted: 21 Mar 2020 10:45 AM PDT

I am selling my car and don't plan to drive another.

Is it safe to assume that if I turn in my tags and don't have any car registered to me at this time, and therefore stop paying insurance, that everything will be fine?

I'm reading all this stuff about fees for a gap in insurance, and how you'll never get cheap insurance again, and wow what a rough and rigged system design. whew.

So what is the deal if I willing don't drive from now until a decently later date in the future?

Help me to find an Unemployement insurance for a non EU citizen?

    Posted: 21 Mar 2020 05:27 AM PDT

I was terminated on Oct'19 (and almost all employees) because the compnay went bankrupt. The company is a danish company and I never thought of getting an insurance as I was on a 3 year contract ending in 2020. All Danish employees had govt supported insurances.

Now after that is over, I managed to get an an year of job contract at another place after a long wait of 6 months. I can't get an unemployemnt insurance because I am a non European. What should I do?

An Insured has a Dwelling Broad Form with a 40,000 limit of Liability. The home has a replacement value of 100,000. How much insurance should the insured carry to obtain full replacement for loss to the dwelling?

I know about replacement cost basis requiring 80% or more for replacement.

If you need more info to answer, I'll give it to you ASAP.

    Thank you in advance!
