Last night at 2:30am I woke up to the sound of our dogs barking and the door opening. Our city is mildly dangerous and I'm licensed to carry, so I got my gun from under the bed and hid behind the door. I heard my dog whine/squeal loudly and then a male voice cursing. One of them opened the bedroom door and I came from behind it pointing the gun at them and I started yelling telling them to get out (with some cursing and threats involved, yes) and only THEN did they identify theirselves as apartment maintenance staff. They had flashlights pointing in my face and I couldn't see their faces properly so I told them to be quiet and stand by the door while I turned the lights on, while keeping the gun pointed at them. I turned the lights on and I don't recognize them. I've lived in the complex over a year and have NEVER seen them, and have had maintenance come by at least 5x while I was home. I call the apartments 24/7 line and ask both of the men to see their identification (they don't have on macitence uniforms either, just sweatpants/t-shirts that were dark coloured) while still keeping the gun in my hand, but no longer pointed at them. They don't have any proper ID with the apartment management, say they don't give them that. They're there because there was a huge leak downstairs and they think it came from my bathroom. I don't really know what to do because the 24/7 line isn't picking up so I tell my dogs to follow me, I grab my car keys and wait outside in my car for them to look at what they need to. I run into my downstairs neighbor who I talk to for a second and let's me borrow her leashes for my dogs, and I go back upstairs to apologize for the gun but then about 5 squad cars come into the lot, pulling onto the grass and all. One of the officers gets out and points his weapon at me and tells me to drop what's in my hand and get on the ground (my dogs leashes). I do what he says and then another officer searches and cuffs me, and leaves me against the wall of the building. I'm not stupid and I know it's because the maintenance guys called the cops (I was standing next to my neighbor and they only looked at me, so clearly they had a description) because of the gun. I told them where my concealed carry permit is and where my ID is. Eventually they uncuff me and start telling me how what I did was assault, but I try to explain that they did not give me the required notice about maintenance and even though her leak was major, it wasn't major enough to not bother knocking or ringing the door bell and just walk in. An incident report was filed against me for assault with a deadly weapon, and they let the macitence guys know I can be charged any time within the next few months or weeks (? didn't hear properly as I was listening in) and I started having a panic attack and throwing up and they (maintenance) accuses me of faking it. Guys go back upstairs, lock ME out of my own apartment (using my own door jammer) and when they're leaving and walking down the stairs I'm sitting on at 4am tell me they'll be pursuing the charges. Do I need to get a lawyer now or should I wait to see if they actually file the charges? Apartment management has been uncountable and the office was closed before I left for work this morning. Edit: I know I messed up by not calling the police immediately and for some people, many, having a gun pointed at them is scary and traumatizing. I stand by the fact that as the complex knows I'm a single woman they should've at the very least knocked. I wore these glassestoday and a customer wasn't happy about it, to the effect of: "why are you wearing those?" "They help me see" "Why those ones tho?" "Because they work?" He wasn't happy with my replies which I might've had a little attitude about but this old ass farmer bro wasn't happy that the guy working on his vehicle was wearing some "hippie ass glasses" or something to that effect(he complained to my boss and that is the summary I got)... Got thru the service without any incident but then my boss asked me to take them off to avoid another incident, I didn't see the point and let him know that I plan on working with them anyway, nothing is stated in the handbook about certain "patterns" of glasses I can/cannot wear(stupid argument I know but I'm good at my job and shit like this doesn't interfere) I've never had a complaint about my performance/customer service, sometimes I wear things that are considered "weird" but not against policy... He tells me to clock out and go home since "customer(s)" are complaining about my "lack of respect", I tell him I'll comply but only if I'm not docked the hours I'd earn, he said forget that, "hope you have a job come tomorrow" Do I have any recourse if I walk in jobless tomorrow/where would I start? Posted: 04 Mar 2020 06:05 AM PST Pennsylvania - let me start out by saying I'm not being the helicopter mom of the group. These are elementary aged kids and the school's rule is that kindergarten and 1st grade students must have a parent at the bus stop. They will not release a 1st grade student or kindergarten student off the bus without a parent. I'm not sure what they'd do in the morning for pick up but in the afternoons they won't release the 1st or kindergarten students with no parent present. I have a 1st grader and 2nd grader, so I have to be there for my 1st grader. At the bus stop with them are a 4th grader from one family and a 3rd grader and 1st grader from another family, these two families cohabitate together. The 3rd grader and 1st grader moved in a few months ago. When they first moved in, the bus driver would not allow the 1st grader off the bus as she knows I am not their parent. That only happened twice and then she started just letting them all off when the mom still didn't show up at the bus stop. I worry she's figuring I'm there so it's fine, and that because of that I'm now the de facto custodian of the girl until she's home. I have not consented to the school, bus driver, or parents that I would take responsibility for this girl. But I worry legally I will end up responsible if something were to happen. Our bus stop is on the corner of a road entering our neighborhood and a busy road. The busy road snakes around downhill so visibility right before our corner is not great. Then the turn into the neighborhood is blind. Most of the people who live in the neighborhood know there's kids about and are responsible about the turn, but delivery drivers, repairmen, etc whip around the corner. So I have my kids stand back a ways from the busy road on the opposite curb from the corner. I tell the other girls the same thing. My kids are well-behaved, but these girls are not. They run around the road, and walk right up to the busy road to wave at cars. The oldest girl even goes out into the busy road to dance around to be "funny" when there's a break in traffic. I've corrected them a dozen times and plenty of times I've straight up scolded them. This morning is one of those times where I yelled at the 4th grader to get away the road and told her to get back on the curb with the other kids and knock it off. Beyond liability I just don't want to be parenting these other kids. But I also don't want them hit by a car. The 4th graders grandma used to come by to get her off the bus. That stopped when the other family moved in (I believe the other girls mom is supposed to be doing it now while 4th grader mom is at work but she just doesn't show). There's usually no issues in the afternoons. The girls just walk back to their house which is along our walk back to our house. I try to walk a bit behind them to watch. Last week in the afternoon some roofers working in the neighborhood were calling out to the girls to get their attention and the one guy got one of the girls attention then grabbed his coworkers ass and laughed. They shut up and got back to work when they noticed me and my dog behind the girls. I kept a close eye on them until they were inside. It really freaked me out that these elementary aged girls were just sexually harassed by grown men and I was the only one present (what a world). That kind of situation along with the traffic.... So, my question is, if something were to happen to any of these girls, especially the 1st grader who requires a guardian present, while I'm the only adult at the bus stop in the morning and afternoon, am I now liable for it? What can I do to protect myself if so? I started driving my kids to school to avoid the bus stop completely for a few weeks, but my kids really want to ride the bus with their friends and I feel like I'm throwing these girls away to protect my back. We were told to pack our bags and be out of the country by Friday. Unfortunately, all students were on spring break so many of us were abroad somewhere else. I had to cancel my plans to go to another country. I had already invested almost $500 on that trip and the flight, living situation, etc. are all non-refundable. I also had to book a flight to get back to Florence. Are there any laws protecting me here so that I can request some sort of compensation from the university for these unrecoverable costs? Today my wife came home for lunch and saw the dryer wash pushed up against the wall, all the clothes thrown out onto the bed, and a litter box was spilled. She freaked thinking someone had broken in, called me and left so I left work early to check it out. Turns out the previous renters rented a W/D through the apartment, and the apartment had moved it into storage before we got here. They notified the appliance company they worked with that they needed to be picked up, but they're in a storage unit, not the apartment (have seen the work order thing and can confirm they did this). People working did not read the notice apparently, took my washer and dryer out of the apartment, causing cosmetic damage on the front and sides (one side really bad, which is why it was pushed against a wall) put it back when they realized they fucked up, without telling the complex they went in there (but the complex still provided them the keys, guy at the front desk wasn't aware of the situation), and said nothing to anybody. Talked to apartment assistant manager and he basically just said sorry a bunch and he'll try and get the appliance people to pay for the damages to my brand new W/D (cost $600 a piece). He's going to call me back when they call him back. Do I have any legal action against either the complex or rental company? Or both? Apartment for letting them in without any notification, and appliance company for the damages? Thanks. She was really fucking weird so I decided to kick her out. She then went to my roomates room and started a fire without anyone seeing her and immideatly got the hell out. The fire was contained in just the one room but now months later when we've finally moved on with our lives (we lost the appartment cause just breathing in the air was hella toxic) the insurance company of the landlord is claiming 70000$ from us. We're all broke uni students who are already very in debt. The police never found the arsonist. Anyone know of a way to not pay this. I'm pretty sure even if us 3 and our parents were to pull our money we wouldn't be able to pay it anyways. I'm kinda scared imma have to go to jail because I survived the fire instead of dying in it. In that divorce decree, my wife and I agreed to split expenses for my then 17-year-old son. One of those expenses was his car payment. My wife took his car payment which was a lease through Honda. After 6 months, she decided to file Chapter 13 bankruptcy. Now that she's making payments to the Trustee they are dictating what she can and cannot do. They've gone as far as telling her that she can't make the payment on my son's car anymore once the Lease expires and I get him a new one. I find it hard to believe that the Trustee of the Bankruptcy Court can go against the divorce decree and the responsibilities that we wrote into it. He would tell me what girls he's into I even helped him to hook up with my friend like the good wing man I am. Suddenly couple of weeks ago he started to flirt with me, touching me quite inappropriately at work. I was uncomfortable and told him to stop. Granted as sort of a joke as we are close friends I didn't make it a big deal. He send me video of his hand down his pants playing with himself saying his horny. I send him a photo of myself revealing my cleavage saying I'm gonna go home make love to my husband and that he should play with himself. He asked me if would consider cheating on him I said no. He filed a complaint about me to HR and says I send him inappropriate photos and he feels uncomfortable (hey that's my line ..). Problem is I fucked up I send him that photo which could be seen suggestively too. So how much trouble do I expect to be in? There has been talk my employment may be terminated. After a full-fledged investigation where my daughter was in a room with strangers for 30 minutes answering questions (at five years old) and then an investigation into myself, it was found unsubstantiated. Turns out that my house was in fact not full of animal waste and there was plenty of food and my house was lived in, but more than clean enough. Fast forward to December. The caseworker from CPS shows up at my door stating that another call came in over their hotline saying that I was selling my food stamps for beer and cigarettes and that my house was filthy and that I was not taking care of my child. All things that are definitely not true. After another investigation, they closed it as unsubstantiated and that was that. Last month, an investigator from food stamps showed up at my apartment on a day that my daughter and I were both at home with the flu. Apparently someone called their hotline and said that I was selling my food stamps for $.50 on the dollar. Which is again completely not true. I now have an investigation for fraud on my food stamp record and now they are trying to not recertify me. Is there anything at all that I can do to make this stop? I can't keep putting my daughter through this, and I don't know what else to do. I'm at a loss here, and I'm about to lose the one thing that ensures that my daughter always has plenty of food options in our home. While I can afford the majority of our food for the month, I do depend on them. Now I'm facing losing them because someone continues to call different DHS departments and make up lies about me. I immediately notified my direct supervisor that I was injured and would be out for a few days while I saw doctors. The injury occurred at about 8PM, and at 10AM the next day I had already taken xrays at a local clinic and had been referred to the ER. ER put me in splints and referred me to the hospital specialist. Hospital specialist referred me to another specialist. He prescribed 2 week of bed rest (no work at all) after which I could work from home for another 3 weeks. After the total 5 weeks I could possibly switch from a wheelchair to crutches, at which point I would physically return to work at my desk job. I gave all of this information to my direct supervisor who forwarded it to his boss, the company CTO. I was informed this last Monday I was being terminated. They would not offer me the ability to work from home (even though I usually did it every weekend on top of my 40hr weeks). They would not be able to hold my position given that they are a small company and everyone has a specialized role. TLDR: Broke both feet and confined to wheelchair for 5 weeks minimum. Someone is using my likeness to get shows for a band I was fired from Posted: 04 Mar 2020 10:28 AM PST Hey all, throwaway for obvious reasons. I was in a popular tribute band around 8 years ago. We had a booking agent and played at some of the top clubs in our area. The band imploded dramatically which resulted in myself and the other singer (we are dating and have been since we worked together in this band), and the bass player to be fired. The other two remaining members quit soon after and they were dropped from the agency. The owner of the band has tried many iterations of the band over the last couple years, but it ultimately fails then will disappear off the map when it doesn't work out. They are back at it again, but they are using ONLY video and photos from the time I was in it on their SM and website. They are using this to get shows at places we currently play (we have moved on and are in another successful, unrelated cover band) since this was from when the band had large crowds, and we are known in the industry. Unfortunately, they have been unable to replicate the success we had at that time to get photos and videos of their own. They have no video or pictures of the current lineup. The issue is two fold, one, they are using my likeness to get work and, two, people often ask if we are in the band ( which is how we found out he was booking again). I don't want to be associated with this person because he is a known scumbag. He used to brag about other people he harassed like this. He is a drug addict. He has been sued before, moves constantly, doesn't hold a normal job etc. He also still to this day uses my address for things like his drivers license, used it to commit Welfare Fraud and more. I have gone to the police, the Post Master and reported him to the WF office. Nothing has helped. The police can't do anything since he's never threatened us physically and uses different numbers and profiles to harass us. Whenever we try to get him to stop, he retaliates in crazy ways. He goes great lengths to libel us and creates fake profiles to leave nasty comments on our SM. I don't have the money for a lawyer; I have tried to send him a cease and desist, but he doesn't have an address. Posted: 04 Mar 2020 11:18 AM PST Salt Lake City, Utah I'm going to keep this as brief as possible and try to include only the facts of what is happening, but it is still a long and confusing story... I am at a complete loss as to what I can possibly do against this. I received unemployment benefits from December 2018 until June of 2019. Had not heard a thing about it since, until I found out that I had an offset for an overpayment Via voicemail to collect a debt on February 8th, 2020. I called for information to Utah BFS, and was told by a live person, I had $1092 for a an offset. $546 for the actual Overpayment, and a charge of $546 for fraud. I also called the Federal offset line, and was told there was no federal offset on file; However, when I received my federal tax return, $1102 had been taken out for this overpayment (2/26). Then, I received a notification from the state, saying that over $600 was taken out of my state returns for the same thing (2/28). So, $1092 "owed" went to $1,702 in a matter of weeks. No information as to why the amount jumped up, and no information showing this paid off this erroneous debt, either. Immediately I begin looking into this and trying to find all the information I can. Apparently, I was accused of fraudulently receiving overpayments on my Unemployment Benefits, had a hearing that I never received notice of, and a decision was made against me. What have had to go through for the information that I have so far, is absolutely ridiculous. Every person I have spoken to on the employer's side as well as at the unemployment appeals office- including the chief administrative judge- have treated me like the scum of the Earth. There have been outright refusals to provide me with information as to why I am accused of fraud, outright refusal to provide me with subpoenas for witnesses and documentation, And rudeness from everyone I speak to, to the point of being extremely unprofessional.. I have had to fight tooth and nail for what I have gotten so far. What happened to not being deprived of life, liberty or property without due process? Anyway, here are the facts regarding the unemployment I received from 12/2018 to 6/2019: Issue 1Fraud overpayment ruled for week ending 12/16/19. Their Reason: I willfully and intentionally withheld information (that I received income that week) from the department in order to receive unemployment benefits which I was not entitled to. This is makes absolutely no sense. I did report income for that week... Here is the evidence I have, that is in THEIR copy of records that I just received from them:
CAJ: " We don't have a recording of that conversation." Me: " You mean to tell me, that you don't have recordings of people calling in to file their claim? When there is a machine recording at the beginning of the call stating 'that for quality and training purposes, this phone call is being recorded?'" CAJ: "We dont record all of those calls and I can't get that for you" Issue 2This is much more confusing, so bare with me. I was terminated 3/18/2019. I received UI Benefits from weeks ending 3/23/2019 until 6/1/2019. Fraud overpayments have been ruled for weeks ending in 3/30, 4/6, 4/13, 4/20, and 5/4. Their reason: I received a severance from the employer that I did not report in order to receive benefits I am not entitled to. This, again, makes absolutely no sense. I did not receive a severance from the employer. This is what happened:
The problem? I could not get the paper check cashed. I tried several different places. It was flagged as risky by certegy. I have emails and texts to my former boss on that date stating I could not cash that check and asking if they could direct deposit. No response. I have bank statements showing I did not cash that check, and there was no money deposited in my account anywhere near that date. Still, I reported my earnings for week ending 3/23/2019 on my UI claim. This reflects in their records.
This is what the employer reported to UI:
So, their claim: I received an extra paycheck, designated for the weeks of 3/17 - 3/30, that I was not entitled to. Therefore, the amount of that check, $1269, should be counted as severance. Makes sense, right? So far, it seems like a simple misunderstanding. This is where it gets hairy. The supporting documentation they sent to the Unemployment Office to support their claim: What the Unemployment Office Determined: That I received a severance check on March 18, 2019 for the amount of $2665. This is not even anywhere near what the employer reported to them. But, they are saying that I received this, as well as my wage earnings, all in March, and this disqualified me from UI until May 4th, 2019... therefore, I must pay back everything I received for those dates. And oh, since I "willfully and intentionally" witheld this information, it was ruled as fraud and I am having to pay triple the amount I received for UI. How they came to this conclusion, I have no idea. Honestly, it looks like they took the amount of all of my wages I earned working hourly in March – which was $2,665 - and saying I received it as a severance. They sent me all of the information my employer reported to them, it says nothing near this.. It makes absolutely NO SENSE as to how they came to that conclusion... yet I am being accused of lying about receiving a severance of $2,665.. And they have now taken $1,794 from me based on, literally, an unsubstantiated accusation. How is that even legal? I have requested documentation regarding my UI case, such as correspondence to UI office to show what I reported to them, their correspondence to me, their decisions for the claims I filed, and so on.. Both the Appeals office and UI office is refusing to provide this to me. I requested for my employer to produce the paystub for the paper check I received, or proof that it was cashed, and they refused to give me any documentation of this. I have requested the UI appeals office to subpeona this information from them, and they are refusing. I have now lost $1,700 because of this, and everyone involved is refusing to produce any evidence of me doing what any of them are accusing me of. All of the evidence available shows I did not commit fraud, but that is not the conclusion they have come to. I have tried requesting more documentation to prove this, and I am being outright refused, and talked down to. How am I supposed to defend myself in this case? How do I get that money back? I am in NSW. 3 years ago (Oct 2016) I was drugged and forcibly raped at a year 12 ball after party, by someone i had previously turned down for a date. I was taken to hospital (as I wasn't drinking the fact that I was passed out unresponsive raised alarms) and a report was filed although I got talked into not filing charges against him. When I found out I was pregnant I did ultimately decide to keep the baby. She is now 2 and a half years old. After she was born he filed and got part custody of her; the judge said that due to our "conflicting stories" he couldn't in good conscience prohibit him from seeing her. He is meant to have 3 visits of 90 minutes each per week. He doesn't always take them but when he does I am supposed to facilitate it. Obviously not only is this traumatic it's also exhausting. He pressures me to pretend like we're normal co parents and we are not. I can barely look at him much less carry on a conversation. He says terrible things to me at visits as well and generally makes me feel uncomfortable. If he has to see her, is there something I can file that says someone else can take her? If it was through mail, I could have had it intercepted as mail fraud, but if it was turned in at a local center, then there's nothing that can be done. Buyer's real estate agent made unauthorized changes to my home before closing. Posted: 04 Mar 2020 11:35 AM PST I would like some advice please. I'm selling my father's home who recently passed away. It is under contract but the closing has been delayed several times now. I am not living in the home and have put the thermostat very low to keep the pipes from bursting from cold weather. (I live in North Carolina and sometimes it gets very cold in the winter time.) I got the power bill the other day and it was outrageously high so I thought something must be wrong. I make the trip to the house and as soon as I get there I notice things have been changed. The back deck had been sanded down and painted, the front porch had been painted, and as soon as I walked in the back door I noticed someone had cut a big space out in the linoleum at the door and put a new piece of linoleum that didn't even match. I noticed dust everywhere and then I saw where someone had been sanding on the ceiling. There was a big black trash bag with their trash and beer bottles in it. I couldn't believe my eyes! I immediately called my real estate agent and she had no idea about it so she said she would call the buyer's agent and see what was going on and then call me back. after a few minutes she called me back and said the agent told her she herself hard people to come in and make the changes to make the house appraised at a higher value. The house had already been appraised, we were already way past that point! My agent was upset about it and I have a real estate lawyer who is helping me with the probate process of my father's estate and when I told him about it he could not believe it! my attorney called the buyers closing attorney while I was in his office and ask them if they knew anything about it and they knew nothing but said that they will try to find out what is going on and let my lawyer know. My lawyer said that he will contact me as soon as he has heard something and he has not heard anything back from them yet. I know it probably sounds silly but every time I would walk into the house I felt like my dad was still there in a way and now I feel like people have come in and trampled in the house and done things without my knowledge and it makes me upset. When I opened it I saw my parents outside, they started talking about how much they missed us after being gone for so long. I got angry that they showed up because 5 years ago they abandoned us and I had to live with my uncle and my sister lived with her aunt. While there she was abused and neglected the entire time. She now lives with me and I'm her legal guardian. I told them that they were not welcome here and that they need to leave. They get mad calling me ungrateful and demanded that my sister goes with them. I told them that wasn't going to happen because my sister is also mad at them for leaving. My sister heard all the commotion and came downstairs to see what it was about. They instantly ask her to come with them and she refuses. They noticed that she was sick and accused me of not taking care of her properly when I slammed the door on them. They mentioned something about calling the cops if I didn't let them take her and I'm worried that she will have to go with them. Mentally unstable tenant in group house Posted: 04 Mar 2020 04:12 AM PST So in the past month I have received two complaints from my tenants in a group house regarding one of their roommates, which greatly escalated last night. This tenant has been coming home drunk and is very aggressive and suicidal, screaming at the top of his lungs, punching walls etc. Last night, several of the tenants felt unsafe and called the police. While the police were talking with him, one of his roommates went into his room and took photos of his walls which he had smeared with blood (in think from his knuckles from punching walls). Prior to living in this group setting, none of the tenants (4) knew each other. Looking for advice on how to proceed. Obviously I want my tenants to feel safe, but don't want to do anything illegal with regards to dealing with the mentally unstable tenant. Please help! “Dad’s credit card debt” half brother is using my dad’s card Posted: 04 Mar 2020 04:42 AM PST Hi, we all live in the state of NC. Bear with me here as it is a sticky situation My mom and dad bought the house legally jointly about 10 years ago but it was mostly paid with my mom's money. A few years ago, we had a will drafted for my mom and additionally, he signed the house over to her name solely. My mom and dad are legally married but have a weird relationship. He basically is her roommate who lives in a separate room and he pays her a certain amount of money for the mortgage monthly. They have a joint checking with enough money to cover bills but separate savings accounts. They own separate cars. And my mom has a life insurance policy on him and he has a life insurance policy (paid for by my mom) on him but payable to my mom upon his death. I can't think of any other "assets" he has. Fast forward to present day, my dad (he's almost 80 years old) willingly lent his 3 credit cards (under his name solely) to his son (my half brother) who have racked up almost 10k on EACH. My half brother pays around $500 to my dad monthly or gets the bill and pays. But the balances are still very high. They are on a Chase, Citi, and discover card. I have talked to my dad about this and the financial repercussions for my mom and I about lending the credit cards to my half brother to rack up $ but he doesn't listen. He says it's fine he will pay him back so he doesn't care... Honestly, I'm not even sure why my half brother does not open credit cards in his name or if he has terrible credit so he is using my dad's. Since I had online access because I used to have to help pay when my dad missed mail payments.... I was able to go online, see his spend, and freeze my dad's credit cards so my brother can't use his card. My half brother has since called the credit card companies, told them my dads social (without his presence and falsely being my dad), requested a change in address for the cards (to my half brothers address), changed security info, and filed for "lost card" so now I am locked out of the online access and he has free range to spend under my dad's cards. I know this because my dad speaks very little English to be doing all of this and he is currently out of the country. We know the reality he is old and I am hoping for advice on the questions and possibly next steps here...I am concerned about financial repercussions for my mom after his death. He does not have a will so upon his death, it will go to the estate. My questions: 1) my mom has bought all of the assets and furnished the home with her money. She owns the house. Are the assets in the home legally hers as well? Can the credit card companies go after her assets if my dad is not tied to it but the are married? 2) my dad has 4 total credit cards but did not technically spend $ on 3 of them. My half brother did. Who is responsible for this after his death? Or does this get absolved given he has little to no assets? So if my half brother doesn't pay it off, is it basically free money for him? 3) what are my next steps? This is shady but I can't do a thing about it. This is morbid but when he passes, do we just call the credit card companies and explain the situation and provide a death certificate? Getting sued regarding an online car sale Posted: 04 Mar 2020 10:54 AM PST Greetings - we own a classic car shop. We have bought, sold, appraised classic cars for over 50 years and never had a problem like this. In this particular sale, we were selling the car on eBay in 2017. It was a beautiful car for the age of the car. The car was sold as-is. Plus I should add that anyone buying classic cars is really taking a risk cuz minor things can go wrong. (My own classic car, we were working on a transmission leak - got that fixed and was driving it into the storage facility and the fuel pump went - it just happens). Anyway, the buyer was a pain in the ass the entire process to the point we almost said, forget this sale. The guy was interfering with the transport company before he even paid. Well he finally paid and we shipped him the car. The minute he got the car he said it didn't start. We told him put it on the charger. He said he took it to one of the low budget places like a Maaco, and they said all kinds of things were wrong with the car. There was NOTHING wrong with the car when we sold it. So then the buyer began calling and harrassing us relentlessly asking for $1000s of dollars back or he was going to fly here and come get the money himself. The buyer also filed a complaint with our State. The State came out, did their investigation, and found out we didn't do anything wrong...the car was not a lemon and case closed. That made the buyer go even more crazy. He keeps getting fake numbers and prank calling the business and our employees. He does crazy things like having people screaming in the phone and saying perverted things, and accusations of pedophilia, I mean it's just insane behavior. He has been harrassing us three years now. I got the idea that this guy is off his rocker so I started looking into him. I found out he has phony disability claims, and pages and pages of small claims suits against people. There are articles about him in his local paper. Then I found pages about him on social media that were created by his former neighbors. This buyer harassed his neighbors to the point they had to move. He would stand in the window holding his penis when the kids were outside playing. He threw poison hot dogs over the fence and killed their dog. That's just the beginning of the story about the neighbors. After I found out all this, I filed a police report in our city (where the business is located) so the police are aware in case he shows up one day and tries to shoot up the place. This guy is a loose cannon. He gets buy in life making phony claims so he can live free and get free things. So fast forward to yesterday, he had been quiet for about 6 months but we started getting prank calls yesterday. Today, in the mail, we get a notice of Small Claims suit filed against our business but it was filed in HIS State. So my first question is, if we are in State A and he is in State B, car sale was on eBay, where is the proper venue to file? #2 - isnt this supposed to be served by a process server (in our State, mailing a summons would never fly in court) #3 - any other suggestions on how to deal with this psycho? Sexual Harassment- boss and his wife Posted: 04 Mar 2020 02:53 AM PST Throwaway because I'm paranoid. I'm located in Chicago, Illinois. I(20F) work as an executive assistant to a CEO. My hours are long and my job entails traveling with him whenever he goes somewhere for work. He's married and his wife also works as a high level manager at the company. Lately he's been calling me at times like 1 am and asking me about projects that we've already gone over during work hours. Then he asks stuff like what I had for dinner and if I was liking it at his company. He also wants to talk about how I feel about other people in the company and ask if I thought " Alan" was cute. Sometimes he works through lunch and asks me to order him stuff. I always bring my own lunch but he keeps on insisting I " take a bite" of something he ordered. When we travel sometimes his wife is there and they make out and talk about sex in front of me. I get called in to go over documents and even when his wife is there he insists on meeting in his hotel room because all this stuff is confidential. He usually offers me drinks and asks for me to stay a while and I almost always refuse both. Once his wife got really close to me and started whispering in my ear nonsensical things about him. The other time he started stroking my shirt in the hotel elevator and asking what fabric that was. I don't have friends at work because most people there are analysts or associates and have their own social circles based on who they spend time with. Also I think there's a revolving door for the more " blue collar" job positions in the firm, like being an assistant. I never see the same janitor, security guards, or front desk personnel much. Today his wife said she wants to make sure I'm comfortable at her husband's firm and said if I ever needed to talk to someone about anything I could always call or text her. She said she's here to protect all the employees that work under her and invited me to an employee hangout that I'm usually not invited to that had a few HR people on top of analysts and associates there. So would there be any damage to a potential case if I talk to her about my feelings? And should I do it to show an effort to solve things before it goes to HR? I also don't know if I can not answer phone calls in the middle of the night since my job technically entails providing support as the CEO's work schedule dictates. I'm afraid he'll fire me and give me bad references. I just feel so alone at my company and really want somebody to talk to about my problems. Most of the other employees either think the CEO is a " cool boss" or they are janitors and security guards who always seem to keep on leaving. Also am I paranoid that Hr won't help me?
