HOA has made a choice which affects my property value—except they’re not MY HOA

    Posted: 30 Nov 2019 05:02 AM PST

    Polk, FL

I own a home in a large subdivision which has smaller neighborhoods inside it. Each neighborhood is managed by their own HOA and property management company.

My house abuts a retention pond on one side. It's part of the reason we bought—for the view and access to the pond. A week ago, I looked outside to see surveyors, then right before Thanksgiving, a fencing company put up a 6-foot chainlink fence all the way around the pond. The fence is now a few feet from my 4-foot picket fence edging my property. I asked the HOA president of my neighborhood what he knew about it. He said that it was the HOA of the neighborhood across the boulevard who made the decision, and he wasn't even consulted.

Here are my issues: (1) According to my HOA president, this other HOA doesn't want people accessing the pond, hence the fence. However, this fence has not done that as people can still access it—only now instead of standing in the street, they'll be trespassing in my neighbor's yard.

    (2) They've fenced off the area in such a way that my property management company cannot mow the tiny strip they left between my property and the fence.

    (3) The most egregious is how they've significantly decreased my standard of living and decreased my property value by obstructing the view.

I had considered sending a certified letter to their HOA, but I don't know if that would help at all. What legal action or recourse (if any) do I have?

Thank you in advance for your help.

    Dentist Calling My Employer

    Posted: 30 Nov 2019 09:36 AM PST

Had a routine visit to a new dentist. Dentist misrepresented treatment options. Got into an argument. Finally told her I was filing license complaint about it, she recanted and admitted the treatment I wanted was fine, I wasn't comfortable working with her and left.

She pulls my employer information from insurance cards and calls and runs her mouth to my boss. Tells my boss all about disagreement with respect to treatment and how I was unprofessional, etc.

Someone at her office apparently emails and calls our corporate HR and notifies them they are suing my employer over the disagreement.

Someone (who sounds mysteriously like the dentist's office manager) calls and leaves an "anonymous tip" that I was stealing from the company. I don't handle cash, there's no way I could be stealing.

    Texas is jurisdiction.

She's obviously in criminal breach of HIPAA, but there's got to be more here?

    Neighbor Mangled My PawPaw Trees

    Posted: 30 Nov 2019 02:44 AM PST

I have two twenty year old pawpaw trees in my yard that I planted shortly after moving into my house. These trees are somewhat rare and fickle to grow. About a month ago I came home to see these trees had been cut back to the trunk on one side, about ten limbs per tree. My neighbor acted as if he was doing me a service by "cleaning the fence line. " however, these trees are about 15 feet away from the fence, and the fence line has definitely not been "cleaned out. " I emphasized that he had come on my property without my permission and that the trees are my property too, but he insisted he knew that but did it anyway.

This neighbor is relatively new, moved in about six months ago and I informed them of the property line within the first week (in a nice way, the property line is a bit odd.)

This neighbor has also been hanging bird feeders in my maple tree, much higher than I am able to reach, about 20 feet up.

I am in Kentucky, and not sure what exactly to do. I've considered small claims court but would appreciate any advice!

Insurance declining my baby’s stay in NICU - $125k bill

    Posted: 30 Nov 2019 12:06 PM PST

So we live in Texas, and my wife and I both have separate insurance policies. Her work insurance is through Allianz Care which is an international policy. They contract through Olympus billing and Aetna PPO in America. Her works HR policy is that children and spouses cannot be added to the policy. Knowing this I started an insurance group (eff. 11/1) through my small corporation and added my son. His due date was originally 11/17, so I thought 11/1 would be sufficiently early. This was a huge mistake as he was born prematurely on 10/28. Due to being premature he spent the next four and a half days in the NICU.

I also had a previous insurance policy that I cancelled effective 10/31 as I was transitioning to the new policy with BCBS effective 11/1.

The hospital says the claim is still pending, and that the total is, to be exact, $127,500. The insurance people from Allianz Care have told us they have declined that claim and will not cover it. Some people had told me that under the ACA and possibly the newborns and mothers protection act of 1996, newborns are automatically covered under the mothers policy for the first 30 days. Is this true? We are in wait-and-see mode right now but are terrified that we may never be able to buy a home or retire.

Any other opinions or ideas regarding recourse for us at this time are greatly appreciated.

Sexual Relations With First Cousin (Indiana, USA)

    Posted: 30 Nov 2019 04:45 AM PST

An awkward and likely taboo question here from me. Not me, not anyone close to me; but rather a legal question posed by a former student based on a family circumstance.

Q: In the state of Indiana, can a under-65 heterosexual couple found to be first-cousins and discovered to be having a sexual relationship, or had sexual relations within state lines within statute of limitations be tried as criminals? If yes, is it grounds for them to be registered as sex offenders? Also if yes, what are the legal punishments prescribed within state law if a couple who did not marry in a legal state are caught having sexual relations and/or are found to be co-habitating?

Background is that a former student recently discovered that one of their parents is in a poly amorous relationship with a first cousin. While they live in North Carolina where sexual relations with and cousin marriages are perfectly legal, the relationship is believed to have originated in Indiana and is one where meetups have undoubtedly occurred in the state within the past year; where sexual relations, cohabitation, and marriage are completely illegal for individuals under the age of 65 with exception to citizens in

Troll responses and dueling banjo jokes aside, this is a serious question. Links to relevant cases or anything sourcing answers would be deeply welcomed.

    Thanks in advance.

I privately sold a car yesterday in TX and forgot to take the plate off the back. Buyer won't tell me where car is and is not in any hurry to return it to me.

    Posted: 30 Nov 2019 08:38 AM PST

I did electronically submit the Vehicle Transfer Notice. But I don't know what to do if he doesn't give it back. My registration does cancel 12/1/19. Another thing, the address he put down on the bill of sale and what shows on his valid license, is old. I went there to try and retrieve my plate and he doesn't live there anymore. He also didn't fill out the back of the title, stating he didn't know what address to put down yet. All I have is his name and phone number. He's obviously up to no good, but will it affect me? Is this going to be a big problem or am I stressing over nothing?

Old Nudes Posted Of Me On A Revenge Porn Thread

    Posted: 30 Nov 2019 08:19 AM PST

    USA, OH

So, back when I was 18 I posted some nudes of myself on Tumblr because I was going through a stage of feeling bad about my body, so wanted to take control and do something confident. About a year or so after that, it wasn't my thing anymore, so I deleted the Tumblr account, not knowing that this doesn't delete the photos themselves. Dumb, I know. I was okay with this at the time though, because I had put them out there myself. It was my choice, and now they were in the past.

Yesterday, I was notified of a thread on a site (not sure if I'm allowed to say which one here, but it isn't Reddit) where people were posting photos of girls from the UK. I have lived in America for the last 4 years, but I am originally from the UK. My old nudes were on there, and even some candid photos of myself from my Facebook, along with many disgusting comments about me, and even comments stating they went to school with me, and that they knew my siblings.

Some people from back home already know about this now, and I really, really don't want it getting any bigger. I tried to report the photos on the site, but to have them taken down I must submit a front and back photo of my ID, a photo of me holding the ID up to my face, my email address, my actual house address and my phone number. I really don't want to give out my address or phone number, and I'm not even sure if they will take the photos down even with all this info. Is there anything I can do at all? I'm thinking there is nothing I can do, and I just have to deal with them staying up.

Also just wanted to add, I know a few people will be confused with why I was okay posting them myself years ago, and not okay with them resurfacing now - Simply put, I have changed a lot since then, and I did NOT consent to having these photos posted.

17- Father is relocating me out of state

    Posted: 30 Nov 2019 12:34 PM PST

Hey guys, first post on here and I have a problem I'm lost in. I'm 17 and a senior in high school in Texas. I just found out that my father and step mother here (currently live with) want to force me to move in with my mom who lives in California. I've had issues with my parents but I've never expected for them to go to this extreme. They seem immature in this action to me and seem to only want to not have to handle me anymore. They plan to move in in January and finish my High school in California. I'm fine with moving out at 18 but I don't turn 18 until July and I want to complete my school here. I find it not in my best interest to move away since it's more of best interest to my parents since I've applied to colleges here and have classes here exclusive to my school. I no matter what want to stay here to AT LEAST finish school in May. However they don't want to wait and it's very irrational on their part. My mother in California is on my side for this as she believes I should finish everything here. Is there any way I can not be forced to move back with my mother or at least find a way to live with someone else here in Texas so that I could finish my school in a few months. Any response will be greatly appreciated. Thank you.

Can I take someone to a small claims court to pay for half the vet bills if their dog attacked my dog?

    Posted: 30 Nov 2019 09:21 AM PST

I live in Glendale, Arizona. I own a miniature poodle mix that lives outside in my backyard.

So this happened around the afternoon, I was in my room doing my own thing and suddenly I heard crying noises outside of my room and I rushed outside to see what is going on. My dog was covered in blood everywhere, and was still bleeding. She was alone full of adrenaline with no other dog in sight and I noticed that my backyard gate was half way opened, I was unaware that it was and I assumed the wind pushed it open since it was pretty windy that day. I asked my next door neighbors what the hell happened and they told me the neighbors across from them had a german shepherd attacked my dog on MY PROPERTY and it had no leash. I had a family member come with me to take my dog to the emergency hospital. Fortunately, she survived and was better within a few days. The bill was $2400 unfortunately, and I had to take the money out of my emergency fund to pay it all at once.

I confronted the the neighbors who owned the dog, and I said no hard feelings it was an accident just keep your dog in a leash next time, but you will have to pay me half of what I paid for in vet bills. They reluctantly agree to pay like $250 a month until the $1200 bucks is paid. We agreed verbally and exchanged phone numbers. I really wanted to solve this issue in a civil manner like adults so I trusted them that they will hold their end of the bargain.

More than a month has passed and I recieved no communication with them and I have not been paid, I called the police department and animal control to try report the issue. but they said that there is nothing they can do about since pets are treated as property. And they advice me to settle it with a small claims court.

So now I want to send them court. Do you think I have case against them?

Uploaded some porn to my cloud backup... found questionable content tried to delete it. Seems to be 'locked' don't know what to do.

    Posted: 30 Nov 2019 02:53 AM PST

I just wanted to start by saying I made a stupid mistake and I feel like I will pay for my actions. I don't really know what to do and I am writing this just so I can figure out how to deal with my family/friends/fiance. I feel sick, stupid and dumb and at this point figure I will just have to face consequences.

I have a popular could based drive, and been using it for a bit. I recently thought it might be a cool idea to back up some porn to it so I can have it on the go. I am an adult and at the time didn't think it would be a big deal. I don't really keep porn on my PC anymore and all I had was this old flashdrive i found from college. I used to browse image-boards and just save random pictures. I went on ahead and started uploading the pictures to the drive.

On second review of the files I realized I might have made a super bad mistake. The drive was over 10 years old at this point and I didn't feel comfortable with what I saw. I deleted the pictures and formatted the drive. I saw some had uploaded and just deleted those as well.

I went about my day and before going to bed I reviewed what files I had online. My heart sank, around 5 images could not be deleted and are in the cloud. I can rename them and move them, but I cannot delete them. I think they had been flagged and my account might have been reported.

The major issue I had was some of the girls looked like they are on the edge of 18 or under. I don't really know what to do at this point and I am pretty sure my account has been flagged.

I feel like all is lost right now, and I am just a super dumb guy and made a super dumb mistake. I already reviewed what I could be charged with in my state and it is possible 3-10 years in jail and 10,000 fine.

This is my fault and I should have never had those pictures in the first place, but don't know what I can do to protect myself and my family. Allot of people depend on me and I just feel like I let them all down if I have to go to jail... I know you guys can't fix this situation but if you have any advice I would appreciate it.

    Thanks

TL:DR - I think I uploaded underage content and can't delete it and think that is on purpose. I am basically waiting for the FBI at this point :\.

    Served someone else’s summons?

    Posted: 30 Nov 2019 01:09 PM PST

My mom received a summons for someone and didn't notice the name before she opened it. She tried to return it to USPS but they wouldn't take it back because it was opened (she didn't have her glasses on when she signed for it)

What should she do? Contact the court saying the correct person didn't receive the papers? Just toss them? Obviously it's gonna show them as delivered even though the person who needs them hasn't gotten them. She lives in PA.

My employer has been modifying employee hours in order to avoid paying overtime. Would it be inadvisable for me to make a complete copy of all changes made in the past 3 years? [California]

    Posted: 30 Nov 2019 02:06 PM PST

I work at a restaurant, where the past management team used to frequently add in breaks and modify employee punch times. Employees are broadly aware of this, and have been discussing a lawsuit, which I support. I often work as a supervisor, and as such I have my own account on the computer system. Through the system, I can view a report of all punch edits made to all employees, in addition to a report of all the original in and out times. Would I find myself in legal trouble if I were to export these reports to a flash drive, in order to provide them to a lawyer? Would it be useful?

Paid the neighbor 400 dollars to rebuild a transmission.

    Posted: 30 Nov 2019 08:06 AM PST

R/legaladvice So around the end of July I paid my neighbor to rebuild a transmission for me. I paid him 400 when I dropped the transmission off and he said he would call me when it was done. I live in a rural area and work 25 miles away, so I dont see him often at all. It's now basically December. I haven't received a call, when I stopped last weekend his wife answered the door and said he was fishing. I said okay just have him call me. This morning i drove past their house and a uhaul truck was in the drive way. I continued on to town to run errands but stopped back by on my way home. Nobody home. I will make contact again as they have many objects left and aren't gone yet.

A rebuilt transmission of this style is easily worth 1200.

My question is what can I do legal once i confront him about said money and the transmission that i paid him already to rebuild. Small claims court? I understand i will likely get nothing but it's the principal I'm after. I dont like people ducking me and being taken from.

Bond/jail question, needing advice for recently receiving a subpoena

    Posted: 30 Nov 2019 06:57 AM PST

    Hi everyone,

So, I got a subpoena to become a witness in my friend's manslaughter trial.

She was bailed out (I was very surprised) as she had a lot of charges by the state of Florida. I don't quite know how the legal things go but she had a bond amount for 3 of the charges, but the other ones didn't have any amount listed. My question is: is it possible they can put her back to jail before her trial starts? And does she stay out of jail until her trial is done?

Next, I know this is absolutely dumb to ask but: is it okay to talk to her? I know the subpoena doesn't put any restrictions if we can or cannot communicate with a defendant, but am I better off not speaking to her or what?

I appreciate anyone taking the time to read and address my stupidity lol

One night I got blackout drunk and disappeared for about 6 hours. I woke up with some gnarly bruises around my wrist, and we all deduced I had been handcuffed. Over the night I had lost all of my possessions as well. I'm a minor and a college student. That night I must have received a citation and I guess I lost it along with everything else I had. I woke up assuming nothing had happened, and went on with my life. About a month later I check the mail and there's a warrant for my arrest for missing court when I would have gone had I known I even had a court date. What are my next steps to correct this matter. Maricopa county if that helps

Does a Restraining Order Apply to Online Contact?

    Posted: 30 Nov 2019 11:00 AM PST

    Cleveland, OH

I don't even know where to begin, but long story short: I grew up in an abusive household, moved to a different state on a whim when I turned 18, and for the past several years, both of my parents--and my sisters--have consistently spammed me on multiple social media platforms and via email.

I've tried to maintain somewhat of a civil yet distant relationship with my family, but years later they still insist on taking advantage of that and spamming me with harassing messages. I've blocked them on multiple platforms and specifically told both of my parents not to contact me, but my youngest sister--a minor--has taken up the mantle and begun sending droves of harassing emails. I've marked the emails as spam, but that doesn't prevent them from being sent.

I'm getting extremely frustrated with the situation. One of my friends who had to file a restraining order against an ex-boyfriend who exhibited very similar behavior, brought up the idea to me. But since the harassing behavior is primarily online--and at the moment isolated to my sister, a minor--I don't know if it would solve anything.

    What are my options?

Custody of younger sister following mother’s car accident - OH

    Posted: 30 Nov 2019 11:57 AM PST

My (23F) mom was admitted into the critical care unit after being hit by a car going 100mph down the wrong side of the highway.

We are unsure of the official custody agreement, but my mom was the sole caretaker of my (11F) sister. She sees her father a few times a week, but he also had a traumatic brain injury (great luck, I know) that makes it difficult for him to care for her properly and process complex information.

So far, my mom has a brain injury that we are unsure of how it will affect her life. All we know is that at the very least, she is looking at months of recovery in hospital and rehab facilities.

I guess my question is —- how difficult would it be for me to gain guardianship of my sister, at least temporarily? Even if he has shared custody or no custody? Would there be financial support for her if I had guardianship (I live on a teacher's salary in TN)?

I by no means want to strip away his rights or take away his daughter, he's a good dude. But I know that I would be much better at providing her with emotional support and teaching her how to be a good human. She has expressed that she's nervous to stay with her dad and we have no other willing family members in her area to take care of her.

Anyone have experience similar to this?

My wife opened a Credit Card under my name without my consent. What could happen to her if I declare that was a fraud?

    Posted: 30 Nov 2019 12:46 PM PST

This is probably the most frustrating thing that I've ever deal with in my whole life.

I don't know how she and r/AMEX worked together to open an account without my knowledge. An account that very likely was impossible to open without my Credit Score.

I just found it today, thru a notification from Credit Karma. And I thought it was a meaningless mistake, so I called AMEX, and overthere I was transferred to the Fraud Department. Talking to them I found out, that the other cosigner was my delightful wife(a huge disappointed). While talking to Amex they basically gave me three options:

    1) Cancel the Account, and eventually pay the remaining balance in the card.

    2) Keep the card (?)

    3) Declare it fraud, and eventually they will lift my responsibility, but when I asked what could happen to the perpetrator of the Fraud, the agent didn't give me a clear answer.

To make the things even more complex. I'm the beneficiary of my wife in the petition process (green card). So I don't want to be like super ungrateful for something that I'm eternally grateful, but doing this kind of things is straight wrong.

So what could happen to her if I declare it as fraud?

My dad died and I believe his sister took, everything, even my last visit with him. She gave my two sisters and I $400 each that she said was all that was left in his bank.

    Posted: 30 Nov 2019 10:00 AM PST

My dad packed trucks for UPS for at least 15 years, that I know of. I also know they really loved him there. I know he wished he could've drove for them but he was born deaf. Lately I keep hearing about all their benefits and it really has me doubting my aunt. Also their mother had passed the year before and left money for all of her kids. She even said she had to keep his cause she knew he'd spend it all. Wonder what happened to his portion? When we got to Texas she wouldn't let us go to his apartment cause she said it was so filthy they needed hazmat suits. Hazmat suits!! I told her at my grandma's funeral the year before he died, "Dad won't tell me if he needs help so please tell me! I'll move here and help him". She told me to go home and "not to worry my precious heart". Doesn't sound like she did much caring. She also had a table of random things from his house. He loved fishing and I remember not seeing any poles and had to ask for them. Wonder what else she was hiding. Things that don't matter to her but to us. He was supposed to visit me the year before he passed. He didn't and I know it was because of her cause when I arrived to get my dad's ashes she told me "I'm glad we're family and can forgive each other". I was so confused cause I was in shock of just losing my dad, having to sign for his cremation, that no one warned me about, getting his dog and she says that! I looked at her so confused and crying about my dad, she explained to me, you know about missing that visit. Ugh! It's been two years now and I can't get over she didn't call me and ask for help if she didn't want to do it. He was my dad. We had a lot of unfinished business. I didn't meet him till I was 14 and can count on two hands the visits we had since. We were really healing things. I was mad at him when he died though that he didn't come for that visit. I know it wasn't his fault now and it hurts so bad I was mad at him. I just think maybe he had more than $1200 that was worth way more to her than my dad's health or my last moments with him. Any ideas on how to figure this out and get some peace of mind already would be so very appreciated.

    Neighbors making false reports (FL)

    Posted: 30 Nov 2019 09:51 AM PST

My uncle owns a few acres of land and within the last 3 years a subdivision was built just behind his backyard. Recently one of his neighbors in this new subdivision made a false report claiming he was destroying the wetlands (spoiler, he doesnt own wetlands). We had the county come inspect his land and verified its indeed not wetlands, shocker. But this persistent neighbor has now gotten the state involved and they had their own inspector come out, and even they agreed it wasn't wetlands. Now recently we come to find some of his bamboo chopped down near the fence line facing the subdivision. The state says the person may remain anonymous, is there a way we can find out who's doing this or can we get the HOA of their subdivision involved?

TLDR neighbors are accusing my uncle of destroy wetlands when there are none and hes just farming. We know it's from the subdivision bc their backyards directly face his land.

My therapist claims to have no records of me. He also has no diagnosis of my mental illnesses on record, despite me having them. How should I handle this?

    Posted: 30 Nov 2019 01:01 PM PST

I was in treatment for around eight months. I need my records for my general practitioner and also for a medical marijuana appointment. I have generalized anxiety disorder with adjustment disorder. I also had a clinical depression and social anxiety disorder. I was in therapy when I was 16 turning 17. I'm now 18 and out of therapy. When I call him to ask for my records, he said he had none. And he said even if he did he would not send them to me. I said I needed them but he said once again that he did not have any. I asked him what my diagnosis was, since he never told me during therapy. He then told me that I had clinical depression, anxiety with adjustment disorder, and social anxiety disorder but that he never actually put it on my record or officially diagnosed me with these. Is this medical malpractice? I really am at a loss of what to do right now. I can go to my GP and get re-diagnosed, but this is very upsetting and I don't know what to do. Thank you
