Received ADA lawsuit. I'm not in the USA. What do I do?

    Posted: 11 Oct 2019 07:34 AM PDT

    Throwaway for obvious reasons.

I'm a solo founder that runs a medium sized blog (250k/monthly visits). It brings in about 10k/month in revenue.

Today I received a certified letter (the mailman asked me to sign the receipt form) with a notice that my LLC is being sued for not complying with the ADA, as apparently my site is not blind friendly!?

What do I do here? I don't have insurance for this. Lawyers are expensive. Advice please!

Trying to reach out to people.

    Posted: 12 Oct 2019 04:20 AM PDT

Hey, I know that this post is kind of self promotional and all, but I am a graphic designer, and I am relatively new to this scene, I guess that I am trying yo find some new people to work with using this post, because while freelancing, to be honest it is pretty frustrating trying to battle all of the fiverr and upwork spam bots who all work for 5 bucks. If I still have your attention, I would be happy if you reached out to me with your graphic design needs and gave the new kid on the block a chance. :) Upvotes would be largely appreciated. :))

Is it important to be on Google and Facebook?

    Posted: 11 Oct 2019 06:50 PM PDT

I have a business that serves a very specific clientele, and as I am just one person, I have very little resources as far as time and budget. However, I have been bombarded with people in my life (from all walks) lately telling me that I need to set up a Google My Business account and a Facebook page. I am busy as it is, booked out for 6 weeks, and I only take on projects that I really want to do so I don't feel like its necessary but it's almost like I can't escape the topic, it's always coming up. What are the pros and cons of having these sites?

Your DBA is not your business entity, people

    Posted: 11 Oct 2019 10:14 AM PDT

I work with a lot of small businesses and one of the more frustrating things is the confusion on what your business entity actually is.

"Oh, I don't have a LLC, it's just set up as a DBA"

Your DBA is the name you operate your business entity as. Your LLC is the actual business entity. You may want to open up a lemonade stand called Squeeze 'Ems. If you are a sole proprietorship, your entity is you as a person. If you are a LLC, you may have a name like Lemon Beverages, LLC. You can operate several DBA's under the same entity, but for tax purposes, each DBA is NOT its own business. Your LLC is the business that gets taxed.

Which is the better approach to starting a website?

    Posted: 11 Oct 2019 09:12 PM PDT

I'm trying to get my foot in the door for freelance writing/authorship, and I realized that pretty much all professional writers have their own website, so I'm trying to set one up for myself right now.

I have a question about it though. I can either pay for hosting right away (roughly $100 a year in total) and have my own domain/url right from the get go, or, I can start by using a free host such as WordPress and use their domain until I gain some traction, at which point I would move my website from WordPress to my own domain (changing it from example.wordpress.com to just example.com)

Each one has its perks and downsides. Which would be the wiser approach as far as getting my personal brand as a writer to stick?

Help me chose a cover photo for a promo style leaflet

Hey all! I'm just getting started so I'm not sure the correct terminology, I'm in the process of creating a leaflet that is sent out to costumers along with their order, to share a bit about our family business, thank them for their business, and perhaps include a promo code. Please let me know if I can pm photos and let me know which are your favorite. Thank you!

How to organize and make available standard processes and procedures

    Posted: 11 Oct 2019 01:37 PM PDT

Documentation and standardization in important. I am working hard on that now as we're starting to grow quickly. I have been trying to document all the important processes that the founders are doing so there is first a standard to which an improvement can be compared, and second the tasks can be handed off to others.

Right now we have a shared file on our server that everyone can access. We're putting the documents there once they are released, but the numbers are starting to get up there and it's not easy for new members to surface the information they are looking for (or even know if it might be in there). I have been careful to try and use descriptive names, but others have not, and even what makes sense to me does not to some others.

How do you organize your policies, procedures, etc., so team members can find them and utilize them without having someone with the tribal knowledge go find it and show them?

First time small business startup questions.

    Posted: 11 Oct 2019 02:20 PM PDT

    Hi All,

I'm getting ready to start up my first business and I'm running into some kind of confusing bumps in the road that have me stuck in a bit of a roundabout. I am an acupuncturist who is getting ready to start up a private practice for the first time. I have experience in running/managing coffee shops in the past, but getting something up and running initially has been somewhat confusing for me.

I am looking at renting offices in my area, but want to make sure to have a business bank account ready to go to make accounting a bit easier. In order to get a business bank account, however, I've discovered that I have to have my business entity ready to go with an EIN number. I'm applying for a PLLC business structure, but they want my business address for filing. I don't have a place rented yet, so should I just put my home address, then change it later once I have a spot rented?

I'm not sure if I'm just over-thinking/over-complicating things since this is a big step for me, or if it really is this convoluted.

    Thanks for your help!

better results immediately or expensive but much better results later on?

    Posted: 11 Oct 2019 12:57 PM PDT

How do you personally decide when to get immediate results or spend a lot of money on a task that will only have a big impact later on? Something like spending 200k for machinery and needing to train and get the expertise compared to instant result in outsourcing?

How does the planning process look like to decide if it is time to move manufacturing in-house to gain custom expertise, or that its time to spend 50k on marketing campaigns to increase branding that will have low impact now but be beneficial later.

Anyone know of a way to add package tracking to Google calendars?

    Posted: 11 Oct 2019 08:55 AM PDT

I get a lot of packages. I have the different package notifications setup with messaging for Fedex and UPS only thing is that it gives not enough detailed info in the SMS Message. They also update the info so it comes in date time order and no way to order by tracking number. So it is confusing. You have to click on the tracking number and figure out which package it is. So at least for the Big three in the US. USPS, \

Anyone find a way to have packages show up on their Calendar? I am Android so Google but if you have Apple or Outlook share for others. My UPS has a calendar but it is self contained.

Just curious how some small businesses are keeping track of packages. Plus I work out of My house and a Commercial location, commercial location is complicated to explain. I get most things at the home location. . Fedex will not let me add that location to Manage MY Deliveries.

Wondering if someone has found an easy way to consolidate and get better tracking info. I know there are a few programs out there but I know a lot are ad based and I don't want that.

Figured I would ask here first as I do some of my own research.

What are your 3 biggest struggles with marketing your business?

    Posted: 11 Oct 2019 12:36 PM PDT

Hey everyone, I would love to hear from some business owners on this one. This question is ONLY for research purposes, I'm not interested in selling to you. I would like to know your 3 biggest pain points when it comes to marketing and growing your business. I'm asking this for reference so I can cover all of the bases with my services. As most of you know, the foundation of marketing your business is understanding what the customer wants, and that's exactly what I'd like some insight on. Thanks in advance!

    Starting a sub-contacting crew

    Posted: 11 Oct 2019 12:35 PM PDT

I've been working as a subcontractor for about two years now (carpet and ada lights). I moved from skilled fabrication and before that I worked in fire and water restoration. I have fair bit of experience in building and repair. So I've started looking into taking jobs on more directly. I won't be biitting cause I don't have the capital to cover materials. I would be contracted several layers down. I have most of the tools I need, a llc, general liability, workers comp, and I'm looking and buying a used truck and trailer with my ok-ish credit. I feel like I'm about to set off on some grant adventure. I've never attempted anything like this before. But I feel like I've missed something. Maybe taxes? I'm technically already self employed so that should change much. I can't shake this dreadful feeling that I've over looked something. Any ideas one what I should double check?

Advice for a food truck based-business

    Posted: 11 Oct 2019 12:18 PM PDT

TL;DR at the bottom of this post

Right now I'm in the process of creating a pro forma analysis of estimated costs for a business in a food truck type setting. As far as static COGS, pricing points, and equipment costs in a two-year revenue & cost estimation, I'm fairly confident in the research and calculations I've done specific to this future business. I've also done some work in estimating some operating expenses like credit card costs, POS system costs, insurance expenses, tax expense, etc. However, there are a few things I'm having difficulties estimating—such as:

    1. gas to run a generator for electricity
    2. costs of water & handing the waste that comes from it
    3. salary and wages expense (should I even employ anyone in the beginning, or just run it myself?)
    4. other miscellaneous expenses that I might not have considered.

Also, my conservative yet average estimate of customers per day has little basis in actual numbers—just a guesstimate of ~120 transactions for a 4-hour event (one transaction per every two minutes). I tried to interview a food truck that I know of in town, but the person working was just an employee and seemed to know very little about the subject (or maybe felt threatened that I might try to poach their business, so they stonewalled me...who knows).

If anyone has any advice or experience with either owning or working in a food truck just to give me a proper frame of reference and realistic expectations, that would be super helpful!

TL;DR- I tried to interview a food truck about their business so I could use it as a basis for my own cost estimations, but it didn't turn out. Anyone who has advice or experience in this field, I am open to your suggestions or questions!

    Best single phone line solution?

    Posted: 11 Oct 2019 09:37 AM PDT

I tried Google voice and it didn't really work well for me. I'm a sole prop and just need a single line with voicemail. Not a landline as I travel a lot. Mostly will be used to schedule appointments.

Edit: most cellular plans are expensive

For those who have filed a provisional patent in the US, did you hire a lawyer? Why or why not?

    Posted: 11 Oct 2019 09:36 AM PDT

I'm ready to put together a provisional patent for a product I'm working on. I spoke with a patent lawyer, who says it will cost me around $500 for him to write up the application, including filing fees. If I do it myself, I'll just pay the $70 filing fee.

I know the point of the provisional patent is that anyone can file it to simply and inexpensively protect their idea, but I want to make sure that it's done right.

For those of you who have been through this process, which way did you go? Would you do it the same way again?

When to decorate for Christmas / Holidays?

    Posted: 11 Oct 2019 08:23 AM PDT

I've read about Christmas Creep. Despite what consumers might say about it getting earlier and earlier, I wonder if retailers are onto something if it increases sales.

We are in the restaurant business and trying to figure out when to decorate for Thanksgiving and Christmas.

I'm thinking that fall decorations should be out already, probably September. And Christmas decorations should be up in early November.

Does anyone else here follow a schedule?

How do I settle a dispute with an Alibaba seller?

    Posted: 11 Oct 2019 08:22 AM PDT

    • I purchased custom fashion eyewear from Alibaba.

    • I received a set of samples back in November 2018.

    • Bulk production began in 2019 and I received the shipment this week.

    • There is an obvious difference in quality in the spring hinges between the bulk batch and the sample set (bulk batch is worse).

    • I haven't confirmed/accepted the shipment on Alibaba yet. I already remarked on the quality of the hinges to the factory. They responded by saying "there is no difference between the sample set and bulk batch".

    • Arguing any further with them may be a waste of time. I'd like to just begin a dispute with Alibaba. I've never disputed an order on Alibaba before...

    • Before I begin, I'd like to know what to expect because I'm worried that Alibaba may not side with me. Has anyone gone thru the process of disputing a shipment before? Did you receive a favorable resolution, discount from the vendor/Alibaba? What was the issue to begin with?

    • I want to start getting my ducks in a row now... I'm not sure what kind of documentation proof Alibaba will ask for. I suppose I can take detailed photos of the hinges, although, the difference in quality isn't exactly visible.

    • Though I don't want to waste anymore time talking to the vendor, I think I do have the option of negotiating a discount directly with the vendor... However, I'm not the best at negotiating and I want to make sure that I make strong, convincing argument while being respectful and without threatening a dispute...

    • I haven't a clue on the correct avenue to take...

Any feedback would be greatly appreciated. Thanks in advance, everyone!
